Human dignity is the supreme criterion for protecting research participants, and likewise for numerous ethical matters of ultimate importance. But what is meant by “human dignity”? Isn’t this some vague criterion, some sort of lip service of questionable relevance and application? We shall see that it is nothing of the sort, that to the contrary, it is a very definite and very accessible criterion. However, how is this criterion applied in protecting research participants? In light of recent criticisms of the concept of human dignity, this contribution offers a proposal for the continued relevance of the concept for tertiary chaplaincy. It is important to consider the concept of human dignity in tertiary chaplaincy because: many higher education institutions continue to identify human dignity as a key value; the kinds of ethical issues that tertiary students face will often involve appeals to human dignity; and the religious connotations (...) that have come to be associated with the concept fall within the scope of chaplains. Nevertheless, there have been recent calls for the concept of human dignity to be dismissed from ethical discourse as unhelpful. In ethical debate, dignity can be unhelpful when it leads to ‘dignity talk’, when there is disagreement about whether it is something human beings always already have or something that is realised through human activity, or when it conceals what people think is really at stake. In response to these criticisms, this contribution proposes a model for understanding human dignity that affirms the value of the human person as a multi-dimensional, historically-situated being in relationship to all that is, a being who is faced with difficult moral choices through which he or she makes meaning in his or her life. This model has both descriptive value in helping us to understand why people do what they do, and normative value in helping us evaluate what should be done. (shrink)

In earlier studies we have shown that abuse in health care (AHC) is commonly reported among both male and female patients. In this study, we present an evaluation of an intervention against AHC based on Forum Play. The evaluation was conducted by means of pre- and postintervention interviews with the staff at a woman's clinic. The interviews were analysed using the constant comparative method. The results of this postintervention study stand out in loud contrast to the results of the preintervention (...) studies. Staff had moved from a distant and fluctuating awareness of AHC to a standpoint characterized by both moral imagination and a sense of responsibility. (shrink)

