This volume examines the property transformations in post-communist Central Eastern Europe (CEE) and focuses on the role of restitution and privatisation in such transformations. It argues that the theorisation of 'restitution' in post-communist CEE is incomplete in the transitional justice scholarship and in the literature on correction of historical wrongs. The book also argues that, for a more complete theorisation of (post-communist) restitution, the transformations of property in post-communist societies ought to be studied in a more holistic way. The main legal vehicles used for such transformations, privatisation and restitution, should not be studied separately and in abstract, but in their reciprocal relationship, and in connection to the dimension of justice which each could achieve. We investigate particular cosmological models, based either on tachyon fields or on perfect fluids, for which soft future singularities arise in a natural way. Our main result is the description of a smooth crossing of the soft singularity in models with an anti-Chaplygin gas or with a particular tachyon field in the presence of dust. Such a crossing is made possible by certain transformations of matter properties. We discuss and compare also different approaches to the problem of crossing of the (...) The supposition of the manifest covariance of average trajectory world lines is violated in Hamiltonian formulations of relativistic quantum mechanics. This is due to the nonlinear appearance of particle dynamical variable operators in the Heisenberg picture boosted position, velocity, and momentum operators. The magnitude of this deviation from world line manifest covariance is found to be exceedingly small for a number of common time of flight experiments.

This article examines the transformation of property rights over fishery resources in Longlake, China, where a gradual evolutionary process from a common property regime to a state property regime occurred between the late 1970s and the late 1980s. It explores the active role played by economic actors as well as the underlying economic, political, and sociocultural forces in transforming both formal and informal property rules. In the wake of the considerable cultural changes and social shifts that the United States and all advanced industrial democracies have experienced since the late 1960s and early 1970s, social discourse around the disempowered has changed in demonstrable ways. In From Property to Family: American Dog Rescue and the Discourse of Compassion, Andrei Markovits and Katherine Crosby describe a “discourse of compassion” that actually alters the way we treat persons and ideas once scorned by the social mainstream. This “culture (...) turn” has also affected our treatment of animals inaugurating an accompanying “animal turn”. In the case of dogs, this shift has increasingly transformed the discursive category of the animal from human companion to human family member. One of the new institutions created by this attitudinal and behavioral change towards dogs has been the breed specific canine rescue organization, examples of which have arisen all over the United States beginning in the early 1980s and massively proliferating in the 1990s and subsequent years. While the growing scholarship on the changed dimension of the human-animal relationship attests to its social, political, moral and intellectual salience to our contemporary world, the work presented in Markovits and Crosby’s book constitutes the first academic research on the particularly important institution of breed specific dog rescue. Recent cases involving biosamples taken from indigenous tribes and newborn babies reveal the emptiness of informed consent. This venerable doctrine often functions as a charade, a collective fiction which thinly masks the uncomfortable fact that the subjects of human research are not actually afforded full information regarding the types of research that may be contemplated, nor do they provide meaningful consent. But if informed consent fails to provide adequate protection to the donors of biological materials, why not turn to principles (...) of property law? Property is power, yet current law permits everyone except for those who donate biological materials to possess property rights. The reluctance to invoke property probably stems from fears of resurrecting slavery and the commodification of human beings. But ironically, avoidance of property transforms the subjects of human research into objects that can be owned only by others, resulting in new forms of oppression and exploitation. Human research subjects are autonomous individuals who should not only possess the power to contribute their biological materials, but also the right to help control the course of research, and to share in the resulting benefits or profits. Conferring body property might enable research subjects to regain power and a measure of self-sovereignty. (shrink)

