There is a consensus that the effects of medical brain drain, especially in the Sub-Saharan African countries, ought to be perceived as more than a simple misfortune. Temporary restrictions on the emigration of health workers from the region is one of the already existing policy measures to tackle the issue—while such a restrictive measure brings about the need for quite a justificatory work. A recent normative contribution to the debate by Gillian Brock provides a fruitful starting point. In the first (...) step of her defence of emigration restrictions, Brock provides three reasons why skilled workers themselves would hold responsibilities to assist with respect to vital needs of their compatriots. These are fair reciprocity, duty to support vital institutions, and attending to the unintended harmful consequences of one’s actions. While the first two are explained and also largely discussed in the literature, the third requires an explication on how and on which basis skilled workers would have a responsibility as such. In this article, I offer a vulnerability approach with its dependency aspect that may account for why the health workers in underserved contexts would have a responsibility to attend to the unintended side effects of their actions that may lead to a vital risk of harm for the population. I discuss HIV/AIDS care in Zimbabwe as a case in point in order to show that local health workers may have responsibilities to assist the population who are vulnerable to their mobility. (shrink)

This paper examines the use of tablet personal computers and how they interfere with Nigerian undergraduates reading culture and love for educational books. The study adopts a descriptive research design. The University of Ilorin undergraduates constitute the population for this study while 200 level students of three faculties across the university constitute the target population. Stratified sampling technique was used to sample the needed respondents. A researchers’ designed questionnaire was use for data collection. The collected data was analysed using descriptive (...) statistics. The findings revealed that access to tablet computer influence the undergraduate reading culture. Also, 55.7% of 200 level undergraduates read more electronic materials on their tablet computer than printed texts. Based on the findings of this study, it is recommended that students should be encouraged to visit the library and read textbooks since there is certain fundamental knowledge that might not be accessible on the net. One of the famous scholars realizing that interest is Abū Ḥayyān al-Andalusī (d. 745/ 1344). The true name of Abū Ḥayyān is Muḥammed b. Yūsuf b. Ali b. Ḥayyān al-Tawḥīdī and he is an Andalusian linguist and exegete. Abū Ḥayyān who came from a Berber family born in the Matahsharesh village of Granada in 654/1256 and died in Cairo in 28th time 745 (11 July 1344). There is not much information about his family in the sources, but it is mentioned that he has a daughter whose name is Nada, a son named Hayyân in his name, and some grandchildren which are named Muḥammad and Ummu Ḥayyān. Abū Ḥayyān became a famous as Ethīr al-dīn and at the same time, he is also known as Naḥvī, Ghirnātī (Granadian), Ceyyānī, and Nafzī. He took lessons in Granada from great scholars such as Abd al-ḥaķ b. Ali al-Anṣarī, Abū Ḥasan al-Ubbezī, Abū Cafer Aḥmed b. Ibrahīm b. Zubair, Ibn Abū al-Ahvas and became a proficient scholar and teacher in matters such as morphology, syntax, language, commentary, hadith, methodology of Fiqh and Kalām. He wrote about 18 works in different sciences and if we mention some of that are al-Baḥr al-muhīt, al-Nahr al-mād, Tuhfat al-arīb bimā fī al-Qur'ān min al-gharīb and some of his works have reached to our time and some of those did not. Abū Ḥayyān left Andalus for various reasons and visited many centers of science and eventually continued his scientific activities in Cairo. Abū Hayyān, who is a great interest in learning languages, has learned Turkish language with the other popular languages ​​such as Persian, Amharic and Himyarite language and written books about these languages. His mainly works about Turkish language are the Kitāb al-Idrāk li-lisān al-Atrāk, Zehv al-mulk fi naḥv al-Turk, al-Af'al fi lisān al-Turk and al-Durret al-mudiyye fi lughat al-Turkiyye. These works did not reach to our days except Kitāb al-Idrak. Kitāb al-Idrāk consists of three sections, namely introduction, dictionary which includes 2200 words, and grammar that is composed of morphology and syntax and this book which is known as al-Idrāk is written in the Turkish which is spoken in XIV-XVI century tongue and named as Middle Turkish Period-Mamluk Kipchak Turkish. The first chapter begins with basmala and continues with detailed his genealogy, personal record, praise to Allah and salawat and salaam to Prophet Muhammad. After this introduction, it is explained the intention of writing this work. The second chapter is a dictionary which the words are explained in alphabetical order. Although Abū Ḥayyān speaks about 23 letters in the Kipchak alphabet, he does not explain the words related to all, but examines 19 items. In this dictionary, it does not take part some letters, that is letters sā, zāl, zā (letters of lips which is written in English th); letters dâd, ayn, fa (letters of throat) which Arabs use. In the third chapter, there is a part of the tasrif (knowledge of morphology) which is generally called knowledge of morphology today. In this section, it is dealt with about the types of words namely, name of diminutive, name of belonging name, plural, agent name, passive name, exaggerated factor name, infinitive, name indicating the location, name of device, arbitrary name, and idâd (which adds are derivation of noun from name like lık, lik at the end of the word) and then it comes to the end with shadda. Section of syntax which is called by the author as consisted of compound and is prepared according to systematic of Arabic grammar begins with the sentence structure in Kipchak language. After that it continues with definite-ambiguous names, verb (orders, past, imperfect verbs), subject-predicate in nominal sentence, nevāsiḫ (additional actions helped change the meaning of the noun phrase), Arabic leyte which express by the actual wish mold and the like, such as two mef'ūl area of ​​the heart of verbs in Arabic told (I think) were deaf ( Turkmen thinks he), acts like it yet scientists (verb phrase in), acts offender (verb-subject), the abutment of the verb nefiy prepositions, prepositions, the nehiy (ban), passive verbs and naib-i fail (so-called subject); other elements of the sentence, called the act müteallakat are: cognate accusativ, direct object, time period (time complement), the envelope space (located complement), state (envelope), causative object, the exception, the specification, conflict of laws, the annexation, the oat, the dependencies: adjective, conjunction, confirm, the apposition; conditional structure. After these, he mentions to letters of meanings (huruf al-maani), and concludes this chapter with information about the date, place, and name of the author of the book. Abū Hayyān used induction method in the book. Since he gave the forms of the words in double, then the triple, quadruple, quintet and other forms. He tried to teach the pronunciation of words by explaining the etymology of word sand the changes of the voices. He examined the words which are synonyms/ contrasted, synonym voice, singular/plural, and words that are passed by foreign languages into Turkish dialects then they are turned into Turkish word structure; brought out witnesses from proverbs and poetries. As a result, in this work, which consists of dictionary and grammar sections, it can be said that it is used predominantly in linguistic information - translation method . (shrink)

