If we are looking for an Ur-explanation for the persistence of the Ur-myth, or any other myth, in our literature, could we not more directly find it in the structure of a mind which does not have to remember in order to imitate? The occasion of both myth and literature is the social life of the species which, in Starobinski's sense, is a history of continual eviction; but as regards the apparatus of thought by which this social life is reflected (...) in art it is more a history of assimilation and repetition. Climate change is one of the most important issues we are currently facing. There are many ways in which states can fight climate change. Some of them involve interfering with citizens’ personal lives. The question of whether such interference is justified is under-explored in philosophy. This paper focuses on a specific aspect of people’s personal lives, namely their informational privacy. It discusses the question of whether, given certain empirical assumptions, it is proportional of the state to risk its citizens’ (...) privacy or to risk infringing its citizens’ right to privacy to fight climate change. The main claim this paper argues for is that if fighting climate change and protecting our privacy conflict, we have good reason to fight climate change rather than protect our privacy. (shrink)

Three issues related to Feldman and Levin's treatment of biological variability are discussed. We question the usefulness of the indirect component of δλ. We suggest that trade-offs between speed and accuracy in aimed movements support identification of δλ, rather than λ, as a control variable. We take issue with the authors' proposal for resolving redundancy in multi-joint movements, given recent data.

Intuitively it has seemed to many that our concepts conscious state and conscious creature are sharp rather than vague, that they can have no borderline cases. On the other hand, many who take conscious states to be identical to, or realized by, complex physical states are committed to the vagueness of those concepts. In the paper I argue that conscious state and conscious creature are sharp by presenting four necessary conditions for conceiving borderline cases in general, and showing (...) that some of those conditions cannot be met with conscious state. The complexity of the real history of economic planning in practice, as well as the variety of rationales that have been offered in theory for various (more or less comprehensive) forms of planning, both suggest that political philosophy would benefit from a more nuanced and less simplistic approach to the discussion of state planning of the economy. The aim of our article is to clear some ground for a discussion of markets and democratic economic planning within normative political philosophy (...) that takes a less stark and dichotomous approach in considering the relationship between markets and state planning, and takes more account of the complexities of both the theory and historical practice of economic planning. The article considers some of the different varieties of democratic economic planning, and the rationales for different forms of imperative and indicative planning regimes, as well as other alternative planning mechanisms. In particular the article looks to bring renewed attention to the theoretical rationales for planning offered by two important theorists of the mixed economy: James Meade and Stuart Holland. We close by revisiting the powerful normative case for economic planning provided by Barbara Wootton, whose rejection of F. A. Hayek’s critique of planning, as well as her positive case for planning on grounds of freedom, democracy, and social equality, deserves to be much better known, and whose work is ripe for reintegration into contemporary normative discussions of social justice and political economy. Virtually every figure in the climate justice literature agrees that states are presently failing to discharge their duties to take action on climate change. Few, however, have attempted to think through what follows from that fact from a moral point of view. In Climate Justice Beyond the State, Lachlan Umbers and Jeremy Moss argue that states’ failures to take action on climate change have important implications for the duties of the most important actors states contain within them – sub-national (...) political communities, corporations, and individuals – actors that have been largely neglected in the climate justice literature, to date. Sub-national political communities and corporations, they argue, have duties to immediately, aggressively, and unilaterally reduce their emissions. Explainable AI (XAI) provides methods to understand non-interpretable machine learning models. However, we have little knowledge about what legal experts expect from these explanations, including their legal compliance with, and value against European Union legislation. To close this gap, we present the Explanation Dialogues, an expert focus study to uncover the expectations, reasoning, and understanding of legal experts and practitioners towards XAI, with a specific focus on the European General Data Protection Regulation. The study consists of an online questionnaire and (...) follow-up interviews, and is centered around a use-case in the credit domain. We extract both a set of hierarchical and interconnected codes using grounded theory, and present the standpoints of the participating experts towards XAI. We find that the presented explanations are hard to understand and lack information, and discuss issues that can arise from the different interests of the data controller and subject. Finally, we present a set of recommendations for developers of XAI methods, and indications of legal areas of discussion. Among others, recommendations address the presentation, choice, and content of an explanation, technical risks as well as the end-user, while we provide legal pointers to the contestability of explanations, transparency thresholds, intellectual property rights as well as the relationship between involved parties. State of nature theories have a long history and play a lively role in contemporary work. Theories of this kind share certain nontrivial commitments. Among these are commitments to inclusion of a Lockean proviso among the principles of justice and to an assumption of invariance of political principles across changes of circumstances. In this article I want to look at those two commitments and bring to light what I believe are some important difficulties they engender. For nonpattern state (...) of nature theories, the justness of a society is marked by the conformance of the society to procedural principles. Distributions of resources and the like have no particular import for questions of justice. Whatever may later result, so long as it came about in accordance with the rules determined by the principles of justice, is itself just. The Lockean proviso is one of the principles of justice governing property and other rights of nonpattern theories of justice. The proviso hangs as a "shadow" over the results of the operation of the other (usual) principles of justice. It is intended to remedy a complaint which arises when the positions of those no longer at liberty to use some resource are worsened (1) by no longer being able to use freely what they previously were free to use and (2) in such a way that they fall below a "baseline." Following Locke, a traditional formulation of the proviso is to allow acquisition just so long as there is "enough and as good" left over for others. Section I concerns the relation of the Lockean proviso to pattern and nonpattern principles of justice, demonstrating that a Lockean proviso turns a nonpattern into a pattern theory of justice. Section II is about the relation of the Lockean proviso to the ideas revealed by an examination of a state of nature, suggesting reasons to reject ideal theories of justice. (shrink)

