Jainism is a religio-philosophical school of India which reacted against the Brahmanic/Vedic tradition and established as a school of thought. As a way of life it started as a Sramanic movement (the non-Brahmanic ascetic tradition) to attain the truth. Jains metaphysics and epistemology are purely logical and conducive for all. Jainism always is against the physical and psychological violence, and believes that it is the Ekanta (one sided view of reality) philosophy, which leads to violence. According to the Jains, (...) Ekantavada is a very rigid view, thus partial in nature. Any school asserting this claim for the absolute truth logically thus rejecting all the other views that basically leads towards dogmatism and in toleration; which further aggravated and leads toward violence. Mahavira as a champion of Ahimsa (nonviolence) carried out this concept from the domain of practical behaviour to the domain of intellectual and philosophical discussion. The Jaina principle of respect for the other life gave rise to the principle of respect for the views of others; thus they advocates Anekāntavāda. According to them, non-violence is the goal and Anekāntavāda becomes the tool. Its Syadvada is basically a logical inclusivity which accepts diversified aspects of truth. Consequently, it tells that a complete understanding of any truth requires the consideration and acceptance of a variety of viewpoints. This pluralistic view of the Jains is to be effective well to combat social violence and evils too. The world is in the pyramid of violence that can only entail massive destruction of this phenomenal world in any moment. I think, this pluralistic approach of Anekāntavāda is to be considered as the panacea to overcome all types of rigidities and bigotries of the present society as well. Because of the impact of Islam in the development of Arab culture, the first Arabic thinkers were theologians. Their main concern was not to prove God's existence or his creation of the world (both these facts being obvious in their view), but to solve questions related to human destiny. They argued about such questions as whether the Muslim who had committed a major sin had thereby lost his faith and deserted the community of believers, and about the exact status of (...) human freedom. This second question was particularly perplexing since, if a person is the author of his own acts and therefore responsible for them, God's power would be curtailed, but on the other hand, if the person is not responsible, his freedom of action is suppressed and God would be unjust in punishing him for his bad deeds. (I make no distinction here between the terms “God” and “Allah,” since for Muslim authors the God of Islam is also the God of Judaism and Christianity.). (shrink)

The tendency to question the accuracy of sensory perception is found in various medieval theological traditions, including Franciscan and Islamic. In both these traditions, the source of the idea that we cannot trust our sensory perception seems to have been the Greek commentaries on Aristotle. However, both traditions go beyond ideas contained in Greek Aristotelian literature and independently develop similar arguments and come to similar conclusions about the reliability of sensory perception.

Common experiences of mothering offer profound critiques of maternal ethical norms found in both Christianity and Islam. The familiar responsibilities of caring for children, assumed by the majority of Christian and Muslim women, provide the basis for reassessing sacrificial and selfless love, protesting unjust religious and political systems, and dismantling romanticized notions of childcare. As a distinctive category of women's experience, motherhood may offer valuable perspectives necessary for remedying injustices that afflict mothers and children in particular, as well as for (...) developing cross-cultural understandings of justice in general. It aimed to identify the strategic creativity in Islamic banks in Palestine between reality and implementation. The study adopted the descriptive analytical approach. A questionnaire was designed as a tool for the study. The study community consisted of all employees in Islamic banks from the top and middle management and the study has been applied to the Palestinian Islamic bank and the Arab Islamic Bank. The comprehensive inventory method was used, given the small size of the study sample, as (...) questionnaires were distributed to (175) employees, and a number of (5) categories were chosen from each branch of the bank(general manager, deputy general manager, director Branch, department head, department manager). (164) questionnaires have been used Recovered with a recovery rate of (93.71%). The study showed a number of results, the most important of which is the availability of dimensions of strategic innovation at a high level in Islamic banks in Palestine with a relative weight of (82.22%). In addition, that there are no differences between the averages estimates about the reality of the study variables in Islamic banks due to (gender, age group, educational qualification, number of years of service, job title). The study also presented a set of recommendations, including that the bank should provide the environment and the appropriate climate for employees to invest their intellectual energy, urge them to strategic creativity, and deal fairly with all creative ideas regardless of their source. The Islam and human rights nexus is too often viewed as being static. In reality, the relationship is complex and mutable. In an era of unsettling changes to the status quo, perceptions of the Islam and human rights nexus have also proven to be sensitive to shifting political dynamics. In these circumstances, the position that Islam and human rights are inherently in conflict, which assumes two settled entities in a stable relationship, is becoming hard to sustain – as is (...) the position that human rights are ineluctably tied to Western civilization. Many