When is a de facto authority not entitled to be considered a `government' for the purposes of International Law? International reaction to the 1991-4 Haitian crisis is only the most prominent in a series of events that suggest a norm of governmental illegitimacy is emerging to challenge more traditional notions of state sovereignty. This challenge has dramatic implications for two fundamental legal strictures: that against the use or threat of force against a state's political independence, and that against interference (...) in matters `essentially' within a state's domestic jurisdiction. Yet although human rights advocates have begun to speak of state sovereignty as an `anachronism', with some expansively proclaiming the emergence of an international `right to democratic governance,' international law literature lacks systematic treatment of governmental illegitimacy. This work seeks to specify the international law of collective non-recognition of governments, so as to enable legal evaluation of cases in which competing factions assert governmental authority. It subjects the recognition controversies of the United Nations era to a systematic examination, informed by theoretical and comparative perspectives on governmental legitimacy. The inquiry establishes that the category of `illegitimate government' now occupies a place in international law, with significant consequences for the legality of intervention in certain instances. The principle of popular sovereignty, hitherto vague and ambiguous, has acquired sufficient determinacy to serve, in some circumstances, as a basis for denial of legal recognition to putative governments. This development does not imply, however, the emergence in international law of a meaningful norm of `democratic governance,' nor would such a norm serve the purposes of the scheme of sovereign equality of states embodied in the United Nations Charter. During the last decade, any questionable or illegal behaviour on the part of businesses has received considerable attention in the media. Using a critical discursive perspective, we here investigate how the media constructs one type of questionable business as illegitimate. Our data draw upon articles dealing with cartels and cartel agreements in Finnish business media covering the five year period 2002-2007. Our contributions are following: We add to the current literature on CSR and national businesses, suggesting that regardless of (...) globalization sociocultural history plays an important role in constructing the illegitimacy of business practices. We therefore emphasize the importance of media as an arena where social actors construct the social contract between business and society. We further contribute to studies on questionable business by reconstructing a discursive framework used to construct cartels and cartel agreements. (shrink)

Gillian Brock’s Justice for People on the Move is an important contribution to the migration literature. While I agree with many of Brock’s arguments, I focus here on a few key points of difference between us. I press three interrelated concerns about Brock’s view: first, the practical implications of her assessment of the state-system’s current illegitimacy remain too unclear. Second, Brock’s human rights-based theory neglects the importance of citizens’ democratic agency, in a way that may have paternalistic implications. (...) Third, Brock’s view is tolerant of inequalities of wealth and power that may enable relations of exploitation, as we see by examining her advocacy of guestworker schemes. Illegitimacy in a historic, single community at Penrith, Cumbria (1557–1812), has been studied using aggregative analysis, family reconstitution and time series analysis. This population was living under extreme conditions of hardship. Long, medium and short wavelength cycles in the rate of illegitimacy have been identified by time series analysis; each represents a different response to social and economic pressures. In a complex interaction of events, the peaks of the cycles in wheat prices were associated with rises in adult (...) mortality which promoted an influx of migrants and a concomitant rise in illegitimacy. The association between immigration and illegitimacy was particularly noticeable after the mortality crises of the late sixteenth and early seventeenth centuries. Children of immigrant families also tended to produce illegitimate offspring. Native and immigrant families responded differently to extrinsic fluctuations, and variations in their reproductive behaviour were probably related to access to resources. (shrink)

