Throughout history, international health collaboration gradually came into being to counteract the emergence of new diseases. This process went through five stages.:1) Quarantine regulations were established for maritime commerce to safeguard public health. 2) Scientific data were studied to understand the causes of infectious diseases and their modes of transmission; a single solution to the problem was not sufficient because of the diversities of the various factors triggering these diseases. Furthermore, defensive and protective measures adopted in Europe were (...) inadequate after the colonial expansion of European countries. 3) If 19th century international health politics were defensive, the aim in the 20th century was to fight infectious diseases and to eradicate them. This third phase saw the rise of international institutions. These agencies aimed at favouring better health organization in individual countries. 4) The World Health Organization was founded, the aim being to fight existing epidemics, little importance being given to 'emerging diseases'. 5) A series of new infectious diseases and the reemergence of old diseases (a consequence of major ecological changes) that were thought to be eradicated revealed the need for continuous surveillance. The current SARS-CoV-2 crisis raises questions about the challenges faced by nation states and international organisations in offering a coordinated international response to the pandemic, and reveals the great vulnerability of European countries, which are implementing lockdown measures and imposing restrictions on international travel, for the most part on a unilateral basis. Such measures run counter to the prevailing approach of the previous two centuries that developed an international public health space. This article examines the measures (...) adopted by European states in order to contain 19th-century cholera pandemics, which took shape through the development of an international maritime quarantine system, based primarily on the implementation of national regulations and local decision-making. This regime was quickly viewed as ineffective and out of step with liberal ideas that urged a “laissez-faire” approach to public health matters. In its stead, a long-term trend developed towards easing quarantine measures. Nation states supported the internationalisation of the fight against pandemics, which chiefly consisted of externalising quarantine measures to the East in order to eliminate them in Europe. This process was based on a subtle dialectical relationship between the construction of an international public health space and the affirmation of state sovereignty, and continued into the 20th century with the progressive creation of international institutions responsible for advancing global health. The International Labor Organization is not an effective force for raising labor standards in the developing world and could become considerably more effective by taking account of two of the most important and interrelated recent theoretical developments in understanding labor standards. First, countries derive no comparative advantage in the global trading system from most very low labor standards. The ILO should therefore concentrate its energies on lifting these, rather than concentrating on labor standards that are a source of comparative (...) advantage, the elimination of which is resisted strongly and effectively. Second, the tools of game theory may be used to identify the collective action problems that prevent countries from lifting their own labor standards, and create a role for a transnational agency that may assist them. Histories of economic development during the Cold War do not typically consider connections to race science and eugenics. By contrast, this article historicizes the debates sparked by the International Labor Organization’s Puno–Tambopata project in Peru and demonstrates how Cold War development practice shared common epistemological terrain with racial and eugenic thought from the Andes. The International Labor Organization project’s goal of resettling indigenous groups from the Peruvian highlands to lower-lying tropical climates sparked heated debates about the biological specificity (...) of Andean highlanders’ physiques and ability to survive in the tropics. Such concerns betrayed the antitypological consensus expressed in the United Nations Educational, Scientific and Cultural Organization (UNESCO) Race Statements and defended by one of the main proponents of the resettlement project, the Swiss–American anthropologist Alfred Métraux. The concern with Andean racial types was central to the research agenda of the acclaimed Peruvian physiologist Carlos Monge, who endorsed modernization projects that did not entail moving highlanders outside of their traditional climate. The debates sparked by the Puno–Tambopata project demonstrate how Cold War development discourse grappled with racial and eugenic thought from Latin America and the Global South and thereby produced projects of indigenous “improvement.”. Global supply chains (GSCs) present the International Labour Organization (ILO) with a challenge that goes to the heart of its founding mandate and structure, one built on the prominence of nation states and national representatives of employers and workers. In February 2020, discussions in the ILO on the rise of GSCs reached deadlock. To fully understand why the ILO has been unable to address decent work deficits in GSCs greater attention needs to be paid to contestation, power and legitimacy (...) in the deliberation of labour governance. Drawing on the concept of agonistic pluralism we examine the evolution of the ILO’s attempt to establish a new labour standard on GSCs under three empirical phases between 2002 and 2020. We argue that shifting power asymmetries between the tripartite constituents of governments, employers and workers, increased counter-hegemonic contestation, and intensified questioning of the deliberative legitimacy of the adversaries, explain the dissensual relations at the ILO. This article contributes to the literature on labour standards in GSCs in demonstrating how and why contestation underpins the evolution of labour governance over time. (shrink)