Giam, Patrick This article seeks to explore some further ethical and legal issues surrounding the practice of preimplantation genetic diagnosis which was the subject of a 2009 article for BRN. After briefly reviewing the state of regulation of PGD in Australia, focusing mainly on the national Guidelines developed by the National Health and Medical Research Council, I proceed to consider the ethical problems with PGD from the Catholic and natural law position that the embryo is a human person with (...) inherent dignity and the right to life, which forms the basis for revisiting the conclusions reached in my previous article on the proper response to the regulation of such technology. The article discusses human dignity in the aspect of modern challenges of technological civilization, which has entered a new stage of its development. Human dignity as a category of ethics remains underestimated, since in the first row of ethical values humanitarians, as a rule, put the categories of freedom and justice. Today, “dignity” acquires a special and higher status, the concept of human dignity is being rethought, going beyond the ethical category itself as (...) a virtue. In the global world, human dignity is a response to such contemporary challenges as the formation of a communicative world community with a focus on digital civilization, the anthropological problem of the future of humanity, the ecological situation on a global scale, the reorientation of the ethical and legal relations of a globalizing world. Human dignity is a problem of national-ethnic and national-state relations in the transition to transnational regulatory interactions. In the interpretation of the nation, the authors do not share the well-known two approaches to understanding the nation, on the one hand ethnocultural, and on the other - national-civil. Both approaches lead, whenever possible or necessary, to the transnational posing of the question, when human dignity becomes a priority regardless of nationality. In this connection, the utopian idea of the possibility of a global ethos is touched upon. The authors focus on the anthropoxy-axiological approach to the understanding of human dignity, where the cosmological principle of human existence is determined by his creative power. The urgency of the problem of human dignity is due to the fact that, as it were, in the modern life world a person did not put the economy above morality, the basis of human dignity in its being is a value moral consciousness, in the depth of which basic human values of transnational nature “work”, contradicting values consumer society driven by practical interests. Human dignity in this regard should be interpreted as an absolute value and at the same time one should take into account the multidimensionality of the problem of dignity in the context of modern globalization processes. Based on the ontological understanding of globalization as megatrends in the self-movement of the natural historical process, the authors substantiate the anthropological value of human dignity, which has universal, transcultural significance. The use of an anthropoxy-axiological approach and interdisciplinary methods reveals the universal value of virtue, based on the anthropo-social moral nature and the creative value of man. The creative transformational activity itself will not be worthy in quality without moral responsibility. The modern concept of human dignity is addressed to the ethics of responsibility, which means responsibility, which highlights the moral and axiological attitude to life, the adoption of responsible decisions in modern conditions of sociocultural interactions. In the context of globalization, the philosophy of human dignity becomes the dominant of all conscious-volitional activities, the core of the moral rethinking of the transnational and national ratio in the light of tolerance, the ability to non-violence. At the same time, the authors indicate in the formulation of the main issue of the philosophy of human dignity the possibility of going beyond the ethical category of human dignity, since the unchanging core of the universal human values of goodness-beauty-truth does not lose its meaning in the global, changing world. I respond to Lennart Nordenfelt's analysis of dignity by questioning his attempt to establish an objective standard by which dignity can be determined. I approach this by considering the way in which claims to dignity may be contested and defended. This leads, in the cases of dignity of merit and dignity of moral status, to an apparent relativism. This relativism is checked by further consideration of dignity of identity, and in particular by consideration of (...) the nature of the processes that serve to humiliate people. It is suggested that acts of humiliation attack certain competences that human beings develop as embodied, social beings. Menschenwürde may then be articulated as an account of human nature, in terms of the human potential to develop a series of core competences. This account of human nature aspires to universality, and as such offers an objective ground to dignity. Management practices prevailing in business organizations receive considerable criticism for often treating the employee as one of many resources or an instrument to achieve the organization’s goals. As employee reification has so far been largely investigated in the scientific literature from the perspective of neo-Marxist approach, this article seeks to broaden the discussion by showing how social teaching of the Catholic Church can serve to solve the problem of reification. Although there is no doubt that universal norms of business ethics (...) can serve as protection of the employee dignity from the individual’s reification tendencies, moral relativism operating in postmodern life tends to call into question any universal moral norms. Therefore, this article discusses how responses to challenges posed by moral relativism can be obtained by applying methodological approaches proposed by the neo-Marxist classics Lukács, Honneth, and Catholic Social Teaching. The similarities and differences of these approaches are identified, and attention is also drawn to the possibilities and limitations of their application in business ethics practice. It is also demonstrated how understanding of human dignity and the attitude to a virtue, offered by social teaching of the Catholic Church, broadens the discussion on addressing the dangers posed by the person’s reification in organizations. Starting from two observations regarding nursing ethics research in the past two decades, namely, the dominant influence of both the empirical methods and the principles approach, we present the cornerstones of a foundational argument-based nursing ethics framework. First, we briefly outline the general philosophical–ethical background from which we develop our framework. This is based on three aspects: lived experience, interpretative dialogue, and normative standard. Against this background, we identify and explore three key concepts—vulnerability, care, and dignity—that must be observed (...) in an ethical approach to nursing. Based on these concepts, we argue that the ethical essence of nursing is the provision of care in response to the vulnerability of a human being in order to maintain, protect, and promote his or her dignity as much as possible. In her 2003 article in the British Medical Journal, Ruth Macklin provocatively declared dignity to be a useless concept: either a vague restatement of other more precise values, such as autonomy or respect for persons, or an empty slogan. A recent response to Macklin has challenged this claim. Doris Schroeder attempts to rescue dignity by positing four distinct concepts that fall under the one umbrella term. She argues that much of the confusion surrounding dignity is due to (...) the lack of disambiguation among these four concepts, but that once we understand the different values in question dignity becomes a powerful tool in the fields of human rights and bioethics. It is the goal of this paper to build upon Schroeder's insights by reconnecting the multiple strands of dignity she identifies. It will be argued that the usefulness of dignity as a guiding principle in medical ethics can be much improved by identifying the single conceptual link that ties together the various values flying under its banner. That conceptual link is provided by understanding dignity as the capacity to live by one's standards and principles.