The case of highland Yemen up to around the middle of the twentieth century involves a history different from most Muslim societies in that, from 1919, the Yemeni state was independent. The problem I address concerns the utility of thinking about the highland property regime in this era in relation to the categories of "private" and "public." What sort of antecedents existed, at the level of property relations, for later commercial transformations that would culminate in such things as (...) Pizza Hut franchises? In Yemen, the polity of the period was a type of Islamic state, one based on the shari`a in ideology and in application and headed by a classical form of jurist-leader, a figure known as an imam. Prior to the twentieth century, this Yemeni form of a shari`a-based Islamic polity had a thousand year history in the highlands. Shari`a courts had exclusive competence as state tribunals, and judges, trained on old-style law books, heard the full gamut of litigation. By contrast, colonial changes in other Muslim societies typically entailed a sharp alteration and restriction of the sphere of the shari`a, often limiting application to the domain of "family law" alone. At the same time, the highlands had yet to commence the other great and, elsewhere, ongoing modern transformation of the shari`a, codification and legislation, which would not begin in Yemen until after the Revolution of 1962.Highland society at mid-century was agrarian, based primarily on settled plow cultivation, and the associated property regime was almost exclusively "private." In Yemen, the "private" property regime centered conceptually on milk, a category of individual ownership of immoveable property, and on the concept of mal, a commercial commodity. As a form of private, landed property, milk involved rights that could be acquired, alienated and inherited, and the associated agricultural production was based on lease contracts between landlords and sharecroppers. Pious endowments were the basis for one of the great Muslim "public" institutions, which supported mosques, schools, water systems, etc. Another fundamental "public" institution was an extension of the "private" commercial notion of mal into the state institution of the 'House of Mal,' or Treasury. Other key "public" institutions were the imamate itself, a form of Islamic state, and the shari`a court. This shari`a system can be thought of in terms of three levels of legal texts. At the highest level, shari`a doctrine, the jurisprudence of the period, constituted an ideology of the property regime. The doctrine provided models for both the range of substantive undertakings and for court processes, but the relationship of these models to the property relations and to litigation on the ground is a key question. At the lowest level, the routine documents of ongoing, uncontested practice proliferated. These included ordinary sale documents, leases, marriage contracts, endowment instruments, wills and estate inheritance instruments. Between high doctrine and low instruments were the records of shari`a court judgments, records in which the conflicts and contradictions of the property system were expressed, argued and ruled upon. In certain problem areas of the law, the ruling imams's personal doctrinal "choices" were designed to guide court judges in their rulings. (shrink)

While it is sometimes thought that free Athenian women were hemmed in by surveillance within the oikos, this article argues that the obstacle that impeded them when they attempted to control property was that they were excluded from the impersonal and formal systems of surveillance of male citizens. Athenian public life, lived in the view of others, dramatically extended the agency of those within it. While women could compensate for their legal incapacities by cultivating the personal trust of men, (...) this required them to treat some of the people closest to them instrumentally, thus transforming their affectionate relationships. The conditional independence relations present in a data set usually admit multiple causal explanations — typically represented by directed graphs — which are Markov equivalent in that they entail the same conditional independence relations among the observed variables. Markov equivalence between directed acyclic graphs (DAGs) has been characterized in various ways, each of which has been found useful for certain purposes. In particular, Chickering’s transformational characterization is useful in deriving properties shared by Markov equivalent DAGs, and, with certain generalization, is (...) needed to justify a search procedure over Markov equivalence classes, known as the GES algorithm. Markov equivalence between DAGs with latent variables has also been characterized, in the spirit of Verma and Pearl (1990), via maximal ancestral graphs (MAGs). The latter can represent the observable conditional independence relations as well as some causal features of DAG models with latent variables. However, no characterization of Markov equivalent MAGs is yet available that is analogous to the transformational characterization for Markov equivalent DAGs. The main contribution of the current paper is to establish such a characterization for directed MAGs, which we expect will have similar uses as Chickering’s characterization does for DAGs. (shrink)

Vietnam is home to a prospering technology community and numerous enterprises that range from small start-ups to development giants. Virtually all public services are offered online. In fact, the country even has a system for e-residency and “data embassies.” This achievement derives in part from the nation’s transparent and enduring political preferences, but more importantly from Vietnamese law and its regulatory system regarding information, the digital general public, and intellectual property rights (IPR) protection. In this examination of the most (...) pertinent aspects of Vietnam’s digital economy legislation, this study explores the nation’s regulatory structure regarding copyright and patents within the context of digital transformation. The study discusses the relationship between foreign and national regulations in terms of IPR protection and the advancement of digitalization. Research on Vietnamese regulations and the practical application of major patent and copyright regulations has revealed that in many respects, the nation is highly reliant on the effective operation of a broader foreign institutional and legal framework. Thus, in the near future, technological advancement will necessitate the establishment of additional transnational regulatory systems. (shrink)

A transformative decision rule transforms a given decision probleminto another by altering the structure of the initial problem,either by changing the framing or by modifying the probability orvalue assignments. Examples of decision rules belonging to thisclass are the principle of insufficient reason, Isaac Levi'scondition of E-admissibility, the de minimis rule, andthe precautionary principle. In this paper some foundationalissues concerning transformative decision rules are investigated,and a couple of formal properties of this class of rules areproved.