The Sufyānī narration, which is also referred in some studies carried out today, is mentioned in the early Shiite and Sunnī sources. The anticipated savior perception of the period has an important place in understanding the Sufyānī narrations in the emergence process of which political and sectarian events were effective. Narrations stating that the Mahdī named Muḥammad, one of the descendants of the Prophet Muḥammad (pbuh), would appear in the end of times and establish justice by bringing order to the (...) world where oppression, injustice and inequity have spread, were effective in the political and social life after the Prophet (pbuh). The emergence of the Sufyānī narrations, whose intellectual infrastructure was constituted by the expected Mahdī perception that is effective in the society, was the result of the political conflicts of the period. The death of Muʻāwiya ibn Yazīd (d. 64/684), the third Caliph of the Umayyad State, without leaving a crown behind caused a political crisis. The cousin of the Muʻāwiya II, Marwān bin al-Ḥakam, the experienced politician who turned this moment of crisis into an opportunity and who was from the same dynasty but from a different family, took over the administration and thus the sultanate continued. Although the reign continued from the sons of Umayyad, the administration passed from sons of Sufyān to the sons of Marwān, who were from the same dynasty. This situation caused discomfort in Sufyānīs. Thus, Muʻāwiya II's brother Khālid ibn Yazīd, whose right of administration was seized from him, with the intention of gaining his lost reputation in the society and turning the pessimism towards his family into hope and desire, has been claimed to spread the savior Sufyānī narrations expected from the sons of Sufyān, parallel to the Mahdī narrations expected from the sons of Alī, which was influential in the society. Thus, the Sufyānī came to be expected like the expected Mahdī, who was influential in society and exploited by the Shiite sects in their own belief systems. The rebellions carried out by the sons of Sufyān against the administration in the 2nd century hijrī and afterwards were conceived as the appearance of the Sufyānī expected by the society and the person who led the rebellion was described as Sufyānī. The most important of these rebellions is the revolt of ʻAlī ibn Abdullah ibn Khālid nicknamed Abū ʻAmayṭar, formed by the coalition of sons of ʻAlī and sons of Sufyān who descend from the sons of Umayya. Abū ʻAmayṭar, who is considered to be the Sufyānī and some sections of whose life constitute a source for many narrations on the Sufyānī, declared his caliphate during the period of Abbasī Caliph al-Amīn (d. 198/813) and called for allegiance to himself. The announcement of his caliphate was considered by his supporters as the expected savior. The period of Abū ʻAmayṭar and the sayings about him are extremely important in terms of presenting the expected savior perception in the society, the Sufyānī understanding and the date of his emergence. Sections from Abū ʻAmayṭar's life reflected in the narrations about the Sufyānī in many Shiite and Sunnī sources. In this article, it is tried to examine the emergence of the Sufyānī narrations, its development and particularly its transformation within the Shiite sect, in a detailed manner and especially based on political and sectarian events of the early period. This study is devoted to the ways and means to justify a ‘more’ cosmopolitan realization of certain policy implications, in the case of immigration. The raison d’être of this study is the idea that the contemporary debate over open borders suffers from indeterminate discussions on whether liberal states are entitled to restrict immigration. On the other hand, most of the liberal cosmopolitan accounts neglect the detrimental consequences of their open borders argument – which take it as a means to compensate (...) people in need –, such as brain drain and the effects of brain drain on the opportunity sets of members of sending countries. Therefore I offer a moral cosmopolitan account of immigration which takes the interests of would-be immigrants, the residents in receiving, along with the residents in sending countries in respect to their opportunity sets because of the way arbitrary border control represents the inequality of opportunity. I do not provide a well-formed immigration policy here, yet I believe the account provided here is more feasible in considering phenomena such as brain drain. (shrink)

Memlûk Devleti’nin kuruluş yılları ile ilgili literatürde pek çok çalışma mevcuttur. Bunlar genellikle sultanların memlûk kökenli olmalarından dolayı devletin meşruiyeti meselesini merkeze almaktadırlar. Memlûkların bu sorunu aşmak için kendilerini İslam’ın koruyucuları kimliğiyle öne çıkardıkları anlatılmaktadır. Bu anlatıma göre İslam’ın koruyucusu olmak ileride kuracakları müstakil devletlerini meşrulaştıracaktı. Ancak bu argüman, devletin oluşumunu büyük oranda Haçlı-Moğol saldırıları gibi dışsal unsurlara karşı yapılan başarılı mücadelelere bağlamaktadır. Bu durum Memlûk Devleti’nin oluşumunun ardında yatan pek çok nedenin göz ardı edilmesine neden olmaktadır. Devletin dışsal unsurlara (...) karşı yürüttüğü mücadelelerden meşruiyet devşirdiği kabul edilmekle birlikte, bu çalışma, hizipler arası çekişmelere odaklanarak bu mücadeleler dolayısıyla devletin dinamik bir hâl aldığını ortaya koymaktadır. Bu bakımdan Memlûk iktidarının kendi içindeki dönüşümünde Eyyûbîler zamanında beri faal olan hizipler arası mücadele dikkate alınmak durumundadır. Ayrıca Memlûklar’da sıklıkla bahsedilen argümanlar arasında bulunan sultan öldürerek sultan olmak gibi anlatımlar mevcut olmasına rağmen devlet sisteminin işleyişinde herkes tarafından bilinen ve yazılı olmayan kaidelerden olan seçkin emîrlerin belirleyici gücü dikkate alınmalıdır. Zira bu ıskalandığında hizipler arası mücadelelerin getirdiği neticeler de göz ardı edilecektir. Bu kaidelerde/sistemde yalnızca sultan değişmiyor aynı zamanda iktidarda bulunan seçkin elit kadroda da bir dizi değişiklikler hasıl oluyordu. Sultan ve seçkin emîrler arasındaki otokrasi-oligarşi çatışması her daim yaşanmaktaydı. Ne zaman ki oligarşik gücü sağlayan emîrlerden biri sultan olur, işte o zaman sultan ile seçkin emîrler arasında iktidar mücadelesi başlardı. Bu durumda sultan açmazda kalarak otoritesini ihdas edebilmek amacıyla kendisine yeni bir hizip kurardı. Dolayısıyla Memlûk Devleti’nin oluşumu noktasında hizipler arası mücadele devletin oluşumunu ve iktidarın değişimini sağlayan en önemli etkenlerdendi. Nitekim resmen olmasa da de facto olarak Âdiliyye, Kâmiliyye ve Sâlihiyye gibi memlûk hiziplerinin de devlet gücünü ellerinde tuttukları bilinen bir gerçektir. Diğer taraftan bu çalışma, süreç içerisinde Sâlihiyye-Bahriyye memlûklarının devletleşmesini sağlayan koşulları bütünsel bir yaklaşımla ele almaktadır. Ayrıca sultanın memlûkları (el-memâlikü’s-sultaniyye) ile hûşdâşları arasındaki gerilimin iktidarın el değiştirmesini nasıl etkilediğini tartışmaktadır. Spesifik olarak Bahriyye-Muʿizziyye arasındaki mücadeleye odaklanan bu çalışma, Memlûk devletinin kuruluş yıllarında iktidarın oluşumu, sürdürülmesi ve değişiminin nasıl gerçekleştiğini incelemektedir. Son olarak çalışmada genel olarak erken Memlûk dönemine ait kronikler ve hususi olarak Memlûk sultanlık anlayışına hasredilmiş çalışmalar sadedinde sultan-seçkin emîrler arasındaki arka plan çatışmaları, iktidar devşirmeleri vb. hadiselerin devletin oluş-bozuluşunda oynadığı rol esas alınmaktadır. Each narration or text, as it informs about an event, situation or person in history, has a history that sheds light on both its formation and how it arrived to us. The illumination of this history is at least as important as the content analysis of the information. For this reason, it is necessary both to examine whether the source in which the information is given has survived to the present day as it was created by the author without being (...) exposed to any external intervention, and to analyze the narration in terms of reliability and indication within the integrity of the isnād-text. In that case, when