As artificial intelligence (AI) integrates across social domains, prevailing technical paradigms often overlook human relational needs vital for cooperative resilience. Alternative pathways consciously supporting dignity and wisdom warrant consideration. Integrating seminal insights from virtue and care ethics, this article delineates the following four cardinal design principles prioritizing communal health: (1) affirming the sanctity of life; (2) nurturing healthy attachment; (3) facilitating communal wholeness; and (4) safeguarding societal resilience. Grounding my analysis in the rich traditions of moral philosophy, I (...) argue that these principles scaffold sustainable innovation trajectories that consciously center shared welfare advancement over detached technical capabilities or efficiency benchmarks alone. Elucidating connections with pioneering initiatives demonstrates fragments of this vision taking embryonic shape, yet pervasive adoption remains largely aspirational to date. Fulfilling dignity-based artificial intelligence demands ongoing collective commitment beyond firms’ profit motives or governance proceduralism. My conclusions urge technology policies and priorities directed toward empowering the vulnerability of people rather than controlling the optimization of systems. (shrink)

Dignity represents the essence of nursing care; hence, nurses are professionally responsible for promoting understanding about the promotion, provision, and preservation of every patient’s dignity, while considering contextual differences. The aim of this study was to explore the factors that influence, promote, or compromise patient dignity. A purposeful sample of 14 participants with hospitalization experience was chosen, and individual in-depth semi-structured interviews were conducted for data collection. Using inductive content analysis, the themes and subthemes related to factors (...) influencing patients’ dignity were explored: “persona” (“personal beliefs” and “personal characteristics”), “communication behaviors” (“verbal interaction,” “body language,” “compassionate behavior,” and “devoting enough time”), and “staff conduct” (“professional commitment,” “adequate human resources,” and “staff’s proficiency and competency”). The findings revealed that it is essential to expand nurses’ insights and knowledge about preserving patients’ dignity and the factors that influence these. Recognizing and focusing on these factors will help nurses to establish practical measures for preserving and promoting patients’ dignity and providing more dignified care at the bedside. (shrink)

Many people are vaguely disquieted by developments (real or imagined) that could alter minds and bodies in novel ways. Romantics and Greens tend to idealize the natural and demonize technology. Traditionalists and conservatives by temperament distrust radical change. Egalitarians worry about an arms race in enhancement techniques. And anyone is likely to have a "yuck" response when contemplating unprecedented manipulations of our biology. The President's Council has become a forum for the airing of this disquiet, and the concept of " (...) class='Hi'>dignity" a rubric for expounding on it. This collection of essays is the culmination of a long effort by the Council to place dignity at the center of bioethics. The general feeling is that, even if a new technology would improve life and health and decrease suffering and waste, it might have to be rejected, or even outlawed, if it affronted human dignity. Background Since dignity is one of the fundamental rights of each patient, maintaining patients’ dignity is essential. Unfortunately, in many cases, particularly among patients with schizophrenia (SCZ), dignity is not fully respected. Nonetheless, there is limited knowledge regarding this matter in Middle Eastern Nations. Research Objective This study aimed to identify the barriers to maintaining dignity for patients with schizophrenia from the perspective of patients with schizophrenia, their family caregivers, and healthcare personnel. Research Design This qualitative (...) study was conducted with patients ( n = 16), family caregivers ( n = 4), and healthcare personnel ( n = 6) who were selected using a purposeful sampling method. The data were collected through semi-structured, in-depth face-to-face interviews until the data reached saturation. Data were analyzed using the Graneheim and Lundman method. Ethical Considerations The Research Ethics Committee of Urmia University of Medical Sciences (IR.UMSU.REC.1401.099). Findings Analysis of the interviews revealed two main themes and five subthemes as the barriers to maintaining dignity for patients with schizophrenia. The main themes included “Black shadow of stigma” (three subthemes: “Facing the fear and discrimination of others,” “Misconceptions in society,” and “Social rejection”) and “Facing violations” (two subthemes: “Basic human rights violation” and “Negative emotional responses”). Conclusion Patients’ dignity with schizophrenia was at a low level due to the negative attitude of society toward these patients. In this respect, the basic human rights violations, social rejection, and misconceptions were abundant in society and care centers. An in-depth comprehension of the threatening factors affecting dignity can assist policymakers in safeguarding their dignity through effective programs. (shrink)

