Broken rules, ruined lives. Een verkenning van de normativiteit van de onrechtservaring Hoewel de rechtspositie van slachtoffers de afgelopen decennia verstevigd lijkt, blijft de relatie tussen slachtoffer en strafrecht ongemakkelijk. Rechtswetenschappers tonen zich bezorgd dat de toenemende aandacht voor de belangen van slachtoffers uitmondt in ‘geïnstitutionaliseerde wreedheid.’ Deze zorg wordt echter gevoed door een verkeerd begrip van slachtofferschap en heeft slecht begrepen wat het slachtoffer nu eigenlijk van het recht verlangt. Deze bijdrage probeert de vraag van het slachtoffer aan het (...) recht tot begrip te brengen. Wij zullen de onrechtservaring van het slachtoffer conceptualiseren als een ontologisch alleen en verlaten zijn van het slachtoffer. Het aanknopingspunt om de relatie tussen slachtoffer en recht opnieuw te denken zoeken wij in deze verlatenheid. De kern van het betoog is dat het slachtoffer (mede) in het recht beschutting zoekt tegen deze verlatenheid, maar ook altijd onvermijdelijk tegen de grenzen van het recht aanloopt. Van een rechtssysteem dat zich volledig uitlevert aan de noden van slachtoffers kan dan ook geen sprake zijn. Integendeel, het recht moet zijn belang voor slachtoffers deels zien in de onderkenning van zijn eigen beperkingen om onrecht te keren, in plaats van de onrechtservaring van het slachtoffer weg te moffelen, te koloniseren of ridiculiseren. This article explains how social norms can help to distinguish and understand a range of different kinds of social inequality and social hierarchy. My aim is to show how the literature on social norms can provide crucial resources to relational egalitarianism, which has made social equality and inequality into a central topic of contemporary normative political theorizing. The hope is that a more discriminating and detailed picture of different kinds of social inequality will help relational egalitarians move beyond a discussion (...) of the justice or injustice of social equality as a single general category. The free energy principle is sometimes put forward as accounting for biological self-organization and cognition. It states that for a system to maintain non-equilibrium steady-state with its environment it can be described as minimising its free energy. It is said to be entirely scale-free, applying to anything from particles to organisms, and interactive machines, spanning from the abiotic to the biotic. Because the FEP is so general in its application, one might wonder whether this framework can capture anything specific to (...) biology. We take steps to correct for this here. We first explicate the worry, taking pebbles as examples of an abiotic system, and then discuss to what extent the FEP can distinguish its dynamics from an organism’s. We articulate the notion of ‘autonomy as precarious operational closure’ from the enactive literature, and investigate how it can be unpacked within the FEP. This enables the FEP to delineate between the abiotic and the biotic; avoiding the pebble worry that keeps it out of touch with the living systems we encounter in the world. (shrink)

Bohr’s work in quantum mechanics posed a challenge to philosophers of science, who struggled with the question of whether and to what degree his theories and methods could be considered rational. This paper focuses on Popper, Feyerabend, Lakatos and Kuhn, all of whom recognized some irrational, dogmatic, paradoxical or even inconsistent features in Bohr’s work. Popper, Feyerabend, and Lakatos expressed strong criticism of Bohr’s approach to quantum physics, while Kuhn argued that such criticism was unlikely to be fruitful: progress in (...) science is generally not made through philosophical reflection. Feyerabend’s criticism of Bohr gradually weakened, as he gained a more detailed understanding of the development of Bohr’s views on quantum mechanics, and this went together with an increasingly critical view of normative philosophy of science and was instrumental to his conversion to ‘anarchism’. This paper aims to show that quantum mechanics played a central role in their debates and disagreements on the rationality of science and the possibility of a normative philosophy of science. Classical epistemic logic describes implicit knowledge of agents about facts and knowledge of other agents, based on semantic information. The latter is produced by acts of observation or communication, that are described well by dynamic epistemic logics. What these logics do not describe, however, is how significant information is also produced by acts of inference – and key axioms of the system merely postulate “deductive closure”. In this paper, we take the view that all information is produced by acts, and (...) hence we also need a dynamic logic of inference steps showing what effort on the part of the agent makes a conclusion explicit knowledge. Strong omniscience properties of agents should be seen not as static idealizations, but as the result of dynamic processes that agents engage in. This raises two questions: (a) how to define suitable information states of agents and matching notions of explicit knowledge, (b) how to define natural processes over these states that generate new explicit knowledge. To this end, we extend earlier epistemic “awareness models” into a dynamic system that includes acts of public observation, but also adding and dropping formulas from the currently ‘entertained’ set, we give a completeness theorem, and we show how this dynamics updates explicit knowledge. Similar ideas have been proposed before, but they were restricted to update with factual propositions; our new dynamic system applies to arbitrary formulas. We also extend our approach to multi-agent scenarios where awareness changes may happen privately. Finally, we mention further directions and related approaches. (shrink)

