Public participation is well known for its practitioner insights and wealth of case reports. This knowledge is essential and has been well employed. Likewise, the theoretical literature on public participation is growing rapidly. The need for better conceptual and theoretical understandings of public participation has become clear. Public participation theories have not received great attention, and few have been proposed or tested. Yet theory offers much to practitioners of various interventions. The authors summarize work toward developing a public participation theory (...) and propose a way to conceptualize its skeletal components. The authors recognize that any theory must acknowledge that different people have different beliefs about what public participation should accomplish. Further, contextual variables affect a process’s character and outcomes. The authors begin with a discussion of theory’s importance to scholars, practitioners, and participants and provide an overview of existing approaches. The authors present findings from two empirical case studies used to further develop their theory of fair and competent public participation. They conclude with some observations about challenges and ways forward. (shrink)

More than 20 years ago, Jürgen Habermas and Karl-Otto Apel started the philosophical research program of Discourse Ethics. This led to a broad discussion about the correct justification and application of basic principles of Discourse Ethics, from which several comprehensive new conceptions emerged in recent years. The authors of this anthology discuss central problems of the previous designs in a constructive way, they carry out alternative designs and thus open up new perspectives for discourse ethics. Killing civilians is worse than killing soldiers. If any moral principle commands near universal assent, this one does. Few moral principles have been more widely and more viscerally affirmed. And yet, in recent years it has faced a rising tide of dissent. Political and military leaders seeking to slip the constraints of the laws of war have cavilled and qualified. Their complaints have been unwittingly aided by philosophers who, rebuilding just war theory from its foundations, have concluded that this principle (...) is at best a useful fiction. Sparing Civilians aims to turn this tide, and to vindicate international law, and the ruptured consensus. Epistemic modal operators give rise to something very like, but also very unlike, Moore's paradox. I set out the puzzling phenomena, explain why a standard relational semantics for these operators cannot handle them, and recommend an alternative semantics. A pragmatics appropriate to the semantics is developed and interactions between the semantics, the pragmatics, and the definition of consequence are investigated. The semantics is then extended to probability operators. Some problems and prospects for probabilistic representations of content and context are explored.

The standard behavioral index for human consciousness is the ability to report events with accuracy. While this method is routinely used for scientific and medical applications in humans, it is not easy to generalize to other species. Brain evidence may lend itself more easily to comparative testing. Human consciousness involves widespread, relatively fast low-amplitude interactions in the thalamocortical core of the brain, driven by current tasks and conditions. These features have also been found in other mammals, which suggests that consciousness (...) is a major biological adaptation in mammals. We suggest more than a dozen additional properties of human consciousness that may be used to test comparative predictions. Such homologies are necessarily more remote in non-mammals, which do not share the thalamocortical complex. However, as we learn more we may be able to make “deeper” predictions that apply to some birds, reptiles, large-brained invertebrates, and perhaps other species. (shrink)

The diverse coalition of activists trying to cut the prison population has thus far failed to articulate a coherent moral foundation for criminal justice reform. Since the various constituents of this coalition support reform for different reasons, it may seem savvy to avoid conversation about moral questions. We argue, however, that failing to work toward developing a moral basis for reform puts the coalition at risk of repeating the failures of the sentencing reform movement of the 1970s and 1980s. This (...) initially promising movement culminated in the passage of the widely disliked and deeply flawed United States Sentencing Guidelines. We lay out and analyze the downsides of avoiding moral discourse in criminal justice reform movements and argue for more collaboration and dialogue between moral thinkers and activists. (shrink)

I don’t propose to harp on the question of whether MacFarlane has the data right. Let us just assume, for the sake of argument, that he does. Let us further assume that his interpretation of the data is correct—i.e., that these judgments are assessments of the the whole clause and not simply of the prejacent. Granting all this—maybe a lot—we need a semantics for epistemic modals that will make sense of the judgments in this case, and in relevantly similar cases. (...) Mac- Farlane argues that contextualism about epistemic modals cannot make sense of the judgments. His central worry is that it can only get the truth-value judgments of speakers right by making the truth-conditions of epistemic modal claims outrageously strong—too strong to be assertable in cases where they are, in fact, assertable. We might call it the contextualist’s dilemma: either our semantics systematically fails to capture the truth-value judgments that people actually make, or it captures these judgments but turns users of epistemic modal sentences into irrational asserters. The view that actually has a reading on which it is a two-dimensional indexical modal operator has some problems.

