The paper purports to provide an analytical treatment of the truth and legal interpretation issue. In the first part, it lays down a conceptual apparatus meant to capture the main aspects of the legal interpretation phenomenon, with particular attention paid to the several kinds of linguistic outputs resulting from interpretive activities. In the second part, it recalls three different notions of truth, focussing, so far as systemic truth is concerned, on the difference between deductive and rhetorical normative systems. In the (...) third, and last, part, it shows in which ways the phenomenon of legal interpretation encompasses truth-apt entities, leaving the choice between austere and liberal alethic pluralism to the reader. In this paper the relationship between Gaia theory and fact/value dualism must be understood from two angles: I shall use Gaia as a case study to show the philosophical limits of dualism, and I shall also use the discussion of fact/value dualism to clarify the contents of Gaia theory. My basic thesis is that Lovelock is right when rejecting the suggestion that he should clear his theory of evaluative considerations. He is right because in his theory facts and moral values (...) are strictly interwoven and therefore cannot be conceptually separated. I shall show this point by arguing that if we dropped the evaluative components from Gaia theory we would not have the same theory cleared of those evaluative components. Instead we would have a theory with a different empirical meaning and different explanatory characteristics. (shrink)

The aim of our study is to test the fit of an explanatory model of the frequency of the phenomenon of choking under pressure in archers, focusing on both the individual components (anxiety, coping styles, and decentralization) and environmental components (perception of coach assistance). 115 competitive athletes including 72 males (62.6%) and 43 females (37.4%) participated in the study, with average age of 39 years (±15.47). Participants reported personal data and completed measures of self-consciousness, anxiety, coping styles, and decentering. The (...) ruminative component of concern was found to be the factor directly influencing the frequency of choking episodes in performance. Two significant mediations of personal coping style were also identified on the effects of anxiety on brooding thinking and on the athlete's ability to decentralize. The latter personal self-regulative component has been shown to be able to strongly limit the frequency of choking under pressure. Finally, among the environmental components, a further facilitating influence for the athlete resulted in the perception of being supported by the coach. The results therefore suggest that the athlete in choking should not face alone the hard upcoming period, but should preferably be supported with an articulated program focused on the cognitive remodeling of disturbing thoughts, on the strengthening of the capacity of decentralization, on the enhancement of the relationship of support and trust with the coach. I discuss a difficulty concerning the justification of the Axiom of Choice in terms of such informal notions such as that of iterative set. A recent attempt to solve the difficulty is by S. Lavine, who claims in his Understanding the Infinite that the axioms of set theory receive intuitive justification from their being self-evidently true in Fin(ZFC), a finite counterpart of set theory. I argue that Lavine's explanatory attempt fails when it comes to AC: in this respect Fin(ZFC) is (...) no better off than the iterative notion. (shrink)