The guiding premise of this chapter is that we, as teachers in higher education, must consider how the content and form of our teaching can foster inclusivity through a responsiveness to neurodiverse learning styles. A narrow pedagogical focus on lectures, textual engagement, and essay-writing threatens to exclude neurodivergent students whose ways of learning and making sense of the world may not be best supported through these traditional forms of pedagogy. As we discuss in this chapter, we, as engineering ethics educators, (...) designed and implemented a new engineering ethics exercise with which we aimed to promote inclusivity at the levels of form and content. At the content level, students were invited to critically engage with inclusivity-undermining ableist assumptions in technology development. This took shape, at the formal level, through a hands-on ‘material tinkering’ workshop in which students collaboratively and creatively altered (or ‘hacked’) artifacts used in contexts of disability and healthcare, so as to operationalize values of inclusivity and accessibility. Our hunch was that this hands-on tinkering workshop would simultaneously encourage a meaningful way of engagement with these ethical issues and values, while also enacting a more inclusive learning environment by enriching the range of pedagogical activities and learning formats available to our students. As we aim to show in this chapter, we believe this hunch largely panned out - though there are clear areas for future improvement pertaining to the pilot exercise itself and the research we conducted on the exercise. We begin by offering a description of our tinkering exercise. We discuss the exercise’s source of inspiration (2.1) and its implementation (2.2), which is visually captured via photographic documentation. We then discuss (3) how we utilized a triangulated research method to assess the pedagogical value of the exercise. After we discuss our findings, we conclude by identifying areas for future improvement (4). (shrink)

Contrastivism is the claim that the knowledge relation is ternary, it relates three relata: a subject, a proposition, and a class of contrastive propositions. The present paper is a discussion of Jonathan Schaffer’s arguments in favour of contrastivism. The case is made that these are unconvincing: the traditional binary account of knowledge can handle the phenomena that ternarity is claimed to handle in a superior way.

The authors explore whether the need for ethical reflection on the part of designing engineers is dependent on the type of design process. They use Vincenti's distinction between normal and radical design and different levels of design hierarchy. These two dimensions are coupled with the concept of ill-structured problems, which are problems in which possible solutions cannot be ordered on a scale from better to worse. Design problems are better structured at lower hierarchical levels and in cases of normal design. (...) Better structured design problems require less ethical reflection on the part of designing engineers if such situations are characterized by the existence of generally accepted normative frameworks. Engineers could then deal with moral problems within the bounds of such frameworks and without the need for further reflection. On the basis of a number of empirical cases, the authors explore whether these ideas hold water. They discuss four cases ranging from a high-level radical design process to a low-level normal design process. (shrink)

This paper offers a review of the argumentation-theoretical literature on metaphor in argumentative discourse. Two methodologies are combined: the pragma-dialectical theory is used to study the argumentative functions attributed to metaphor, and distinctions made in metaphor theory and the three-dimensional model of metaphor are used to compare the conceptions of metaphor taken as starting point in the reviewed literature. An overview is provided of all types of metaphors distinguished and their possible argumentative functions. The study reveals that not all possible (...) argumentative functions of metaphor have been taken into account, such as the role of conventional direct metaphors in standpoint and starting point. Novel direct metaphor as part of an analogy argument has received most attention, while indirect metaphor can constitute argumentative moves as well, such as the introduction of a standpoint, starting point or connection premise. The overview also shows that certain combinations of variables seem to be impossible of unlikely to occur. These results have a bearing on the analysis of metaphors in argumentative discourse and show the omission in current studies of metaphor. Being aware of these dimensions of metaphor ánd of its potential in argumentation would enrich argumentation studies and metaphor studies alike. (shrink)

