The science of wakf-ibtidâ, whose practical reflections we observe from the Prophet himself, draws attention as an important subject that the companions also referred to, within the framework of the interpretation of the word "tertîl" in the verses where Allah orders the Qur'an to be read with tertîl. In the following period, this science, which was considered among the sub-disciplines of the science of recitation, both in the Qur'anic recitation-themed works and in the interpretations of commentators, was included in chapter, (...) section or special parts. Because wakf and ibtidâ are extremely important for the interpretation of the Quran as well as for the science of recitation. Namely, "wakf", which means stopping reading and breathing at a place where the meaning is complete, and "ibtidâ", which means continuing to read from a place that is suitable for the integrity of the meaning, is an indispensable discipline due to its direct relevance in the correct manifestation of the meaning of the Quran. In addition, wakf-ibtidâ, which performs an undeniable function in regulating the recitation of the reader, stands out as a science that scholars cannot remain independent of in this respect. One of the scholars in question is Mekkî b. Ebî Talib (d. 437/1045). He is a scholar of recitation who has guided the literature with his writings throughout the historical process of the science of recitation and is among the most distinguished names in the field, and has also influenced the subsequent literature with his attitude towards the basic issues of this science. Based on this reality, in this study, Mekki's approach to the science of vakf-ibtidâ will be examined specifically in his commentary named al-Hidaye ila bülüği'n-nihâye. In this context, first of all, a brief definition of the concept will be made, and the method of scholars' compilation of the mentioned science and the resulting classifications will be touched upon. Then, Mekki's classification logic in this discipline, the original concepts he used in this regard, and the words he subjected to special criticism will be discussed. ÖZ Geçmişi insanlık tarihi kadar eski olan iyilik yapma ve sevap kazanma duygusundan doğan vakıf, İslam ile birlikte hukuksal bir zemin kazanarak ebedi bir müessese haline gelmiştir. Sosyo-kültürel ve dini hizmetleri üstlenen vakıf ya da vakfa benzer fiiller yalnızca Müslümanlar arasında değil diğer dinlere mensup insanlar arasında da yaygın şekilde görülmekteydi. Örneğin Hint devletlerinde kralların din adamı olan Brahmanlara köyler hediye ettiği görülmektedir. Brahmanlar bu köylerin mülküne sahip olmamakta, köylüler tarafından işlenen toprakların gelirini almakta ve böylece varidat sahibi olmaktaydılar. Dârülislâm’da (...) gerek Müslüman gerekse de gayrimüslim tebaa tarafından kurulan vakıflar şerʻî hukuka bağlı olarak faaliyet göstermekteydi. Osmanlı Devleti’nin üç yüz yedi yıl hüküm sürdüğü Kıbrıs Adası’nda da aynı şerʻî hükümler bağlamında çok sayıda vakfın kurulduğu görülmektedir. Osmanlı Dönemi Kıbrıs vakıfları üzerine birçok çalışma yapılmasına rağmen bunlardan yalnızca biri gayrimüslim vakıflarını konu edinmektedir. Söz konusu çalışmada ise yalnızca yedi şahıs vakfı ele alınmakta ancak kiliselere ait fetih öncesi ve sonrası vakıflarına değinilmemektedir. Bu çalışmada işaret edilen söz konusu eksiklik üzerinde durulacaktır. Genel olarak KKTC Girne Milli Arşiv ve Araştırma Dairesinde bulunan Kıbrıs Şerʻiyye Sicilleri kaynak olarak alınmakla birlikte, Osmanlı Arşivi ve Vakıflar Genel Müdürlüğü Arşivinden tespit edilen belgeler analiz edilecektir. Öncelikle gayrimüslim ve zimmî kavramları açıklanarak Kıbrıs’ta bu kategoriye giren şahıslar ve bunların hukuki haklarına değinilip İslam hukukunda gayrimüslimlerin vakıf kurma hakları üzerinde durulacaktır. Diğer bir başlık altında iki tablo halinde verilen biri iptal edilmiş on bir şahıs vakfı ile farklı cemaatlere ait yirmi bir kilise ve manastır vakfı ayrıntılı olarak incelenecektir. (shrink)