This paper explores several paths a distinctive third wave of extended cognition might take. In so doing, I address a couple of shortcomings of first- and second-wave extended cognition associated with a tendency to conceive of the properties of internal and external processes as fixed and non-interchangeable. First, in the domain of cognitive transformation, I argue that a problematic tendency of the complementarity model is that it presupposes that socio-cultural resources augment but do not significantly transform the brain’s representational (...) capacities during diachronic development. In this paper I show that there is available a much more dynamical explanation—one taking the processes of the brain’s enculturation into patterned practices as transforming the brain’s representational capacities. Second, in the domain of cognitive assembly, I argue that another problematic tendency is an individualistic notion of cognitive agency, since it overlooks the active contribution of socio-cultural practices in the assembly process of extended cognitive systems. In contrast to an individualistic notion of cognitive agency, I explore the idea that it is possible to decentralize cognitive agency to include socio-cultural practices. (shrink)

We discuss the criteria for deriving new information from coordinate transformations, focusing on the property of implementability, or measurability in practice. We contrast the role of coordinate transformations in classical and quantum physics, and demonstrate that many well-known applications fail to meet the criteria for new information. Finally, we discuss some mathematical properties of the coordinate transformations, and then relate these properties to a practical measurement scheme.

Values and norms enshrined in culture contribute to the integration and spiritual development of society The transformational processes taking place in modern society have influence on the value system. The relevance of this study is determined by the dialectic of emerging (...) contradictions in modern Russian culture caused by the formation of ambivalent values, norms, and attitudes in mass culture that have a negative impact on collective consciousness, on changing the value foundations of culture in modern society, which jeopardizes the safety of culture. In the focus of the analyzed problem, kitsch culture as a phenomenon of mass culture acts as the subject of research. The purpose of the study is to identify threats to cultural security coming from kitsch culture, which transforms the value foundations of culture, and to identify strategies to protect Russian culture. The study of the voiced issues is carried out through the prism of socio-cultural, structural-functional, interdisciplinary approaches. The novelty of the studied problem lies in the fact that kitsch culture acts as a pseudo-culture, which is devoid of aesthetic and artistic value and moral content, as one of the sources that creates certain risks and poses threats to cultural security. In particular, we are talking about the organization of joint activities of government agencies, public organizations, scientific, cultural and educational spheres, based on the principles of optimizing the constructive impact on the consciousness of the younger generation through the mediation process and inculturation. This article draws on theoretical resources from economic sociology and sociology of law to intervene in economic debates about the relationship between intellectual property and industrialization. Utilizing historical evidence from the earliest period of American intellectual property law and from a formative company in the New England textile industry, I propose a social process of influence that connects intellectual property law to industrialization. I argue that, consistent with the findings of New Economic Sociology, social relationship structures and (...) social capital are the proximate influential force in industrialization. However, I also argue that transformative changes in those social relationship structures are rooted in the emergence of a particular type of political culture: what I call here, borrowing from Hannah Arendt and Frank Dobbin, a “Natal-Industrial Culture.” A Natal-Industrial Culture, as I propose it here, is a political culture in which collective hopes for the future are placed in new technologies and new cultural products, as means for achieving economic growth. Intellectual property law contributed to the emergence of this new type of political culture by holding out the promise of property, as a reward for the provision of new technologies or new cultural products. Because of the way that hope works on motivation—through cognitive pre-rehearsals of future attainment, which involve semantically-meaningful propositions and contribute to positive emotional experience—the promise of property provided a powerful stimulant to social capital formation. Working through the semantic resonances of property, intellectual property law contributed to a political culture in which invention and creativity were expected to secure a future of growth within the political community, both for particular members and for the political community, as a whole. By fostering a Natal-Industrial Culture, intellectual property law contributed to systematic invention and social capital-formation, leading, in turn, to the transformative changes in working and material provisioning that constitute industrialization. This paper provides an entrance into central discussions regarding Kant’s account of property. The first section shows how Kant engages and transforms