On October 14, 2003, the Supreme Court announced that it would not review a Ninth Circuit Appeals Court ruling that enjoined the federal government from punishing doctors who recommend medical use of marijuana to their patients. The Ninth Circuit case, Conan v.Walters, drew a fine line in distinguishing betweendispensing information and dispensing controlled substances, and held that [p]hysicians must be able to speak frankly and openly to patients under the First Amendments. Although unauthorized use and distribution of marijuana is prohibited, (...) the court found that a doctor s recommendation does not itself constitute illegal conduct that doctors should be free to recommend the use of medical marijuana if based on sincere medical judgment, without fear of retaliation by a government probe or prosecution. The concept of animal welfare refersto the animal''s quality of life. The choice ofdefinition always reflects some basicvaluation. This makes a particular conceptionof welfare value-dependent. Also, the animalhusbandry system reflects certain values oraims. The values reflected in the chosenconception of animal welfare ought tocorrespond to values aimed for in the husbandrysystem. The IFOAM Basic Standards and otherwritings dealing with organic animal husbandryshould be taken as a departure point for adiscussion of how to interpret the conceptionof welfare in organic farming systems. Theconception of welfare is related to two corevalues in the organic agriculture movement.These core values should be considered in termsof (1) aim for holistic view and (2) aim forsustainability. A third, implicit core value,based on bio- and ecocentric views: (3) respectfor nature is needed as a supplement to thesetwo core values. There are importantimplications of these core values for an``organic'''' conception of animal welfare and forconfronting two dilemmas due to conflictinginterests. Comparisons among the three commonlyused welfare definitions will show thesuperiority of the third approach, which canprovide an outline for a conception of animalwelfare more suitable for organic farmingsystems. This outline combines a holisticecocentric approach with respect for theindividual animal, and it can be used as thebasis for a complex definition with emphasis onnatural behavior. Such a systemic approachconsiders welfare in relation to differentsystemic levels. The systemic view also offerspossibilities for resolving the dilemmas in newways. (shrink)

This article explores what an ethicfor organic animal husbandry might look like,departing from the assumption that organicfarming is substantially based in ecocentricethics. We argue that farm animals arenecessary functional partners in sustainableagroecosystems. This opens up additional waysto argue for their moral standing. We suggestan ethical contract to be used as acomplementary to the ecocentric framework. Weexpound the content of the contract and end bysuggesting how to apply this contract inpractice. The contract enjoins us to share thewealth created in the agroecosystem (...) (by ourjoint contributions) by enjoining us to carefor the welfare and needs of the individualanimal, and to protect them from exploitation(just as human co-workers should not beexploited). The contract makes promoting goodanimal welfare a necessary condition forbenefiting farm animals. Eleven organic and two conventionalSwedish livestock farmers and two initiators(non-farmers who took part in shaping earlyorganic livestock production in Sweden) wereinterviewed, using a semi-structured method.Respondents were selected through purposive andheterogeneous sampling with regard toconversion year, type of production, and sizeof farm. Conversion of the animal husbandrytook place between 1974 and 2000. All but twohad positive attitudes towards organiclivestock production and saw it as a wayforward for Swedish livestock production,although especially the latecomers did notperceive it as the only alternative. There wasa (...) distinct difference in values between thepioneers, who converted their farms early, andthose converting later. Pioneer farmers sharedthe values of the initiators. They expressed amore ecocentric view emphasizing a systemicapproach, and displayed a more holisticapproach to questions, interpreting them inlarger frameworks. They also had a moreecocentric understanding of animal welfare. Thelater the conversion, the more important theeconomic reason for conversion appeared to be.Those converting later also tended to have amore superficial relationship to organicprinciples. However, the farmers also tended tobe more influenced by organic values the longerthey worked with organic farming. (shrink)

