Educational philosophy helps to orient the educational development process of each country and develop the capacity of each individual in society. In the educational history of each country, there is always a process of preserving and transferring social heritages. The educational system prepares the next generation to enter society and imparts ideas, values, and beliefs that will shape young people’s thinking and behavior for the rest of their lives. Therefore, this article wishes to clearly and vividly clarify the importance (...) of studying Pragmatism’s educational philosophy to realize its present influence. At the same time, it is crucial to deeply understand the educational process of Pragmatism to derive meaning and clarify the primary function of educating Vietnamese people in the context of current global integration. The article uses the materialist dialectic method with broad and specific historical principles to evaluate Vietnamese education with opportunities and challenges in the current integration process by studying Pragmatism’s philosophical education. The article found that the theory of education by Pragmatism clarifies the role of social educational institutions – schools in the educational process. In parallel, it is a teacher with educational methods and programs that are the basis for educating learners to become comprehensive citizens in the future. And students are the goal and the product that the educational philosophy needs to implement. Research results, the article clarifies the need to develop an educational philosophy for Vietnamese people to build comprehensively in the socialist orientation in the current globalization context. This study contrasts the evidence exclusion principles within the adversarial legal system of the United States, particularly the “fruit of the poisonous tree” doctrine, with the inquisitorial system of Vietnam. The U.S. model, emphasizing the exclusion of unlawfully obtained evidence to protect the presumption of innocence and ensure fair trials, relies on the Fourth Amendment to prevent police misconduct. Conversely, Vietnam, with its focus on uncovering the truth, has started to adopt adversarial elements, including evidence exclusion, to align with international (...) standards and enhance human rights protections within its criminal justice system. The research examines the application of the “fruit of the poisonous tree” doctrine in the U.S. and its implications for Vietnamese legal reforms, especially the proposed amendments to Article 87 of Vietnam's Criminal Procedure Code. These reforms aim to exclude unlawfully obtained evidence while allowing for the use of evidence collected independently from illegal actions. Highlighting the need for a balanced approach that respects procedural rights and promotes justice, the study advocates for comprehensive legal reforms in Vietnam. It suggests amendments to refine evidence exclusion principles, ensuring they reflect both the Vietnamese context and the progressive features of U.S. criminal justice practices, thereby enhancing the fairness and integrity of criminal proceedings. Crime victims are forgotten in criminal proceedings. Criminal justice systems tend to treat crime victims quite poorly, but, when they deal with child victims, their frequent failure to respect the child’s rights finds no excuse. Law enforcement and criminal justice interventions made in the name of protecting children against violent crime often fail to consider what is truly in the best interests of the child and end up further victimizing the child victims. Vietnam has instituted justice reforms that recognize the (...) need for special measures to protect the rights of child victims and witnesses of crime. This article reviews the progress achieved in implementing these reforms and points at several areas where implementation has been slow or further reforms are needed. Based on a comparative legal analysis, the article exemplifies how legal semiotics can contribute to an understanding of the complexity of policy transfer in the area of justice and human rights. History of political ideology in Vietnam.

Hòa Hảo Buddhism belongs to that traditional lay and frugal buddhism encouraging practicing at home (tu tại gia) while being engaged with the world (nhập thế). It appeared in Southern Vietnam at the end of the 1930’s. Obviously, colonial contest and economic depression have played the part of a powerful catalyst in the spread by a young charismatic and reformist character of this millenarianism. Then, during three decades of postcolonial and cold wars (1945–1975), this New Religious movement hardly expressed its (...) Buddhist ethic of social statements in order to lend moral support and material protection to the local peasantry. Eventually, at the end of the war, this autonomous Buddhist community finally tried to morph again into a legal religion at a time when the Vietnamese Communist Party had to urgently impose a new sovereign socialist republic (1976). In other words, the new regime had to reunify the Nation and build a new secular state. In the southern part of the country, the replacement of a former liberal regime (Republic of Vietnam) by a socialist republic (called formerly a Democratic Republic in Northern Vietnam) completely changed the nature of the State-Church relations. Therefore, many religious groups’ agencies suffered a drastic blow as these groups were subordinated to the Patriotic Front and its mass organizations. Nevertheless, in 1991, the reorientation of the religious policy officially reaffirmed the religions’ social utility. Since then, new debates emerged to define the nature of the social actions of religious groups and then to delineate the legal sphere of their activities in this secular state. This essay intends to question how the two notions of being engaged with the world (nhập thế) and that of the secular state (nhà nước trung lập thế tục) interacted during these last decades. To tackle this pivotal issue, we focused on the specific implementation of Hòa Hảo social activism, from 1940’s until now, to underline how this activism evolved under different political regimes and how a new culture of social service has been promoted since the Hòa Hảo official church was recognized in 1999 and achieved years later. It questions more generally how religious groups can negotiate with the state for the emergence of a civil society or, at least, for the acceptance of their own tribute to the prosperity of the Nation. In recent years, the Neo-Kantian movement has received wide acknowledgment as the hidden origin of several contemporary philosophical discussions. This paper focuses on one specific Neo-Kantian topic; namely, the idea of history put forward by Wilhelm Windelband. Even though this topic could be seen as one of the better-known Neo-Kantianism themes, there are certain unnoticed elements in Windelband’s treatment of history that merit further discussion. While the texts in which Windelband deals with the logical problems of the historical (...) sciences have been studied at length, other texts, those in which history is studied in connection with the problem of the philosophical method, have not. This paper argues that, for Windelband, history is not merely an object of epistemological reflection but rather a key component of transcendental philosophy. (shrink)