The conventional role of the state has, however, simultaneously been challenged by the process of globalization which transcends such national boundaries. This paper questions the dominance of market-based mechanisms (MBMs) as the primary means of climate change mitigation. It argues that, not only they are unsuccessful on their own terms, but also they actually make the task more difficult by the unintended consequence of normalising the act of polluting and crowding out alternatives. The theoretical contribution of the paper is to draw a link between two bodies of literature. The first is the business ethics literature on the dominance of market-based rather (...) than direct regulation, and the second is the literature on market ethics, particularly the work of Michael Sandel on how MBMs crowd out non-market norms. The empirical contribution is to use the international maritime transport sector to illustrate the way market-based regulation renders alternatives such as direct regulation and supply-side approaches invisible. This chapter first addresses the standard definition of international organizations and the theory of functionalism. Then, it examines why the status of international organization may be deemed attractive. Functionalism appears highly plausible when it suggests why international organizations are set up since, obviously, a single state will be unable to guarantee the accurate delivery of mail abroad or provide for collective security. The chapter also focuses on the European Union, which can be regarded as possessing international (...) legal personality. The European Communities were all individually granted legal personality, and this was construed as including personality under international law. Functionalism finds its normative justification in the contribution of organizations to the common good, and the Court of Justice of the European Union's (CJEU), in similar spirit, has placed considerable weight on the public nature of the tasks of an international organization, both in SAT Fluggesellschaft and in Vardakas. International Law in Context is a pedagogy-forward textbook. It reflects the recent paradigm shift in legal education, which focuses more on what students actually learn rather than the material to which they are exposed. The text aims to prepare the next generation of U.S. lawyers to engage with our interconnected world and to critically evaluate the U.S.'s role within the international legal order. The work is divided into three parts that accomplish these goals. Part One lays a foundation. (...) It covers the various actors within the system, the theories that help explain their behavior, and the principles and sources of law they create. Part Two turns to the fora that define and support the international order, the historical and political contexts that impacted their design, and their efficacy. Part Three is a capstone section that asks students to weave together everything they have learned in Parts One and Two. Students will engage in normative development regarding climate change, including the existing international treaty regime and U.S. implementation options, and the law of war in the modern age. The cornerstone of this book is its organization. The text groups material into conceptual frameworks that promote understanding and retention. For example, rather than consider the various dispute resolution fora in isolation, Part Two asks students to consider them in the context of what types of disputes arise and what legal rules can be employed to resolve them in various international and domestic fora. The institutions also are presented in chronology. In this way, students are encouraged to chart the developmental progression and to make connections and comparisons between various institutions. The use of conceptual frameworks continues within each part. For example, Chapter Six covers the sovereign State as a conflict resolution forum. Under this umbrella, the author discusses (a) State Jurisdiction; (b) The Reception of International Law into the Domestic Sphere; (c) The Qualification as a State Forum or State Litigant (i.e., Recognition of States & Governments); and (d) Protections Afforded Within the Forum: Sovereign, Diplomatic, and Consular Immunity. A typical coursebook might locate this material in four different chapters. The conceptual framework approach, however, allows students to see the big picture and the relationship between concepts. In addition to the frameworks, there are several other innovative pedagogical devices that support student learning. There are Foundation Questions that initially direct readers through the material and cumulatively help students confirm whether they have grasped key takeaways from each section. There also are Assessment Sets in each section, which provide students with immediate opportunities to apply material and gauge their understanding, and "Why Is This Important (a/k/a WITI Moment)" prompts designed to delve deeper into the underpinnings and consequences of various rules. This chapter focuses on the implications of economically self‐interested behavior by voters and lobbyists, rather than important issues of irredentism, demagoguery, and security. It also focuses on the political problems of liberalizing migration between poor and wealthy states. Economists often support temporary migration in order to guard against potential adverse effects of brain drain. International organizations can serve to engage in surveillance, communication, and adjudication in order to enforce rules. Responsibility for international economic migration could be assigned to (...) an existing organization or to a new organization. The chapter addresses the possible features of a new international organization addressing migration. It also describes the present migration‐related functions of the International Organization for Migration (IOM), International Labor Organization (ILO), and World Trade Organization (WTO). International organisations are actors capable of bearing moral responsibilities and ought to be accountable for their failures in doing so. However, we should understand these responsibilities and respond to their failures in the light of fuller considerations about morality and the common good. The article argues that the international community should ensure victims are attended to, but also that defaulting institutions