Muslims are arguing that Islam and human rights are harmonious, and human rights contain principles that address some of Muslims' most pressing concerns. However, there are also factors – such as certain U.S. policies - that could work in the opposite direction, energizing Islamist hostility to human rights and confirming Muslims' suspicions that human rights are part of a nefarious Western plot. We must recognize that the Islam and human rights relationship is regularly readjusting in response to a changing environment, so that the issues addressed over the next decades will not likely be the same ones that Muslim societies and Islamic thinkers have been wrestling with to date. This chapter aims to discuss critically the changing values in higher education within the context of culturally, ethnically and religiously plural modern European societies with a special focus on the case of emerging European Islamic higher education institutions. The inquiry argues for the need to rethink the core values in Islamic and western liberal, secular higher education in order to facilitate a new creative engagement between these two distinctive perspectives on higher education that share an intertwined intellectual legacy. The focus (...) of the study is framed by the following questions: Do central educational values of Islam and western secular higher education remain in conflict? To what extent can a critical dialogue of convergence be facilitated between the educational/pedagogic cultures of Islamic and western higher education? Why should such a critical engagement be based on a shared relational ethics of respecting the dignity of difference and recognition of mutual interdependence? The study adopts a phenomenology- infomed critical, comparative analysis method while exploring the topic within its historical and contempoaray dimensiosns. The original contribution of the inquiry lies in its reflective engagement with the Islamic and western values of higher education and developing a distinctive conceptual framework to facilitate a new pedagogic dialogue among the communities of learners and teachers coming from these educational cultures who increasingly share the same social space. After presenting the aims and context of the inquiry, a brief historical account of Islamic and western values of higher education will be provided. This will be followed by discussing the arguments supporting the incompatibility of Islamic and western values of education. The incompatibility thesis will be deconstructed by critically examining its logic of binary literalism. By drawing on the evidence suggesting presence of a shared reflective, critical educational heritage between Islam and the West, the chapter argues for the need to revive these forgotten traditions of pedagogic curiosity and critical openness to inspire a new cross-pollinating dialogue capable of acknowledging the dignity of being different and recognizing the reality of sharing an interdependent world. Since the time of the Renaissance, it has been believed in the West that Greco-Roman Civilization developed solely between Athens, Rome and Paris. In so doing, we forget the detour that Greek culture took into Muslim culture over a period of several centuries, and the influence of this culture on Muslim philosophy and science. This assumption also fails to take note of Muslim influence on Europe, in which Andalusia and Sicily acted as intermediaries. In order accurately to trace the spread (...) of knowledge from Greece we must follow a path leading from Athens to Baghdad and Cordoba before reaching Paris. If we omit this historical reality, we underestimate the role played by Eastern Christians and Jews in the transmission of Greek knowledge to Islam, and from Islam to the West. (shrink)

After the tragic events in New York, Madrid, Istanbul, and London, one has every reason to think that Islam is somehow a part of the problem. Understanding of the afterlife significantly determines life of members of individual religions and this article defines how Muslims understand the last realities, which paths lead to Jannat (heaven) and which to Jahannam (hell), and how these afterlife dwellings are presented in Qur’an. Demonstration of Islamic soteriology includes a description of differences between the Sunni and the Shia interpretation of salvation, because the differences between them are often overlooked or remain in the background due to the generally widespread Sunni interpretation of (...) Islam. Finally, the article opens the question of who is, according to the Islamic teaching, the recipient of salvation and shows why it is difficult to give a one-dimensional answer to the question whether only the righteous Muslims will be saved or if the salvation is also intended to be achievable to adherents of other religions or even to non-religious. In this paper, the attributes of Jesus as the second person of Trinity in Christianity and Muhammadan Reality in Islamic Theosophy were compared. The term ''Muhammadan Reality'' in Islamic Theosophy refers to transcendental and divine being of Muhammad rather than his human and historic existence. According to this research, both Jesus and Muhammadan Realities have divine attributes. They are lights of God, the Word or the Pen of God, the creators of the word, omniscience, omnipotent, omnibenevolent as well (...) as the intermediaries between God and humans. In this study, it is demonstrated that what happened to Jesus in Christianity, it has also happened to Muhammad in Islamic theosophy with some differences. The influence of Greek philosophy, especially Platonic, in ascribing these attributes to Jesus in Christianity and Muhammad in Islamic theosophy is undeniable. There is a strong temptation among the scholars of both religions, Islam and Christianity, to extend Jesus and Muhammad to the level of divinity and godhead. (shrink)

