The general mitigating and aggravating circumstances of criminal liability are elements attached to the crime that, when they occur, affect the punishment quantum. Cuban criminal legislation provides a catalog of such circumstances and some general conditions for their application. Such norms give judges broad discretion in assessing circumstances and adjusting punishment based on the intensity of those circumstances. In the interest of broad judicial discretion, the law does not establish specific ways for measuring circumstances’ intensity. This gives judges more freedom (...) and autonomy, but it also imposes on them more social responsibility and challenges them to manage the uncertainty and subjectivity inherent in this complex activity. This paper proposes a model to aid the linguistic assessment of circumstances’ intensity and to provide linguistic and numerical recommendations to determine an appropriate punishment interval. M-LAMAC determines the collective evaluation of circumstances of the same type, determines the prevalence of a type of circumstance by means of a compensation function, recommends the required modification in the input interval, and finally recommends a numerical interval adjusted to the judges’ initially expressed preferences. The model’s applicability is demonstrated by means of several experiments on a fictitious case of bank document forgery. (shrink)

The purpose of this study was to examine student perceptions of teaching behavior. Additionally the aim was to examine if teacher characteristics (educational level, gender, and teaching experience) could explain differences in student perceptions of their teachers. Teaching behavior was studied from the research on teaching and teacher effectiveness perspective. Secondary students (N = 7,114), taught by 410 teachers in Spain, participated in the study. Survey data were analyzed using non-parametric tests, Kruskal-Wallis, U Mann-Whitney with Bonferroni correction, and the analysis (...) of effect sizes. Furthermore, a regression model was applied. Results showed that teaching behavior was perceived as sufficient to good, depending on the teaching behavior domain. Results indicated interesting differences between lower secondary education, upper secondary education and vocational education and training teachers. The effect size values (rU statistic) ranged between 0.43 and 0.63, highlighting the significant effect of teachers’ teaching experience on the six teaching skills domains: learning climate, efficient classroom management, clarity of instruction, activating teaching, differentiation, and teaching learning strategies. Those teachers with less teaching experience were the ones who showed higher scores. Findings from the regression model showed that educational level had a significant predictive effect on the six teaching skills domains, mainly for male teachers. However, in several domains female teachers were perceived by students to outperform their male counterparts. (shrink)

El trabajo propone un marco para analizar las opciones estratégicas de las majors del petróleo ante el reto de la transición energética, considerando simultáneamente dos cuestiones que están interrelacionadas: el objetivo de reducir las emisiones de gases de efecto invernadero y el objetivo de adaptarse a los cambios que se están produciendo en la demanda de energía. Haciendo uso de este marco, se pregunta en qué medida los cambios que se están produciendo en la demanda energética han sido una condición (...) necesaria, o incluso suficiente, para que las compañías europeas hayan iniciado estrategias de diversificación. Igualmente se pregunta si la diversificación del negocio hacia otras actividades no vinculadas a los hidrocarburos ha sido condición necesaria, o incluso suficiente, para que estas empresas hayan empezado a asumir la reducción de emisiones como un objetivo estratégico. Por último, el trabajo analiza el impacto de esas estrategias de diversificación sobre el desarrollo de las energías renovables. (shrink)

