This essay examines theoretical arguments surrounding the use of post-colonial theory as a way to fill in the epistemological lacuna in the studies of post-socialism. It reviews the various streams of this theoretical development and employs Edward Said’s notion of “traveling theory” to demonstrate that theoretical claims made by proponents and opponents of this particular comparative perspective are historically, socially, and geographically situated, although not fixed. Disciplinary, national, and institutional affiliations, instead of theoretical justifications, are identified as (...) important factors in the propensity to accept or resist the introduction of post-colonial perspective on Central and Eastern Europe and the former Soviet Union. The essay concludes by acknowledging the potential usefulness as well as the limits of post-colonialism in the conceptualization of the post- socialist space. (shrink)

Indigenous cultures of North America confronted a problem of knowledge different from that of canonical European philosophy. The European problem is to identify and overcome obstacles to the perfection of knowledge as science, while the Indigenous problem is to conserve a legacy of practice fused with a territory. Complicating the difference is that one of these traditions violently colonized the other, and with colonization the Indigenous problem changes. The old problem of inter-generational stability cannot be separated from the post- (...) class='Hi'>colonial problem of sovereignty in the land where the knowledge makes sense. I differentiate the question of the value of knowledge (Part One), and its content (Part Two). The qualities these epistemologies favor define what I call ceremonial knowledge, that is, knowledge that sustains a ceremonial community. There is no safe place and no single locus of enunciation from where the uni-versal could be articulated for all and forever. Hindu nationalism and Western neo-liberalism are entangled in a long history of the logic of coloniality (domination, oppression, exploitation) hidden under the rhetoric of modernity (salvation, civilization, progress, development, freedom and democracy). There are, however, needs and possibilities for Indians and Western progressive intellectuals working together to undermine and supersede the assumptions that liberal thinkers in the West are (...) better placed to understand what is the common good better than Indian thinkers in post-partition India. Science, in the last analysis, doesn't carry in itself an ethics and politics. Therefore, it is doubtful to argue that science is beyond both, and only concerned with the advancement of the frontier of knowledge and understanding. Science could be (like Christianity, Hinduism, Liberalism or Marxism) both imperial and liberating. Knowledge and understanding, rather than science; gnoseology rather than epistemology, should be thought out as which the horizon toward a dialogical and critical cosmopolitanism (e.g., pluriversallity as universal project), could be envisioned beyond East and West, Hindu nationalism and Westertn (neo) liberalism. Feminist and post-colonial epistemologists, philosophers of science, and thinkers more generally may find themselves in a distinct form of difficult situation regarding their access to and authority over knowledge within the academic world. Because feminist and post-colonial approaches to knowledge require an acute awareness of relations of domination and the ways in which these pervade the social and epistemic world, it is often difficult to know how to proceed in making theory. These theorists are in particularly (...) ripe positions to benefit from what philosopher-physicist Karen Barad offers us. In this paper, I engage with parts of Karen Barad’s theory of agential realism, both critically and self-reflexively. I assert that allowing Barad’s theory to inform and structure our thinking and language makes knowers better able to meet certain requirements of epistemological responsibility, particularly with regard to the ways we make theory. Moreover, I attempt to assert this in a way that is mindful of how her theory speaks to and accounts for my doing so. (shrink)

Arguing that ecological thinking can animate an epistemology capable of addressing feminist, multicultural, and other post-colonial concerns, this book critiques the instrumental rationality, hyperbolized autonomy, abstract individualism, and exploitation of people and places that western epistemologies of mastery have legitimated. It proposes a politics of epistemic location, sensitive to the interplay of particularity and diversity, and focused on responsible epistemic practices. Starting from an epistemological approach implicit in Rachel Carson’s scientific projects, the book draws, constructively and critically, (...) on ecological theory and practice, on (post-Quinean) naturalized epistemology, and on feminist and post-colonial theory. Analyzing extended examples from developmental psychology, from medicine and law, and from circumstances where vulnerability, credibility, and public trust are at issue, the argument addresses the constitutive part played by an instituted social imaginary in shaping and regulating human lives. In this paper, our analysis lays on two different levels. Firstly, we dis­cuss the central concepts of the early Russian structuralism within an epistemological framework focusing on the way in which linguistic knowledge is structured. In order to achieve this goal, we mobilize the concept of episteme developed by Michel Foucault in his works The Order of Things (1966) and The Archaeology of Knowledge (1969). This Foucauldian approach leads us to highlight a new epis­teme which is different from those that (...) Foucault described in the Order of Things. Secondly, we analyze the political and social impli­cations of this epistemological approach in the context of European and (post)colonial history. We highlight the material “action” of the linguistic knowledge under discussion. This second dimension of our approach is important insofar it represents a critic of the idea accord­ing to which the theoretical knowledge is separated from praxis. Our hypothesis is that the language constitutes a marker of particular so­cial interests, which are overdetermined by power relations. (shrink)

