The United States is at a critical crossroads in its foreign policy and its relationship to the international community. Indeed, the very existence of an international community, rooted in the authority of the United Nations and capable of enforcing its resolutions, is from Washington's contemporary perspective an issue of contention. The foreign policy of the administration of George W. Bush has demonstrated, both before and after the tragic events of 11 September 2001, a willingness to undertake major initiatives (...) unilaterally when these are deemed to be in the vital interest of the United States specifically or of international order generally. In light of the inability of the United Nations to exercise collective will in the effort to disarm the aggressive regime of Saddam Hussein in Iraq, 1991-2003, Washington's determination to act alone or in coalitions-of-the-willing to secure international order is a welcome alternative to the international community as it is presently constituted. Maurice Blanchot is perhaps best known as a major French intellectual of the twentieth century: the man who countered Sartre's views on literature, who affirmed the work of Sade and Lautreamont, who gave eloquent voice to the generation of '68, and whose philosophical and literary work influenced the writing of, among others, Jacques Derrida, Gilles Deleuze, and Michel Foucault. He is also regarded as one of the most acute narrative writers in France since Marcel Proust. In __Clandestine Encounters__, Kevin (...) Our digital world feels unstable because it is in constant change, but Dewey reminds us that "all interactions that effect stability and order in the whirling flux of change are rhythms. There is ebb and flow, systole and diastole: ordered change."2 The rhythms of our digital world pervade all experience in what he termed "doing and undergoing." We are swimming in a sea of data and leaving behind what investigative reporter Julia Angwin terms data pollution.3 But in the data-driven world, that data pollution is collected, analyzed, and monetized by big data tech firms in a kind of societal harm that threatens digital democracy.Whereas part one saw contributions from five scholars throwing curriculum and technology into sharp relief, this issue asks questions such as "Where ought we to begin?", "What does feminist pragmatism have to tell us about the pandemic and online teaching and learning?", and "Do the aims and means of data and technology align with human experience?"John Machielsen's "Responsible Imagineering: John Dewey's Pluralistic Ethics and Technological Innovation" seems like a good place to begin. Machielsen argues for placing Dewey's ethics at the starting point from which technological innovation can flourish. Driven by Deweyan concepts of intelligence, education, and imagination, Machielsen explores, among other themes, socially disruptive technology from the perspective of pragmatists who constantly reconstruct concepts and values through the process of Deweyan inquiry. Human beings are imaginative and plastic with regard to problem solving, and what is needed here is to keep the barriers between technology and everyday life porous so that we do not risk compartmentalizing them as distinctly different realms.In the next two essays, we turn our attention to the growing concerns surrounding intelligent technology in online educational environments. Great strides have been made in the field of artificial intelligence, and intelligent technology has inserted itself into various aspects of data and technology, such as machine learning that creates personalized learning paths for students. Whether these technologies fall under the [End Page 1] category of algorithms, machine learning, or artificial intelligence, they raise questions about their potential impact on teaching and learning.Olivier Del Fabbro is also suspicious of the current state of intelligent technology in his article, "How to Teach Machines in Artificial Intelligence: Technical Education in John Dewey, Gilbert Simondon, and Machine Learning." Citing the Google machine learning model that classified African Americans as gorillas, Del Fabbro utilizes Dewey and Gilbert Simondon to argue that the human–machine relationship is still immature and at risk of creating an alienated situation out of undesirable bad habits. Intelligent technology requires constant care by engineers and programmers to form good habits and adapt to social life if their aims are to align with Deweyan pedagogy.As Del Fabbro focuses on intelligent technology, the human dimension of online learning comes under scrutiny in two articles that adopt feminist pragmatist methods. Krissah Marga B. Taganas's article, "Feminist-Pragmatist Perspectives on Online Education: Challenging and Changing Online Educational Conversation," rightfully acknowledges how the pandemic has magnified existing inequalities in society. The rapid migration to online learning was necessarily expedited in the face of uncertainties surrounding public health, but how do educators migrate classes that were not designed with online learning in mind to begin with? Dewey emphasized schools as sites and tools for change, but how does online education provide an optimal social environment for learning? In this single industry study, the authors examine relationships between forest products companies in Maine and their stakeholders. The research question, why do firms work with stakeholders, is examined from both instrumental and normative perspectives. Specifically, it is hypothesized that stakeholder power and corporate social responsiveness affect the degree to which firms have working relationships with stakeholders. The study found support for the impact of the firm’s perception of stakeholder power on the strength of its relationships with stakeholders. Most notably, (...) it also found support for the firm’s corporate social responsiveness on the strength of its stakeholder relations, indicating that firms do work with stakeholders from both instrumental and normative bases. Abbot Heng Lyu, the monks and nuns, and members of the Dharma Realm Buddhist Association hosted the dialogue at (...) the City of Ten Thousand Buddhas in Talmage, California. The community had transformed their Confucius Hall into a chapel, with a large, newly constructed wooden cross on a wall above an altar facing out from a raised platform, so the Catholic delegation would have a space for worship. A special poster announcing the theme of the conference, "Walking the Bodhisattva Path/Walking the Christ Path," showing a Buddhist dharma wheel at one foot of a bridge and a Celtic cross at the other foot, had been created by the hosting community.The daily schedule for the dialogue did not interfere with the monastic routine at the City of Ten Thousand Buddhas, which included early morning chanting (4:00-5:00 am), daily rituals in the Buddha Hall, and the single large meal for monastics before noon to which all participants were invited. Catholics and Buddhists meeting in the dialogue began each day with an optional forty-five minutes of quiet sitting together in the monastery meditation hall, each following their own form of meditation and prayer. There was a Eucharist on Friday and Saturday evenings for the Catholics and to which the Buddhists were invited, and additional meals of breakfast and supper throughout the meeting at the City's Jyun Kang Restaurant.Fourteen Buddhists and fourteen Catholics participated in the formal discussions. Each participant spoke on what it means to them to follow Christ or the way of the Bodhisattvas or enlightened beings. In addition to speaking, each participant distributed a short passage, usually from a traditional text, on this topic. Several passages from Master Dogen's Shobogenzo and the Gospel of John were among those shared by the group. Other passages shared were taken from the Avatamsaka Sutra and the Shurangama Sutra and from the other gospels and the writings of Zen master HakuinZenji, the Dalai Lama, Korean Zen Master I-sahn Hye-yeon, the teachings of Master [End Page 247] Hsuan Hua, Shantideva, Origen, St. Ignatius, St. Benedict, the author of The Cloud of Unknowing, St. John of the Cross, and Chiara Lubich. A minute of silence separated the fifteen-minute segments for each presentation. With so large a group, most of the time in the formal sessions involved listening to series of presentations; however, during discussion periods the participants asked several challenging questions of one another.Some participants noted the tension they felt between belonging to a particular religious group and the need to let go of any consequential