Slippery slopes crop up with startling frequency when controversial moral issues are debated. Generally, those who mount this line of argument appeal to some grim, highly undesirable state of affairs which would—they allege—inevitably ensue were society to sanction certain activities. Their reasoning is often fallacious, offering little more than an easy out for those reluctant to address problematic moral issues with the care and honesty they demand.

It is argued that utilitarianism should be reformulated as a scalar theory admitting of degrees of wrongdoing. It is also argued that the degree of wrongness of an action should be sensitive both to the relative valueloss the action results in and to the difficulty of having acted better. A version of utilitarianism meeting these specifications is forumalted.

Utilitarianism and prioritarianism make a strong assumption about the uniqueness of measures of how good things are for people, or for short, individual goodness measures. But it is far from obvious that the presupposition is correct. The usual response to this problem assumes that individual goodness measures are determined independently of our discourse about distributive theories. This article suggests reversing this response. What determines the set of individual goodness measures just is the body of platitudes we accept about distributive (...) theories. When prioritarianism is taken to have an ex ante form, this approach vindicates the utilitarian and prioritarian presupposition, and provides an answer to an argument due to Broome that for different reasons to do with measurement, prioritarianism is meaningless. According to Rawls, the principles of justice are principles that determine a fair resolution of conflicts of interest among persons in a society. “A set of principles is required for choosing among the various social arrangements which determine this division of advantages and for underwriting an agreement on the proper distributive shares” (p. 4). Different interpretations or conceptions of justice fill out this core concept; a theory of justice seeks a best conception. Justice takes priority over other normative claims—as Rawls (...) states, justice is the “first virtue of social institutions.” The principles of justice are principles to regulate what Rawls calls the “basic structure of society,” that is, the way in which the major social institutions distribute fundamental rights and duties and determine the division of advantages from social cooperation” (p. 6). Why focus on the basic structure? “The basic structure is the primary subject of justice because its effects are so profound and present from the start. The intuitive idea here is that this structure contains various social positions and that men born into different positions have different expectations of life determined, in part, by the political system as well as by economic and social circumstances. In this way the institutions of society favor certain starting places over others. These are especially deep inequalities. Not only are they pervasive, but they affect men’s initial chances in life; yet they cannot possibly be justified by an appeal to the notions of merit or desert. It is these inequalities, presumably inevitable in the basic structure of any society, to which the principles of social justice must in the first instance apply” (p. 7). (shrink)

Two essays on utilitarianism, written from opposite points of view, by J. J. C. Smart and Bernard Williams. In the first part of the book Professor Smart advocates a modern and sophisticated version of classical utilitarianism; he tries to formulate a consistent and persuasive elaboration of the doctrine that the rightness and wrongness of actions is determined solely by their consequences, and in particular their consequences for the sum total of human happiness. In Part II Bernard Williams offers (...) a sustained and vigorous critique of utilitarian assumptions, arguments and ideals. He finds inadequate the theory of action implied by utilitarianism, and he argues that utilitarianism fails to engage at a serious level with the real problems of moral and political philosophy, and fails to make sense of notions such as integrity, or even human happiness itself. Surveying the historical development and the present condition of utilitarian ethics, Geoffrey Scarre examines the major philosophers from Lao Tzu in the fifth century BC to Richard Hare in the twentieth. Utilitarianism traces the 'doctrine of utility' from the moralists of the ancient world, through the Enlightenment and Victorian utilitarianism up to the lively debate of the present day. Utilitarianism today faces challenges on several fronts: it cannot warrant the drawing of adequate protective boundaries around the essential (...) interests of individuals, and it does not allow them the space to pursue the personal concerns which give meaning to their lives. Geoffrey Scarre considers these and other charges, and concludes that whilst utilitarianism may not be a faultless moral doctrine, its positions are relevant, and significant today. Utilitarianism, the great reforming philosophy of the nineteenth century, has today acquired the reputation for being a crassly calculating, impersonal philosophy unfit to serve as a guide to moral conduct. Yet what may disqualify utilitarianism as a personal philosophy makes it an eminently suitable guide for public officials in the pursuit of their professional responsibilities. Robert E. Goodin, a philosopher with many books on political theory, public policy and applied ethics to his credit, defends utilitarianism against its (...) critics and shows how it can be applied most effectively over a wide range of public policies. The author identifies and defines the features of traditional utilitarian theories which account for their appeal, demonstrates that no theory which is exclusively act-oriented can have all the properties that ultilitarians have attempted to build into their theories, and develops a new theory co-operative utilitarianism.