important, related proposals from Hobbes and Locke as well as how the ‘libertarian’ and ‘liberal republican’ interpretive traditions differ in their readings on these points. Since Kantian theories for a long time didn’t focus on Kant’s Doctrine of Right but instead followed Rawls’s lead by developing Kantian theories grounded on Kant’s (meta-) ethical writings, the second section focuses (...) on property discussions found in the Rawlsian tradition. The final section shows how important contemporary work in the Kantian tradition goes beyond Rawlsian, libertarian, and liberal republican concerns of distributive justice among free and equal citizens, to include questions central to, for example, the philosophy of care, feminist philosophy, philosophy of race, philosophy of sex and love, and environmental philosophy. The interpretation of complex eigenvalues of linear transformations defined on a real geometric algebra presents problems in that their geometric significance is dependent upon the kind of linear transformation involved, as well as the algebraic lack of universal commutivity of bivectors. The present work shows how the machinery of geometric algebra can be adapted to the study of complex linear operators defined on a unitary space. Legendre transform between thermodynamic quantities such as the Helmholtz free energy and entropy plays a key role in the formulation of the canonical ensemble. In the standard treatment, the transform exchanges the independent variable from the system’s internal energy to its conjugate variable—the inverse temperature of the heat reservoir. In this article, we formulate a microscopic version of the transform between the free energy and Shannon entropy of the system, where the conjugate variables are the microstate probabilities and the energies (...) (scaled by the inverse temperature). The present approach gives a non-conventional perspective on the connection between information-theoretic measure of entropy and thermodynamic entropy. We focus on the exact differential property of Shannon entropy, utilizing it to derive central relations within the canonical ensemble. Thermodynamics of a system in contact with the heat reservoir is discussed in this framework. Other approaches, in particular, Jaynes’ maximum entropy principle is compared with the present approach. Philosophical tradition holds that sounds, like colors, are sensible properties. Recently, however, there is a growing consensus in favor of the view that sounds are particulars, not properties. This article bucks the trend: it argues for the Event-Property View of Sounds – a widely overlooked and intuitively plausible version of the traditional view that not only avoids the difficulties that have led philosophers to opt for particularist alternatives, but does justice to the best insights of recent philosophical and empirical (...) work on audition. Contemporary civil libertarians claim that their works preserve a worthy American tradition of defending free-speech rights dating back to the framing of the First Amendment. _Transforming Free Speech_ challenges the worthiness, and indeed the very existence of one uninterrupted libertarian tradition. Mark A. Graber asserts that in the past, broader political visions inspired libertarian interpretations of the First Amendment. In reexamining the philosophical and jurisprudential foundations of the defense of expression rights from the Civil War to the present, he exposes (...) the monolithic free-speech tradition as a myth. Instead of one conception of the system of free expression, two emerge: the conservative libertarian tradition that dominated discourse from the Civil War until World War I, and the civil libertarian tradition that dominates later twentieth-century argument. The essence of the current perception of the American free-speech tradition derives from the writings of Zechariah Chafee, Jr., the progressive jurist most responsible for the modern interpretation of the First Amendment. His interpretation, however, deliberately obscured earlier libertarian arguments linking liberty of speech with liberty of property. Moreover, Chafee stunted the development of a more radical interpretation of expression rights that would give citizens the resources and independence necessary for the effective exercise of free speech. Instead, Chafee maintained that the right to political and social commentary could be protected independent of material inequalities that might restrict access to the marketplace of ideas. His influence enfeebled expression rights in a world where their exercise depends increasingly on economic power. Untangling the libertarian legacy, Graber points out the disjunction in the libertarian tradition to show that free-speech rights, having once been transformed, can be transformed again. Well-conceived and original in perspective, _Transforming Free Speech_ will interest political theorists, students of government, and anyone interested in the origins of the free-speech tradition in the United States. We calculate the mixing of real and imaginary components of space and time under the influence of superluminal boosts in thex direction. A unique mixing is determined for this superluminal Lorentz transformation when we consider the symmetry properties afforded by the inclusion of three temporal directions. Superluminal transformations in complex six-dimensional space exhibit unique tachyonic connections which have both remote and local space-time event connections.

Isotropic 4-vectors are images of 4-spinors under projection. This leads to a particularly clear interpretation of the spin properties of Nature.

