Disjunctivism, as a theory of visual experience, claims that the mental states involved in a “good case” experience of veridical perception and a “bad case” experience of hallucination differ, even in those cases in which the two experiences are indistinguishable for their subject. Consider the veridical perception of a bar stool and an indistinguishable hallucination; both of these experiences might be classed together as experiences (as) of a bar stool or experiences of seeming to see a bar stool. This might (...) lead us to think that the experiences we undergo in the two cases must be of the same kind, the difference being that the former, but not the latter, is connected to the world in the right kind of way. Such a conjecture has been called a “highest common factor” or “common kind” assumption. At heart, disjunctivism consists in the rejection of this assumption. According the disjunctivist, veridical experiences and hallucinations do not share a common component. There are a host of interesting questions surrounding disjunctivism including: What is involved in the claims that good case and bad case experiences differ? Why might one might want to be a disjunctivist? What kinds of claims can the disjunctivist make about hallucination and illusion? Readers of Donagan expecting a book in the style of The Theory of Morality will be surprised; Choice: The Essential Element in Human Action is far more compact and demanding. In setting out to support his thesis that the "propositional attitudes" (the term is taken from Russell) of beliefs and wishes explain choices which, in turn, explain human actions, the author considers a plethora of views and objections of both contemporary and traditional philosophers: Gilbert Ryle-whose Concept of Mind Donagan considers a classic of analytic Aristotelianism -Roderick Chisholm, Donald Davidson, Anthony Kenny, John Searle, Alvin Goldman, Elizabeth Anscombe, Bertrand Russell, Plato, Aristotle, Aquinas, Wittgenstein, Quine, and Frege. At times the reader may wish that fewer theorists were appealed to, or perhaps that his or her familiarity with the views referred to were more extensive, or at least that (although not in the case of Frege) they were explicated in more detail. Further explication, however, could obscure hopelessly the line of reasoning of the author. While he appears to wish to give credit every place it is due, he also wishes to clarify the genesis of significant objections to be met by a defensible action theory. Happily, Donagan himself provides an overview of his project, which he calls a " Plan for an Investigation of Human Action on Socratic Lines." This is proffered in chapter one after the author has discussed the " Socratic tradition in the theory of human action " and the question "Should the Socratic tmdition be jettisoned as folk psychology?" BOOK REVIEWS 161 As these sections provide the foundation for Donagan's thesis, they are briefly summarized here. Considering both Aristotle and the " mediaeval Aristotelian " Aquinas to be in the Socratic tradition, Donagan emphasizes Aristotle's role in distinguishing human from animal action. Possibilities for acting are represented in the human intellect in propositions, toward which one can take various attitudes. Those philosophers who hold that such propositional attitudes cannot explain human action are challenged. Donagan then takes on those cognitive scientists who reject as " stagnant " and rooted in folk beliefs the Socratic theory of action. He rather impressively presents the problems involved in admitting, as do the " scientific psychologists," the practicality of employing the notion of propositional attitudes in history and natural sciences (which seem to exist in a context of history), while at the same time actually :rejecting the existence of such attitudes and hence their theoretical validity. Indeed, Donagan brings home the point that it is simply incon· sistent to hold both that there are no beliefs and that the belief that there are beliefs underlies a stagnant research program. Having thus sustained his position :regarding propositional attitudes in general, Donagan summarizes, chapter by chapter, his "contem· po:rary Socratic " plan for examining the actions of rational animals. It will be helpful to sketch this program, filling in crucial portions. In chapter two the author contends that bodily or mental actions are events that are individuals insofar as they are " changes or persistences in states of continuing individual objects" (p. 38). Propositional attitudes are states, but their arising and persistence in being as energeiai are events that explain,actions. Building on Aristotle's teaching and that of his mediaeval successors, in chapter three Donagan argues that beliefs and wishes, or the cognitive and appetitive propositional at· titudes, explain choices which in turn explain actions. When ancient mathematical treatises lack expositions of numerical techniques, what purposes could ancient mathematical theories be expected to serve? Ancient writers only rarely address questions of this sort directly. Possible answers are suggested by surveying geometry, mechanics, optics, and spherics to discover how the mathematical treatments imply positions on this issue. This survey shows the ways in which these ancient theoretical inquiries reflect practical activity in their fields. This account, in turn, suggests that the authors may have intended their theorems (...) not to predict, but to explain phenomena. We may then consider what kind of explanations they were seeking. While the ethics and the sociology of The Open Society can stand up to criticism after 50 years, it is argued that Popper's thesis that closed societies are prompted and promoted by "historicism" cannot. Moreover, Popper's conceptions of "historicism" and of "developmental law" are based on a misunderstanding of our knowledge of history, the practice of historical writing, and the discipline of sociology. This paper presents a quantitative scale of the phenomenon of arson in Poland. Basing on data from the General Headquarters of the Police and Fire Headquarters it analyzes the scale offire danger. It also presents the role of specialists in the detection of causes of fires. The article points the role ofinsurance (...) in the compensation of fire damage. (shrink)