The distinction between existence and essence in contingent beings is one of the foundational doctrines of medieval philosophy. Building upon Neoplatonic precursors, thinkers such as Avicenna and Aquinas debated its nature. However, one Islamic philosopher, who had an enormous influence on the development of philosophical discourse in Iran, subverted the traditional Peripatetic vision of reality and disputed the ontological nature of existence. Through a critique of the Peripatetic notion of existence, Suhrawardi demonstrated the irrelevance of the distinction for metaphysical (...) inquiry, which should, instead, rely upon an eidetic vision of the 'hierarchy of lights'. I shall explain why the later tradition advocated an essentialist reading of Suhrawardi and suggest that the Platonic hermeneutic of essential vision which Suhrawardi expounds, might be the reason for it. Later philosophers in the Islamic tradition had mistaken methodology for a description of reality. (shrink)

This article is an overview of the evolution of Islamic radicalism during the 19 th - 21 st centuries. It demonstrates that nineteenth century Islamic radicalism is based on the ideas of pan-Islamism, whose main representatives are J. al-Din al-Afghani and M. Abduh. In turn, Islamic radicalism of the twentieth to twentyfirst centuries is based on the ideas of Islamic fundamentalism. Its main representatives are H. Al-Banna, S. Qutb, the Deoband movement, al-Maududi and R. Khomeyni. Pan-Islamic theories of the 19 (...) th -20t h centuries are based on the thesis that people who seek liberation from colonial oppression should merge. However, scholars have different views on the union of the Muslim world. It was, once, regarded as a combination of historical circumstances and the political realities of the nineteenth century. These were further shaped by the basic idea of Islamic fundamentalism in the twentieth to twentyfirst centuries, which is Salafiyya, or a return to “pure Islam”, a revival of active faith traditions and the union of all walks of life under the Sharia law and strict interpretation and application of its rules. The instruments used by Islamic fundamentalists and radicals to implement it have been the Islam-related slogans for Takfir and Jihad. But in the 21st century, integration and globalization have started playing a significant role. Various geopolitical forces are using various tools, including the idea of Islamic radicalism. This collection of essays by one of the best known contemporary Muslim scholars writing in English covers many facets of Islamic life and thought. The author has brought together studies dealing with the practical as well as intellectual aspects of Islam in both their historical and contemporary reality. The contemporary significance of themes such as religion and secularism, the meaning of freedom, and the tradition of Islamic science and philosophy is given particular attention.

It is known that there are different concentrations of Muslims in European countries. However, Germany has a special importance in these countries due to the numerical excess of Muslims and the existence of our compatriots due to the economic migration from Turkey to Germany that started in the 1960s. For this reason, in our article, the educational activity carried out on Islamic theology, in particular kalam, in the example of Germany will be discussed. In Germany, Islamic religious education departments were (...) opened in three different universities to train teachers to teach Islamic religion in primary, secondary and high school schools, and to provide Imam education in order to eliminate the language and adaptation problems experienced by mosque officials coming from abroad. The process that started with Osnabrück University, Westfälische Wilhelm Münster University and Friedrich-Alexander University has progressed beyond the initial aim of training Islamic religion teachers with the seven universities reached today. In addition to the influence of the German Islamic Conference on the formation of the theoretical infrastructure of this process, the impact of the 2010 recommendation of the Scientific Committee is also known. The originality, scientific impartiality and conformity of Islamic Theology in Germany are the issues that are emphasized in the discussions. As a matter of fact, for this reason, the discussion of the science of of kalām in these centers is of particular importance in the debates. Because kalām is a science that shapes the understanding of religion and offers the opportunity to develop a correct intellectual perspective on religion. It is possible to say that the content of kalām in these centers and the studies carried out will affect the understanding of Islam that will emerge in Europe, especially in Germany, in the next century. For this reason, in our article, the study areas of theology professors in seven Islamic Theology centers and theses which they supervise will be discussed, on the other hand, researches, projects and collaborations that reflect the intellectual perspective of the Islamic Theology center will be highlighted. This article aims not only to criticize the said centers in Germany, but also to determine what kind of mutual contributions they might have with the theological accumulation in Turkey. As a matter of fact, it is obvious that the courses given, the theses managed and the fields of study will shape the future of Islamic theology in Europe, as well as having an impact on Islamic theology in Turkey given that today global scientific interaction is at the highest level. It is not possible to think the issues currently studied in Islamic Theology in Germany independently of the realities and needs of the country in which they flourish. As a matter of fact, although there are historical studies on Islamic theology schools, especially Maturidism, Ash'arism and Mu'taziliism, in different universities, the existence of studies on subjects that can be called “practical theology” draws attention. In addition, due to the fact that Germany creates a multi-religious