This article is dedicated to Nikolai O. Lossky’s intuitivism and personalism and their significance in the context of Russian philosophy. The author demonstrates how Lossky’s study of Russian philosophy influenced his work and allowed him to take a second look at a number of philosophical issues, indicating ways to develop them further. As a result of his research, Lossky discovered ideas close to his own in the works of various other Russian philosophers. Lossky became especially interested in two authors, Vladimir (...) S. Solovyov and Fyodor M. Dostoevsky. He created interpretations that examined Solovyov’s philosophy and Dostoevsky’s works from the positions of intuitivism and personalism. The study of Russian thought Lossky undertook in his book History of Russian Philosophy gave him a strong impetus for developing his own philosophical views, which were aimed at bringing philosophy and religion into closer proximity. The article proposes a universal dual-axis intelligent systems assessment scale. The scale considers the properties of intelligent systems within the environmental context, which develops over time. In contrast to the frequent consideration of the “mind” of artificial intelligent systems on a scale from “weak” to “strong”, we highlight the modulating influences of anticipatory ability on their “brute force”. In addition, the complexity, the ”weight“ of the cognitive task and the ability to critically assess it beforehand determine the actual set of (...) cognitive tools, the use of which provides the best result in these conditions. In fact, the presence of ”common sense“ options is what connects the ability to solve a problem with the correct use of such an ability itself. The degree of ”correctness“ and ”adequacy“ is determined by the combination of a suitable solution with the temporal characteristics of the event, phenomenon, object or subject under study. The proposed approach can be applied in the evaluation of various intelligent agents in different contexts including AI and humans performing complex domain-specific tasks with high uncertainty. We consider an example of four valued semantics partially inspired by quantum computations and negation-like operations occurred therein. In particular we consider a representation of so called square root of negation within this four valued semantics as an operation which acts like a cycling negation. We define two variants of logical matrices performing different orders over the set of truth values. Purely formal logical result of our study consists in axiomatizing the logics of defined matrices as the systems of binary (...) consequence relation and proving correctness and completeness theorems for these deductive systems. The phrase combining the terms κάλλ0ς and ἀπoρρoή to my knowledge does not occur anywhere else in the Greek Corpus in the context of contemplating a beautiful beloved. Achilles Tatius therefore must be making an allusion to Plato. This can hardly come as a surprise considering that Phaedr. 251, which describes the influence of the appearance of beauty on the soul of the lover, is one of the most famous and widely known Platonic passages. However, the context within which these (...) two allusions to Plato are introduced deserves attention. Adding a certain learned touch to the description of erotic episodes in his novel, Achilles Tatius presents a ‘scientific’ explanation of the mechanism of visual perception. The consistency of both accounts suggests that he draws on some scholarly theory of vision which was part of his general educational background. But, unlike the above mentioned allusions, this theory is hardly Platonic. (shrink)

The article discusses the philosophical views and ideas of Ivan I. Lapshin in order to introduce him as an original thinker who plays an important role in Russian Neo-Kantianism. Lapshin applied Neo-Kantian ideas in the areas of creativity, art, and literature. He sought to develop aesthetics and proposed the idea of ​​aesthetic transformation [The Russian word is perevoploshchaemost’, which can also be translated as reincarnation.—Trans.]. Having investigated the idiosyncrasies of Russian culture, Lapshin produced a special phenomenology of creativity, which aims (...) to reveal the essence laid down in different works of writers and composers. The phenomenology of creativity is the foundation of Lapshin’s philosophy; it allowed him to remain faithful to the basic principles of Neo-Kantianism while dialectically combining various aspects of human activity to express his own aesthetic program. Primatological and archaeological evidence along with anthropological accounts of hunter-gatherer societies indicate that lethal between-group violence may have been sufficiently frequent during our ancestral past to have shaped our evolved behavioral repertoire. Two simulations explore the possibility that heroism (risking one's life fighting for the group) evolved as a specialized form of altruism in response to war. We show that war selects strongly for heroism but only weakly for a domain-general altruistic propensity that promotes both heroism and other privately costly, (...) group-benefiting behaviors. A complementary analytical model shows that domain-specific heroism should evolve more readily when groups are small and mortality in defeated groups is high, features that are plausibly characteristic of our collective ancestral past. The authors investigated the relevance of consequentialism in commercial space exploration as well as in the actively developing space market. The authors conclude that space expansion and colonization of space objects will lead to a revision of the foundational consequentialism provisions. Consequentialism, formed during the history of terrestrial civilization, loses its effectiveness under conditions of space commercialization. The basics of planetary thinking are different from those of cosmic thinking. Therefore, considering the meaning of the terms “cosmic expansion” and “colonization of (...) the cosmos” through the existing theory of consequentialism faces serious contradictions. There is a range of problems that are not explored in modern philosophy and ethics due to the lack of an empirical basis for philosophical analysis. (shrink)

