This paper examines the effectiveness of the use of executive compensation linked to Corporate Social Responsibility (CSR) goals across US firms. Empirical analysis of a cross-industry sample of 746 listed companies for the period 2002–2013 showed that the use of CSR-linked compensation contracts for Named Executive Officers (NEOs) promotes CSR performance. More specifically, we found that linking NEOs’ compensation to CSR goals produces positive effects in the 3rd year after adoption. As firms accumulate experience and learn how to use the (...) system over the following eight periods, CSR performance increases monotonically. Furthermore, experience accumulated over time affects the different specifications of CSR performance asymmetrically, by reducing both environmental and social CSR concerns and increasing only environmental CSR strengths. Interestingly, we also found that the simultaneous use of other CSR-focused governance systems moderates the effect of a firm’s accumulated experience in using CSR-linked executive compensation on CSR performance: the existence of a CSR committee at the board level and the public release of a CSR report are likely to have a positive moderating effect, while the purchase of a CSR audit has no moderating effect. The first issue of Artificial Intelligence and Law journal was published in 1992. This paper provides commentaries on nine significant papers drawn from the Journal’s second decade. Four of the papers relate to reasoning with legal cases, introducing contextual considerations, predicting outcomes on the basis of natural language descriptions of the cases, comparing different ways of representing cases, and formalising precedential reasoning. One introduces a method of analysing arguments that was to become very widely used in AI and Law, namely (...) argumentation schemes. Two relate to ontologies for the representation of legal concepts and two take advantage of the increasing availability of legal corpora in this decade, to automate document summarisation and for the mining of arguments. This paper intends to offer a critical evaluation of the role played by intuitions in the mainstream methodology in traditional analytic epistemology. The criticism directed to what I call methodology of evaluation by intuitions shows that epistemologists often idealize the reliability of intuitions when assessing a theory against potential counterexamples, ignoring that the disposition to answer intuitively to a case of concept attribution is bounded to the familiar dimension in which the relevant conceptual competence emerges. Thus, the reliability of intuitions (...) does not necessarily extend to far-fetched cases. Given that the assessment by our intuitions is not sufficient to decide for or against an epistemological theory, I offer a sketch for a pragmatic and naturalized conception of theoretical decision-making in epistemology.Key-words: Intuitions, Analytic epistemology, Conceptual abilities, Naturalism, Pragmatism. O presente artigo apresenta um estudo detalhado sobre a dimensão performativa implícita na redução fenomenológica a partir de uma análise das obras de Edmund Husserl e da sua reinterpretação nas contribuições de Eugen Fink. Atribuindo à função do espectador transcendental a estrutura de janela, estrutura esta previamente desenvolvida nas pesquisas sobre os atos das presentificações em geral e sobre a consciência de imagem em particular, Fink consegue demonstrar a medialidade característica da redução, verdadeiro centro operativo da fenomenologia. Essa função medial (...) — situada, como uma janela, entre o âmbito mundano e a esfera transcendental — será um elemento fundamental tanto para o desenvolvimento da fenomenologia constitutiva de Husserl e suas análises sobre a história transcendental, quanto para a teoria transcendental do método e sua tematização pelo pensamento fenomenológico in fieri, bem como para a declinação meôntica da fenomenologia proposta por Fink. Neste sentido, a operação da redução será radicalizada numa performance que pretende “fissurar” a “superfície da vida transcendental”, criando aí uma abertura ao transcendental. A partir deste topos medial, o espectador transcendental se torna, portanto, uma espécie de panopticum “não envolvido” e “imparcial” do jogo da constituição, o qual ele pode enxergar através da janela aberta pela redução entre o âmbito natural e o transcendental como um imenso espetáculo. O espetáculo da “ontogênese” transcendental — anteriormente escondida uma latência anônima, sepultada na profundidade de um esquecimento “antigo como o mundo” — apresenta-se entre a subjetividade constituinte transcendental e seu produto final: a finitude, a correlação experiencial constituída entre ser humano e mundo. Finalmente, retomando as sugestões implicadas no fenômeno da imagem, as conclusões traçam um paralelismo com os famosos Cortes de Luciano Fontana, obras de arte performativa que, substituindo a represented spatiality por uma acted spatiality, rompem com o espaço “natural” e tradicional da imagem para adentrar, através da criação de uma cesura, de um corte na superfície da imagem, o infinito. We consider the ways humans engage in social epistemic actions, to guide each other's attention, prediction, and learning processes towards salient information, at the timescale of online social interaction and joint action. This parallels the active guidance of other's attention, prediction, and learning processes at the longer timescale of niche construction and cultural practices, as discussed in the target article.