narrowness. The goal of the discussion was to promote understanding of the differences and similarities between Christianity and Buddhism. At one point, the participants noted several concerns about mutual enrichment: whether Buddhist methods can be separated from Buddhism and Christian methods from Christianity, and what specific aspects of Christian practice truly enrich Buddhists and which Buddhist practices likewise enrich Christians. Several times participants discussed their understanding of terms such as transformation, grace, the incarnation and the passion of Jesus, discernment of spirits, prayer, Buddha-nature, and related terms. There was consensus that Buddhists and Catholics can practically help one another regarding mental cultivation and religious precepts. They expressed this consensus in their choice of the topic forthe next dialogue, "Transformation of Hearts and Minds: Chan/Zen-Catholic Approaches to Precepts."The group agreed to reconvene in 2004 to respond to six presentations, three from each side, on different aspects of this topic.Chairing the sessions were Rev. Heng Sure for the Dharma Realm Buddhist Association, Rev. Taigen Dan Leighton for the San Francisco Zen Center, and Bishop John Webster for the United States Conference of Catholic Bishops. Succession of states regains its importance in current geopolitical situation as now we are witnessing a possible new wave of state succession: South Sudan has been accepted to the United Nations, Kosovo’s independence has been recognized by many countries, Palestine has gained new status in the United Nations, etc. This would lead to the necessity to resolve questions related to succession of states, which might, among other subjects, include issues of diplomatic protection which was subject to international legislation (...) – International Law Commission has prepared the Draft Articles on Diplomatic Protection. However, General Assembly is still not ready to adopt this document as a convention, therefore the term to consider possible ways of handling the issues on diplomatic protection within the UN was extended till 2013. Draft articles give the definition of diplomatic protection, indicating the main features of this institute. However, sometimes the difference among the institutes being called the same name with diplomatic protection might cause misunderstandings when analyzing the issue both in general and in the context of succession of states. One of the main prerequisites for diplomatic protection recognized in the jurisprudence of International Court of Justice is the Mavrommatis rule, which indicates that when protecting the citizen’s rights, state in reality is asserting its own right. This rule has been cited in other cases, however, especially now, when individuals already have quite a number of measures to protect their individual rights independently from the actions of state, it has been acknowledged that the rule is fictitious. This recognition, reflected in the Draft Articles and indicated in the commentary of it, is most welcomed as it helps to resolve questions related to the succession of states. There is a need to understand that there is a difference between international obligations under which state is entitled to diplomatic protection and those under which it really asserts its own rights, despite the fact that the latter might also be related to the rights of individuals. This difference is also important in the context of the succession of states, as the consequences arising out of the breach of these obligations in the context of state succession might differ. The last but not least issue addressed in the article is the question of the succession to treaties, which indicate individual rights, but does not form a customary international law. The question is whether the successor state is entitled to diplomatic protection on behalf of its succeeded citizen in a case of a breach of international treaty which was not subject to succession by the successor state. Taking everything into account, there are issues which are not addressed in the Draft Articles on Diplomatic Protection. Herewith there are issues of diplomatic protection which should be addressed in a case of state succession. Nonetheless, it should be reminded that diplomatic protection is always subject to the decision of the state itself, it is just important that newly created states understand and know the possibility to invoke international responsibility of the third state using the means of diplomatic protection, even if the injury was made to its national before the moment of state succession. Frantz Fanon's Black Skin, White Masks is an analysis of lived experience, experiences supported or inhibited by our group, and individual interactions with the world. Present in the text is an accounting of the lived experiences of Negrophobic white males. Fanon argues that Negrophobic white males live their bodies and their worlds inauthentically, as improperly limited possibilities. He finds that the Negrophobic white male's body operates as a body of “structural harmony.” The Negrophobe tries to use his interactions with others (...) to delude himself into believing that his body is the pinnacle of agency. The Negrophobe is troubled by guilt. Projecting, what he sees as, his socially acceptable characteristics onto fellow white males and projecting, what he sees as, his socially unacceptable characteristics onto black males allows the Negrophobic white male to perpetuate the lie that he is the pinnacle of innocence. Removing this mythical blackness into the background of his world would allow the Negrophobe to exist in a world that is all white. He would be white. All of the Other people in this world would be white. And, they would all be innocent. In this world the prevalence of whiteness would mean that the Negrophobe and his guilt could not be seen because everyone would be suffering from snow-blindness. (shrink)

Narrative analysis offers a compelling platform that organizations can use to engage with those whose world and worldview may be radically different. A narrative approach places stories as vehicles through which individuals, organizations, and groups socially construct their identity, culture, land, and their inter-relationships through time. Because part of the stakeholder approach includes consideration of stakeholders’ physical, relational, and ethical experiences, narratives hold great promise.

Two months after the attacks of 9/11, the Bush administration, in the midst of what it perceived to be a state of emergency, authorized the indefinite detention of noncitizens suspected of terrorist activities and their subsequent trials by a military commission. Here, distinguished Italian philosopher Giorgio Agamben uses such circumstances to argue that this unusual extension of power, or "state of exception," has historically been an underexamined and powerful strategy that has the potential to transform democracies into totalitarian states. The (...) sequel to Agamben's _Homo Sacer: Sovereign Power and Bare Life, State of Exception_ is the first book to theorize the state of exception in historical and philosophical context. In Agamben's view, the majority of legal scholars and policymakers in Europe as well as the United States have wrongly rejected the necessity of such a theory, claiming instead that the state of exception is a pragmatic question. Agamben argues here that the state of exception, which was meant to be a provisional measure, became in the course of the twentieth century a normal paradigm of government. Writing nothing less than the history of the state of exception in its various national contexts throughout Western Europe and the United States, Agamben uses the work of Carl Schmitt as a foil for his reflections as well as that of Derrida, Benjamin, and Arendt. Government officials have tremendous discretion to offer or withhold foreign aid, ration-books, government contracts and jobs, welfare subsidies, public housing, tariff protection, academic grants, alien resident status, paroles, or exemption from conscription or combat, from arrest or prosecution or imprisonment. Right-wing economists have worried about welfare-state emphasis on administrative discretion rather than (...) the rule of law. Originally titled Frontières de la poésie (1935), This book by Jacques Maritain, whose philosophical writings read as interestingly as a novel, will be welcomed by all who are seeking a better understanding of the art of our time. The book delves into Maritain's thoughts on the nature and subjectivity of art and poetry. As a philosopher, Maritain attempts to define the two concepts, describing