In The Birthright Lottery, Ayelet Shachar subjects the institution of birthright citizenship to close scrutiny by applying to citizenship the historical and philosophical critique of hereditary ownership built up over four centuries of liberal and democratic theory, and proposing compelling alternatives drawn from the theory of private law to the usual modes of conveyance of membership. Nonetheless, there are some difficulties with this critique. First, the analogy between entailed property and birthright citizenship is not as illustrative as Shachar intends it (...) to be; second, the mechanism of the birthright privilege levy is insufficient for addressing structural impediments to growth; and third, the principle of ius nexi, while an important corrective to currently dominant principles of nationality, will likely have effects both unnecessary and insufficient to correct the injustices that Shachar identifies. In the end, the most significant improvements in the lives of the neediest persons on the planet are more likely advanced through conventional arguments for the lowering of barriers to the circulation of goods, labor, and capital. English translates ‘genos’ as kind and ‘eidos’ as form, which differ in meaning as much as ‘herd’ and ‘brand’ do. But there are hard passages where ‘genos’ and ‘eidos’ have appeared to be synonyms, usually given the new meaning class. We show that, although ‘genos’ and ‘eidos’ are never synonyms and continue to mean kind and form, the word ‘eidos’ can be used figuratively, as a metonym, for a genos.

O presente trabalho visa expor, utilizando dupla perspectiva, as tecnociências e suas inovações como resultantes do modo de produção capitalista e no que isso implica. Num primeiro momento, será apresentada a perspectiva utilizada por Deuleuze e Guattari em Mil Platôs para denotar a importância do Estado como garantidor de um modo de produção e como agenciador, via ordem jurídica, das linhas de fuga que emergem da sociedade, inclusive no que toca às inovações trazidas pelo desenvolvimento e ampliação dos conhecimentos e (...) dos saberes. Na sequência, de forma complementar, serão abordados o capitalismo em si e alguns de seus fundamentos relevantes para a compreensão das consequências possíveis para as inovações tecnocientíficas, isso a partir de postulados da teoria materialista-histórica. Current legal theory is concerned with the presence of principles in law partly because they are at the core of Dworkin's criticisms of Hart's rule of recognition. Hart's theory is threatened by the possibility that the identification of some principles follows an extremely relaxed rule of recognition, or even no rule at all. Unfortunately, there is no conclusive test to ascertain what is the case in actual practice. On the other hand, the evaluative arguments which support Dworkin's proposal of principled (...) adjudication are forceful but not conclusive. A dilemma has stymied interpretations of the Stranger’s method of dividing kinds into subkinds in Plato’sSophistandStatesman. The dilemma assumes that the kinds are either extensions or intensions. Now kinds divide like extensions, not intensions. But extensions cannot explain the distinct identities of kinds that possess the very same members. We propose understanding a kind as like an animal body—the Stranger’s simile for division—possessing both an extension and an intension. This chapter focuses on one of the common fallacies in Western philosophy: hasty generalization (HG). HG is committed when some aspect of the definition of the proper generalization is violated. In other words, the “hasty” aspect of this fallacy is triggered either when there is a lack of knowledge of the selected sample or when the selected sample is not representative of the whole group, or when both and are true. We see HG committed just about every day in politics (...) and the media. In politics, HGs are used to emphasize the extremes of a particular viewpoint. Concurrently, HG is used quite often by advertisers to promote a particular product. To avoid committing this fallacy, the arguer should take into consideration the amount of justifiable knowledge one might have on a particular subject and whether the selected sample being used in the case is justifiably representative of the group in question. Beauty, as it has been traditionally defined, is an ultimate value, an ideal on same level as truth and goodness. Many of the ancient Greeks believed that symmetry represented order, and order was beautiful because it revealed a type of cosmic justice and truth that no person could deny. So, when Steinman's application of beauty comes into play, he is definitely emphasizing the order and justice that beauty (...) provides. The player of BioShock is introduced to a world quite familiar to ours, not necessarily in sense of Rapture, underwater cities, or vintage décor, but rather in the form of worldview. The vending machines are not coincidentally called Circus of Values. In the article, we carry out a theoretical reflection on the contributions of Paulo Freire's pedagogy. Given the diversity of themes that Freire covers, we make a first approach to his pedagogical-political thought and for this we do it through a brief biographical journey through the main life stages of the author. The great Brazilian educator was a person who had a special concern for the other, for denouncing injustices and for showing us that human beings have in our hands (...) the possibilities of change and transformation. In order to address all these questions, according to Freire, it is necessary to do so from a critical reading of the world in which we live. To delve deeper and understand essential aspects of his life and also of his work, we do so with people close to the author who have had the opportunity to live and work with him and know, in depth, his pedagogical legacy. As a result of this journey through his pedagogical work, we offer some reflections that invite us to look at the validity and timeliness of his approaches. Freire's pedagogy proposes a critical reading of the world that does not generate hopelessness, but rather allows us to see the resistance, the ways to get ahead, the construction of the new, the permanent possibilities that human beings have to rebuild our lives. Freire spoke of hope as an inherent issue in teaching practice, remembering, at the same time, that change, although difficult, is possible. (shrink)

