Adopting a broadly compatibilist approach, this volume's authors argue that the behavioral and mind sciences do not threaten the moral foundations of legal responsibility. Rather, these sciences provide fresh insight into human agency and updated criteria as well as powerful diagnostic and intervention tools for assessing and altering minds.

We reflect on the nature of corporate codes of conduct is this article. Based on John Austin’s speech act theory, four characteristics of a performative concept of corporate codes will be introduced: 1) the existential self-performative of the firm identity, 2) which is demanded by and responsive to their stakeholders; 3) Because corporate codes are structurally threatened by the possibility of failure, 4) embracing the code not only consists in actual corporate responsible behaviour in light of the code, but in (...) the incessant recapturing of the code in the struggle of firms against the possible incongruence between their ethical principles and their actual responsible behaviour. A performative concept of corporate codes helps to bridge classical dichotomies like individualist versus collectivist approaches of moral agency and restrictive versus empowering ethics, and opens a new perspective on the interaction between individual ethical behaviour and the corporate institutionalisation of codes. Positive Polarity indefinites, such as some in English, are licensed in simplex negative sentences as long as they take wide scope over negation. When it surfaces under a clausemate negation, some can in principle take wide scope either by movement or by some semantic mechanism; e.g., it can take pseudoscope if it is interpreted as a choice function variable. Therefore, there is some uncertainty regarding the way in which PPI indefinites get licensed: can pseudoscope suffice? In this article we show, (...) using novel data from Hindi-Urdu and English, that pseudoscope is not sufficient, and that it is the syntactic position of PPI indefinites at LF, rather than their actual scope, which is relevant for licensing. These facts support a unified view of PPI indefinites as generalized quantifiers, and disfavor analyses where they are, or can be, interpreted as choice function variables. (shrink)

In Charles S. Peirce: On Norms and Ideals, Potter argues that Peirce's doctrine of the normative sciences is essential to his pragmatism. No part of Peirce's philosophy is bolder than his attempt to establish esthetics, ethics, and logic as the three normative sciences and to argue for the priority of esthetics among the trio. Logic, Potter cites, is normative because it governs thought and aims at truth; ethics is normative because it analyzes the ends to which thought should be directed; (...) esthetics is normative and fundamental because it considers what it means to be an end or something good in itself. This study shows that Peirce took seriously the trinity of normative sciences and demonstrates that these categories apply both to the conduct of man and to the workings of the cosmos. (shrink)

"This book provides new interpretations of Heidegger's philosophical method in light of 20th-century postmodernism and 21st-century speculative realism. In doing so, it raises important questions about philosophical method in the age of global warming and climate change. Vincent Blok addresses topics that have yet to be extensively discussed in Heidegger scholarship, including Heidegger's method of questioning, the religious character of Heidegger's philosophical method and Heidegger's conceptualization of philosophical method as explorative confrontation. Synthetic biology, materials chemistry and soft robotics are fast becoming leading disciplines within the field of practices which look to nature for inspiration and opportunities. In this article I discuss how these molecular-scale practices fit within the existing trends of bio-informed design defined at the macro level, that is, bionics, biomimetics and more specifically biomimicry. Based on the metaphysical views underlying bio-informed design practices, I argue that none of them currently fit the biomimicry model, as they are not consistently concerned (...) with environmental sustainability. While biomimetic chemistry loosely belongs to the field of biomimetics, and soft robotics to the field of bionics, both practices have a profound impact on their respective fields, as they question the places of nature and engineers. Despite the multidisciplinary dimension of the kinds of research conducted under the umbrella of synthetic biology, the US-based founders of this new research area adopted a disciplinary profile to shape its institutional identity. In so doing they took inspiration from two already established fields with very different disciplinary patterns. The analogy with synthetic chemistry suggested by the term ‘synthetic biology’ is not the only model. Information technology is clearly another source of inspiration. The purpose of the paper, with its focus (...) on the US context, is to emphasize the diversity of views and agendas coexisting under the disciplinary label synthetic biology, as the two models analysed are only presented as two extreme postures in the community. Epistemic logic begins with the recognition that our everyday talk about knowing and believing has some systematic features that we can track and re‡ect upon. Epistemic logicians have studied and extended these glints of systematic structure in fascinating and important ways since the early 1960s. However, for one reason or another, mainstream epistemologists have shown little interest. It is striking to contrast the marginal role of epistemic logic in contemporary epistemology with the centrality of modal logic for metaphysicians. This article (...) is intended to help in correcting this oversight by presenting some important developments in epistemic logic and suggesting ways to understand their applicability to traditional epistemological problems. Obviously, by itself, tweaking the formal apparatus of epistemic logic does not solve traditional epistemological problems. Epistemic logic can help us to navigate through problems in a systematic fashion by unpacking the logic of the problematic concepts, it can also lead us to recognize problems that we had not anticipated. This is basically analogous to the role that modal logic has played in contemporary metaphysics. (shrink)