There are no egalitarians in a pandemic. The scale of the challenge for health systems and public policy means that there is an ineluctable need to prioritize the needs of the many. It is impossible to treat all citizens equally, and a failure to carefully consider the consequences of actions could lead to massive preventable loss of life. In a pandemic there is a strong ethical need to consider how to do most good overall. Utilitarianism is an influential moral (...) theory that states that the right action is the action that is expected to produce the greatest good. It offers clear operationalizable principles. In this paper we provide a summary of how utilitarianism could inform two challenging questions that have been important in the early phase of the pandemic: (a) Triage: which patients should receive access to a ventilator if there is overwhelming demand outstripping supply? (b) Lockdown: how should countries decide when to implement stringent social restrictions, balancing preventing deaths from COVID‐19 with causing deaths and reductions in well‐being from other causes? Our aim is not to argue that utilitarianism is the only relevant ethical theory, or in favour of a purely utilitarian approach. However, clearly considering which options will do the most good overall will help societies identify and consider the necessary cost of other values. Societies may choose either to embrace or not to embrace the utilitarian course, but with a clear understanding of the values involved and the price they are willing to pay. (shrink)

We give two social aggregation theorems under conditions of risk, one for constant population cases, the other an extension to variable populations. Intra and interpersonal welfare comparisons are encoded in a single ‘individual preorder’. The theorems give axioms that uniquely determine a social preorder in terms of this individual preorder. The social preorders described by these theorems have features that may be considered characteristic of Harsanyi-style utilitarianism, such as indifference to ex ante and ex post equality. However, the theorems (...) are also consistent with the rejection of all of the expected utility axioms, completeness, continuity, and independence, at both the individual and social levels. In that sense, expected utility is inessential to Harsanyi-style utilitarianism. In fact, the variable population theorem imposes only a mild constraint on the individual preorder, while the constant population theorem imposes no constraint at all. We then derive further results under the assumption of our basic axioms. First, the individual preorder satisfies the main expected utility axiom of strong independence if and only if the social preorder has a vector-valued expected total utility representation, covering Harsanyi’s utilitarian theorem as a special case. Second, stronger utilitarian-friendly assumptions, like Pareto or strong separability, are essentially equivalent to strong independence. Third, if the individual preorder satisfies a ‘local expected utility’ condition popular in non-expected utility theory, then the social preorder has a ‘local expected total utility’ representation. Fourth, a wide range of non-expected utility theories nevertheless lead to social preorders of outcomes that have been seen as canonically egalitarian, such as rank-dependent social preorders. Although our aggregation theorems are stated under conditions of risk, they are valid in more general frameworks for representing uncertainty or ambiguity. (shrink)

This book is a rebuttal of the common charge that the moral doctrine of utilitarianism permits horrible acts, justifies unfair distribution of wealth and other social goods, and demands too much of moral agents. Bailey defends utilitarianism by applying central insights of game theory regarding feasible equilibria and evolutionary stability of norms to elaborate an account of institutions that real-world utilitarians would want to foster. The object of this article is to examine, with the work of Jeremy Bentham as the principal example, one strand in the complex pattern of European social theory during the second half of the eighteenth century. This was of course the period not only of the American and French revolutions, but of the culmination of the movements of thought constituting what we know as the Enlightenment. Like all great historical episodes, the Enlightenment was both the fulfilment of long-established processes and (...) the inauguration of new processes of which the fulfilment lay in the future. Thus the seminal ideas of seventeenth-century rationalism realized and perhaps exhausted their potentialities in the eighteenth-century Enlightenment. The ideas with which this article is concerned, however—conveniently grouped and labelled as the ideas of utilitarianism—only began to achieve systematic development in these later decades of the eighteenth century. Within that period—during the first half and more of Bentham's long life—attempts to apply those ideas to the solution of social problems met largely with failure and frustration. Yet unrealized potentialities remained, the realization of which was reserved for a time when the world of the philosophes no longer existed. The movements for social and political reform which have played so large a part in modern history since the French Revolution may be judged in widely differing ways; but whatever the verdict, these movements surely cannot be understood without due consideration of that part of their origins which lies in eighteenth-century utilitarianism. I think that utilitarianism is a good moral theory, and definitely better than its rivals, deontology and teleology. For practical purposes in multicultural contexts, at least, I think that no one should overlook a theory that is able to take into account a variety of ethical views and accommodate the ever-changing facts of the material world. But utilitarianism has a bad reputation in bioethics. It is often seen as the inhumane theory that allows the sacrifice of minorities, the (...) killing of the innocent, and simplistic calculations on the value of life. Hardly anyone cares to remember that most formulations of the theory do not allow these actions. The economic doctrine sometimes labeled as utilitarianism could be guilty as charged, but ethics and economy are not interchangeable words. Also as a theory that can actually propose answers to no-win situations, utilitarianism has been an easy target for criticism. (shrink)