L’immanence de l’analyse a été une base méthodologique importante pour une éthique de l’interprétation, en retenant le texte comme la plateforme critique où les actes de communication doivent converger selon le principe régulateur de la consistance sémantique de l’entente ou du différend. Le périmètre textuel devrait fonctionner comme le plan d’homogénéisation des tensions herméneutiques potentiellement hétérogènes. Toutefois, l’hétérogénéité ne peut qu’émerger de nouveau dans la textualité; par exemple, pendant l’expérience perceptive de l’oeuvre d’art, les signifiants peuvent devenir des interprétants du (...) texte en démarrant d’autres articulations sémiotiques, détachées des grammaires qui ont permis l’accès prioritaire à la signification. La délimitation de l’objet artistique est déjà une question interprétative, l’oeuvre habitant déjà un espace d’implémentation publique où elle est en relation avec d’autres identités culturelles. Par ailleurs, on connait bien la question classique de l’intertextualité, tout comme la présence d’une intentionnalité liée au cadre pratique de la production historique de l’oeuvre. Aujourd’hui, les développements des études sur l’oeuvre d’art peuvent dépasser la simple accumulation des problématiques et la parataxe d’applications disciplinaires, afin de repérer une syntaxe d’approches coordonnées. Cette visée a besoin avant tout d’interconnecter les distinctions entre perception, interprétation, analyse et usage de l’oeuvre d’art avec les différentes déterminations spatiales de cette dernière : l’énoncé, l’énonciation, l’intertexte, l’espace d’implémentation. Dans les traditions juives et chrétiennes, on trouve, à côté d�un ensemble d�écrits canoniques (ensemble dont la définition précise varie d�ailleurs selon les communautés), toute une littérature «deutéro-canonique» (ou «apocryphe») et pseudépigraphe. Depuis longtemps, les spécialistes � en particulier dans le monde anglo-saxon � ont pris l�habitude d�analyser cette littérature sous l�angle de la «réécriture» des traditions bibliques. Cette approche soulève toutefois plusieurs difficultés, en particulier parce qu�elle tient pour acquise la fixation des traditions bibliques au moment où se constitue (...) ce qui deviendra la littérature «apocryphe». Au contraire, en dialogue avec plusieurs travaux récents, l�étude suivante défend et illustre l�idée qu�il convient d�approcher le problème du point de vue de la mise en place progressive de «traditions mémoriales» dans le judaïsme et le christianisme anciens. Dans ce processus complexe, le phénomène de la réécriture ne reflète pas nécessairement la soumission à un original considéré comme «autoritaire» ou normatif, mais témoigne bien plutôt de la très grande fluidité des traditions «scripturaires» recueillies par les communautés à cette époque. The volume collects the most important papers Pierluigi Donini wrote in the last three decades with the aim of promoting a better assessment of post-hellenistic philosophy. The philosophical relevance of post-hellenistic philosophy is now widely (though not yet universally) recognized. Yet much remains to be done. The common practice of focusing each single school in itself detracts from a balanced assessment of the strategies exploited by many philosophers of the period. On the assumption that debates among schools play a (...) major role in the philosophy of the commentators, Donini concentrates on the interaction between leading Aristotelians and Platonists and demonstrates that the developments of both systems of thought were heavily influenced by a continuous confrontation between the two schools.And whereas in cases such as Alcinous and Aspasius this is basically uncontroversial, for other authors such us Alexander, Antiochus and Plutarch the pioneering work of Donini paves the way for a better understanding of their doctrines and definitely confirms the intellectual importance of the first imperial age, when the foundations were laid of versions of both Aristotelianism and Platonism which were bound to influence the whole history of European thought, from Late Antiquity onwards. This book engages in an analytical and realistic enquiry into legal interpretation and a selection of related matters including legal gaps, judicial fictions, judicial precedent, legal defeasibility, and legislation. Chapter 1 provides an outline of the central theoretical and methodological tenets of analytical realism. Chapter 2 presents a conceptual apparatus concerning the phenomenon of legal interpretation, which it subsequently applies to investigate the truth-in-legal-interpretation issue. Chapters 3 to 6 argue for a theory of legal interpretation - pragmatic realism - by (...) outlining a theory of interpretive games, revisiting the debate between literalism and contextualism in contemporary philosophy of language, and underscoring the many shortcomings of the container-retrieval view and pragmatic formalism. In turn, Chapter 7, focusing on comparative legal theory, advocates an interpretation-sensitive theory of legal gaps, as opposed to purely normativist ones. Chapter 8 explores the connection between judicial reasoning and judicial fictions, casting light on the structure and purpose of fictional reasoning. Chapter 9 provides an analytical enquiry into judicial precedent, examining a variety of ideal-typical systems in terms of their normative or de iure relevance. Chapter 10 addresses defeasibility and legal indeterminacy. In closing, Chapter 11 highlights the central tenets of a realistic theory of legislation. (shrink)

