The confrontation between Philip the Fair and Boniface VIII has long been seen as a major turning point for the medieval papacy, for the rise of national monarchies, and for the political shaping of public opinion in late-medieval France. Philip's campaign to gain and display the support of the clergy, the nobility, and townspeople throughout the realm also generated a large body of documentation, much of which survives today. Although frequently explored and exploited during the last four centuries, (...) the archival record is not as straightforward as it appears. While recognizing it as part of a masterly propaganda campaign, one needs to look not simply at the shaping of opinion, but at the shaping of the written record—a case in which the silences, what is not recorded, are often as important as the voices on which our attention has been focused. In On the People’s Terms, Philip Pettit incorporates the Sieyèsian notion of constituent power into his constitutional theory of non-domination. In this article, I argue that Emmanuel Sieyès’s understanding of liberty precludes such an appropriation. While a republican, his conceptualisation of liberty in the face of commercial society stood apart from theories of civic vigilance, preferring instead to disentangle individuals from politics and maximise what he understood to be their non-political freedoms. Sieyès saw that liberty was heightened through relations (...) of representation and commercial dependency. This conception of liberty was pivotal to the identity of the nation, and so allowed Sieyès to assess forms of collective injustice committed by the French nobility. It also provided the normative foundation of his theory of constituent power. For Sieyès, constituent power guarded against legislative excess in a decidedly minimal sense, intending instead to separate citizens from the political sphere so they were not burdened with ongoing participation or public vigilance. As a cornerstone of public health, epidemiology has lately undergone substantial changes enabled by, among other factors, the use of biobank infrastructures. In biobank-related research, the return of results to participants constitutes an important and complex ethical question. In this study, we qualitatively investigated how individuals perceive the results returned following their participation in cohort studies with biobanks. In our semi-structured interviews with 31 participants of two such German studies, we observed that some participants overestimate the nature of the personal (...) information they will receive from the study. Although this misestimation does not seem to jeopardize the validity of the consent provided at recruitment, it may still represent a threat for participants’ trust in research and thus their long-term commitment, crucial for such studies. We argue that such misestimation may have ethical consequences on the principles guiding the reflection on the return of results in biobank research, i.e. autonomy, beneficence, non-maleficence and reciprocity. We suggest that shifting from the idea of directly benefiting participants through the return of research results could help focusing on benefiting society as a whole, thereby increasing research trustworthiness of population-based studies using biobanks. Background In bioethics, especially nursing ethics, systematic reviews are increasingly popular. The overall aim of a systematic review is to provide an overview of the published discussions on a specific topic. While a meta-review on systematic reviews on normative bioethical literature has already been performed, there is no equivalent for systematic reviews of empirical literature on ethical topics. Objective This meta-review aims to present the general trends and characteristics of systematic reviews of empirical bioethical literature and to evaluate their reporting (...) quality. Research design Literature search was performed on PubMed and Google Scholar. Qualitative content analysis and quantitative approaches were used to evaluate the systematic reviews. Characteristics of systematic reviews were extracted and quantitatively analyzed. The reporting quality was measured using an adapted PRISMA checklist. Findings Seventy-six reviews were selected for analysis. Most reviews came from the field of nursing (next to bioethics and medicine). Selected systematic reviews investigated issues related to clinical ethics (50%), followed by research ethics (36%) and public health ethics or organizational ethics (14%). In all, 72% of the systematic reviews included authors’ ethical reflections on the findings and 59% provided ethical recommendations. Despite the heterogeneous reporting of the reviews, reviews using PRISMA tended to score better regarding reporting quality. Discussion The heterogeneity currently observed is due both to the interdisciplinary nature of nursing ethics and bioethics, and to the emerging nature of systematic review methods in these fields. These results confirm the findings of our previous review of systematic reviews on normative literature, thereby highlighting a recurring methodological gap in systematic reviews of bioethical literature. This also indicates the need to develop more robust