Our approach bases on the explication of Rosanov’s creativity as the special intention, that implements the unspeakable Self-Selfness of Vasiliy Rosanov. The ineffability of Self-Selfness can be dialectical expressed by Rosanov through phenomena, of that consists the Rosanov’s world. This ineffability actualizes by Rosanov by means of understanding as a filled emptiness, that determinates the specialties and the structure of the understood objects. The exposition of this emptiness conditions the antinomies of Rosanov’s creativity: one sides is understanding by Rosanov the (...) closed world, other sides it corresponds with the world of things. Rosanov mythically fills the void, using the intimate personal contact with the things. We consider the creativity of Rosanov as the synthesis of both this global directions of Rosanov’s theory: the vision of understanding through things, this vision causes the special perception of things by Rosanov. The things are by Rosanov neither material objects, nor the ideal essences. This are by Rosanov the givens, inherent to the understanding. At the same time Rosanov examines the things through understanding, including it with help of the carnivalisation in his own special world. This method defines in our opinion style and content of Rosanov’s works. The thinker realizes by means of the carnivalisation the understanding, according to the concrete things, creating the special world of life (reality). For Rosanov this world is the second world. The relevance of the research reflects the unity of the requirements of the Beijing Philosophical Congress "Learning to be a man" and the anniversary report of the "Rome Club" "Come On! Capitalism, myopia, population and destruction of the planet", which the transformation processes of the socio-sphere are revealed from the standpoint the need for a radical breakdown of the spiritual and moral world of man and his worldview. The foundation of these transformations is the transition in education, as the hippocrine (...) of our knowledge, the source that quenches thirst in them to the "new Enlightenment" as a decisive factor in the learning of a person to be him. This determined the purpose and objectives of the article. The purpose of the article is to substantiate the natural and necessary character of the formation of the "new Enlightenment", to reveal the architectonics of its content. Research objectives : in the context of the goal to uncover the factors that determine the need for a transition in education to the "new Enlightenment", its qualitative difference from the Enlightenment of the 17th-18th centuries; to characterize the new content of "connectedness" in education based on the use of new information technologies; analyze the process of formation of a new spiritual and moral outlook of a specialist on the universal values of humanity; focus the learner’s attention on focusing knowledge of sustainable development as a determining factor of the global problems of mankind through the interrelation of academic disciplines; an important component presents the demand for the formation of a new integral thinking, innovative in its essence and qualitatively different from the analytical one. It is noted that the transition to the path of integral thinking contributes to the connection, coordination and organization into a single whole of the fragments of the object under study. Such thinking is characterized by stability, reliability, variability; it is original in its connections with science and education, and methodological influence on individual and social consciousness. Integral thinking reflects a qualitatively new level of intelligence. Research methods: to achieve the stated goal and constructive solution of the tasks, the article used the method of abduction, analysis and synthesis, historical and logical, synergistic approach. The results of the research: a new paradigm of education is represented – the noospheric-information one corresponding to the factuality of the “new Enlightenment”, as its ability to reproduce itself on a changing scale. The change in the scale of the socio-sphere is due to its globalization processes. The content of the “new Enlightenment” is explicated as a qualitatively new level of formation of students' sustainable knowledge based on the integral innovative type of thinking based on the information resources of society, the use of modern educational technologies, as well as on the values of society, as the quintessence of its wisdom and public intelligence. Conclusions. Thus, the formation of a "new Enlightenment" is natural and necessary. This follows from the requirements of the “learn to be human” program, as well as from the development of an internally ordered education process. “New Enlightenment” also has an attribute of uniqueness, since it does not have anything to compare with, identify; it is an objective, essential, unique phenomenon; it is single, relative, determined by the previous development of education. It is based on the processes of intellectualization, innovation, informational content, humanism and is capable of solving constructively the tasks facing society. (shrink)

Доведена авторська позиція перегляду організаційних умов у вирішенні проблемних ситуацій у стратегічному консалтингу з метою підвищення результативності діяльності.

