On Nietzsche, science, the oral tradition -- or the troubadours and ancient Greek music drama.

The question examined in this study is not merely how a Nietzschean critique of law would look had Nietzsche ever applied his genealogical method to the question of law, but also what positive function Nietzschean philosophy may ascribe to law, and how law must then be transformed. The methodological parable imagines a “post-genealogy” or “pot-ressentiment” phase of the human condition, akin to the Marxist “post-revolutionary” phase: how would law look for the person of power - overman or otherwise - who (...) needs to live among others? How is normativity possible - what are its forms and functions - in a social world that has undergone a reevaluation of all values? The study traces three possible models for conceptualizing law in Nietzschean terms, each requiring a radical shift from traditional (in different contexts: liberal, Christian, bourgeois) conceptions. The first one is play: law as affirming and embracing the essence of the Dionysian, which is perpetual becoming. Play requires us to let go of law's role as the curtailer of arbitrariness. An integral part of the Nietzschean program, it requires a radical reevaluation: not just law's content is overcome, nor merely its bourgeois forms (in Pashukanis' critical terms), but its “internal” or “inherent” values of certitude and stability are overcome as well. The model I offer for play is not Zarathustra's dicethrow but Borges' The Lottery in Babylon. The second model is that of resistance, framed by Nietzsche's analysis of power and Deleuze's distinction between active and reactive forces. The insight here is that power requires resistance, and it is law's primary function to empower the other in order to invest value in meeting and confronting her; thus the monism of the will to power not only does not do away with normativity in the public sphere but actually requires it - but for goals opposite to those of liberalism. Resistance is linked to the third model, fashioned after Nietzsche's model of education: here, law performs not as a socializing agent but rather as a “liberator” of authenticity. Its function is analogous to that of a mentor whose role is to ultimately encourage the pupil into coming into her own will, shedding ressentiment and bad conscience in an active, i.e. non-conscious way; in its relation to consciousness it is the opposite of psychoanalysis. A fourth consideration is then offered, the role of normativity in self-overcoming, or self-legislating; namely, how does normativity figure in the will to power's most significant challenge. While all these models work from an interpretation of the will to power as becoming, the last two are especially dependent on the active-reactive distinction. The cornerstone is not to mix up power with representations of power; to realize that the case is not the will that desires power (as an object of desire, this would necessarily involve a representation of power) but power that wills becoming. In dealing with this metaphysical question I expound on a similar crucial interpretation, originally offered by Deleuze; however, I break off from Deleuze's claim that the will to power has nothing to do with any notion of struggle. If this discussion of the will to power is missed , or if it is wrong, the main argument of this article can not hold. Finally, I use this interpretation of the will to power to solve Kafka's riddle in The Trial: a necessary move once one realizes that, in the ethical history of western culture, Kafka's parable of the seeker of the law before its closed gates continues a sequence that began with Plato's fable of the cave and continued with Zarathustra's cave parable. I add three points that may be termed methodological or contextual. The first is positioning Nietzsche's limited discussion of law and politics as a derivative of his metaphysics of the will and treatment of moral psychology, not as an independent topic to be searched and indexed in some textual corpus. The second is to understand the question of normativity in its particularly Nietzschean sense, i.e. “what is X to me/to the overman?”, and not in the Kantian sense of uncovering the conditions that entail any synthetic, a-priori sentence (such as normative ones). The last comment places the Nietzschean project in a larger pattern that defined radical thought in the late nineteenth and early twentieth centuries, and whose other cases are Marx and Freud: a new metaphysics (will to power/materialism/id) that uncovers a state of bondage, psychological and material, in which law plays a pivotal role in its function of reinforcer and supplier of a legitimizing language (respectively, of ressentiment, of the relations of production, of Oedipus and the bourgeois family); and finally radical, yet partial ways of overcoming bondage that are not mutually translatable - genealogy, revolution, psychoanalysis. ABSTRACTAmor fati—the love of fate—is one of many Nietzschean terms which seem to point towards a positive ethics, but which appear infrequently and are seldom defined. On a traditional understanding, Nietzsche is asking us to love whatever it is that happens to have happened to us—including all sorts of horrible things. My paper analyses amor fati by looking closely at Nietzsche's most sustained discussion of the concept—in book four of The Gay Science—and at closely related passages in that book. (...) I argue that by ignoring the context in which Nietzsche writes about amor fati in The Gay Science, we are liable to ignore several exegetical and philosophical problems with the traditional understanding of the term. I'll argue for a different interpretation which locates Nietzsche's amor fati within the philosophical project of The Gay Science and which copes