Existence monism is defended against priority monism. Schaffer's arguments for priority monism and against pluralism are reviewed, such as the argument from gunk. The whole does not require parts. Ontological vagueness is impossible. If ordinary objects are in the right ontology then they are vague. So ordinary objects are not included in the right ontology; and hence thought and talk about them cannot be accommodated via fully ontological vindication. Partially ontological vindication is not viable. Semantical theorizing outside the ontology room (...) and semantical theorizing in the doorway. How is it possible for human subjects who are socially constructed to engage in effective and authoritative acts of resistance to the social norms and institutions within which they were formed? Judith Butler, in her engagement with the work of Pierre Bourdieu, locates this possibility in the nature of `speech acts', and in resistance to social norms emanating from the abjected margins of social life. She criticizes Bourdieu for undermining the promise of agency contained in habitus by reducing it to (...) the social field in which it was constituted, thus re-closing `the iron cage' of structural/institutional determination. For Butler, social norms and institutions, dependent as they are on reiterative performance, are intrinsically open to disruption. It is possible, she claims, using as her example Rosa Parks's historical act of resistance in Montgomery, Alabama in 1955, to resist with authority, yet without prior institutional authorization. This article argues that Butler's theory of iterability works to endow the capacity to authorize against the grain of institutional authority with individuals and their acts and hence neglects the social contexts that inform and de-limit this capacity. `Resisting with authority' is possible precisely because it is not endowed by individuals or their acts, but is collective and interactional. Neo-liberalism has become one of the boom concepts of our time. From its original reference point as a descriptor of the economics of the ‘Chicago School’ or authors such as Friedrich von Hayek, neo-liberalism has become an all-purpose concept, explanatory device and basis for social critique. This presentation evaluates Michel Foucault’s 1978–79 lectures, published as The Birth of Biopolitics, to consider how he used the term neo-liberalism, and how this equates with its current uses in critical social and cultural theory. (...) It will be argued that Foucault did not understand neo-liberalism as a dominant ideology in these lectures, but rather as marking a point of inflection in the historical evolution of liberal political philosophies of government. It will also be argued that his interpretation of neo-liberalism was more nuanced and more comparative than more recent contributions. The article points towards an attempt to theorize comparative historical models of liberal capitalism. (shrink)

In Chapters 4 and 5 of his 1998 book From Metaphysics to Ethics: A Defence of Conceptual Analysis, Frank Jackson propounds and defends a form of moral realism that he calls both ‘moral functionalism’ and ‘analytical descriptivism’. Here we argue that this metaethical position, which we will henceforth call ‘analytical moral functionalism’, is untenable. We do so by applying a generic thought-experimental deconstructive recipe that we have used before against other views that posit moral properties and identify them with certain (...) natural properties, a recipe that we believe is applicable to virtually any metaphysically naturalist version of moral realism. Heyman explains useful ways to bring addictive drug use under environmental control. We doubt that relapse is explained by drug features such as immediate reinforcement, clouding of judgment, and so forth. Relapse may require explanation in terms of enduring sensitization of incentive neural substrates, but even if its causal assumptions are wrong, Heyman's model makes useful predictions for behavioral control.