This study develops a genetic phenomenological sociology of space from the phenomenology and phenomenological sociology of space. Based on relational ontology, it argues that social space is a social relationship in genesis. An Apple walk-in store and an Apple online store are examples to illustrate the essence of social space. Any Apple store as a social space represents a set of social relations. The genetic phenomenological sociology of space in both store types includes two parts: first, the social ontology of (...) space, that is, ‘being-in-the-Apple-store’ or ‘being-in-the-Apple-online-store’; and second, the social epistemology of space, that is, the act of ‘encountering’ in either store. Examining the existence of space ontologically and the mode of existence epistemologically clarifies that the actual ‘meaning’ of social space, an Apple store or an Apple online store in this study, emerges through the act of encountering. Three characteristics of encountering are placelessness, ‘de-distancing,’ and mediation. (shrink)

Der Aufsatz diskutiert die Tragfähigkeit des Begriffes “Denkstil”, wie er von Alistair Crombie eingeführt und Ian Hacking aufgegriffen wurde, für das Verständnis dessen, wie das Fach Chemie historisch seine Identität ausgeprägt hat. Obwohl weder Crombie noch Hacking den Begriff “Denkstil” in Bezug auf einzelne Disziplinen verwendet haben, erscheint im Fall der Chemie seine Anwendung besonders vielversprechend, weil er hier hilft, ein zentrales Problem zu thematisieren – nämlich die Frage, wie es Chemikern trotz wechselnder Gegenstandsbereiche und theoretischer (...) Umbrüche gelang, eine eigenständige und stabile Identität auszubilden. Nach einer Einführung in den Begriff “Denkstil”, argumentiert der Aufsatz, dass die Beständigkeit der Chemie als eines Faches wesentlich in ihren Laborpraktiken gründet, die ihrerseits wiederum die spezifische Art der Fragen bestimmten, die Chemiker in ihren Forschungen stellten bzw. die Form der Antworten, nach denen sie suchten. Folgende Merkmale kennzeichnen diesen “chemischen Denkstil” (1) eine spezifische, im Herstellen begründete Form des Wissens, (2) die Befassung mit einzelnen Stoffen und Materialien statt mit Materie im Allgemeinen und (3) eine Beobachtung von Natur besonders im Hinblick auf Transformationsprozesse.The Chemists' Style of Thinking. This paper discusses the relevance of the notion of “styles of scientific thinking” introduced by Alistair Crombie and revisited by Ian Hacking, for understanding how chemistry shaped its identity. Although neither Crombie nor Hacking applied this notion to individual disciplines, it seems appropriate to use it in the case of chemistry because it helps to address a puzzling issue: how did chemists manage to shape an identity of their own, despite shifting territories and theoretical transformations? Following a presentation of the notion of style, I will argue that the stable identity of chemistry is rooted in laboratory practices, which determined the specific questions that chemists put to nature as well as the answers to their questions. The “chemical style of thinking” is characterized by i) a specific way of knowing through making, ii) the concern with individual materials rather than matter in general and iii) a specific commitment to nature. Western democracies experience profound conflicts that induce concerns about polarization and social cohesion. Yet although conflicts are a core feature of democracies, the forms, functions, and dynamics of democratic conflicts have rarely been subject of political theory. This paper aims at furthering our understanding of democratic conflicts. It analyzes the theory of conflict in Mouffe's agonistic pluralism, confronts it with sociological conflict theory, and presents concrete points of departure for a more comprehensive theory of democratic conflicts. The paper, thus, contributes (...) to two lines of research: (1) Regarding agonistic theories, the paper shows that agonistic pluralism fails to provide a convincing theory of conflict since it underestimates the mechanisms and effects of conflict dynamics (e.g. intergroup cohesion, intragroup conflict, domination, and escalation) and fails to account for the variety of conflict interactions. Proponents of agonistic pluralism should therefore invest more into clarifying their core concept. (2) For a general account of democratic conflicts, the paper proposes to pursue interdisciplinary research on the cognitive concepts shaping conflict interactions, the linked practices of conflict regulation, and the processual dynamics of conflicts. The aim of this thematically unified anthology is to track the history of epistemic logic, to consider some important applications of these logics of knowledge and belief in a variety of fields, and finally to discuss future directions of research with particular emphasis on 'active agenthood' and multi-modal systems. It is accessible to researchers and graduate students in philosophy, computer science, game theory, economics and related disciplines utilizing the means and methods of epistemic logic.