The relevance of the problem under study is due to the need to improve the practical skills and competencies of students in the course of training in order to prepare them for competition with other job seekers in employment. In this regard, this article is aimed at identifying the expediency of students’ participation in competitive selections and grants as a factor that creates conditions for effective practice-oriented learning. The leading method for the study of this problem is a pedagogical experiment, (...) which allows us to comprehensively consider the relationship between students’ participation in competitions and their further self-realization and development as young professionals. The article presents the results of monitoring the behavior of students who received an offer to participate in the university-wide competitive selection of student projects, implemented as part of the Program for Supporting Applied Research and Development of Students and Postgraduates of Petrozavodsk State University. The materials of the article can be useful for teaching staff in building a scheme for teaching students and services involved in the recruitment of personnel for large and medium-sized companies that require young professionals to have practical work skills, teamwork skills and creativity. In many films, story is presented in an order different from chronological. Deviations from the chronological order in a narrative are called anachronies. Narratological theory and the evidence from psychological experiments indicate that anachronies allow stories to be more interesting, as the non-chronological order evokes curiosity in viewers. In this paper we investigate the historical dynamics in the use of anachronies in film. Particularly, we follow the cultural attraction theory that suggests that, given certain conditions, cultural evolution should conform to (...) our cognitive preferences. We study this on a corpus of 80 most popular mystery films released in 1970–2009. We observe that anachronies have become used more frequently, and in a greater proportion of films. We also find that films that made substantial use of anachronies, on average, distributed the anachronies evenly along film length, while the films that made little use of anachronies placed them near the beginning and end. We argue that this can reflect a functional difference between these two types of using anachronies. The paper adds further support to the argument that popular culture may be influenced to a significant degree by our cognitive biases. (shrink)