may themselves need rehabilitation for different kinds of international common purposes to be achievable. Further, the ways (...) in which both goals are agreed and undertaken must recognise multiple perspectives, else the possibilities for durable peaceable cooperation internationally will be damaged. Even in a world of plural views, we can find sufficient proximity on matters of ‘good’ and ‘bad’ to move toward further agreement. Drawing on Braithwaite, Rawls, and Sunstein, the article argues we should search out and build on such ‘islands of agreement’ on wrongs in international life and on mutually respectful ways of responding to them. Permit me to direct attention to Academician Kapitsa's colorful remark that we all now live in "communal quarters." But these are shared quarters that we came to after living in private ones, and rules of humanistic communal behavior should be established for its residents. This is one of the basic principles on which the set of measures to improve the environment must be built. The Norwegian Association for Heredity Research played a key role in the rise of genetics as a research field in Norway. The immediate background of its establishment in 1919 was the need for an organization that could clarify scientific issues regarding eugenics and coordinate Norwegian representation in the organized international eugenics movement. The Association never assumed this role. Instead, Norway was represented in the international eugenics movement by the so-called Norwegian Consultative Eugenics Commission, whose leader, Jon Alfred Mjøen, (...) was dismissed as a pseudo-scientist by Norwegian geneticists. The paper explores the Association’s role in defining and delimiting scientific expert knowledge in the field of genetics and eugenics in Norway. It demonstrates how struggles about academic authority on the national arena were intertwined with struggles about representation and impact in the international eugenics movement and how transnational scientific networks where mobilized to legitimize and delegitimize notions about Nordic race supremacy, racial mixing and the politics of eugenic sterilizations. The vision and mission statements of 24 environmental organisations were analysed under the premise that the language used in these statements reflects and influences the priorities of their operation. A dominant perspective, hinging on the concept of 'sustainable development', merged the profile of government agencies and non-governmental groups. The language reflected an utilitarian ethics: the environment was more generally portrayed as resources than as nature. Aesthetic remarks were exceptional, even among groups focusing on wildlife. Despite a broadly claimed link between (...) human welfare and habitat viability, environmental issues were not broadly referred to by humanitarian organisations, while conservation groups comply with societal priorities and needs. Organisational statements seem more concerned about political legitimation by audiences with specific expectations than about articulating purposes with internal structural consequences or goals that advocate change or reflect organisational uniqueness. The International Academy of Freedom of Religion and Belief was formed in July 1985 in England as a result of the meeting of the International Working Group on Religious Freedom in UNESCO with representatives of various religious traditions from different countries. The composition of MASRP includes, in the first place, experts and scientists from the departments of state-church relations of universities of different denominations and from different countries of the world - the USA, England, Italy, Spain, Greece, Belgium, (...) Germany, etc. Currently, among the members of the MSDP, there are already scholars and public figures from Ukraine, Russia, Bulgaria and other post-socialist countries. The head office of MASRP is located in Washington, DC. The President of the Academy is James Wood - Professor at Baylor University. The function of the head of the section on the organization of international scientific conferences on freedom of religion is organized by Cole Durem, professor at Bringam-Young University. This article uses the concept of partial organization to examine how organizing principles can facilitate the effective operation of networked forms of corruption. We analyze the case study of a corruption network in the South Korean maritime industry in terms of how it operated by selectively appropriating practices normally associated with formal bureaucratic organizations. Our findings show that organizational elements built into the corruption network enabled coordination of corruption activities and served to distort and override practices within member organizations. (...) The network was primarily organized through the hierarchical organization of a bounded and controlled set of members and, to a lesser extent, through processes of monitoring and sanctions. Given its clandestine nature, the network avoided the use of explicit rules to govern behavior, instead relying on habituated routines to ensure consistent and predictable action from members. We find that organizational elements were rescinded when the corruption network was exposed after the sinking of a passenger ferry, the Sewol. By rolling back its hierarchical organization and reverting to core relationships, the corruption network sought to preserve its center. The article illustrates the explanatory value of studying how the activities of corruption networks are enabled and adapt to existential challenges through partial organization. (shrink)

Public international law is entirely a product of consensualism. The State, which is both the legislator and subject of the world juridical order, only agrees to comply with exterior norms to the extent that it approves of their content. Any treaty, in its contractual nature; any custom, in its consensual nature; any decision of an international organization, in its ability to be en forced, expresses the agreement of the concerned States, whether on a case by case or global (...) basis. National sovereignty is in this way safeguarded. Nothing can be imposed on those who govern without their consent. Indeed, until the middle of the twentieth century, States had succeeded in juridically protecting their free will; or more precisely, their free willfulness. International law required no behavioral norms, and no obligation of tolerance, in regard to a State's own nationals. (shrink)