An inadequate grasp of the role of imagination has vitiated understanding of human cognition in western thinking. Extending a project initiated with George Lakoff in _Metaphors we Live By_ (1980), Mark Johnson's book _The Body in the Mind_ (1987) offers the claim that all thinking originates in bodily experience. A range of schemata formed during our early experience manipulating a physical world of surfaces, distances, and forces, lays the foundation of later, more abstract modes of thought. In presenting his argument, (...) Johnson lays special stress on the qualities and dynamics of the image schemata, the (generally unnoticed) metaphoricity of the transformations underlying abstract thought, and the new significance that should be attributed to the imagination, which is the general term Johnson wishes to claim for the mental processes he expounds. In this paper I draw attention to the importance of Johnson's insights for understanding literary response. In particular, I will show how a typical procedure of literary texts involves bringing to awareness image schemata of the kind that Johnson describes. At the same time, several problems in Johnson's account which limit its usefulness will also be examined: an undue reliance upon the spatial properties of schemata; a conflation of dead with live or poetic metaphors; and a neglect of other bodily influences on thought, especially kinaesthetic and affective aspects. These problems, for example, limit the usefulness of Johnson's attempt to build on Kant's theory of imagination. In comparison with Coleridge, who also attempted to build on Kant, Johnson is unable to overcome the formalism of Kant's theory. Coleridge's account of imagination, I will suggest, provides a better foundation for examining the bodily basis of meaning, while remaining compatible with Johnson's intentions and his more valuable insights. M'illumino/d'immenso - I'm lit/with immensity is Geoffrey Brock's translation of Giuseppe Ungaretti's poem Mattina. In the poem's minimalism, Ungaretti points to the maximal: the richness of poetry's expressive possibilities and the power of thinking in literature. This book addresses the fascination of readers to transcend the boundaries of their own in fiction, and literature's capacity, according to Kant, even to evoke, with the help of the development of aesthetic ideas, representations that exceed what is empirically and conceptually graspable (...) - in case studies about myths of creativity, images of death and the beyond after the 'death of God', of the soul, of melancholy as the dark ground of genius, of metamorphoses of both evil and good, of ecstasy, of the economy of self-sacrifice, of the art of resistance, and, among others, about figurations of biography and the portrait as approaches to singularity, what is particular and cannot be fully subsumed to any universality. How does literature illuminate the way we live? Maurice Natanson, a prominent champion of phenomenology, draws upon this method's unique power to show how fiction can highlight aspects of experience that are normally left unexamined. By exploring the structure of the everyday world, Natanson reveals the "uncanny" that lies at the core of the ordinary. Phenomenology--which involves the questioning of that which we usually take for granted--is for Natanson the essence of philosophy. Drawing upon his philosophical predecessors Edmund Husserl, (...) Through the examination of anti-psychiatric theory and literary texts, this timely and thought-provoking volume explores the possibilities of liberating our habitual patterns of perception and consciousness beyond the confines of a capitalist era. The semiotic model that disregards the normative context represented by the protagonist examines how we can distinguish the three conceptions of heroism, namely hero, semi-hero, and anti-hero. What are the methodological criteria whereby we can follow the protagonist in the text from beginning to end? To answer them, this article tries to present a model made up of five stages/criteria which constitute a semiotic model by means of which the connection to heroism can be determined. These are: (1) motivation, (2) (...) will, (3) ability, (4) execution, and (5) outcome. These stages can be logically classified into three categories: 1) Pre-action (the first three stages), 2) Action (the fourth stage), 3) Post-action (the fifth stage). The question of what is philosophy, leads, it would seem, inevitably to diverse and conflicting, if not at times contradictory, answers. It is not only a matter of different philosophic perspectives, but also of fundamentally opposed conceptions of philosophy. Varying philosophic intentions and aims underlie what is taken to be the nature of philosophy and disagreement abounds. Philosophies then tend to differ not so much in terms of what they disagree about but what they consider philosophically sound and important. Phenomenology (...) may share some concerns about basic philosophic problems, like intentionality, with ordinary language philosophy. But they diverge again sharply about the question of what philosophy should accomplish for, and what difference it makes to, human knowledge and understanding. The one sees intentionality as the pervasive structure of human consciousness and reality, and the other sees it as simply part of the various ways in which the uses of language can explain, and thus do away with, philosophical questions on perplexity. This difference about what philosophy should accomplish, its purpose, is not resolvable. It is what on each approach must be considered the very nature of philosophy and its primary task. (shrink)