Muhyiddîn el-Kâfiyecî (öl. 879/1474), on beşinci yüzyıl Saruhanoğulları, Osmanlı ve Memlüklü alimlerindendir. Yüzden çok eser yazmıştır. Makale Kâfiyeci’nin hayatı ve eserlerini araştırır. Yazdığı eserler, onun, Arap dili, Arap grameri, belagat, tarih metodolojisi, hadis ve usulü, tefsir ve usulü, fıkıh ve usulü, kelâm, tasavvuf, dil felsefesi, semantik, metafizik meseleler, geometri, optik ve astronomi gibi konularda uzmanlaştığını göstermektedir. Kâfiyeci en önemli eserlerini Arap dili ve mantık sahalarında yazmıştır. Eserleri içerisinde yaptığı linguistik çözümlemeler, onun yetkin bir dil alimi olduğunu göstermektedir. Kâfiyeci eserlerini yazarken (...) linguistik, mantıki, ilmi ve felsefi bir yöntem kullanmıştır. Araştırmada, Kâfiyeci’nin, hayatı boyunca en az yüz on iki eser yazdığı tespit edilmiştir. Ülkemizde 6 Şubat 2023 tarihinde 11 il ve ilçelerini kapsayan büyük bir deprem yaşanmıştır. Bu depremde bütün kamu kurumları ve Sivil Toplum Kuruluşları (STK) bölgeye destek olmak için seferber olmuştur. Bazı kamu kurum ve kuruluşları enkaz kaldırma, yaralılara tıbbi müdahale, çadır temini, kurulması, iaşe ve ibate vb. ihtiyaçların karşılanması için görev yaparken, bazıları da yaşanan depremin travmatik etkilerini azaltmaya yönelik manevi destek hizmetleri yürütmüşlerdir. Bir kamu kurumu olan Diyanet İşleri Başkanlığı’na (DİB) bağlı İl ve İlçe Müftülükleri personeli, merkez teşkilatı ve (...) Diyanet Vakfı çalışanları da sahada görev yapmıştır. DİB personelinin deprem bölgesinde manevi danışman olarak hizmet vermesi, o tarihlerde, bazı kesimler tarafından eleştirilmiştir. DİB personelinin alanda yaptıklarının incelenmesi bu çalışmanın konusunudur. Çalışmanın amacı manevi danışman olarak hizmet veren DİB personelinin alanda neler yaptıklarını detaylarıyla belirlemek ve yapılanların manevi danışmanlık mesleğinin ilkelerine uygunluğunu literatür esas alınarak değerlendirmektir. Araştırma nitel araştırma desenlerinden, durum çalışmasıyla (Case Study) yapılmıştır. Araştırmanın çalışma grubunu Kırşehir il ve ilçe müftülüklerinde çalışan din görevlileri oluşturmaktadır. Bu çalışma grubunun seçiminde amaçlı örneklem yöntemi kullanılarak ölçüt örneklem tekniği ile veri toplanmıştır. Burada tercih edilen ölçüt, Kırşehir İl ve İlçe Müftülüklerinde görev yapmak ve depremde manevi danışman olarak, alanda çalışmış olmak şeklinde belirlenmiştir. Katılımcılarla yarı yapılandırılmış görüşmeler yoluyla sorulan sorulardan elde edilen verilere, betimsel analiz uygulanmıştır. Mülakat soruları araştırma amacına uygun olarak ve literatür taraması esas alınarak araştırmacı tarafından oluşturulmuştur. Bu araştırma sonucunda elde edilen bulgular, DİB tarafından manevi danışmanlara düzenlenecek eğitim programlarının düzenlenmesinde veri oluşturması yönüyle önemlidir. Araştırma sonunda bulgular şöyle sınıflandırılmıştır: Psikolojik/manevi danışmanlık: Ziyaretlerde depremzedelerin ellerinin tutulması, kucaklama, duygusal refakat, çocukların başlarının okşanması vs. yakınlık hissi verilerek depremzedelerin rahatça konuşmalarına imkân oluşturmuşlardır. Bölgenin yapısından dolayı mezhepsel ayırım yapmadan bütün köylere gidip “Siz bizim kardeşimizsiniz, sizin için geldik, yalnız