Comment se concilient gouvernance autochtone et pluralisme identitaire dans le cas particulier du Nunavut ? Ces deux termes ont été forgés dans le cadre théorique du constitutionnalisme libéral, qui rend la conciliation soit impossible, soit contradictoire ; une exigence éthique conduit à repenser les termes de la question. L’histoire particulière du Nunavut, ainsi que les stratégies contentieuses identitaires, m’ont permis de le qualifier de modèle de gouvernance autochtone moderne. S’appuyant sur une forme de pluralisme juridique, rapidement le pluralisme dialogique est (...) devenu la condition à cette gouvernance hybride au Nunavut, dont la finalité évidente est la garantie d’un pluralisme identitaire renouvelé. ABSTRACTThe judgment of blame was studied in a group of 28 teenagers, 14 with Asperger syndrome and 14 typically developed. Teenagers in each group were matched by age, cognitive development and academic level. They were presented with 12 short vignettes in which they had to judge an action according to the intent of the actor, the consequences of the action and the seriousness of the situation. Results showed a significant difference in the patterns of judgment of both groups. The AS (...) group judged the action according to the physical consequence of the action more than the intent of the actor; the opposite was observed with the control group. In addition, the AS teenagers were less capable than the control group of grading injury to a person when apportioning blame especially when they were not familiar with the social situations. Processing and recognizing facial expressions are key factors in human social interaction. Past research suggests that individuals with autism spectrum disorder present difficulties to decode facial expressions. Those difficulties are notably attributed to altered strategies in the visual scanning of expressive faces. Numerous studies have demonstrated the multiple benefits of exposure to pet dogs and service dogs on the interaction skills and psychosocial development of children with ASD. However, no study has investigated if those benefits also extend to the processing (...) of facial expressions. The aim of this study was to investigate if having a service dog had an influence on facial expression processing skills of children with ASD. Two groups of 15 children with ASD, with and without a service dog, were compared using a facial expression recognition computer task while their ocular movements were measured using an eye-tracker. While the two groups did not differ in their accuracy and reaction time, results highlighted that children with ASD owning a service dog directed less attention toward areas that were not relevant to facial expression processing. They also displayed a more differentiated scanning of relevant facial features according to the displayed emotion. Results from the present study suggest that having a service dog and interacting with it on a daily basis may promote the development of specific visual exploration strategies for the processing of human faces. Experiments on theories of reference have mostly tested referential intuitions. We think that experiments should rather be testing linguistic usage. Substantive Aim (I): to test classical description theories of proper names against usage by “elicited production.” Our results count decisively against those theories. Methodological Aim (I): Machery, Olivola, and de Blanc (2009) claim that truth-value judgment experiments test usage. Martí (2012) disagrees. We argue that Machery et al. are right and offer some results that are consistent with that conclusion. (...) Substantive Aim (II): Machery et al. provide evidence that the usage of a name varies, being sometimes descriptive, sometimes not. In seven out of eight tests of usage, we did not replicate this variation. Methodological Aim (II): to test the reliability of referential intuitions by comparing them with linguistic usage. Earlier studies led us to predict that we would find those intuitions unreliable, but we did not. Our results add to evidence that tests of referential intuition are susceptible to unpredictable wording effects. (shrink)

In this paper, we investigate how certain types of predicates should be connected with certain types of degree scales, and how this can affect the events they describe. The distribution and interpretation of various degree adverbials will serve us as a guideline in this perspective. They suggest that two main types of degree scales should be distinguished: (i) quantity scales, which are characterized by the semantic equivalence of Yannig ate the cake partially and Yannig ate part of the cake; quantity (...) scales only appear with verbs possessing an incremental theme (cf. Dowty 1991); (ii) intensity scales, which are characterized by degree modifiers (e.g., extremely, perfectly) receiving an intensive interpretation; intensity scales typically occur with verbs morphologically related to an adjective (to dry). More generally, we capitalize on a typology of degree structures to explain how degrees play a central role with respect to event structure. (shrink)

Riesterer, Brand, and Ragni compare a variety of models to human performance and show that not only do current models have a lot of room for improvement, but more importantly a large part of this improvement must come from examining individual differences in performance.