Paradox — the simultaneous existence of two inconsistent states — has become orthodox. The orthodox is now the paradox. The orthodox world of ordering, controlling and organizing is increasingly opposed to a normalizing world of disordering, disrupting and disorganizing. And organization studies cannot avoid changing its conceptions of reality as that reality changes. In the future, organization studies will be the study of paradox, how to understand it, how to use it. In this book of original contributions addressed to management (...) and organization paradoxes the authors address the new state of the field in terms of representations — representing paradoxes — and materialisations — materialising paradoxes. The themes — although varied, ranging from dialectics to internal tensions; from collaborations to ethics and value conflicts; from resistant labourers and wharfies to cartoon characters such as The Simpsons; from the irrationalities of finance to the psychoanalytic rationalities of auditing, and from issues of governance in Asian and international business to the composition of the new knowledge work force in the business professions — cohere around core aspects of paradoxicality. Overall, the contributions to Management and Organization Paradoxes are diverse and challenging. Each contribution takes a different angle on the central theme. All of the chapters illuminate diverse aspects of contemporary paradoxes in management and organization theory. The book provides, in each of its chapters, a challenge to the still overwhelmingly rationalist views of theory and practice that dominate the field and provides new directions for understanding organizations and management.The contributors are drawn from leading European, Australian and Latin American contributors. Four international codes of conduct (those of the International Chamber of Commerce, the Organization for Economic Cooperation and Development, the International Labor Organization, and the United Nations Commission on Transnational Corporations) are analyzed to determine the ethical bases of the behaviors they prescribe for multinational enterprises (MNEs). Although the four codes emphasize different aspects of business behavior, there is substantial agreement regarding many of the moral duties of MNEs. Organizational aesthetics, both as a body of theory and a method of inquiry, is a rapidly expanding area of the organizational sciences. The Aesthetics of Organization accessibly draws key contributions delineating the emerging parameters of the field. It explains the significance of concepts devised by postmodern thinkers, through which emerge meaning and order in organizations. The essays appearing in these two volumes are based on Keynote and State-of-the-Art Lectures delivered at the XXVth International Congress of Psychology, in Brussels, July 1992. The Brussels Congress was the latest in a series of conferences which are organized at regular intervals under the auspices of the International Union of Psychological Science, the main international organization in the field of Scientific Psychology. The first of those meetings took place in Paris in 1889. An important function of (...) the International Congresses is to promote communication between different specializations in Psychology. Speakers were therefore asked to present lectures and discussions in their own fields of study, in a way that would be accessible to fellow psychologists active in other fields. State-of-the-Art lecturers were specifically asked to prepare a tutorial review on a topic which, in the view of the Program Committee, had recently given rise to particularly important developments. These contributions are included in Volume Two. Keynote lecturers were left free to address whatever subject they felt was of greatest interest. When the journal Minerva was founded in 1962, science and higher educational issues were high on the agenda, lending impetus to the interdisciplinary field of “Science Studies” qua “Science Policy Studies.” As government expenditures for promoting various branches of science increased dramatically on both sides of the East-West Cold War divide, some common issues regarding research management also emerged and with it an interest in closer academic interaction in the areas of history and policy of science. Through a close reading (...) of many early issues of Minerva but also of its later competitor journal Science Studies (now called Social Studies of Science) the paper traces the initial optimism of an academically based Science Studies dialogue across the Cold War divide and the creation in 1971 of the International Commission for Science Policy Studies as a bridging forum, one that Minerva strangely chose to ignore. In this light, attention is drawn to aspects of the often forgotten history of Science Studies in the former Soviet Union and the Eastern European block. Reviewed also are several early discussions that are still relevant today: e.g., regarding differing concepts of Big Science, science and democracy, autonomy in higher education and what conditions are necessary to sustain academic freedom and scientific integrity (some of Edward Shils’ primary concerns). Finally, it is noted how the question of quantitative methods to measure scientific productivity lay at the heart of a “Science of Science” movement of the 1960s has re-emerged in a new form integral to the notion of a “Science of Science Policy.”. The rise of “the rest,” especially China, has triggered an inevitable transformation of the so-called liberal international order. Rising powers have started to both challenge and push for the reform of existing multilateral institutions, such as the International Monetary Fund, and to create new ones, such as the Asian Infrastructure Investment Bank. The United States under the Trump administration, on the other hand, has retreated from the international institutions that the country once led or helped to create, (...) including the Trans-Pacific Partnership ; the Paris Agreement; the Iran nuclear deal; the Intermediate-Range Nuclear Forces Treaty; the United Nations Educational, Scientific and Cultural Organization ; and the United Nations Human Rights Council. The United States has also paralyzed the ability of the World Trade Organization to settle trade disputes by blocking the appointment of judges to its appellate body. Moreover, in May 2020, President Trump announced his decision to quit the Open Skies Treaty, an arms control regime designed to promote transparency among its members regarding military activities. During the past decade or so, both Russia and the United States have been dismantling multilateral arms control treaties one by one while engaging in new nuclear buildups at home. (shrink)