Se establece la problemática respecto a la autenticidad de la obra de Platón y se opta por el criterio de que la polémica carece de sentido, pues su interés reside en que ellos han sido conocidos a lo largo de la historia de la filosofía como tales y que, en todo caso, de no ser escritos por Platón lo fueron por sus discípulos, cuestión que es suficiente en una época en la que no existe tan claramente la idea de autoría. (...) Se hace un recorrido por los métodos utilizados para ordenar los diálogos y un repaso de las clasificaciones más importantes. Finalmente se propone un método en dos direcciones: una considerada más filológica, consistente en fijar las obras se conocieron en cada momento histórico y otra, más filosófica, es la de establecer un marco teórico que reorganice los diálogos suponiendo que debe existir una lógica interna entre unos diálogos y otros, lo que supone un test para la teoría interpretativa de Platón que se proponga. RESUMEN Analizar el papel del centro universitario en la articulación con la universidad médica en la búsqueda de entornos saludables y su contribución al desarrollo local en el municipio Yaguajay, constituye el propósito fundamental del presente trabajo, para el que se realizó una revisión documental de numerosos documentos y entrevistas a los principales líderes y a la población. El fomento de prácticas y estilos de vida sanos, la integración y capacitación de actores sociales, el desarrollo de la ciencia, la innovación (...) tecnológica y del potencial científico productivo, junto a la sostenibilidad ambiental, fueron algunos de los resultados evidenciados. Se constató que la universidad en el territorio trabajó por incentivar una cultura saludable, por unificar esfuerzos, coordinar acciones, involucrar sectores, consolidar alianzas interinstitucionales dentro y fuera de la esfera sanitaria, con lo que se demostró la fortaleza de la promoción de salud dentro de los procesos de desarrollo local. ABSTRACT To analyze the role of the university center in the coordination with the medical university in the search of healthy environments and its contribution to the local development in the municipality Yaguajay, constitutes the fundamental intention of the present work, for which a documentary review of numerous documents was carried out and interviews to the principal leaders and the population. The promotion of practices and healthy life styles, the integration and training of social actors, the development of the science, the technological innovation and of the productive scientific potential, along with the environmental sustainability, were some of the demonstrated results. It was stated that the university at the territory was employed for encouraging a healthy culture, for unifying efforts, coordinating actions, involving sectors, consolidating inter-institutional alliances inside and out of the sanitary sphere, with what there was demonstrated the fortitude of the promotion of health inside the processes of local development. Este trabajo se centra en la acción dialógica y comunicativa entre las personas con la intención de mejorar su educación. Para ello se ha adaptado el formato de las tertulias literarias dialógicas al contenido de las obras musicales. Los principales objetivos han sido: desarrollar las competencias comunicativa, lingüística y musical a través del diálogo interactivo; aumentar el grado de motivación e incrementar la cultura musical de los futuros docentes hacia la música clásica. Se combina una metodología cualitativa con cuantitativa y (...) el método investigación-acción. La muestra han sido 136 estudiantes, futuros docentes en formación. Tras el inesperado fallecimiento de la reina María de las Mercedes de Orleans el 26 de junio de 1878, las muestras de dolor y respeto se vivieron tanto dentro como fuera del Reino. The informed consent is an ethical and legal requirement for potential participants to enroll in a study. There is ample of evidence that understanding consent information and enrollment is challenging for participants in clinical trials. On the other hand, the reasoning process behind decision-making in HIV clinical trials remains mostly unexplored. This study aims to examine the decision-making process of people living with HIV currently participating in antiretroviral clinical trials and their understanding of informed consent. We conducted a qualitative socio-constructivist (...) study using semi-structured interviews. Eleven participants were selected by purposive sampling in Argentina until data saturation was reached. A content analysis was performed. The findings highlight the fact that some participants decided to enroll on the spot, while others made the decision a few days later. In all cases, the decision was based on different aspects of trust (in doctors, in the clinical research site, in the clinical trials system) but also on emotions associated with HIV and/or treatment. Moreover, while people living with HIV felt truly informed after the consent dialogue with a researcher, consent forms were unintelligible and unfriendly. The immediacy of patient decision-making has rarely been described before. Enrollment in an HIV clinical trial is mainly a trust-based decision but this does not contradict the ethical values of autonomy, voluntariness, non-manipulation, and non‐exploitation. Thus, trust is a key issue to be included in reshaping professional practices to ensure the integrity of the informed consent process. (shrink)

En este trabajo estudiaremos la presencia de imágenes hagiográficas que se pueden considerar ajenas al ciclo de la Pasión de Cristo en las procesiones penitenciales españolas a lo largo de la historia, deteniéndonos fundamentalmente en aquellas que por méritos propios han sido merecedores de presidir un paso procesional en solitario.