After showing that despite being inherently flawed the concept of dignity cannot be replaced without loss by ethical principles such as “respect for persons,” it is argued that, if dignity be not understood as dignitas, but as bonitas, which emphasizes connectedness rather than excellence and to which the proper response is not respect, but awe, there is no reason not to ascribe it to the human embryo. The question whether or not human embryos have dignity (...) can then be answered in the affirmative on the same pragmatist grounds that ultimately lead us to respect other human persons as possessors of dignity, that is, a special moral worth. With robots being introduced into caregiving, particularly for older persons, various ethical concerns are raised. Among them is the fear of replacing human caregiving. While ethical concepts like well-being, autonomy, and capabilities are often used to discuss these concerns, this paper brings forth the concept of social dignity to further develop guidelines concerning the use of robots in caregiving. By social dignity, we mean that a person’s perceived dignity changes in response to certain interactions and experiences (...) with other persons. In this paper, we will first present the concept of social dignity, and then identify a niche where robots can be used in caregiving in an ethical manner. Specifically, we will argue that, because some activities of daily living are performed in solitude to maintain dignity, a care recipient will usually prefer robotic assistance instead of human assistance for these activities. Secondly, we will describe how other philosophical concepts, which have been commonly used to judge robotic assistance in caregiving for the elderly so far, such as well-being, autonomy, and capabilities, are less useful in determining whether robotic assistance in caregiving is ethically problematic or not. To conclude, we will argue that social dignity offers an advantage to the other concepts, as it allows to ask the most pressing questions in caregiving. (shrink)

Having a sense of dignity is one of the core emotions in human life. Is our dignity, and accordingly also our sense of dignity under threat in elderly care, especially in robotic care? How can robotic care support or challenge human dignity in elderly care? The answer will depend on whether it is robot-based, robot-assisted, or teleoperated care that is at stake. Further, the demands and realizations of human dignity have to be (...) distinguished. The demands to respect humans are based on human dignity and the inalienable high and equal moral standing that everyone has. For human moral agents, these demands take the form of negative and positive duties. For robots, they arguably take the form of corresponding ought-to-be norms. The realizations of dignity consist in variable responses to these demands, by oneself by others, and by society at large. This article examines how robot-based, robot-assisted, and teleoperated care can amount to realizations of dignity. The varieties of robotic care can, in different ways, be responsive to the demands of dignity and recognize humans as vulnerable beings with needs, as autonomous agents, and as rational subjects of experience, emotion, and thought. This essay responds to Bharat Ranganathan's “Comment” on my essay, “The Concept of Dignity in the Universal Declaration of Human Rights” . Addressing key criticisms in this “Comment,” I make the following points. First, neither the idea of inherent dignity being “imparted” to humans, nor the Universal Declaration's implication—through its use of terms such as “inherent” and “inalienable”—that humans participate in transcendent reality, necessarily presuppose a Christian metaphysics. Second, a concept such as “inherent dignity” must be (...) affirmed to be intrinsically heuristic unless we are to assume that its meaning can be completely known within the conditions of existence; but this affirmation does not render such concepts “indeterminate of sense.” Finally, Ranganathan's distinction between“weak” and “strong” senses of transcendence is untenable. If human truths beyond all contingencies are knowable , then there must be a real dimension of meaning that transcends all contingencies. (shrink)