the word “text criticism” is mentioned, an understanding of a specific criticism should come to mind, which includes both critical edition (scholarly editing) of the first source and the critique of the narration by making sound research in terms of isnād and literary criticism (naqd al-isnād wa-l-matn). Due to reasons such as the inability to follow a standard method, the limited number of the copies and/or the distance of the copies from the author in terms of history and commercial concerns, many classical works published with relative verification contain such errors require a re-examination. One of these works is Ibn Hibbān’s (d. 354/965) book al-Majrūhīn. In his work al-Majrūhīn, Ibn Hibbān divided the narrators into two groups according to their reliability and collected the ones that he determined as weak according to his opinion. In this work, he placed Abū Ḥanīfa (d. 150/767) at the top of the list. First, he denounced Abū Ḥanīfa with the following expressions: Sahib al-ra’y, child of slaves, bicker, hypocrite, had little knowledge of hadith, a Murji’ī propagandist, a narrator who was blamed by imams. Then he tried to justify these claims by about thirty narrations from various salaf scholars. These narratives are completely different from the largely intellecutal discussions and criticisms of scholars such as al-Awza'i (d. 157/774), Ibn Abī Laylā (d. 148/765) and Ibn Abī Shayba (d. 235/849) on Abu Ḥanīfa and his school. The narrations compiled by Ibn Hibbān are display insulting and polemical narrations against Abu Ḥanīfa’s personality and reliability. In terms of being a source for later periods, it is important to examine and criticize these narratives in terms of the narration techniques. The al-jarḥ wa-l-taʿdīl is important part of the hadith science. al-Mejrūhīn, one of the leading works of this science is remarkable in many respects. According to this narration Abū Ḥanīfa Nuʿmān b. S̱ābit b. Zūtā b. Māh’ın (öl. 150/767) said, "If a man worships this mule to get closer to Allah, I see no harm in it." According to our analysis, there are the following determinations about the narrators in the chain of this narrative. Ibn Abī Mushir is unknown (majhūl), the narrator who is written as “Mahfūz b. Abī Savba” but his correct name is “Tawba” is matrūk. Ahmad b. al-Walīd al-Mahramī al-Karkhī is weak, and Yahyā b. Hamza, source person, is qadari who narrates from people with munkar al-hadith; but is also considered as a thiḳa narrator. As for Sa‘īd b. Abd al-Azīz, he has nothing to do with the reception and transmission of the narrative. In addition, there is also a break in the chain. First of all, what is expected from a basic work such as al-Majrūhīn, whose subject and purpose is purely a narrator analysis, is that the report in it should be acceptable, at least in terms of isnād. When the narrative in question, which is also included in earlier sources such as al-Fesewī (d. 277/890), is evaluated in terms of both the isnād and the text, one realizes the transformation of an expression circulating in the form of gossip against Abu Ḥanīfa in Damascus around the subject of ʾirjāʾ. ʾIrjāʾ was at the forefront of the heated debates in the second half of the second century into semā form in terms of isnād and text, besides, the word النعل/clog is transformed into البغل/mule. Apart from the weak points of the chain, Sa‘īd b. Abd al-Azīz, who has nothing to do with the reception and transmission of the narrative, has also been turned into the narrator/source of the report with the samā expression. Regardless of the purpose and the criteria of the narration technically, during the conversation with Sa‘īd, Yahyā b. Hamza’s sincere friend and teacher, a special speech in which a common report attributed to Abu Ḥanīfa was expressed, was transformed into Yahyâ’s samā‘ in the form of jazm. As a result, the word “shoe” or “clog” has evolved into mule. It would be a reductionist and over optimistic approach to assume that all this may have resulted from tashīf and tahrīf of the copyists. The narration we discussed is a typical example in terms of showing the effect of the conflict of ideas between Ahl al-Hadīth and Ahl ar-Ra’y on the narrations. There are many studies and theories in the literature on the source of power in the formative years of the Mamlūk state. In these studies, the importance of power and influence as a form of becoming a sultan in the Mamlūks has been emphasized, although the oligarchic power of the umara has been indirectly mentioned in terms of the source of power by discussing the distinction between a puppet sultan and an authoritarian sultan. However, this axiom causes a number of (...) problems and ambiguities within itself and leads to the supersession of the determinism of the elite amirs. This work will try to overcome this problem by focusing on the political developments during the foundation years of the state and discussing how powerful and influential amirs were restricted by the umara on their way to becoming sultans. At the same time, by focusing on the chronicles of the period in question, the administrative determinism of the Mamlūk factions as a decision-making mechanism in the Mamlūk state will be pointed out. On the other hand, the statement that power emanated from both the sultan’s household faction and the military support of the elite amirs or khushdāshs who held the Mamlūk oligarchy in their hands leads to overlooking the tension or conflict between the two throughout Mamlūk political history. Considering the state of conflict between the two sides, it is a logical contradiction for the two opposing poles to agree on the same candidate. For instance, considering Muʿizz Aybak’s accession to power, the Sālihiyya-Bahriyya amirs unanimously endorsed his sultanate, but in the process, Muʿizz Aybak prevailed over the tensions he experienced with the elite that brought him to power and managed to become the absolute sultan, albeit for a short time. Therefore, it is essential to keep in mind that there was no uniform relationship between the sultan and the elite amirs, but rather a dynamic functioning. In other words, the future sultan, who had to establish good relations with the amirs until he became sultan, had to go against the amirs who brought him to power if he wanted to become an absolute ruler after he became sultan. In this study, the source of Mamlūk power is traced to the collective interests of the Mamlūk factions. It is emphasized that these interests were usually centered on candidates who were seen as more moderate among the factions. At the same time, by revealing the shortcomings of the understandings presented as a rule such as “the one who kills the sultan becomes the sultan” and “the powerful and influential become the sultan”, the analysis of the period from the founding years of the Mamlūks to Baybars’ sultanate mostly emphasizes the continuity of the status quo of the elite amirs by highlighting the “sultanate of weak and middle-ranking amirs”. The analysis has pointed out that those who killed sultans or usurped the throne were punished rather than usurping the throne as a legitimate right. Similarly, the consensus of the umara on the candidate for sultanate was pointed out by mentioning that those who were powerful and influential were being challenged rather than made sultan. This article analyzes the position of Ibn Hilāl, who is regarded as nāsıbī and ghālī, in the science of Shia rijāl, his reports and the validity of the accusations against him. It is found that narrators are criticized for various reasons in the science of Shiʻa rijāl. Some of them are the Shiite followers that the imams cursed and wanted to be kept away from their adherence. It is seen that the narrations reported by some of the narrators are included (...) in the main sources of Shiite hadith, albeit these narrators were cursed by the innocent imams. Ahmed Ibn Hilāl (d. 267/880) is one of these narrators cursed by the imams and his name is found in the report (the