In this chapter, I argue that Plato and Aristotle provide analyses of virtue and practical reason that are strongly shaped by the structure of the technai. Socrates assimilates virtue to skill, while Aristotle assimilates practical reason to a means-end technique. While both philosophers are sensitive to the problems these technē models generate, and try either to escape or to remedy them, they nonetheless remain under the impress of those models. Jessica Wilson has recently offered a more sophisticated version of the self-defeat objection to Cartesian scepicism. She argues that the assertion of Cartesian scepticism results in an unstable vicious regress. The way out of the regress is to not engage with the Cartesian sceptic at all, to stop the regress before it starts, at the warranted assertion that the external world exists. We offer three reasons why this objection fails: first, the sceptic need not accept Wilson’s characterization of the sceptical (...) thesis and thus need not start her regress; second, even if she did commit to the regress, it would not undermine scepticism in the way Wilson envisages; and third, the appeal to mental state scepticism which is necessary to generate the second and subsequent steps in the regress is not justified. This series celebrates the Bodleian Library's acquisition of Tom Phillips's archive of over 50,000 photographic postcards dating from the first half of the twentieth century, a period in which, thanks to the ever cheaper medium of photography, 'ordinary' people could afford to own their portraits. Each title in this series is thematically assembled and designed by the artist, the covers featuring a linked painting specially created for each title from Tom Phillips's signature work, A Humument.With an illuminating foreword by Eric (...) Musgrave, 'Menswear' presents postcards of men in all manner of outfits, whether formal, practical or casual, dating from around 1900 up to c. 1949. Most of the subjects are posing for portraits, displaying both their individual style and an interpretation of the fashions of the time. This paper outlines, from a sociological and social psychological perspective, a theoretical framework with which to define and analyse consciousness, emphasizing the importance of language, collective representations, conceptions of self, and self-reflectivity in understanding human consciousness. It argues that the shape and feel of consciousness is heavily social, and this is no less true of our experience of collective consciousness than it is of our experience of individual consciousness. The paper is divided into two parts. Part One argues that the (...) problem of consciousness can be approached fruitfully by beginning with human group and collective phenomena: community, language, language-based communication, institutional and cultural arrangements, collective representations, self-conceptions, and self-referentiality. A collective is understood as a group or population of individuals that possesses or develops collective representations of itself: its values and goals, its structure and modes of operating, its strategies, developments, strengths and weaknesses, etc. Collective reflectivity emerges as a function of an organization or group producing and making use of collective representations of the self in its discussions, critical reflections, and planning. A collective monitors its activities, achievements and failures, and reflects on itself as a defined and on-going collective being. In this perspective, human consciousness is understood as a type of reflective activity: observing, monitoring, judging and re-orienting and re-organizing self; considering what characterizes the self, what self perceives, judges, could do, should do . The reflectivity is encoded in language and developed in conversations about collective selves. Part Two of the paper applies the framework to analysing the individual experience of consciousness, self-representation, self-reference, self-reflectivity and self-development. (shrink)

It begins by noting the challenges which the 'return' of religions to liberal democracies poses to the liberal commitment to respect citizens’ freedom and equality. Then, with particular reference to Rawls' theory of liberal politics, it situates the papers in relation to three different senses of liberal ‘respect’ that are challenged by contemporary religions – one understood in terms of the justification of political (...) power, another as tolerance of diversity, and the third in terms of freedom from interference. Over fifteen years after first reporting to the State of New York, the Harvard Medical Practice Study continues to have a significant impact in medical malpractice policy debates. In those debates the HMPS has come to stand for four main propositions. First, “medical injury… accounts for more deaths than all other kinds of accidents combined” and “more than a quarter of those were caused by substandard care.” Second, the vast majority of people who are injured as result of substandard care (...) do not file a claim. Third, “a substantial majority of malpractice claims filed are not based on provider carelessness or even iatrogenic injury.” Fourth, “whether negligence or a medical injury had occurred… bore little relation to the outcome of the claims.”Medical malpractice researchers have long known that the HMPS provides far stronger support for the first two of these propositions than for the last two; the HMPS was not designed or powered to reach strong conclusions about the validity of medical malpractice claims. In ‘Moral Character’, Miller develops his “mixed trait” account of character. The first two parts consist in conceptual background and the empirical grounding for his account . In this essay, I describe Bob Veatch’s career from the perspective of a colleague and friend. Bob and I started our professional careers at the same time and quickly came into professional contact. With Bob’s move from the Hastings Center to the Kennedy Institute, we became colleagues and worked for almost a decade on our book on death and dying. He was an outstanding co-editor and author. I believe he knew more about the philosophically connected issues in this area of (...) bioethics than anyone publishing in the area, and it was an area of intellectual interest that he pursued throughout his career. Beyond bioethics, Bob and I shared our shared love of contemporary bluegrass music, especially the songs of The Seldom Scene. Bob studied them much as he studied bioethics—with deep knowledge and seriousness. He was just a scholar by nature and with excellent training and experience. If we were to create a Hall of Fame for bioethics, Bob might be the first person elected. (shrink)

In this commentary, we assess the propositional approach to associative learning not only in terms of veridicality and falsifiability, but also in heuristic value. We remark that it has furthered our knowledge and understanding of human, as well as animal, associative learning. At the same time, we maintain that models developed from the association formation tradition continue to bear great heuristic value as well.