methodological standards. Conclusion Through its extensive overview of the characteristics of systematic reviews of empirical literature on ethical topics, this meta-review is expected to inform further discussions on minimal standards and reporting guidelines. This innovative approach to freedom starts from an account of what we mean by describing someone, in a psychological vein, as a free subject. Pettit develops an argument as to what it is that makes someone free in that basic sense; and then goes on to derive the implications of the approach for issues of freedom in political theory. Freedom in the subject is equated with the person's being fit to be held responsible and to be authorized as a partner (...) in interaction. This book is unique among contemporary approaches - although it is true to the spirit of classical writers like Hobbes and Kant - in seeking a theory that applies to psychological issues of free agency and free will as well as to political issues in the theory of the free state and the free constitution. The driving thesis is that it is only by connecting up the different issues of freedom, psychological and political, that we can fully appreciate the nature of the questions involved, and the requirements for their resolution. This paper explores the role of moral uncertainty in explaining the morally disruptive character of new technologies. We argue that existing accounts of technomoral change do not fully explain its disruptiveness. This explanatory gap can be bridged by examining the epistemic dimensions of technomoral change, focusing on moral uncertainty and inquiry. To develop this account, we examine three historical cases: the introduction of the early pregnancy test, the contraception pill, and brain death. The resulting account highlights what we call “differential (...) disruption” and provides a resource for fields such as technology assessment, ethics of technology, and responsible innovation. Many philosophers maintain that the ability to do otherwise is compatible with comprehensive divine foreknowledge but incompatible with the truth of causal determinism. But the Fixity of the Past principle underlying the rejection of compatibilism about the ability to do otherwise and determinism appears to generate an argument also for the incompatibility of the ability to do otherwise and divine foreknowledge. By developing an account of ability that appeals to the notion of explanatory dependence, we can replace the Fixity of (...) the Past with a principle that does not generate this difficulty. I develop such an account and defend it from objections. I also explore some of the account's implications, including whether the account is consistent with presentism. (shrink)

Assuming that states will remain a permanent feature of our world, what is the ideal that we should hold out for the international order? An attractive proposal is that those peoples that are already organized under non-dominating, representative states should pursue a twin goal: first, arrange things so that they each enjoy the republican ideal of freedom as non-domination in relation to one another and to other multi-national and international agencies; and second, do everything possible and productive to facilitate the (...) representation of less fortunate peoples in non-dominating states and to incorporate them in a non-dominating international order. This republican ideal stands midway between a utopian ideal of cosmopolitan justice and a sceptical ideal of non-intervention. This paper explores the truism that people think about what they say. It proposes that, to satisfy their own goals, people often plan their speech acts to affect their listeners' beliefs, goals, and emotional states. Such language use can be modelled by viewing speech acts as operators in a planning system, thus allowing both physical and speech acts to be integrated into plans. Methodological issues of how speech acts should be defined in a planbased theory are illustrated by defining operators (...) for requesting and informing. Plans containing those operators are presented and comparisons are drawn with Searle's formulation. The operators are shown to be inadequate since they cannot be composed to form questions (requests to inform) and multiparty requests (requests to request). By refining the operator definitions and by identifying some of the side effects of requesting, compositional adequacy is achieved.The solution leads to a metatheoretical principle for modelling speech acts as planning operators. The basic income proposal provides everyone in a society, as an unconditional right, with access to a certain level of income. Introducing such a right is bound to raise questions of institutional feasibility. Would it lead too many people to opt out of the workforce, for example? And even if it did not, could a constitution that allowed some members of the society to do this – at whatever relative cost – prove acceptable in a society of mutually reciprocal, equally (...) positioned members? I assume in this short essay, however, that none of these problems is insurmountable. I concentrate on the question of how far republicanism makes room for justifying something like a right to