Governing greenwashing in environmental, social, and governance (ESG) disclosure is an important issue, but relevant literature is scant. Based on the data on Chinese A-share listed firms from 2012 to 2021, we investigate the governance role of corporate digital transformation (DT) in ESG greenwashing and its influencing mechanism. We find that DT significantly inhibits ESG greenwashing. Moreover, DT mitigates ESG greenwashing by enhancing corporate green technology innovation (i.e., innovation channel), reducing information asymmetry (i.e., information channel), and increasing trade credit (...) (i.e., resource channel). From the perspective of investor attention, we find that both retail investors' online opinions and institutional investors' site visits strengthen the inhibitory effect of DT on ESG greenwashing. Furthermore, such an inhibitory effect is more pronounced in large firms, industries with high competition, and regions with strong intellectual property protection. This research provides new insights and policy suggestions for governing corporate ESG greenwashing behavior. (shrink)

This study investigates simple games. A fundamental research question in this field is to determine necessary and sufficient conditions for a simple game to be a weighted majority game. Taylor and Zwicker showed that a simple game is non-weighted if and only if there exists a trading transform of finite size. They also provided an upper bound on the size of such a trading transform, if it exists. Gvozdeva and Slinko improved that upper bound; their proof employed a property (...) of linear inequalities demonstrated by Muroga. In this study, we provide a new proof of the existence of a trading transform when a given simple game is non-weighted. Our proof employs Farkas’ lemma, and yields an improved upper bound on the size of a trading transform. We also discuss an integer-weight representation of a weighted simple game, improving the bounds obtained by Muroga. We show that our bound on the quota is tight when the number of players is less than or equal to five, based on the computational results obtained by Kurz. Furthermore, we discuss the problem of finding an integer-weight representation under the assumption that we have minimal winning coalitions and maximal losing coalitions. In particular, we show a performance of a rounding method. Finally, we address roughly weighted simple games. Gvozdeva and Slinko showed that a given simple game is not roughly weighted if and only if there exists a potent certificate of non-weightedness. We give an upper bound on the length of a potent certificate of non-weightedness. We also discuss an integer-weight representation of a roughly weighted simple game. (shrink)

Amphibians that undergo a metamorphosis provide an unparalleled opportunity to investigate how skeletal shape is generated, preserved, and transformed in development. Their pharyngeal arch (PA) cartilages, which support breathing and feeding behaviors, form embryonically from cranial neural crest cells, grow isometrically at larval stages, and abruptly change shape during metamorphosis. Further, the shape changes occur in three different ways: some adult cartilages form de novo, others emerge from within resorbing larval cartilages and some larval cartilages reshape themselves at the cellular (...) level. Isometric growth followed by abrupt shape change is unique to amphibian PA cartilages, which suggests that the origin and evolution of amphibian metamorphosis has been influenced by the tissue properties of cartilage. This essay reviews the functional role of the PA skeleton in frogs and salamanders and presents a mechanistic framework for understanding how its shape is generated, preserved, and transformed at the levels of cell behavior and specification mechanisms. We prove assorted properties of matrices over \documentclass[12pt]{minimal} \usepackage{amsmath} \usepackage{wasysym} \usepackage{amsfonts} \usepackage{amssymb} \usepackage{amsbsy} \usepackage{mathrsfs} \usepackage{upgreek} \setlength{\oddsidemargin}{-69pt} \begin{document}$${\mathbb{Z}_{2}}$$\end{document}, and outline the complexity of the concepts required to prove these properties. The goal of this line of research is to establish the proof complexity of matrix algebra. It also presents a different approach to linear algebra: one that is formal, consisting in algebraic manipulations according to the axioms of a ring, rather than the traditional semantic approach via linear transformations.

In the last two decades, major cities in Malaysia have witnessed a spate of urban redevelopment including commercial and retail complexes, and residential estates. The current urban transformations taking place in Malaysian cities are mainly market-driven and characterized by fast-track development with a strong priority on the road infrastructure. This is a typical example of an intensive property-led development that is becoming a central driver of the national economy. This article provides a deeper understanding of the complexity of urban (...) development in Malaysia. Here, the major aim is to understand the Malaysian cities' transitions in the trajectory of their colonial past, national identity, multi-cultural community, culture, and religion. Focusing on South East Asian urbanism, this article determines how internal and external forces and global trends such as neoliberalism and property-led development affect the transformation of urban landscapes and expansions in Malaysia. The outcomes of this paper will indicate how much property-led development and globalisation have affected the traditional and tropical climate-responsive urban environment in Malaysia. It will also identify sustainable design and planning measures that should be implemented in the cities of Malaysia to combat the ill-effects of globalisation. (shrink)