isnād) of many early narrations. Ibn Hilāl, one of the close companions of Shia's 10th imam Ali b. Muḥammed al-Hādī (d. 254/868) and 11th imam Ḥasan al-ʻAskarī (d. 260/874), was first cursed by the letter of al-Askarī allegedly sent, and the Shiite followers were ordered to move away from him. Ibn Hilāl refused to accept the ambassadoriality of Muḥammed b. Osman (d. 305/918), the ambassador of the 12th Imam. Thus, he was cursed by Muḥammad al-Mahdī as well. In later periods, Ibn Hilāl was accused of being nāsıbī and ghālī. However, there are also some Shiite scholars who supported (tavthîk) Ibn Hilāl. In the Shi'a tradition, Nāsibism indicated the meaning of hating ʻAli and Ahl al-bayt or feeling anger towards them. Later on, this meaning has been changed into a meaning including the haters of ʻAli and then the Shiʻa Nāsibism is regarded as a position towards Shiʻa outside of Shiʻa. Ghulāt is a form of a belief generally found in the Shi'a tradition. In the belief of Ghulāt, holiness is attributed to the imams. When the Shiite sources are examined, it can be seeb that Ibn Hilāl represents neither a ghālī nor a nāsıbī position. In the Shiʻa, when the narrator leaves his sect, his narrations are evaluated differently. Therefore, among Ibn Hilāl's narrations only those which narrated before he left can be accepted. The likely reason for this attitude can be those narrators such as Ibn Hilāl brought in many narrations to the Shiite hadith literature. Ibn Bābeveyh and Sheikh Sadūk reported many narrations that includes Ibn Hilāl in their report chain (the isnad). Among these narrations, they criticized only one. Again, in the 4th century of Hijrī, Numānī, al-Hazzāz, Ibn Qavlaveyh and Mufīd reported many narrations transmitted by Ibn Hilāl. However, none of them mentioned about the negative perception on Ibn Hilāl in any of these narrations. This shows that Ibn Hilāl was not regarded as nāsıbī or ghālī in the eyes of the these scholars. As regards to, Tūsī, in the 5th century after Hijra, claimed that Ibn Hilāl was a ghālī and he was accused of being an adherent to this religion. He narrated in sum fifty narrations that included Ibn Hilāl in the report chain, but Tūsī criticized only three of them because of including Ibn Hilāl. The reason why Ibn Hilāl was accused of being nāsıbī and ghālī, which Shiʻa deemed the worst, was probably related to the political conditions of that period. On the other hand, there is no report that Ibn Hilāl shared a nāsıbī and ghālī thought or had a tendency towards them. It is obvious that if Ibn Hilâl, who has an important place in the eyes of the Shiite community, does not accept the second ambassador of al-Mahdī, and that this would cause discord among the followers. This complex situation was tried to be remedied by letters alleged to have been written by the imams, cursing Ibn Hilâl and ordering them to stay away from him. Later, Ibn Hilāl was accused of being a nāsıbî or ghālī who expressed the attitudes and thoughts that Shiʻa saw the most distant from him. Sadūk first reported the narration that Ibn Hilāl was Nāsıbî. Tūsī, on the other hand, described Ibn Hilāl as ghālī in the 5th century (after hijra). This study tries to reveal that there is no explicit evidence that proves Ibn Hilāl’s nāsıbī or ghālī position. (shrink)

İslâm teoloji/kelâm geleneğinin filizlenmeye başladığı dönem, yoğun siyasi gelişmelerin, iç savaşların, hilafet tartışmalarının yaşandığı bir evrenin yanısıra, kendisinden önce üretilen fizikî, felsefî ve dinsel anlamda yaşanan gelişmelerle paralel bir sülûk izlemiştir. Bu anlamda kelâm tartışmalarının siyasi olgu ve olaylar kadar, fikrî anlamda tarihsel bağlam etrafında incelenmesi gerekmektedir. Bu çalışmada, Müslüman kelâm geleneğinde Mu’tezile’nin; nasıl, hangi şartlarda ve nelere itiraz ederek ortaya çıktığı, teoloji anlayışlarında neleri slogan haline getirdiği incelenecektir. Buna istinaden Grek geleneğinde üretilen felsefî metinler bilhassa atomculuk tartışmaları, Hıristiyan ve (...) Zerdüşt teolojisi, Mu’tezile’nin tarihsel bağlamda nasıl tepkisini çekti ve apolojik anlamda ne tür karşı koyuşlara sebebiyet verdiği tafsilatlı olarak tartışılacaktır. Kelâm problemleri ya da tartışmaları sadece i’tikâd boyutunda ele alındığında gayet tabii eksik kalacaktır. Bu amaçla Mu’tezile’nin beş esasından biri sayılan tevhid anlayışının o dönemin bağlamında hangi tartışmalara karşı reddiye nitelikli olduğu, ayrıntılarıyla ve tarihsel süreçten kopmaksızın din ve düşüncelerin birbirleriyle olan ilişkisi nispetinde değerlendirilecektir. There is a recent interest in the ethics of high-skilled worker emigration through which the limitations of the right to exit are discussed. Insightful arguments have been made in favour of the emigration restrictions on skilled workers in order to tackle the deprivations in developing countries. However, there is still a need for clarification on how we can understand, discuss and implement limitations of a right from a normative perspective. Significantly, how we understand the limitation of a right might determine (...) how we approach such limitations – both in terms of the process of assessing the limitations and in terms of their implications. In this paper, I identify two distinct ways to understand limitations of the right to exit with respect to losses associated with health worker emigration, while also pointing to their implications for restrictive policies: as a matter of scope, and as a matter of weight or emergency, which requires a compensatory scheme for the individual right holders. While the emergency restrictions seem to be a point of convergence in the literature, what defines an emergency and the nature of the compensation still warrant exploration. To that end, I also discuss from a normative perspective what might constitute a public emergency that would give states a prima facie prerogative to regulate temporary limitations on the exercise of the right to exit. In addition, I briefly introduce the implications of emergency restrictions, with a particular focus on compensatory schemes for individual right holders. (shrink)

One of the ways to address the effects of skilled worker emigration is to restrict the movement of skilled workers. However, even if skilled workers have responsibilities to assist their compatriots, what if other parties, such as affluent countries or source country governments, do not fulfil their fair share of responsibilities? This discussion raises an interesting problem about how to think of individual responsibilities under partial compliance where other agents (including affluent countries, developing states, or other individuals) do not fulfil (...) their fair share of responsibilities. What is fair to expect from them? Taking health worker emigration as a case in point, I discuss whether the individual health workers’ fair share of responsibilities to address basic health care needs decreases or increases when the other parties do not fulfil their share. First, I review the responsibilities that different stakeholders may hold. Second, I argue that there are strong reasons against increasing or decreasing health workers’ fair share of responsibilities in a situation of partial compliance. I also argue that it is unfair for non-complier states to enforce health workers to fulfil their fair share or take up the slack. (shrink)