El pintor Rafael Ángel Fernández Piedra, fallecido en 2018, es considerado uno de los artistas más representativos de Costa Rica, cuya obra ha tenido también una proyección internacional considerable, al formar parte de la Colección del Museo José Luis Cuevas en Ciudad de México, así como de la Colección del Museo Rally de Arte Contemporáneo, en Punta del Este, Uruguay, entre otros. Obtuvo el premio Aquileo J. Echeverría en Artes Plásticas en 1968, 1972 y 1975, así como el premio (...) Nacional de Cultura Magón en 2002, el más importante galardón que otorga el Estado costarricense en reconocimiento a una vida dedicada a la cultura. Como homenaje póstumo a este insigne creador, en esta edición la Revista Ístmica convierte su sección de Artes Visuales en una galería virtual dedicada a la exposición de parte de su obra, comentada sentidamente por su hija, la curadora y también artista, Alma Fernández. Die Studie zeigt, dass Autobiographien weit mehr sind als individuelle Lebensentwürfe. Vor allem Autobiographien von Paaren zeugen von den Schnittstellen gemeinsamen Lebens und Schreibens. Sie bieten sich in herausragender Weise an, die Zweistimmigkeit im Leben und Schreiben von Paaren in den Blick zu nehmen und relationale Dimensionen des Lebens in kreativen Schaffensprozessen als ethisches und ästhetisches Moment wahrzunehmen. Dem komplexen Beziehungsgeflecht von Autobiographien wird hier am Beispiel des bekannten spanischen Schriftstellerpaares María Teresa León und Rafael Alberti nachgespürt. Über die (...) individuellen Prägungen der Autobiographien hinaus wird das Netz, das zwischen beiden Autoren und Texten im autobiographischen Schreiben gesponnen wurde, aufgedeckt und einer Stereophonie der Autobiographie Raum gegeben. Nos acercamos a la figura de Gabriel Riesco Fernández del Campo por ser una de las más prolíficas de la planificación urbana de España y El Salvador del siglo XX, como autor de más de 180 planes. Tras el estudio de su biografía y de algunas de sus obras podemos situarlo en la más alta Administración pública de ambos países, donde su trabajo fue determinante para su ordenación territorial, en los años 50 y tras el terremoto de 1986 en Centroamérica, (...) y en España durante el desarrollismo y la constitución de las Comunidades Autónomas. Asimismo fue asesor de Naciones Unidas para la ordenación territorial en El Salvador. Su obra arquitectónica es aún más desconocida. (shrink)