değilsiniz, acınızı paylaşıyoruz, geçmiş olsun” ifadeleri ile duygudaşlık hissi verilmiş ve yardım götürülmüştür. Dinî/manevi danışmanlık: Cenaze yıkamak, kefenlemek, cenaze namazı kıldırmak, çadır mescidinde vakit ve Cuma namazı kıldırmak, Kur’an okumak, dua ve sohbet etmek gibi faaliyetler yapılmıştır. Depremzedelerin yaşadıkları evler, çadır kentler, konteynerler ve köyler düzenli ziyaret edilerek hal ve hatırlarının sorulup, vatandaşın isteği üzerine dini törenler yapılmıştır. Destek hizmeti: Özellikle ilk giden görevliler yemek/su dağıtma, çadır kurma ve AFAD çalışmalarında kurtarma işlemine katılmışlardır. Diğer hizmetler: Depremzede esnafın kalkınması ve ekonomik destek için, esnaftan alış-veriş yapmışlar, nişanlı kızlara çeyiz ve üniversite öğrencilerine kitap yardımında bulunmuşlardır. (shrink)

Gayretimin bir kısmı bilim dünyasına hizmet, ama diğer çok mühim bir gayesi ise; koskoca bir İslam aleminin yitirmiş olduğu kendine hürmeti, güveni ve insanlık tarihindeki yerini hatırlatmak, kaybettiklerini inşa etmek içindir. Prof. Dr. Fuat Sezgin Prof. Dr. Fuat Sezgin anısına ithaf ettiğimiz Felsefe ve Din Bilimleri Özel Sayımıza hoşgeldiniz. Prof. Dr. Fuat Sezgin, 24 Ekim 1924 tarihinde Bitlis’te dünyaya gelen Fuat Sezgin, il-kokulu Doğubayazıt’ta, ortaokul ve liseyi ise Erzurum’da bitirdikten sonra 1943 yılında İstanbul’a geldi. İstanbul Üniversitesi şarkiyat (Doğu bilimi) Araştırmaları (...) Enstitüsü’nde ünlü Alman şarkiyatçı Prof. Dr. Hellmut Ritter’in (1892-1971) öğrencisi olan Sezgin, Ritter’in tavsiyesi üzerine İslâm bilimlerine yöneldi. 1951’de İstanbul Üniversitesi Edebiyat Fakülte-si’den mezun olduktan sonra Arap Dili ve Edebiyatı alanında “Buhârî’nin Kaynakları Hakkın-da Araştırmalar” başlıklı teziyle doktorasını tamamladı. Bu çalışmasıyla, hadis kaynağı olarak İslâm kültüründe önemli bir yere sahip olan Buhârî’nin sözlü kaynaklar yerine yazılı kaynaklara dayandığı tezini ortaya attı. Doçent unvanını 1954 yılında alan Sezgin, 1960 askeri darbesinin ardından üniversi-telerden uzaklaştırılan 147 akademisyen arasında kendi adının da bulunması üzerine 1961’de Türkiye’den ayrıldı ve çalışmalarına Goethe Üniversitesi’nde (Frankfurt) devam etti. Câbir bin Hayyân hakkında hazırladığı ikinci tezini 1965’te Goethe Üniversitesi Doğa Bilimleri tarihi Enstitüsü’ne sunan ve bir yıl sonra profesörlüğe yükseltilen Sezgin, aynı yıl kendisi gibi şarkiyatçı olan Ursula Sezgin ile Evlendi. Alanında şimdiye kadar yazılan en kapsamlı eser kabul edilen Geshichte des arabisc-hen Schrifttums (Arapça Yazma Eserler Literatürü Tarihi) başlıklı kapsamlı eserinin ilk cildini 1967’de yayımlayan Sezgin, 1978’de Kral Faysal İslâmi İlimler Ödülü’ne lâyık görüldü. Bu ödül nedeniyle kendisine takdim edilen maddi desteği değerlendirerek 1982’de Goethe Üniversitesi Arap-İslâm Bilimleri Tarihi Enstitrüsü’nü, ertesi yıl ise bu enstitü bünyesinde, tarih boyunca Müslüman bilim insanlarının icat ettiği 800’den fazla bilimsel alet ve düzene-ğinin modellerinin sergilendiği İslam Bilim ve teknoloji Müzesi’ni kurdu. Bu müzenin bir benzerini 2008 yılında istanbul’da kuran Sezgin, 2010 yılında Prof. Dr. Fuat Sezgin İslam Bilim Tarihi Araştırmaları Vakfı’nın kuruluşuna öncülük etti. Kahire Arap Dili Akademisi, Şam Arap Dili Akademisi, Fas Rabat Kraliyet Akademisi, Bağdat Arap Dili Akademisi, Türkiye Bilimler Akademisi şeref üyeliği de dâhil olmak üzere çok sayıda ödül ve nişana layık görülen Sezgin’e; Erciyes Üniversitesi, Atatürk Üniversitesi, Süleyman Demirel Üniversitesi ve İstanbul Üniversitesi tarafından fahri doktora unvanları verildi. Frankfurt am Main Goethe Plaketi, Almanya