The aim of this study was to understand how nurses experience patients’ dignity in Swedish medical wards. A hermeneutic approach and Flanagan’s critical incident technique were used for data collection. Twelve nurses took part in the study. The data were analysed using hermeneutic text interpretation. The findings show that the nurses who wanted to preserve patients’ dignity by seeing them as fellow beings protected the patients by stopping other nurses from performing unethical acts. They regard patients as fellow (...) human beings, friends, and unique persons with their own history, and have the courage to see when patients’ dignity is violated, although this is something they do not wish to see because it makes them feel bad. Nurses do not have the right to deny patients their dignity or value as human beings. The new understanding arrived at by the hermeneutic interpretation is that care in professional nursing must be focused on taking responsibility for and protecting patients’ dignity. (shrink)

The idea of expressing an opinion on the difficult issue of relating to the anthropological basis of human dignity, arose in response to writings coming from two ideologically very different philosophical positions. The first of these is to be found in the author's academic neighborhood, namely school of Christian personalist philosophy associated with the Catholic University of Lublin. The second, on the other hand, originates from the sphere of libertarian humanist philosophy and expresses itself in a secular concept (...) of human moral autonomy. Ideas coming from these two diametrically opposed standpoints provoke critical reflection; the latter will form the basis on which an alternative concept of human dignity will be outlined. With this aim in mind, analysis of this subject will consist of two parts: the first will take the form of a commentary-style critique, while the second will consist of proposals and clarifications. Ethical reality is coextensive with human dignity. Therefore, one essential way to understand ethics is as the systematic effort to discern the imperatives of human dignity. Seeing ethics in this way highlights the fact that health care institutions have many centers of ethical responsibility (CERs) — the Chief Executive Officer, Board of Trustees, senior management team, etc. The Ethics Committee is only one such CER and not the most important one. These other CERs will benefit (...) from identifying: (1) the fact that they are consistently dealing with ethical reality and making ethical decisions; (2) some critical elements of good ethical decision-making: (i) having the appropriate community; (ii) making the guiding value priorities explicit and specific; (iii) gaining skill in using the needed intellectual tools; and (iv) fashioning appropriate process and structure for discernment. A social responsibility (SR) theory of the press has emerged in various democratic societies worldwide since World War II. The Hutchins Commission in the United States is the source of this paradigm in some cases, but a similar emphasis on serving society rather than commerce or government has also arisen in parallel fashion without any connection to Hutchins. Professionalism and codes of professional ethics are too narrow to serve as the framework for a global SR paradigm of the 21st (...) century. Instead, universal ethical principles are the most appropriate framework, and the cross-cultural axis around which these principles revolve is the sacredness of human life. Embedded in the protonorm of human sacredness are such ethical principles as human dignity, truthtelling, and nonmaleficence. These principles are citizen ethics rather than professional ethics; they are set in the social domain where SR gets its rationale. They provide a frame of reference internationally for assessing local news media practices and formulating codes of ethics. (shrink)

This paper is focused on the ethical dimension of palliative care for the terminally ill. I agree with other authors that the value of human dignity shall be acknowledged as the most important value in this setting. Recognition of the value of dignity as the central value requires responsible palliative care where the relational aspect between care-givers and care-receivers is of the greatest importance. In order to achieve this, dignity as a concept and the notion of (...) dignity in subjective, objective and normative worlds has to be in harmony. In reality, often these separate worlds present various threats to the notion of dignity and to dignified end-of-life care. I think that if we want our palliative care to be of high quality and humane, we have to urge medicine together with medical ethics to search for solutions to these threats to the dignity of patients. I, therefore, propose Leuven personalism to be one of the possible fruitful methodologies for medical ethics and for the promotion of dignity in a palliative care setting. (shrink)

