Background: The United Kingdom has the highest incarceration rate in Western Europe. It is known that women in prison are a vulnerable female population who are at risk of mental ill-health due to disadvantaged and chaotic life experiences. Accurate numbers of pregnant women held in UK prisons are not recorded, yet it is estimated that 6%–7% of the female prison population are at varying stages of pregnancy and around 100 babies are born to incarcerated women each year. There are limited (...) published papers that document the departure of the researcher following closure of fieldwork with women in prison. This article identifies the dilemmas and challenges associated with the closure of prison fieldwork through the interwoven reflections of the researcher. Departure scenarios are presented which illuminate moments of closure talk with five women, supported by participant reflections regarding abandonment and loss, making pledges for the future, self-affirmation, incidental add-ons at the end of an interview and red flags, alerting the researcher to potential participant harm through ill health or self-injury. Objectives: The primary intention of the study was to observe the pregnant woman’s experience with the English prison system through interviews with pregnant women and field observations of the environment. Research design: Ethnographic design enabled the researcher, a practising midwife, to engage with the prisoners’ pregnancy experiences in three English prisons, which took place over 10 months during 2015–2016. Data collection involved semi-structured, audio-recorded interviews with 28 female prisoners in England who were pregnant or had recently given birth while imprisoned, 10 members of staff and a period of non-participant observation. Follow-up interviews with 5 women were undertaken as their pregnancies progressed. Computerised qualitative data analysis software was used to generate and analyse pregnancy-related themes. Ethical considerations: Favourable ethical opinion was granted by National Offender Management Services through the Health Research Authority Integrated Research Application System and permission to proceed was granted by the University of Hertfordshire, UK. Findings: Thematic analysis enabled the identification of themes associated with the experience of prison pregnancy illuminating how prison life continues with little consideration for their unique physical needs, coping tactics adopted and the way women negotiate entitlements. On researcher departure from the field, the complex feelings of loss and sadness were experienced by both participants and researcher. Discussion: To leave the participant with a sense of abandonment following closure of fieldwork, due to the very nature of the closed environment, risks re-enactment of previous emotional pain of separation. Although not an ethical requirement, the researcher sought out psychotherapeutic supervision during the fieldwork phase with ‘Janet’, a forensic psychotherapist, which helped to highlight the need for careful closure of research/participant relationships with a vulnerable population. This article brings to the consciousness of prison researchers the need to minimise potential harm by carefully negotiating how to exit the field. Reflections of the researcher are interlinked with utterances from some participants to illustrate the types of departure behaviours. Conclusion: Closure of fieldwork and subsequent researcher departure involving pregnant women in prison requires careful handling to uphold the ethical research principle ‘do no harm’. (shrink)

A scientific dispute may turn crucially upon whether or not a given hypothesis is ad hoc. So, it is extremely important to determine what makes a hypothesis ad hoc. Yet, previous accounts have failed, either because they have run afoul of the Quine-Duhem problem, or because of other major defects.I develop a novel account of ad hocness. I propose that a hypothesis is ad hoc when disconfirming evidence leads scientists to accept that hypothesis into their theory even though the core (...) of the theory, in combination with auxiliaries and the evidence, does not entail the hypothesis. Alfred North Whitehead wrote a letter to Charles Hartshorne in 1936 in which he referred to William James as the American Plato. Especially given Whitehead’s admiration of Plato, this was a high compliment to James. What was the basis for this compliment and analogy? In responding to that question beyond the partial and scattered references provided by Whitehead, this article briefly explores the following aspects of the thought of James in relation to Whitehead: the one and the many, the denial (...) of Cartesian dualism, James’s background in physiology, refutation of Zeno’s paradoxes, religious experience, and other kinships. In the end, the author agrees with Robert Neville that James had seminal ideas which could correctly result in a complimentary analogy with Plato. Therefore, a greater focus on the important thought of James is a needed challenge in contemporary philosophy. (shrink)