This book reflects on the role that the opposition to anti-Semitism has been playing in shaping political philosophy after the Holocaust. Its premise is that in post-Holocaust philosophy anti-Semitism has become a paradigm of evil ideology or politics, a negative Politeia. The analysis proceeds through critical readings in prominent political philosophers, from Adorno, Horkheimer, Jean-Paul Sartre and Hannah Arendt, to Alain Badiou and most recently Jean-Luc Nancy, as well as the debates and contemporary scholarship around them. Through these readings (...) the book develops a critical observation, demonstrating how post-Holocaust philosophy has identified the fundamental, epistemological evil of anti-Semitic thought not in thinking against Jews, but in thinking of Jews. In other words, so the book’s claim, what philosophy has been denouncing as anti-Semitic is the figure of “the Jew” in thought. The book thus reveals how it is paradoxically the opposition to anti-Semitism that has been generating in post-Holocaust philosophy a rejection of Jewish thought. With respect to this rejection, this book makes two claims: first, that in rejecting Jewish thought the opposition to anti-Semitism comes dangerously close to anti-Semitism; second, that at work in this rejection is a problematic understanding of the relations between politics and thought, i.e. a problematic “political epistemology”. It is the critique of this political epistemology, as foundational for contemporary political thought, which is the ultimate aim of the book. The book’s original contribution consists in offering the first systematic analysis of the contemporary philosophical problem of anti-Semitism and the opposition to anti-Semitism. It intervenes in current conversations on the relations between Western philosophy, anti-Semitism and Jewish thought, the relation between politics and truth, and the relations between religion and race, among others in the context of the critiques of orientalism and secularism as well as post-colonial theory. In this introduction the coordinators of the First Congress of Postcolonial Studies (Buenos Aires, 5th, 6th, 7th December 2012) review some of the main questions and guidelines which characterized the workshops. Starting from a heated debate on the categories and the epistemological proposals developed by postcolonial studies and decolonial feminism, the Congress accepted the challenge of producing a South/South dialogue through the consolidation of a space of interdisciplinary discussion in the different theorical fields inquiring post-colonial experience.

Decolonial/anti-colonial Black, Indigenous and Mestiza feminist movements and scholar-activists foreground how the oft-touted apocalypse that the Covid-19 pandemic heralds is not new, nor does it signify the great rupture into chaos that those from within modernity-coloniality often claim it to be. Rather Covid-19 is preceded by and will be out-lived by the apocalyptic anti-life onto-epistemological logics that are foundational to the (re)production of hetero-patriarchal capitalist-(settler) coloniality. However, one would commit the violence of reproduction of the epistemological logics and (ir)rationalities (...) constitutive of the current system if the story ended there. We have survived (despite our losses) and our survival points to the urgent necessity and responsibility of (critical) social theory to listen to the story of the pandemic from a Black/Indigenous genealogy and to begin the sense-making of the Covid-19 pandemic, from prior to this particular virus, outside, against and beyond the politics of knowledge of critical social theory itself. Thus, I invite you to journey to an affirmative re-enfleshment of reason and theory-making in relation to and dialogue with Black, Indigenous, and subaltern Mestiza feminist movements in southwest Colombia and in southeast so-called Australia in the unceded lands of the Awabakal and the Worimi. I explore this through the metaphor, the materiality, the cosmology and the herstory of the mangrove swamps a knowing-being otherwise (in)visible to the dehumanising gave of Whiteness and bring to thought three stories of a politics of knowledge of/as the Black/racialised and feminised body/flesh. To do this is to suggest that the co-creation of pathways which are life affirming and life making beyond and out of the post-Covid 19 conjuncture involves an epistemological-political project which decolonises and feminises the containments of reason and knowing (non)being of coloniality/modernity. This article introduces some of the key philosophical contributions of W. E. B. Du Bois. Du Bois studied with Santayana and William James (among others), but chose social science, social theory, journalism, and activism over academic philosophy. Despite this detour, the philosophic depth of his work has won the attention of scholars in fields such as history, English, post‐colonial theory, African‐American Studies, American philosophy, and Africana philosophy, and it has belatedly begun to attract the interest of philosophers more (...) generally. This brief overview will explore the philosophical dimensions of some of Du Bois’s best‐known positions – his claims about the ‘color line’ and the Talented Tenth, his argument with Booker T. Washington, and his account of double‐consciousness. Packaging Post/Coloniality reads the marketing matter surrounding works of Francophone literature as an important though overlooked source in the cultural history of colonialism and the articulation of new identities in France and the Francophone world.

