A prominent way of justifying civil disobedience is to postulate a pro tanto duty to obey the law and to argue that the considerations that ground this duty sometimes justify forms of civil disobedience. However, this view entails that certain kinds of uncivil disobedience are also justified. Thus, either a) civil disobedience is never justified or b) uncivil disobedience is sometimes justified. Since a) is implausible, we should accept b). I respond to the objection that this ignores the fact that (...) civil disobedience enjoys a special normative status on account of instantiating certain special features: nonviolence, publicity, the acceptance of legal consequences, and conscientiousness. I then show that my view is superior to two rivals: the view that we should expand the notion of civility and that civil disobedience, expansively construed, is uniquely appropriate; and the view that uncivil disobedience is justifiable in but only in unfavorable conditions. In Daoist philosophy, the self is understood as an individual interdependent with others, and situated within a broader environment. Within this framework, the concept ziran is frequently understood in terms of naturalness or nature while wuwei is explained in terms of non-oppressive government. In many existing accounts, little is done to connect these two key Daoist concepts. Here, I suggest that wuwei and ziran are correlated, ethical, concepts. Together, they provide a unifying ethical framework for understanding the philosophy of the (...) Daodejing. I explore the meaning of ziran as self-so-ness or, in human terms, as pertaining to an individual’s spontaneity. The appropriate response to the spontaneity of individuals is to avoid, insofar as possible, imposing or using restrictive norms and methods, that is, wuwei. According to this view, ziran and wuwei offer an account of ethics that attends to core notions of interdependent selfhood, including mutuality, relationality, interdependence, symbiosis, and responsiveness. Social movements often impose nontrivial costs on others against their wills. Civil disobedience is no exception. How can social movements in general, and civil disobedience in particular, be justifiable despite this apparent wrong-making feature? We examine an intuitively plausible account—it is fair that everyone should bear the burdens of tackling injustice. We extend this fairness-based argument for civil disobedience to defend some acts of uncivil disobedience. Focusing on uncivil environmental activism—such as ecotage (sabotage with the aim of protecting the environment)—we (...) argue that some acts of uncivil disobedience can be morally superior to their civil counterparts, when and because such acts target people who are responsible for environmental threats. Indeed, insofar as some acts of uncivil disobedience can more accurately target responsible people, they can better satisfy the demands of fairness compared to their civil counterparts. The standard criticisms of Confucian ethics appear contradictory. On the one hand, Confucian ethics is deemed overly rule-bound: it is obsolete because it advocates adherence to ancient Chinese norms of proper conduct. On the other hand, Confucian ethics is perceived as situational ethics—done on the run—and not properly grounded in fundamental principles or norms. The core thesis of anti-luck epistemology is the incompatibility thesis, that is, knowledge is incompatible with veritic epistemic luck. Traditionally, anti-luck epistemologists hold that there are two distinct types of veritic epistemic luck, viz, intervening luck and environmental luck. The former occurs when something luckily intervenes between the subject’s belief and the target fact, which renders the subject’s belief luckily true. The latter can be found in cases where the subject’s belief is luckily true when she is in an unfriendly (...) epistemic environment. This paper purports to show that there is another long-neglected type of veritic epistemic luck—I name it ‘interpretative luck’. It refers to the type of luck occurring when the subject accidentally chooses the correct interpretation of evidence and thus her belief is luckily true. I will demonstrate that no proper reasons can support the incompatibility between interpretative luck and knowledge. Instead, the price for insisting this incompatibility would be unacceptably high. Therefore, the existence of interpretative luck falsifies the incompatibility thesis of anti-luck epistemology. (shrink)

Social movements may bring positive social changes. However, escalated levels of violence and delinquency in some campaigns caused public concerns about infringing personal rights and destroying public property. In modern societies, we encourage mutual respect, peace, and appropriate conflict resolutions and avoid the use of aggression across situations. This cross-sectional study examined forgiveness, moral disengagement, and reactive and proactive aggression among different types of young social activists in Hong Kong. Findings would provide insights into intervention strategies for reducing aggressive behaviors (...) in young people and helping them restore their quality of life. Our participants were 1046 local secondary school and tertiary students (583 males and 463 females) aged 12 to 25 years (M = 