The successes and failures of the past will contribute to a more speedy solutions of the notational problems of the present times.Questa storia, ovviamente, coinvolge anche le (...) notazioni della logica. Il presente contributo intende proporre un nuovo insieme di simboli per una particolare teoria logica: la Mereologia Formale, in considerazione del fatto che questa teoria, pur avendo avuto trattazioni sistematiche, non ha allo stato attuale ancora raggiunto un sistema di notazioni condiviso dagli studiosi. Tale stato dell’arte è espressione, da un lato, di un legame della teoria al suo nascere con la notazione polacca, e del suo confronto con la Teoria Assiomatica degli Insiemi; dall’altro, del fatto che essa ha ricevuto solo in tempi recenti sistematiche applicazioni alle scienze.94 In tale prospettiva ho ritenuto necessario definire in primo luogo dei criteri attraverso cui procedere alla costruzione del sistema di simboli. The paper offers a comparison between the legal theory of normative facts on the one hand, and Bruno Celano’s theory of pre-conventions on the other, suggesting two ways that the latter may be of use to well-meaning jurists.

The economics of happiness is an influential research programme, the aim of which is to change welfare economics radically. In this paper I set out to show that its foundations are unreliable. I shall maintain two basic theses: (a) the economics of happiness shows inconsistencies with the first person standpoint, contrary claims on the part of the economists of happiness notwithstanding, and (b) happiness is a dubious concept if it is understood as the goal of welfare policies. These two theses (...) are closely related and lead to a third thesis: (c) happiness should be replaced by autonomy as the fundamental goal of welfare economics. To defend my claims I shall show that a hedonic approach to happiness leads to an awkward trilemma. Furthermore, I shall clarify the meaning of and , along with their conceptual relationships. Lotman and Barthes created two different critically oriented semiotic traditions. Both of them wen t through an evolution in their thought, moving from systematic organization to living transformations in cultural systems. This allowed them to carry out a bilateral critique of codes and identities in favour of either anonymous hybridity (Lotman) or neutrality (Barthes), where heterogeneity becomes a principle of creative “disorder”. Though quite different as regards their theoretical production, both scholars meet in their refusal to turn descriptive practices (studium) (...) into a model of any other form of behaviour, considering that the determination of textual or institutional perimetres is not always clear. In short, Barthes and Lotman anticipated current research trends on the semiotics of practices; Barthes because of a sort of self-reflexion on the behaviour of the interpreter in front of an object, and Lotman through his analytic interest in attitudes and ways of living.Barthes’s view on writing essentially reaches Lotman’s conception of culture as a “collective person”: we are looking for traces of breathing in the life of signs. More precisely, we can assert that, in the view of both scholars, inscribing speech events in history problematizes the dynamic and asynchronous relation between the structural frame of a culture and its textual heritage. The rhythm of fashion is not a side topic in their research, but, rather, it is the clearest exemplification of a dialectic between structural projection from the outside and local introjection of forms, depending on the conditions that make a difference. In this article the author provides new external evidence demonstrating that the correspondence between the philosopher Seneca and the apostle Paul is a forgery. The author compares archaeological data offered by inscriptions, graffiti and regionarii with information conveyed by the apocryphal letters. The setting of the epistles, as well as information about the duration and damages of the Neronian fire, contrast with the archaeological data, indicating that the text should be considered a forgery. The contribution shows that the forger worked (...) rather in a literary mode. Conversely, the only archaeological date that scholars have brought to support authenticity is probably not a Christian inscription and does not prove anything regarding a meeting between Seneca and Paul or Seneca’s conversion. The origin of the correspondence should instead be traced to the cult of the apostles Paul and Peter during the 3rd and 4th centuries. (shrink)

In recent years, the veracity of the tradition of the martyrdom of the apostles Peter and Paul has been disputed; recently, Brent Donald Shaw denied the historicity of the persecution of Christians. In this article, the author analyzes the texts of Tacitus and Suetonius as well as other texts omitted by Shaw and demonstrates the inconsistency of the hypotheses put forward by negationist scholars from a theoretical and historical point of view.