better with the objections that plague the traditional view. This book offers a lively and unorthodox analysis of Nietzsche by examining a neglected aspect of his scholarly personality--his sense of humor. While often thought of as ponderous and melancholy, the Nietzsche of Higgins's study is a surprisingly subtle and light-hearted writer. She presents a close reading of The Gay Science to show how the numerous literary risks that Nietzsche takes reveal humor to be central to his project. In an essay on Nietzsche's view of morality written in 1891, Eduard von Hartmann suggested that Nietzsche's most important contribution to philosophy was in the sphere of ethics; at the same time, he drew attention to the affinity between Nietzsche's ideas and the philosophy of Max Stirner. Hartmann's remarks open up Nietzsche's philosophy to examination in terms of a radically materialist framework. Nietzsche sees the ethics of asceticism, and hence Christianity, as a consequence of metaphysical dualism , a stance which (...) enables him to advance a positive, because physiologically based, sexual ethics. His philosophy proposes a profound and instrinsic relationship between the sexual and the aesthetic. This article shows how an appreciation of the radical materialism advanced by Nietzsche serves as evidence of the relevance of his philosophy to contemporary concerns and debates in ethics, and explores Nietzsche's ethical programme to develop ‘a more Goethean attitude toward sensuality’. Plato said that as long as wisdom and power, or philosophy and politics, are separated, “there can be no rest from troubles.”1 In The Republic, he sought to forge such a union. For over two millennia, from Plato through John Rawls, philosophers have put forward models for the just state.2 Despite these ongoing efforts, W. B. Gallie contends, “No political philosopher has ever dreamed of looking for the criteria of a good state viz-à-viz [sic] other states.”3 I will argue that (...) as long as wisdom and power are separated in international relations, we will continue to have problems. We need to forge a normative framework capable of addressing global issues. I further maintain that, in order to advance a global normative framework, achieving peace, or at least the “outlawry of war” championed by John Dewey, may well be the precondition for success in addressing the myriad global problems facing humanity.4 I agree with Ronald Glossop that among all the global issues we need to address, war is “humanity’s most pressing problem.”5 How can we adequately protect everyone’s human rights, secure economic well-being for all persons, preserve this planet’s rich biological diversity, and attend to other serious global concerns if we fail to end war? The structure of my argument is as follows: I will begin by reviewing the parochial and warist implications of the focus on national sovereignty within Enlightenment political philosophy from Thomas Hobbes through Immanuel Kant. Then, after indicating how Georg Wilhelm Friedrich Hegel and Karl Marx point beyond the modern state in a way that would allow for the global application of normative principles, I will note that the Hegelian and Marxian traditions have not made this normative prospect focal. Finally, in order to develop a global normative framework, I will connect the efforts within twentieth-century philosophy to develop arenas of applied ethics to recent efforts in political science to develop a model of a humane world community.. This article examines the absence of biological relatedness in couples where the use of a third-party gamete donor casts doubt on the notion of conventional kinship. The authors observe that individuals who have used technology to create a family remediate relatedness through a dehistoricized idea of kinship in which the traditional concept is replaced with the concept of chance. The article also examines how inherited value is replaced by strategies that redefine the ways in which donor gamete parents can pass (...) their values on to their children. This essay provides an analysis of the clinical problems that arise at the borderline between neurology and psychiatry. We postulate that psychopathological and neuropathological constructs have distinct referents and conceptual fields, but they are not mutually exclusive categories. After establishing criteria for defining neuropsychiatric constructs, we outline rules for identifying cases where a significant relationship exists between neuropathological and psychopathological patterns. We propose three approaches to establishing this relationship: a clinical epidemiology approach, a clinical neuroscience approach offering a mechanistic model, (...) and a longitudinal study of individual cases incorporating idiographic perspectives. We discuss the logic of brain-behavior relationships and emphasize the need for closer academic feedback between neuroscientific research and clinical practice to better understand the causality of psychopathological phenomena in the context of neuropsychiatry. While precise demarcation may be challenging in some cases, we provide two types of examples: first, straightforward cases where neuropathology explains psychopathological patterns; second, complex cases that require studying the causal interactions between neuropathological factors, psychological factors, and sociocultural contexts, leading to intricate clinical patterns that demand cognitive neuropsychiatry resources, and a multidisciplinary approach to clinical care. Money and support tend to flow in the direction of economics, science, and other academic departments that demonstrate measurable "progress." The humanities, on the other hand, offer more abstract and uncertain outcomes. A humanist's objects of study are more obscure in certain ways than pathogens