A questionnaire study was performed among Swedish organic livestock farmers to determine their view of animal welfare and other ethical issues in animal production. The questionnaire was sent to 56.5% of the target group and the response rate was 75.6%. A principal components analysis (exploratory factor analysis) was performed to get a more manageable data set. A matrix of intercorrelations between all pairs of factors was computed. The factors were then entered into a series of multiple regression models to explain (...) five dependent variables. Respondents were well educated and had long experience of farming. 81% were full-time farmers. They generally had a very positive attitude towards organic animal husbandry. They considered allowing animals their natural behavior a central aim, which is in accordance with organic philosophy. Farmers tended to be less approving of concepts like animal rights, dignity, and intrinsic value. When analyzing correlations between the factors, two groups of farmers emerged that were only partially correlated, representing different attitudes and behavioral dispositions. These may be interpreted as two subpopulations of organic livestock farmers in Sweden: those who saw organic farming as a lifestyle (``pioneer attitude'''') and entrepreneurs, who considered making money and new challenges more important. Their view of animal welfare differed. While the pioneers considered natural behavior a key issue, this was less important to the entrepreneurs, who also had a more approving attitude towards invasive operations such as castration and were more critical of the organic standards. Several writers on animal ethics defend the abolition of most or all animal agriculture, which they consider an unethical exploitation of sentient non-human animals. However, animal agriculture can also be seen as a co-evolution over thousands of years, that has affected biology and behavior on the one hand, and quality of life of humans and domestic animals on the other. Furthermore, animals are important in sustainable agriculture. They can increase efficiency by their ability to transform materials unsuitable for human consumption (...) and by grazing areas that would be difficult to harvest otherwise. Grazing of natural pastures is essential for the pastoral landscape, an important habitat for wild flora and fauna and much valued by humans for its aesthetic value. Thus it seems that the environment gains substantially when animals are included in sustainable agricultural systems. But what about the animals themselves? Objections against animal agriculture often refer to the disrespect for animals’ lives, integrity, and welfare in present intensive animal production systems. Of the three issues at stake, neither integrity nor animal welfare need in principle be violated in carefully designed animal husbandry systems. The main ethical conflict seems to lie in the killing of animals, which is inevitable if the system is to deliver animal products. In this paper, we present the benefits and costs to humans and animals of including animals in sustainable agriculture, and discuss how to address some of the ethical issues involved. (shrink)

Physician prescribing practices contributed to the US opioid epidemic, leading to increased regulation of opioid prescribing. In some instances, prescribers are unscrupulous or corrupt. They are criminally investigated and subject to prosecution. Less egregious opioid prescribing infractions are addressed through state medical licensing boards. At stake are physicians’ licenses to practice medicine.

In organic philosophy, the concept of naturalness is of major importance. According to the organic interpretation of animal welfare, natural living is considered a precondition for accomplishing welfare and the principal aims of organic production include the provision of natural living conditions for animals. However, respective regulations are lacking in organic legislation. In practice, the life of a calf in organic rearing systems can deviate from being natural, since common practices in dairy farms include early weaning, dehorning, or cow-calf separation (...) soon after birth. This case study explores how calf welfare is approached in six different organic dairy farms and how far the concept of naturalness is implemented. The farms included in this study were located in Norway and Sweden. A semi-structured questionnaire was used for data collection. The interviewed farmers approach the concept of welfare in various ways and state that naturalness is an aspect of animal welfare. However, in practice in the calf rearing systems under study, only a few naturalness aspects were implemented. Reasons for the observed discrepancy might lie in differing understandings of naturalness, in economic restrictions, and in other trade-offs resulting from production system inherent characteristics and in limited regulation concerning provision of natural living aspects. The first session was titled “The Boundaries of Knowledge in Buddhism, Christianity and Science.” The theme for the second session was “Buddhist-Christian Dialogue in an Age of Science.”The (...) first session, a panel discussion of The Boundaries of Knowledge in Buddhism, Christianity and Science, edited by Paul Numrich (Göttingen: Vandenhouek and Rupricht, 2008), considered the epistemological questions raised by Buddhist, Christian, and scientific insights on the inadequacies of conceptualization and language for understanding reality. The project that produced the book was funded by the Templeton Foundation, which also generously supported this panel.After a welcome by moderator Miriam Levering (University of Tennessee), the book’s editor, Paul Numrich (Theological Consortium of Greater Columbus), gave a brief overview of the volume, followed by reflections on their chapters by two contributors: Dennis Hirota (Ryukoku University) and Paul Ingram (Pacific Lutheran University). Amos Yong (Regent University School of Divinity) responded to Hirota’s chapter, and Sandra Costen Kunz (Phillips Theological Seminary) responded to Ingram’s. Hirota and Ingram each made a few remarks on these responses, leading into an open discussion including other contributors to the book: John Albright (Lutheran School of Theology), Roger Blomquist (Argonne