Whether we are aware of it or not, we are profoundly dissatisfied with the stark reality of life's swift progress onward, and the enigmatic and irretrievable meaning of the past. And so we dramatise our existence, probing deeply for a lyrical and heartfelt yet (...) universally valid sense of our experience. It is in great works of literature that we seek those hidden springs that so move us. The United Nations World Tourism Organization has acknowledged 2020 as the worst year in tourism history due to the worldwide pandemic COVID-19. Destinations, tourists, local communities, stakeholders, and residents, and their daily activities were affected. Thus, wellbeing and resilience are two crucial variables to help the industry and the people recover. This research aims to analyze early positive approaches and attitudes to respond to the negative impact of COVID-19 in tourism everyday activities that have at its core wellbeing and resilience, (...) the two main variables of the Positive Psychology field of studies. A systematic literature review was conducted, following PRISMA guidelines to achieve this aim. The research was done using the Online Knowledge Library and all the available databases. The research led to 32 articles that were screened using the inclusion and exclusion criteria. A total of 18 scientific articles met all criteria. Overall, results show that a positive and resilient approach to deal with the adverse outcomes of the pandemic is a concern for stakeholders and the future of the organizations in the tourism and hospitality sector, as is tourists’ wellbeing. However, less research has been done on wellbeing and a clear lack of research regarding residents’ wellbeing and resilience is evident. A deeper study of wellbeing and resilience in tourism is needed, and actual practices and interventions to ensure that all tourism actors have the resources to overcome the pandemic and restart the industry’s daily lives feeling well and safe. Untying Things Together helps to clarify the stakes of the last fifty years of literary and cultural theory by proposing the idea of a sexuality of theory. In 1905, Freud published his Three Essays on the Theory of Sexuality, the book that established the core psychoanalytic thesis that sexuality is central to formations of the unconscious. With this book, Eric L. Santner inverts Freud’s title to take up the sexuality of theory—or, more exactly, the modes of enjoyment to be found (...) in the kinds of critical thinking that, since the 1960s, have laid claim to that ancient word, “theory.” Santner unfolds his argument by tracking his own relationship with this tradition and the ways his intellectual and spiritual development has been informed by it. Untying Things Together is both an intellectual history of major theoretical paradigms and a call for their reexamination and renewal. Revisiting many of the topics he has addressed in previous work, Santner proposes a new way of conceptualizing the eros of thinking, attuned to how our minds and bodies individually and collectively incorporate or “encyst” on a void at the heart of things. Rather than proposing a “return to theory,” Santner’s book simply employs theory as a way of further “tying together” the resources of philosophy, art and literature, theology, psychoanalysis, political thought, and more. Today humanity is in the midst of the massive expansion of new and fundamental technology, represented by advanced artificial intelligence (AI) systems. The ongoing revolution of these technologies and their profound impact across various sectors, has triggered discussions about the characteristics and values that should guide their use and development in a responsible manner. In this paper, we conduct a systematic literature review with the aim of pointing out existing challenges and required principles in AI-based systems in different industries. (...) We discuss our findings and provide general recommendations to be considered during AI deployment in production. Richly illustrated study drawing on art, literature and science to explore Victorian attitudes towards sight.