A central characteristic of living organisms is their agency, that is, their intrinsic activity, both in terms of their basic life processes and their behavior in the environment. This aspect is currently a subject of debate and this article provides an overview of some of the relevant publications on this topic. We develop the argument that agency is immanent in living organisms. There is no life without agency. Even the basic life processes are an intrinsic activity, which we call the (...) organismic level of agency. In addition to this we describe several further levels. These capture different qualities that occur or transform during evolution. In addition to the organismic level, we propose an ontogenetic level, a level of directed agency, directed agency with extended flexibility, and a level that includes the capacities to follow preconceived goals. A further property of organisms is their autonomy. It has been shown that the capacity for autonomy changed during evolution. Here we propose that the two organismic properties autonomy and agency are closely related. Enhanced physiological and behavioral autonomy extends the scope of self-generated, flexible actions and reactions. The increase in autonomy through the evolution of a widened scope of behavioral possibilities and versatility in organisms coincides with extended levels of agency. Especially the human organization, including the sophisticated brain, is the basis for an extended level of agency referring to the capacities to follow preconceived goals. However, it is important for the understanding of the phenomenon of agency not only to assume this latter form, but also to look at the different levels of agency. (shrink)

This is especially so in the case of Asian migrants who settle down in Western countries, as their very identity as Asian locates them at a precarious point in the real or imagined “terror network.” The migrant is no longer the Du, but the Es, imparting an identity to the Ich, where (...) the Ich denotes the “original” citizens of the country. The transactions of the “I” with the “Thou” and the “It” become significant in the context of Asian immigrants in that, for the dominant mainstream, the “terrorist” is an Es/”It” that has gradually marked its transition from the Du/“Thou.” The person of the “terrorist” finds its ontological properties from the gradual movement away from a “Thou” to an “It.” The hitherto unbounded “Thou” is transformed into a definable “It,” by ascribing to her/him a religion, race, colour, nationality and ethnicity. He/she is not confronted, as every “Thou” is, but is rather “experienced” as a source of terror, as an “It.” The paper attempts to explore the transformation of the figure of the “migrant terrorist” from a confronted “Thou” to an “imagined/experienced” “It” through an analysis of New York by Kabir Khan and Home Fire by Kamila Shamsie. Taxa and homologues can in our view be construed both as kinds and as individuals. However, the conceptualization of taxa as natural kinds in the sense of homeostatic property cluster kinds has been criticized by some systematists, as it seems that even such kinds cannot evolve due to their being homeostatic. We reply by arguing that the treatment of transformational and taxic homologies, respectively, as dynamic and static aspects of the same homeostatic property cluster kind represents a good (...) perspective for supporting the conceptualization of taxa as kinds. The focus on a phenomenon of homology based on causal processes (e.g., connectivity, activity-function, genetics, inheritance, and modularity) and implying relationship with modification yields a notion of natural kinds conforming to the phylogenetic-evolutionary framework. Nevertheless, homeostatic property cluster kinds in taxonomic and evolutionary practice must be rooted in the primacy of epistemological classification (homology as observational properties) over metaphysical generalization (series of transformation and common ancestry as unobservational processes). The perspective of individuating characters exclusively by historical-transformational independence instead of their developmental, structural, and functional independence fails to yield a sufficient practical interplay between theory and observation. Purely ontological and ostensional perspectives in evolution and phylogeny (e.g., an ideographic character concept and PhyloCode’s ‘individualism’ of clades) may be pragmatically contested in the case of urgent issues in biodiversity research, conservation, and systematics. The theoretical foundations of the social structure of the society and the historical forms of ownership were discussed in the article. The presence of many types of property is a necessary condition for its normal functioning in society. As a result of these types of property, the needs and activities of every person in society are fully satisfied. From ancient times to the present day, attitudes towards property issues have developed in different ways in different regimes. Even (...) before the creation of society, people generally, used and took advantage of collective property. Over time, as a result of a number of events occurring in the world and in nature, collective property began to lose its relevance. After property inequality began to emerge, stratification among people began to form, which acted as a driving force for the creation of other forms of property. The collective form of property gradually changed and began to be replaced by individual and other forms of property. Modern production is conditioned by the transformation of economic, social and other spheres, which, in turn, creates the basis for the formation of new types of social systems and requires the reconsideration of property as the main category of private-legal relations. Since property is multi-subject, it not only expands and complicates the internal structure of property subjects, but also means the formation of new social classes according to the place they occupy (the functions they perform) in property relations.The modern structure of property relations is formed as a complex multi-level system: the close contact of individual and common beginnings, levels of ownership, the specificity of various sociаl fields creates the opportunity and demand for the formation of various forms of property, determines their dynamics and transformation in advance. Different classes and groups of owners, territorial associations, state, national groups and monopolies become the subjects of property relations. (shrink)

