When studying the work of Émile Durkheim, scholars must consider how his intellectual development in a traditional Jewish environment contributed to and informed his ideas. This article details how Durkheim’s upbringing endowed him with a traditional rabbinic thought-model. The author analyzes five of Durkheim’s major works to argue that the system of classification, language, and style of argument Durkheim used to define concepts in his scholarship mirror streams of rabbinic thought. The article builds off the sociology of knowledge to illuminate (...) how Durkheim employed his codified knowledge of biblical texts and modern Jews to bolster his arguments, and reveals the subtler ways he demonstrates his tacit knowledge of the texts and argument styles. The article ends with an exploration of how conceptual frameworks from the sociology of knowledge may be applied to other leading sociological thinkers—how the modes of thinking instilled during formative years may orient scholarship and the benefits and limitations of this approach. Informed consent, decision-making styles and the role of patient-physician relationships are imperative aspects of clinical medicine worldwide. We present the case of a 74-year-old woman afflicted with advanced liver cancer whose attending physician, per request of the family, did not inform her of her true diagnosis. In our analysis, we explore the differences in informed-consent styles between patients who hold an "independent" and "interdependent" construal of the self and then highlight the possible implications maintained by this position in the context (...) of international clinical ethics. Finally, we discuss the need to reassess informed-consent styles suitable to the needs of each patient regardless of whether he or she resides in the United States or in Japan. (shrink)

This article explores the affective dimension of resilient epistemological systems. Specifically, I argue that responsible epistemic practice requires affective engagement with nondominant experiences. To begin, I outline Kristie Dotson's account of epistemological resilience whereby an epistemological system remains stable despite counterevidence or attempts to alter it. Then, I develop an account of affective numbness. As I argue, affective numbness can promote epistemological resilience in at least two ways. First, it can reinforce harmful stereotypes even after these stereotypes have been rationally (...) demystified. To illustrate, I examine the stereotype of Black criminality as it relates to false confessions. Second, it can encourage “epistemic appropriation”, which I demonstrate by examining the appropriation of “intersectionality” and #MeToo by white culture. Finally, I conclude that resisting harmful resilience requires affective resistance, or efforts that target numbness via different kinds of affective engagement. I consider Kantian “disinterestedness” as a candidate. (shrink)

Social categories play a central role in inquiry. Some authors have argued that social categories can only play this role because they have a particular metaphysical status, such as a connection to natural kinds or to comparatively joint-carving properties. This reflects the broadly realist idea that categories that play important roles in inquiry do so for metaphysical reasons. In this paper I argue that such metaphysical views of social categories cannot accommodate ‘empty’ social categories, cases in which social categories that (...) cannot have the metaphysical features attributed to them by such accounts still play a central role in inquiry. I defend an alternative approach: context-dependent naturalness, an analogue of metaphysical naturalness that concerns context-dependent, rather than metaphysical, structure. (shrink)

This article is an introduction to a philosophical approach termed “panspiritism.” The fundamental principles of this approach are summarized, with discussion of how it links to earlier (mainly Eastern) philosophical perspectives, how it differs from panpsychism and its relationship to idealism and theism. Issues such as the relationship between mind and matter, the relationship between the mind and the brain, and the emergence of mind are discussed from a “panspiritist” perspective. There is a discussion of how panspiritism relates to mystical (...) experiences. The article concludes by suggesting that this approach can help to elucidate a wide range of phenomena that appear anomalous or problematic from a materialist point of view. (shrink)

Machery and Weiskopf argue that the kind concept is a natural kind if and only if it plays an explanatory role in cognitive scientific explanations. In this paper, we argue against this explanationist approach to determining the natural kind-hood of concept. We first demonstrate that hybrid, pluralist, and eliminativist theories of concepts afford the kind concept different explanatory roles. Then, we argue that we cannot decide between hybrid, pluralist, and eliminativist theories of concepts, because each endorses a different, but equally (...) viable, specification of the explananda of cognitive science. It follows that an explanationist approach to determining the natural kind-hood of concept fails, because there is no consensus about whether or not concept should be afforded an explanatory role in our best cognitive scientific explanations. We conclude by considering what our critique of explanationism could imply for further discussions about the explanatory role of concepts in cognitive science. (shrink)