This volume presents philosophy of science at its best, i.e. as a philosophical questioning informed by current scientific research, which carefully assesses and evaluates its commitments and consequences. As such it represents philosophy simpliciter at its best, for it is concerned with and dares to ask fundamental questions about the nature of the results of the natural sciences, arguably our most reliable sources of knowledge of the world. The contributions collected in this volume make clear that a philosophy that is (...) disconnected from science is sterile and that the practice of science that is disconnected from a philosophical attempt to understand the natural world in its most general features is blind. Throughout the book we are confronted with questions about the nature of species, numbers, space, time, matter, consciousness and so on. Taking seriously these questions, along with other open problems in philosophy of sciences, and keeping the dialogue between science and philosophy wide open, is likely to be our best bet for a deeper understanding of what surrounds us. The book has a further, deeply important merit. Being the result of a post-graduate conference, it brings together not only leading, long established experts in the field but also new, young researchers, who usually find too small a place within the academic environment. Promoting exactly this kind of interaction is an essential step in constructing a new paradigm for an open, collaborative and fruitful scientific community. (shrink)

It has often been remarked that the metatheory of strong reduction $\succ$ , the combinatory analogue of βη-reduction ${\twoheadrightarrow_{\beta\eta}}$ in λ-calculus, is rather complicated. In particular, although the confluence of $\succ$ is an easy consequence of ${\twoheadrightarrow_{\beta\eta}}$ being confluent, no direct proof of this fact is known. Curry and Hindley’s problem, dating back to 1958, asks for a self-contained proof of the confluence of $\succ$ , one which makes no detour through λ-calculus. We answer positively to this question, by extending (...) and exploiting the technique of transitivity elimination for ‘analytic’ combinatory proof systems, which has been introduced in previous papers of ours. Indeed, a very short proof of the confluence of $\succ$ immediately follows from the main result of the present paper, namely that a certain analytic proof system G e [ $\mathbb {C}$ ] , which is equivalent to the standard proof system CL ext of Combinatory Logic with extensionality, admits effective transitivity elimination. In turn, the proof of transitivity elimination—which, by the way, we are able to provide not only for G e [ $\mathbb {C}$ ] but also, in full generality, for arbitrary analytic combinatory systems with extensionality—employs purely proof-theoretical techniques, and is entirely contained within the theory of combinators. We introduce a certain extension of -calculus, and show that it has the Church-Rosser property. The associated open-term extensional combinatory algebra is used as a basis to construct models for theories of Explict Mathematics (formulated in the language of "types and names") with positive stratified comprehension. In such models, types are interpreted as collections of solutions (of terms) w.r. to a set of numerals. Exploiting extensionality, we prove some consistency results for special ontological axioms which are refutable under elementary comprehension.