I examine the standard view of dignity in Western literature and Metz’s African community view of dignity as a capacity for communal harmonious living. I argue that moral dignity is not just having a capacity for harmonious communal living, but the moral use of such capacity for the promotion of love, friendship, positive identity and active solidarity, which involves normatively prescriptive and evaluative elements. Thus, a plausible African communal conception of moral dignity, which is founded on (...) a moral conception of personhood and community, involves a combination of capacity and agency that is conceptually tied to communal responsibility and respect for self and others. This indicates that human capacities do not have an inherent moral worth. Capacities are instrumentally good and their worth depends on how they are used to promote the moral good of communal well-being, on which individual well-being or dignity depends. This view captures the various use-senses of dignity, addresses many of the problems with many of the analyses of dignity in the literature, and also indicates its relevance. (shrink)

In their paper titledChoosing death in unjust conditions: hope, autonomy and harm reduction,Wiebe and Mullin argue against the stance of diminished autonomy in chronically ill, disabled patients living in unjust sociopolitical environments who pursue medical assistance in dying (MAiD). They suggest that it would be paternalistic to deny these people this choice and conclude that MAiD should actually be seen as a form of harm reduction for them.This response to their article argues that basing discussions surrounding this important topic on (...) a single bioethical concept does not address the needs of this cohort and is restrictively siloed. The discussion should include considerations of human rights and the need for legislative reforms to address social conditions, in addition to traditional bioethical principles. Work in this area needs to become interdisciplinary and collaborative as well as integrate input from the patients themselves. The concept of the dignity of these patients, in its broadest sense, needs to be infused into the discussion in order to optimise the exploration for solutions for this cohort.The stance of MAiD as harm reduction, in this context, does not meet the definition of harm reduction, nor does it represent a commitment to the best interests of these patients. In 2016, the European Parliament approved the General Data Protection Regulation (GDPR) whose core aim is the safeguarding of information privacy, and, by corollary, human dignity. Drawing on the field of philosophical anthropology, this paper analyses various interpretations of human dignity and human exceptionalism. It concludes that privacy is essential for humans to flourish and enable individuals to build a sense of self and the world.

The International Committee of the Red Cross (ICRC) offers a dilemma for international political theory. ICRC's success as a humanitarian actor in international conflict is credited to its neutral stance. However, ICRC neutrality is vulnerable to serious challenges regarding its supposed avoidance of the political. ICRC neutrality is commonly dismissed as either illusory or impossible. The problem is not grounded in the principle of neutrality itself, though, but rather in the lack of critical engagement with what it means to be (...) neutral on a humanitarian register. ICRC misreads the demands of neutrality in such ways as to permit both partiality and irresponsibility to its mission. Drawing from Roland Barthes' address of the neutral, I argue that international humanitarianism is possible as a neutral movement but that this neutrality can only be such through vigorous and fundamentally political movement responsible to the goals of human well-being and dignity as questions. The desire for dignity informs an individual’s daily activities. Human beings, driven by a universal desire to be recognised and to be seen as dignified people within a society, conduct their actions according to values that are considered dignified. Society informs our disposition toward the dignity of one another. This evokes the question of the true nature of dignity: what is dignity? This chapter seeks to explore and engage with the question of the nature of (...) dignity in African society, drawing on African philosophers’ conceptions of human dignity in personhood within moderate and strict communitarian positions. Is dignity an intrinsic or an instrumental value? Can dignity be both an instrumental and an intrinsic value? These distinctions are very important in moral theory. Is dignity value in itself (an end in itself) or instrumental value (means to an end) or both? Responses to these questions shed light on African conceptions of dignity. (shrink)

Many approaches to dignity endorse the Human Scope Thesis (HST), according to which almost all humans and almost only humans have dignity. I argue that justifications for this thesis are doomed to fail. Proponents of the HST can be broadly divided into two camps, according to how they defend this thesis against the Scope Challenge. This challenge states that there is no non-arbitrary way of restricting the scope of dignity that includes almost all and almost only (...) humans. Naturalistic Accounts attempt to find a property which roughly matches the HST, while Conventionalist Accounts attempt to explain why endorsing the HST is necessary to achieve coherence with the human rights project. I argue that neither strategy overcomes the Scope Challenge. I then draw out the important implications of this. Even as dignity retains relevance to all humans, it must move beyond the mere human, so as to include nonhuman animals. (shrink)