Heidegger’s doubts concerning the concept of “empathy” are unequivocally proven not only by his general tendency to avoid it, but also by his sharp critique of this term, as presented in both Being and Time and the lectures from the Summer Semester 1925, History of the Concept of Time. However, the concept of empathy is used by Heidegger in a positive, albeit rather allusive fashion, in three consecutive lectures of his early Freiburg period: Basic Problems of Phenomenology, Phenomenology of Intuition (...) and Expression and The Phenomenology of Religious Life. The present paper analyzes these three passages of Heidegger’s early lectures in close detail, revealing their connection to the conceptions of empathy found in the works of both Dilthey and Scheler. Thus it aims to connect Heidegger’s rather idiosyncratic conception of intersubjectivity with some of the discussions on that topic in the phenomenological millieu of the early 1920s. (shrink)

It is widely agreed that the top three Model Penal Code culpability levels suffice for criminal liability, but the fourth is controversial. And it isn’t just the particular MPC wording; that negligence should be on the list at all is controversial. My question is: What makes negligence so different? What is it about negligence that gives rise to the view that it should not suffice for criminal liability? In addressing it, I draw attention to how we conduct the debate, and (...) how our framing of the issues is shaping it. My hope is to prompt thought and discussion on just what we want the element of mens rea to provide, and to draw attention to background assumptions that shape our views of what it should take for negligence to count as a species of mens rea. The Book makes readers realize the contradiction between the rules imposed by government and their own conscience. Besides, the act of reading symbolizes the process of growing to reach the truth. The aim of this article is to demonstrate that the theory of changes in perspectives allows a different presentation of the problems which arise from a loss of recognition as an element of punishment, particularly in reference to others, the entire structure of the interaction is changed. Communicative conditions of moral discourses assume that every participant of the argumentation process takes place in all spheres of social life and can assume the perspective common to all other participants. The main task (...) of criminal law is, then, the protection of elementary aspects of one’s role as a participant of interaction without which the chain of mutual recognition and understanding could be freely and at any moment infringed by any given participant of interactions, i.e. the protection of such rights. The capacitive voltage transformer is a special measuring and protecting device, which is commonly applied in high-voltage power systems. Its measurement accuracy is affected seriously by the stray capacitances of the capacitance voltage divider to ground and other charged parts. In this study, based on the boundary element method, a mathematical model was established firstly to calculate the stray capacitance. Then, the voltage distribution of the CVD was obtained by the CVD’s equivalent circuit model. Next, the effect of stray capacitance (...) on the voltage distribution and the voltage difference ratio of CVD was analysed in detail. We finally designed three types of shield and optimized their structure parameters to reduce VDR. The results indicated that the average deviation rate between calculated and experimental measured voltages is only 0.015%; that is to say, the method has high calculation precision. The stray capacitance of the CVD to ground is far larger than that of the CVD to the high-voltage terminal. It results in the inhomogeneous distribution of voltage and the increase of VDR. For the test CVT, its VDR exceeds the requirement of class 0.2. Among all of the three types of shield, the C type reduced the VDR of the test CVT the most. After optimizing the structure parameters of C-type shield, the VDR is further reduced to 0.08%. It is not only in accord with the requirement of class 0.2 but also has an adequate margin. (shrink)

Law article prediction is a task of predicting the relevant laws and regulations involved in a case according to the description text of the case, and it has broad application prospects in improving judicial efficiency. In the existing research work, researchers often only consider a single case, employing the neural network method to extract features for prediction, which lack the mining of related and common element information between different data. In order to solve this problem, we propose a law article (...) prediction method that integrates the characteristics of common elements. It can effectively utilize the co-occurrence information of the training data, fully mine the relevant common elements between cases, and fuse local features. This article explores a training need common to every stage of a teacher’s career : the need to be accompanied. It takes an integrative perspective on the process of the situated learning of teaching, throughout the career, from the pre-service practicums to the period of entrance in the profession then to the in-service training. Providing a reflexive accompaniment of the teachers’ practical experiences is here presented as a central factor for linking the training and the work environments. The first part (...) of the article exposes our conception of a reflexive accompaniment and justifies its importance for the evolution of the teaching practices. Then, we describe how we were convinced of that importance through our role as directors of two teacher training devices, one in Switzerland, one in Quebec. Finally, the third part of the article is devoted to the training of the persons that practice such an accompaniment. (shrink)