art and poetry as "virtues," and as primarily concerned with beauty. Rather than focus on aesthetic theory, (...) Maritain examines the concepts at a more tangible level, including a discussion of how they are made. The principles established with such precision and brilliance in his earlier work "Art and Scholasticism," which has had such a deep influence on contemporary artists, are successfully put to the test in illuminating the creative works of such diverse artists as Rouault, Marc Chagall, Gino Sevirini, and Arthur Lourie. Jacques Maritain was a French Catholic philosopher and political thinker. He was born in Paris in 1882, where he spent most of his life. His father was a prominent lawyer and his mother the daughter of a statesman. He attended the Sorbonne to study philosophy and natural science, and after marrying, he and his wife converted to Catholicism. It was after this he became a well-known scholar of St. Thomas Aquinas and Thomistic philosophy. He published widely on philosophical and political thought, and by the 1930s, he was an established thinker in the Catholic community. After the outbreak of WWII, Maritain relocated to the United States, where he taught at Princeton University and Columbia University. Later in life, he and his wife returned to France, where he continued to write and study Catholic scholarship until his death in 1973. (shrink)

The United States, which committed itself to alleviating the severe post-World War II global famine, failed to meet its relief commitments. Relief efforts failed largely because voluntary attempts at reducing consumption proved too difficult, and the U. S. government refused to return to mandatory rationing of food despite evidence indicating the majority of Americans, especially American women, would have welcomed such a move. Contributing to officials' opposition to mandatory post-war rationing were the revived ideology of government non-interference; a strong (...) government/agriculture alliance; the focus on private, as opposed to public, interests and obligations; and increasing Cold War tensions precluding any worldwide efforts at famine relief. It seemed only the fear of Communist takeover could provoke Congress in partnership with business interests into sufficiently alleviating famine conditions, but only for those countries willing to abide by U. All names have been changed to protect the privacy of the patient and the patient's family.I first met Ellen when she was admitted to the Women and Infant unit on a late spring day in May. She was 27 weeks (...) pregnant and was experiencing intense abdominal pain.As a hospital chaplain, I support patients and their families emotionally and spiritually. Sometimes, this looks like praying with patients; other times, it looks like sitting in quiet because there are no adequate words. Over time, I have developed ways to help me cope with the intensity I witness daily. Still, cases come up that I must grieve. The case of Ellen is one such example.The first time I met Ellen, she was waiting to hear back about her scans and tests. A quick look at her chart and a conversation with the medical team revealed that she was in her mid-thirties. While she spoke English fluently, she had immigrated to the US, and English was her second language. She, along with her husband, Mark, and their young son, had come to the United States on a work visa.After knocking on the door and entering her dim hospital room, I noticed right away what a beautiful person Ellen was, inside and out. Lying in bed, her long dark hair piled up on her head, her slim figure was visibly pregnant underneath her hospital gown. She smiled and gently greeted me. Mark was at her side. Clearly, Ellen was in physical pain, and while she and Mark still hoped the doctors were wrong in thinking she may have cancer, the emotional strain of waiting lay heavy upon them.Ellen and Mark kindly welcomed me and were attentive as best they could as I introduced myself and explained my role as a chaplain. They told me [End Page 75] that they were spiritual, not religious, but welcomed chaplain visits. Both exuded a certain peace and kindness, which was striking considering all they were enduring.As Ellen and her family waited for the results to come back, I waited as well and frequently checked her medical chart, looking for updates. About a week after she was first admitted, the medical team broke the dreaded news: Ellen had stage IV gastric cancer; it was estimated she only had 11 months to live. At this point, the Palliative Care team became involved in Ellen's care, and the chaplain on this team supported Ellen through the shock of her diagnosis and the difficult treatment choices she faced.Originally, the plan was for Ellen to deliver her daughter at 29–30 weeks and then to receive 2–3 rounds of chemotherapy. After further deliberation, however, it was decided that it was riskier to deliver a baby at 29–30 weeks than it was to undergo chemotherapy while pregnant, so Ellen began chemotherapy while still carrying her baby. Her chemotherapy was not a curative treatment, but there was hope it might give her more time.While my role became more peripheral at this point, I continued visiting Ellen. She was often tired or in pain, so I was mindful to keep my visits short. Mark, who stayed with his wife day in and day out, was usually in the room when I came by, and I often inquired after his well-being. Since Ellen and Mark's families still lived abroad, Mark was Ellen's primary support, and needed care and support himself.After two rounds of chemotherapy, Ellen made the decision to stop treatments. She made this decision because she was concerned about the risks of chemotherapy on her baby. It was an agonizing decision, and even after she made it, Ellen turned it over in her mind. During one of our visits, she asked me if I thought she had made the right decision. In the midst of the current ecological crisis, there is often lofty talk of the need for humanity to ‘overcome its divisions’ and work together to tackle the big challenges of our time. But as this new book by Razmig Keucheyan shows, the real picture is very different. Just take the case of the siting of toxic waste landfills in the United States: if you want to know where waste is most likely to be dumped, ask yourself where Blacks, (...) Hispanics, Native Americans and other racial minorities live and where the poorest neighbourhoods are. This kind of ‘environmental racism’ is by no means restricted to the United States: it is very much a global phenomenon. Keucheyan show how the capitalist response to the crisis has been marked by a massive expansion in ‘environmental finance’. From ‘carbon markets’ to ‘pollution permits’, ‘climate derivatives’ and ‘catastrophe bonds’, we are seeing a proliferation of nature-related financial products. Instead of tackling the root of the problem, the neoliberal strategy seeks to profit from environmental risks. Moreover, with the rise in natural disasters, resource scarcity, food crises, the destabilization of the poles and oceans and the prospect of tens of millions of ‘climate refugees’, Western powers are increasingly adopting a military response to ecological problems. The Cold War is over: welcome to the ‘green wars’. From New Orleans to the Siachen glacier via the Arctic floes, Keucheyan explores the landmark sites of this new ‘climate geostrategy’. Through a sharp critique of the way capitalism responds to environmental disaster, this innovative book provides a fresh perspective on some of the most critical issues confronting our societies today. The 28–31 January 2009 meeting was cochaired by the Rev. Heng Sure of the Berkeley Buddhist Monastery and the Institute for World Religions, Berkeley, California, and by (...) Most Rev. John C. Wester, Bishop of Salt Lake City, Utah.Sr. Mary Ann Donovan of the Jesuit School of Theology, Berkeley, led an experience of lectio divina based on John 15:1–17, Jesus's simile of the vine and the branches. Rev. Victoria Austin of the San Francisco Zen Center gave an "encouragement talk," which would typically be delivered to Zen retreatants. She referred to the Gospel passage, noting: "We don't prune the vine because it is dead, but because it has the capacity to be fruitful. We don't purify the mind to get rid of dirt, but to return to the mind's original purity, which is the source of our conscience and is the true life within us." Rev. Jan Chosen Bays of Great Vow Zen Monastery in Oregon observed that "Vows make our life energy more focused, keeping us from losing purpose and meaning. Vows prune away unnecessary things. When we ask for help with the challenge of being