Charles Babbage was an English mathematician, philosopher and mechanical engineer who invented the concept of a programmable computer. From 1828 to 1839 he was Lucasian Professor of Mathematics at Cambridge, a position whose holders have included Isaac Newton and Stephen Hawking. A proponent of natural religion, he published The Ninth Bridgewater Treatise in 1837 as his personal response to The Bridgewater Treatises, a series of books on theology and science that had recently appeared. Disputing the claim that science disfavours (...) religion, Babbage wrote 'that there exists no such fatal collision between the words of Scripture and the facts of nature'. He argues on the basis of reason and experience alone, drawing a parallel between his work on the calculating engine and God as the divine programmer of the universe. Eloquently written, and underpinned by mathematical arguments, The Ninth Bridgewater Treatise is a landmark work of natural theology. (shrink)

The Ninth Biennial Meeting of the Hegel Society of America was held at Emory University, Atlanta, from Thursday the 9th to Saturday the 11th of October 1986. The theme of the meeting was “Hegel and his Critics: Philosophy in the Aftermath of Hegel.” The attendance at the meeting was large, with over 70 people registered from outside Atlanta, in addition to many from Atlanta itself and surroundings.

Hanlester Network v. Shalala ) marks the first test of the application of the Medicare-Medicaid anti-kickback statute to physician self-referral joint ventures. The most recent development in this ongoing litigation was the April 6, 1995 decision of the Ninth Circuit Court of Appeals, holding the Hanlester Network vicariously liable for its marketing vice president's knowing and willful violation of the antikickback statute. The vice president had offered to pay physician-investors in order to induce their referrals of program-related business.The Hanlester (...) Network was a California general partnership comprised of corporations, clinical laboratories, and individual investors. In Vencor, Inc. v. National States Insurance Co., the U.S. Court of Appeals for the Ninth Circuit held that a Medigap insurance provider was only obligated to pay the rates that Medicare would have paid for the same care.Clarence Rollins purchased a Medigap insurance policy from National States Insurance Company to supplement his Medicare coverage. When Rollins became ill and required care beyond that which Medicare would cover, he received his medical treatment from Vencor Hospital-Phoenix. Upon Rollins's death, NSIC (...) paid Vencor $38,760. Vencor claimed that NSIC owed an additional $132,438 because NSIC was not entitled to the lower care rates established by Medicare. NSIC refused to pay Vencor's higher rates. As a result, Vencor sued NSIC for breach of contract.The U.S. District Court for the District of Arizona held, on a motion for summary judgment, that no breach occurred, and that NSIC was obligated to pay only the lower rates established by Mediare. A Manuscript belonging to the Municipal Library at Tours of the beginning of the thirteenth century contains a portion of a Commentary on Donatus, compiled in the middle of the ninth century by Sedulius of Liège. This copy was left unfinished by the scribe, and the Commentary comprises only about two-thirds of the Ars Minor. A brief note on the manuscript was contributed by Charles Thurot to the Comptes rendus de l' Académie des Inscriptions et Belles Lettres in 1870.

One of the most learned and prolific writers of the ninth century was Remigius of Auxerre . In addition to lengthy expositions of several books of the Bible, he wrote Commentaries on Donatus, Priscian, Eutyches, Beda, the Disticha Catonis, Sedulius, Martianus Capella, Boethius, and Phocas.

This paper discusses the communicability of musical listening, proposes a semanalytical perspective to approach it in terms of communicational production, and summarizes an analysis of the production of musical listenings in the case of Beethoven’s Ninth Symphony. Instead of assuming that verbal talk on music banalizes listening, or that musical arrangers are the privileged authorities when it comes to transmitting a personal listening, our suggestion is that communication produces – in the post-structuralist sense of the word – musical listenings (...) even when it seems to simply try and account for it. In a transmissive, “phenotextual” comprehension, listening may be understood as a phenomenological, receptive act that pre-exists its communication. Instead, our communicational research on musical listening turns to the listening-accounts in order to grasp the “listenabilities” as they emerge within specific listening-territories that “genotextually” produce their regulations and habits. This semiotic production is methodologically investigated, here, in terms of interpretant signs, especially as Normal Interpretants, within a particular listening-territory. Three remarks are made on the genotextual operations that produce “insufficiency,” “monumentality,” and “distinção” as listening normalities. (shrink)

