Locke’s endorsement of prerogative, the power of the executive to exceed positive laws in emergencies, seems to contradict his political and theoretical aims in writing the Two Treatises of Government, particularly his vindication of the rule of law in a constitutional government. However, this article argues that prerogative and the rule of law are consistent in the ultimate ends that they serve, in spite of their significant differences as means. Prerogative is essential to the realization of the most fundamental duties (...) of government, including the preservation of society, because unforeseeable contingencies make it difficult and even counter-productive to rely exclusively on juridical means of fulfilling these duties. Prerogative compensates for the shortcomings of the law without abandoning the principles of legality altogether by allowing the executive to exercise extra-ordinary powers in accordance with the highest law of all: the good of the people as defined by the laws of nature. Intense religious and political hostility to Roman Catholicism, or "popery" as its detractors referred to it, played a pervasive and constitutive role in the development of both liberal and republican conceptions of liberty in seventeenth- and eighteenth-century English political thought. Liberal and republican thinkers alike endorsed both individual and collective notions of liberty, such as freedom of thought and the idea of a free state, in contradistinction to various political and religious evils closely associated with Catholicism. Das Cognitive Enhancement, die Steigerung der geistigen Leistungsfähigkeit gesunder Menschen durch Psychopharmaka und andere Interventionen, ist in jüngster Zeit verstärkt in den Fokus sowohl der Ethik als auch der breiteren Öffentlichkeit geraten. In kontrafaktischer Abstrahierung vom gegenwärtig noch sehr bescheidenen Stand der Technik wird dabei unter anderem erörtert, was grundsätzlich für und was gegen den Einsatz von markant wirksamem Cognitive Enhancement sprechen würde. Der vorliegende Beitrag gibt einen Überblick über die einschlägige Diskussion. Zunächst wird der recht uneinheitlich verwendete Begriff des (...) Cognitive Enhancement näher bestimmt; danach folgt eine systematische Übersicht über die verschiedenen Pro- und Kontra-Argumente. Besprochen werden Per-se-Bewertungen des Cognitive Enhancement, etwaige Folgen für die „verbesserten“ Individuen selbst sowie die Konsequenzen, die ein großflächiger Einsatz von Cognitive Enhancement für die Gesellschaft als Ganzes zeitigen könnte. Ein besonderes Augenmerk wird auf die Frage gelegt, was für einen Einfluss der Einsatz von Cognitive Enhancement auf unser Menschenbild und auf andere Teile des epistemischen Fundaments unserer Kultur haben könnte. This dissertation argues that the current tendency to define liberal constitutionalism in terms of the impersonal and formalistic ideals of the rule of law diverges from early liberal theories of constitutionalism, which were sensitive to the occasional need for extra-legal discretionary exercises of power to deal with the unpredictable contingencies of politics. This understanding of politics shaped the constitutional and political thought of liberal thinkers from John Locke, David Hume, and William Blackstone to Alexander Hamilton, James Madison, and other Federalists (...) who defended the extraordinary powers of the American presidency. Since these early liberals recognized that it would sometimes be necessary for an executive to perform extraordinary actions in response to unforeseeable events, they were reluctant to place excessive legal checks on executive power. Consequently, they emphasized the importance of limiting executive power to those with "fit characters." In particular, they looked to those politico-moral virtues associated with republicanism to supplement and enhance the constitutional machinery of government that was designed with the ordinary course of politics in mind. Although early liberal theorists and the designers of the American Constitution abandoned many of the core principles of republicanism, particularly its reliance on a virtuous and active citizenry as the best guarantee of free government, they preserved a place for distinctively republican virtues such as patriotism and disinterestedness in the office of the executive. In fact, the Federalists made the American presidency the primary repository of republican virtue in the new government. The first century of liberal constitutional theorists was actually skeptical of the ability of impersonal institutional devices such as the separation of powers and checks and balances to secure a free and effective government without the presence of fit characters. Since formal institutions are imperfect and often inadequate---both in dealing with political contingencies and in checking the executive---these thinkers supplemented legal and institutional safeguards with character requirements to minimize potential abuses of largely indeterminate executive powers irreducible to law. An abiding conviction that uncertainty is the only certainty in politics led them to prefer flexible approaches rather than the rigid formulas in theorizing constitutionalism. (shrink)