Departing from an epistemological tradition for which knowledge properly achieved must be objective, especially in eschewing affect and/or special interests; and against a backdrop of my thinking about epistemic responsibility, I focus on two situations where care informs and enables good knowing. The implicit purpose of this reclamation of care as epistemically vital is to show emphatically that standard alignments of care with femininity—the female—are simply misguided. Proposing that the efficacy of epistemic practices is often enhanced when would-be knowers care (...) about the outcomes of investigation, I suggest that epistemic responsibility need not be compromised when caring motivates and animates research. Indeed, the background inspiration comes from the thought, integral to feminist and post-colonial theory and practice that, despite often-justified condemnations of research that serves "special interests," particularities do matter, epistemically. Such thoughts, variously articulated, are integral to enacting a shift in epistemology away from formal abstraction and toward engaging with the specificities of real-world, situated knowledge projects. They are not unequivocally benign, for villains too care about the outcomes of their projects. Hence multi-faceted engagements with epistemic practices and processes are urgently required across the social-political world. (shrink)

This paper is one in a series of attempts on my part to think through one of the central challenges left to us by Merleau-Ponty’s sudden death in 1961: if we understand the turn, in his later writings, toward an ontology of the flesh as “a radical rethinking of the experience of belonging from within, [as] a phenomenology of being-of-the-world”, how are we to bear witness to such an experience? What modalities are called forth to do justice to this belonging? (...) The task accrues existential and ethical weight when, at stake in our analyses, are historical and social structures like coloniality that normalize experience, perception, and sense-making while marginalizing others. It is my contention, in this article, that when the phenomenological inquiry becomes critical the question of modality becomes ethically central; how we bear witness to experiences of marginalization and the operations of power that produce them matters in that it risks reifying the same normative structures that predicate the oppression of many. With these questions and considerations in mind, in this article, I return to silence and propose that the mobilization of what I call “deep silences” can be a powerful tool for a critical phenomenology that bears witness without capitulating to the imperative of transparency norming the modern/colonial world system. Deep silence, in fact, designates signifying practices that do not primarily operate within the bounds of logocentrism and speech as the foundational principles of meaning, or that rely upon conceptual, analytical, and instrumental thinking, mobilizing instead the somatic, affective, and sensual dimensions of existence. In this article, I am primary concerned with the sense-making effected by the aesthetic as an instance of deep silence. Specifically, I focus on the image- and ritual-centered photographic documentaries of Silvia Rivera Cusicanqui, which, I suggest, challenge the hegemonic normativity of modern/colonial aesthetics, introducing the reader to other sensibilities wherein the distinction between theory and practice has no purchase and the multiplicity of creative expressions is recognized. This article reads Cherokee academic/author Thomas King’s “The One About Coyote Going West” and Okanagan writer Jeannette Armstrong’s “This is a Story” to question whether these Aboriginal creation tales subvert the referential race codes and the kinds of hierarchical exclusion that take place in Caucasian discourses about Homo sapiens. To do so, it draws links between Slavoj Zizek’s post identity theories, and post-colonial and Indigenous literary and nationalist epistemologies, to challenge the implications of how the Coyote narratives (...) transformation the hegemony, or “the big Other.”. The Rwandan writer, Scholastique Mukasonga chronicles her eye-witness account of Rwandan civil war and genocide; her two novels are part of literary attempts to historicize ethnic collective trauma and memory, but they end up traumatizing national history itself and deconstructing Eurocentric representations. Her works are popularly read as autobiographies and could be mapped under trauma studies. However, this study intends to read these works as autoethnographical texts which this hyphenated writer uses to dismantle conventional boundaries of linguistic morpho-syntax of French, (...) to deconstruct European historical constructions and to contest Eurocentric epistemologies that gave rise to the literary cartography of the Other world. This Eurocentrism produces markers of post/colonial idioms such as “civilized/primitive” and “modern/traditional” as means of justifying the essence of empires. Mukasonga’s account opens our eyes to Rwandan indigenous art, science, medicine and society; therefore, it contests the ontology of European civilization. Although her novels are predominantly written in French, Mukasonga uses her native dialect of Kinyarwanda to unveil age-long Rwandan [African] civilization, thus