La enseñanza aprendizaje de la historia ha enfrentado muchos retos, en todos los niveles educativos, que van desde la educación primaria y sin generalizar se puede decir que se extiende hasta la educación universitaria. Ello implica que cada vez sea más necesario que los docentes conozcan los avances sobre la didáctica de la historia así como la disciplina escolar. Las estrategias que el docente trabaje con los estudiantes deben encaminarse al desarrollo del pensamiento histórico, al uso de fuentes y a (...) la investigación. La propuesta que aquí se presenta tiene el propósito de que los estudiantes de primaria trabajen con versiones diferentes sobre un hecho histórico al tiempo que ejerciten su comprensión lectora. The confinement of the population into their homes as a result of COVID-19 has entailed a notable increase in the consumption of diverse media. This exploratory study aimed to examine how the increase in media consumption was related to subjective happiness and psychological well-being. For this purpose, a questionnaire was administered to a sample of Spanish adults to assess their consumption of different media before and during confinement. Moreover, participants were evaluated for hedonic, eudaimonic, social, and experienced happiness by using (...) the Pemberton Happiness Index. The results underlined the great increase in the consumption of TV for entertainment and social networking sites during confinement. Furthermore, it was found that higher consumption was negatively correlated with the level of happiness, so that, people who reported greater well-being, both subjective and psychological, spent less time watching TV and using SNS. In contrast, no association was found between the level of happiness and the consumption of news and radio. Therefore, it seems that far from cultivating greater happiness, those who engaged in heavy consumption of TV entertainment and SNS during confinement were less happy than those who did so more moderately and spent more time using other media or performing other activities. This study focuses on a news framing analysis of Latin America and Latin Americans in the Spanish press. For this purpose 1,271 news articles with different Latin American countries or their citizens as main actors were examined. These news stories had been published by the main Spanish newspapers in 1999. The results reveal that attribution of responsibility, human interest, and conflict constitute the prevailing frames used by the Spanish press. Furthermore, significant differences in the considered variables in terms of main (...) country actor were observed. Venezuela and Colombia, in particular, are associated with armed conflicts, natural disasters, crimes, and accidents using human interest and conflict news frames. This leads to a necessary consideration of the consequences this type of news coverage on Latin America may generate, and whether it will reinforce stereotypes or prejudices in the Spanish audience against peoples from these countries, especially those with a high migratory influx to Spain. No Íon, a autoridade e a sabedoria de poetas e rapsodos são confrontadas por meios indiretos. O caráter oblíquo dessa estratégia impede o acesso direto ao conteúdo do diálogo e provoca inúmeros equívocos de leitura. Um fato contextual estimula mais ainda leituras equivocadas. A poesia tratada no Íon difere muito da forma como nós, modernos, a entendemos. Na Antiguidade grega, de base aural, a poesia era o modo privilegiado de conservação da tradição herdada, e permaneceu exercendo essa função capital até (...) mesmo quando a escrita passou a desempenhar papel relevante na forma de composição e transmissão cultural. Neste contexto, o rapsodo representa uma autoridade que cobre praticamente todos os campos do saber. Autoridade enciclopédica, contra a qual Platão travou uma guerra não sem ambiguidades. O presente artigo busca revelar a motivação profunda que anima o Íon: a contraposição entre dois modos de comunicação, o da poesia e o da filosofia. Defende, ainda, que Platão, ao atacar a performance poética, busca, além de rejeitá-la, substituí-la pelo élenkhos socrático como modo de comunicação ideal para instrução e guia da vida humana. Resumo A conservação da biodiversidade tornou-se um compromisso inquestionável diante do seu papel inexorável para a manutenção da vida na Terra. Apesar do consensual compromisso em sustentá-la, as razões pelas quais fazê-lo ainda são alvo de discussões e controvérsias. Que valores devem reger sua proteção? Contudo, a conservação da biodiversidade está cada vez mais voltada para um lado objetivo-econômico, na qual a natureza é marginal aos interesses que parecem mais evidentes: a eficiência econômica. Esse artigo faz uma reflexão sobre os (...) esquemas de biodiversity offsets, instrumentos cujo objetivo é a compensação pelos danos à biodiversidade provocados pelas atividades de desenvolvimento; e sobre a mudança nos valores da conservação da biodiversidade que tais instrumentos tendem a provocar. Uma mudança discursiva, institucional, técnica e material que altera o sentido de se fazer conservação e a relação humana com o mundo natural. Essa ‘nova’ perspectiva da conservação revela dilemas éticos fundamentais, e vem se tornando uma estratégia cada vez mais difundida no âmbito das políticas ambientais para a conservação. (shrink)