This book surveys the vast body of medieval Jewish philosophy, devoting ample discussion to major figures such as Saadiah Gaon, Maimonides, Abraham Ibn Ezra, Judah Halevi, Abraham Ibn Daoud, and Gersonides, as well as presenting the ancillary texts of lesser known authors. Sirat quotes little-known texts, providing commentary and situating them within their historical and philosophical contexts. A comprehensive bibliography directs the reader to the texts themselves and to recent studies.

What are the relationships between philosophy and the history of philosophy, the history of science and the philosophy of science? This history is designed to present a dynamic approach to the study of ancient and medieval philosophy. It correlates ancient, medieval, and modern ideas and shows the perennial significance of the contributions of ancient thinkers.

In his disputatio, Johann Peter von Ludewig provides a history of rational philosophy among the Arabs and sets out to contextualize the Turks’ attitude to it. Like many Lutheran scholars of the time, Ludewig believed that Islam, as a religion, impeded the development of rational philosophy in the Arab world. However, unlike those philosophers, he examines external influences that may have fed the interest of Arab Muslims in rational philosophy, especially dialectic. Unlike Orthodox Lutherans, such as Pfeiffer and Kromayer, (...) in his conclusion, Ludewig prays that Muslim philosophers cultivate reason to overcome the "deceit of Muhammadanists" toward rational worship. The use of the contentious and seemingly oxymoronic phrase “rational worship” (logikē latreia: λογική λατρεία, from Rom. 12:1), combining “rationality” and “worship” together refects, to a certain extent, the Enlightenment belief that reason could be used to understand the nature of God against any type of irrational religiosity. The idea of worshipping God rationally and equating God with reason shows the intellectual engagement of Protestant scholars with Enlightenment rationalism. (shrink)

This paper uses analogies between Socratic and Wittgenseinian dialogues to argue that analytic philosophy of history should not be abandoned. -/- In their responses to my paper ‘In Defence of Four Socratic Doctrines’ James Warren and John Shand raised a number of important methodological objections, relating to the study of the history of philosophy. I here respond by questioning the supremacy of contextualist history of philosophy over the so-called ‘analytic’ approach. I conclude that the history of (...) ideas had better leave space for both approaches, and that it is a mistake to think of each as being in competition with the other. (shrink)

The transcripts of the three Kyoto School roundtable discussions of the theme of 'The standpoint of world history and Japan' may now be judged to form the key source text of responsible Pacific War revisionism. Published in the pages of Chuo Koron, the influential magazine of enlightened elite Japanese opinion during the twelve months after Pearl Harbor, these subversive discussions involved four of the finest minds of the second generation of the Kyoto School of philosophy. Tainted by controversy and (...) shrouded in conspiratorial mystery, these transcripts were never republished in Japan after the war, and they have never been translated into English except in selective and often highly biased form. David Williams has now produced the first objective, balanced and close interpretative reading of these three discussions in their entirety since 1943. This version of the wartime Kyoto School transcripts is neither a translation nor a paraphrase but a fuller rendering in reader-friendly English that is convincingly faithful to the spirit of the original texts. Schelling’s System of Transcendental Idealism is usually considered to be either (1) an early Fichtean-influenced work that gives little insight into Schelling’s philosophy or (2) a text focusing on self-consciousness and aesthetics. I argue that Schelling’s System develops a subtle conception of history which originates in a dialogue with Kant and Hegel (concerning the question of teleology) and concludes in proximity to an Idealist version of Spinoza.