forcing her European readership to see the “lilies in the mires”. In this this paper, I will attempt to extract some insights from Rorty’s neo-pragmatic political philosophy with the aim of enriching and fortifying our local postcolonial projects by giving justice to their agenda and methods, critiquing their current status, and providing them a clearer sense of direction and vision. As a preliminary step in order to accomplish this core task this paper would take a look at three things: 1) the main tenets of Rorty’s political philosophy; 2) the highlights of (...) As academic subject African philosophy is predominantly concerned with epistemology. It aims at re-presenting a lost body of authentic African thought. This apparently austere a-historical concern is framed by a grand narrative of liberation that cannot but politicise the quest for epistemological autonomy. By "politicise" I mean that the desire to re-cover an authentic African epistemology in order to establish African philosophy as autonomous subject, ironically re-iterates Western, enlightenment notions of the autonomous subject. Here, in the pursuit of (...) an autonomous subject the terms of historical oppression are necessarily duplicated in the terms of liberation. In this study I use the term disfigurement to refer to the double-bind - peculiar to post-coloniality - in which the African subject finds itself when it has to establish and affirm a sense of apartheid (in order to confirm the assumption of difference) by inventing its own autonomy in a way that ironically conflicts with an African conception of the autonomous subject. The transcendental concern with epistemological authenticity and autonomy - indicative of an oppressive desire for Western style autonomy - necessary as it may be in a post-colonial context, is placed in an ethical framework that seeks to remain faithful to the African dictum of identity and autonomy "I am because we are". Whereas the first three chapters are concerned with the transcendental question 'what is African philosophy?', the fourth and last chapter situates the ethical framework within which this question arises in the context of the recently "completed" South African Truth and Reconciliation Commission. As Benita Parry (...) so lucidly explains, “The labor of producing a counter-discourse displacing imperialism’s dominative system of knowledge rests with those engaged in developing a critique from outside its cultural hegemony.” And what an awesome labor it is. The noted postcolonial theorist Georg M. Gugelberger sums things up by saying (I’m not inventing this) “postcolonialism can be conceptualized as the last bulwark against an encroaching total capitalism.”But what of the struggling masses of oppressed peoples whose interests and cultural sensitivities are so caringly looked after by practitioners of postcolonial studies? How do they feel about the fact that the only thing standing between them and “total capitalism” is resistance being mounted in a comparative literature department in Idaho, or someplace? This is a question seldom asked, let alone answered. Fortunately, new light has been thrown on the matter with the arrival of a booklet at this journal. Indian History from Above and Below, by Rukun Advani, is published by Ram Advani, probably a member of the family, in Lucknow. The framing problematic of this dissertation is the political and epistemological relationship between metropolitan theory and post-colonial narrative. By providing multiple determinations to that problematic, I seek to situate the inventions of post-colonial identity. Using "detour" both as a privileged figure of contemporary theory and as the lived socio-historical experience of post-colonials, I examine the theoretical and political consequences using the former to translate the latter. Placing my own discourse at the limits of theory, I (...) show that the predicament in which contemporary theory finds itself is a result of the reduction of narrative to theory . ;I stage the negotiation between metropolitan theory and post-colonial narratives as an allegory of the post-colonial predicament. Finally, through a critique of certain post-colonial theorists , I plot the limits of the post-colonial space in the First World. I conclude that to invent the post-colonial space as a signifying space, we need to develop a poetics of retour which will be as complex and as ambiguous as the poetics of detour that the post-colonials have been living, narrating, and theorizing. ;Chapter I sets the theoretical context for posing the problem of post-colonial self-fashioning. In Chapter II, I sketch the trajectory of post-colonial detour through a close reading of V. S. Naipaul's The Mimic Men. In Chapter III, I interrogate Homi Bhabha's theory of cultural hybridity as a version of the poetics of detour. In Chapter IV, I offer a characterization of the predicament of theory. In the final chapter, I discuss the uses of theory by post-colonial intellectuals and offer a critique of their politics of cultural description and self-description. I argue that post-colonial theorists have evaded the question of inventing the post-colonial space as a signifying space by rewriting the narrative of their detour as a narrative of diplacement, as immigritude. The absence of colonial and post-colonial examinations of the conflict-ravaged