Merleau-Ponty, Varela, Nagarjuna. Une triangulation possibleDans cet article, on voudrait mettre en évidence une triangulation possible entre Maurice Merleau-Ponty, le biologiste chilien Francisco Varela et le philosophebouddhiste de l’Antiquité Nagarjuna. L’objectif de cette perspective réside dans l’urgence d’une étude de la dynamique du réel, et même de la sensibilité en général.Dans The Embodied Mind, le « projet neuro-phénoménologique » et « l’urgence énactive » de Varela se joignent à la pratique bouddhiste Mahayana de Nagarjuna, à laquelle le biologiste consacre une (...) grande partie de son oeuvre. Ce rapprochement révèle l’intérêt de Varela pour l’ontologie bouddhiste, non substantielle et permanente, ce qui, non seulement le conduit jusqu’aux ultimes conséquences de la chair merleaupontienne, mais accroît aussi sa compréhension de la signification de cette chair.Dans les années précédant le développement de son ontologie, Merleau-Ponty se consacre à l’anthologie intitulée Les philosophes célèbres et décide d’y inclure un chapitre sur la philosophie orientale. A Possible TriangulationIn this article, we would like to bring to light a possible triangulation between Maurice Merleau-Ponty, the Chilean biologist, Francisco Varela, and the ancientBuddhist philosopher, Nagarjuna. The purpose of doing this lies in the urgency of a study of the dynamic of the real and even of the sensible in general.In The Embodied Mind, Varela’s “neuro-phenomenological project” and the “enactive urgency” are joined to the Nagarjuna’s Mahayana Buddhist practice, to which the biologist devotes a large part of this work. This intersection reveals Varela’s interest in Buddhist ontology, an ontology that is non-substantialist and permanent. It leads not only to the ultimate consequences of Merleau-Ponty’s idea of the flesh, but also it adds its way of understanding to the significance of this flesh.In the years preceding the development of his ontology, Merleau-Ponty devoted himself to the anthology called Les philosophes célèbres. He decides to include in it a chapter on oriental philosophy. He shows there the necessity of a return to the Orient insofar as the East has often been the precursor and the “resonator of our relation to being.” The present work asks to what is Merleau-Ponty alluding when he invites us “to take stock of the possibilities in which we are enclosed by becoming ‘Western’ and perhaps we should reopen these possibilities” in order to establish the possibility of a convergence between the flesh, the Buddhist constitution of reality, and Varela’s enactive project. In dieser Arbeit geht es zunächst um eine Auslegung der aristotelischen Affekttheorie, so wie sie hauptsächlich im 2. Buch der Rhetorik ausgeführt wird unter Berücksichtigung der einschlägigen Passagen aus der Nikomachischen Ethik und aus De Anima. Es zeigt sich, dass Affekte für Aristoteles nicht etwa unserem Verstand gegenüberstehen, sondern, dass sie selbst Anteil an der Vernunft haben, indem sie auf einem Erkenntnisakt beruhen. Ziel dieser Untersuchung ist aber auch zu zeigen, dass der Stoiker Poseidonios, trotz seiner Absicht sich der platonisch-aristotelischen (...) Seelen- und Affekttheorie anzuschließen, mit seiner Theorie das Konzept eines Gegensatzes von Vernunft und Affekt verteidigt hat und somit in Wirklichkeit nicht als Anhänger der platonisch-aristotelischen Philosophie betrachtet werden kann. Für Poseidonios besteht, anders als bei Aristoteles, eine radikale Trennung zwischen Sinnlichkeit und Vernunft, zwischen Emotionslos-Rationalem und Geistfrei-Irrationalem. (shrink)