L'objet de cet article est d'examiner en quoi la phrase nominale existentielle : (a) "Lecture pendant toute la matinée" (b) "Lecture d'un poème" (c) "Lecture" peut être concernée par la distinction aspectuelle télique / atélique. Nous avons examiné les phrases qui, notamment à cause du type d'expression nominale employé, renvoient à un événement, un processus ou un état. Celles qui renvoient à un événement sont téliques, les autres sont atéliques, comme dans le cas des expressions verbales. Nous avons étudié les (...) énoncés nominaux qui comportent un circonstant (a) pouvant influer sur l'aspect télique ou atélique de l'énoncé et les énoncés qui renferment uniquement un groupe nominal, comme en (b), ou un simple nom comme en (c). Il ressort de cette étude i) que le caractère télique ou atélique d'une phrase nominale existentielle dépend non seulement du type de nom utilisé, mais aussi de facteurs syntaxiques (circonstant, complément, adjectif et déterminant du nom) voire contextuels (l'énoncé précédent); ii) que la phrase nominale existentielle impose certaines contraintes d'emploi, notamment par rapport aux déterminants, ce qui peut freiner l'observation de la télicité pour certains groupes nominaux. Computer vision aims to produce an understanding of digital image’s content and the generation or transformation of images through software. Today, a significant amount of computer vision algorithms rely on techniques of machine learning which require large amounts of data assembled in collections, or named data sets. To build these data sets a large population of precarious workers label and classify photographs around the clock at high speed. For computers to learn how to see, a scale articulates macro and micro (...) dimensions: the millions of images culled from the internet with the few milliseconds given to the workers to perform a task for which they are paid a few cents. This paper engages in details with the production of this scale and the labour it relies on: its elaboration. This elaboration does not only require hands and retinas, it also crucially zes mobilises the photographic apparatus. To understand the specific character of the scale created by computer vision scientists, the paper compares it with a previous enterprise of scaling, Malraux’sLe Musée Imaginaire, where photography was used as a device to undo the boundaries of the museum’s collection and open it to an unlimited access to the world’s visual production. Drawing on Douglas Crimp’s argument that the “musée imaginaire”, a hyperbole of the museum, relied simultaneously on the active role of the photographic apparatus for its existence and on its negation, the paper identifies a similar problem in computer vision’s understanding of photography. The double dismissal of the role played by the workers and the agency of the photographic apparatus in the elaboration of computer vision foreground the inherent fragility of the edifice of machine vision and a necessary rethinking of its scale. Policy-makers face an uncertain world. One way of getting a handle on decision-making in such an environment is to rely on evidence. Despite the recent increase in post-fact figures in politics, evidence-based policymaking takes centre stage in policy-setting institutions. Often, however, policy-makers face large volumes of evidence from different sources. Robustness analysis can, prima facie, handle this evidential diversity. Roughly, a hypothesis is supported by robust evidence if the different evidential sources are in agreement. In this thesis, I strengthen the (...) case for the use of robustness analysis in evidence-based policymaking by answering open research questions about this inference technique. First, I argue that existing taxonomies miss a fruitful category of robustness reasoning, that is predictive stability. Second, I claim that derivational robustness analysis – the investigation of whether the results of different models are in agreement – can yield interesting insights even if not the entire relevant model space is covered by available models or if the model results are only partially in agreement. Third, I claim that expert knowledge is necessary to address questions that arise when one applies measurement robustness analysis – the investigation into whether multiple means of measurement yield the same result. Finally, I argue that, in situations where evidence from different measurements is not in agreement, it can be advisable to no longer take all of the evidence into account. This can be done in a rationally defensible way by choosing the most adequate theory or model underlying parts of the evidence set. I discuss examples from climate, medical, and economic policy-making to establish my claims. (shrink)