Monitoring health is one of the basic principles of Occupational Health and Safety. The main objective of this monitoring will be the detection of possible damage to health arising from work. They try to discover the effects that the inherent risks with the work may cause the worker, which will show, given the case, through an alteration of health or the state of organic and functional state, both physically and mentally. Regarding the monitoring of health, there are many and varied (...) issues to be raised concerning the right to personal privacy. Thus, notably, whether there was effective consensus, and whether, in particular, the object and the purpose of the medical examination meant a disregard of the statutory scheme, an excess or even a failure to comply with the terms of the Spanish Constitution. The limits imposed by the law makers to the productive unit will play a key role in identifying the content of the company obligation to monitor health, being in many cases guarantees of constitutional rights. Therefore, the methods of health monitoring and control of workers will always be carried out respecting the privacy and dignity of the worker as well as the confidentiality of all information related to their health. A common approach for measuring the effectiveness of an education system or a school is the estimation of the impact that school interventions have on students’ academic performance. However, the latest trends aim to extend the focus beyond students’ acquisition of knowledge and skills, and to consider aspects such as well-being in the academic context. For this reason, the 2015 edition of the international assessment system PISA incorporated a new tool aimed at evaluating the socio-affective variables related to the well-being (...) of students. It is based on a definition focused on the five dimensions proposed in PISA theoretical framework: cognitive, psychological, social, physical and material. The main purpose of this study is to identify the well-being components that significantly affect student academic performance and to estimate the magnitude of school effects on the well-being of students in OECD countries, the school effect being understood as the ability of schools to increase subjective student well-being. To achieve this goal, we analyzed the responses of 234,000 students from thirty-five OECD countries to PISA 2015 questionnaires. Specifically, we considered non-cognitive variables in the questionnaires and student performance in science. The results indicated that the cognitive well-being dimension, composed of enjoyment of science, self-efficacy and instrumental motivation, as well as the test anxiety all had a consistent relationship with student performance across countries. In addition, the school effect, estimated through a two-level hierarchical linear model, in terms of student well-being was systematically low. While the school effect accounted for approximately 25% of the variance in the results for the cognitive dimension, only 5-9% of variance in well-being indicators was attributable to it. This suggests that the influence of school on student welfare is weak, and the effect is similar across countries. The present study contributes to the general discussion currently underway about the definition of well-being and the connection between well-being and achievement. The results highlighted two complementary concerns: there is a clear need to promote socio-emotional education in schools, and it is important to develop a rigorous framework for well-being assessment. En este artículo llevamos a cabo una extensa revisión de la literatura científica en lo relativo a los vínculos entre materialismo y felicidad, desde un enfoque multidisciplinar que incluye la psicología, la comunicación, la economía y la ética. La línea dominante en la bibliografía insiste en vincular un mayor materialismo con una menor auto-percepción de felicidad y de bienestar, y con una mayor propensión a la depresión. En esta revisión atendemos a los aspectos que así lo evidencian, al rumbo actual (...) de las investigaciones y a los retos aún pendientes de clarificación por parte de la comunidad investigadora. Bajo el concepto común de gamificación existe un complejo mundo dentro del cual existen distintas opciones, cada una con su denominación, que para quien se adentra por primera vez en él pueden generar confusión. Cada una de ellas goza de características, funciones y elementos metodológicos propios. ¿Gamificación? ¿Juegos serios? ¿Aprendizaje Basado en Juegos? Ante esta amalgama de posibilidades, las siguientes líneas se presentan a modo de hoja de ruta que ayude a transitar por la senda del juego educativo, para lo (...) que, a su vez, se acompaña esta fundamentación teórica con un ejemplo didáctico de ABJ -editado como juego de mesa bajo la denominación “Catedral 1221”- concebido y diseñado con la finalidad de promover y facilitar el estudio de la Edad Media en la Educación Secundaria Obligatoria. Su aplicación con éxito en las aulas permite aportar orientaciones didácticas al respecto y extraer conclusiones relativas a la conveniencia y validez académica del juego en el marco de la enseñanza reglada.