The impeachment of Brazilian President Dilma Rousseff in 2016 was the result of a coup of the economically dominant conservative oligarchy against the leftist Partido dos Trabalhadores, in power since 2003. The right wing Brazilian media played a crucial role in this coup by manipulating public opinion as well as the politicians who voted against Dilma. In particular, the media of the powerful Globo Corporation, such as O Globo newspaper, and especially Globo’s Jornal Nacional, the pervasive TV news program, systematically (...) demonized and delegitimized Dilma, as well as ex-President Lula and the PT, in their news reports and editorials by selectively associating them with pervasive corruption and attributing the serious economic recession to them. After a summary of this sociopolitical context, and a brief theoretical definition of manipulation, this article examines some of the manipulative strategies of O Globo’s editorials during March and April 2016. Objectives: To analyse and compare the surveys on German doctors and judges on end of life decision making regarding their attitudes on the advance directive and on the dying process.Design: The respondents were to indicate their agreement or disagreement to eight statements on the advance directive and to specify their personal view on the beginning of the dying process.Participants: 727 doctors in three federal states and 469 judges dealing with guardianship matters all over Germany.Main measurements: Comparisons of means, analyses of (...) variance, pivot tables and factor analyses .Results: Three attitude groups on advance directive were disclosed by the analysis: the decision model, which emphasises the binding character of a situational advance directive; the deliberation model, which puts more emphasis on the communicative aspect; and the delegation model, which regards the advance directive as a legal instrument. The answers regarding the beginning of the dying process were broadly distributed, but no marked difference was observed between the responding professions. The dying process was assumed by most participants to begin with a life expectancy of only a few days.Conclusions: A high degree of valuation for advance directive was seen in both German doctors and judges; most agreed to the binding character of the situational directive. Regarding the different individual concepts of the dying process, a cross-professional discourse on the contents of this term seems to be overdue. (shrink)

In his text ‘The modern development of the foundations of mathematics in the light of philosophy’ from around 1961, Gödel announces a turn to Husserl's phenomenology to find the foundations of mathematics. In Gödel's archive there are two draft letters that shed some further light on the exact strategy that he formulated for himself in the early 1960s. Transcriptions of these letters are presented, together with some comments.

Criticizing Gallagher’s view on direct perception, I develop a basic model of social perception. According to the Cartesians another person’s intentions are not directly accessible to an observer. According to the cognitivist Cartesians conscious processes are necessary for social understanding. According to the Anti-Cartesians social perception is direct. Since both of these latter approaches face serious problems, I will argue in favor of an alternative: anti-cognitivist Cartesianism. Distinguishing between an active- and a passive part of the perceptual system we can (...) describe the situation as follows: Some functionally individuated parts of our nervous system generate percepts that correspond to the properties that causally trigger the system, whilst others form percepts of properties that do not causally trigger the system. The model is basic in that it merely helps clarifying some of the fundamental concepts we need in order to describe empirical findings. (shrink)

In 2003, Peratt demonstrated that rock art images worldwide bear a remarkable similarity to high-energy plasma discharge formations. In later papers, Peratt located the plasma discharge column in which all of these would have occurred at the Earth’s South Pole. This article accepts the relation between the rock art images and the plasma formations, but concludes that the geometry of the reconstruction is incompatible with the global occurrence of the rock art images. As a corollary, the finer details of the (...) reconstructed column must also be called into question. In particular, the reconstruction of the top cusp, the two upper plasmoids, and the filamentary sheath in a single column at the South Pole cannot be reliably deduced from the data as presented by Peratt. All evidence points to a worldwide distribution of the phenomena. (shrink)