Chittagong Hill Tracts (CHT) – a Bangladesh’s distant fringe– warranted me to explore how colonial legacy facilitated the post-colonial statist approach and majoritarian Bengali supremacists’ tendencies to exploit and subjugate the distinct CHT culture. This reconnaissance endeavour finds that the history of extortion of the Chittagong Hill Tracts (CHT)indigenous peoples is a suitable example of racism victims, and thus it examines in the light of (...) the colonial and post-colonial discourses. This explorative study – based on secondary sources of data – finds the very ideas of racism practices, especially identity politics, demographic politics, and women’s subjugation, are prevalent in this postcolonial (and internally colonised) terrain. Postcolonial studies are in actuality constituted by counterdiscoursive, decolonizing practices which acknowledge the recognition of minority discourses, deconstructing hegemonic texts and imperialist metanarratives, opposing unduly overprivileging Western canonical paradigms of “literature,” and—well, you know what I mean. As Benita Parry (...) so lucidly explains, “The labor of producing a counter-discourse displacing imperialism’s dominative system of knowledge rests with those engaged in developing a critique from outside its cultural hegemony.” And what an awesome labor it is. The noted postcolonial theorist Georg M. Gugelberger sums things up by saying (I’m not inventing this) “postcolonialism can be conceptualized as the last bulwark against an encroaching total capitalism.”But what of the struggling masses of oppressed peoples whose interests and cultural sensitivities are so caringly looked after by practitioners of postcolonial studies? How do they feel about the fact that the only thing standing between them and “total capitalism” is resistance being mounted in a comparative literature department in Idaho, or someplace? This is a question seldom asked, let alone answered. Fortunately, new light has been thrown on the matter with the arrival of a booklet at this journal. Indian History from Above and Below, by Rukun Advani, is published by Ram Advani, probably a member of the family, in Lucknow. The post-colonial has often functioned as a code word for a form of French post-theory. In more recent efforts to reconstruct linkages between metropolitan Marxism and counter-colonialism, the post-colonial refers to an open-ended research field for investigating the present weight of colonial histories. But even in these reformulations, post-colonial research presents formidable challenges to Euro-American urban Marxism. In this context, this paper redirects Henri Lefebvre’s work to analyse post-colonial situations. It (...) traces in particular the notion of ‘colonisation’ as it develops from his critique of everyday life to his work on the state. We argue that Lefebvre’s notion of ‘colonisation’ presents a promising opening to understanding the ‘colonial’ aspects of urbanisation today. Resumos -/- The view of historical writing as a mere objective and dispassionate recording of the past is already passé. From the outset of postmodernity, historiography was already seen as a tool either for oppression or empowerment. Integral to the role of historiography in this oppression or empowerment tendency is the construction of identity. In earlier stages of Southeast Asian scholarship, the common pattern among the historiographical materials produced (often by the intelligentsia of the colonial establishment) is the depiction (...) of Southeast Asia as an artificial buffer region that serves as a watershed of "Sinicization" from the East and "Indianization" from the West, and even "Islamization" later on. Very illustrative in this regard is George Coedes seminal work, "The Indianized States of Southeast Asia" (1968). This will in turn act as an intellectual conditioning to prepare others to passively recognize the legitimacy of Westernization and Modernization as the rightful heirs of Sinicization and Indianization. The period of decolonization will change the landscape of historiography, specifically in insular Southeast Asia, or what Zeus Salazar would call "Dunia Melayu" (1998). Post-coloniality would give birth to the indigenization of historical discourse in the region and, as a corollary, to a reactive movement that would challenge colonial identity politics. The Austronesian complex would serve as a major hermeneutical tool in asserting the nationalist agenda towards the collective Malayan past of the Maphilindian countries. This paper would attempt to survey major historical works, from colonial historiography to national historiography, with an emphasis on their roles in the identity politics of the region. (shrink)