In this article, I support the liberal claim that the state's fundamental responsibility is to ensure that persons are able to interact as equals, that is, on the basis of equal freedom. That persons must be treated as responsible agents leads to an obligation on the part of the state to ensure that its citizens have the necessary conditions (and resources) for responsible agency. I further suggest that this conception of equality and the requirement for responsible agency is (...) the right measure to use for setting limits on the state's obligation to redistribute its resources. I defend this claim by making a parallel argument in moral philosophy that distinguishes the duty to aid from the duty of beneficence and establishes a priority relationship between them. (shrink)

Abstract This paper argues that there are good reasons to adopt a non-reductive account of states when it comes to quantum mechanics. That is to say, it is argued that there are advantages to thinking about states as sui generis, as reducible to classes of values of quantities, when it comes to the quantum domain. One reason for holding this view is that it seems to improve the prospects for explanation. In more detail, it is argued that there is an (...) 'explanatory shortfall' in the quantum domain owing to the failure of value definiteness. To remedy this situation, two proposals are put forward about the nature of the quantum state: Proposal A, that the quantum state is the only first-order property of quantum systems, Proposal B, that the quantum state is one first-order property among many. This study examines 14,900 disciplinary actions by the professional licensing boards for attorneys, CPAs, and physicians in four states from 2008 through 2014. It was found that both attorneys and physicians are disciplined at a rate at least seven times that of CPAs. While the majority of disciplinary actions are for misconduct directly related to the professional practice, nearly 14% of sanctions were the result of “social crimes” such as failure to pay child support or student loans, driving under the (...) influence, and general unprofessional conduct. The severity of licensure sanctions varied with the cause for discipline, but was inconsistent both within and between jurisdictions. These results raise important questions about the purpose and performance of state licensing boards and possible reasons for inequitable treatment. Additionally, the widespread and severe sanctions for conduct not related to the professional practice suggest that moral turpitude clauses may violate both equal protection and prohibitions on excessive fines. Children's exposure to and participation in mental state discourse contributes to their development of social understanding. Vygotsky's mechanism of internalization is used to account for this process, which has advantages of cultural and linguistic universality. If children internalize mental state discourse, however, then their own use of mental state language should be related to social understanding.

The issue of care work has become a burning issue in western capitalist welfare states because of the greater proportion of women in the workforce and the growth of alternative forms of family arrangement outside of the traditional male breadwinner model. This article addresses equity and welfare states with respect to social entitlements around care. It asks how new theoretical concepts can be applied to understand welfare states and their evolving employment-related family policies, using Nancy Fraser's utopian universal caregiver approach (...) as a model for evaluation. It focuses on carers and evaluates how a modern citizen is expected to be financially self-sufficient and yet also perform care duties at home. The term 'carer-commodification' captures the extent to which the state expects carers to engage in the labour market and how non-carer earners are engaged in care duties. The term 'carer-stratification' incorporates the extent to which the state creates differences between carers. Policies from selective welfare states (Sweden, Germany, Italy, the United Kingdom and the United States) are evaluated speculatively with these tools, and how they fare with equitable social entitlements is illustrated. Agricultural modernisation is a longstanding goal of China’s Party-state. Since the early 2000s, it has pursued this goal through policies designed to facilitate land consolidation and support the expansion of large agricultural enterprises – ‘New Agricultural Operators’ (NAOs). In this paper we explore the effect of these policies on the livelihoods of a cohort of smallholder orange growers in the mountainous regions of Hubei province and the local political economy. An analysis of data from a 2019 survey of 266 (...) households and interviews with villagers, agribusiness executives, cooperative leaders, and government officials, we find smallholder farmers are earning good incomes as independent commodity producers, withstanding attempts by local officials at land consolidation, and bypassing NAOs to self-determine their own modes of production and exchange. Our results speak to the ongoing debate about the future of smallholder farming in China, identify the strengths and limitations of recent state-centric analyses of agrarian transition, and re-iterate the pitfalls of the central government’s agricultural modernisation agenda. Ambient assisted living technologies are increasingly presented and sold as essential smart additions to daily life and home environments that will radically transform the healthcare and wellness markets of the future. An ethical approach and a thorough understanding of all ethics in surveillance/monitoring architectures are therefore pressing. AAL poses many ethical challenges raising questions that will affect immediate acceptance and long-term usage. Furthermore, ethical issues emerge from social inequalities and their potential exacerbation by AAL, accentuating the existing access gap between (...) high-income countries and low and middle-income countries. Legal aspects mainly refer to the adherence to existing legal frameworks and cover issues related to product safety, data protection, cybersecurity, intellectual property, and access to data by public, private, and government bodies. Successful privacy-friendly AAL applications are needed, as the pressure to bring Internet of Things devices and ones equipped with artificial intelligence quickly to market cannot overlook the fact that the environments in which AAL will operate are mostly private. The social issues focus on the impact of AAL technologies before and after their adoption. Future AAL technologies need to consider all aspects of equality such as gender, race, age and social disadvantages and avoid increasing loneliness and isolation among, e.g. older and frail people. Finally, the current power asymmetries between the target and general populations should not be underestimated nor should the discrepant needs and motivations of the target group and those developing and deploying AAL systems. Whilst AAL technologies provide promising solutions for the health and social care challenges, they are not exempt from ethical, legal and social issues. A set of ELSI guidelines is needed to integrate these factors at the research and development stage. (shrink)