faithful to our vows, we call up and encounter unexpected sources of support and 'grace.' "The Ch'an Buddhist presentation focused on meditation experience, which was described as "recovering the natural state of the mind." Prof. Martin Verhoeven of the Pacific School of Religion pointed out that in meditation "we are returning to the origin, not moving forward to 'gain something.'" Linking ethical engagement with contemplation, he said, "When the mind of a meditator is motivated to act out of genuine compassion, its action is accurate and correct. Action is neither driven nor obstructed by ego or sentiment." These comments resonated with Rev. Heng Sure's presentation on the statement on the environment from the recent Gethsemane III conference "Simple and Sufficient," in which Buddhist and Christian monastics embraced an ecologically valid way of life. Urging the group to notice the connections between contemplation and ethical action, Bishop John C. Wester commented: "This [End Page 145] work embodies mercy by lifting people up; it embodies justice as it arises out of our common humanity."Because of the financial challenges that all three sponsoring institutions are facing, it was decided to conclude formal sponsorship of the Ch'an/Zen-Catholic Dialogue with this meeting. However, participants agreed to work together to reconstitute the dialogue regionally. A steering committee was designated to undertake new logistical arrangements and to draft a narrative of the previous seven years of dialogue for posting on our respective websites. Bishop Wester summarized the convictions of participants, both Buddhist and Catholic, by observing: "It is impossible not to be affected by this experience. Dialogue in this atmosphere has had an impact on my own way of ministering to others. Contemporary American life’s alternation between uncritical consumerism (Marcuse’s one-dimensional man) and nonothing anti-intellectualism (Christian fundamentalism and corporate-fueled jingoism) could only produce such a body of work as an alien presence: its own systemic negation and thus the fullest expression of its deepest internal contradictions. The present collection of interviews from 1981 to the present, then, stands as a welcome commentary on Jameson’s vast work and an important reflection of the changes in American intellectual life in the period from the last days of the Cold War to the end of the second Bush administration.Naturally, as with any collection of interviews, not every thing is new here. Indeed, to the seasoned reader of Jameson, much of this is familiar territory, and there is a fair amount of repetition from one interview to the next (Goethe’s concept of “world literature,” for example, is a recurring motif). Nonetheless, there are many moments of real insight and bold commentary that remind us why Marxism is far from dead and how Jameson has achieved an iconic status rivaling that of Lukacs, Althusser, or Eagleton, as one of the preeminent Marxist thinkers of the last century. Many of these come in the form of vignettes, little snippets of cultural analysis. One such comes in Jameson’s interview with Columbia University Professor of History Anders Stephanson. Here Stephanson asks Jameson to comment on the recent architectural and cultural phenomenon of creating ersatz public spaces. These come in the form of commercial areas that present themselves in guise of “squares,” “plazas,” or “villages.” They make reference to and pastiche traditional forms of life and then re-represent them in the form of a hypercapitalist consumerism. These simulacra of less alienated, precapitalist forms of [End Page 65] life are then presented as depthless surfaces, parodies of authenticity. The archetype of such ersatz public spaces is Disney’s EPCOT:Stephanson: In other words, you are referring to his compressed version of the world; little toy countries where you can orient yourself in no time at all.Jameson: I suppose you can orient yourself because walking paths are available. But where you actually are is a real problem, for you may in fact be in the Florida Everglades, and in this case you are not only in a swamp but also in a simulacrum of a different geographical complex altogether. Disneyland is, on the whole, supremely prophetic and paradigmatic of these multiple shifting and dissolving spatial levels. Passionate, rigorous, beautifully argued, wide-ranging, the texts shed an entirely new light on his work and will be welcomed by scholars in many disciplines--politics, philosophy, history, cultural studies, literature, and a range of interdisciplinary programs. Derrida's arguments vary in their responsiveness to given political questions--sometimes they are vivid (...) polemics on behalf of a position or figure, sometimes they are reflective analyses of a philosophical problem. They are united by the recurrent question of political decision or responsibility and the insistence that the apparent simplicity or programmatic character of political decision is in fact a profound avoidance of the political. This volume testifies to the possibility and the necessity of a philosophical politics. Negotiations assembles some of the most telling examples of the intrinsic relationship, so often affirmed by Derrida in more abstract philosophical terms, between deconstructive reading practices and what is called the "political"--more precisely, politics in an almost down-to-earth, pragmatic, and commonsense use of the word. This study examines the impact of Fair Trade on the sustainability of coffee growing. To examine sustainability we use an ethnographic approach, interviewingproducers and their associated buyers working in Fair Trade organizations in Chiapas Mexico. We focus on social, economic and ecological dimensions of the producers’ and buyers’ experience.

Technology companies are increasingly being asked to take responsibility for the technologies they create. Many of them are rising to the challenge. One way they do this is by implementing “guardrails”: restrictions on functionality that prevent people from misusing their technologies (per some standard of misuse). While there can be excellent reasons for implementing guardrails (and doing so is sometimes morally obligatory), I argue that the unrestricted authority to implement guardrails is incompatible with proper respect for user freedom, and is (...) not something we should welcome. I argue instead that guardrails should be implemented for only two reasons: to prevent accidental misuse of the technology, and as a proportionate means of preventing people from using the technology to violate other people’s rights. If I’m right, then we may have to get more comfortable with developers releasing technologies that can, and to some extent inevitably will, be misused; people using technologies in ways we disagree with is one of the costs of liberty, but it is a cost we have excellent reasons to bear. ABSTRACTThe German state permitted about one million refugees to enter Germany in 2015–2016, although many were subsequently denied refugee status. Germany adopted an ‘integration’ and ‘welcome’ politics, an important, if imperfect, model for a European refugee policy. The integration of refugees required the joint activity of state, of civil society, of the public sphere and of refugees themselves. Civil society initiated a vast amount of essential care work and solidarity with refugees pursued especially, but not only, by women, yet civil (...) society and refugees had no say in refugee policies. German refugee policy and practice raised many normative issues, producing an intense and vigorous national debate about them, in which philosophers and theorists were active. Among the questions debated were whether Germany had accepted ‘too many’ refugees, the acceptability of the costs of the policy, the risks of harm to the least well off, the purported risks to safety, security and the social order and the purported threats to German culture. I first describe German state policies, practices and civil society efforts and then turn to normative debates. I discuss the limits of the German discourse and suggest how it needs to be expanded. Kevin M. Graham argues that political philosophy cannot fully understand race-related injustice without shifting its focus away from distributive inequities between whites and nonwhites and toward white supremacy, the unfair power relationships that allow whites to dominate and oppress nonwhites. Graham's analysis of the racial politics of police violence and public education in Omaha, Nebraska, vividly illustrates why the pursuit of racial justice in the United States must move beyond redistribution.

