This article re-examines the House of Lords» decision in Pepper v Hart, which relaxed the rule prohibiting courts from using ministerial explanations of Bills in Parliament in the construction of statutes. It recognizes the importance of context in the interpretation of statutes, but questions the assumption in the case that intention can be attributed to Parliament. It argues that the case can be confined to authorizing the use of ministerial statements in Parliament when such statements can be shown to be (...) inconsistent with arguments made by government before the courts on the meaning of the legislation. Any broader interpretation of the decision raises serious constitutional objections. (shrink)

Parameters of a Bertalanffy type of temperature dependent growth model are fitted using data from a population of stone loach ( Barbatula barbatula ). Over two periods respectively in 1990 and 2010 length data of this population has been collected at a lowland stream in the central part of the Netherlands. The estimation of the maximum length of a fully grown individual is given special attention because it is in fact found as the result of an extrapolation over a large (...) interval of the entire lifetime. It is concluded that this parameter should not at forehand be set at one fixed value for the population at that location due to varying conditions over the years. (shrink)

Until late in the nineteenth century, madder was the most popular natural red dye. Holland was the largest and best-known supplier. As early as the fourteenth and fifteenth centuries, the province of Zeeland and adjoining parts of the provinces of South Holland and Brabant developed into important producers. In the course of the seventeenth century these areas even succeeded in acquiring a monopoly position. Early in the nineteenth century, however, this position came under attack because France had gone over to (...) industrial production methods from around 1800, whereas Holland continued to produce with craft technologies. After 1820, as a result, a period of stagnation and decay set in. The fate of the Dutch madder industry would have been completely sealed if the production capacity of the French factories had been sufficiently large to satisfy the great increase in demand. Consequently, in Holland, after 1845, a process of revival based upon the French manufacturing methods began slowly and hesitatingly. This process started too late and was not persevered with sufficiently to regain lost markets. The Dutch producers remained strongly attached to their own out-dated, craft methods of production. Scholars have long been captivated by the parallels between birdsong and human speech and language. In this book, leading scholars draw on the latest research to explore what birdsong can tell us about the biology of human speech and language and the consequences for evolutionary biology. They examine the cognitive and neural similarities between birdsong learning and speech and language acquisition, considering vocal imitation, auditory learning, an early vocalization phase, the structural properties of birdsong and human language, and the striking (...) similarities between the neural organization of learning and vocal production in birdsong and human speech. Though their influence on the battle against superstition is difficult to measure, they obviously reflect the practices and debates of their own time. This article confronts Erasmus’ dialogue on exorcism with the ideas and practices of folk religion in the sixteenth-century biconfessional duchy of Cleves under Duke William V. Two sources (...) stand out in particular: the influential treatise De praestigiis daemonum of court physician Johan Wier, an admirer of Erasmus and opponent of magic and sorcery, and the vernacular treatise on magical agency by Jacob Vallick, Catholic parish priest of the village of Groessen, which was printed by Nicolaas Biestkens in 1559. Vallick’s practical and pastoral approach to these matters, though it greatly irritated Wier, nevertheless reflects the influence of Erasmianism in Cleves even among the lower clergy. (shrink)

It is a major move from the claim that the core linguistic problem in Broca's aphasia is the inability to deal with traces, to the claim that this is the syntactic operation only and that it is exclusively supported by Broca's region. Three arguments plead against this move. First, many Broca patients have no damage to Broca's area. Second, it is not only passive, but also active jabberwocky sentences that activate the frontal operculum in a judgment task. John Rawls argues that the Difference Principle would be chosen by parties trying to advance their individual interests behind the Veil of Ignorance. Behind this veil, the parties do not know who they are and they are unable to assign or estimate probabilities to their turning out to be any particular person in society. Much discussion of Rawls’s argument concerns whether he can plausibly rule out the parties’ having access to probabilities about who they are. Nevertheless, I argue that, even (...) if the parties lacked access to probabilities about who they are in society, they would still reject the Difference Principle. I argue that there are cases where it is still clear to the parties that it is not in any of their individual interests that the Difference Principle is adopted. (shrink)

Sellars claims completeness for both the “manifest” and the “scientific images” in a way that tempts one to assume that they are independent of each other, while, in fact, they must share at least one common element: the language of individual and community intentions. I argue that this significantly muddies the waters concerning his claim of ontological primacy for the scientific image, though not in favor of the ontological primacy of the manifest image. Any theory that analyses personal identity in terms of phenomenal continuity needs to deal with the ordinary interruptions of our consciousness that it is commonly thought that a person can survive. This is the bridge problem. The present paper offers a novel solution to the bridge problem based on the proposal that dreamless sleep need not interrupt phenomenal continuity. On this solution one can both hold that phenomenal continuity is necessary for personal identity and that persons can survive dreamless sleep.