This chapter sets out John Rawls’s conception of autonomy and considers the role that it plays in his thought across A Theory of Justice and Political Liberalism. I suggest that one distinctive but overlooked feature of this conception is that it takes seriously the threat to autonomy that arises from how individuals are shaped by their social and political institutions. After setting out this conception and tracing its connections to wider discussions of autonomy, I argue for two main conclusions. First, (...) that despite appearances to the contrary, Rawls’s autonomy-based commitments are broadly speaking consistent across his two main works. Second, that these autonomy-based commitments are not in fact disbarred from playing a grounding role in Political Liberalism. On the contrary, I suggest that Rawls’s conception of autonomy motivates his aim of finding principles of justice that can be stable, and that this in turn illuminates his later commitment to a political liberalism. Some philosophers argue that all concepts cannot have the same representational structure, because no single kind of representation has been successful in accounting for the phenomena related to the formation and application of concepts. Here, I argue against this “appeal to cognitive science” by demonstrating that different theories of the kind concept cohere with different interpretations of the argument. To circumvent the threat of relativism, I argue that theories of concept should be understood as working hypotheses, which are provisionally accepted (...) to facilitate the investigation and explanation of the mind/brain. From this perspective, theories of concept are to be evaluated as part of a comparative analysis of the different kinds of cognitive science they inspire. (shrink)

I offer a new response to the regress argument against pure powers ontologies. This involves rejecting an overlooked premiss, which is that a power’s manifestation is exhaustively accounted for by the powers involved in it. Rejection of this premiss not only answers the regress argument, but also brings with it wider metaphysical consequences, including a shift away from one-category ontologies.

This article examines the nature of affective states across biological taxa. It argues that affect constitutes a primary form of consciousness. Creatures capable of affect are sentient of their bodily states and can behave in ways intended to maintain or restore them to a homeostatic range. After reviewing and critiquing neurobiological and philosophical theories of the evolution of consciousness, this article argues that some possible creatures are limited to self‐directed affective states, even if those creatures are capable of exteroception. Such (...) creatures enjoysolipsistic sentience: awareness of their own selves and bodily demands, but unawareness of their exogenous environments. (shrink)

Representationalists and anti-representationalists disagree about whether a naturalisation of mental content is possible and, hence, whether positing mental representations in cognitive science is justified. Here, I develop a novel way to think about mental representations based on a philosophical description of (cognitive) science inspired by cognitive instrumentalism. On this view, our acceptance of theories positing mental representations and our beliefs in (something like) mental representations do not depend on the naturalisation of content. Thus, I conclude that if we endorse cognitive (...) instrumentalism about mental representations, then we can finally leave the dispute between representationalism and anti-representationalism behind. Techniques for resolving some types of inherited mitochondrial diseases have recently been the subject of scientific research, ethical scrutiny, media coverage and regulatory initiatives in the UK. Building on research using eggs from a variety of providers, scientists hope to eradicate maternally transmitted mutations in mitochondrial DNA by transferring the nuclear DNA of a fertilised egg, created by an intending mother at risk of transmitting mitochondrial disease, and her male partner, into an enucleated egg provided by another woman. In this (...) article we examine how egg providers for mitochondrial research and therapy have been represented in stakeholder debates. A systematic review of key documents and parliamentary debates shows that the balance of consideration tilts heavily towards therapeutic egg providers; research egg providers have been ignored and rendered invisible. However, mapping the various designations of therapeutic egg providers shows that their role is so heavily camouflaged that they have only an absent presence in discussions. We explore this puzzling ambivalence towards egg providers whose contributions are necessary to the success of current mitochondrial research and proposed therapies. We suggest that labels that diminish the contributions of egg providers serve certain governance objectives in managing possible future claims about, and by, therapeutic egg providers. We demonstrate that the social positioning of research egg providers is entangled within that of therapeutic egg providers which means that the former can also never receive their due recognition. This article contributes to the wider literature on the governance of new technological interventions. (shrink)

Commercial republicanism is the idea that a properly-structured commercial society can serve the republican end of minimizing the domination of citizens by states (imperium) and of citizens by other citizens (dominium). Much has been written about this idea in the last half-century, including analyses of individual commercial republicans (e.g., Adam Smith and Immanuel Kant) as well as discussions of national traditions of the same (e.g., in America, Britain, France, the Netherlands, and Italy). In this chapter, I review five kinds of (...) arguments that have been historically offered for how commercial society so understood advances the republican ideal of non-domination: first, by simply realizing non-dominating relationships in the marketplace itself (Instantiation); second, by encouraging the growth of a wide middle class that can offer a counterweight to other, dominating classes (Internal Check-and-Balance); third, by increasing the wealth and power of republics vis-à-vis other, dominating states in the international arena (External Check-and-Balance); fourth, by helpfully nurturing bourgeois-civic virtues in republican citizens (Cultivating Virtue); and finally, by transforming dangerous passions into more readily regulable, even socially beneficial material interests (Sublimating Vice). I end the chapter by briefly considering commercial republicanism’s prospects as a continuing research program. (shrink)