Prior research has investigated the recruitment of inhibition in the use of science/mathematics concepts in tasks that require the rejection of a conflicting, nonscientific initial concept. The present research examines if inhibition is the only EF skill recruited in such tasks and investigates whether shifting is also involved. It also investigates whether inhibition and/or shifting are recruited in tasks in which the use of science/mathematics concepts does not require the rejection of an initial concept, or which require only the use (...) of initial concepts. One hundred and thirty‐three third‐ and fifth‐grade children participated in two inhibition and shifting tasks and two science and mathematics conceptual understanding and conceptual change (CU&C) tasks. All the tasks were on‐line, and performance was measured in accuracy and RTs. The CU&C tasks involved the use of initial concepts and of science/mathematics concepts which required conceptual changes for their initial formation. Only in one of the tasks the use of the science/mathematics concepts required the concurrent rejection of an initial concept. The results confirmed that in this task inhibition was recruited and also showed that the speed of shifting was a significant predictor of performance. Shifting was a significant predictor of performance in all the tasks, regardless of whether they involved science/mathematics or initial concepts. It is argued that shifting is likely to be recruited in complex tasks that require multiple comparisons of stimuli and the entertainment of different perspectives. Inhibition seems to be a more selective cognitive skill likely to be recruited when the use of science/mathematics concepts requires the rejection of a conflicting initial concept. (shrink)

As a consequence of this we improve a result of Humke and Laczkovich, who showed in [HL] that the set of functions of the form f ⚬ f form a true analytic set in C[0, 1]. This book covers the field of and points to the intersections between politics, art and philosophy. Its hero, the late Sir Roger Scruton had a longstanding interest in all fields, acquiring professional knowledge in both the practice and theory of politics, art and philosophy. The claim of the book is, therefore, that contrary to a superficial prejudice, it is possible to address the philosophical issues of art and politics in the same oeuvre, as the example of this Cambridge-educated analytical philosopher (...) proves. Accordingly, the book has a bold thesis on the general, theoretical level, mapping the connections between politics, art and philosophy. However, it also has a pioneering commitment on the level of the particular, offering the first full-length study into the philosophical legacy of Roger Scruton, probably the most important British conservative philosopher of the late 20th and the first decades of the 21st century. The paper comments on a rather uncommon approach to mathematics called physicalist formalism. According to this view, the formal systems mathematicians concern with are nothing more and nothing less than genuine physical systems. I give a brief review on the main theses, then I provide some arguments, concerning mostly with the practice of mathematics and the uniqueness of formal systems, aiming to show the implausibility of this radical view.

At the end of his life György Lukács described his intellectual career as ‘my way to Marx’ [mein Weg zu Marx]. By this he meant that his professional life can be interpreted as an attempt to get to the real Marx. In this paper I use this expression in a narrower and more direct meaning: I attempt to present the road at the end of which the young Lukács arrived at a Marxist standpoint.

The brokenness in South African society strikingly apparent, exacerbated by the effects of exceptionally high criminal behaviour statistics show. The demand for pastoral care (...) and assistance with various personal proble is on the increase, with many non-church goers turning to churches for help. Also appare in South Africa is the acute shortage of trained individuals to offer care and counselling. T task of offering care is not the sole responsibility of clergy, as all are called to be shepherds a caregivers. The importance and urgency in training church-based counselling teams cannot overstated. More so in that we are becoming increasingly aware that not only are individu in need of care, but whole communities are struggling with trauma and life's challenges, a often do not know whom to turn to. In pursuance of the realisation that pastoral care is t function and duty of all Christians, this article will delineate in particular an explanation lay counselling, reasons for its importance including biblical foundations, where and ho ordinary South Africans can get involved, and will propose certain models and approach for getting started. These models will not be discussed in depth, but present an opportun for the next. Teams for these models consist of professional counsellors, but ought not to restricted to a select few, as all are called to this special ministry and can be trained for t task, which will include on-going supervision and mentoring. The overall purpose of t article is to highlight the urgency of training lay counsellors and some recommendations w be made how to apply it, in an attempt to be faithful to the biblical mandate and examples by Jesus Christ. This paper argues against dismissing the Principle of Alternative Possibilities merely on the ground of so-called Frankfurt-style cases. Its main claims are that the interpretation of such cases depends on which substantive theory of responsibility one endorses and that Frankfurt-style cases all involve some form of causal overdetermination which can be interpreted either as being compatible with the potentially manipulated agent’s ability to act otherwise or as a responsibility undermining constraint. The paper also argues that the possibility of such scenarios (...) can support the truth of classical compatibilism as much as the truth of semicompatibilism. (shrink)