The introduction of the National Health and Medical Research Council guidelines for the ethical conduct of Indigenous health research: Values and Ethics: guidelines for ethical conduct in Aboriginal and Torres Strait Islander health research (NHMRC, 2003), has prompted renewed debate about the ethical assessment of Indigenous health research in Australia. Concern has been expressed that these guidelines provide inadequate protection of Indigenous interests and that their introduction will result in a rolling back of important Indigenous research reform gains of the (...) past three decades. Another view is that the participatory focus of the Guidelines will help ensure that key Indigenous values are positioned as central to the development of research involving Indigenous interests. In this article we provide an overview of recent commentary on the Guidelines, and canvass practical proposals for their implementation into practice. In particular, we present a case for applying the Values and Ethics Guidelines as a foundation for establishing negotiated research agreements between Indigenous peoples and professional researchers at the local community level. The intention of this proposal is to give voice to the concerns and perspectives of Indigenous peoples through research, and to provide a framework for monitoring research after ethics approval has been granted. In Kant's "fact of reason," there is an apparent paradox of our being subject to laws of which we must regard ourselves as the author, while at the same time being normatively bound by the same laws that we cannot see ourselves as authoring. Working out the implications of this apparent paradox generated much of the response to Kant in post-Kantian idealism. Wilfrid Sellars notes the same paradox when he speaks of the "paradox of man's encounter with himself" in "Philosophy (...) and the Scientific Image of Man." Like some of the idealists, Sellars thus opted for "two track" system of philosophy that combines the two tracks in a metaphor of "stereoscopic vision." This paper argues that understanding Sellars 's own thought in terms of the issues that formed the dynamic of post-Kantian philosophy in Germany puts us in a better position to understand why Sellars 's own conception of experience and of the unreality of the manifest image is not completely consistent with the argumentative direction of his thought. Understanding Sellars in this way helps us understand the limits of post-Kantian idealism just as understanding the dynamic of post-Kantian idealism gives us a more nuanced version of Sellars 's conception of experience. Pressures are mounting upon Australian retailers including their ability to grow profit. Price deflation for many items, a lack of wage growth, and, the rise of huge online platforms is just some of the factors now creating difficulties for retailers. In the absence of sales growth, profit can only be improved with a focus on the cost side of the business. And, it is this focus that has brought about the potential for unethical decision making. This case study examines the (...) role of accountants in influencing this decision making. Accountants are often seen as the experts when it comes to cost control. Consequently, they have a unique opportunity to use their position to help ensure that when governance processes surrounding cost (and profit) management are established, or when key decisions are made, these are undertaken on an ethical basis. This teaching case explores this issue within three scenarios relevant to the current Australian retail industry. Firstly, the ethical concerns of the use of power by the big retailers to reduce costs within international and domestic supply chains are examined. Secondly, recent instances of questionable practices to inflate profits through rebate, and other, accounting methods are analysed. Finally, the design of remuneration systems is discussed within the context of whether these are creating unethical biases within organisational decision making. (shrink)

Active externalism (also known as the extended mind hypothesis) says that we use objects and situations in the world as external memory stores that we consult as needs dictate. This gives us economies of storage: We do not need to remember that Bill has blue eyes and wavy hair if we can acquire this information by looking at Bill. I argue for a corollary to this position, which I call ‘internalism.’ Internalism says we can acquire knowledge on a need‐to‐know basis (...) by consulting portable, inner analogues of the world. This, however, leads to a dilemma. If the knowledge was stored in memory, it is difficult to see how we could have acquired it by consulting inner analogues, for it would seem that we knew it already. Moreover, if it was stored in memory, we lose the economies of storage that provide much of the rationale for external memory stores and hence for their inner analogues. If, on the other hand, the knowledge was not stored in memory, it is difficult to see how we could have acquired it by consulting inner analogues, for it was not there to be acquired. I propose a solution to this problem that turns on the concept of nonconceptual content, and I relate the solution to Stephen Kosslyn's (1994) architecture of perception and visual mental imagery. Viewed in a broader context, the solution shows that the world leaks into the mind, as well as mind leaking into the world. (shrink)

In his PhD proposal, now published as Seeing Sociological, Garfinkel [2006] formulated action in terms of a mutually constitutive structure—the Noesis-Noema Structures. This structure can be traced to Aaron Gurwitsch’s gestalt psychology and Law of Good Gestalt which theorises how participants prioritise functional Gestalts over other possible meanings of what is perceivable in their surroundings. While Gurwitsch illustrated his theory using images, in this paper we revisit Gurwitsch’s theory in light of the advances in recording real-time interaction to consider Gestalt (...) in spatio-temporality of real-time interaction. We consider the Law of Good Gestalt in terms of the dimensions of time and space, and postulate two analytical principles—the Principle of Good Momentary Gestalt and the Principle of Good Temporal Gestalt—for analysing a multi-angle video segment of a monologue taken from a training event. The analysis examines how the monologue was embedded in a multi-layer projection structure, so that during the time of the monologue, the trainer and trainees can be seen as achieving a transition between one activity to another while sustaining the frame of the training event. Through this, the analysis highlights the multi-layered structure of participants’ field of perception that constitutes their experience of the social activity, and explores a “method” to reconstruct such a structured field of perception through re-coupling meanings to the assemblages of multimodal resources recoverable on video. Deleuze’s philosophical method is analyzed and positioned against the background of the intellectual/religious tradition of practical mysticism that has been traveling the globe across times, places, languages, and cultural barriers. The paper argues that Deleuze’s unorthodox ontology of the virtual enables a naturalistic interpretation of the functioning of mysticism when the triad of concepts, percepts and affects is formed in accordance with the logic of the included middle.