Compulsory (health) service contracts have recently received considerable attention in the normative literature. The service contracts are considered and offered as a permissible and liberal alternative to emigration restrictions if individuals relinquish their right to exit via contract in exchange for the state‐funded tertiary education. To that end, the recent normative literature on the service programmes has particularly focused on discussing the circumstances or conditions in which the contracts should be signed, so that they are morally binding on the part (...) of the skilled workers. However, little attention is devoted to the relevance of the right to exit for the debate on compulsory service programmes. In this paper, I argue that even if the service contracts are voluntary, and thus the would‐be medical students voluntarily relinquish their right to exit, the reasons behind the right should be taken into account for the contracts to be morally valid. A clear understanding of the right to exit is a must in order not to breach its basic components and for the service contracts to be morally binding. To that end, I provide two accounts of the reasons to value the right to exit by presenting Patti Lenard's discussion of the right to exit and by reconstructing James Griffin's account of human rights. I conclude by offering brief ethical considerations for compulsory health service programmes grounded in the reasons to value the right to exit. (shrink)

Self-efficacy is an integral part of personal factors that contributes substantially to students' success in mathematics. This review draws on previous intervention studies to identify, describe, and expose underlying mechanisms of interventions that foster mathematics self-efficacy. The findings show that effective mathematics self-efficacy interventions can be categorized into three categories using their underlying mechanisms: those that directly manipulate sources of self-efficacy to foster the construct, and those that either embed self-efficacy features in teaching methods or in learning strategies. Specific examples (...) of interventions that fall in each of these three categories are described including their features and the underlying mechanisms that improve students' mathematics self-efficacy. I argue for the two “most effective” interventions that foster mathematics self-efficacy and their relevance to either pre-university or university students with implications for teaching and learning of mathematics. Aydınlanma, coğrafi keşifler, sanayi devrimi ve benzer etkenlerin tesiriyle doğuya hâkim olma ümidine kapılan batı emperyalizmi, istila ettiği toplumları tanıyıp iç dinamiklerini deşifre etmek için oryantalist çalışmaları başlatmıştır. 19. yüzyılın ilk yarısından itibaren başlayan ve farklı boyutlar kazanarak günümüzde de devam eden bu çalışmalar çok yönlü ve çeşitlidir. Arap edebiyat tarihi çalışmaları bu çalışmaların önemli bir kısmını oluşturmaktadır. Her ne kadar Arap şiiri hakkında bazı oryantalist iddialar polemik konusu olmuş ise de oryantalist telif tarzı Arap yazarlar arasında kabul görmüş ve (...) Arap edebiyatı tarihine dair yazılan kitapların genelini şekillendirmiştir. Bu makalenin konusu Mısırlı âlim ve edebiyatçı Mustafa Sadık er- Râfiî’nin Arap edebiyat tarihine dair oryantalist yaklaşıma ve yazım tarzına yöneltiği eleştirileriler ve bu eleştirilerin değerlendirilmesidir. Râfiî’nin bu alanda yazdığı kitabın başlangıç kısmından çıkardığımız bu eleştirileri terim eleştirisi, kalıp eleştirisi, niyet eleştirisi, pratik fayda eleştirisi başlıkları altında topladık. Bu başlıklar altında incelediğimiz eleştirilerin ortak noktası bunların esasında bir paradigma eleştirisi olmasıdır. (shrink)

Deixis is the thing referred to by linguistic units outside the text or the discourse. The act of demonstrating or indicating the elements of a state through gestures or linguistic units is called deixis. Deictic is the name given to the linguistic elements such as pronouns, demonstrative nouns and adverbs which refer to the personal, spatial or temporal aspects of a speech act and which are, therefore, all directly related to the context surrounding its act of communication. Since the references (...) of the deixis expressions can only be identified within the context of actual communication, the subject is considered as a part of the pragmatics. This study aims to analyse the demonstrative nouns used in Qur’anic verses within the context of deixis and types of deixis, which are research areas of pragmatics, and to identify the types of deixis used in Qur’an. This study also aims to provide insight about how to present the references of demonstrative nouns especially in Qur’anic translations to be understood correctly by the readers. This is because the translations of Qur’an are presented in written form and the references of the deictic units are not expressed clearly in some of them. In this case, it is assumed that the reader might have difficulty understanding the meanings of the deixis such as “this, to this, these”. This study, firstly by studying deixis and types of deixis from the modern linguistics and pragmatics resources, aims to form a conceptual framework. After the first chapter, upon which the main problem of the study will be built, is completed, the demonstrative nouns are analysed in terms of their structural and referential aspects within balâg̲h̲a and tafsîr sources, classical Arabic language nahw sources being in the first place. After the obtained data is analysed, by associating the demonstrative nouns in Qur’anic verses to types of deixis, anaphora and cataphora, their references are determined. In this direction, firstly the demonstrative nouns in Qur’an will be identified and the type of deixis is tried to be explained by providing one example for each one of the demonstrative nouns in terms of their referential variety. For this purpose, this study highlights the demonstrative nouns which cannot be directly understood but only can be identified by checking the context. That is, the demonstrative nouns which take adjectives or which are adjectives themselves will not be included in the scope. The references of these nouns existing in the verses will be specifically analysed within the classical tafsîr works. This study is significant as it reveals the references of the demonstrative nouns by analysing the types of deixis in order to understand Qur’an more accurately. Though there are various studies regarding the demonstrative nouns, there are no studies found analysing the references of these nouns according to their types of deixis. With this study, it is understood that classical tafsîrs mention the deixis, types of deixis, and the references anaphora and cataphora for demonstrative nouns. As the demonstrative nouns, which are deictic elements, are used to point to all types of living and non-living creatures, they are considered as indefinite things. It is understood that for the other interpreters, the vagueness can only be eliminated by taking pragmatic factors such as the speaker, listener and the context of communication into consideration. 20 types of demonstrative nouns were used for a total of 1047 times in 89 different surahs. These demonstrative nouns are as following: “ذا، هذا، هذان، هاتين، هؤلاء، ذلك، ذانك، ذلكما، ذلكم، تلك، ذلكن، هذه، أولئك، أولئكم، أولاء، كذلك، كذلكم، هاهنا هنالك، ثم”. The fact that demonstrative nouns are used so often in Qur’an prove that these nouns are quite important in understanding the Qur’an. This study addresses the verses with demonstrative nouns in terms of types of deixis, as part of pragmatics, by referring to classical tafsîr and linguistic sources. It has been determined that demonstrative nouns in Qur’an make personal, spatial or temporal references, discourse deixis, anaphora and cataphora, however they do not perform as social deixis. It has been concluded that identifying the references of demonstrative nouns is quite important in understanding and interpreting Qur’an correctly. It is also understood that the methods to determine the references of demonstrative nouns by the sources used in the study have pragmatic characteristics. It is observed that the references of the demonstrative nouns are not presented in certain Qur’an translations. In this context, it has been concluded that stating the references of these nouns in written form for the translation of Qur’an into different languages is vital for these references to be understood correctly. It has also been concluded that it is a requirement in terms of pragmatics to take the references of the deictic elements mentioned especially in the primary sources into consideration. (shrink)