This article explores the distinction between anti-colonial longing and postcolonial becoming through a commentary on Antjie Krog’s Begging to Be Black. The epistemology and ontology of postcolonial becoming is the central concern. Begging to Be Black is a mytho-poetic narrative in which a world is imagined where King Moshoeshoe, missionaries from the 19th century, Antjie Krog and her friends and colleagues, ANC cadres, the Deleuzian philosopher Paul Patton, Nelson Mandela, Archbishop Desmond Tutu and the ANC Youth League are (...) placed in the same narrative space where they can intermingle. And this is done to respond to a crisis of the present — the difficulties South Africans face in grappling with the legacies of colonialism and Apartheid, and the fact that there is a process of un-homing and re-homing that Krog feels white South Africans in particular need to think about more deeply. The article compares Krog’s approach to decolonization with that of the leading South African philosopher of ubuntu, Mogobe Ramose. Both Krog and Ramose offer the epistemological and ontological resources for grappling with the relationship between past, present and future in a decolonizing setting. The article examines how postcolonial critique may take place through liminal figures. Liminality is characterized as central to postcolonial becoming. (shrink)

Qualifying post-Westphalian sovereign statehood as a 'power' as argued for in Hendrik Berkhoff's political theology, this book addresses the decades-long theological-spiritual debate between Christian realism and Christian pacifism in U.S. foreign policy and global Christian circles. It approaches the debate by delving into the pacifist Anabaptist political theology and delineates empirically how sovereign statehood in post-colonial Africa and Asia has fallen into the hands of the devil Satan, as a 'fallen power' in the Foucaultian terms of power (...) structures, techniques and episteme. While the book offers intervention schemes and options, it holds that Christian statecraft remains the source of hope to effectively address a number of serious global issues. Rather than ‘superbugs’ signifying recalcitrant forms of life that withstand biomedical treatment, drug resistant infections emerge within and are intricate with the exercise of social and medical power. The distinction is important, as it provides a means to understand and critique current methods employed to confront the threat of widespread antimicrobial resistance. A global health regime that seeks to extend social and medical power, through technical and market integration, risks reproducing a form of triumphalism and exceptionalism that resistance itself should (...) have us pause to question. An alternative approach, based on a postcolonial as well as a ‘post-colony’ approach to health and microbes, provides impetus to challenge the assumptions and norms of global health. It highlights the potential contribution that vernacular approaches to human and animal health can play in altering the milieu of resistance. (shrink)

This essay explores the possibilities and limits of decentering Europe by examining the Haitian Revolution and contemporary invocations of its legacy among political theorists and historians. Recent accounts of the Haitian Revolution have celebrated its universalism as a realization of French revolutionary ideals. As I argue in the essay, this interpretation undermines the Haitian Revolution’s specificity as the first and only successful revolution against colonial slavery. I offer an alternative interpretation that begins from the specificity of colonial slavery (...) and explores how Haitian revolutionaries inaugurated another universalism linked to individual and collective autonomy. Haitian revolutionaries offered a radical account of black citizenship and envisioned a world order in which both slavery and colonial rule would be transcended. This reinterpretation of the Haitian Revolution offers an alternative approach to what it might mean to decenter Europe—one that begins from the specific political problems subaltern actors encountered and illustrates how ideals are remade in diverse contexts. This article continues the themes developed in a previous paper looking at reparations for past wrongs in post-colonial Australia. It narrows the focus to examine the scope of the law of tort to provide reparations suffered as a result of colonisation and dispossession, with particular emphasis on the assimilation policies whose legacy is now known emphatically, although it ought not be exclusively, as the Stolen Generations. The search for more than just words is particularly topical in light of (...) the Australian Prime Minister's formal apology in early 2008. This highly symbolic step must not lose momentum. That momentum could be both political and legal. In the latter context, we explore here the concept of alien tort, in the light of current Australian tort jurisprudence, which has thus far proved inadequate to achieve compensation for the harms suffered. Taking a comparative approach, procedural and substantive developments are to better deliver justice consistent with community values. In particular, the greater acceptance of psychological harm as actionable tortious conduct in Canada and the United States is examined. The article further examines the scope for stolen children to bring suit under the US Alien Tort Claims Act 1789. While the Australian government enjoys sovereign immunity in the courts of the United States, non-state organisations such as churches that were complicit in the forcible removals may be subject to United States jurisdiction wherever they have a presence in that country. The procedural and substantive elements of such a claim are discussed. In particular, the relevant cause of action, the issue of forum non conveniens and the statute of limitations will be analysed to map out whether a claim could be developed and successfully prosecuted. © Springer Science + Business Media B.V. 2009.