Given reductionism about people, personal persistence must fundamentally consist in some kind of impersonal continuity relation. Typically, these continuity relations can hold from one to many. And, if they can, the analysis of personal persistence must include a non-branching clause to avoid non-transitive identities or multiple occupancy. It is far from obvious, however, what form this clause should take. This paper argues that previous accounts are inadequate and develops a new proposal.

Experientialist semantics has contributed to a broader notion of linguistic meaning by emphasizing notions such as construal, perspective, metaphor, and embodiment, but has suffered from an individualist concept of meaning and has conflated experiential motivations with conventional semantics. We argue that these problems can be redressed by methods and concepts from phenomenology, on the basis of a case study of sentences of non-actual motion such as “The mountain range goes all the way from Mexico to Canada.” Through a phenomenological reanalysis (...) of proposals of Talmy, Langacker, and Matlock, we show that non-actual motion is both experientially and linguistically non-unitary. At least three different features of human consciousness—enactive perception, visual scanning, and imagination—constitute experiential motivations for non-actual motion sentences, and each of these could be related to phenomenological analyses of human intentionality. The second problem is addressed by proposing that the experiential motivations of non-actual motion sentences can be viewed as sedimented through “passive” processes of acquisition and social transmission and that this implies an interactive loop between experience and language, yielding losses in terms of original experience, but gains in terms of communal signification. Something that is underestimated by phenomenology is that what is sedimented are not only intentional objects such as states of affairs, but aspects of how they are given, i.e., the original, temporal, bodily experiences themselves. Since cognitive semantics has emphasized such aspects of meaning, we suggest that phenomenology can itself benefit from experientialist semantics, especially when it turns its focus from prepredicative to predicative, linguistic intentionality. How do we inferentially unify separately acquired empirical information into a single comprehensive picture of the lives of persistent particulars? This paper argues that hidden in such inferences is a Fregean puzzle that can only be solved by individuating our demonstratives thoughts in terms of object-dependent Fregean Senses. I begin by characterizing some constraints on a non-skeptical account of our inferential unification of empirical information. I then go on to show that traditional Fregean views of Sense cannot explain the rationality (...) of such inferences; the consequence of which would be widespread skepticism concerning fundamental aspects of our empirical worldview. I show how the theory of object-dependent Senses can account for the rationality of the puzzling inferences. Lastly, I consider the alternative that we abandon a Fregean explanation of the rationality of inferences. While not fully dismissing that option, I briefly raise, what I take to be, a daunting challenge that uniquely faces non-Fregean views of rational inference. (shrink)

Why act when the effects of one’s act are negligible? For example, why boycott sweatshop or animal products if doing so makes no difference for the better? According to recent proposals, one may still have a reason to boycott in order to avoid complicity or participation in harm. Julia Nefsky has argued that accounts of this kind suffer from the so-called “superfluity problem,” basically the question of why agents can be said to participate in harm if they make no difference (...) to it. A compelling requirement on normative theories is that they should be satisfiable, that is, in every possible choice situation with a finite number of alternatives, there should be at least one performable act such that, if one were to perform that act, one would comply with the theory. In this paper, I argue that, given some standard assumptions about free will and counterfactuals, Objective Act Consequentialism violates this requirement.

Daniel C. Dennett has long maintained that the Consequence Argument for incompatibilism is confused. In a joint work with Christopher Taylor, he claims to have shown that the argument is based on a failure to understand Logic 101. Given a fairly plausible account of having the power to cause something, they claim that the argument relies on an invalid inference rule. In this paper, I show that Dennett and Taylor’s refutation does not work against a better, more standard version of (...) the Consequence Argument. Contemporary historians of logic tend to credit Bernard Bolzano with the invention of the semantic notion, of consequence, a full century before Tarski. Nevertheless, Bolzano's work played no significant rôle in the genesis of modern logical semantics. The purpose of this paper is to point out three highly original, and still quite relevant themes in Bolzano's work, being a systematic study of possible types of inference, of consistency, as well as their meta-theory. There are certain analogies with Tarski's concerns here, (...) although the main thrust seems to be different, both philosophically and technically. Thus, if only obliquely, we also provide some additional historical perspective on Tarski's achievement. (shrink)

The article explores the limits of buck-passing analysis in evaluating value or goodness. It talks about the inability of back-passers to account for two important types of value or goodness, which include excellence and means. The use of delimiting strategy in buck-passing analysis in order to be in possession of goodness is discussed.