National Laboratory), Tom Christenson (Capital University), and David McMahan (Franklin and Marshall College).Hirota’s paper, based on his chapter “Shinran and Heidegger on Truth,” examined the epistemology of Shinran (1173–1263), founder of the Japanese Shin Pure Land Buddhist tradition. Hirota noted that for both Shinran and Martin Heidegger (1889–1976) [End Page 197] truth is less a matter of asserting propositions and more a matter of the recognition and turning away from prior perceptual distortion. This permits the emergence of a new structure of awareness, an emergence that parallels Thomas Kuhn’s paradigm shifts in scientific understanding.In his response, Yong called for a greater role for different “particularistic or even confessional approaches” within “the religion-science discussion.” He thus noted with appreciation the grounding of Hirota’s paper in a Buddhist tradition that is not “broadly Tibetan,” like much work in Buddhist-science dialogue. He compared and contrasted Shinran’s teachings about the corruption and purification of human reason with those of the Council of Dordt’s five-point condensation of Protestant reformer John Calvin’s soteriology, pointing out that both have a salvific intention.Ingram argued that while science has amassed reliable information about physical reality, and Buddhist and Christian practitioners have amassed reliable knowledge about the structures of human experience, all three traditions confront epistemological boundaries imposed by their methods of inquiry. Questions arising at these boundaries form the foundation for a science-Buddhism-Christianity trialogue. Noting that science demonstrates that “nature is rooted in a realm... only half-translated into our phenomenal experience,” Ingram reviewed how scientists and Buddhist and Christian practitioners “work back from relevant experiences on the phenomenal level, and then ask what hypothetical reality might constructively explain these experiences.”Kunz pointed out that in his examples of “working back” from experience toward hypotheses, Ingram cites many reasons for epistemological humility. Noting her research on how methods of Christian spiritual discernment might yield hypotheses for reducing the ecological crisis, she argued that Christians who have ignored the boundaries of human knowledge have contributed to this crisis. In lieu of an abstract, here is a brief excerpt of the content:Ignorance, Knowledge, and Omniscience: At and Beyond the Limits of Faith and Reason after Shinran:Reflections on The Boundaries of Knowledge in Buddhism, Christianity, and Science, with Special Attention to Dennis HirotaAmos YongAlthough published in the series Religion, Theologie und Naturwissenschaft, Paul Numrich's edited volume is really about epistemology in religion and science, in particular about human knowing in Buddhist and Christian traditions shaped by the world of science on (...) the one hand, and how such knowing might also inform scientific knowledge on the other hand.1 The panoply of positions is presented by both Buddhist and Christian thinkers.From the Buddhist side, the following arguments are sketched:• that religion and science are complementary modes of knowing and that "understanding the true nature of the physical world" opens up "the way to enlightenment" (Trinh Xuan Thuan).2• that Buddhism is both continuous with (and hence deserving of serious consideration amidst) the epistemic discourses of modernity in many respects and yet also discontinuous with (and hence capable for critically interrogating) modernity's epistemology in other respects as well (David L. McMahan).3• that a Shin Buddhist approach to human knowledge—which in this chapter is brought into dialogue with Martin Heidegger's (1889-1976) notion of truth—opens up to a Kuhnian philosophy of science that emphasizes how paradigmatic shifts occur when new perspectives replace older frameworks (Dennis Hirota).4• that the questions raised by theoretical and quantum physics provide a scientific framework for discussing fundamental epistemological, ontological, and metaphysical questions that Buddhists and Christians might otherwise disagree about (Mark T. Albright).10The foregoing summaries do not do justice to the complexity and sophistication of the chapters in the book. However, they provide a broader context for my interactions with Dennis Hirota's chapter on Shinran's (1173-1263) epistemology and its implications for both religious and scientific knowledge. As an evangelical Christian, I am particularly intrigued by the challenges confronting a Shin Buddhist approach to the sciences, even as I am hopeful that such a consideration will precipitate creative insights both for the Buddhist-Christian encounter and for the religion-science dialogue. I am all the more motivated since I have long been convinced that the religion-science dialogue has been dominated by generically religious approaches and that it is time for more particularistic or even confessional positions to be registered in the discussion.11 I am optimistic that the specificity of the Shin tradition will provide both complementary and contrasting perspectives to the contemporary Buddhist encounter with science that has so far been dominated by the broadly Tibetan approaches of His Holiness the Fourteenth Dalai Lama (1935-) and those in his circle of dialogue partners,12 and that this will in turn open up new trajectories—even initiate new paradigms, as Hirota suggests—for the Buddhist...