En la historiografía nacional poco se ha estudiado el problema de la lectura y la confrontación del sentido del pasado en la historia de la revolución durante la tercera década del siglo xix. El objetivo de este artículo es reconstruir las prácticas lectoras a partir de las cuales se asumió una posición crítica y se construyó cierta opinión pública frente a la narración de los hechos del pasado republicano vinculado con los procesos de independencia en la Nueva Granada. Para ello, (...) se examina la defensa de José Fernández Madrid frente a los testimonios, narrativas y lo que llamaba la “desnaturalización de los hechos” en la naciente historia de Colombia, que se empezó a inventar después de los sucesos de Boyacá en 1819 y luego de sancionada la Constitución Política de 1821. Se quiere llamar la atención, por un lado, sobre los criterios de veracidad a los que eran sometidos los testimonios de los protagonistas de la Independencia al momento de ser confrontados con la interpretación, los documentos y las pruebas del lector; y, por otro, sobre los usos que hacían del pasado los republicanos ilustrados para justificar su “conducta política” y mantener el “buen nombre”, justo cuando se estaban inventando y legitimando los fundamentos políticos de la nueva República. En este sentido, se trata, desde el punto de vista metodológico, de avanzar en el campo de la historia de la lectura a partir de un análisis de las discusiones, defensas, comentarios y contestaciones del público lector, para legitimar su actitud crítica frente a las formas de desconocimiento suscitadas por la escritura de la historia. La formación ética de las fuerzas militares es esencial para la democracia, pues orienta el respeto por los derechos humanos, la observancia de las leyes de la guerra y la protección de lalegitimidad institucional. Por tal motivo, la ética militar se convierte en una herramienta crucialpara guiar el comportamiento de los militares en entornos complejos y garantizar la toma de decisiones responsables. En ese contexto, este artículo evalúa el impacto del curso Conceptos Básicos en Ética Militar y su enfoque inductivo (...) en las actitudes y comportamientos del personal militar colombiano. A través de una metodología con un enfoque cuantitativo, se realizó un estudiocon 230 participantes del curso en la Escuela Superior de Guerra General Rafael Reyes Prieto(ESDEG) de Colombia, para medir las actitudes sobre la ética militar, las reglas de enfrentamiento (RE) y la efectividad operacional. Dentro de los principales resultados se identificó que el curso tuvo un impacto positivo en las actitudes de los participantes sobre la importancia de la ética militar, su contribución a la cohesión de las unidades y su influencia en la toma de decisiones responsables.Se concluye que la formación en ética militar, a través de métodos innovadores como el inductivo, prepara a los militares para enfrentar los desafíos del mundo actual y garantizar el cumplimiento de su misión de manera responsable. Se aborda la relación entre María Zambrano y Rafael Dieste desde espacios vivenciales y literarios. Ambos autores participaron en las Misiones Pedagógicas, actividad enmarcada en la España de la II República. Ocupación en la que trasladan al pueblo la necesidad de una educación transformadora. Distanciados del intelectualismo de los institucionalistas, se acercan al pueblo buscando un lugar de encuentro, de un camino por el cual transitar intercambiando experiencias y sentires. En cuanto al espacio literario, tenemos que señalar especialmente la (...) participación en el cuerpo de la redacción de la efímera, pero fructífera, revista La Hora de España. A pesar de que los autores no tendrán muchos momentos de encuentro a lo largo de sus vidas tendrán una larga relación epistolar. Veremos a través de las cartas los perfiles más desconocidos de los escritores. Un pensamiento en gestación vertido en la relación epistolar que los mantuvo unidos tras la diáspora de la Guerra Civil. Analizando algunos de los textos de Rafael Dieste de vertiente más filosófica encontraremos canales de comunicación con la razón poética de la filósofa. (shrink)

El propósito de esta investigación es caracterizar la inversión española en Ecuador, y analizar las percepciones sobre ésta de las empresas ibéricas que desarrollan su actividad en esta república Latinoamericana. Esta información es de especial relevancia para las instituciones gubernamentales, y para los potenciales inversores. Para realizar el trabajo se utilizó una metodología cualitativa con una perspectiva socioeconómica de tipo exploratoria de bola de nieve. Los resultados muestran como principal conclusión que los diez años del gobierno del presidente Rafael (...) Correa han sido positivos para la inversión en términos generales debido a la continuidad del gobierno que influyó en una mayor estabilidad política y social, que dio lugar a un periodo de crecimiento económico por encima de muchos países desarrollados. En relación a las multinacionales españolas, también fue favorable, por su participación en grandes proyectos de obra civil que supusieron importantes ingresos en una época de recesión económica y reducida inversión en España. The debate over Plato’s “ so called unwritten doctrines”, which he communicated only to a small circle of trusted disciples, has caused a stir among philosophers in recent decades. Rafael Ferber assumes a differentiated position in this controversy. He is convinced that the unwritten doctrines did exist, but that Plato, for reasons inherent in the process of gaining knowledge, was unable to communicate these doctrines even to his closest disciples. In this book, Ferber outlines the discussion and summarizes the (...) standpoints of greatest interest. Ever since Aristotle, we have known that Plato did not put his most important teachings into writing, but instead communicated them only orally to the inner circle of his disciples. While the extant dialogues merely pass down Plato’s “exoteric” doctrines, his most important “esoteric” insights were not meant for the general public. In the meantime, the contents and the significance of Plato’s “unwritten doctrines” have become the subject of debate in philosophical circles. Fifteen years ago, at the height of the controversy over the “unwritten doctrines”, Rafael Ferber entered the fray with a small book. He proposed that Plato was also unable to communicate the “unwritten doctrines” because the highest principles (i.e. the subject of the unwritten doctrines) cannot be known through logical operations due to an epistemological paradox. Ferber’s differentiated position met with great respect and acceptance, although in individual cases it was also rejected. Ferber’s new book again presents the text of 1991, but significantly expands on it through new perspectives and an outline of the discussion it triggered. In this book, the reader learns what is meant by Plato’s unwritten doctrines and what the controversy is all about. (shrink)