Exploiting the apparent paradox that utility maximization will not be achieved by adopting the strategy of maximizing utility, Indirect Utilitarianism denies that the right decision which maximizes the probable good can always be identified by the direct application of the criterion of rightness. In this view, generally speaking, Utility is characterized as providing merely a standard of evaluation or an “esoteric” criterion of right conduct, and not a substantive decision procedure in practical situations. This characterization of utilitarianism as (...) an esoteric morality may have certain advantages for avoiding central objections to utilitarianism that arise when the Principle of Utility becomes a decision procedure which governs the moral deliberation of most people, i.e., when it becomes an “exoteric” morality. If a utilitarian takes seriously the “publicity condition” or being the “public moral basis of society” which Rawls has held to be a conceptual condition for a plausiblemoral theory, however, the indirect view of utilitarianism may not be seen as so attractive to the utilitarian. For the damage to utilitarianism as a whole inflicted by giving up on being a public moral basis of society, from a strategic point of view, may be greater than the protection the indirect view has hopefully promised. Utilitarianism is the view according to which the only basic requirement of morality is to maximize net aggregate welfare. This position has implications for the ethics of creating and rearing children. Most discussions of these implications focus either on the ethics of procreation and in particular on how many and whom it is right to create, or on whether utilitarianism permits the kind of partiality that child rearing requires. Despite its importance to creating and raising children, there are, (...) by contrast, few sustained discussions of the implications of utilitarian views of welfare for the matter of what makes a child’s life go well. This paper attempts to remedy this deficiency. It has four sections. Section one discusses the purpose of a theory of welfare and its adequacy conditions. Section two evaluates what prominent utilitarian theories of welfare imply about what makes a child’s life go well. Section three provides a sketch of a view about what is prudentially valuable for children. Section four sums things up. (shrink)

In Utilitarianism in the Early American Republic James E. Crimmins provides a fresh perspective on the history of antebellum American political thought. Based on a broad-ranging study of the dissemination and reception of utilitarian ideas in the areas of constitutional politics, law education, law reform, moral theory and political economy, Crimmins illustrates the complexities of the place of utilitarianism in the intellectual ferment of the times, in both its secular and religious forms, intersection with other doctrines, and practical (...) outcomes. The pragmatic character of American political thought revealed--culminating in the postbellum rise of Pragmatism--stands in marked contrast to the conventional interpretations of intellectual history in this period. Utilitarianism is more convincing than resource egalitarianism or welfare egalitarianism as a theory of how resources should be distributed between disabled people and nondisabled people. Unlike resource egalitarianism, utilitarianism can redistribute resources to the disabled when they would benefit more from those resources than nondisabled people. Unlike welfare egalitarianism, utilitarianism can halt redistribution when the disabled would no longer benefit more than the nondisabled from additional resources. -/- The author considers one objection to this view: it has (...) been argued, by Sen and others, that there are circumstances under which utilitarianism would unfairly distribute fewer resources to the physically disabled than to nondisabled people, on the ground that the disabled would derive less benefit from those resources. In response, the author claims that critics of utilitarianism have fallaciously exaggerated the circumstances under which the disabled would benefit less than the nondisabled from additional resources. In those limited circumstances in which the disabled really would benefit less from resources, the author argues, it does not seem unfair to distribute fewer resources to them. (shrink)

This volume presents a comprehensive statement in defense of the doctrine known as classical, hedonistic utilitarianism. It is presented as a viable alternative in the search for a moral theory and the claim is defended that we need such a theory. The book offers a distinctive approach and some quite controversial conclusions. Torbjorn Tannsjo challenges the assumption that hedonistic utilitarianism is at variance with common sense morality particularly as viewed through the perspective of the modern feminist moral critique.