Scientific textbooks are often said to deliver a stereotyped kind of knowledge, which conceals rather than reveals the real making of science. They may, however, alternatively be regarded as of peculiar interest for historians of science. An over-mechanical application of the Kuhnian concepts of ‘scientific revolution’ and ‘normal science’ can lead to the neglect of the internal dynamics of ‘normal science’. Scientific textbooks may provide a better understanding of the process of normalization in science.

At first glance twentieth-century philosophy of science seems virtually to ignore chemistry. However this paper argues that a focus on chemistry helped shape the French philosophical reflections about the aims and foundations of scientific methods. Despite patent philosophical disagreements between Duhem, Meyerson, Metzger and Bachelard it is possible to identify the continuity of a tradition that is rooted in their common interest for chemistry. Two distinctive features of the French tradition originated in the attention to what was going on in (...) chemistry.French philosophers of science, in stark contrast with analytic philosophers, considered history of science as the necessary basis for understanding how the human intellect or the scientific spirit tries to grasp the world. This constant reference to historical data was prompted by a fierce controversy about the chemical revolution, which brought the issue of the nature of scientific changes centre stage.A second striking—albeit largely unnoticed—feature of the French tradition is that matter theories are a favourite subject with which to characterize the ways of science. Duhem, Meyerson, Metzger and Bachelard developed most of their views about the methods and aims of science through a discussion of matter theories. Just as the concern with history was prompted by a controversy between chemists, the focus on matter was triggered by a scientific controversy about atomism in the late nineteenth-century.Keywords: France; Epistemology; Chemistry; Revolution; Atomism; Realism. My aim in this paper is twofold. First, I provide an analysis of the notion of cognitive homology. In contrast with the well-known concept of structural homology in biology—defined as the same structure in different animals regardless of form and function—the notion of cognitive homology captures the idea that the basic cognitive contribution of a given homologous brain structure tends to remain stable over long evolutionary time scales. Second, I argue that this notion provides a powerful conceptual tool for the (...) study of cognition. Since a cognitive homology will often consist of an evolutionarily conserved relationship between a homologous brain structure and its basic cognitive contribution, such structure–function mappings can be conceived as basic building blocks of human cognition. Engineering science is a scientific discipline that from the point of view of epistemology and the philosophy of science has been somewhat neglected. When engineering science was under philosophical scrutiny it often just involved the question of whether engineering is a spin-off of pure and applied science and their methods. We, however, hold that engineering is a science governed by its own epistemology, methodology and ontology. A growing body of evidence shows that brain oscillations track speech. This mechanism is thought to maximise processing efficiency by allocating resources to important speech information, effectively parsing speech into units of appropriate granularity for further decoding. However, some aspects of this mechanism remain unclear. First, while periodicity is an intrinsic property of this physiological mechanism, speech is only quasi-periodic, so it is not clear whether periodicity would present an advantage in processing. Second, it is still a matter of debate (...) which aspect of speech triggers or maintains cortical entrainment, from bottom-up cues such as fluctuations of the amplitude envelope of speech to higher level linguistic cues such as syntactic structure. We present data from a behavioural experiment assessing the effect of isochronous retiming of speech on speech perception in noise. Two types of anchor points were defined for retiming speech, namely syllable onsets and amplitude envelope peaks. For each anchor point type, retiming was implemented at two hierarchical levels, a slow time scale around 2.5 Hz and a fast time scale around 4 Hz. Results show that while any temporal distortion resulted in reduced speech intelligibility, isochronous speech anchored to P-centers (approximated by stressed syllable vowel onsets) was significantly more intelligible than a matched anisochronous retiming, suggesting a facilitative role of periodicity defined on linguistically motivated units in processing speech in noise. Pregnancy-based employment discrimination has long been a topic of interest for gender inequality scholars and civil rights agencies. Prior work suggests that employer stereotypes and financial interests leave pregnant women vulnerable to being fired. We still know little, however, about women’s interpretations of their terminations and how employers justify such decisions in the face of arguably protective laws. This article provides much needed, in-depth analyses of such dynamics and a relational account of pregnancy-based employment discrimination claims. Elaborating on theoretical expositions (...) of power and research surrounding the patriarchal character of organizational life, we draw on unique quantitative and qualitative data from verified cases of pregnancy-based firing discrimination. Our analyses reveal a two-pronged legitimation process where employers symbolically vilified pregnant workers while simultaneously amplifying ostensibly meritocratic organizational procedures and concerns. Pregnancy discrimination plaintiffs attempted to counter employer arguments. Yet, their limited power within the organizational hierarchy along with the culturally resonant nature of employer logics—logics that seem gender-neutral but that reify gendered assumptions and prioritize business profit—place pregnant women at a considerable disadvantage. Without attending to such cultural and structural power imbalances and the relational processes that undergird them, pregnancy discrimination will remain a significant problem. (shrink)