In the whole Corpus Platonicum, we find in principle only one "direct argument" (Charles Kahn) for the existence of the ideas (Tim.51d3-51e6). The purpose of the article is to analyse this argument and to answer the question of why Plato in the Timaeus again defended the existence of the ideas despite the objections in the Parmenides. He defended it again because the latent presupposition of the apories in the Parmenides, the substantial view of sensibles, is removed through the introduction of (...) space as "substantialized extension". First (I) it is shown that Plato remained in dialogues, like the Sophist and Politicus, faithful to the "theory of ideas" despite his criticism in the Parmenides. The common theme in the trilogy of the Theaetetus, Sophist and Politicus is to refute relativism by showing that any relativism presupposes something absolute that is something like the "theory of ideas". The second part of the paper (II) examines closely the logical structure of the argument for the existence of ideas in the Timaeus (51d3-52a7). The third part (III) shows how this argument can avoid the criticism of ideas in the Parmenides. In the Parmenides, sensibles are treated as substantial entities. But, as the Timaeus shows, sensibles are not substantial entities but merely qualities, namely qualities of space, which is the only substance in the sensible world. Current suggestions for capacities that should be targeted for moral enhancement has centered on traits like empathy, fairness or aggression. The literature, however, lacks a proper model for understanding the interplay and complexity of moral capacities, which limits the practicability of proposed interventions. In this paper, I integrate some existing knowledge on the nature of human moral behavior and present a formal model of prosocial motivation. The model provides two important results regarding the most friction-free route to moral enhancement. First, (...) we should consider decreasing self-interested motivation rather than increasing prosociality directly. Second, this should be complemented with cognitive enhancement. These suggestions are tested against existing and emerging evidence on cognitive capacity, mindfulness meditation and the effects of psychedelic drugs and are found to have sufficient grounding for further theoretical and empirical exploration. Furthermore, moral effects of the latter two are hypothesized to result from a diminished sense of self with subsequent reductions in self-interest. (shrink)

To see nationalism as a cultural artifact is to argue against attempts at essentializing it. Anderson claims that nationalism can be better understood as obliquely analogous to such categories as religion and kinship. Membership in a nation draws on the vocabulary of filiation whereby one comes to understand oneself in relation to ancestors long gone and generations yet to be born. In addressing pasts and futures, nationalism resituates identity with reference to death, one’s own as well as others’. Herein lies (...) nationalism’s affective appeal, that which makes it possible to sacrifice oneself for the “motherland.” It lends to the accident of birth the sense of continuity and converts mortality into something that is meant for as much as it is realized by one. By placing one in a certain relationship to death and generativity, nationalist discourse therefore frames the arbitrariness of existence. “It is the magic of nationalism to turn chance into destiny”.However, while nationalism tends to mine the idioms of kinship and religion, the historical conditions of its emergence undermine the logic and stability of these inherited categories. Thus Anderson defines nations as “imagined communities.” Built on the rubble of traditional polities, the nation invokes a radically secular subjectivity that sets it apart from its predecessors. Dynastic states presumed power and privilege as functions of the purity of bloodlines guaranteed by a divine order. Colonial states as dynastic states in drag replicate the obsession with hierarchy by reorganizing social and epistemological categories according to a metaphysics of race and progress. By contrast, the nation envisions a more egalitarian community. “Regardless of the actual inequality and exploitation that may prevail in each, the nation is always conceived as a deep, horizontal comradeship”. It thus reveals the mutability of all sorts of hierarchies. Rather than take power for granted as natural and inherited, nationalism asks about “rights” and thereby opens up the problem of representation: who has the right to speak for whom and under what circumstances?