and multicultural environment, it is seen that a supra-denominational approach is adopted and thus it is aimed to ensure a pluralism that allows different views. The present work is part of a trilogy including Ideal and Realities of Islam and The Heart (...) of Islam. Nasr states that the common theme in the trilogy "is the universalist perspective and respect for other religions" (p. xxiv). In addition, Nasr clarifies that his approach, as with all of his Islamic writings, is to write from an Islamic perspective, which he terms "traditional Islam" (p. xxiii). Nasr stands opposed to either the secular modernist or fundamentalist perspectives, both of which he regards as forms of extremism.This book, initially published as part of Our Religions, edited by A. Sharma, is significantly revised and includes a new introduction and bibliography. It can best be described as a primer on Islam, consisting of eight chapters that focus on a variety of pertinent themes.Chapter 1 deals with the self-understanding of Islam and the Islamic world. Islam, Nasr notes, sees itself as a return to the primordial faith of humanity, a faith that affirms the unity and oneness of God. This chapter also presents an overview [End Page 495] of the various ethnic and cultural groupings within the Muslim world, and charts the spread and demographic growth of Islam.Chapter 2 introduces the notion of al-din, an Arabic term that corresponds closely to the word "religion." This study documents how multicultural education is constructed and implemented in a local pesantren in Tabanan, Bali, Indonesia, namely PBBI (Pesantren Bali Bina Insani). It demonstrates that the multicultural education in this pesantren is based upon the reality of religious, cultural, ethnic, group, and gender diversity that exists surrounding the pesantren. Teaching and administrative staff of this pesantren consist of Muslims and Hindus. Students come from the different socio-cultural backgrounds. Inclusive and tolerance values are incorporated into the curriculum of (...) the pesantren. Multicultural education in this pesantren has become a strategic instrument for adaptation to the Hindu environment where it is located. The pesantren teaches students how to implement Islamic teaching on pluralism and inclusivism in their daily activities. (shrink)

Tolerance implies both renunciation and negotiation, concepts that assume truth as relative. The rationality of religious faith does not acknowledge the existence of a shared truth, but history reminds us that religions could be directed through their social representatives to engage in social realities. This had been the case with Islam, despite the existence of strong structuring of knowledge and the Ulemas who play a vital role in its control and reproduction.

Muslims living in England are living in a predicament. On the onehand, they have to face the reality that the laws governing the family institutionare secular in nature. This poses a threat to their identity and freedom ofreligion. On the other hand, they are commanded by Islam to settle theirdisputes according to its laws and principles. However, this is unrealistic,simply due to the fact that the only recognized legal system in England isthe English Law. To circumvent this situation, certain (...) Muslim scholars andcommunities have established quasi-judicial courts, acting in the capacity ofmediators, counsellors, arbitrators and even judges, in order to settle maritaldisputes. These courts, known as Shariah councils, provide a modern approachto alternative dispute resolution, whereby Muslim families and individualscan have their disputes resolved amicably. It was also set up as a response forMuslims to adapt to life under the English secular laws in which they live in,that do not afford them the right of having a Sharʑah-based institution. Onesuch Shariah council offering a modern approach to settling marital disputesamicably is the Islamic Council of Europe. The researcher conducted anin-depth interview with the said council and was able to collect a couple ofarbitrational cases and analysed them in order to give a better understandinginto its inner workings, its structural set-up and operation. One of the most widespread claims combining epistemology and metaphysics in post-Avicennian Islamic philosophy was that every object of thought is real. In Muʿtazilite reading, it was endorsed due to a theory of knowledge which states that knowledge is a connection or relation between the knower and the object known. Avicennists accepted it due to the rule that in a proposition “s is p” if p is something positive s has to be positive and real too. Hence, insofar as one (...) can conceptually distinguish between two non-existent items, they have to be real. In this article, the author presents significant consequences of this theory: the acceptance and denial of non-existent yet real extramental objects; the concept of mental existence as an alternative solution; the conceivability of paraconsistent ideas and their reality or reducibility to some real objects. The object of this paper is to elaborate an understanding of Islamic law and legal theory in terms of the conceptual framework provided by Legal Positivism. The study is not based on denying or contesting the claim of Islamic law to being of divine origin; rather, it is based on the historical reality of Islamic law as part of a (once) living legal tradition, with structure, method, and theory, regardless of claims of origin. It will be suggested that Ash‘arism (...) may be taken as providing an Islamic version of Legal Positivism, and that the objections which Mu‘tazilism raised in the face of Ash‘arism were not different in substance from some of the objections that have been directed at contemporary Legal Positivism. It will also be suggested that the Ash‘arites and the Mu‘tazilites were not opposed to each other in the way they are commonly supposed to have been. An exposition of Islamic mysticism by a Sufi scholar.