Does democracy lead to more ethical or just systems of welcoming, of hospitality? Derrida considers an analysis of sovereignty as pivotal to any re-evaluation of contemporary politics and ethics, tying such a project in with deconstructions of democracy and hospitality: ‘what is “living together”? …must one live together only with one's like, with someone semblables?’ he asks in Rogues, prompting us to think through what it means to be, at once, democratic and hospitable. In this paper I propose that (...) Derrida provides us with a way of re-orienting democracy and hospitality that complicates conditions of citizenship and belonging, of the nation-state and sovereignty and of justice and unconditionality. It is the contention of this paper that deconstructing sovereignty is essential for any re-orientation of practices of hospitality within liberal democratic countries. The figure of the foreigner and questions of hospitality reveal a deep ambivalence at the core of democracy in the sense that it provokes the desire for openness and closure simultaneously. In closing, I raise questions concerning the potential for deconstructive practice to engage in a future politico-ethics of the border in light of this critical evaluation of democracy. In so doing, I consider the role of deconstruction in relation to liberal modalities of hospitality. (shrink)

The mind-brain identity theory, the thesis that sensations are identical with properties or processes of the brain, was introduced into contemporary discussion by U.T. Place, Herbert Feigl, and J.J.C Smart in the 1950s. Despite its widespread rejection in the following decades, the identity theory has received several carefully articulated defenses in recent years. Aside from developing novel responses to well-known arguments against the identity theory, contemporary identity theorists have argued that the epistemological resources available to support the adoption of identities (...) are more plentiful than has often been supposed; further, they have argued that mind-brain identities allow for the resolution of otherwise intractable explanatory puzzles about the phenomenal properties of experience. From an epistemological perspective, identity theorists have thus argued that a central reason for believing theoretical identities—both mind-brain identities as well as more mundane identities such as water = H2O—stems from the explanatory power that they confer. Yet from an explanatory perspective, identity theorists have maintained that identities cannot themselves be explained; indeed, they have maintained that it is hardly intelligible to request an explanation for an identity. This paper considers these ideas draws out an important tension between them. The central claim is that insofar as identity theorists insist on the explanatorily efficacy of identities, they should concede that there is a good sense in which theoretical identities can be explained. However, it is moreover argued that this concession is not especially problematic and, indeed, ought to be welcomed by identity theorists. (shrink)

Outside the art world, this observation is jejune. Inside, it makes for immediate disqualification. Is there something about the most common artistic motivations and attitudes that make this awfulness bound (...) to happen yet hard for insiders to sniff out?There are probably many factors in need of elaboration. One reason is widespread self-deception about the motivations for pursuing art. We often hear artists explain their commitment to art by a desire to express themselves or develop their gifts. We hear of a love of beauty or the challenges of craft or the chance for insight into self and world. Frequently, artists describe being called to art, a feeling of being chosen by art rather than choosing it. These are familiar accounts of what makes a life or career in art worth pursuing. But the piety of these high sounding explanations is strikingly incongruent with so much—though by no means all—contemporary art and suggests that, among artists, self-deception about motivations looms large.Franz Kafka's "A Hunger Artist" is a parable of artistic motivation and a case study in the self-deception of the artist. In the brief story, Kafka unwinds an account of artistic motivation that begins with the familiar explanations but gives way eventually to less flattering admissions about artistic ambition. Professional fasting ultimately becomes a path to truth for the hunger artist. But the truth that it yields reduces [End Page 142] art from a source of intrinsic value to a somewhat desperate form of attention seeking. In the figure of the hunger artist, Kafka captures one self-delusion common among artists.IIn "A Hunger Artist," Kafka charts the decline of an accomplished artist.1 Kafka tells us that the artist, a practitioner of what the author describes as a now forgotten genre of performance art known as professional fasting, garners a degree of notoriety for his ability to sustain fasts of death-defying lengths. Half-art, half-sport, Kafka's professional fasting amounts to sitting in a contained but public space such as a cage, where the fast is observable round-the-clock by watchers whose job is to verify its authenticity. The fast is also subject to the attention of paying spectators. Presumably, it is this commercial element as well as the secular hubbub surrounding the fast that most distinguishes it from religious fasting (out of which artistic fasting must have emerged sometime in previous centuries, had Kafka also bothered to concoct a history of the practice). A professional fast typically lasts for periods of up to the biblically resonant forty days, after which the artist is carried from his cage with great fanfare to a modest, performance ending breakfast. Through the practice of fasting, the hunger artist lifts self-denial and by implication, self-control, to the level of virtuosity. The grace of the fast and even a sense of moderate contentment in it are part of what is on display for the audience.Notwithstanding a light routine of bonhomie, Kafka's hunger artist remains distant from his audience. He is neither buoyed by their adoration nor deflated by their vulgarity. Instead, the hunger artist seems entirely sustained by his practice. In his self-possession, we glimpse a familiar ideal of the authentic artist devoted to his practice for the sake of its intrinsic rewards. Indeed, doubts about the authenticity of his performance only fuel the hunger artist's determination. Far from insulted by the zeal of official observers, the hunger artist welcomes their vigilance. In their distrust of the hunger artist, the most severe of watchers convey a respect for the practice of professional fasting. Their desire to scrupulously ratify the authenticity of his effort is also an endorsement of its value. The earnestness of the referees pleases the hunger artist, though we are assured that their presence hardly matters. Scholarship in experimental jurisprudence has reported surprising findings about various concepts of legal significance: _acting intentionally_, _causation_, _consent_, _knowledge, recklessness_, _reasonableness,_ and _law_ itself. Often, these studies examine laypeople’s ordinary concepts and draw broader conclusions about legal experts’ concepts. This Article questions such inferences, from empirical findings about ordinary concepts to conclusions about the concepts of those with legal expertise. It presents a case study concerning what it means to act _intentionally._ An experiment examines intentionality judgments across four populations (N (...) = 774): laypeople, law students, non-law students, and United States judges. Legal training affected judgments in three ways that are consistent with the acquisition of a distinctive legal concept. This case study supports the Article’s broader claim: Laypeople’s ordinary concepts are not equivalent to experts’ legal concepts. The acquisition of legal concepts is an important form of legal expertise. (shrink)

The renewed interest in the issue of black reparations, both in the public sphere and among scholars, is a welcome development because the racial injustices of the past continue to shape American society by disadvantaging African Americans in a variety of ways. Attention to the past and how it has shaped present-day inequality seems essential both to understanding our predicament and to justifying policies that would address and undermine racial inequality. Given this, any argument for policies designed to pursue racial (...) justice must be, at least in part, backward-looking, justifi ed partly as compensation for the effects of the wrongs of the past. However, some arguments about black reparations, both pro and con, are focused too far in the past. An unspoken assumption of much of the debate about black reparations is that these would be reparations for slavery. This, we argue, is a mistake. Racial inequality in the United States today may, ultimately, be based on slavery, but it is also based on the failure of the country to take effective steps since slavery to undermine the structural racial inequality that slavery put in place. From the latter part of the nineteenth century through the fi rst half of the twentieth century, the Jim Crow system continued to keep Blacks “in their place,” and even during and after the civil rights era no policies were adopted to dismantle the racial hierarchy that already existed. An important part of the story of racial inequality today is the history of housing and lending discrimination in the second half of the twentieth century (McCarthy 2002; 2004). Home equity, for many Americans, is a very important source of wealth, and the decades after World War II were ones of rapid home equity growth. They were the decades that saw the creation of a large, mostly suburban, middle class. But the middle class that was created was also mostly White, and this was due largely to government policies that (in many cases intentionally) excluded Blacks from the opportunities to get into the home market and benefi t from home equity growth. In this paper we argue that recent housing and lending discrimination constitutes an important basis for black reparations.. (shrink)