The rapid expansion of competence‐based education through the work of the National Council for Vocational Qualifications has now, thanks to generous public funding and official endorsement by the Department for Education, penetrated the theory and practice of professional studies in teacher education at both school and post‐school levels. The NCVQ model of CBE is criticised and alternatives described. The current NCVQ approach is neither the only nor necessarily the most appropriate model of occupational development on offer. Models of professionalism based (...) on the concept of ‘expertise’ are recommended as the ones most likely to produce the reflective practitioners required to enhance the status and quality of teaching in schools and colleges. This is the central topic of Elizabeth Harris’s Theravada Buddhism and the British Encounter: Religious, Missionary, and Colonial Experience in Nineteenth Century Sri Lanka. By throwing light on this crucial encounter, Harris greatly reduces the heat generated by these competing missions and makes greater understanding possible. At least, that would be one hoped-for outcome.Harris challenges the standard postcolonial critique (SPC) of what happened to Sri Lankan Theravada Buddhism and Sri Lankan Theravada Buddhists when Christian missionaries, riding on the coattails of the Portuguese, Dutch, and British colonialists, invaded the peaceful and pristine island of Ceylon, now Sri Lanka, in the seventeenth, eighteenth, nineteenth, and twentieth centuries. SPC posits Western colonial missionaries gaining power through their political proxies, shaping Western understandings of Theravada Buddhism to fit their Puritan and rationalistic preconceptions, and then attempting to destroy this made-in-the-West Buddhism, using aggressive and triumphalistic mission tactics that not only failed, but generated such a backlash that still, today, Buddhist-Christian relationships in Sri Lanka are poisoned almost beyond remedy.Harris challenges the SPC not by denying the obvious truths embedded in the various elements of this version of the sad story, but by convincingly showing us that the SPC is only one side of a very complex story. The SPC, Harris argues, needs to be complexified by realizing that not all British in nineteenth century Ceylon fit the stereotypical missionary model, that Sri Lankan Buddhists had agency in shaping what became known as Protestant Buddhism in the twentieth century Buddhist revival, and that the Buddhist mission effort that corresponded to the Christian mission effort led to a system of competing mission efforts that must be factored into any attempt to understand the influence of the nineteenth century on the twentieth—and the twenty-first.British ChristiansHarris uses three paradigms to show the diversity of British interlocutors with Sri Lankan Theravada Buddhism and Buddhists. Some came as political overseers for the colonial government. Some came as merchants, looking for a way to turn the island’s abundant natural resources into pounds in their bank accounts back home. Some came simply as “tourists” looking to find out more about what was in the nineteenth century a very exotic culture indeed to European eyes. Some came as missionaries to spread the Christian gospel story. And a trickle of scholars seeking data for research topics gradually turned into a fairly broad stream by the end of the century. Each of these five groups came asking slightly different questions. Because Buddhism was so ubiquitous among the people of Ceylon, Buddhism was always part of the answer to the different questions politicos, businesspeople, travelers, Christians, and professors asked, but the different questions produced different products: statements of public policy vis-à-vis Buddhism, Southeast Asian versions of Weber’s observations about religion and economics, diaries and travelogues, theologies of religion, and... The ABA has adopted four model policies that address, in one way or another, the issue of foreign lawyer mobility. These policies are the ABA Model Foreign Legal Consultant Rule, which is commonly known as the FLC rule, the ABA Model Rule for Temporary Practice by Foreign Lawyers, which is commonly known as the FIFO rule, ABA Model Rule of Professional Conduct 5.5, which permits foreign lawyers to serve as in-house counsel, and the ABA Model Rule on Pro Hac Vice (...) Admission. All four of the ABA's foreign lawyer mobility recommendations include a requirement that the mobile foreign lawyer is “ subject to effective regulation and discipline by a duly constituted professional body or a public authority .” In other words, these rules set forth requirements regarding the nature of the regulatory system in the foreign lawyer's home jurisdiction. A number of US states have included this requirement in their foreign lawyer mobility provisions, but a number have not. Although the ABA model rules and a number of state rules include this requirement, neither the ABA Model Rules nor any of the state rules have defined what it means for a foreign lawyer to come from a system with “effective regulation and discipline.” Nor is there any evidence that this requirement has been enforced in those states that have included this requirement. This article suggests that the “effective regulation and discipline” requirement has been an elephant in the room that no one has been willing to talk about. The article argues that the time has come to confront this issue head-on. It asserts that either efforts should be undertaken to define and enforce this requirement or that the requirement should be abandoned. The article reviews two “threshold” issues that jurisdictions might want to consider when deciding whether to adopt or retain an “effective regulation and discipline” requirement. It also identifies cross-cultural and cross-professional resources that might be consulted for “benchmarking” purposes if and when US regulators decide to add “meat to the bones” by defining and enforcing the “effective regulation and discipline” requirement found in foreign lawyer mobility provisions.