Focusing on cases which involve binding into epistemic modals with definite descriptions and quantifiers, I raise some new problems for standard approaches to all of these expressions. The difficulties are resolved in a semantic framework that is dynamic in character. I close with a new class of problems about de re readings within the scope of modals.

This volume is a tribute to the thought of Seth Benardete by contributors who had the rare good fortune of studying with him or those who discovered the treasure of his writings. Benardete was fully immersed in the world of the ancients, starting with Homer, but their works opened up for him a way to the fundamental questions-about justice and love, nature and law, human and divine. Finding "the problem of the human good grounded in the city, and the (...) problem of being in god," he was led to the conclusion that "Political philosophy is the eccentric core of philosophy." While Benardete wrote this statement reflecting on the theological-political issue in the work of his teacher, Leo Strauss, the paradoxical notion of an "eccentric core," in giving this volume its title, is meant to capture a characteristic of his own way of thinking. The essays in this collection-on the Bible and Homer, the pre-Socratics, Plato, Aristotle, and the Roman writers-indicate the range of Benardete's studies and teaching. The centrality of Plato is evident at the same time in those pieces as well as in the reviews of Benardete's books included here, along with three of his own previously unpublished essays. Killing in War presents the Moral Equality of Combatants with serious, and in my view insurmountable problems. Absent some novel defense, this thesis is now very difficult to sustain. But this success is counterbalanced by the strikingly revisionist implications of McMahan’s account of the underlying morality of killing in war, which forces us into one of two unattractive positions, contingent pacifism, or near-total war. In this article, I have argued that his efforts to mitigate these controversial implications fail. The reader (...) is left stranded: to reach plausible conclusions, Walzer deployed an implausible conception of our rights to life; McMahan’s more rigorous account of those rights generates untenable conclusions. Absent new developments, it seems that the prospects for grounding the ethics of war in individual rights are poor: any theory of our rights to life that is sufficiently indiscriminate to work in the chaos of war is not discriminating enough to be a plausible theory of our rights to life. Perhaps by rejecting the ideal of the rights-respecting war altogether we might develop an alternative theory of justified warfare, which marries theoretical soundness with conclusions that we can more confidently support. A major approach to the ethics of artificial intelligence is to use social choice, in which the AI is designed to act according to the aggregate views of society. This is found in the AI ethics of “coherent extrapolated volition” and “bottom–up ethics”. This paper shows that the normative basis of AI social choice ethics is weak due to the fact that there is no one single aggregate ethical view of society. Instead, the design of social choice AI faces three (...) sets of decisions: standing, concerning whose ethics views are included; measurement, concerning how their views are identified; and aggregation, concerning how individual views are combined to a single view that will guide AI behavior. These decisions must be made up front in the initial AI design—designers cannot “let the AI figure it out”. Each set of decisions poses difficult ethical dilemmas with major consequences for AI behavior, with some decision options yielding pathological or even catastrophic results. Furthermore, non-social choice ethics face similar issues, such as whether to count future generations or the AI itself. These issues can be more important than the question of whether or not to use social choice ethics. Attention should focus on these issues, not on social choice. (shrink)