Contemporary accounts of what it is for an agent to be justified in holding a given belief commonly carry substantive commitments concerning what cognitive processes can and should be like. In this paper, we argue that concern for the plausiblity of such psychological commitments leads to significant epistemological results. In particular, it leads to a multi-faceted epistemology in which elements of traditionally conflicting epistemologies are vindicated within a single epistemological account. We suggest thinking of the epistemologically relevant cognitive processes in (...) terms of the metaphor of an iceberg--the accessible and articulable states that have been the exclusive focus of much epistemology must, for reasons that we explain, comprise only a proper subset of epistemologically relevant processing, even as only a part of an iceburg is exposed to view. When one focuses on the interaction of accessible states and articulable information, the structure of epistemic justification looks rather like what has been called structural contextualism (Timmons 1993, Henderson 1994b). It might also be called quasi-foundationalist. Yet, given the sort of creatures we are, in attending to our epistemological tasks we must rely on processing that is sensitive to information that we could not articulate, that is not accessible in the standard internalist sense. When one focuses on the full range of epistemologically important processes, the structure of what makes for justification may be rather more like that envisioned by some coherentists. (shrink)

Through most of the history of economics, the most influential commentators on methodology were also eminent practitioners of economics. And even not so long ago, it was so. Milton Friedman, Paul Samuelson, Trygve Haavelmo, and Tjalling Koopmans were awarded Nobel prizes for their substantive contributions to economics, and were each important contributors to methodological thought. But the fashion has changed. Specialization has increased. Not only has methodology become its own field, but many practitioners have come to agree with Frank Hahn's (...) (1992) view that methodology is a distraction to the practitioner, best left to the professional methodologists and philosophers, and of little practical import even when delivered from their pens. John Sutton's lectures, Marshall's Tendencies: What Economists Can Know, is a welcome return to the older fashion, for Sutton is an eminent practitioner of game theory and industrial organization. One of the main themes of these rich and nuanced lectures is the relationship of economic theory to econometric evidence. Sutton's reflections on econometrics appear to arise from the darker recesses of his practitioner's soul. While he affects a sunny disposition and ends on a hopeful note, his analysis articulates the lurking fear that econometrics is a hopeless project and that economics has little to learn from the interaction of theory and econometrics. Sutton's book is like a play in which virtue triumphs, but the villain gets all the good lines. (shrink)

The rise of a “maker movement,” located in hacker and makerspaces and involving the democratization of technologies of production and support of grassroots innovation, is receiving increasing attention from science and technology studies scholarship. This article explores how hacking is characterized by users of hacker and makerspaces and relates this to broader discussion of the maker movement as, for instance, promoting innovation, engaged in countercultural critique, or as accessible to anyone. Based on an interview study of users of twelve hacker (...) and makerspaces across the United States, it argues that for these users, hacking is not about politics, commercial innovation, or critique. Rather, it is understood as a lifestyle one subscribes to, a meaningful leisure activity, or as providing access to a welcoming and close-knit community. Contrary to expectations of the maker movement as heralding social change, the benefits of hacking were viewed as personal rather than political, economic, or social; similarly, democratization of technology was experienced as rather incidental to most hackers’ and makers’ experiences. Much of its incisive analysis owes to the editor's preface, introductory chapter, and concluding critical discussion of the positions represented, including his own.Four chapters lay out the Christian arguments for just war, biblical pacifism, and the late Glen Stassen's "just peacemaking theory," presenting ten practices to deter or transform violent conflict. Although Gushee's chapter would have to be placed among just war theorists, he stresses that war must be a last resort to defend innocent life, carried out with the least violence possible. Gushee appreciates the paradox of expressing love through acts of violence. Lisa Sharon Harper insists this goes beyond paradox to outright denial of the redemption Jesus brings, failing to honor the image of God in all persons. Following Anglican theologian Oliver O'Donovan, Erik Patterson sees publicly authorized force to protect society as a positive Christian duty. Striving to unite these two sides in practice, Stassen derives alternative, nonviolent strategies from the Sermon on the Mount to transform conflict at the local, national, regional, and international levels.But are such efforts successful? Can and do Christian peacemakers actually bring about significant societal and political change? Twelve further chapters offer experience-based evidence from Evangelical organizations and ministries that the answer is yes. Authors describe initiatives at home and abroad, giving special attention to Christian–Muslim outreach and understanding. Christian political resistance and mobilization can no longer be dismissed as utopian, naïve, or marginal. In many cases, it works.Gushee honestly and acutely articulates why pacifism and just war have had longstanding places in Christian political ethics, and why their adherents are [End Page 206] not easily reconciled. First, Jesus was nonviolent, and even those who construe rare and restrained violence as a form of neighbor love cannot deny that Jesus himself never expressed love in this way (121). Second, although Jesus calls disciples to participate in God's reign, that reign is but "eschatologically" present in a fallen world (119). Violence-transforming practices do not always work (125). Reconciling love may define kingdom discipleship, but when do we gauge love-in-action by the "present" reality of the kingdom, and when by the "not yet"? Third, according to Gushee, there is a difference (not separation) between church and government. This yields the conundrum that although their roles are different, Christians participate in both spheres, responsible not only for the peacemaking activities of the church but also for their social effects and for building just structures (5–6).Gushee does not claim to resolve these paradoxes. An interconnected and interdependent world in the age of globalisation invites Christianity to a different understanding of sin, which has been individualistically understood, because individualistic understanding of sin is impotent to address injustice or oppression caused by collective sins, wherein human beings have been collectively involved in. In order to overcome individualistic understanding of sin, this article is critically engaged in the concepts, such as concrete totality, which sees both individuality and socialness as constitutive parts of human beings, tyranny of (...) collective identity through which oppression and injustice is carried out to unspecified others and retreat from truth to omnipotence, which is a concretised example of tyranny of collective identity in a nation-state building of the United States. Retreat from truth to omnipotence means that the United States covers its blamable history with relation to Native Americans and immigrants and justifies the discrimination and exclusion of others using untrue social, political, hygienic and economic reasons. Retreat from truth to omnipotence is not a temporal aberration but a constant repetition in the US history. To address discrimination and exclusion of others necessitates a new understanding of sin, that is, sin of human beings as concrete totality rather than an exclusively individualistic view of sin.Contribution: The article explores a necessity of emphasizing collective dimension of sin to address injustice and oppression caused by tyranny of collective identity in a globalizing world. Leaders from NGSs affiliated with the United Nations, as well as Religions for Peace and Rissho Kosei-kai, also participated.Grace served as a most gracious host for the program. Before the official opening of the conference, Mark chaired a panel discussion on interfaith dialogue, and Leo chaired a session on work for peace. Leo served as co-chair of the conference and offered opening remarks welcoming former UN Secretary General Ban Ki-moon, who delivered the keynote speech on "Global Citizenship Now." Do Sun later accompanied Leo on a visit to the main Jogye Temple in Seoul and to the fine collection of Buddhist art at the National Museum of Korea. The following day, Kuni and Leo had an extended conversation with retired Archbishop Hyginus KIM Hee-joong and Sogang Professor Kim Chae Young. This year, in 2022, we were delighted to meet face-to-face again on November 18–19 in conjunction with the annual meeting of the American Academy of Religion (AAR). Because we are (...) an AAR "related scholarly organization," all of our events were scheduled through, and publicized by, AAR's staff. President Mark Unno not only presided at the board's table but also graciously ran a video conference, primarily to accommodate board and committee members who were outside the United States or dealing with travel-prohibiting health issues.The 2020 and 2021 fully online governance meetings, led by then-president Leo Lefebure, had been well organized, well run, highly effective, and a lot of fun. But as I watched the attentive eyes around the table this year and listened to the laughter, empathetic sighs, and plans for follow-up conversations, it seemed to me that meeting in person, in some ways, more powerfully supports the society's aim to foster in-depth