We initiate the study of a generalization of Kim-independence, Conant-independence, based on the notion of strong Kim-dividing of Kaplan, Ramsey and Shelah. A version of Conant-independence was originally introduced to prove that all [Formula: see text] theories are [Formula: see text]. We introduce an axiom on stationary independence relations, essentially generalizing the “freedom” axiom in some of the free amalgamation theories of Conant, and show that this axiom provides the correct setting for carrying out arguments of Chernikov, Kaplan and Ramsey (...) on [Formula: see text] theories relative to a stationary independence relation. Generalizing Conant’s results on free amalgamation to the limits of our knowledge of the [Formula: see text] hierarchy, we show using methods from Conant as well as our previous work that any theory where the equivalent conditions of this local variant of [Formula: see text] holds is either [Formula: see text] or [Formula: see text] and is either simple or [Formula: see text]. We observe that these theories give an interesting class of examples of theories where Conant-independence is symmetric. This includes all of Conant’s examples, the small cycle-free random graphs of Shelah, and the (finite-language) [Formula: see text]-categorical Hrushovski constructions of Evans and Wong. We then answer Conant’s question on the existence of non-modular free amalgamation theories. We show that the generic functional structures of Kruckman and Ramsey are examples of non-modular free amalgamation theories. We also show that any free amalgamation theory is [Formula: see text] or [Formula: see text], while an [Formula: see text] free amalgamation theory is simple if and only if it is modular. Finally, we show that every theory where Conant-independence is symmetric is [Formula: see text]. Therefore, symmetry for Conant-independence gives the next known neostability-theoretic dividing line on the [Formula: see text] hierarchy beyond [Formula: see text]. Compromise as a notion is frequently met in discussion and debate regarding many everyday decisions, including health care. It therefore seems that it may be of interest and value to try to give this some careful consideration. In the following pages, an attempt is made to discuss what one might mean when one uses this concept. Consideration is then given to some possible uses of compromise in health care. Gustatory studies are predicated on the existence of basic tastes. Erickson questions this assumption and offers contrary evidence. Although Erickson may conflate certain concepts and demand uncommonly stringent requirements for basic tastes, his thoughtful article reminds us that the basic organization of taste is not yet settled.

The first is an interpretation of the poem against the heroic deeds of ancient kings described in Mesopotamian royal narratives, especially the Gilgamesh epic. The second is a thorough philological and textual commentary which employs an aesthetic rationale for restoring the text of the poem as a work of art. In euthanasia and/or assisted suicide of persons with dementia, the controversy has mostly focused on decisionally incapable persons with very advanced dementia for whom the procedure must be based on a written advance euthanasia directive. This focus on advance euthanasia directive-based EAS has been accompanied by scant attention to the issue of decision-making capacity assessment of persons with dementia who are being evaluated for concurrent request EAS. We build on a previous analysis of concurrent request EAS cases from the Netherlands, (...) which showed that many such cases involve persons with significant cognitive impairment. We use illustrative cases to describe the difficulty of determining decisional capacity in persons whose stage of dementia falls between severely impaired and mildly impaired. We show that the Dutch practice of capacity assessment in such dementia cases is difficult to reconcile with the widely accepted functional model of capacity—a model explicitly endorsed by the Dutch euthanasia review committees. We discuss why such deviations from the standard functional model might be occurring, as well as their ethical implications for dementia EAS policy and practice. (shrink)

Daniel Haybron has made an original contribution to philosophical discussions of happiness. He has put forward a theory that identifies happiness with moods and the propensity to experience moods. Haybron’s contribution deserves a critical examination. The first section of my paper is interpretive. I show how Haybron uses the concepts of ‘central affective states’ and ‘mood propensity’ to define happiness. The second and third sections of the paper are critical. They focus on the inclusion of mood propensity in Haybron’s theory. (...) In the second section I argue that his theory fails because there is an example that shows a subject can be happy even when that subject does not have a positive mood propensity. In the third section of the paper, I consider Haybron’s objection that the case in question is ‘object-specific’ and that it is not ‘emotionally-based’. I discuss both of these technical terms in detail. Moreover, I argue that a modified version of the counter example accommodates these technical terms while retaining the persuasiveness of the original example. (shrink)

The body of almost every Roman or Byzantine emperor has been lost. This piece draws attention to two skeletons, recovered from a Muslim türbe at Trabzon during World War I by the Russian excavator Feodor Uspensky. Using local oral tradition, Uspensky identified the two bodies he recovered as the Byzantine emperor of Trebizond Alexios IV (1417-1429) and a local Turkish hero Hoşoğlan. Since Uspensky, his identifications have not been challenged nor scientifically examined. This paper argues that Uspensky did not recover (...) just one but two imperial skeletons. It first dissects his identifications, showing how competition for sacred space between Greeks and Turks in the Ottoman period led each community to identify the tomb’s occupants with foundational figures in their communities. After dissecting Uspensky’s identifications, this paper then makes the case that both occupants of this tomb were unidentified members of the Grand Komnenoi family, urging for scientific examination of what may be the only bones of a Byzantine emperor. The modern legal and ethical movement against traditional welfare paternalism in medical decision-making extends to how decisions are made for patients lacking decisional capacity, prioritising surrogates’ judgment about what patients would have decided over even their best interests. In England and Wales, the Mental Capacity Act 2005 follows this trend of prioritising the patient’s prior wishes, values and beliefs but the dominant interpretation in life-sustaining treatment cases does so by in effect calling those values the ‘best interests’ of the patient (...) and focusing nearly exclusively on the ‘subjective’ viewpoint of the patient. In this article, we examine the recent Court of Protection judgment inBarnsley Hospitals NHS Foundation Trust v MSP[2020] EWCOP 26, which adhered closely to this approach, to suggest that it could have unexpected negative consequences. These include insufficient information gathering about and attention to patients’ objective medical interests, inadequacy of the evidentiary standard used for the substituted decision-making and, in some cases, even prioritising a surrogate’s current substituted judgment over the potential for an actual judgment by the patient.