I see four symbol grounding problems: 1) How can a purely computational mind acquire meaningful symbols? 2) How can we get a computational robot to show the right linguistic behavior? These two are misleading. I suggest an 'easy' and a 'hard' problem: 3) How can we explain and re-produce the behavioral ability and function of meaning in artificial computational agents?4) How does physics give rise to meaning?

This note presents an outline of the social and intellectual conditions accounting for the rise of “conspiracy entrepreneurs”, that is these heterodox thinkers who make a living from their denunciations and revelations on the malevolent organisations and characters who really lead the universe. A special attention has been focused on the reports concerning conspiracy entrepreneurs in the media, which describe them as eccentric and thus entertaining. After the presentation of some studies of David Icke's reptilian hypothesis, a question is raised: (...) is it not legitimate to assert that academics studying conspiracy theories are themselves conspiracy entrepreneurs through their role in the spread of the subject of their studies. Some of the most important achievements in the field of empiricist ethics were made by the School of Moral Sentiment, comprising Francis Hutcheson, David Hume, and Adam Smith. This book throws new light on their consensus theory of virtue. Hope works some of their ideas into a merit theory of rights applicable to conventional rights, defends ethical cognitivism, and analyzes pleasure.

The strong opposition of nineteenth-century French chemists to atomism is usually described as a national attitude due to the overarching influence of positivism in France. The explanation sounds plausible, at first glance. However, the idea that a philosophy of science acted as an obstacle to the advancement of science needs further investigation. What is meant exactly by a philosophical influence on a scientific community? In analysing the alleged influence of positivism on the chemists' community it is argued that the common (...) connection established between philosophical views and scientific attitudes leads to a misunderstanding of both philosophy and scientific activity. This paper first stresses the misreading of Auguste Comte's works; then the misunderstanding of scientific debates about atomism in chemistry. Finally it suggests an alternative view: that the atomic debates generated a variety of positivisms. (shrink)

The so-called daxue zhi dao 大學之道, though a Confucian way of self-cultivation, can inspire contemporary universities through a process of creative interpretation. Having examined the ethos of modern university in its four historical stages, I come up with its last stage of reaching out in the era of globalization and dialogue among civilizations, in which we have to rethink the idea of university from the fuller development of human reason. This can be achieved only through increasingly reaching out toward many (...) others by means of mutual waitui 外推 and self-reflection, which presuppose and announce an ethics of generosity in priority over and implementable by reciprocity. Universities today should learn from classical Confucianism, and we should keep in mind their initial generous spirit as exemplified by Confucius himself. Strangification and self-reflection, being moved by original generosity and implemented by reciprocity, will eventually bring us the hope of reason. (shrink)

"Public engagement in science" is one of the buzzwords that, since 2000, has been used in nanotechnology programs. To what extent does public engagement disrupt the traditional relations between science and the public? This paper briefly contrasts the traditional model of science communication - the diffusionist model - that prevailed in the twentieth century and the new model - the participatory model - that tends to prevail nowadays. Then it will try to disentangle the assumptions underlying the public dialogue initiated (...) about nanotechnology, and conclude that nanotechnology actually develops a managerial model of society. Thanks to the stability and elegance of the Church-Turing thesis, the notion of computation defined by these mechanisms is etched in stone as the theoretical essence of computation. This discussion paper proposes that a meaningful distinction between science and technoscience can be found at the level of the objects of research. Both notions intermingle in the attitudes, intentions, programs and projects of researchers and research institutions – that is, on the side of the subjects of research. But the difference between science and technoscience becomes more explicit when research results are presented in particular settings and when the objects of research are exhibited for the specific interest they hold. (...) When an experiment is presented as scientific evidence, which confirms or disconfirms a hypothesis, this agrees with traditional conceptions of science. When organic molecules are presented for their capacity to serve individually as electric wires that carry surprisingly large currents, this would be a hallmark of technoscience. Accordingly, we propose research on the ontology of research objects. The focus on the material presence of research objects makes this a specifically philosophical project. (shrink)