This paper finds its origin in a debate between Georges Bataille (1897-1962) and Octavio Paz (1914-1998) on what is central to the idea of eroticism. Bataille posits that violence and transgression are fundamental to eroticism, and without prohibition, eroticism would cease to exist. Paz, however, views violence and transgression as merely intersecting with, rather than being intrinsic to, eroticism. Paz places focus on imagination, and transforms eroticism from a transgressive, to a ritualistic act. Eroticism thus functions as an intermediary, turning (...) animal sexuality into ceremony and rite. In this paper, I argue that Paz and Bataille are not fundamentally at odds in their conceptualisation of eroticism. Instead, Paz redefines the locus of eroticism by subverting its unsettling aspects. His conception of eroticism gives precedence to the imagination, which in itself is an act of violation. Imagination transgresses normal life, but this transgression – the violation of the habitual world – also introduces a glimpse of the numinous that Paz associates with belongingness. The paper further explores eroticism, as this is perceived today, and argues that it ultimately eliminates the threshold marked by transgression. The rise of the contemporary pornographic society is marked by a loss of imagination and transcendence, which ultimately reduces the subject into a mere automaton that demands instant gratification. I present a fictional and somewhat unpleasant tutorial. In it a use of the term “ideal political theory” is connected with the reflective equilibrium method: an ideal theory requires no adaptation of specific moral judgments to fit with the theory. I have not been in a tutorial closely resembling this, I should say.

The article explores the possibilities of literary studies as a hermeneutics of the social by focusing on intermediations of literary and social studies in the present and in the early days of the DVjs, i.e. in the 1920s. It first investigates, how sociology interrogates itself by reading detective stories (Kracauer, Boltanski). As a testing ground for the productivity of the proposed orientation the article then takes a closer look at German crime fiction of the interwar years (Perutz, Jacques) and demonstrates (...) how these novels problematize the workings of a social imaginary in the »time of monsters«. This article reconstructs the forgotten friendship between Georges Bataille and the Russian émigré poet and philosopher Boris Poplavsky. Comparing their solar metaphysics, I focus on conceptions of friendship, sacrifice and depersonalisation. First, I retrace Bataille’s relationship to early Surrealis and Russian circles in interwar Paris, with a focus on his friendship with Irina Odoevtseva. I then offer a novel reading of Poplavsky’s poetry through the lens of Bataille’s philosophy, analysing a recurring motif that I call ‘dark solarity’. Uncovering a hidden (...) intertextual dialogue between Poplavsky and Bataille, I argue for Poplavsky’s lasting impact on Bataille’s anti-Icarian sun cult. Finally, my paper demonstrates how Poplavsky’s writings on solar sacrifice, excess and friendship left marks on Bataille’s vision of a solar community, embodied in the secret society Acéphale. The dialogue between Poplavsky and Bataille, I finally suggest, is a missing piece in the entangled history of Russian and French philosophy, as well as an original contribution to discourses on friendship in twentieth-century continental thought. This is a theoretical and methodological statement of what isn’t and what is Cognitive poetics. It is focused on Peter Stockwell’s discussion of deixis; but, I claim, much of what I have to say on Stockwell’s work would apply to some degree to the work of many other critics. I argue that Stockwell translates traditional critical terms into a “cognitive” language, but does not rely on cognitive processes to account for issues related to the texts discussed; and that he uses (...) these terms to label or classify poetic expressions rather than point out their interaction in generating poetic effects. The present paper does not presume to tell what is the “correct” way to handle those terms, but attempts to give examples of how the same terms could be used with reference to cognitive processes, so as to account for poetic effects. This book demonstrates the presence of literature within speech act theory and the utility of speech act theory in reading literary works. Though the founding text of speech act theory, J. L. Austin's _How to Do Things with Words_, repeatedly expels literature from the domain of felicitous speech acts, literature is an indispensable presence within Austin's book. It contains many literary references but also uses as essential tools literary devices of its own: imaginary stories that serve as (...) examples and imaginary dialogues that forestall potential objections. _How to Do Things with Words_ is not the triumphant establishment of a fully elaborated theory of speech acts, but the story of a failure to do that, the story of what Austin calls a "bogging down." After an introductory chapter that explores Austin's book in detail, the two following chapters show how Jacques Derrida and Paul de Man in different ways challenge Austin's speech act theory generally and his expulsion of literature