We define analogues of modal Sahlqvist formulas for the modal mu-calculus, and prove a correspondence theorem for them.

Pragmatism has ties to Idealism; it has even been accused of being a form of idealism. I tell a story about the changing nature of idealism that makes sense of its relationship to pragmatism without threatening to collapse the two. My story is a genealogy that begins well before pragmatism shows up. Pragmatism has very little in common with the subjective idealism of Berkeley or the problematic idealism of Descartes; the differences between idealism and pragmatism get blurred only because idealism (...) underwent an evolution transforming it into something primed to influence and maybe bleed into pragmatism. It was, according to my story, the evolved idealism developed in Germany between 1781 and 1831 that contributed to the formation and development of pragmatism. Yet pragmatism is a large evolutionary step away from idealism, however much it retains and utilizes some of the strengths of late idealistic thought. (shrink)

In the 60 years since IRAS was founded, and the 50 years since Zygon: Journal of Religion and Science started, science has developed enormously. More important, though less obvious, the character of religion has changed, at least in Western countries. Church membership has gone down considerably. This is not due to arguments, for example, about science and atheism, but reflects a change in sources of authority. Rather than the traditional and communal authority, an individualism that emphasizes “authenticity” characterizes religion and (...) spirituality in our time. Less extensive but similar is the loss of authority with respect to science. As a consequence, “religion and science” might seek to provide attractive constructive proposals for visions that integrate an ethos and a worldview. IRAS might contribute by providing a platform for information and the exchange of proposals for a particular audience, while Zygon serves a global and diverse audience with well-researched articles. The relation between logic and philosophy of science, often taken for granted, is in fact problematic. Although current fashionable criticisms of the usefulness of logic are usually mistaken, there are indeed difficulties which should be taken seriously — having to do, amongst other things, with different scientific mentalities in the two disciplines (section 1). Nevertheless, logic is, or should be, a vital part of the theory of science. To make this clear, the bulk of this paper is devoted to the (...) key notion of a scientific theory in a logical perspective. First, various formal explications of this notion are reviewed (section 2), then their further logical theory is discussed (section 3). In the absence of grand inspiring programs like those of Klein in mathematics or Hilbert in metamathematics, this preparatory ground-work is the best one can do here. The paper ends on a philosophical note, discussing applicability and merits of the formal approach to the study of science (section 4). (shrink)

This paper discusses the relation between medical ethics and general moral theory, the argument being that medical ethics is best seen as independent from general moral theory. According to this independence thesis, here explicated in terms of what is called a disunitarian stance, the very idea of applied ethics, which is often seen as underlying medical ethics (as well as many other more specific fields of ethics), is misguided. We should instead think of medical ethics as a domain-specific ethical inquiry (...) among other domain-specific ethical inquiries. On this alternative kind of picture, such ethical inquiries should start with looking at the particularities of the domain under consideration and then proceed from there. Some possible consequences of this idea for medical ethics are then identified and discussed. (shrink)

In this introduction, the author argues that Thomas Hobbes and Carl Schmitt can help us rediscover the foundations of politics and political thought. In the years since World War II, the prevailing paradigm of politics has largely centred on the redistribution of resources. Hobbes and Schmitt, by contrast, help us appreciate two other conceptions of politics. Firstly, these thinkers averred that it is the problem of order ? not redistribution ? which is the fundamental concern for any society. Secondly, both (...) were acutely aware of the role played by myth: that is, how shared ideas ? sometimes created for this very purpose ? serve to promote order, social cohesion, and law?abiding behaviour. The author also argues, finally, that normative theory and the social sciences in general have often neglected these two conceptions of politics. (shrink)

Jeremy Bentham is often interpreted as defending a satisficing, rather than maximizing, version of utilitarianism, where an act is right as long as it produces more pleasure than pain. This lack of maximization is surprising given Bentham’s maximizing slogan ‘the greatest happiness of the greatest number’. Against the satisficing interpretation, I argue that Bentham consistently defends a maximizing version of utilitarianism, where an act’s consequences are compared to those of not performing the act.