Üstün Hizmet Madalyası, İran İslâmi Bilimler Kitap Ödülü ve Cumhurbaşkanlığı Kültür ve Sanat Büyük Ödülü ile taltif edildi. Prof. Sezgin’in öncülüğünde kurulan İstanbul İslâm Bilim ve teknoloji tarihi Müzesi, Kültür ve Turizm bakanlığı 2016 özel Ödülü’ne lâyık görüldü. Arapça, Süryanice, İbranice, Latince ve Almanca başta olmak üzere 27 dil bilen Prof. Dr. Fuat Sezgin, 30 Haziran 2018’de İstanbul’da vefat etti ve Gülhane Parkı’ndaki İstanbul İslâm Bilim ve teknoloji tarihi Müzesi’nin bahçesine defnedildi. Vefatının ardından, 2018/6 sayılı Cumhurbaşkanlığı genelgesi ile 2019 yılı “Prof. Dr. Fuat Sezgin Yılı” olarak ilân edildi. Cumhurbaşkanlığı genelgesinde "İslam kültür ve medeniyetinin daha iyi anlaşılmasını sağlamak ve onu yeni nesillere en doğru şekilde aktarmak amacıyla yapılacak söz konusu çalışmalara ilgili tüm kamu kurum ve kuruluşlarınca her türlü destek ve katkının sağlanması hususunda gereğini rica ederim." İfadelerine yer verilerek Fuat Sezgin’in ülke sathında anlatılması ve düşüncelerinin anlaşılması için çeşitli faaliyetlerin yürütülmesi istenmişti. Koordinasyon Merkezi olarak da Kırıkkale Üniversitesi seçildi Dünyanın önde gelen bilim tarihçilerinden olan, İslam Bilim Tarihi alanındaki çalışmaları bulunan Prof. Dr. Fuat Sezgin’i gelecek nesillere tanıtmak, fikirlerini anlatmak amacıyla Sivas Cumhuriyet Üniversitesi tarafından da birçok faaliyet yapıldı. Dünyanın önde gelen bilim tarihçilerinden Prof. Dr. Fuat Sezgin’e, İslam Bilim Tarihi alanındaki çalışmalarından dolayı Üniversitemiz tarafından “Fahri Bilim Doktoru” unvanı verildi. Prof. Dr. Sezgin’e fahri bilim doktoru unvanı verilmesi dolayısıyla Üniversitemiz Kül-tür Merkezi’nde düzenlenen tören İstiklal Marşımızın okunması ve saygı duruşuyla başladı. Programa Rektörümüz Prof. Dr. Alim Yıldız, Sivas Belediye Başkan Yardımcısı Ah-met Özaydın, Fatih Sultan Mehmet Üniversitesi Rektörü Prof. Dr. Musa Uzun, öğretim elemanları ve öğrenciler katıldı. Rektörümüz Prof. Dr. Alim Yıldız yaptığı açış konuşmasında, "İnsanlara İslam bilimlerinin gerçeğini tanıtmak, benlik duygularını olumsuz etkileyen yanlış yargılardan onları kurtarmak ve ferdin ehemmiyetine olan inancı kazandırmak amacıyla İslam Bilimi Tarihi araştırmalarına adanmış bir ömürdür Prof. Dr. Fuat Sezgin Hocamız. Öyle büyük bir otoritedir ki onu anmadan, onun hazırladığı eserlere bakmadan, bilim tarihiyle, İslam tarihiyle ilgili ortaya bir şeyler sunabilmek çok zordur. Bilim tarihinin en çalışkan, en birikimli bilim insanlarından biridir. İslam tarihine, İslam düşüncesine, İslami eserlere ve bilim dünyasına vermiş olduğu katkılarıyla bir medeniyet kâşifi, eşi bulunmaz bir değer ve ‘darbeler neden kötüdür’ sorusunun mücessem cevabıdır Prof. Dr. Sezgin. Bizim medeniyet ve kültürümüzde kültür, sanat ve beşerin, Yaratıcının her eserinde müşahede ettiği güzellikleri, çeşitli yol ve yöntemlerle ortaya koymasının vasıtasıdır. Bilgiyi hikmetle taçlandırıp irfana ulaştırmadıkça hiçbir şeyi yerli yerine oturtamayız." dedi. Konuşmanın ardından Rektör Yıldız, 93 yaşındaki Prof. Dr. Fuat Sezgin’e cübbe giydirdi. Daha sonra Sezgin katılımcılara ‘Arap İslam Tarihinden Bazı İzlenimler’ konulu ders verdi. Prof. Dr. Fuat Sezgin, “İnsanların bilgi tarihi ile ilgili verileri yazılı olarak kaydetme gayreti, politik tarihe olana nispetle tesadüflere ve keyfi değerlendirmelere göre çok geri zamanlarda oldu. İslam bilim tarihi yüksek ve kaliteli görüşleri yansıtır. Bunları burada sunamayacağım. Birçoğunu Arap-İslam tarihi adlı kitabımın bugüne kadar çıkmış olan 17. cildinde kaydetmeye çalıştım. Onu İstanbul’da Gülhane Parkı’nda İslam Tarihi Araştırmaları