specifically. Derrida shows that literature cannot be expelled from speech acts—rather that what he calls "iterability" means that any speech act may be literature. De Man asserts that speech act theory involves a radical dissociation between the cognitive and positing dimensions of language, what Austin calls language's "constative" and "performative" aspects. Both Derrida and de Man elaborate new speech act theories that form the basis of new notions of responsible and effective politico-ethical decision and action. The fourth chapter explores the role of strong emotion in effective speech acts through a discussion of passages in Derrida, Wittgenstein, and Austin. The final chapter demonstrates, through close readings of three passages in Proust, the way speech act theory can be employed in an illuminating way in the accurate reading of literary works. Interpersonal coordination in soccer has become a trending topic in sports sciences, and several studies have examined how interpersonal coordination unfolds at different levels (i.e., dyads, sub-groups, teams). Investigations have largely focused on interactional behaviors at micro and macro levels through tasks from dyadic (i.e., 1 vs. 1) to team (i.e., 11 vs. 11) levels. However, as the degree of representativeness of a task depends on the magnitude of the relationship between simulated and intended environments, it is necessary to address (...) a discussion on the correspondence between competitive and practice/experimental settings in soccer. The aims of this paper are to: (i) provide a brief description of the main concepts underlying the subject of interpersonal coordination in sports teams; (ii) demonstrate, through exemplar research findings, how interpersonal coordination in soccer unfolds at different scales; and (iii), discuss how coaches and researchers may ensure representativeness for practice and experimental tasks. We observed that papers addressing the analysis of interpersonal coordination tendencies in soccer often resort to dyadic (one vs. one) or sub-group (many vs. many) experimental tasks, instead of full-sized (11 vs. 11) games. Consequently, the extent to which such patterns reflect those observed in competition is somewhat uncertain. The design of practice and/or experimental tasks that rely on sub-phases of the game (e.g., 1 vs. 1, 4 vs. 4) should ensure the preservation of players’ behavior patterns in intended match conditions (11 vs. 11). This can be accomplished by measuring the level of action fidelity of the task, ensuring correspondence and successful transfer across contexts. (shrink)

The prevalence, course and prognosis of diseases in patients referred to tertiary medical centers frequently differ from those treated in primary care settings. Extrapolation of findings from one population to another may therefore be unwarranted. Other factors that contribute to misinterpretation of medical literature include failure to distinguish statistical from clinical significance and advocacy of medical interventions prior to adequate clinical trials.

This essay concentrates on philosophizing that happens outside and in addition to planned philosophical discussions, philosophizing that comes alive in practice, that is intensified in children’s encounters with the world, with others, with language, in play. It contemplates how adults, educators and parents encounter children and are affected by children’s philosophical explorations. What is the role of the adult in children’s philosophical questioning? How can we respond to children’s philosophizing? What does it mean to do so? The essay explores philosophical (...) exercises for early childhood educators in a range of examples from literature – memoirs, autobiographies, fiction and works that play in between those. By thinking through these literary examples, it investigates how educators can prepare for philosophical encounters with children through exercises of reading and thinking. In doing so the essay experiments with a form of writing that itself becomes a philosophical exercise. Through the examples and exercises the essay suggests how early childhood educators can train for a pedagogical immediacy that involves listening to the philosophical and existential questioning in children’s play, tantrums, and silences. The investigations and readings of the examples are not meant to lead to conclusions that can be directly applied in pedagogical practices; neither do they work as arguments for listening or listening in a particular way to children. What we get, and what I am looking for, is rather the experience of working and thinking through these examples. (shrink)

This article examines the controversial issue of blasphemy in literature from the viewpoint of reception inside and outside the academia. The thesis of the article is that blasphemy in literature, though inherently related to religion and language, has a plurality of connotations and interpretations (dissidence, intertextuality, critique of colonialism, discursive strategy, alterity/Otherness, ethnicity, subversive text). Consequently, blasphemy in literature is an incentive for fruitful discussions regarding tolerance, freedom of expression, and the re-situation of the (post)modern self in (...) today’s world, dominated by an uncanny admixture of secular and religious values.