The contributors to this issue offer applied critical and normative perspectives on central, yet overlooked, ethical aspects of migration management with a certain cosmopolitan lance in some capacity. However, cosmopolitanism might mean different things for transnational migration. It can refer to “political cosmopolitanism” that provides the reasons for why there should be certain global institutions governing migration. It can also refer to “moral cosmopolitanism” that simply represents a moral concern for individual rights and interests first and foremost. Cosmopolitanism can also (...) work as a lens that is based on a scepticism towards using the nation-state as the ultimate unit or locus of analysis. These perspectives are not mutually exclusive, and the contributions in this special issue accommodate a form of cosmopolitan outlook or stance to some extent in their discussion on migration management practices. Bu araştırma, Birinci Mushaf Projesi’nden yarım asır sonra gerçekleşen önemli bir projeyi ortaya çıkarmayı hedeflemektedir. Bu proje, hicrî 84 ve 85 yılları arasında Irak’ın Vâsıt şehrinde zamanın Kûfe ve Basra (Irâkeyn) valisi Haccâc b. Yûsuf’un (ö. 95/714) girişimi ve Emevî Halifesi Abdülmelik b. Mervân’ın desteğiyle uygulamaya koyulmuştur. Projenin yürütülmesini ise Hasan-ı Basrî (ö. 110/728) üstlenmiş ve hafızlar, kâtipler ve kârîler gibi çok sayıda uzman kişiden oluşan komisyonlara başkanlık etmiştir. Bu çalışmada Giriş’in ardından bu projeye yol açan etkenlerden söz edilmiştir. Bunların (...) başında da üçüncü Halife Osman’ın başlattığı Kur’an metninde birliğin sağlanması düşüncesi gelmektedir. Daha sonra bu projenin sahibi Haccâc’tan bahsedilmiş, bu projenin nerede ve ne zaman gerçekleştiği, projede yer alan önemli şahsiyetlerin kimler olduğu şeklindeki bir dizi soru cevaplanmıştır. Daha sonra Proje’nin hedefleri hakkında ayrıntılara girilmiş, Haccâc’ın Osman Mushaf’ında toplam on bir harfte değişiklik yaptığı isnâdında bulunan rivayetler tartışılmış, bu rivayetler incelenerek eleştiri süzgecinden geçirilmiş ve İkinci Mushaf Projesi’nin Hz. Peygamber ve hulefâ-i râşidîn döneminde gerçekleştirilen Birinci Mushaf Projesi’ni tamamlayıcı mahiyette olduğu sonucuna ulaşılmıştır. Ardından İslam devletinin tanık olduğu siyasi çalkantıların ardından İkinci Mushaf Projesi’nin akıbetinin ne olduğu hususuna değinilmiştir. (shrink)

Ghent Üniversitesi öğretim üyeleri arasında yer alan Jo Van Steenbergen’in kaleminden çıkan bu çalışma Memlûk sosyal ve politik tarihi açısından son derece önemlidir. Müellif bu eserde genel hatlarıyla Memlûk Devleti’nin klasik devlet teşkilatından kopmalarının akabinde ortaya çıkan siyasi boşluğun (kaos) nasıl doldurulmaya çalışıldığını, emir-i mîe adını verdiğimiz sultandan sonra en yetkili âmirlerin nasıl bir politik güç edindiklerini, ulema sınıfının siyaset sınıfıyla nasıl bir ilişkisi olduğunu ve bu ilişki çerçevesinde ulema sınıfının siyaset sınıfına nasıl bir meşruiyet sağlama gayreti içerisinde olduğunu ele (...) alıp tartışmıştır. Üç bölümden oluşan eserde; meşru iktidar, etkin güç ve kaosun düzensizliği hususunda ayrıntılı bilgiler verilmiştir. Müellif öncelikle meşru iktidardan ne anladığını dönemin kaynakları aracılığıyla ifade ederek, Memlûk devlet geleneğinde kölemenlerin (memlûk) yerinin ne olduğunu, Mısır özelinde nasıl bir değerleri olduğunu ve bu askerlerin zamanla iktidarı mutlak anlamda ele geçirmeleriyle birlikte halk üzerinde nasıl bir meşruiyet sağladıklarını tartışmıştır. Bu çerçevede Steenbergen, kölemenlerin Memlûk Devleti’ndeki tarihçesine kısaca değinerek, onların Salih Eyyûb (ö. 1249) tarafından orduya alınıp “seçkin” bir asker yapıldıklarını izah etmeye çalışmıştır. Ardından Bahrî memlûklerin iktidarı ele geçirmede nasıl bir rol oynadığını, bir taraftan Moğollarla diğer taraftan da Frenklerle mücadele ederek halk tarafından nasıl kabul edildiklerini ele almıştır. Bu noktada müellife göre ilk etapta sadece “hükümdarın koruyucuları” olarak anılan Bahrî memlûkleri, Frenk ve Moğollarla yaptıkları başarılı savaşlar neticesinde “İslâm’ın koruyucuları” olarak anılmış ve kabul edilmişlerdir. Steenbergen’e göre memlûk/kölemen hizipleri kurulmadan bir emirin ya da sultanın hâkimiyetinden söz edilemez. Dönemin seçkin emirleri tarafından kurulan hizipleşmeleri harekete geçiren şey; hâmilik, (patronage) nimet elde etme (tayin-terfi/ikta) ve makbulü’l-kelime olma arzusuydu. Belâgat ilmi, Arap dilinin özelliklerini kavramada ve gizemlerini anlama konusunda önemli bir yere sahiptir. İslam’la birlikte lafzıyla mûcize olan Kur’ân-ı Kerîm inmiş ve sonrasında bu kitapla belâgat ve hitabet konusunda zirvede bulunan Araplara meydan okunmuştur. Nitekim Kur’ân-ı Kerîm’in indirildiği dönemde muhatabı olan toplum Belâgat ve Fesahat konusunda son derece başarılı bir toplumdu. İşte Kur’ân-ı Kerîm’in böyle bir meydan okumasına bakılarak belâgat açısından ne kadar zengin olduğu daha da fazla anlaşılmaktadır. Aynı zamanda Kur’ân hitap açısından öyle bir üslup kullanmıştır ki İslam’a (...) karşı olan kimseler bile bu üslup karşısında hayretler içerisinde kalmışlardır. Hayret etmeleri dışında kendilerinden bir benzerini getirmeleri talep edilmesi karşısında da aciz kaldıkları kanıtlanmıştır. Kur’ân-ı Kerîm’in içeriğinde ve üslubunda görülmeyen, yüzeysel olarak bakıldığında hemen anlaşılmayan, derin araştırma sonucu ulaşılan edebî güzelliklere ve ayetlerin nazmında gizlenmiş edebî sanatlara Belâgat ilmi yardımıyla ulaşılır. Bu bakımdan Arap dili ilimlerinden gerek Sarf ve Nahiv ilmi olsun gerekse Belâgat ilmi olsun Kur’ân-ı Kerîm’deki sûreler ve ayetlerin doğru anlaşılması konusunda önem arz eden ilimlerdir. Kur’ân-ı Kerîm’in her sûresi Belâgat ilmi açısından kendisinde birçok edebî sanatı barındırmaktadır. Mesela Kur’ân-ı Kerîm’in ilk sûresi olan Fâtiha sûresinin edebî yönden oldukça zengin bir sûre olduğu söylenmiştir. Fâtiha sûresinin edebî yönden olan bu zenginliği dolaylı olarak manasına da açık bir şekilde etki etmiştir. Bu minvalde Fâtiha sûresinin sadece Ebû Hayyân’ın “el-Baḥrü'l-muḥîṭ” adlı eserinde belirtmiş olduğu edebî sanatlarının tanıtımı ve açıklaması yapılmıştır. Bu eser etrafında amacımız belâgat ilmi içerisinde edebî sanatların ayetler üzerinde anlam bakımından katkılarını araştırmaktır. Çalışma da bahsi geçen edebî sanatlar genel olarak Arap dili ve Belâgat ilminden bahseden kaynaklardan araştırılmış ve incelenmiştir. Bu sanatlar hakkında elde edilen bilgilere ve tespitlere de burada yer verilmiştir. Bu edebî sanatların genel olarak oluşumu, Fâtiha sûresinde var olan birden fazla kıraat vücûhâtının belâgat ilmi açısından tahlil edilmesi ve anlamsal bağlamda söz dizime kattığı mana derinliği doğrultusunda gerçekleşmiştir. İçerikteki konular üzerinde derin bir açıklama yapılmaya çalışılmış ancak amacın dışına çıkılmamaya gayret edilmiştir. Konular kısaca ifade edilerek bu sanatların ayette nerede ve nasıl ortaya çıktığından bahsedilmiştir. Bu çalışmamızda Belâgat ilmi ve sanatları veciz bir şekilde ele alınmaya çalışılmış ayrıca edebî sanatların ayetler üzerindeki etkileri ortaya çıkarılmaya çalışılmıştır. Son olarak da bu edebî sanatların Kur’ân-ı Kerîm’i anlama bakımından ne kadar önemli olduğu çalışmanın genelinde anlatılmaya çalışılmıştır. (shrink)

In this article, a new adaptive fuzzy wavelet neural network model is proposed for nonlinear function approximation problems. The AFWNN model is based on the traditional Takagi-Sugeno-Kang fuzzy system. Specifically, this model replaces the membership functions of fuzzy rules with wavelet basis functions, which are known to have time and frequency localization properties, i.e., they can approximate patterns both in the time and frequency domains. The structure of the AFWNN model is derived from that of the adaptive neuro-fuzzy inference system. (...) However, the AFWNN improves over the ANFIS by replacing Gaussian functions in the hidden layer with wavelet basis functions. The AFWNN model is trained using a gradient-based optimization algorithm. The AFWNN is then tested on three function approximation problems of time series prediction. For certain types of nonlinear time series, for instance fractal processes, the AFWNN is found to be substantially more accurate than alternative methods. (shrink)