16.95, SD = 3.29). They completed a questionnaire about their participation in local campaigns, with psychological measures of forgiveness, moral disengagement, and aggression. The respondents were then divided into three categories: non-activists (NA), moderate activists (MA), and activists with delinquent/violent action (ADA). ANOVAs were used to examine the differences between these three types of social activists. Results indicated that ADA reported using more reactive and proactive aggression than NA, and MA reported using more reactive but not proactive aggression than NA. ADA had significantly higher levels of moral disengagement overall than NA and MA. Regarding forgiveness, both ADA and MA had significantly lower levels of absence of negative than NA. Implications for psychotherapy, education, and social policies will be discussed. (shrink)

This paper is a preliminary study of Bhāviveka’s Svātantrika-Mādhyamika justifications for taking non-existent things as the subject of an inference, based on his Dacheng Zhangzhen Lun. Bhāviveka’s treatment of inference is similar to that of Dignāga in that the subject is required to be existent. Bhāviveka also holds that, in a conventional sense, words refer to universals and to the existent entities that possess them, while the two are cognised together. However, in his inference for the unreality of unconditioned things, (...) he likens these things to a sky-flower that never arises and is unreal even conventionally. This paper first demonstrates how taking unconditioned things as the subject of an inference can be problematic for Bhāviveka. Then, it discusses Bhāviveka’s attempts to address the problems by subsuming the unconditioned things under the domain of conventional reality. The paper concludes that these attempts show his flexibility in terms of what is taken as conventionally real. (shrink)

Within this framework li are multidimensional, as they have different functions at different stages in the cultivation process. This novel interpretation refocuses the issue regarding the flexibility of li, a topic that is still being debated by scholars. From Levinas’s reading of the Talmud and Franz Rosenzweig, and Derrida’s work on Marx and Levinas, to Agamben’s reading of Benjamin and Saint Paul, and Žižek’s work on Saint Paul and Derrida, among (...) others, it is now possible to detect what Arthur Bradley and Paul Fletcher call “a messianic turn” in continental thought. To contribute to this ongoing “messianism” dialogue, this chapter aims to examine what could be termed “(im) patient messianism,” as illustrated in the writings of Marx, Levinas, and Derrida. Although these three philosophers are of Jewish decent (and all of them inherited the concept of Jewish messianism), they develop different, and yet intersecting, messianisms in their philosophies. While Marx’s political philosophy demands an impatient messianism entailing an impending apocalypse intended to achieve social justice, Levinas’s ethical messianism requires absolute patience to pursue justice for the Other in infinity. Resorting to both Levinasian ethics and Marxist politics, Derrida’s spectral (im)patient messianism attempts to [End Page 59] demonstrate the possibility of moving from the ethical to the political without returning to the mire of either ontology or theology. Nevertheless, all three thinkers have problems associated with their messianic beliefs. Where does it come from? And why speak of the messianic now? It is, on the face of it, difficult to imagine anything less contemporary — more untimely — than talk of Messiahs, redeemers, chosen people, last judgement.... Yet, paradoxically, it might be precisely this radical sense of untimeliness — of ever becoming ‘timely’ or happening ‘now’ — that represents the messianic’s greatest value of our time, to ‘now-time.’... In other words, the messianic now might actually be something that enables us to think, write and perhaps even judge our ‘now’ otherwise.”1The word Messiah is derived from the Hebrew mashah (“the anointed”) and refers to an eschatological redeemer, a savior, of a group of people. In Difficult Freedom, Levinas points out “messianism in the strong sense of the term has been compromised in the Jewish consciousness since Emancipation, ever since Jews participated in world history” (DF 96). In “Toward an Understanding of the Messianic Idea in Judaism,” Gershom Scholem also claims that “Judaism, in all its forms and manifestations, has always maintained a concept of redemption as an event which takes place publicly, on the stage of history and within the community.”2 Messianism appears “as a living force in the world of Judaism.”3 In truth, the idea of messianism originated in Judaism and is also used in the other Abrahamic religions, namely Christianity and Islam. According to Jewish eschatology, the Messiah is a king or High Priest, traditionally anointed with holy oil to be the ruler of God’s Kingdom. Many scholars note that the Analects, and Confucian philosophy more generally, hold a conception of knowing that more closely approximates ‘knowing-how’ than ‘knowing-that’. However, I argue that this description is not sufficiently sensitive to the concerns of the early Confucians and their focus on self-cultivation. I propose that a particular conception of