There is a tendency in decision‐making research to treat uncertainty only as a problem to be overcome. But it is also a feature that can be leveraged, particularly in social interaction. Comparing the behavior of profitable and unprofitable poker players, we reveal a strategic use of information processing that keeps decision makers unpredictable. To win at poker, a player must exploit public signals from others. But using public inputs makes it easier for an observer to reconstruct that player's strategy and (...) predict his or her behavior. How should players trade off between exploiting profitable opportunities and remaining unexploitable themselves? Using a recent multivariate approach to information theoretic data analysis and 1.75 million hands of online two‐player No‐Limit Texas Hold'em, we find that the important difference between winning and losing players is not in the amount of information they process, but how they process it. In particular, winning players are better at integrative information processing—creating new information from the interaction between their cards and their opponents’ signals. We argue that integrative information processing does not just produce better decisions, it makes decision‐making harder for others to reverse engineer, as an expert poker player's cards act like the private key in public‐key cryptography. Poker players encrypt their reasoning with the way they process information. The encryption function of integrative information processing makes it possible for players to exploit others while remaining unexploitable. By recognizing the act of information processing as a strategic behavior in its own right, we offer a detailed account of how experts use endemic uncertainty to conceal their intentions in high‐stakes competitive environments, and we highlight new opportunities between cognitive science, information theory, and game theory. This volume brings together Seth Benardete's studies of Hesiod's Theogony, Homer's Iliad, and Greek tragedy, of eleven Platonic dialogues, and Aristotle's Metaphysics. These essays, some never before published, others difficult to find, span four decades of his work and document its impressive range. Benardete's philosophic reading of the poets and his poetic reading of the philosophers share a common ground that makes this collection a whole. The key, suggested by his reflections on Leo Strauss in the last piece, lies (...) in the question of how to read Plato. Benardete's way is characterized not just by careful attention to the literary form that separates doctrine from dialogue, and speeches from deed rather, by following the dynamic of these differences, he uncovers the argument that belongs to the dialogue as a whole. The "turnaround" such an argument undergoes bears consequences for understanding the dialogue as radical as the conversion of the philosopher in Plato's image of the cave. Benardete's original interpretations are the fruits of this discovery of the "argument of the action.". (shrink)

Neural Darwinism (ND) is a large scale selectionist theory of brain development and function that has been hypothesized to relate to consciousness. According to ND, consciousness is entailed by reentrant interactions among neuronal populations in the thalamocortical system (the ‘dynamic core’). These interactions, which permit high-order discriminations among possible core states, confer selective advantages on organisms possessing them by linking current perceptual events to a past history of value-dependent learning. Here, we assess the consistency of ND with 16 widely recognized (...) properties of consciousness, both physiological (for example, consciousness is associated with widespread, relatively fast, low amplitude interactions in the thalamocortical system), and phenomenal (for example, consciousness involves the existence of a private flow of events available only to the experiencing subject). While no theory accounts fully for all of these properties at present, we find that ND and its recent extensions fare well. (shrink)