Vakfı yayınları arasında bulabilirsiniz.” dedi. Prof. Dr. Sezgin “Bilimler tarihinin verilerini değerlendirmekte, yaşanılan zamanın etüt şartını gözden kaçırılmasının esas olması gerektiğini anladım ve henüz kitabımı yazma-ya başlamadan rastladığım Fransız Coğrafya tarihçisi Joseph Toussaint Renaud (1795-1867)’un şu sözleri beni çok etkilemişti. “Tesadüf teknik ve sanatın ilerlemesinde çok büyük bir rol oynamaz. İnsanlar buluşlarında devamlı bir şekilde birden bir sıçrayışla değil, adım adım hareket eder. Her zaman aynı hızda değil, fakat devamlı olarak insan icat etmez. Olanı ilerletir.” ifadelerine yer verdi. Konuşmasının sonunda Prof. Dr. Sezgin, “Benim 65 yıldır yaymaya çalıştığım Arap İslam bilimleri tarihi hemen hemen her gün beni hayata bağladı. İslam dünyasında büyük bir hızla ilerleyen bilimler MS. 8. yüzyıldan itibaren Fransa ve İngiltere’ye diğer taraftan 10 ve 11. yüzyıldan itibaren Sicilya’ya ve İtalya’ya 9. yüzyıldan itibaren Bizans’a ulaştılar. Avrupa-lılar teknik bilimleri diğer bilimlere nazaran daha kolay anlıyor ve alabiliyorlardı. Bu anlam-da onlar 16. yüzyılda bazı yönlerde Müslümanlara ulaşmaya hatta onları geçmeye başladılar.” ifadelerini kullandı. Programın sonunda Rektörümüz ve Fatih Sultan Mehmet Üniversitesi Rektörü Prof. Dr. Musa Duman, Prof. Dr. Fuat Sezgin’e tezhipli bir tablo hediye ettiler. 2019 Prof. Dr. Fuat Sezgin Yılı kapsamında Sivas Cumhuriyet Üniversitesi Merkezî Kütüphanesi’ne Prof. Dr. Fuat Sezgin’in ismi verildi. Ayrıca Üniversitemiz Rektörlüğü tarafından düzenlenen 5’inci Hazan Şiir Dinletisi Sezgin anısına ithaf edilmiştir. 2019 yılının Haziran ayı içerisinde ise Üniversitemiz Rektörlüğü öncülüğünde ve İlahiyat Fakültesi Dekanlığınca ile Sivas Merkez Ulu Cami’de merhum Prof. Dr. Sezgin için Kur’an-ı Kerim tilaveti ve Mevlid-i Şerif programı gerçekleştirilmiştir. Son olarak üniversitemiz rektörlüğü tarafından desteklenen ve Sivas Cumhuriyet Üniversitesi İlahiyat Fakültesi tarafından yayımlanan Cumhuriyet İlahiyat Dergisi’nin 23. Cilt 3. Qurʾān was revealed to the Prophet Muḥammad (pbuh) not as a written document, but by word of mouth over a period of approximately 23 years. He dictated the verses to the scribes of revelation. After this, Abū Bakr compiled the written verses; i.e. gathered between two covers. Thus when the Qurʾān was compiled as a text, a number of addresses lost their characteristics. This situation, which is a result of the shortcomings in inscription, suggested the necessity of separating the verses, (...) preserving the recitation method (waqf places) learned from Prophet and transmitting the Qurʾān towards new learners. As a result, the science of al-Waqf and al-Ibtidāʾ has emerged. The systematics of al-Sajāwandī was chosen among the people who systematized the waqfs marks and the mushafs that we have today are arranged according to the systematics of al-Sajāwandī. At this point, the issue of showing other addressing features of the Qurʾān, such as the emphasis, in text appeared as an area that to be considered. The aim of this study is to analyze this issue and to focus on the possibility and method of realizing the subject. If punctuation marks are to be added to the Qurʾānic text, this should be done by taking into account the characteristics of punctuation marks in Arabic. According to comparison between punctuation and wakf marks, it was seen that they have different characteristics. First difference is the systematic difference. Punctuation marks in modern Arabic script are divided into four groups: end marks, tone marks, quotation marks, and the signs used in