The author argues that according to Sextus Empiricus, (a) the "sensual" nature of the phenomenon is a metaphorical notion, since it is indistinguishably extended both to sensuality and thinking; (b) the phenomenon manifest itself with irresistible force of impact, through a wide range of passive states of mind; (c) the impact of phenomena is always mediated by our ego, because all skeptic expressions are strongly correlated with the first person singular. The article proves that Descartes could not refute the “excess” (...) of skeptical doubt and make an immanent critique of skepticism without borrowing the aforementioned statements of Sextus. Such borrowing (1) has created a common ground for discussion between Descartes and skeptics; (2) made it possible for the meditator to give persuasiveness to careful observation of his own internal experience. Descartes' search for certainty in "Meditations" is entirely based on [а] evidence of "phenomena", "states of mind", "passions"; [b] refusal to agree with the "non-evident" proclaimed by Sextus Empiricus. For a quasi variety of algebras K, the Higman Theorem is said to be true if every recursively presented K-algebra is embeddable into a finitely presented K-algebra; the Generalized Higman Theorem is said to be true if any K-algebra which is recursively presented over its finitely generated subalgebra is embeddable into a K-algebra which is finitely presented over this subalgebra. We suggest certain general conditions on K under which the Higman Theorem implies the Generalized Higman Theorem; a finitely generated K-algebra (...) A is embeddable into every existentially closed K-algebra containing a finitely generated K-algebra B if and only if the word problem for A is Q-reducible to the word problem for B. In the paper we analyse the problem of axiomatizing the minimal variant of discussive logic denoted as $$ {\textsf {D}}_{\textsf {0}}$$ D 0. Our aim is to give its axiomatization that would correspond to a known axiomatization of the original discussive logic $$ {\textsf {D}}_{\textsf {2}}$$ D 2. The considered system is minimal in a class of discussive logics. It is defined similarly, as Jaśkowski’s logic $$ {\textsf {D}}_{\textsf {2}}$$ D 2 but with the help of the deontic normal logic (...) $$\textbf{D}$$ D. Although we focus on the smallest discussive logic and its correspondence to $$ {\textsf {D}}_{\textsf {2}}$$ D 2, we analyse to some extent also its formal aspects, in particular its behaviour with respect to rules that hold for classical logic. In the paper we propose a deductive system for the above recalled discussive logic. While formulating this system, we apply a method of Newton da Costa and Lech Dubikajtis—a modified version of Jerzy Kotas’s method used to axiomatize $$ {\textsf {D}}_{\textsf {2}}$$ D 2. Basically the difference manifests in the result—in the case of da Costa and Dubikajtis, the resulting axiomatization is pure modus ponens-style. In the case of $$ {\textsf {D}}_{\textsf {0}}$$ D 0, we have to use some rules, but they are mostly needed to express some aspects of positive logic. $$ {\textsf {D}}_{\textsf {0}}$$ D 0 understood as a set of theses is contained in $$ {\textsf {D}}_{\textsf {2}}$$ D 2. Additionally, any non-trivial discussive logic expressed by means of Jaśkowski’s model of discussion, applied to any regular modal logic of discussion, contains $$ {\textsf {D}}_{\textsf {0}}$$ D 0. The democratic state and social development courses chosen by Ukraine have defined its religious diversity, where a prominent place in the spiritual life of society is the phenomenon of religious minorities, which play an ambiguously important role in forming a new system of value orientations. All these changes are taking place against the background of global transformations in the modern world, which is becoming increasingly open to interactions and interactions between its various elements, pluralistic and multicultural, in which different religious (...) traditions freely coexist. At the same time, it shows discrimination against certain groups of people called minorities. Depending on this, in it in its own way individually and socially life experiences are displayed, the system of emotionally-shaped representations and experiences, norms of human existence is preserved.

A Reader in Early Franciscan Theology presents for the first time in English key passages from the Summa Halensis, one of the first major installments in the summa genre for which scholasticism became famous. This systematic work of philosophy and theology was collaboratively written mostly between 1236 and 1245 by the founding members of the Franciscan school, such as Alexander of Hales and John of La Rochelle, who worked at the recently founded University of Paris. Modern scholarship has often dismissed (...) this early Franciscan intellectual tradition as unoriginal, merely systematizing the Augustinian tradition in light of the rediscovery of Aristotle, paving the way for truly revolutionary figures like John Duns Scotus. But as the selections in this reader show, it was this earlier generation that initiated this break with precedent. The compilers of the Summa Halensis first articulated many positions that eventually become closely associated with the Franciscan tradition on issues like the nature of God, the proof for God’s existence, free will, the transcendentals, and Christology. This book is essential reading for anyone wishing to understand the ways in which medieval thinkers employed philosophical concepts in a theological context as well as the evolution of Franciscan thought and its legacy to modernity. This anthology of philosophical texts by Greek and Roman authors brings together works from the late fifth century BC to the sixth century AD that comment on major aesthetic issues such as the perception of beauty and harmony in music and the visual arts, structure and style in literature, and aesthetic judgement. It includes important texts by Plato and Aristotle on the status and the role of the arts in society and in education, and Longinus' reflections on the sublime in (...) literature, in addition to less well-known writings by Philodemus, Cicero, Seneca, Plotinus, Augustine and Proclus. Most of the texts have been newly translated for this volume, and some are available in English for the first time. Эволюционирующая социальная динамика требует переоценки обоснования и дискурса, используемых для поддержки теологических взглядов, по сравнению с более ранними периодами. Уникальные характеристики современного российского культурного и исторического контекста вносят изменения в роль богословия и придают его природе более неопределенный и спорный характер, влияя на его статус и место в общественной сфере. В рамках данной работы я попытаюсь сформулировать перспективу, направленную на раскрытие богословской стратегии в форме аналогического и мирного видения.