Religious moderation has been popular and widely promoted to students as a countermeasure to radicalism. However, it runs across several challenges. Not to mention that radicalism has extended its influence within Islamic universities in Indonesia. Many research organisations have found that Indonesian students tend to be radical. Hence, the discussion around religious moderation among students highlights its urgency. With emphasis on the reception of Islamic university students to religious texts, this study proposed the appropriate approach to religious moderation in the (...) context of plural Indonesian society with the reception of Qur’anic verses and hadiths that promoted moderation. It employed a qualitative approach with a purposive sampling technique involving 81 students of Islamic Religious Education of UIN Maulana Malik Ibrahim Malang as the research subjects. They were students from four semester IV and VI classes. This study revealed several key findings: firstly, the majority of students equate religious moderation with religious tolerance; secondly, students draw from a range of verses and hadiths that emphasise religious moderation, primarily on tolerance promotion; and thirdly, students’ application of religious moderation based on religious texts manifests through verbal, written and practical approaches. This study presents a model for developing religious moderation rooted in students’ comprehension of religious texts advocating moderation. This study implies using religious texts to promote moderate thought to lessen radicalism and intolerance in the world. Contribution: This study introduces a religious text-oriented approach to enhance the development of religious moderation, thereby refining strategies and methods that have predominantly emphasised aspects of social reality. The religious texts that advocate for moderation are accepted and applied by students in their lives. This contribution is crucial to lessening radicalism and intolerance in Indonesia. (shrink)

Generally, in Muslim world, art and beauty are almost neglected ones, so, they are not given significant and sufficient importance because of some unauthentic and false notions and consequently, we have almost lost this pristine Islāmic heritage and now we must revisit it and realise its vital function and role in our socio-political and ethico-spiritual life. Islāmic aesthetics has a significant role in the cultural tradition of Islāmic Ummah, so it must be revitalised for a peaceful life’s onward caravan. The paper provides valuable accounts of the general concepts underlying privacy law in both cultures, and great detail about the impact of criminal procedure and evidence rules on privacy in reality rather than legal theory. It is, in this sense, a “realist” approach to privacy, particularly but not exclusively in relation to sexual activity. The distinction which the article draws between the frameworks within which privacy is conceived broadly, self-determination and limited government in the USA, protection of one’s persona (...) in Europe, and reputation in Islamic law. However, the paper argues that Western and Islamic traditions share many of the same concepts about the tests to be applied when deciding how far an intrusion on privacy is justified and value many of the same interests in doing so. At the same time, it will highlight those areas where they differ which are not ones of crucial importance when deciding, for example, what are the proper limits on mass surveillance. Indirectly, this shows that even though there may be stark differences between the cultures on some points, there is enough agreement on some aspects of privacy to make comparisons in relation to issues such as mass surveillance. The scholar Jin Tian-zhu (1690 ~ 1765) was a Muslim of the Hui 回 ethnic group in the Qing dynasty who adhered to Islamic traditions handed down from generation to generation. In Qing Zhen Shi Yi, Jin Tian-zhu attempts to combine Confucianism and Islam through a simple comparison of their rituals. Jin Tian-zhu expresses his respect for Allah by attesting Allah’s existence and insisting that humans should obey Allah. He admits that in reality, besides Allah, the ruler is also (...) clearly an object of loyalty. In addition, he asserts that it is basic propriety for Muslims to be filial to their parents and that the scope of practice of filial piety must also apply to their ancestors beyond their parents. Jin Tian-zhu further expands his view of zhongxiao 忠孝 by asserting that the ultimate Muslim interest is in renlun 人倫, which he believes must be rectified. (shrink)