mathematics. However, al-sajawānds consists of only end/stop marks. In this case, al-sajawānds do not function as punctuation marks indicating tone of voice/emphasis and quotations. The second difference is that punctuation marks are more about the meaning than waqf marks. Because waqf marks do not oblige reader to understand only one of the possible meanings. However, punctuation marks limit or even determine the meanings. In addition, waqf marks are also based on the recitation(s) of the Prophet/al-qirāʾat al-manqulah. Correct comprehension depends on correct reading. For correct reading, addressable features must be able to be incorporated into the text as much as possible. Today’s muṣḥaf, cannot show emotions, emphasis to the reader. Beside, each of the characteristics of waqf marks (al-waqf al-muʿānaqah ext.) cannot meet the end marks found in today’s punctuation marks. In this case, we can add emphasis marks to text in order to reflect the emphasis that are missing from them by keeping al-sajāwands. Likewise, the question of to where/whom the word belongs to, which may cause confusion in text, can be resolved with quotation marks. Hereby, it has been concluded that a pseudonym system that can reflect the emphasis features of the Qurʾān and show quotations, should be developed in addition to al-sajāwands. So, our proposal includes the following steps: keeping al-sajāwands existing in the muṣḥaf; placing the emphasis marks in today's punctuation marks, which will serve this function in places where the emphasis and tone of prayer’s voice cannot be reflected in writing; putting quotation marks. Thus, it will be possible to develop a system that can show the linguistic, grammatical, semantic, phonetic, emotional and reciprocity dimensions of address in the writing/text. In this context, the punctuation marks that we find useful to be added to the muṣḥaf are emphasis marks (:!؟) and some quotation marks («»: -). قَالَ فَمَنْ رَبُّكُمَا يَا مُوسٰى؟ قَالَ رَبُّنَا الَّذ۪ٓي اَعْطٰى كُلَّ شَيْءٍ خَلْقَهُ ثُمَّ هَدٰى. Tāhā 20/49-50 As an example, in this verse, there is a real question that is expected to be answered. Then a question mark can be put at the end of this sentence. In addition, a dot mark can be placed at the end of the answer sentence to indicate that the answer is concluded. (shrink)

The foundation (waqf), which is a charity institution that was able to find an application area since the emergence of Islam, has developed over time in Islamic societies and has become a common institution. In the Ottoman Empire, these institutions had incorporated different services into its structure. This expansion has also led to the establishment of many different types and purposes of foundations such as charities; family, animal care, hospice, foodbank and educational institutions and mosques. Types of foundations in which (...) the incomes of the foundation were shared in different ways were also developed in this period. Family foundations are one of the types of foundations established for the purpose to share of income. Family foundations, which are characterized by many different names such as “zürri” (familial), “ehli” (domestic) and “evlatlık” (filial), have been criticized legally for various reasons in the last period of the Ottoman Empire and the Republic period, and their legitimacy has been questioned. This questioning of legitimacy, which started especially with orientalist studies, was also written among Turkish historians and lawyers, and attempts were made to base the claims that family foundations are illegitimate. In time, these