Rationalism offers an account of moral properties as a subset of the properties which serve to rationalize right actions, and these properties are fit to be the referents of our moral terms. That fitness can be exploited in constructing an externalist theory of reference determination for these terms. The resulting externalist theory draws support from standard responses to Moral Twin-Earth scenarios. The relevance of these responses to moral semantics has recently beenvigorously challenged by Dowell and by Schroeter and Schroeter. The (...) social character of meaning relations, which can explain the openness of questions about an analysis, may thereby also make Twin-Earth judgements beside the point. But the resources available to translators go beyond semantic competence and it is these resources that nonetheless make the Moral Twin-Earth responses relevant. (shrink)

Dynamic body feedback is used in dance movement therapy, with the aim to facilitate emotional expression and a change of emotional state through movement and dance for individuals with psychosocial or psychiatric complaints. It has been demonstrated that moving in a specific way can evoke and regulate related emotions. The current study aimed to investigate the effects of executing a unique set of kinetic movement elements on an individual mover’s experience of happiness. A specific sequence consisting of movement elements that (...) recent studies have related to the feeling of happiness was created and used in a series of conditions. To achieve a more realistic reflection of DMT practice, the study incorporated the interpersonal dimension between the dance movement therapist and the client, and the impact of this interbodily feedback on the emotional state of the client. This quantitative study was conducted in a within-subject design. Five male and 20 female participants participated in three conditions: a solo executed movement sequence, a movement sequence executed with a DMTh who attuned and mirrored the movements, and a solo executed movement sequence not associated with feelings of happiness. Participants were only informed about the movements and not the feelings that may be provoked by these movements. The effects on individuals were measured using the Positive and Negative Affect Schedule and visual analog scales. Results showed that a specific movement sequence based on movement elements associated with happiness executed with a DMTh can significantly enhance the corresponding affective state. An additional finding of this study indicated that facilitating expressed emotion through movement elements that are not associated with happiness can enhance feelings such as empowerment, pride, and determination, which are experienced as part of positive affect. The results show the impact of specific full-body movement elements on the emotional state and the support outcome of DMT on emotion regulation. (shrink)

Moral (or ethical) sensitivity is widely viewed as a foundational learning goal in engineering ethics education. We have argued in this paper is that this view of moral sensitivity cannot be readily transported from the nursing context to the engineering context on the basis of a care-analogy. The particularized care characteristic of the nursing context is decisively different from the generalized and universalized forms of care characteristic of the engineering context. Through a focus on care and maintenance, the engineering student’s (...) moral sensitivity can be refined, opening up a perceptual awakening and affectivity towards the complex nature of the engineer’s Other. This awakening is in part promoted through an understanding of the ideology of neutrality as a moment in the history engineering. Becoming aware of this ideology as an ideology can then be seen as an activity of dividing loyalties that allows for a reflexive and critical view of the biases and presuppositions inherited within the world of engineering. This process of deepening the engineering student’s moral sensitivity is perhaps as much a process of the student becoming aware of her professional world, how it shapes her understanding of herself, and what it means to be a good engineer. Smith and van Dijk explore the relationship between the emotions schadenfreude and gluckschmerz, and why people experience these emotions. Their perspective is valuable and adds to a better understanding of how people respond to the fortunes of others. In this manuscript I try to further these ideas by arguing that schadenfreude and gluckschmerz are best seen as signals that indicate that a balance in how we would want the world to be is restored or violated.

The goal of the Reason! project is to develop an effective and affordable method for improving informal reasoning. In this paper we sketch the background to the project, briefly describe the Reason! software, and report positive results from a detailed study of the first full-scale trial.

Some moral debunkers such as Sharon Street argue that evolutionary debunking arguments favor a response-dependent or subjectivist metaethics over more realist metaethical accounts. I argue that this thought conflates meta-semantics with semantics by running together mind-dependent content determination relations with mind-dependent content. Insofar as reference is broadly an epistemic relation, evolutionary debunking arguments would cause trouble for mind-independent theories of reference and content determination, since there would be no guarantee that reference would track epistemic access. But a firmly realist theory (...) of content is consistent with a mind-dependent theory of reference. I use David Hilbert's theory of color to illustrate. (shrink)