Buddhist-Christian dialogue and comparative studies. Mark, then vice president, had organized the 2020 and 2021 online paper sessions carefully for online audiences. We were thrilled that these beautifully crafted and moderated presentations drew audiences that were amazingly broad in terms of both size and diversity. He recalled his father's participation in the Cobb–Abe dialogues and the network that evolved into the SBCS, and that these initial conversations were often highly theological—and testy—and often involved a translator. Mark is convinced, however, that this early debate was a necessary foundation for developing a more robust mutual learning community. Whereas in the United States concern for the environment is rarely consciously philosophical, Chinese history has made people aware that philosophy underlies and shapes public policy. The philosophies of Vygotsky and Gardner have much in common, even though their lives have been separated by different continents, different (...) political regimes, different languages, different cultures, and almost a century of innovative research in the fields of psychology and education.I argue that Vygotsky's ideas should be viewed through the prism of Gardner's theory of Multiple Intelligences. The combination of these concepts can shed new light on education—on teaching and learning. By doing so, we would enable the students to reach a higher level of cognitive development.This article intends to suggest that Vygotsky's dream of maximizing the Zone of Proximal Development can be realized by utilizing Gardner's approach of nurturing the students' combination of intelligences. He was only thirty-seven years old. "Vygotsky was a product of his time: an intellectual, [End Page 1] a Jew, [one] who took as much pleasure in thinking through the intricacies of speech impediments and language acquisition as he did in contemplating Shakespeare's Hamlet or the psychology of Art."1 Fundamental to Vygotsky's theory was the idea that higher mental functions, such as thinking, logical memory, and human consciousness, have their origins in human social life.Vygotsky believed that culture should be passed down to future generations in a Socratic, rather than a dogmatic, way. He believed that everyone should be given the tools to live up to their highest potential. For Vygotsky, psychological development could not be separated from human history and human culture. The notion of development as growing out of the interactions of human beings with one another, especially the interaction of adults and children, offers a collectivist vision of human psychological growth that is especially different from American ideas of individualism and predetermined stages of psychological growth.2 Vygotsky believed that the child has to be exposed to the array of intellectual and cognitive "tools" developed over the centuries by human beings—tools such as language, mathematics, music, and art.He stressed that systematic instruction in the formal disciplines—Latin, Greek, mathematics, and composition—is beneficial to the development of students' mental facilities in general. Studying the formal disciplines would lead to higher-order thinking and thus enhance "scientific" concepts. In other words, the systematic learning of scientific concepts in one field translates into developmental changes, abstract thinking, and greater logical thinking and logical flexibility. Recently, this notion is being welcomed by American psychologists. For example, in one study in the United States a group of American psychologists demonstrated that specialized training in medicine, law, and psychology seems to have an effect on real-life problem solving requiring statistical and logical reasoning.3In American educational psychology, Vygotsky is famous for his concept of the Zone of Proximal Development (ZPD). Behind this is the notion that a child's cognitive development occurs within a social milieu. The teaching-learning process (instruction) does not occur in isolation. The role of instruction for enhancing cognitive development is a joint activity—a collaborative effort between the child and a more knowledgeable partner, such as an older sibling, a parent, a teacher, etc. Therefore, the analysis of cognitive functioning requires studying how a child's social interaction with more competent peers of their culture is mastered and internalized. Cannot something similar be said of interreligious dialogue? All our planning and study are best put to use when they suddenly become (...) mere prologue to an encounter that has forced us off the well-trodden path. A dialogue meeting at Loyola Marymount University, September 9-14, 2001, began with much planning and became highly improvisational on September 11th.The roots of this conference go back to discussions between Dennis Hirota and myself in Kyoto in 1998-1999. The two of us are interested in contributing to the future development of Shin Buddhism by placing it in dialogue with Christian theology. The focus here is on Christian theology as one aspect of Christianity's response to the modern world. We are both interested in investigating various theological methods as Christian responses to modernity, and the contributions these methods have made to the reform and renewal of Christian institutions. The ulterior purpose of these investigations is to think in new ways about how a Buddhist "theology" might contribute to the institutional reform and religious renewal of Shin Buddhism.A first dialogue meeting was held at Chikushi Jogakuen University (Dazaifu, Japan) in June of 2000. Participants included faculty from Chikushi Jogakuen, Charlie Hallisey (then of Harvard University), Peter McCormick (International Academy for Philosophy, Liechtenstein), and me (Loyola Marymount University). A second meeting was held at Loyola Marymount in September 2001. For one week, beginning September 6th, meetings were held at the Shin Buddhist temple and a neighboring Roman Catholic parish in the Little Tokyo district of Los Angeles, followed by an academic conference at Loyola Marymount starting on Monday, September 10th. These meetings brought together faculty from Chikushi Jogakuen and Loyola Marymount, Shin Buddhist specialists from the Eastern Buddhist Society in Tokyo, ministers from the Los Angeles Nishi and Higashi Honganji Temples, Charlie Hallisey (Wisconsin), and John Ross Carter (Colgate University). The visiting Buddhists had a chance to meet with the Buddhist-Catholic dialogue group in Los Angeles. Papers were presented on a number of subjects, including (1) Christian theology's [End Page 201] contribution to institutional reform and religious renewal in recent Roman Catholic history and its implications for Shin Buddhism in both the United States and Japan; (2) theological method and moral theology in relation to end of life issues from both a Shin and Christian perspective; (3) truth and history in interreligious understanding; (4) Shin Buddhism, Christianity and religious responses to social discrimination; and (5) Christian theology as a stimulus to the development of a Shin Buddhist theology.On the morning of September 11th, dialogue as formal academic presentations ended and dialogue as spontaneous improvisation began. With U.S. air transportation closed down by the federal government, prospects for return flights to Japan were indefinitely postponed. A planned outing to watch Ichiro Suzuki (of the Seattle Mariners) play the Angels had to be canceled (Anaheim stadium was also closed). Instead, Christians and Buddhists, Americans and Japanese suddenly were brought together in ways they could not have predicted and began to improvise. The campus ministry of Loyola Marymount organized an impromptu mass for the entire university on the evening of September 11th. The Buddhist visitors were given a place of honor at the liturgy and publicly welcomed as guests of the Catholic community. The psalm response for the mass was a musical setting of the words, "Shepherd me oh Lord, beyond my wants, beyond my fears, from death into life." In the days that followed, this text became the basis for very affecting conversations among the Buddhists and the Christians in response to the terrorist attacks. A number of recent legal cases in the United States have considered both disability‐based exceptions to Covid‐19‐related mask mandates and disability‐based claims to stronger masking rules in states restricting the abilities of local governments to enforce mask mandates. We argue that a proper legal and ethical analysis of such cases requires understanding the distinction between disability accommodations and disability modifications. Disability accommodations are individualized adjustments that enable qualified individuals to perform jobs or achieve access on terms comparable to those (...) experienced by others. Disability modifications are programmatic changes to structures or policies that increase accessibility. We contend that in the context of mask mandates, modifications rather than accommodations are ethically desirable because modification‐oriented policies promote disability access in a way that treats all individuals fairly, avoiding the risk of promoting misinformation and uncertainty about the health benefits of masking. Protests against the war in Iraq or against American support for Israel have led to the accusation that there now exists an Anti-Americanism of the left that is virtually indistinguishable from an Anti-Americanism of the right. Losurdo points out that the United States was actually endowed with a certain fascination for Marx, Engels, Lenin, Boukharin or Gramsci, and that the indignation which they voiced concerning the regime of white supremacy was not unmitigated. The convergence of several technological systems (especially nanotechnology, biotechnology, information technology, and robotics) has now been adopted as a strategic goal by several countries, most notably the United States and those of the European Union. The anticipated benefits and related fears of competitive disadvantage have brought together a wide range of interested parties, governmental and nongovernmental. In the rush to enter and/or dominate this arena, the benign promise of converging technologies (CT) are highlighted, although a range of risks and (...) less welcome (if difficult to quantify) implications are at best understated. What, then, are the prospects for exercising governance over the technological systems we are busy creating—and the uses to which they might be put? What will it mean to speak of “global governance” in a world in which the technological promise of CT has been fulfilled? (shrink)