and cells. Consequently, it seems as if the humanities never truly progress. Is this a fair assessment? By comparing objects of science, such as the brain, the galaxy, the amoeba, and the quark, with (...) objects of humanistic inquiry, such as the poem, the photograph, the belief, and the philosophical concept, Volney Gay reestablishes a fundamental distinction between science and the humanities. He frees the latter from its pursuit of material-based progress and restores its disciplines to a place of privilege and respect. Using the metaphor of magnification, Gay shows that, while we can investigate natural objects to the limits of imaging capacity, magnifying cultural objects dissolves them into noise. An essential aspect of forming representations of social groups is to recognize socially relevant attributes licensed by the group membership. Because knowledge of cultural practices tends to be transmitted through social contact within social groups, it is one of the fundamental attributes shared among members of a social group. Two experiments explored whether 5‐ and 6‐year‐olds selectively attribute shared cultural knowledge on the basis of group membership of agents. Using novel social groups, children were introduced to one target agent and (...) two other agents, one of which belonged to the same group as the target and one belonged to a different group. Children were then asked who would know or like same things as the target agent. The results showed that children expect group members to know the same songs, whereas they do not necessarily expect them to like the same songs or know the same generic facts. These findings suggest that children are remarkably selective in the attributions they make based on social group membership and from early on, they expect social group membership and cultural knowledge to be closely linked. Summary Raphael Meldola FRS (1849–1915) was professor of chemistry at the City and Guilds Technical College in Finsbury. He was a colleague and close friend of Silvanus Phillips Thompson FRS (1851–1916), the college principal and professor of physics. This paper follows an earlier one on Thompson and the making of his career. It is intended to illustrate further the ways in which scientists of Meldola and Thompson's generation gained advancement within the scientific community. Meldola had interests beyond chemistry, including a (...) serious interest in field entomology. In this he had several well-known mentors including Alfred Russel Wallace and Charles Darwin. The paper, which includes much new information derived from archival work, is presented as six thematic narratives related, among other things, to chemical and technical education, dye chemistry, the Royal Society solar eclipse expedition of 1875, natural history and Darwinism, field clubs, learned societies, and the honouring of scientists. Together these narratives illustrate a generalist/voluntarist career pattern that came to an end with the First World War. (shrink)

Science and Homosexualities is the first anthology by historians of science to examine European and American scientific research on sexual orientation since the coining of the word "homosexual" almost 150 years ago. This collection is particularly timely given the enormous scientific and popular interest in biological studies of homosexuality, and the importance given such studies in current legal, legislative and cultural debates concerning gay civil rights. A journal editor recently apologised for publishing a 2010 paper in which authors designated an enzyme as New Delhi metallo-β-lactamase-1 (NDM-1) and its related gene bla_NDM-1 after a city, New Delhi. This name had raised an outcry in India, with health authorities, media and medical practitioners demanding New Delhi be dropped from the name. The name was actually first given in another 2009 paper, whose corresponding author remains the same as the 2010 paper. There is a tradition of eponymous names (...) in science. But those found derogatory to races, groups, cities, and countries have been changed. For example, Mongolism was changed to Down's syndrome; Australia antigen to HBsAg; Mexican Swine flu to H1N1; GRID (Gay Related Immune Deficiency) and 4H-Disease (Haitians, Homosexuals, Haemophiliacs and Heroin Users Disease) to AIDS. It is necessary that NDM-1 also be changed to a name based on scientific characteristics. NDM-1 must be changed to PCM (plasmid-encoding carbapenem-resistant metallo-β-lactamase). It is also necessary to review the tradition of naming organisms, diseases, genes, etc. after cities, countries and races. Often, such names giving amounts to names calling. It needs to be discarded by scientists in all new names giving from now on. Geographical and racial names giving must be replaced by scientific names giving. Journal editors must ensure that such scientific names giving is laid down as standard guideline in paper submissions. All such names still in currency need to be phased out by replacing them with names based on scientific characteristics, or in honour of their pioneering scientist/s or institutions. The lead author of the above 2010 paper has said he was not consulted about the final draft and did not agree with the conclusions of the paper. To ensure that corresponding authors do not ride roughshod over co-authors, and lead and other authors do not backtrack on papers, editors must ensure written concurrence of all authors, especially the lead author, to the final draft of a paper and include this in their guidelines for paper submissions. Summary Many people were involved in producing the seven volumes that make up the fourth series of the Royal Society catalogue of scientific papers. Included were about two hundred volunteers and about one hundred people working either on short-term contracts or carrying out piece work. At the Royal Society there was a small, largely female, secretariat working full-time. It included both clerical and bibliographic staff. Coordinating all the work was the chemist Herbert McLeod, appointed director of the catalogue in 1901. (...) As is discussed, the position of director was created especially for him after his forced retirement from the Royal Indian Engineering College. The paper shows the complexity of the work involved in producing the catalogue, as well as something of the office culture at the Royal Society in the early twentieth century. The working conditions of the women employees, and prevailing attitudes toward the largely female clerical and bibliographic staff, are briefly discussed. (shrink)