This paper both elaborates and interrogates the transactional model of human experience at the center of Shannon W. Sullivan's Living Across and Through Skins. In particular, it highlights the need to supplement her account with a psychoanalytic reading of our gendered subjectivities. Moreover, it stresses the necessity to focus on such humanly important—and irreducibly somatic—phenomena as grief and eros.

Is there an obligation by nations, who do not themselves recognize same-sex marriage to recognize such marriages when they have been consummated abroad? Is the right to such recognition a human right? If so, what obligations do the domestic courts of various countries have to incorporate the right to same-sex marriage for their own people? Must international law recognize a right to same-sex marriage as a human right, especially if some nations have already begun to move on that track? These (...) questions are moving to center stage as more and more countries in the EU and elsewhere are being forced to address various rights claims especially by lesbian, gay, bisexual and transgendered communities. At their core, these questions are troublesome not so much because of the communities they affect, but because they draw attention to a deeper set of problems concerning the relationship of domestic to international human rights law. What are the similarities and differences between these two areas of law, is there a hierarchy where one area dominates the other, do international human rights norms arise out of various domestic constitutional provisions, and what are the duties of courts (especially domestic courts) in declaring the law? Can local traditions, religious beliefs, or constitutional requirements justifiably stand in the way of extraterritorial recognition of international human rights law? (shrink)

In this article I want to consider whether the authority of the United States to enter into treaties in a global environment is limited by constitutional constraints. The issue arises because a reasonable interpretation of the language of Article VI would place the treaty power on the same status-footing as the Constitution of the United States. But if that is the case, then presumably a treaty might be designed that could delegate constitutional powers to bodies like the United Nations, the (...) North Atlantic Treaty Organization (“NATO”), the International Monetary Fund, the World Trade Organization (“WTO”), or other international organizations. Or, a treaty might be designed to reserve particular constitutional rights – like the Sixth Amendment right to trial by jury in criminal cases – from operating within certain contexts as might concern areas over which the United States exercises territorial jurisdiction, for example, Guam, Puerto Rico, and in other contexts where only international agreements apply. With the rise of state sponsored standardized testing and curriculum alignment, it is important to consider the impact such practices may have on educational aims. In this paper, I argue that critical thinking ought to be the principle aim in every educational pursuit, and that practices such as “teaching to the test” may be detrimental to its development. I maintain these claims with a discussion of the philosophical works of Harvey Siegel, Israel Scheffler, and John Dewey. Operating from their definitions (...) of critical thinking, rationality, and education respectively, I offer support for my conclusion based on one’s ability to challenge the soundness of claims, and the revisional quality of true belief. The issue of critical thinking as general or subject specific is also addressed. Using Siegel’s notion of a critical spirit, I propose that a universal quality of critical thinking lies in its normative as opposed to technical aspects. (shrink)

The human intestinal ecosystem, previously called the gut microflora is now known as the Human Gut Microbiota. Microbiome research has emphasized the potential role of this ecosystem in human homeostasis, offering unexpected opportunities in therapeutics, far beyond digestive diseases. It has also highlighted ethical, social and commercial concerns related to the gut microbiota. As diet factors are accepted to be the major regulator of the gut microbiota, the modulation of its composition, either by antibiotics or by food intake, should be (...) regarded as a fascinating tool for improving the human health. Scientists, the food industry, consumers and policymakers alike are involved in this new field of nutrition. Defining how knowledge about the HGM is being translated into public perception has never been addressed before. This raises the question of metaphors associated with the HGM, and how they could be used to improve public understanding, and to influence individual decision-making on healthcare policy. This article suggests that a meeting of stakeholders from the social sciences, basic research and the food industry, taking an epistemological approach to the HGM, is needed to foster close, innovative partnerships that will help shape public perception and enable novel behavioural interventions that would benefit public health.