The concept of presentism has been at the center of current discussions in the historical discipline. Among the efforts to define presentism, we face radically different approaches. On the one hand, we have scholars that see it as ‘a cardinal sin’ or as a vice, while on the other, there are many who recognize in it something that is unavoidable and should be understood and welcomed. In this article, we explore and discuss these contrasting positions and argue for three central (...) virtues that presentism can bring to our understanding of the past. Through the analysis of narratives surrounding World War II and the founding of the United States, we argue that presentism: 1. allows history to be critical by motivating present reviews to established–mostly western-centric– accounts; 2. allows us to create new perspectives about the past by strategically using the tools of our present and finally, 3. welcomes pluralism rather than a single historical truth. These points allow us to defend a view of the past that is not static, fixed, and forever closed, but instead, see it as a place of debate, dispute, and constant renewal. (shrink)

The book is founded on the authors' research on diversity flashpoints in higher education for which they interviewed a national sample of student affairs professionals. The authors identified uncomfortable interpersonal situations with faculty members in which the discomfort arose from student identity difference. Reworking a number of columns that she wrote for Commonweal magazine, (...) Kaveny offers her concept of a "culture of engagement" as an alternative to America's polarizing culture wars. She builds a vision of engagement—typified by Pope Francis's emphasis on the church's need to "encounter" all human beings—that welcomes the influence that religious traditions and the broader culture and its laws can have on each other.Kaveny notes two ways in which the Roman Catholic tradition is particularly well situated to engage American culture and law. First, both American common law and the Catholic moral tradition use forms of "casuistry" to connect general rules with particular situations. Second, Catholic reluctance "to draw sharp lines between the pure and the tainted" can supply a salutary alternative to the Puritan tendency toward "prophetic indictment" (16).In part 1, Kaveny argues that law has both pedagogical and pragmatic qualities. In part 2, she describes the nation's struggle to balance governmental interests and religious liberty in the context of the contraception mandate in the 2010 Affordable Care Act. She faults the United States Conference of Catholic Bishops for elevating the law's pedagogical role over its pragmatic function in their attack on the mandate. She herself leans toward pragmatism; she assumes that exceptions to laws of general applicability should apply only "in the most extreme cases" (116) and that the government—not the religious claimant—should determine when exceptions apply.Kaveny also suggests that the bishops would do well to pay greater attention to the common good, as "it reflects the moral consensus of the community, which is accurately reflected in our democratic process of lawmaking" (90). Development of the grounds for this optimistic linking of a moral consensus and majority rule to the common good would have been an interesting addition to the book.Part 3 is the heart of the work, exploring ways for American society to "move beyond a culture war mentality" (120). Kaveny resists the assumption that public discourse in a society torn by culture wars is served by pitting secular and religious voices against each other. She hopes instead for persuasion based on natural law. One is left wondering, however, how persuasion based on natural law could happen in America's ideologically diverse culture. Its scope extends beyond any one religious tradition, however, as it offers a picture of engagement between equals: the American legal tradition and Catholic moral teaching. Decisions about whether or not to become a parent are significant parts of normative human development. Many studies have shown that married different-sex couples are expected to become parents, and that many social pressures enforce this norm. For same-sex couples, however, much less is known about social norms surrounding parenthood within marriage. This study examined injunctive norms and descriptive norms for the pursuit of parenthood as a function of age, gender, and sexual orientation. Participants in an internet survey included 1020 (...) cisgender people from across the United States Findings showed that norms, especially descriptive norms, for the pursuit of parenthood for heterosexual people were much stronger than those for lesbian women and gay men, and that norms for lesbian women were stronger than those for gay men. These differences were more pronounced for older, heterosexual, and male participants. However, lesbian and gay participants, especially gay men, reported that lesbian and gay people ought to become parents to the same extent as heterosexual people. Overall, the results indicated that, regardless of sexual orientation, adults report that lesbian and gay married people ought to become parents, but that they expect only a minority of these couples will pursue parenthood. This research provided a glimpse into how Americans are envisioning family formation among same-sex couples today. (shrink)

The administrative practices of officials who process the admission of immigrants show severe variations in the ways in which migration policy is enforced on the ground. For the author, inequality of treatment lies in the very hierarchy of tasks and services of what he dubs, following Pierre Bourdieu, the immigration "field". According to the author, the governments’ securitizing priorities favour the sort of suspicion towards foreigners that the media then reproduces, thus authorizing so-called street-level bureaucrats to act with great leeway (...) with regard to immigrants. Under pressure, governments implement what the author calls a "trompe-l’oeil policy" that explores the ambivalence between international and domestic law: while the state enforces repressive laws that apparently comply with fundamental human rights, it leaves to low-ranking civil servants enough discretion to make those rights ineffective. This point is the author’s central contention. The arbitrariness of these officials is neither contingent nor accidental: it actually constitutes a purposive "front-line policy" to enlarge the discretionary power of street-level bureaucrats in charge of regulating admissions. Unequal treatment comes in three flavours in this context. First, officials are asked to ensure that each right granted to a foreigner will not threaten the national order, which means the economic, social and political order. They are therefore in a position to judge the suitability of each application in view of their own arbitrary interpretation of what such "threats" consist of. The question of discretionary power is in this way intimately linked to the problem of equality before the law. Second, the scarcity of material and human resources allocated to services in charge of welcoming migrants starkly contrasts with the expenditure incurred to deport foreigners. Inequality also arises from how agents perceive users and the leeway they have to implement the law. Third, inequality is related to foreigners’ abilities and means to challenge discretionary power, especially through the legal tools they use or through legal intermediaries. The author thus concludes that such "front-line policy" has increasingly been used as a weapon against migrants, especially since the early 2000s, when immigration and detention policies were generalized in France. More broadly, in Europe as well as in United States, immigration reforms have made greater use of detention and focused on enforcement rather than on hosting programs and services for asylum seekers. But they have also strengthened the role of legal intermediaries. Hence the need to investigate how discretionary power is challenged as it sheds light on the power relations between states and migrants. Catholic hospitals seek to offer health care in accord with the example of Christ. They have several models to assist in this effort. The first model is the values portrayed in the Gospels. The Catholic Church has sought to embody these Gospel values in specific teachings. These teachings have been further specified for hospitals in the United States by the National Conference of Catholic Bishops in the Ethical and Religious Directives. Finally, the Gospels values are also expressed for individual (...) Catholic health care systems in mission statements and statements of Catholic identity. This article examines the worth of mission and identity statements, and explains that the statements must be put into practice through a process of internalization before they will be able to be of worth to the Catholic health care apostolate. Mr. A's physician recommends immediate dialysis. However, Mr. A is in the United States illegally, has no family living in the area, and is unemployed. The Emergency Medical Treatment and Labor Act requires the hospital not only to examine Mr. A, but to provide him with any needed stabilizing treatment without considering his lack of insurance coverage or ability to pay. The needed treatment to stabilize Mr. A is dialysis. Therefore, the physician admits him and starts dialysis. But Mr. (...) A will need to continue dialysis indefinitely. Because he has no insurance and is an illegal immigrant, he is not eligible for any outpatient dialysis units. He is also unable to afford any medical treatments. Once Mr. A is stabilized, should he be discharged? His physician and social worker turn to the hospital ethics committee for help. What should Mercy Hospital do? (shrink)