Chronicling the history of gendered and sexualised violence in Zimbabwe, our article upholds the view that what transpired in Judges 19:20–48 offers the contemporary readers some important lessons that are worth pondering over. Looking through feminist hermeneutical lenses, we engage in a comparative analysis of the gender-based violations, human rights abuses, and the lack of hospitality depicted in Judges 19–21 with the lived realities of Zimbabwean women in our contemporary times. The discussion draws to a close by proffering a (...) theology of restorative justice. It is our argument that Zimbabwe needs healing through a non-retaliative response to some wrongdoing that prioritises repairing harm and the recognition that maintaining positive relationships with fellow humans is a core human need. This is the only way forward to reclaim and restore the humanity and dignity of women exposed to diverse forms of gender-based violence in our Mother Earth.Contribution: This article reveals the link between the violations and brutality endured by the woman in Judges 19–21 with the history of sexualised violence in Zimbabwe. It is worth noting that in African Traditional Religion, the three worlds (spiritual, natural, and human) are intertwined and make up the cosmic totality; sexually violating women is tantamount to desecrating Mother Earth. In this paper I argue that the idea of human dignity has a precise and philosophically relevant sense. Following recent works,we can find some important clues in the long history of the term.Traditionally, dignity conveys the idea of a high and honourable position in a hierarchical order, either in society or in nature. At first glance, nothing may seem more contrary to the contemporary conception of human dignity, especially in regard to human rights.However,an account (...) of dignity as high rank provides an illuminating perspective on the role it plays in the egalitarian discourse of human rights. In order to preserve that relational sense regarding human dignity, we can use the notion of moral status, towhich somemoral philosophers have paid attention in recent years.I explore the possibilities of the idea of moral status to better understand the idea of human dignity and its close relationship with human rights. In the traditional understanding, human dignity is often portrayed as a «final», «inherent», and «absolute» value. If human dignity as the core of the status of a human being did indeed have thos characteristics, this would yield a severe limitation for obligations that stem from the moral status of non-human animals, plants, eco systems and other entities discussed in environmental ethics; for obligations that arise from human dignity standardly take priority over the (...) duties toward entities with non-human moral status. Yet, many theorists of human dignity nowadays have given up the traditional picture in favour of a more «contingent» understanding of human dignity that abandons one or more of its traditional characteristics.In this paper, I argue that to the contrary, we have good reasons to think that the three characteristics of human dignity just mentioned can indeed be attributed to a value that deserves the name «human dignity». In a first part, I argue for a specific understanding of the three value characteristics under consideration. After these preliminaries, I show in a second part that given such an understanding, we have ample evidence that we can indeed say that human dignity is an inherent, absolute and final value; and also that these three characteristics are properties of a single value. The concept of human dignity and the relationship between dignity and human rights have been important subjects in contemporary international academia. This article first analyzes the different understandings of the concept of dignity, which has left great influences in history (including the “theory of attribution-dignity”, the “theory of autonomy-dignity” or the “theory of moral completeness/achievement-dignity”, and the “theory of end-in-itself-dignity”); it then exposes the obvious defects of these modes of understanding; finally, (...) it tries to define dignity as a moral right to be free from insult. Meanwhile, the relationship between human dignity and human rights is clarified as a result of this research: Rather than being the foundation of human rights, human dignity is one of human rights. The idea of dignity nevertheless has a particular status in ethics in that it embodies a kind of core moral concern, representing a basic demand rooted in the human self or individuality, and hence representing an important aspect of human rights. We may anticipate that sooner or later, the idea of human dignity will become, together with other human rights, the only intangible cultural heritage of human society. (shrink)