What has become generally known as the Berlin School of Logical Empiricism constitutes a philosophical movement that was erected on foundations laid by Albert Einstein. His revolutionary work in physics had a profound impact on philosophers interested in scientific issues, prominent among them Paul Oppenheim and Hans Reichenbach, the founding fathers of the school, who joined in viewing him as their hero among philosopher-scientists. Overall the membership of this school falls into three groups. The founding generation was linked by the (...) circumstance that both Grelling and Reichenbach were collaborators of Oppenheim; the middle generation by the fact that both Hempel and Helmer were students of Reichenbach's in Berlin; and the younger generation by the fact that all of its members were students and disciples either of Reichenbach's or of Hempel's in the USA. Critics of the target article objected to our account of art appreciators' sensitivity to art-historical contexts and functions, the relations among the modes of artistic appreciation, and the weaknesses of aesthetic science. Gracias a la inclusión del testimonio heraclíteo, resulta posible rastrear la presunta consolidación de la tesis sobre los nombres primarios y los secundarios como el eje de la separación entre dos planos de realidad (uno estable y uno móvil) (...) y de la teoría de las Ideas -es decir, como la base de la epistemología platónica presente en los diálogos de madurez-. The article seeks to trace the image Plato has of Heraclitus and connect it with the argumentative structure of the Cratylus in order to understand the textual needs that give rise to the doctrine of perpetual flux, that is, the discussion regarding the correctness (ὀρθότης) of names. The inclusion of Heraclitus's testimony makes it possible to trace the alleged consolidation of the thesis regarding primary and secondary names as the axis of separation between two levels of reality (one stable, the other, changing) and the theory of Ideas -that is, as the basis of Plato's epistemology as set forth in the late dialogues-. Parte-se da idea de que as territorialidades contra-hegemônicas no mundo rural são resultantes de um duplo processo de aprendizagem e/ou adaptación: um interno ao próprio território, resultante da coevolução entre ecosisstemas e comunidades, e outro externo e entre territórios –o que envolve os processos de territorialização do capital sobre territórios tradicionais. Estas dinâmicas adaptativas dos territórios tradicionais e alternativos são expressas em hibridismos de práticas e representações sociais modernas e tradicionais acerca dos atributos reprodutivos da natureza: a fertilidad da natureza (...) nos territórios tradicionais subsume a reprodutibilidade do complexo socioambiental, ao passo que o imaginário de natureza na cultura científica moderna subsume a produtividade objetivada dos ecossistemas. Em outros termos, trata-se de interpretar narrativas e políticas de natureza. De fato, o entendimiento da complexidade da reprodução socioterritorial da agricultura e pesca tradicionais e alternativas (como aquelas da agricultura familiar de base ecológica) subsume, portanto, a indissociabilidade dos aspectos objetivos e subjetivos acerca da reprodutibilidade de sistema produtivo lato sensu, ou seja, dos condicionantes geoecológicos locais, dos valores e simbolismos tradicionais, que são sintetizados nas estratégias de adaptação e resiliência das comunidades rurais frente aos projetos de (re)territorialização do Capital sobre aqueles territórios contra-hegemônicos. Para calificar la estética posmodernista, que responde a la entrada en la era posmoderna, marcada por la ausencia de una visión unitaria y global del mundo, los teóricos de los años 70 privilegiaron el concepto de “heterogeneidad”, que en la década siguiente y parte de los años 90, dejó paso al de “sincretismo”, “mestizaje” o “creolidad”. A partir de los años 90 y, sobre todo, desde la primera década del tercer milenio, el concepto de “hibridez” ocupa un lugar destacado debido, (...) en parte, a la influencia de los estudios poscoloniales. Uno de los primeros en utilizar dicho concepto, en 1990, fue el crítico cultural argentino Néstor García Canclini, pero no profundizó sobre la hibridez de las obras literarias. In the hard determinism of Newtonian physics all aspects of the universe are deterministic and therefore all future behavior in the universe is determined by its present state. Hard determinism is incompatible with the existence of free will, but not with the belief in the existence of free will. It is analyzed what is required from physics for free will to exist. It is detailed which conditions must be fulfilled for randomness to be suficient for the existence of free will, (...) and it is argued that these conditions are valid in our physical universe. The approach to physics that is used is Zurek's information-based interpretation of measurement in quantum mechanics, called quantum existentialism. Zurek's approach is capable of describing the boundary between quantum physics and Newtonian physics in great detail. Belief in hard determinism increases the chances of feeling hopeless, and thus a direct consequence of the belief in hard determinism is a reduction of emotional well-being. The results obtained imply that the belief in the existence of free will is compatible with observed reality. (shrink)

This paper aims to offer a metaphilosophical reconstruction of Law in the analytic tradition of the twentieth and twentieth-one century first fifteen years, in order to determine the identity of the “analytic concept of law”. To do that I will use three argumentative axes. The first will clarify the distinction between the Continental and Anglo-Saxon focuses on twentieth century analytical legal philosophy. The second axis will emphasize the methods and purposes of the latter, from the publication of Hart’s The Concept (...) of Law’s first edition to its second edition in 1994. The third will problematize the existence or non-existence of an analytical concept of Law. (shrink)
