"Australian legislation and military doctrine stipulate that soldiers ‘subjugate their will’ to" "government, and fight in any war the government declares. Neither legislation nor doctrine enables the conscience of soldiers. Together, provisions of legislation and doctrine seem to take soldiers for granted. And, rather than strengthening the military instrument, the convention of legislation and doctrine seems to weaken the democratic foundations upon which the military may be shaped as a force for justice. Denied (...) liberty of their conscience, soldiers are denied the foundational right of democratic citizenship and construed as utensils of the State. This article critiques the idea of moral agency in Australian legislation and military doctrine and is concerned with the obligation of the State to safeguard the moral integrity of individual soldiers, so soldiers might serve with a fully formed moral assurance to advance justice in the world. Beyond its explicit focus on the convention of Australian thought, this article raises questions of far-reaching relevance. The provisos of Australian legislation and doctrine are an analogue of western thinking. Thus, this discussion challenges many assumptions concerning military duty and effectiveness. When the U.S. conducts warfare, elements of a force are drawn from different services and work together as a single team to accomplish an assigned mission. To achieve such unified action, it is necessary that the doctrines governing the actions of members of specific services be both consistent with and subservient to joint Doctrine. Because warfighting today increasingly involves not only live forces but also automated systems, unified action requires that information technology that is used in joint warfare must (...) be aligned with joint doctrine. It requires also that the separate information systems used by the different elements of a joint force must be interoperable, in the sense that data and information that is generated by each element must be usable (understandable, processable) by all the other elements that need them. Currently, such interoperability is impeded by multiple inconsistencies among the different data and software standards used by warfighters. We describe here the on-going project of creating a Joint Doctrine Ontology (JDO), which uses joint doctrine to provide shared computer-accessible content valid for any field of military endeavor, organization, and information system. JDO addresses the two previously mentioned requirements of unified action by providing a widely applicable benchmark for use by developers of information systems that will both guarantee alignment with joint doctrine and support interoperability. Recent developments such as the 'new wars' or the growing privatisation of warfare, and the ever more sophisticated military technology, present the military with difficult ethical challenges. This book offers a selection of the best scholarly articles on military ethics published in recent decades. It gives a hearing to all the main ethical approaches to war: just war theory, consequentialism, and pacifism. Part I includes essays on justice of war (jus ad bellum), focussing on defence against aggression (...) and humanitarian armed intervention, but also addressing topics such as conscientious objection and the relation of patriotism to war. Articles in Part II deal with the central problems of justice in war (jus in bello): civilian immunity and 'collateral damage' to civilian life and property. Wang Yangming's saying " liangzhi xianzai " has been widely misread to suggest that liangzhi is already complete and perfect, need not and cannot be developed. I argue that "xianzai" means "to be still present" and connotes that something still remains and needs protection. " Liangzhi xianzai " is a dictum instructing learners to engage in moral actions according to liangzhi here and now, and to cut off the calculative mindset about the past and future. Liangzhi is not a timeless (...) substance. It has a special mode of temporality. Yangming's military activities, calligraphy, and philosophical sayings together show that he appreciates the esthetic, moral, and spiritual exercise of immersing oneself in the present moment. Daoism and Chan Buddhism challenged Confucianism by offering a mystical experience of time. In response, Yangming transformed Chan Buddhist "nothought" to explore a Confucian approach to temporal consciousness. This observation changes the conventional narrative about how Chan Buddhism influenced Yangming. (shrink)

Two centuries after Carl von Clausewitz wrote On War, it lines the shelves of military colleges around the world and even showed up in an Al Qaeda hideout. Though it has shaped much of the common parlance on the subject, On War is perceived by many as a “metaphysical fog,” widely known but hardly read. In War as Paradox, Youri Cormier lifts the fog on this iconic work by explaining its philosophical underpinnings. Building up a genealogy of dialectical war (...) theory and integrating Hegel with Clausewitz as a co-founders of the method, Cormier uncovers a common logic that shaped the fighting doctrines and ethics of modern war. He explains how Hegel and Clausewitz converged on method, but nonetheless arrived at opposite ethics and military doctrines. Ultimately, Cormier seeks out the limits to dialectical war theory and explores the greater paradoxes the method reveals: can so-called “rational” theories of war hold up under the pressures of irrational propositions, such as lone-wolf attacks, the circular logic of a “war to end all wars,” or the apparent folly of mutually assured destruction? Since the Second World War, commentators have described war as obsolete. War as Paradox argues that dialectical war theory may be the key to understanding why, despite this, it continues. (shrink)