The paper explores Islamic morality within labor market realities. It presents Islamic moral axioms that are expected to guide employer–employee relationships. It provides an extensive review of Islamic moral ideals related to fairness in the labor market. Based on survey data from 319 individuals in the Saudi labor market, it tests three hypotheses related to religiosity, secular aspirations, and perception and practice of fairness in the labor market. Using multinomial logistic regression, the findings from several models clearly support all three (...) hypotheses. They show that employers, owners and senior managers were more likely to consider market reality as their reference for describing fairness. Ideally speaking, the regression results confirm that being religious contributes positively to the sense of fairness even in a secular context. However, they also reveal that secular aspirations override religious ideals when it comes to market realities. In other words, when people place great importance on worldly outcomes, religious ideals have almost no impact on their labor market practices even if they ideally support fair practices. The study concludes that religious morality does matter with regard to fairness in employer–employee relationships only if it is not superseded by secular aspirations. Those who have a high-level of religiosity consider themselves to be fairer. However, if they embrace secular aspirations, they are less likely to practice their moral ideals in the labor market. Academic research suggests that variances in contextual dynamics, and more specifically religion, may lead to disparate perceptions and practices of corporate social responsibility. Driven by the increased geopolitical and economic importance of the Middle East and identified gaps in knowledge, the study aims to examine if indeed there is a divergent form of CSR exercised in the region. The study identifies unique CSR dimensions and constructs presented through an empirical framework in order to outline the practice and perception of CSR (...) in a context with strong Islamic beliefs. The framework goes beyond the platform of mere Islamic philanthropy and is based on CSR-stakeholder management practices. Following an exploratory research design and collecting interview data from representatives of 63 organisations from Saudi Arabia, the United Arab Emirates and Oman, the study offers a snapshot of the CSR reality from the perspective of those living the phenomenon. The results suggest that the practice and perception of CSR in the examined context are largely grounded in the areas of social and altruistic actions but they cannot be examined in isolation from the religious context of CSR operation. This focus is mainly attributed to the dominant role of Islam in the examined sample, which leads to forms of non-structured or semi-structured approaches to CSR. Apart from the theoretical advancements offered to the CSR literature, the study also provides contributions for practitioners and policy makers. (shrink)

What is language? How did it originate and how does it work? What is its relation to thought and, beyond thought, to reality? Questions like these have been at the center of lively debate ever since the rise of scholarly activities in the Islamic world during the 8th/9th century. However, in contrast to contemporary philosophy, they were not tackled by scholars adhering to only one specific discipline. Rather, they were addressed across multiple fields and domains, no less by linguists, (...) legal theorists, and theologians than by Aristotelian philosophers. In response to the different challenges faced by these disciplines, highly sophisticated and more specialized areas emerged, comparable to what nowadays would be referred to as semantics, pragmatics, and hermeneutics, to name but a few – fields of research that are pursued to this day and still flourish in some of the traditional schools. Philosophy of language, thus, has been a major theme throughout Islamic intellectual culture in general; a theme which, probably due to its trans-disciplinary nature, has largely been neglected by modern research. The role of reason, and its embodiment in philosophical-scientific theorizing, is always a troubling one for religious traditions. The deep emotional needs that religion strives to satisfy seem ever linked to an attitudes of acceptance, belief, or trust, yet, in its theoretical employment, reason functions as a critic as much as it does a creator, and in the special fields of metaphysics and epistemology its critical arrows are sometimes aimed at long-standing cherished beliefs. Understandably, the mere approach to these beliefs (...) through organized philosophical activity, however well-intended, is viewed with suspicion by ecclesiastical authorities and the devout. The attitude towards philosophical inquiry on the part of the Islamic religious community might be thought to typify this reaction. As one of the great prophetic religions, the self-avowed image of Islam is of a tradition which already possesses the truth as set forth in the divine revelation of the Qur'an. What need is there for philosophizing on fundamental matters, e.g., the ultimate nature of reality, the foundations of morality, the modes whereby the divine is connected with the temporal? The structure of creation is already made clear, the "straight path" for living already manifest. how can philosophical activity be anything but a source of divisive controversy, for as it turns its gaze to the foundations upon which the Shari`a' (Islamic Law) rests, or to the grounds for religious belief itself, it cannot avoid turning up alternative viewpoints, different perspectives on divine revelation, noting various weaknesses in received 1 interpretations? In short, isn't the practice of philosophy a threat to Islam's promise of providing a comprehensive way of living devoid of skepticism and uncertainty about the place of a human in God's creation and his or her role in the 'umma (Islamic community)? This problem is not unique to Islam, nor is it a new one within Islam. Basic characteristic of