basic income, assuming that there are no problems of this kind with introducing and establishing such a right. As an alternative to establishing awareness thresholds, stimulus contexts in which there were either greater conscious or greater unconscious influences were defined on the basis of performance on an exclusion task. Target words were presented for brief durations and each target word was followed immediately by its three-letter stem. Subjects were instructed to complete each stem with any word other than the target word. With this task, failures to exclude target words indicate greater unconscious influences, whereas successful exclusion indicates greater (...) conscious influences. Conscious influences were dominant at long durations , but unconscious influences were dominant at short durations . Performance on the exclusion task successfully predicated both qualitative differences in Stroop priming and qualitative differences in recognition memory previously associated with the different effects of conscious and unconscious influences. Taken together, these results demonstrate that an exclusion task allows both unconscious and conscious influences to be defined in terms of significant deviations from baseline performance. As such, exclusion tasks provide a method for distinguishing conscious from unconscious influences that does not require establishing thresholds for null awareness. (shrink)

It is a priori on many accounts of colour concepts that something is red if and only if it is such that it would look red to normal observers in normal circumstances: it is such that it would look red, as we can say, under normal conditions of observation. And as this sort of formula is widely applied to colour concepts, so similar schemas are commonly defended in relation to a variety of other concepts too. Not only are colour concepts (...) connected in such a fashion with human responses, so by many accounts are secondary quality concepts in general; aesthetic concepts, moral concepts and evaluative concepts of all kinds; modal concepts that serve to pick out the possible and the necessary; and so on. The fashion for resorting to such formulas should not be surprising. Most of us suppose that whether a given, ostensively introduced term has a certain semantic value – whether, for example, it designates a certain property – ought to show up in people’s tending to use it of things, and only of things, that apparently have that property. The obvious way of expressing this expectation is to require that the use of the ostensive term covary with the presence of the property in conditions that are normal in some sense for detecting that property. Thus there is prima facie reason to hold, and hold as an a priori matter, that for any ostensively introduced term, ‘P’, something is P if and only if it is such that it would seem P – people would be disposed to use ‘P’ to ascribe the corresponding property to it – under normal conditions of observation. The schemas invoked under this motivation may vary in many different ways, of course. The principle of alternative possibilities tells us that an agent is morally responsible for an action only if he could have done otherwise. Frankfurt-style cases provide an extremely influential challenge to the PAP . And Frankfurt-style compatibilists are motivated to accept compatibilism about responsibility and determinism in part due to FSCs. But there is a significant tension between our judgments about responsibility in FSCs and our judgments about responsibility in certain omissions cases. This tension has thus far largely been treated (...) as an internal puzzle for defenders of FSCs to solve. My goal here is to regiment this tension into a clear argument which undermines the FSC based critique of PAP. I will also argue that there is an in principle reason to doubt that Frankfurt-Style Compatibilists will be able to successfully respond to my argument. (shrink)

I aim to illuminate foundational epistemological issues by reflecting on ‘epistemic consequentialism’—the epistemic analogue of ethical consequentialism. Epistemic consequentialism employs a concept of cognitive value playing a role in epistemic norms governing belief-like states that is analogous to the role goodness plays in act-governing moral norms. A distinction between ‘direct’ and ‘indirect’ versions of epistemic consequentialism is held to be as important as the familiar ethical distinction on which it is based. These versions are illustrated, respectively, by cognitive decision-theory and (...) reliabilism. Cognitive decision-theory is defended, and various conceptual issues concerning it explored. A simple dilemma suggests that epistemic consequentialism has radical consequences. (shrink)