This presentation explores the significance of just military preparedness, or jus ante bellum as a new category of just war theory, for just war thinking, especially with regard to irregular warfare. It articulates six just military preparedness principles. It further discusses how America’s military preparation fails the JMP principles and how this negatively impacts its capability to justly initiate, execute, and conclude war. This critical analysis takes as its point of departure Defense Secretary Robert Gates’s view that (...) the Pentagon needs to be “reprogrammed” toward a “balanced strategy” of preparing for both conventional and irregular warfare. This book provides an introduction to the real-life ethical issues faced by those serving in modern military forces. With its focus on the practical problems facing those in positions of command, it is of particular relevance to prospective military officers at military academies. Although most unmanned systems that militaries use today are still unarmed and predominantly used for surveillance, it is especially the proliferation of armed military robots that raises some serious ethical questions. One of the most pressing concerns the moral responsibility in case a military robot uses violence in a way that would normally qualify as a war crime. In this chapter, the authors critically assess the chain of responsibility with respect to the deployment of both semi-autonomous and (learning) (...) autonomous lethal military robots. They start by looking at military commanders because they are the ones with whom responsibility normally lies. The authors argue that this is typically still the case when lethal robots kill wrongly – even if these robots act autonomously. Nonetheless, they next look into the possible moral responsibility of the actors at the beginning and the end of the causal chain: those who design and manufacture armed military robots, and those who, far from the battlefield, remotely control them. Is a nation ever justified in attacking before it has been attacked? If so, under precisely what conditions? This volume of new, specially commissioned chapters provides the most definitive assessment to date of the justifiability of preemptive or preventive military action.

Three methods for ethics instruction are used in Taiwanese military education: the ‘bag-of-virtues’, value-clarification and virtue-ethics methods. This article explains, analyzes and discusses each of these, thereby giving an introduction to how military ethics is taught – and thought of – within the Taiwanese military system. Recommendations are given for how to improve the parts of the system that do not seem to live up to the stated intentions.

The men and women who serve in the armed forces, in the words of Major General Joseph Caravalho, “sign a blank check, co-signed by their families, payable to the Army, Navy, Air Force, or Marines, up to and including their lives.” It is human nature to consider such a pact in polarized terms; the pact concludes in either a celebratory homecoming or funereal mourning. But in reality, surviving catastrophic injury may incur the greatest debt. The small but real possibility of (...) losing the ability to bear biological children due to genitourinary combat injury has been a topic of discussion in hushed tones, behind closed doors. But as policy changes move the conversation into the open, we must be fully aware of the far-reaching and long-term impacts of decisions on those who have sustained genitourinary injury. In January 2016, Secretary of Defense Ashton Carter outlined a set of reforms that would improve the quality of life for military families by recognizing the importance of maintaining fertility, even in the face of severe injury. This first promising step could build a solid foundation of insuring fertility preservation for wounded service members with genitourinary injury, and it could set a precedent beyond the military for insuring treatment for people who have lost their reproductive capacity. Thus, the ethical challenges raised by the new policy require careful analysis. (shrink)

This essay explores and partially debunks claims about higher moral standards for all aspects of a military professionals' lives. Using a functional approach, I develop a more restricted but also more defensible version of the claim.

It is common to think of warfare as a setting in which emotion can lead combatants to engage in unethical behavior. On this view, it is natural to conceptualize the aim of military ethics training as quelling the influence of emotion in combat in order to reduce the risk that military personnel are vulnerable to its influence. Recent research, however, indicates that what is called “emotion processing” is connected in important ways with moral judgment and behavior. In this (...) view, acting ethically is not simply a matter of subordinating emotion to reason, but of responding with appropriate rather than inappropriate emotion. In this respect, such research challenges the powerful “rationalist” account of moral judgment and behavior. More fundamentally, it calls into question the distinction between reason and emotion as a way to understand our moral sensibilities. This article describes this research and discusses work on naturalistic decision-making and neuroscience that provide support for its insights. It then suggests ways in which such research is consistent with Aristotelian notions of character and virtue. Finally, it identifies ways in which some military training implicitly draws on lessons from this body of research, and suggests how it might do so more deliberately. (shrink)

In this précis I introduce the topic of the symposium, namely, Oliver D. Crisp’s book, Analyzing Doctrine: Toward a Systematic Theology. I discuss the impetus behind the symposium, provide a précis of Analyzing Doctrine, and preview the various responses to the book given by his interlocutors. I conclude by highlighting some possible new directions for analytic theology.

This chapter attempts to identify some ethical concerns evoked by military engagement in healthcare reconstruction. By bringing empirical evidence to the ongoing debate in military and development communities we aim to shed some light on the central question if and how, from a military ethical point of view, military should be involved in healthcare reconstruction during stabilization and reconstruction operations in Uruzgan.

US foreign policy became one of the most popular issues in public and academic discussions, particularly since George W. Bush was elected president. A lot has been said about the negative effects that the Bush administration had on the world's international relations and peace, mainly with regard to the restraints which are required by jus ad bellum. However, not much has been said about the damage that the Bush administration caused to the norms of jus in bello, by ignoring them (...) or turning a blind eye toward their violations. In this paper, I want to recall a few military and civil reasons which have been neglected for following the requirements of jus in bello by the fighting soldiers and the fighting unit, as well as by the belligerent state. Democratic societies expect their armed forces to act in a morally responsible way, which seems a fair expectation given the fact that they entrust their armed forces with the monopoly of violence. However, this is not as straightforward and unambiguous as it sounds. Present-day military practices show that political assignments, social and cultural contexts, innovative technologies and organisational structures, present military personnel with questions and dilemma’s that can have far-reaching consequences for all involved – not in the last (...) place for the soldiers themselves. A thorough training and education, in which critical thinking is developed and stimulated, seems therefore a necessary condition for morally responsible behaviour.