Having recently chosen to lecture on the Pythian Odes, and coming in due course to the ninth, I naturally consulted Dr. Farnell's translation and his article in the Classical Quarterly with regard to the puzzling question of the connexion in thought between lines 76–96 and the rest of the ode. Being more or less dissatisfied both with his views and with those of such other commentators as were known to me, I am now attempting to analyze the poem myself (...) in hopes of showing that it is a more continuous whole than has been generally supposed. This paper discusses the eighth and ninth Karmapas' representation of Prāsaṅgika-Madhyamaka. The ninth Karmapa, Wangchuk Dorjé (1556–1603), outlines a Prāsaṅgika system that can only be articulated through denials and/or by deference to what is "acknowledged by others" ( gzhan grags ). He thus affirms a view of Prāsaṅgika only and always in terms of what is acknowledged by others, but never in terms of any view acknowledged by the Prāsaṅgika tradition itself. This paper explores the implications of Wangchuk (...) Dorjé's unique Prāsaṅgika interpretation, as well as the parallel portrayals of Madhyamaka in the works of the eighth Karmapa, Mikyö Dorjé (1507–1554), which influenced Wangchuk Dorjé and were inspired in part by the Sakya scholar Taktsang Lotsawa (1405–1477). The paper will also situate this interpretation of Madhyamaka historically and philosophically against the backdrop of Mahāmudrā in the Karma Kagyü tradition. (shrink)

Should we affirm our hope or let go of it? And, if we embrace hope, what should we hope for and what can inspire (...) us? Between sixty and seventy people, from sixteen countries, came together to address questions such as these at the ninth conference of the European Network of Buddhist-Christian Studies, held in glorious weather at Liverpool Hope University in England, between 30 June and 4 July 2011.At the heart of the conference were ten keynote presentations on five crucial aspects of the theme of hope: "Hope and the Critique of Hope," "Hope in Pastoral Situations," "Embodiments of Hope," "Hope in Situations of Hopelessness: Engaged Buddhism and Liberation Theology," and "Eschatologies of Hope." Dr. Sybille Fritsch-Oppermann (Church of Southern Hesse) gave the introductory lecture, which suggested that hope can be seen both as a utopian ideal within and beyond living religions, and a working hypothesis, through which humans can strive toward truth and transcendence.Each theme was addressed from a Buddhist and a Christian perspective, followed by a plenary to enable dialogue between the speakers, and between speakers and participants. Addressing the first theme, "Hope and the Critique of Hope," from a Buddhist perspective, Richard Gombrich (Balliol College, Oxford) robustly argued that hope was not a category relevant to Theravada Buddhism, distinguishing between hope and confidence, and hope and expectation. Within the rich literary tradition of the West Syrian (i.e., Syriac Orthodox) Church, two ninth-century authors stand out thanks to a curious problem. The authors are the bishops John of Dara, who lived in the first half of the century, and Moses bar Kepha, who died in northern Iraq in 903. The problem is the literary relationship between several of the texts transmitted in their names. Applying a three-pronged approach to this synoptic problem, this article offers a path toward (...) a solution. On the basis of biographical, stylistic, and philological arguments, it is argued that at least one text that goes under John’s name, On Heretics, was not in fact written by him. The author of that text, likely operating in the tenth century, drew heavily from Moses bar Kepha’s treatise On Paradise, while reshaping the material from Moses, and also incorporating additional material from other sources. If Justice Louis Brandeis were alive to witness San Francisco’s recent experiment with universal health care legislation, he might amend his famous characterization of the states as “laboratories of democracy” to include municipalities as well. In San Francisco, where ten percent of residents have no health insurance and where fifteen percent of businesses provide no health coverage for their employees, the Board of Supervisors recently passed the San Francisco Health Care Security Ordinance, which funds a network of primary care services (...) for uninsured residents. While the Ordinance has, in the main, met with general approval, its provision mandating contributions from local businesses that do not meet minimum health spending requirements is the subject of ongoing litigation. The Ninth Circuit Court of Appeals recently ruled in the city’s favor, thereby allowing the spending provision to go forward pending a full appeal on the merits of the case. (shrink)

On October 14, 2003, the Supreme Court announced that it would not review a Ninth Circuit Appeals Court ruling that enjoined the federal government from punishing doctors who recommend medical use of marijuana to their patients. The Ninth Circuit case, Conan v.Walters, drew a fine line in distinguishing betweendispensing information and dispensing controlled substances, and held that [p]hysicians must be able to speak frankly and openly to patients under the First Amendments. Although unauthorized use and distribution of marijuana (...) is prohibited, the court found that a doctor s recommendation does not itself constitute illegal conduct that doctors should be free to recommend the use of medical marijuana if based on sincere medical judgment, without fear of retaliation by a government probe or prosecution. Rice, Robert James William Gleeson was born in Balaklava, a town in the mid-north of South Australia, on 24 December 1920. The son of John Joseph Gleeson and Margaret Mary O'Connell, he was the third born of six children - the elder brother of Thomas, John and Raphael (Ray), and the younger brother of Mary. The first-born child, also Mary, born in Balaklava on 6 May 1918, died one hour after birth. She was baptised during her short life.