After years of progress in terms of gender and sexual rights, since 2012 Europe is facing a so-called gender backlash – opposition directed to issues related to reproductive policies and abortion, violence against women, lesbian, gay, bisexual, transgender, intersex, and queer (LGBTIQ) rights and gay marriages, gender mainstreaming and sex education at schools as well as antidiscrimination policies. In this article, firstly, by taking the anti-gender developments as point of reference, I examine the emergence of anti-gender movement in Europe via (...) the use of what I call troll science. Troll science is based on (distorted) scientific arguments moulded into populist discourse, creating an alternative narrative on the conceptions of gender equality. Similar to troll accounts posting provocative, superfluous and even off-topic messages on social media to start arguments and quarrels aiming to distract, troll science, I argue, creates an alternative narrative opposing the scientific facts and discourses (i.e. climate change, evolution, vaccination and gender theory). Later, I discuss the emerging conservative troll-scientific discourses and the gendered public normative order of Adalet ve Kalkinma Partisi (AKP; Justice and Development Party) government, under the New Turkey. I previously argued that New Turkey and the society under the party’s rule perpetuated by a new set of standards create an alternative narrative on the conceptions of gender equality through troll-science narratives. I concluded by showing how such ideological discourses help create emotional echo chambers – enabling its fast distribution and acceptance by the ideologically conservative groups. What are ‘gay genes’ and are they real? This article looks at key research into these hypothesized gay genes, made possible, in part, by the Human Genome Project. I argue that the complexity of both genetics and human sexuality demands a truly critical approach: one that takes into account feminist epistemologies of science and queer approaches to the body, while putting into conversation resources from agential realism and critical realism. This approach is able to maintain the agential complexity of (...) genetic materiality, while also critically challenging the seemingly stable relationships between sex, gender and sexuality. This paper is both an exercise in historical recovery in that it details some of the events surrounding the founding of the City and Guilds of London Institute and describes the way in which the Institute set about the building and running of two of its colleges, the City and Guilds Technical College, Finsbury, and the Central Institution in South Kensington and an attempt to interpret the above material in terms of various forms of association within the City Corporation and (...) the guilds. Collectively the City and the guilds made an effort to come to terms with a modernizing world through the means of providing scientific and technical education. The guilds wanted to remain important even though traditional apprenticeship was dying out. In joining in a new venture to provide technical education for young people it was necessary to maintain an order in which the City's presence was clear and apparent. This paper will show how such an order was achieved and, in so doing, it shows something more generally of the relationship of tradition and rhetoric to institution building. (shrink)

In the face of what has been referred to as a crystal methamphetamine ‘‘epidemic’’ among gay men in North America, a number of health promotion efforts have been developed. While these efforts vary in approach, a core feature is the assumption that a user’s health depends on distinguishing accurate truths about CMA from inaccurate beliefs about CMA. Drawing on insights developed by Bruno Latour, this article unravels how this distinction plays out in the context of one expression of CMA health (...) promotion. I suggest that CMA health promotion may be more usefully understood as form of collective work in which various players throw up different knowledge practices for debate rather than an effort to mark the difference between truth and belief. In doing so, I suggest that of Latour, and science studies more generally, offers an opportunity for rethinking the nature of health promotion writ large. (shrink)

This article provides an analysis of the transnational spatial politics of activism around lesbian, gay, bisexual, transgender and queer politics in Poland. The authors discuss three key themes that emerged from their empirical research on activism associated with the equality marches in Krakow, Poznan and Warsaw. These are concerned with age and the intergenerational politics of solidarity; the connection between migration and activism, and the use of city-twinning links. The authors argue that research on the spatial politics of activism and (...) social movements can enhance existing understandings of the sustainability of activist struggles for lesbian, gay, bisexual, transgender and queer politics in Poland.