There appears to be a tension between two commitments in liberalism. The first is that citizens, as rational agents possessing dignity, are owed a justification for principles of justice. The second is that members of society who do not meet the requirements of rational agency are owed justice. These notions conflict because the first commitment is often expressed through the device of the social contract, which seems to confine the scope of justice to rational agents. So, contractarianism seems to (...) ignore the justice claims of the severely cognitively impaired. To solve this problem, Martha Nussbaum proposes the capabilities approach. The justifiability condition, on this approach, is met by the idea of overlapping consensus. This essay argues that overlapping consensus cannot meet liberalism’s justifiability condition, nor is it more inclusive of the cognitively impaired. Therefore, we have reason to retain the contract device and look for another way to ensure that liberalism respects the justice claims of all. (shrink)

Kateb asserts that the defense of universal human rights requires two indispensable components: morality and human dignity. For Kateb, morality and justice have sound theoretical underpinnings; human dignity, by virtue of its “existential” quality, lacks its own theoretical framework. This he proceeds to establish with a critique of the writings of canonical Western political philosophers and contemporary thinkers like Peter Singer and Thomas Nagel. The author argues that while morality compels just governments to prevent, reduce, (...) or eliminate human suffering inasmuch as it is possible, people possess and are entitled to dignity by mere virtue of their “status” as human beings. Homo sapiens, he maintains, have a “stature,” manifest in the species's “great achievements,” that exceeds that of other creatures, even in the secular cosmos. (shrink)

This article focuses on human dignity as a moral idea and, in particular, on a single but fundamental question: what conception of human dignity, if any, can generate an egalitarian duty to respect all persons? After surveying two mainstream and two alternative conceptions, the article suggests that explaining how human dignity generates an egalitarian duty of respect may be more difficult than has been appreciated.

Do societies have an ethical responsibility to care for and about the health of undocumented migrants? Some people claim that societies have no responsibility to care for undocumented migrants because these migrants have no legal right to be in the country. But this view tends to ignore ethical responsibilities that are independent of legal status. Other people claim that all human beings, in virtue of their dignity and status as human beings, have a right to (...) the highest standard of health. But this view tends to ignore ethical responsibilities that arise out of relationships between a society and the undocumented migrants who are living and working in that society. In this article, I take a different approach. In the case of undocumented workers, I try to show how these workers are used in the economy and why a widely accepted pattern of responsibility should be extended to them. In the case of undocumented young people, I try to show how these people are socialized in a society and why a widely accepted pattern of responsibility should be extended to them. Toward the end of this article, I reflect on the nature and limits of these arguments. (shrink)

Leon Kass's often-cited essay, “Death with Dignity and the Sanctity of Life,” provides the basis for a case study in the rhetorical function of definition in debates concerning bioethics. The study examines the way a particular definition of “human dignity” is used to maintain an advantage of power in the debate over the morality of physician-assisted suicide. It also considers sources of human dignity that are deflected from attention by the rhetoric of Kass's formulation.

Current developments in biomedicine are presenting us with difficult ethical decisions and raising complex policy questions about how to regulate these new developments. Particularly vexing for governments have been issues related to human embryo experimentation. Because some of the most promising biomedical developments, such as stem cell research and nuclear somatic transfer, involve such experimentation, several international bodies have drafted documents aimed to provide guidance to governments when developing biomedical science policy. Here I focus on two such documents: the (...) Council of Europe's Convention for the Protection of Human Rights and Dignity of the Human Being and the Additional Protocol to the Convention for the Protection of Human Rights and Dignity of the Human Being.I argue that by using human dignity as a criterion to determine the permissibility of particular human embryo research practices, these documents cannot aid in identifying research that would be contrary to human dignity. Thus, they fail to guide public policy on embryo experimentation. Their use of human dignity as a criterion makes their task of offering guidance unfeasible because the concept as used in these documents is too vague and is applied in contradictory ways. I discuss the main goals of these documents and their claims in relation to human embryo research. I then discuss how they have influenced public policy in several countries. Finally, I show that although these Council of Europe treaties attempt to serve as public policy guides in the area of embryo research, they fail to do so. (shrink)