Islamic heritage law, principally it has accepted the two-to-one ratio between the male and the female children/siblings in division of heritage. In Islamic inheritance law, the main/basic reason why the share of the male is twice the share of the female is no “value” judgments given to female/women in creation and gender in Islam, on the contrary, are real realities related with the roles and financial obligations that man and woman have undertaken, in other words, related with (...) “socio-economic structure/fact” in the family and society structure foreseen by Islam. As a matter of fact, “need principle” is based on in division and succession of heritageand a fair arrangement has been made in accordance with the rights and responsibilities of the husband and wife in Islamic Law. In some classical tafsīr books, the concept of “degree” in the verse “... Men have a degree (right) over women” (Al-Baqara 2/228) mentioning the mutual rights and responsibilities of women and men; and the expression of “lil al-dhakari mithlu haẓẓ al-unthayain” in the verse –the inheritance of man is the share of two women– (Al-Nisā 4/11) mentioning the inheritance shares of boys and girls is interpreted against the woman by disregarding the intended purpose and socio-economic contexts of these verses. As a result of this interpretation, the share of men in inheritance is twice the share of women in Islamic law is ontologically (existential/creation) based on a justification that “man is superior to woman”. In this article/study, an analyticallook atthe interpretations in some classical tafsīr books on the axis of “daraja/degree” and “lil al-dhakari mithlu haẓẓ al-unthayain” that today sheds light on the sociological-historical background of depriving the daughter from the heritage will be made. Summary: Just as there is no way to determine a person’s sex, it is not either possible by reason to have such an opportunity. - With the possibility of medical intervention nowadays - sex is determined by the discretion of the Supreme Creator rather than will. Indeed, it is mentioned in the Qur’ān: To Allah belongs the dominion of the heavens and the earth; He creates what he wills. He gives to whom He wills female [children], and He gives to whom He wills males (Al-Shūrā 42/49.)In addition to human biological sex, there is also social gender. Indeed, the term “sex” refers to being biologically female or male, while the term "gender" refers to the social and cultural identity of a woman or man, or the social roles that occur in the historical process.Accordingly, while it is not possible to determine biological sex (in normal circumstances in advance), determining gender is shaped by the cultural will of individuals and societies. As a matter of fact, gender is shaped according to the religions, customs and cultures of the societies and it shows differences according to time, culture and family structure. In this context, in the pre-Islamic Arab society, the gender of the girl or the woman was shaped by the custom of the ritual and customs. Indeed, it is a known fact that during the period of Jahiliyyah, in terms of social gender, the girl/woman has been deprived of many social and economic rights, especially heritage. The Qur’ān has brought the girls who, in the period of Jahiliyyah, were oppressed in terms of gender, deprived of many social and economical rights, treated as second class human, embarrassed of themselves and buried alive, to the same position as man. In this context, as it is in every field in the direction of social structure and social conditions of that day, also in the field of inheritance law, a number of regulations were made in the Qur’ān and the Sunnah being the main sources of Islam. The divisions of the inheritance were connected with religious and legal rules and the shares of the inheritance of the sons and daughters were determined by naṣṣ (verses and hadiths).However, in Islamic inheritance law, as a requirement of the structure of family and society accepted by Islam, in principle, “two-to-one” measures have been adopted between male and female children. As a matter of fact, in this aspect, it is mentioned in the Qur’ān: Allah instructs you concerning your children: for the male, what is equal to the share of two females (Al-Nisā 4/11.)On one hand, the principle that Islamic law brings between boys and girls; Seems to be an inequality in terms of the arrangement in which "the inheritance share of the male child is twice the share of the female child", while on the other hand, within the border of in the family foreseen by Islam, this regulation has not been seen as an injustice and inequity by Muslim societies, because in Islamic family law, a man is obliged to ensure the livelihood of the family after marriage. He is also obliged to give his wife her mahr when marrying.In Islamic inheritance law, “necessity principle” is taken as the basis of responsibility that women and man have undertaken in family and society. Therefore, even though giving nothing at all to those who are not in need and giving less to those who are in less need, giving too much to those who are in much need might seem contrary to the principle of equality, it is a necessity of the principle of justice and fairness. As a matter of fact, while "law equality, necessity in sharing" principle, law is arranged according to people's