Three results in [14] and one in [8] are analyzed in Sections 3–6 in order to supply examples on Loeb probability spaces, which distinguish the different strength among three generalizations of k-saturation, as well to answer some questions in Section 7 of [15]. In Section 3 we show that not every automorphism of a Loeb algebra is induced by an internal permutation, in Section 4 we show that if the 1-special model axiom is true, then every automorphism of a Loeb (...) algebra is induced by a point-automorphism, in Section 5 we show that not every measure-preserving homomorphism from a small subalgebra to a Loeb algebra is induced by an internal permutation, without assuming full-saturation, in Section 6 we show that, under some cardinality assumptions, the 1-isomorphism property does not guarantee the compactness of a Loeb space, and in Section 7 an application of the 1-special model axiom is given on the existence of ergodic transformations of a Loeb space, which partially answers Problem 2.3 of [5]. The quantum harmonic oscillator is described in terms of two basic sets of coordinates: linear coordinates x, px and angular coordinates eiφ, Pφ (action-angle variables). The angular “coordinate” eiφ is assumed unitary, the conjugate momentum pφ is assumed Hermitian, and eiφ and pφ are assumed to be a canonical pair. Two transformations are defined connecting the angular coordinates to the linear coordinates. It is found that x, px can be physical, i.e., Hermitian and canonical, only under constraints on the pφ (...) eigenvalue spectrum. The conclusion is that eiφ can be a unitary operator. A parallel analysis of the classical harmonic oscillator is done with equivalent results. (shrink)

The Paradox of Intellectual Property in Capitalism is an innovative book that comprehensively discusses and analyses intellectual property under capitalistic social conditions and relations. It not only addresses some historical developments of intellectual property but also brings to the fore the very notion of what knowledge is, knowledge creation, and knowledge production and appropriation within a Marxist framework. Nonetheless, the adopted approach pays heed to multiple fields of knowledge, providing rich discussions that facilitate the understanding of actual (...) social totality in which capitalism, knowledge production and appropriation, and the struggles of appropriation mutually reinforce each other, although not devoid of antagonisms and contradictions. In light of contemporary capitalism, the transformations that social property relations are undergoing must be scrutinised – such as those brought about by the development of digitalisation and the convergence between big pharma and tech giants. What are the conditions of intellectual property creation today? What theoretical assumptions does it make? Under what social relations is intellectual property produced? Throughout, the emphasis is not on individual cases or symptoms but on the overarching logic: the logic of capitalism as revealed in intellectual property. (shrink)