Recently (2010–2011) new criminal legislation to combat illegal income and corruption was passed and publicly discussed in Lithuania. Within the list of the new legal measures, special attention should be paid to criminalisation of illicit enrichment, establishment of a model of extended property confiscation, reinforcement of responsibility for corruption-related offenses, a provision that not only property but also personal benefits may constitute a bribe. It can be seen from the explanatory letters attached to the draft laws and the political debate (...) that the new regulation is expected to achieve decisive breakthrough in the fight against corruption and illegal income. However, without any doubt as to the necessity to fight against those social evils, the author presents critical evaluation of the reform by applying the test of principles of criminal law, legal language and practical effectiveness. By making critical conclusions that the new criminal legislation deliberately lightens the prosecution’s goal of incrimination and the burden of proof, the author warns about the purposive instrumental nature of the new laws, which are balancing on the threshold of legitimacy. In the article the author reveals crucial shortcomings of the new legislation: in some aspects it lacks legal certainty, in other aspects it ignores the principles of guilt, presumption of innocence and proportionality as well as the conception of criminal law as a last resort (ultima ratio). As a result, the new legal means against illegal income and corruption leave space for applying inadequate repression beyond their intended purpose, in addition, they criminalise human conduct that is insufficiently dangerous and create preconditions for senseless criminal prosecutions and violation of human rights. The modern Lithuanian legal doctrine recognises that criminal liability is a last resort (ultima ratio) protecting the society from various law violations. This idea has got deep roots in criminology and is obviously based on the position of rational approach towards the state criminal policy. However, it is not clear whether it is of obligatory legal status to the legislature and the courts. This article attempts to present the idea of a last resort as a concept based on the constitutional (...) principles of the rule of law, justice, proportionality and rationality in the legislation and case law. The author concludes that the main precursors of the ultima ratio principle are the German legal doctrine of protection of legal goods (Rechtsgüterschutz) and Harm principle respected in the common law tradition, as well as the need for protection of human rights in the democratic world. These concepts raise the duty of the legislator to justify the act of criminalisation by legitimate purpose and to comply with certain constitutional limits of application of criminal law. The idea of criminal liability as a last resort is recognised both in the jurisprudence of the Constitutional Court (obiter dictum) and in the practice of the Supreme Court of Lithuania reasoning particular decisions in criminal cases, especially delimiting criminal and other types of legal liability. The author concludes that the fact of discrepancy of criminal law to ultima ratio test can be one of the arguments in support of its objection to the Constitution and even the European Convention on Human Rights and Fundamental Freedoms. At the same time, the author of the article has found that many norms of the Criminal Code are in conflict with the idea of a last resort. (shrink)

Evasion of value added tax (VAT) is a pressing criminal justice problem; however, there still are no theoretical studies on the specific nature of this offense and the basis of its legal evaluation. This article is an attempt to explain the preconditions of the origin of this type of fraud and its connection with the Value Added Tax Law, to formulate the conceptual understanding of the offense, to reveal the important aspects of its legal evaluation and to discuss relevant examples (...) from the case-law. The preconditions of VAT fraud lie in the legal nature of tax administration and the particularity of VAT regulation creating opportunities to abuse the right of deducting the overpayment from the budget or reducing the tax payable. The system of tax crimes stipulated in the Criminal Code is not sufficient to properly assess the impact and danger of VAT fraud. The judicial practice considering VAT deception as property fraud is theoretically justified and welcome. (shrink)

What allows us to talk about the state as an active agent when we understand that only individuals act? This article draws comparisons between Quentin Skinner's exposition of the history of the concept of the state in major European languages and the history of its equivalent Russian term gosudarstvo in order to provide some general hypotheses on the development of the phenomenon of the state, and on the origins of this baffling usage. First, summing up a vast number of historical (...) and lexicographical works, it attempts a detailed reconstruction of the conceptual development of the term in the Russian language. Second, a peculiarity of the Russian case is discussed, in which absolutist thinkers stressed the difference between the person of the ruler and the state. Third, political interests in introducing such novel usage are discussed, together with the role of this usage in the formation of the state. This allows us to see better the origins of current faith in the existence of the state as a more or less clearly designated and independent actor, predicated on the mechanism of what Pierre Bourdieu described as "mysterious delegation.".