Hugh Murray seems animated by two basic contentions. First, he believes that blacks and their liberal allies have acted irresponsibly by supporting the thuggish policies of the Nation of Islam and its leader, Louis Farrakhan. He states that this is “the era of Farrakhan,” and implies (without any evidence other than selected anecdotes) that support for Farrakhan among blacks is virtually unanimous. Second, he deplores the replacement in the 1960s of equal opportunity by affirmative action policies — promoted by “the (...) quota-racial-ethnic and gender preference lobby” — which he argues discriminate against more qualified individuals merely because they happen to be white or male. In the half-century since Kenneth Sisam characterized the Middle English Sir Orfeo as a Greek myth “almost lost in a tale of fairyland,” scholars have struggled to synthesize these two apparently disparate elements into a unified reading of the poem. The narrator has seemingly transformed the ancient legend of Orpheus and Eurydice into a contemporary romance of a king Orfeo and his queen Heurodis. The Greek harper becomes an English minstrel, and some readers have explored the meaning of this transformation (...) through the traditions of medieval mythography and the music theory of Boethius. In Orfeo's loss of his wife and kingdom, his wandering in the wilderness, and his final successful return, other readers have seen the outlines of a specifically Christian allegory. Many of these scholars have explored the exegetical resonances between Orpheus and David and Orpheus and Christ, and, in spite of differences in emphasis and technique, they share a view of Orfeo's journey as a kind of penance or pilgrimage of the soul. Unlike his classical counterpart, however, Orfeo finds his wife not in Hell but in fairyland, and in defining the precise nature of this other world, suggestions range from a version of the Celtic world of “the dead and the taken” to associations between fairyland and the architecture of Revelation. I try to show that agent responsibility is an inadequate basis for the attribution of liability, by discrediting the Risk Argument and showing how the Responsibility Argument in fact collapses into the Risk Argument. I have concentrated on undermining these as philosophical theories of self-defense, although I at times note that our theory of self-defense should not be predicated on assumptions that are inapplicable to the context of war. The potential combatant, I conclude, should not look to the agency view (...) to ease his conscience about the killing he will do in war. If he is to fight without violating rights, then he will need a different theory of self-defense; if there are no more defensible theories, then he must either accept pacifism—which I think is a live possibility—or seek to identify stronger countervailing reasons, which can override the great force of his victims’ rights to life. Many of us believe (1) Saving a life is more important than averting any number of headaches. But what about risky cases? Surely: (2) In a single choice, if the risk of death is low enough, and the number of headaches at stake high enough, one should avert the headaches rather than avert the risk of death. And yet, if we will face enough iterations of cases like that in (2), in the long run some of those small risks of (...) serious harms will surely eventuate. And yet: (3) Isn't it still permissible for us to run these repeated risks, despite that knowledge? After all, if it were not, then many of the risky activities that we standardly think permissible would in fact be impermissible. Nobody has yet offered a principle that can accommodate all of 1-3. In this paper, I show that we can accommodate all of these judgements, by taking into account both ex ante and ex post perspectives. In doing so, I clear aside an important obstacle to a viable deontological decision theory. (shrink)

Institutional differentiation has been one of the central concerns of sociology since the days of Auguste Comte. However, the overarching tendency among institutionalists such as Durkheim or Spencer has been to treat the process of differentiation from a macro, "outside in" perspective. Missing from this analysis is how institutional differentiation occurs from the "inside out, "or through the efforts and struggles of individual and corporate actors. Despite the recent efforts of the "new institutionalism" to fill in this gap, a closer (...) look at the literature will uncover the fact that (1) it has tended to conflate macro-level institutions and meso-level organizations and (2) this has led to a taken for granted approach to institutional dynamics. This article seeks to develop a general theory of institutional autonomy; autonomy is a function of the degree to which specialized corporate units are structurally and symbolically independent of other corporate units. It is argued herein that the process by which these "institutional entrepreneurs" become independent can explain how institutions become differentiated from the "inside out." Moreover, this article offers five dimensions that can be operationalized, measuring the degree to which institutions are autonomous. (shrink)

Deontologists have been slow to address decision-making under risk and uncertainty, no doubt because the standard approaches to non-moral decision theory appear superficially similar to consequentialist moral reasoning. I identify some central tenets of simple decision theory and show that they should not put deontologists off, before showing where we should go next to develop a comprehensive deontological decision theory.

The Assimilation Argument purports to show that libertarians cannot plausibly distinguish supposed exercises of free will from random outcomes that nobody would count as exercises of free will. If this argument is sound, libertarians should either abandon their position or else concede that free will is a mystery. Drawing on a parallel with the Manipulation Argument against compatibilism, Christopher Franklin has recently contended that the Assimilation Argument is unsound. Here I defend the Assimilation Argument and the Rollback Argument, a second (...) challenge to libertarianism that Franklin rejects. My aim in doing so is to underscore the force of these challenges, and thereby to resist what appears to be an emerging trend in the literature. By not coming to grips with the kind of power that libertarians must secure, many writers have recently downplayed or dismissed the pressing worry for libertarianism. (shrink)