Walter Glannon argues that our proposal for routine recovery of transplantable cadaveric organs is unacceptable After carefully reviewing his counterarguments, we conclude that, although some of them have merit, none are sufficiently strong to warrant abandoning this plan. From the publication of _Growing Up Absurd_ in 1960 until his death in 1972, Paul Goodman had the ear of the young radicals of the New Left, pouring forth books and articles on education, technology, decentralization, and of course, the war in Vietnam. Yet Goodman saw himself primarily as an artist rather than a political thinker or sociologist, and many of his books, even during the 1960s, were works of poetry, drama, and fiction. He had also practiced as a psychotherapist (...) and joined with Frederick Perls and Ralph Hefferkine in producing a new synthesis in psychological thought, Gestalt therapy, which has since become an international movement. In an age of specialization, few writers have taken on so braod a range of concerns. _Crazy Hope and Finite Experience_ is the final summing up of the thought and life of a self-described "old-fashioned man of letters." This book brings together for the first time five personal essays, all written near the end of his life, in which Goodman discusses his sense of the world and how he was "in" it, his politics, his spiritual and religious attitude, his sexuality, and his calling as a literary artist. For those already familiar with one or another aspect of his work, Goodman's self-assessment will provide new insight into the credo that underlies his whole career. For those learning about him for the first time, it offers a vivid sense of the man and his perspective. And for psychotherapists - especially Gestalt therapists - the book will fill in the picture of Goodman as a theorist whose work was crucial to the development of a new approach to therapy. (shrink)

In Australia, since 2004, there has been a move to expand the range of models for legal practice. Lawyers may now incorporate a legal practice, which may have non-legal directors and shareholders. They may also enter into a partnership with a range of non-legal professional partners. This change is happening at the same time that legal practice culture is moving from a professional service model to a business-oriented model. Increased pressures have been thrown into the mix by the global financial (...) crisis and the downturn in the legal market. Inevitably, these changes have created new conflict problems. When a lawyer is responsible to both clients and shareholders, how can that conflict be resolved? What are the roles of non-legal directors or partners? What if they have ethical or legal duties which conflict with a lawyer?s duty to a client? When a corporate legal business is listed on the stock exchange, what pressure may that bring to bear on the business model of the legal practice? How can all of these issues be resolved in grim financial times? The author will examine all of these issues in light of Australian and international experiences with new lawyering patterns and the global financial crisis. (shrink)

In order to address questions about how to conceptualize and resist epistemic oppression most effectively, this essay develops a critical engagement with Kristie Dotson’s “Conceptualizing Epistemic Oppression.” Relying on a conceptual clarification of what is meant by “shared epistemic resources,” I argue against Dotson’s distinction which finds some instances of epistemic oppression to be “reducible” to the unequal distribution of social and political power, and some to be distinctively epistemic, and thus “irreducible” to these factors. Rather, I maintain the most (...) effective conceptualization of the phenomenon will find that all of its forms have a distinctive epistemic dimension that must be contended with; they are thus irreducible in Dotson’s sense. In other words, the critical interrogation of governing norms will be necessary for resistance in all three cases. I briefly consider the import of my view by looking at epistemic oppression amidst the presidency of Barack Obama. (shrink)