Purpose. The signification of the theoretical grounds for the conceptual reconstruction of the dichotomy "spirit-body" in the field of postmodern notions in philosophy and culture, the identification of the location of the given dichotomy in the processes of the transition of philosophy from being classical to the postclassical one, simultaneously, culture – to the cultural forms of postmodernity. Theoretical basis. The changing systems of post paradigm relations, radically transforming human life in the postmodern world, represent the obvious transformations of the (...) fundamental conceptual schemes. For postmodern philosophers, the dichotomy "spirit-body" does not mean better interpretation of separate substances any more, but the development of the relationship between mental and physical properties. Feminist philosophers assert that the "spirit-body" opposition occupies the special place among classical dichotomies, as it acquires the key meaning in the patriarchal concepts of masculinity and femininity. In the post modernity, the body and corporality become dominant themes not only in the philosophy and "high" culture, but also in mass culture; at the same time, the emphasis on their common narratives and intertexts testifies to the fundamental transformations that reflect the "condition" of postmodernity. Originality of this research lies in the expose of the specific transformation features of the dichotomy "spirit-body" as a philosophic opposition closely connected with postmodernism and realized in the practices of mass culture. This research is reflectedof the idea of the absoluteness and invariabilityof this duality as thebasicdichotomy of the classical philosophy in its correlation with cultural logic of the postmodernity at the end of the 20 – the beginning of the 21st centuries. Conclusions. With the reinterpretation of the "spirit-body" dichotomy, the body is theorized as a cognitive agent with desires independent of the mind. In postmodernism, the body is the source of charm, and aversion and destruction, and restoration. At the same time, with the growth of the visualization factor and the change in the status of "high" culture, the "turn" in the status of mass culture is created: today both the former and the letter have many common discourses, narratives and intertexts. The body of information on the Internet is becoming increasingly geographical. This is both due to the expansion of established categories of geographic information and to the simultaneous enrichment of other types of information through geographic identifiers. As this repository of geographic information expands, it is also a key site for multiple processes of commodification transforming informational resources into market goods. Understanding the dynamics driving the integration of geographic information into the digital economy requires a comprehensive political economic analysis. A (...) key component of this analysis is to explain the logics of creation and allocation of economic value from geographic information on the Internet. Addressing this need, in the present article I deploy the property regimes schema developed by Schlager and Ostrom and expand it to elucidate the differentiated commodification processes of geographic information on the Internet. Property regimes are arrangements that define rules, distribute rights, and delineate roles with respect to particular goods. These arrangements are enabled by elements such as legal frameworks, jurisdictions, type of information, and technologies of access. In this article, I explore how the legal frameworks regulating traditional categories of geographic information have been destabilized in the process of technological innovation, leading to the creation of new informational goods along with their respective property regimes, and rearticulating legal, economic, and sociotechnical relations. Transformer-based language models (TLMs) have widely been recognized to be a cutting-edge technology for the successful development of deep-learning-based solutions to problems and applications that require natural language processing and understanding. Like for other textual domains, TLMs have indeed pushed the state-of-the-art of AI approaches for many tasks of interest in the legal domain. Despite the first Transformer model being proposed about six years ago, there has been a rapid progress of this technology at an unprecedented rate, whereby BERT and (...) related models represent a major reference, also in the legal domain. This article provides the first systematic overview of TLM-based methods for AI-driven problems and tasks in the legal sphere. A major goal is to highlight research advances in this field so as to understand, on the one hand, how the Transformers have contributed to the success of AI in supporting legal processes, and on the other hand, what are the current limitations and opportunities for further research development. This article challenges the long-standing boundary that separates human beings from non-human entities, whether animate or inanimate. In doing so, it engages with the jurisprudential strands that debate the transformative power of law in moving towards a fuller recognition of human relations with non-human entities. To this end, the article first examines the legal theoretical strategies that scholars have so far developed to overcome the dichotomous vision that pits humans against non-humans. It then argues for a new model of understanding (...) property, called cont(r)actualisation, which seeks to reconfigure existing strategies. It makes the case that the legal categories of person and object should be brought together under the overarching heading of ‘legal entity’. Rather than being built around humans as persons/subjects and non-human entities as objects/objects, law should be built around the contingent points of contact between particular entities in a particular web of relations. In this way, the article advances a view that does justice to how these entities contribute to what human beings are and do. (shrink)

Context: Technology has not only changed the way we teach mathematical concepts but also the nature of knowledge, and thus what is possible to learn. While geometric transformations are recognized to be foundational to the formation of students’ geometric conceptions, little research has focused on how these notions can be introduced in elementary schooling. Problem: This project addressed the need for development of students’ reasoning about and with geometric transformations in elementary school. We investigated the nature of students’ understandings of (...) translations, rotations, scaling, and stretching in two dimensions in the context of use of the software application Graphs ’n Glyphs. More specifically, we explored the question “What is the nature of elementary students’ reasoning of geometric transformations when instruction exploits the technological tool Graphs ’n Glyphs?” Method: Using a design research perspective, we present the conduct of a teaching experiment with one pair of fourth-graders, studying translation and rotation. The project investigated how and to what extent activity using Graphs ’n Glyphs can elicit students’ reasoning about geometric transformations, and explored the constraints and affordances of Graphs ’n Glyphs for thinking-in-change about geometric transformations. Results: The students proved adept using the software with carefully designed tasks to explore the behavior of two-dimensional shapes, distinguish among transformations, and develop predictions. In relation to varied conditions of transformations, they formed generalizations about the way a shape behaves, including the use of referent points in predicting outcomes of translations, and recognizing the role of the center of rotation. Implications: The generalizations that the students developed are foundational for developing an understanding of the properties of transformations in the later years of schooling. Dynamic technological approaches to geometry may prove as valuable to elementary students’ understanding of geometry as it is for older students. Constructivist content: This study contributes to ongoing constructivism/constructionism conversations by concentrating on the transformation of ideas when engaging learners in activity through particular contexts and tools.