qualifications, goods and wealth sharing is divided according to the needs of people. In this context, there has been a fair division in Islamic heritage law based on the necessity, (distributive) justice and fairness principle. Indeed, the French philosopher Roger Garaudy (1913-2012), who chose /converted to Islam, evaluates the following about the proportion of male child in the Qur'an to that of female child: “When we consider that in the Arab society all the obligations of the family and of the care of the parents and of all the things that we call ‘social security’ today are put on the shoulders of the husband, the hereditary male child's share must be twice as high as the female child’s is”.As Garaudy argues, the difference in the inheritance of women and men in Islamic inheritance law is not a legal discrimination/inequality, but a form of divisiveness stemming from a need based on the role and responsibility that women and men have undertaken in the family and society. Therefore, giving nothing to those who need nothing, giving little to those who need little, and giving a lot to those who need a lot,even though may seem contradictious to the principle of equality, it becomes a necessity of equity and (distributive) justice principle. In this case, in Islamic inheritance law, the basic reason why the share of the male child is twice the share of the female child, is social and economic reasons and it is possible to rank them as follows:1) According to Islamic law, women are not obliged to make their own economic livelihoods. The woman’s economic responsibility belongs to her father or brothers before marriage, and then to her husband after marriage. 2) When a woman is married she is not responsible for herself or other family members’ livelihood. The male is obliged to make a living for himself, his wife and his children.3) While married, the male is obliged to give the wife mahr. The woman has no such responsibility.As it is understood from the above explanations, in Islamic inheritance law, the basic reason why the share of the male child is twice the share of the female child is not about the ontologically “value” based on creation and sex given to the woman (girl child) in Islam. On the contrary, it is the real facts concerning the family and society structure that Islam predicts, the roles and financial obligations that man and woman have undertaken, namely “socio-economic structure/fact”.In some commentaries in classical commentary books, the rights and responsibilities of women and men are referred to, like: the word “degree” mentioned in: …but the men have a degree over them [in responsibility and authority (Al-Baqara 2/228), and the talk about the inheritance shares of boys and girls in: for the male, what is equal to the share of two females (Al-Nisā 4/11). Eventually, the concepts “lil al-dhakari mithlu haẓẓ al-unthayain” have been associated with the gender of the woman/girl child ontologically (based on social fact) by ignoring the referent purpose and socio-economic contexts of these verses. As a result of these interpretations, it was desired that the Islamic law principle of inheritance share of male child being twice the share of female child, ontologically, should be based on a justification that “man is superior to woman”.In this study, some of the era’s dominant culture classical interpretations grounding women's inheritances share on her gender and based on the axis of the concepts of "degree" and “lil al-dhakari mithlu haẓẓ al-unthayain” in the related verses of the Qur'ān will be elaborated. In this book the author seeks to explain the distinct character of Islamic art as a manifestation of the spiritual realities of the Quranic revelation in the world of forms. The book undertakes to study certain important facets of Islamic art ranging from calligraphy, painting and architecture to music, literature and plastic art, and underlines the sacred and spiritual nature of each. While the author has dealt with Islamic art, as produced in various countries of the Islamic world, his universe (...) of discourse is primarily Persian art. For Nasr, Islamic art is essentially an outcome of the inner dimension of Islam which is inextricably related to Islamic spirituality. This esoteric aspect has all along molded the soul of the Muslim artist by imbuing in them certain transcendental attitudes and virtues derived from the Quran and the prophetic traditions. In support of his esoteric thesis Nasr argues that many of the greatest masterpieces of Islamic art were created much before the sciences of the Quran and the Hadith were fully codified and accepted in the world of Islam as the ultimate authoritative works produced in those fields. If Islamic art leads to the inner chamber of the Islamic tradition it is because this art is a message from the noumenal world sent to those qualified to harken to its liberating message. The object of this paper is to explore the possibility defending women's rights (or, more broadly, expressing women's concerns) within a framework of Islamic concepts and ideas. This is to be accomplished by introducing a number of methodological principles that can, and (for feminists) should govern the practice of "religious interpretation" (ijtihad) which Muslims have used throughout the centuries to adapt Qur'anic and Islamic teachings to changing realities and circumstances.