L’essai traite l’héritage de l’idéalisme allemand chez Rosenzweig dans la perspective particulière de la théorie de la reconnaissance. Dans le premier paragraphe il trace les contours d’une théorie de la reconnaissance dans L’Étoile de la Rédemption à travers le thème du temps dans le rapport entre aimant et aimée, les formes du langage de la reconnaissance et la communauté comme résultat de la reconnaissance ouverte envers la rédemption. Le deuxième paragraphe développe une confrontation synthétique avec les modèles fichtéen et hégélien (...) de la reconnaissance pour montrer qu’on peut utilement lire Rosenzweig du point de vue d’une théorie de la reconnaissance et lire les théories idéalistes de la reconnaissance du point de vue de Rosenzweig. La conclusion met en lumière quelques idées fondamentales de Schelling à la base des points décisifs de l’originalité de la théorie de Rosenzweig centrée sur l’amour capable de vaincre la mort. This study was aimed at predicting individual differences in text reading fluency. The basic proposal included two factors, i.e., the ability to decode letter strings (measured by discrete pseudo-word reading) and integration of the various sub-components involved in reading (measured by Rapid Automatized Naming, RAN). Subsequently, a third factor was added to the model, i.e., naming of discrete digits. In order to use homogeneous measures, all contributing variables considered the entire processing of the item, including pronunciation time. The model, which (...) was based on commonality analysis, was applied to data from a group of 43 typically developing readers (11- to 13-year-olds) and a group of 25 chronologically matched dyslexic children. In typically developing readers, both orthographic decoding and integration of reading sub-components contributed significantly to the overall prediction of text reading fluency. The model prediction was higher (from ca. 37% to 52% of the explained variance) when we included the naming of discrete digits variable, which had a suppressive effect on pseudo-word reading. In the dyslexic readers, the variance explained by the two-factor model was high (69%) and did not change when the third factor was added. The lack of a suppression effect was likely due to the prominent individual differences in poor orthographic decoding of the dyslexic children. Analyses on data from both groups of children were replicated by using patches of colours as stimuli (both in the RAN task and in the discrete naming task) obtaining similar results. We conclude that it is possible to predict much of the variance in text-reading fluency using basic processes, such as orthographic decoding and integration of reading sub-components, even without taking into consideration higher-order linguistic factors such as lexical, semantic and contextual abilities. The approach validity of using proximal vs distal causes to predict reading fluency is discussed. (shrink)

The essay provides a critical assessment of the objections raised, especially by P. Destrée, against the cognitivistic interpretation of the pleasure of tragedy. It is pointed out that in the Poetics, chapter 4, it is unsound to distinguish between the pleasure of artistic imitation and the child’s pleasure for learning through imitation or the pleasure of the philosopher engaged in theoria. Moreover, the reference to children and philosophers proves that it is uncorrect to distinguish in the verb manthanein between the (...) meaning “to understand” and “to learn” and to say that the latter does not fit the example of painting. Consequently, this example cannot mean that contemplating the picture has as its only out-come a trivial recognition of the identity of the real object and the painted subject-matter. Actually, the tragedy’s audience sees in the plot a case which is exemplary (because it is universal) for particular actions and states of affair already known; and of these situations the audience understands and learns the causes with pleasure. Also the position of chapter 4 in the opening section of the book (chapters 1-5), which is entirely devoted to a general treatment of mimesis, confirms that all is said there of the pleasure must be a general premise for the treatment of all particular kind of pleasure recorded in the book: consequently, for the treatment of tragic pleasure in chapter 14 as well. L’examen de quelques textes clés de Flavius Josèphe et des écrits apocalyptiques contemporains permet de mieux comprendre quelles étaient les attentes des milieux radicaux judéens et quelle était la perception que les Romains pouvaient avoir de ceux qui, à leurs yeux, n’étaient que des agitateurs et des brigands. | : Tacitus is the only witness to the persecution of the “Christians” in Rome following the famous fire of 64 CE that severely burned the capital city ; a catastrophe for which Nero would have been considered responsible had the followers of that “most mischievous superstition” of Judean origins not been identified as the culprits. If, on the one hand, it is easy to understand the urgency for the imperial power to find scapegoats, on the other hand, it is not so easy to imagine the reasons why the members of a Judean sectarian, marginal group were eventually chosen. A new look at a series of key passages from the writings of Josephus and contemporary apocalyptic texts allow us to have a better understanding of the expectations at work among the members of Judean radical groups, as well as the perception that Romans could have had of those who, in their opinion, were simply agitators and bandits. In termini più generali si afferma che il bello, il buono e il vero sono tutti elementi essenziali per comprendere le attività che caratterizzano la scienza. Si tratta di questioni importanti culturalmente e politicamente. Capirle (...) sino in fondo significa comprendere la natura della scienza e il suo ruolo nel mondo d’oggi. (shrink)