knowing—knowing to act in the moment—is better suited to capturing the Analects’ emphasis on exemplary lives in actual contexts. Background: In health, ethics is an essential aspect of practice and care and guarantees a better quality of life for patients and their caregivers. Objective: To outline a conceptual analysis of quality of life and ethics, identifying attributes, contexts and magnitudes for health. Method: A qualitative design about quality of life and ethics in health, considering the evolutionary approach in order to analyse the concept. To collect the data, a search was done using the keywords ethic*, quality of life and (...) health. After, in total, 152 studies were found, finalizing seven relevant studies for the proposed concept analysis. Findings and discussion: Of seven studies analysed, their main results were shown by means of antecedents, consequences and attributes of the concepts. The three final attributes that synthesize the concept of quality of life and ethics in health were highlighted: Ethics dilemmas and quality of life; Human ethics and quality of life; and Ethics of care and quality of life. In fact, the attributes and context clearly reveal that ethics and quality of life influence the ability to solve ethical dilemmas, guarantee human ethics in healthcare and impact ethics in healthcare for the production of effective health policies and care that encompasses professional quality of life as well. Conclusion: The magnitude of ethical knowledge in each professional discipline permits cultivating a solidary attitude and developing the willingness to improve healthcare. The right to access, dignity and respect in care delivery are rooted in behaviours and are spontaneously applied in practice to the extent that they play an ethical role. (shrink)

Civil disobedience, despite its illegal nature, can sometimes be justified vis-à-vis the duty to obey the law, and, arguably, is thereby not liable to legal punishment. However, adhering to the demands of justice and refraining from punishing justified civil disobedience may lead to a highly problematic theoretical consequence: the debilitation of civil disobedience. This is because, according to the novel analysis I propose, civil disobedience primarily functions as a costly social signal. It is effective by being reliable, reliable by being (...) costly, and costly primarily by being punished. My analysis will highlight a distinctive feature of civil disobedience: civil disobedients leverage the punitive injustice they suffer to amplify their communicative force. This will lead to two paradoxical implications. First, the instability of the moral status of both civil disobedience and its punishment to the extent where the state may be left with no permissible course of action with regard to punishing civil disobedience. Second, by refraining from punishing justified civil disobedience, the state may render uncivil disobedience—illegal political activities that fall short of the standards of civil disobedience—potentially permissible. Drawing on the core values of western civilization, the author refines the counterparts in Chinese civilization, summarized as four core principles: duty before freedom, obedience before rights, community before individual, and harmony before conflict. Focusing on guoxue or Sinology as the basis of his approach, the author provides detailed explanations of traditional Chinese values. Recent scholars have addressed the concept of guoxue since the modern age, sorting through it and piecing it together, which has produced an extremely abundant range of (...) information. First, it analyzes the mindset of guoxue, examining the dominant ideas and values of the era from which the term "guoxue" arose, focusing on its connection to early changes and trends in society and culture, and distinguishing three key phases of development. Past scholars mainly had in mind the range of objects studied in guoxue when defining it, and what this book underscores is the meaning of guoxue as a modern body of research. In this paper, I want to ascertain whether there is an interest-based moral position to claim in Confucian ethics. This is crucial to a further ascertainment of moral human rights in Confucianism, because a moral position to claim is a necessary condition to a moral right. Upon careful textual analysis of some of the passages in Mencius, I argued that such moral position to claim is implicit but actually available in Confucian ethics. In a review of the Punishment of the (...) Outcast in Mencius 1B:8, I argued that Mencius not only agrees that people should revolt against the despots, but also that their doing so signifies what Joel Feinberg calls “the activity of claiming.” In other words, it is Mencius’ point of view that when things come to a person’s vital interests, namely one’s own life in this case, it is morally justified for one to act thus claim on one’s interests. I conclude that while an interest-based moral position to claim is found present in Confucian ethics, this does not necessarily mean that a Confucian moral rights discourse is ready. While such position to claim is no doubt crucial to a ‘rights-engineering’ in Confucianethics, attempts to ascertain other elements of a moral right, namely a claim-against and a moral duty are required.