This paper defends the use of quasi-experiments for causal estimation in economics against the widespread objection that quasi-experimental estimates lack external validity. The defence is that quasi-experimental replication of estimates can yield defeasible evidence for external validity. The paper then develops a different objection. The stable unit treatment value assumption, on which quasi-experiments rely, is argued to be implausible due to the influence of social interaction effects on economic outcomes. A more plausible stable marginal unit treatment value assumption is proposed, (...) but it is demonstrated to severely limit the usefulness of quasi-experiments for economic policy evaluation. More specifically, it distinguishes between creature consciousness and state consciousness, and between access consciousness and phenomenal consciousness. In this book, a distinguished international group of legal theorists re-examine legal positivism as a prescriptive political theory and consider its implications for the constitutionally defined roles of legislatures and courts. The issues are illustrated with recent developments in Australian constitutional law.

This essay examines the conjunction of French historical epistemology and Lacanian theory in postwar France. In particular, Lacan's account of scientific formalization is scrutinized insofar as it develops aspects of the prior epistemological research of Gaston Bachelard, whose innovative approach to the problem of the nature and limits of scientific knowledge proved so influential on the subsequent field of French structuralism. Lacan's reflections on formalization will be shown, in contrast to Bachelard, to place an emphasis on the constitutive and limiting (...) role of language in its interaction with logical and scientific projects. In asking how Lacan's structural psychoanalysis extends and subverts the rationalist emphasis of French philosophy of science, I hope to provide a new optic through which to assess the role of formalization in critical theory today. Philosophy, which does not begin again, always unfolds against the background of the ongoing philosophical tradition, which it needs to interpret. I argue that Heidegger’s theories, like all philosophical theories, can neither be reduced to, nor separated from, the historical context. In that sense they are like all other philosophical views, perhaps in theory ahistorical but in practice historical, hence always bound up with and inseparable from their historical moment. If, as I believe, Heidegger’s theories led him in part toward (...) National Socialism, there is no alternative, if philosophy is to survive in a meaningful sense, to rejecting those aspects of his position, which must now be considered as simply and wholly dead, in favor of other aspects of Heidegger’s thinking that, if they are still living, can possibly be saved. The recent concern with hermeneutics, which stems above all from Truth and Method, should not be allowed to obscure the fact, to which Gadamer certainly is sensitive, that this topic has a long philosophical lineage, extending back into the tradition at least to Aristotle. In particular, it seems rarely to have been noticed that although their thought is notoriously difficult, the major members of the German idealist tradition provided not only the positions themselves, but a theory of their interpretation. The (...) latter point is important since, if evaluation is to be fair, positions must be measured against standards which are their own and not against extrinsic criteria. Yet for idealism this has rarely been done, in part because little attention has so far been directed to the idealist view of how theory is to be interpreted. Accordingly, my task in this paper will be twofold: to discuss the idealist theory of hermeneutics, and to test that theory in the interpretation of one of the major idealist positions. In consequence, the paper will come full circle, since the idealist theory of hermeneutics will be both expounded and put to the test provided by the hermeneutics of idealism. (shrink)

Ces conditions relèvent du marxisme, de Hegel, de l’économie politique, et du modèle marxien de la société industrialisée moderne.

Despite the attacks on metaphysics in the 20th century, the field remains surprising alive, not less robust, less interesting, nor ready to be consigned to the dustbin of history. The essays assembled in this volume, which come from all areas of the metaphysical tradition, are all by authors who are committed to the kind of metaphysics which Hume and later Kant recommended, although naturally they regard what good metaphysics is in very different ways. Aimed at specialists, as well as graduate students and select undergraduates, this study centers on Hegel's important, but neglected, theory of knowledge. Professor Rockmore interprets Hegel as reacting to the Kantian effort to reformulate epistemology in the wake of what Kant contends is the failure of earlier, dogmatic theories. Recent work has shown that Hegel's epistemology is a good deal more respectable than has usually been thought. Rockmore's aim is to continue that work in order to bring Hegel into the (...) main discussion of knowledge. Rockmore's main argument for the relevance of Hegel's theory to the problem of knowledge is that in the absence of foundationalism, Hegel's antifoundationalist theory of knowledge as perspectival and historical supplies two items helpful to advance the epitemological discussion.