The interaction between Zaydism and Muʿtazilism, which is claimed to date back to the formation periods, took place when Zaydī scholars studied Muʿtazilite thought in Baghdad intensively and directly from the Mu'tazilite theologian Abū ʿAbd Allāh al-Baṣrī as part of the curriculum, and especially the Basra school of Muʿtazila was influential in the theological thoughts of the Zaydis of Tabaristan/Hazar. In this process, Zaydī scholars such as al-Muʾayyad bi-llāh Aḥmad b. al-Ḥusayn al-Hārūnī and al-Nāṭiq bi-l-Ḥaqq Abū Ṭālib Yaḥyā b. al-Ḥusayn (...) took lessons from the Mu'tazilite theologian Abū ʿAbd Allāh al-Baṣrī in Baghdad. In the same period among the Zaydī scholars who studied theology from Abū ʿAbd Allāh al-Baṣrī and deliberated with him was Imam al-Mahdī li-Dīn Allāh Abū ʿAbd Allāh b. al-Dāʿī, who has been one of the important figures Zaydī-Muʿtazilī interaction can be pursued. Ibn al-Dāʾī, who has detailed information both his political life and scholarly activities in classical sources, wrote many works in the fields of theology and fiqh, but most of his studies have not survived to the presdent day or have been lost, except for the treatise al-Dāʿī, Ḥaqāʾiq al-Aʿrâḍ, which was identified and confirmed as belonging to Ibn al-Dāʾī, with the discovery of a collection of Zaydī-Muʿtazilite studies. In his only extant work, Ḥaqāʾiq al-Aʿrâḍ, Ibn al-Dāʾī classified the accidents on the basis of different criteria and dealt with their realities and states in accordance with the division and evaluation of accidents in later Muʿtazilite sources. This study is one of the rare studies known to have been written on the subject, which contains very detailed division of accident. The publication of this work is important both for the elucidation of the Zaydiyya-Muʿtazilite interaction in the relevant period and for a better understanding of the early theology's understanding of existence. This article will present an analysis of Ibn al-Dāʾī's treatise Ḥaqāʾiq al-Aʿrâḍ and its critical edition using three different manuscript copies. The publication of this study on accidents, one of the most fundamental topics of kalām, will contribute to the understanding of the holistic theological systems of Zaydiyya-Muʿtazila. With the publication of this work, it will be revealed that the interaction between Zaydiyya and Mu'tazila in the 4th/10th century on the subject of accidents was quite intense. (shrink)

Yusuf el-Karadâvî’nin alanında en kapsamlı çalışma olan Fıkhü’z-Zekât isimli eseri bağlamında “fî sebîlillâh” kavramının ne anlama geldiğini ele aldık. Dünya Müslümanlarından büyük kitlelerin takip ettiği Karadâvî, verdiği fetvalarda günümüz şartlarını göz önünde bulundurmuştur. Konuları ele alırken kendi tercih ettiği görüşünü söylemekten çekinmemiştir. “Fî sebîlillâh” kavramını bütün mezhepler cihad ve Allah yolunda cihad eden gaziler olarak anlamıştır. : Muḥammad ibn Yūsuf al-Sanūsī, who was one of the theologian of later Muslim Asʿharī theologians, is one of the scholar came to the fore in Maghrib. Although al-Sanūsī shapes his thoughts within the Asʿharī’s kalam system, he presents new contributions to this system with his own unique perspective. In particular, his effort to give importance to reason in maʿrifat Allāh is remarkable. According to him, maʿrifat Allāh can only be reached with reflection. Also the reflection is waʿẓ or (...) contexture process done in the reason. When a method is followed, such an reflection leads to the maʿrifatullāh. In particular, the ruling wisdom adds a form to the functioning of the reason through its perceived and compassionate perceptions. For a believer to know the necessary, the permissible and the impossible is to use the reason. In this context al-Sanūsī imposes a central role in the concept of judgment. If the human can operates its reason in this way, necessarily will comprehend that he/she is created. In the process of acquiring the knowledge, al-Sanūsī draws attention to the heart as much as the reason and that shows that he is in the effort of combining these two. Summary: Muḥammad ibn Yūsuf al-Sanūsī is a scholar raised at the Maghreb geography. Although al-Sanūsī, living in the 9th/15th century, gave a lot of work in different fields, his theologian identity became front-line. By standing against the innovation that he had seen during his era, he wrote many beliefs works. Among these works, the relation of maʿrifat Allāh-reason attracts attention. al-Sanūsī thinks that the most important means of delivering to maʿrifat Allāh is deduciton. According to him, the deduction is “to reveal the known to reach the desired thing or to arrange two or more works”. If we evaluate this definition in terms of Asʿharī tradition, we will see that al-Sanūsī is in the effort to emending the definition of his al-Qāḍī al-Bayḍāwī’s definition who is his contemporary. al-Bayḍāwī described deduction as ‘to organize things that are not known to be known’. al-Sanūsī made a contribution to this recognition. He has adopted the arrange part completely and also add the waʿẓ expression into that. The reason why al-Sanūsī goes to such a separation is the reason for trying to explain the functioning of the reason in a logical form. In the logical sense, the thought consists of envision and confirmation. From these concepts that constitute thought, envision refers to waʿẓ, and confirmation refers to arrange. If the definition of al-Bayḍāwī is accepted as valid, the envision in reason is incomplete. This shows the importance that al-Sanūsī gives to the functioning of the reason in terms of the achievement of the maʿrifat Allāh. The confirmation made without envision can lead a person to imitation. Therefore, the deduction made by waʿẓ must be taken into account. It can be imagined groundlessly that in the definition of deduciton which al-Sanūsī made, he had an understanding of reason that doesn’t base on Allah. However, al-Sanūsī has never broken the Asʿharī tradition in this matter. According to al-Sanūsī, both the deduction and the knowledge formed as a result of this, is Allah’s creation without means. There is no influence of deduction on knowledge and also the knowledge on deduction. Also, the human has no influence neither in inference nor knowledge. It seems to be contradictory to the definition of such a discourse. However, he made his interpretations within the framework of the understanding of the omnipotence that the Asʿharites had drawn. It is unthinkable that Allah, who created everything and even man’s actions, can’t be imagine that doesn’t create thought. Intellect produces knowledge, but Allah creates both intellect and the knowledge produced by intellect. al-Sanūsī, while describing deduction, said that it could be produced with waʿẓ in the sense of envision. However, there is another very important concept that creates a conception from his point of view, which is “judgment”. According to him, judgment is “the proof or negation of something”. The phrases “the universe is created” or “Allah is not created” are the examples of a proof or negation of an issue. See, this is a judgment. In this sense, envision is a road to judgment. That is, the information obtained by envision reaches a judgment in the forms of the reason. al-Sanūsī classify the judgment in to three: lawful, ordinary, intellectual. The lawful judgment is the salutation of Allah with the demand related to the actions of the amenable, not being good deed or sin or waʿẓ. Ordinary judgment is the link between the existence or absence of a state and the existence or absence of another state. The most important of these three judgments is the intellectual judgment. As for the intellectual judgment, it is the proof or the negation of a work without waʿẓ and repetition. It is separated