In this paper, I argue that principles of justice, contrary to what John Rawls and Thomas Nagel believe, do apply transnationally. I start with a debate about the proper scope of justice and defend the view according to which social practices, apart from the structure of the state, ought to be included in the purview of justice. However, I hold that there is no need to include individual behaviour, alongside social practices, opposing G. A. Cohen’s view on this matter (...) and agreeing with Aaron James. I then argue for a relational account of equality, understood as a central principle of justice, whose application is feasible at the transnational level. Finally, I briefly discuss two examples of international social practices that could (and in my view ought to) be assessed in terms of social justice and respond to two objections to my position. -/- . While the questions of death and dying have a long history (Wildes 1996), the attempt to address them as secular questions is an element of what established bioethics as (...) a field of inquiry.The controversies of death and dying are not only formative of bioethics, but also are among the most persistent bioethical controversies. Today, almost 30 years after the Harvard Ad Hoc Committee’s definition of death and 20 years after the Quinlan decision, the questions of death and dying are still with us. Recently, the question of physician-assisted suicide once again gained national [End Page 378] attention with the trials of Dr. Kevorkian and the decisions of the Ninth and Second Circuit Courts on the constitutionality of the Washington and New York state laws prohibiting physician-assisted suicide. At the same time, questions and controversies about the appropriate extent of treatment and the determination of death in relationship to treatment continue to be problematic in health care.As I reviewed the literature in the area of death and dying, one central question emerged: Why, after so much reflection, energy, and discussion, do the problems around death and dying continue to persist? There is a recurring character to these questions that is indeed a wonder. In reviewing these moral controversies, one might ask what these controversies and their persistent character tell us about bioethics that can help us to understand the issues and the field.Some might blame the development of medical technology for the persistence of these issues of death and dying. The development and use of technological resources certainly is an important element of these continuing controversies. The use of medical technologies at the end of life allows us the possibility to sustain lives that would have been lost just a few decades ago. However, while medical technology certainly opens new horizons and possibilities, the development and deployment of technology does not sufficiently explain why these issues are so difficult and persistent. The question underlying the use of medical technology at the end of life is the question about which criteria are to be used to make judgments about the appropriate use of such technology. If the use of medical technology depends on the moral views one holds about death, suffering, and the appropriate use of resources, then such issues will be morally controversial in a society that is morally pluralistic.To address these questions, it is important to remember what is all too obvious and yet often forgotten. Death is not only a medical event. In this century, particularly in the last 40 years, we have reduced death to a medical event, yet, the medical meanings do not exhaust the event (see Engelhardt 1996, pp. 189–238). Death is also a social, cultural, and often religious event and the medical realities of death must be interpreted within these different contexts. As such, death will be the locus of different meanings and interpretations. By keeping these different structures of interpretation in mind, we are better able to understand why controversies around death and dying persist. Just as the meaning of death will vary from culture to culture, so too will the criteria of death vary. Different moral communities have different criteria for death—e.g., pulmonary or cognitive function. We can observe from this text detailed discussions surrounding terms such as _xing_ 性 (nature), _qing_ 情 (emotion), _xin_ 心 (heart-mind), and _yue_ 樂 (music), which played crucial roles in producing early Chinese philosophical discourses, particularly in the area of moral psychology. Since its (...) publication in 1998, this text has gained huge interest from Chinese scholars. This article illustrates how Chinese scholars, through their concrete studies, reveal the complicated textual nature of the _Xing Zi Ming Chu_ and its intricate relations to different philosophical streams which followed.