To state the obvious, “health matters”, but health (or its equitable enjoyment) is neither simple nor easy. Public health in particular, which encompasses a broad collection of complex and multidisciplinary activities which are critical to the wellbeing and security of individuals, populations and nations, is a difficult milieu to master effectively. In fact, despite the vital importance of public health, there is a relative dearth of ethico-legal norms tailored for, and directed at, the public health sector, particularly at the (...) class='Hi'>international level. This is a state of affairs which is no longer tenable in the global environment. This article argues that public health promotion is a moral duty, and that international actors are key stakeholders upon whom this duty falls. In particular, the World Health Organization bears a heavy responsibility in this regard. The article claims that better health can and must be better promoted through a more robust interpretation of the WHO’s role, arguing that neither the WHO nor international law have yet played their necessary part in promoting health for all. The United Nations is the world's most extensive international organization whose primary task is to create a new international security framework, the maintenance of international peace and security. United Nations not only to retain the World Health Organization, International Labour Organization, International Court of Justice and other international cooperation organizations, to promote throughout the world from Euro-centric changes to the global system, but also provides a world political center stage, but it has not succeeded (...) in expectations of its founders to establish the international security framework and the security of each country to obtain a new world order. The end of the Cold War can finally restore the UN's ability to successfully perform the duties assigned to it by the Charter, or whether the disappearance of confrontation between the superpowers but exposed the establishment of a global structure of international security barrier deep, although it seems after the were more likely, but will wait and see. The United Nations is the most general international organization in the world at present, the primary mission of which is to establish a new international security framework in order to maintain international peace and security. The UN not only preserved international cooperation organs like the World Health Organization , the International Labour Organization, and the International Court of Justice, and facilitated the transformation of the world from a Eurocentric to a global system; but also provided a focus for world politics. But it has not succeeded in creating an international security framework conceived by its fathers and a new world order from which every state gains a security shield. It remains to be seen whether the end of the Cold War will eventually restore the capacity of the UN to fulfil the role set in its Charter; or whether, as scents more likely, the disappearance of superpower confrontation will only reveal deeper systematic obstacles of the creation of an effective global structure of international security. Elle examinera la trajectoire de son directeur, Albert Pérard (1880-1960), et de son réseau, les stratégies déployées pour s’adapter aux contraintes de la période et plus généralement pour maintenir une coopération scientifique à l’échelle internationale dans un monde fracturé par la guerre et une Europe sous domination nazie. Le Bureau international des poids et mesures fait partie en 1940 des quelques organisations intergouvernementales dont le siège est en zone occupée. Pendant toute la durée de la guerre, il est soumis à la pression du _Militärbefehlshaber in Frankreich_ (MbF), le commandement militaire allemand, et entretient des relations continues avec le gouvernement de Vichy et de nombreuses institutions françaises. This paper examines the implications of the General Agreement on Trade in Services (GATS), the World Trade Organization’s agreement governing trade in health-related services, for health policy and healthcare reform in the United States. The paper describes the nature and scope of US obligations under the GATS, the ways in which the trade agreement intersects with domestic health policy, and the institutional factors that mediate trade-offs between health and trade policy. The analysis suggests that the GATS provisions on market access, (...) national treatment and domestic regulation, which are designed to eliminate ‘regulatory barriers’ to global trade in health services, limit the range of options that state and federal regulators and legislative bodies can employ to regulate the health sector and implement healthcare reforms. As such, the paper identifies the broader social and ethical implications of free trade policy. (shrink)

This article explores the relation between the American-led liberal international order and the persistence of ‘violent extremism’ in the Middle East through a questioning of the role of constitutive aspects of this order, namely territoriality of political organization and capitalist organization of world economy, in contributing to the persistence and recurrent formation of militant Islamist groups. It argues that the historical legitimation crisis of this international order in the Middle East and the other conflict-ridden regions of the Islamic (...) world, and the current globalization of this legitimation crisis in the relatively well-off and democratic states of the western world, contribute to the recurrent explosions of alienation, expressed in the form of militant Islamist groups.
