Résumé: La conscience est toujours conscience de quelque chose, généralement une chose autre qu’elle-même - mais quelle sorte de chose est donc la conscience, considérée en et pour elle-même? Naguère redoutable paradoxe qu’une science sérieuse abandonnait volontiers aux philosophes, la conscience a-t-elle été ramenée finalement à la condition d’un objet de science parmi les autres? Le développement d’une nouvelle «neuroscience de la conscience» depuis une vingtaine d’années est souvent présenté comme une avancée naturelle pour une (...) science forte de son succès dans l’explication des fonctions cognitives sur la base des mécanismes neuronaux du cerveau humain. Conçue, elle aussi, originairement, comme «science de la conscience», mais sur la base de l’immanence du sujet conscient à sa propre expérience vécue, la phénoménologie doit-elle réfréner son sens du paradoxe devant le projet de cette neuroscience de la conscience, pour ne pas être accusée d’irrationalisme? Faisant retour sur le dialogue Changeux-Ricœur, je relève les objections du phénoménologue à l’objectivation de notre expérience de la conscience sur la base de mécanismes corrélatifs dans le cerveau et j’examine sur l’exemple représentatif de la théorie neuronale de Changeux, Dehaene et al. dans quelle mesure cette critique phénoménologique garde une pertinence. Resumo: A consciência é sempre consciência de algo, geralmente algo diferente de si - mas que tipo de coisa é a consciência, considerada em si mesma? Paradoxo a pouco tempo temido de que uma ciência séria se entrega de bom grado aos filósofos, será que a consciência foi finalmente reduzida à condição de um objeto da ciência, dentre os demais? O desenvolvimento de uma nova “neurociência da consciência” por cerca de vinte anos é frequentemente apresentado como um avanço natural para uma ciência segura de seu sucesso na explicação de funções cognitivas baseadas nos mecanismos neurais do cérebro humano. Concebida, também, originalmente como uma “ciência da consciência”, mas com base na imanência do sujeito consciente à sua própria experiência vivida, a fenomenologia deve refrear seu sentido de paradoxo frente ao projeto da neurociência da consciência, para não ser acusada de irracionalismo? Retornando ao diálogo Changeux-Ricoeur, considero a crítica da objetivação fenomenológica da nossa experiência de consciência com base em mecanismos internos ao cérebro, e examino o exemplo representativo da teoria neuronal de Changeux e Dehaene et al., para avaliar até que ponto a crítica fenomenológica permanece relevante. In "Nature and Conscience in Butler's Ethics," Nicholas Sturgeon argues that Butler's account of the role of conscience in morality is fundamentally Incoherent. Butler's emphasis upon conscience as the most superior principle rendering acts natural or unnatural is inconsistent with his tacit commitment to the "Naturalistic Thesis" that conscience always uses naturalness and unnaturalness as grounds upon which it bases its approvals and disapprovals. I argue that Butler is not committed to the Naturalistic Thesis, and hence (...) his views are saved from incoherence. This Thesis is not entailed, as Sturgeon claims, by two of Butler's central doctrines, and there are reasonable interpretations of the passages Sturgeon cites that do not conurlt Butler to the Thesis. Butler's view is that the logically primary perception-approvals of acts as virtuous and perception-disapprovals of acts as vicious by themselves can render acts natural and unnatural, respectively, without the need for conscience to rely upon some other superior principle to first determine the naturalness or unnaturalness of acts. This article argues that the peculiarly ‘common law tradition’ separation of common law and equity had at its origins a principled basis in the concept of ‘conscience’. But ‘conscience’ here did not mean primarily either the modern lay idea, or the ‘conscience’ of Christopher St German's exposition. Rather, it referred to the judge's, and the defendant's, private knowledge of facts which could not be proved at common law because of medieval common law conceptions of documentary evidence and (...) of trial by jury. The concept of a jurisdiction peculiarly concerned with this issue allowed the ‘English bill’ procedure to be held back to a limited subject area rather than—as in Scotland and the Netherlands—overwhelming the old legal system. By the later 17th century, however, the concept of conscience had lost its specific content, leaving behind the problem, still with us, of justifying the separation of ‘equity’. (shrink)

This article explores silence and the ethics of conscience through a study of the life and late letters of Sir Thomas More. More's silence is a paradigm case for the contest of conscience under conditions of tyranny, and it is one of the most influential in the formulation of principles of conscience and human rights in modern constitutional democracies. The article focuses on More's prosecution by King Henry VIII, and offers close analysis of the concept of (...) class='Hi'>conscience discussed in his last letters. The approach is historical and philosophical, and puts More's case in dialogue with other classic and modern texts on the ethics of conscience. Emphasis is placed on More's principle of self-determination as essential to conscience. (shrink)

Although many scholars have recognized the pivotal importance that the notion of conscience plays in Hegel’s thought, much of the scholarship surrounding this notion has remained piecemeal. Dean Moyar’s book Hegel’s Conscience breaks new ground on this subject in offering a comprehensive analysis of the indispensable role that conscience plays in Hegel’s philosophy, demonstrating not only its foundational place for Hegel’s approach to ethics, but also the contemporary relevancy of Hegel’s account for understanding the performative character of (...) practical reason. Despite the novelty and intellectual rigor of Moyar’s position, my essay “Translating Convictions into a Clear Conscience” argues that in confining his approach to a “cognitivist” interpretation of conscience, Moyar ends up neglecting the richness and existential depth of Hegel’s discussion. And so although Moyar’s interpretation is clear, succinct, and plausible, it accomplishes this by overlooking much of Hegel’s original phenomenological fidelity to the actual experience of conscience. Dostoevskij’s underground parody of confession paradoxically recovers an Orthodox morality by constructing an unorthodox model of authority and authorship. The authenticity and authority of underground discourse are both contingent on self-conscious parody, which also mediates Orthodox community or sobornost’. This essay critically reconsiders ethical, aesthetic and cultural dimensions of the self-conscious interpolation of literary and religious discourses in Dostoevskij’s Notes from Underground. Arguing with and against Bakhtinian readings, it re-examines the underground narrator’s secularized, Romanticized sensibilities, cynical critique of humanism, sacrilegious (...) modes of laughter, usurpation of authority, internalization of dialogue, literary stylization and parody, aesthetic and moral self-critique, and, finally, insistence on “a new word.”. The compass point of Kantian ethics is Kant’s categorical imperative. The compass point of Kantian ethics directs persons to ends of actions. It directs to ends the attainment of which can be universally prescribed. It directs away from those which can not. Most reviews of the demands of the categorical imperative tend torest in an assay of rationality and its demands. I think that this is a mistake. I think that on Kant’s mature view, the conscience, and so the (...) categorical imperative, have nothing necessarily to do with rationality at all. The following work develops this position. The article begins with a sociologically triumphalist critique of philosophical aesthetics, grounded in the work of Ernest Gellner and Emile Durkheim. It proceeds to note the practical failure of this kind of sociology to become institutionalized within the wider discipline. It explores a number of possible explanations for this failure, but finally suggests that a normalized sociology of art requires a normalized conception of art itself, such as that tentatively advanced by Pierre Bourdieu and Franco Moretti.