criticisms came out of the family foundations and became legally questioning the entire Islamic foundation system. Investigating the justification of these criticisms, which have been popular since the end of the 19th century, is of particular importance for the development of today's foundation system. Because as a result of these criticisms, the foundations, which are one of the most effective institutions that provide social cohesion and that Islam has created and developed, have lost their importance over time and there has been a noticeable decrease in established foundations. Previously established foundations were somehow transferred to individual ownership on legal grounds. Based on these reasons, the study aims to determine the truth of these claims and to offer a critical approach to the debates on the legitimacy of family foundations in Islamic law, thus revealing the legal basis of the foundation system in Islam. In terms of nature, family foundations are a type of foundation for the purpose of the foundation. Although its name is described as family, it indicates a foundation that is broader than the concept of family. In this sense, it refers to foundations established first for private individuals and then for one of the general charity classes. Specially designated persons do not have to be among family members. It is referred to by this name as these foundations are mostly established for family members. When the evidence regarding the legitimacy of these foundations is examined, examples from the practices of the Prophet himself can be seen, as well as general verses from the Qur'an that will be included in the scope of these foundations. On the other hand, there are examples of family waqfs in foundations established by almost all of the Companions. The legitimacy of family foundations is challenged within the framework of four main reasons such as violation of the provisions of legacy, avoiding to be confiscated, preventing the fragmentation of property by the heirs and causing the feudal system and it is claimed to be illegitimate. However, the fact that these foundations have existed in Islamic societies since the golden age, including the Ottoman Empire raises a question about the authenticity of the criticisms. When examining the details of the criticisms, it can be easily seen that there is no question of legitimacy in the real sense, only a misinterpretation arising from misunderstanding. As a result, it will be seen that it is not possible to say that the practices of Muslims throughout history are illegitimate. Family waqfs have taken place in history as an institution that does not contradict the general provisions of Islam, on the contrary, by increasing Islamic foundation culture and social solidarity. It is extremely important for these foundations to find a field of application in social and economic terms now. (shrink)

Every word of the Qur'an ensures the understanding of the divine will. The foundation signs in it were created for this purpose. Just like the punctuation marks that ensure the correct understanding of a Turkish sentence, the foundation marks in the Qur'an have assumed the same function. The signs of foundation, which give the opportunity to breathe by interrupting the recitation at the places where the mana is completed, and the signs of ibtida, which provides the recitation starting from the (...) appropriate place for the integrity of the meaning, have a significant importance in the authentic interpretation of the Qur'an. The scholar, who wrote very important works related to the field and brought