from lawful judgment without being waʿẓ and separated from ordinary judgment with being not repeated. In this sense, if the mind needs the examination or repetition while deciding for a work’s certainty or negation, this kind of a judgment is not lawful or ordinary but it is intellectual judgment. The reason judges either a work’s certainty or absence together, or accepts only the certainty or accepts the negation. According to al-Sanūsī, having the right to comment on belief is pertain to intellectual judgment in the first place. al-Sanūsī takes the maʿrifat Allāh to the center in matters related to the place of reason and examines the relation of the maʿrifat Allāh with these three concepts. What al-Sanūsī tends in doing so is that to show that there is an inherent meaning of reason as well as having relevance of knowing some things. As a result, according to al-Sanūsī, knowing these three parts of the intellectual judgment is the reason itself. Anybody who does not know these, is the person without reason. al-Sanūsī thinks that it is necessary for the amenable to know the intellectual judgments and its parts. This necessity is to make the amenable separate the things about Allah or his prophets related to necessity, permissible and impossible attributes; but also, the things exist within the limits of intellectual judgment or not. The amenable who know these has evidence and thereby can defeat the doubts that may have formed or may will form in him. al-Sanūsī also emphasizes the deduction of reason to reach the maʿrifat Allāh with reason. According to him, it is the best deduction method in terms of the evidence that Allah exists is that the deduction from causing agent to cause and the deduction from one correlative to another The acceptance of the possible entity has agent who wills its existence, oppose to the Fakhr al-Dīn al-Rāzī, that this proposition is whether imperative or not. According to him, these propositions are not imperative, they need deduction. In this respect, deduction is necessary for the maʿrifat Allāh. The reason which is considered in the sense of logic in al-Sanūsī is not a structure which merely functions as a analogy and a deduction. On the contrary, according to al-Sanūsī, there is a direction going towards the heart from the point of reason and it seems that the heart is used in meaning of reason. This is an example of al-Sanūsī’s attempt to combine mystical knowledge with reason and legal injunction. This is a remediation project in terms of his time. (shrink)

Yūsuf al-Nabhānī (d. 1932) became famous in the world of science with many works he wrote in the fields of Hadith and Kalam. On the other hand, he is a person who has proven himself with his works and poems in the field of madīh nabawī. For this reason, he was also referred to as Hassān and Busīrī of the period in which he lived. His diwan named al-Sābiqātu'l-jiyād fī madhi seyyidi'l-'ibād is an important work that contains the poems (...) he sang in the type of prophetic madīh nabawī. The divan in question consists of ten couplet odes in which each letter of the alphabet is determined as a rhyme. In these odes, which he wrote to express his love for the Prophet and for some other religious reasons, the influence of classical Arabic poetry and especially Būsīrī can be found. Mystical thought also has a great influence on the poems of Yūsuf al-Nabhānī. As a matter of fact, the narration of the Prophet in his poems is generally shaped in line with the concept of al-Haqīqa al-Muhammedī/al-Nūr al-Muhammedî. In this study, Yūsuf al-Nabhānī will be discussed as a madīh nabawī poet within the framework of his divan. In this context, the content and stylistic structure of his poems will be examined in the axis of literary criteria, and the effect of mystical thought on his poems will be tried to be explained in general terms. Yūsuf al-Ardabīlī is one of the Shāfiʿī jurists who lived in Azerbaijan in the 8th century of Hijri. This scholar, whose birth date we couldn’t find any information about, even though it has been searched in both local and foreign literature, died in Ardabīl in the year 799/1397 as bibliographical scholars agreed on. Ardabīlī is a person known by his work al-Anwār li-aʿmāl al-abrār, which he dedicated to Shāfiʿī jurisprudence, and someone with jurisprudential knowledge whom Shāfiʿī jurists benefit from. (...) In his work on jurisprudence (furūʿ al-fiqh), al-Anwār, he discussed the issues without delving deeply into evidences and partially mentioned uṣūl al-fiqh. Yūsuf al-Ardabīlī addressed the topics in his work by classifying them as acts of worship (ʿibādāt), transactions (muʿāmalāt), inheritance (farāʾiḍ), marriage and divorce (munākaḥāt-mufāraqāt), punishments (ʿuqūbāt), the conduct of judges (adab al-qāḍī), and freeing slaves (ʿitq). Moreover, in his work, he provides explanations that shed light on recent studies by addressing the subject of fatwā in detail. By addressing the fatwā institutions, Ardabīlī includes information on topics like the etiquette of istiftāʾ, fatwā with sharīʿah tricks (ḥiyal sharʿiyyah), and exceptions in divorce (ṭalāq). Because no academic studies have been done on his explanations in this field, the subject requires further attention. Additionally, presenting his explanations on the fatwā institution to the scholarly community is greatly important for shedding light on future studies. Islamic jurists recognize fatwā activities as a duty that requires responsibility in terms of religion and worldly life. Therefore, they do not favor the participation of those who lack knowledge and the capability of deducing religious rulings from sharīʿah evidences in fatwā activities.This study aims to contribute to the Islamic jurisprudence literature by addressing the principles of fatwā procedure through Ardabīlī’s perspective in his work, al-Anwār. The correct understanding of the Qurʾān verses is possible by examining the concepts in them linguistically and revealing the meaning they express in the integrity of the Qurʾān. The verb “h-m-m” is one of these concepts. This verb has been used as sulasi mucerred in a total of seven verses in Āl-i 'Imrān 3/122, al-Nisāʾ 4/113, al-Māʾidah 5/11, at-Tawba 9/13, 74, Yūsuf 12/24, al-Mu'min 40/5. In our study, the aforementioned verses in which the verb “h-m-m” is used, have been (...) examined through the sources of tafsir and based on the meaning of the mentioned word in the unity of the Qurʾān, the verse of "Woman had tend to him. He also tended to the woman. If he had not seen the proof of his Lord. This is what We did to drive away evil and immorality from him. Surely, he is one of Our sincere servants." (Yūsuf 12/24) has been analyzed. First of all, information about the verb “h-m-m” was given within the scope of the conceptual framework, then it was emphasized that in which verses the related verb is used and how it can be considered within the context of the verse in Yūsuf Surah and narrations about revelation reasons of this verse. In the context of the relevant verse, the views in the "Manar Tafsir" have been handled separately since it differs from almost all commentaries in terms of approach. Although it is examined how the relevant verse in Yūsuf Surah is handled in the Bible, this aspect of the subject has not been mentioned because it will not contribute to our study and because of the limited structure of the article. In the handling of our subject, as a method, the integrity of the Qurʾān within the scope of the verb “h-m-m”, the narrations about the revelation reasons and the context of the verse were taken as basis. The aim of our study is to reveal what is meant by the verb “h-m-m” in the mentioned verse, based on the uses of the verb in the Qurʾān and considering the context of the relevant verse and narrations about its revelation reasons. In this context, it can be said that the verb “h-m-m” in the relevant verse of Yūsuf Surah means to decide and attempt an attack in connection with sexual impulses. (shrink)