The possibilities of non-invasive prenatal testing (NIPT) are expanding, and the use of NIPT for adult-onset conditions may become widely available in the near future. If parents use NIPT to test for these conditions, and the pregnancy is continued, they will have information about the child’s genetic predisposition from birth. In this paper, we argue that prospective parents should be able to access NIPT for an adult-onset condition, even when they have no intention to terminate the pregnancy. We begin by (...) outlining the arguments against testing in such a situation, which generally apply the same considerations that apply in the predictive testing of a minor to the fetus in utero. We then contend, firstly, that there are important practical considerations that support availability of testing for prospective parents regardless of their stated intentions. Secondly, we object to the ethical equation of a fetus in utero with a minor. We base our analysis on a view of pregnancy that conceptualises the fetus as a part of the gestational parent, as opposed to the more common ‘container’ model of pregnancy. We suggest that fetal information is best conceptualised as shared information between the gestational parent and future child. Thus, it should be approached in similar ways as other kinds of shared information (such as genetic information with implications for family members), where a person has a claim over their own information, but should be encouraged to consider the interests of other relevant parties. Some have claimed that identity crowding is a case where we consciously see an object to which we are unable to pay attention. Opponents of this view offer alternative explanations, which emphasise the importance of prior knowledge, amongst other factors. We review new empirical evidence showing that prior knowledge has a profound effect on identity crowding. We argue that this is problematic for the “conscious seeing without attention” view, and supports an opposing view.

Legal prohibitions on the financial compensation of donors are frequently justified by appealing either to concerns about patient safety or to concerns about the putatively unethical nature of such compensation. But jurisdictions that legally prohibit the financial compensation of donors routinely import plasma that has been collected from financially compensated donors—and they do so knowing its origins. I outline some possible ways in which this puzzle could be resolved and find them all wanting. Focusing on Canada I draw upon public (...) documents to explain how many provinces came to have its apparently puzzling approach to plasma procurement. I then argue that the actions of those who support this approach to plasma procurement are immoral. (shrink)

ABSTRACT This paper explores the dynamics of extrinsic pressure in sport and its relation to athletic excellence. We argue that psychological pressure exerted by activities extrinsic to sport can be relevant to success or failure in it, such that how one manages extrinsic pressures can transmit to failure to perform in sport and thus be a determinant to victory, with no reason to think failure mitigated by the non-sporting nature of one’s other behaviour. To make this argument we offer a (...) series of examples to test intuitions about what constitutes sporting excellence and what constitutes sporting failure. On the basis of these examples, we offer a categorization of pressures in sport and argue that psychological pressure from almost any area of life may be relevant to competition, whether intrinsic or extrinsic to the sporting contest. We substantiate this claim by proposing a framework for adjudicating the relevance of extrinsic pressures to sporting performance by appealing to the internal goods of each sport and their contribution to flourishing. The COVID-19 outbreak has simultaneously increased the need for mental health services and decreased their availability. Brief online self-help interventions that can be completed in a single session could be especially helpful in improving access to care during the crisis. However, little is known about the uptake, acceptability, and perceived utility of these interventions outside of clinical trials in which participants are compensated. Here, we describe the development, deployment, acceptability ratings, and pre–post effects of a single-session intervention, the Common Elements (...) Toolbox, adapted for the COVID-19 crisis to support graduate and professional students. Participants, who were not compensated, were randomly assigned to two of three modules: behavioral activation, cognitive restructuring, and gratitude. Over 1 week, 263 individuals began and 189 individuals completed the intervention. Participants reported that the intervention modules were acceptable, helpful, engaging, applicable to their lives, and could help them manage COVID-related challenges. Participants reported pre- to post-program improvements in secondary control and in the perceived negative impact of the COVID-19 crisis on their quality of life. On average, differences in their perceived ability to handle lifestyle changes resulting from the pandemic were positive, but small and at the level of a non-significant trend. Our results highlight the acceptability and utility of an online intervention for supporting individuals through the COVID-19 crisis. (shrink)

This chapter is an edited transcription of an author-meets-critics session at the Truth 20|20 Conference, on Douglas Edwards’ award-winning book, The Metaphysics of Truth (2018, Oxford University Press). The Metaphysics of Truth tackles fundamental questions about the role of truth in connections between language and the world. Edwards proposes a pluralist account, according to which sentences in different domains get to be true in different ways. Kellen’s questions center around how to locate Edwards’s pluralist account given certain distinctions between varieties (...) of truth pluralism, and on how to determine what domains certain sentences belong to, especially mixed compounds. Taylor’s comments critically investigate Edwards’ critiques of deflationism, particularly to do with what the deflationist can say about whether truth counts as a ‘sparse’ or ‘abundant’ property, and whether deflationists are able to explain important differences between sparse properties such as being magnetic, and abundant properties, which deflationists will likely think include being true. Lynch provides several questions about the metaphysics of Edwards’s account, including the nature of the determination relation, and the nature of the property of truth itself, and whether Edwards’s account of that property manages to distinguish itself from something a truth minimalist would be happy with.