Imagine a human society, perhaps in pre-history, in which people were generally of a psychological kind with us, had the use of natural language to communicate with one another, but did not have any properly moral concepts in which to exhort one another to meet certain standards and to lodge related claims and complaints. According to The Birth of Ethics, the members of that society would have faced a set of pressures, and made a series of adjustments in response, sufficient (...) to put them within reach of ethical concepts. Without any planning, they would have more or less inevitably evolved a way of using such concepts to articulate desirable patterns of behavior and to hold themselves and one another responsible to those standards. Sooner or later, they would have entered ethical space. While this central claim is developed as a thesis in conjectural history or genealogy, the aim of the exercise is philosophical. Assuming that it explains the emergence of concepts and practices that are more or less equivalent to ours, the story offers us an account of the nature and role of morality. It directs us to the function that ethics plays in human life and alerts us to the character in virtue of which it can serve that function. The emerging view of morality has implications for the standard range of questions in meta-ethics and moral psychology, and enables us to understand why there are divisions in normative ethics like that between consequentialist and Kantian approaches. Examines what is necessary for a group to constitute an agent that can display akrasia, and what steps such a group might take to establish self‐control. The topic has some interest in itself, and the discussion suggests some lessons about how we should think of akrasia in the individual as well as in the collective case. Under the image that the lessons support, akrasia is a sort of constitutional disorder: a failure to achieve a unity projected in the avowal of (...) agency. This paper reviews the history of psychological investigations of unconscious perception and summarizes the current status of experimental research in this area of investigation. The research findings described in the paper illustrate how it is possible to distinguish experimentally between conscious and unconscious perception. The most successful experimental strategy has been to show that a stimulus can have qualitatively different consequences on cognitive and affective reactions depending on whether it was consciously or unconsciously perceived. In addition, recent studies of patients (...) undergoing general anaesthesia have shown that the effects of stimuli perceived unconsciously during surgery can last for approximately 24 hours. Taken together, the results of these recent psychological investigations provide empirical support for the importance of unconsciously perceived information in determining cognitive and affective reactions. David Lewis [1988; 1996] canvases an anti-Humean thesis about mental states: that the rational agent desires something to the extent that he or she believes it to be good. Lewis offers and refutes a decision-theoretic formulation of it, the 'Desire-as-Belief Thesis'. Other authors have since added further negative results in the spirit of Lewis's. We explore ways of being anti-Humean that evade all these negative results. We begin by providing background on evidential decision theory and on Lewis's negative results. We (...) then introduce what we call the indexicality loophole: if the goodness of a proposition is indexical, partly a function of an agent's mental state, then the negative results have no purchase. Thus we propose a variant of Desire-as-Belief that exploits this loophole. We argue that a number of meta-ethical positions are committed to just such indexicality. Indeed, we show that with one central sort of evaluative belief--the belief that an option is right--the indexicality loophole can be exploited in various interesting ways. Moreover, on some accounts, 'good' is indexical in the same way. Thus, it seems that the anti-Humean can dodge the negative results. (shrink)

John Broome’s Rationality Through Reasoning is a trail-blazing study of the nature of rationality, the nature of reasoning and the connection between the two. But it may be somewhat misleading in two respects. First, his theory of reasoning is consistent with the meta-propositional view that he rejects; it develops a broadly similar theory but in much greater detail. And while his discussion of rule-following helps to explain the role of rules in reasoning, it does not constitute a response to the (...) classic problem associated with Wittgenstein and Kripke. I argue that moral dialogue concerning an agent’s standing to blame facilitates moral understanding about the purported wrongdoing that her blame targets. Challenges to a blamer’s standing serve a communicative function: they initiate dialogue or reflection meant to align the moral understanding of the blamer and challenger. On standard accounts of standing to blame, challenges to standing facilitate shared moral understanding about the blamer herself: it matters per se whether the blamer has a stake in the purported wrongdoing at issue, (...) is blaming hypocritically, or is complicit in the wrongdoing at issue. In contrast, I argue that three widely recognized conditions on standing to blame—the business, non-hypocrisy, and non-complicity conditions—serve as epistemically tractable proxies through which we evaluate the accuracy and proportionality of blame. Standing matters because, and to the extent that, it indirectly informs our understanding of the purported wrongdoing that an act of blaming targets. (shrink)