Definition of the problem Medical ethics is increasingly faced with issues that result from power asymmetries and epistemic injustice. However, medical ethics lacks the epistemic lenses for analyzing these social context factors of clinical practice. A theoretical and conceptual reconfiguration is necessary in order to be able to address these issues. Arguments This paper discusses the foundations of critical medical ethics, which takes perspectives and epistemic categories from critical theories. This includes the Critical Theory of the Frankfurt School as well (...) as those approaches from social sciences and cultural studies that reflect on power asymmetries. By drawing on these theories, the epistemic spectrum of medical ethics could be broadened in order to better include real power relations into normative analyses. The paper starts by outlining the contribution of social sciences to empirical medical ethics. This shows that an empirical approach as such cannot bridge the epistemic gap. In a further step, epistemic lenses and concepts from critical theories are discussed, such as Critical Theory of the Frankfurt School, feminist approaches, postcolonial approaches, queer theory, gender studies, and science and technology studies (STS). The conclusion sums up the foundations of critical medical ethics and discusses its limitations. Conclusion Critical medical ethics possesses the epistemic categories and broader social perspective needed to address issues in medicine that result from power asymmetries and epistemic injustice in society. It is the aim of this paper to establish the concept of politicized medicine. The starting point is the work by Steger and Schochow on the Closed Venerological Wards in the GDR. Steger and Schochow operate with the concept of politicized medicine, although they do not elaborate it due to their primarily empirical approach. In this paper, the theoretical foundations for this concept shall be laid. Therefore, the results of the research by Steger and Schochow as well as the different (...) approaches to politicized medicine have to be examined. In a further step, the house rules of the Closed Venerological ward in Halle is analyzed as an example of politicized medicine. Finally, politicized medicine is differentiated from Foucault’s approach of Bio-Power/Bio-Politics on order to demonstrate its status as an autonomous and fruitful concept. (shrink)

The paper proposes an analysis and a formalisation of factor-based reasoning. After examining the relevance of factors in legal reasoning, binary and scalable factors (dimensions) are distinguished and the relations between them are discussed. An account of a fortiori reasoning with both types of factors is developed.

In this commentary, I focus on Jones' suggestion of a close connection between the domain of space and that of kinship. I expand on that suggestion by introducing the concept of frame of reference and show how it can possibly participate to the generation of kinship systems.

Magic and religion are at the origin of the concept of money as a unit for measuring value. Actually, they determined the first forms money took: precious objects, engraved stones, amulets and talismans which conferred a special power, within a social group, on the one who possessed them. In time, this power came to include the power of acquisition in commercial terms, but its original ties with magic were never lost. Aristotle clearly saw the relationship between a certain concept of (...) money (in Politica) and a new ethical concept as a corrective for the imbalances within a social community (in Ethica Nicomachea). If we look closely, we see that this ethical concept is not in opposition to the former but emphasizes the double aspect of the idea of money in antiquity, an idea which has survived, with some modifications, in Christianity and the modern era. This essay is unique in putting intersubjectivity front and center. It is an attempt to provide a clinical method to re-establish the fragile dialogue of the soul with oneself and with others. Throughout, the book builds on the assumption that to be human means to be in dialogue. It uses dialogue as a unitary concept to address three essential issues for clinical practice: 'What is a human being?', 'What is mental pathology'?, and 'What is care?'. To be human - it (...) is argued - means to be in dialogue with oneself and with other persons. Thus, mental pathology is the interruption of this dialogue - of the person with the alterity that inhabits them, and with the alterity incarnated in other persons. Therefore, therapy is a dialogue with a method whose aim is to re-enact one's interrupted dialogue with alterity.