an independent topic under the name of "Secâvend" to the science of recitation, undoubtedly Muhammad b. Tayfur es-Secavendi. According to him, it is considered obligatory to dwell on the foundation denoted by the remzi (م) in the mushafs. Because when vasl is performed in these places, the nature and meaning of the verse changes. Based on these reasons, a foundation is different from other types of foundations. In this study, the signs of the need for foundation were examined within the framework of the verse integrity, and it was analyzed why Secavendi considered it necessary to make a foundation, taking into account the possible meanings that may occur in the case of vasl. Undertaking a crucial role in transferring the Qur’an and Sunnah after the prophet, companions of him became the basic gateways to be referred to in apprehending the nuṣūṣ for future generations after them. While the companions spent their scientific skills on understanding the nuṣūṣ with the methods they used, in general, they used the Qur’an, Sunnah and Arabic poetry in this sense. The fact that companions spread to different places in the world through conquests resulted in the transfer of sciences (...) such as tafsīr, fiqh, qirāʾah, etc. to these places. These transfers later facilitated the formation and expansion of scientific circles, hastening the establishment of scientific schools in various locations and initiating the process of formal education; moreover, independent figures began to come to the fore in the mentioned sciences. As a result of this, in the sciences such as qirāʾah etc. a process of independence was initiated. Later, the rules of qirāʾah science were transferred in the books instead of oral narration. So much so that the importance of waqf and Ibtidā can be understood from the fact that they are the fields where works are constantly written. Although they did not mention some of the defining concepts and expressions used in today's fields such as waqf, Ibtidā, etc., the companions of the prophet used them in practice. In addition, they implemented the concepts that would be named later in the theoretical sense in waqf and Ibtidā of the Qur’an. This made a significant contribution to the formation of the rules, which would be developed later. Our main goal in this study, where the companions and different qurrāʾs recitations are basically studied, is not an attempt to determine the initial adventure of waqf and Ibtidā, which have important functions, but to see the effects that this science reveals in the fields such as fiqh, tafsīr, qirāʾah and rhetoric. Here, without spreading the issue too much, and by limiting the topics discussed, the effects of waqf and Ibtidā were tried to be revealed within the framework of Mu'tazilah, Kharijiyyah, Jahmiyyah, Shiʿah, Haruriyyah and Ahl al-Sunnah. On the other hand, it was put forth that waqf and Ibtidā, are as important for recitations as they are for reading the Qur’an properly, presenting its interpretation in an authentic way, preserving the language structure and determining the provisions firmly. In addition, in this study, the relationship of waqf and Ibtidā, with the related sciences was metioned under the determined headings. However, it is useful to state that the subjects related to this science should be addressed independently in different studies. Within this context, the importance and subtleties of the science of waqf and Ibtidā, were reflected by determining the approaches of the sects and giving examples of reference verses that would shed light on the subject by opening subheadings.
