Unlike other proposals, which deal mainly with the commonsense level of the subject, we will ground our explication on well-established scientific practice and language. In this way we show how to reconsider in an innovative way questions such as the distinction between the bona fide boundaries and the fiat boundaries, the thickness and the ownership of the boundaries. In lieu of an abstract, here is a brief excerpt of the content:AQUINAS'S FOURTH WAY AND THE APPROXIMATING RELATION HERE IS, IT CAN BE SAID, at least one troubleome premise (to some, unacceptable) in each of the Five Ways recorded by Aquinas in the Summa Theologiae (S.T., I, q.2, a.3, c.). Three of the W·ays, i.e., the First and the Second and the Fifth, have a premise which describes God-Prime Mover (Primum Movens, quod a nullo movetur), First Efficient Cause (Causa (...) Efficiens Prima), Intelligent Orderer (Aliquid Intelligens, a quo omnes res naturales ordinantur in finem), respectively-in a way which falls short of a proper or adequate (unmistakable, unquestionable, unique) identification of God. That is, it is not necessary that the Prime Mover be God, or that the First Efficient Cause be God, or that the Intelligent Orderer be God. For, whatever else God is, God is the Creator, and the Prime Mover is not. And neither is the First Efficient Cause; nor is the Intelligent Orderer. This happens because the empirical point of departure of each of these three Ways gives the causality of the Prime Mover, of the First Efficient Cause, and of the Intelligent Orderer an effect and a scope which make it impossible to identify them with the effect and the scope of the causality of the Creator. The two remaining ways, though providing a description of God which quite properly or adequately identifies God-SelfNecessary Being (Ens per se necessarium), Most a Being (Maxime Ens), respectively-make an analytic claim which is troublesome (to some unacceptable), in any case difficult to understand. In this paper a simple model in particle dynamics of a well-known supertask is constructed (the supertask was introduced by Max Black some years ago). As a consequence, a new and simple result about creation ex nihilo of particles can be proved compatible with classical dynamics. This result cannot be avoided by imposing boundary conditions at spatial infinity, and therefore is really new in the literature. It follows that there is no reason why even a world of rigid spheres should (...) be eternal, as has been erroneously assumed, especially since the time of Newton. (shrink)

To take into account the growing importance of this extraterritoriality paradigm reassessing the idea of territory in literature, culture and languages, this book offers an interdisciplinary and plurilingual journey through four centuries, four continents and a dozen languages.

The article aims at demonstrating that in attributing the creatio ex nihilo to both Plato and Aristotle as their unanimous philosophical conviction the Treatise on the Harmony between the Two Sages deeply depends upon the Neoplatonic reading of those two philosophers. The main obstacles for such a view in the works of the two sages are Plato's assumption of a precosmic chaos in the Timaeus and Aristotle's denial of any efficient causality to the unmoved mover in the Metaphysics. Both of (...) these points had been, however, done away with by the Neoplatonist commentators already, especially by Ammonius in his lost treatise on efficient and final causality in Aristotle the use of which in the Harmony is shown by a comparison with Simplicius. Christian and Muslim readers just had to transfer those arguments and hermeneutical techniques into an anti-eternalist context in order to make the two philosophers agree with one of the basic tenents of their face, a hermeneutical technique considerably different from the one employed by al-Fārābī in his exposition of Plato's and Aristotle's philosophy which is compared to the Harmony in a briefly sketched concluding section.L'article vise à montrer que le Traité sur l'harmonie des deux sages, en attribuant la creatio ex nihilo à Platon et Aristote comme conviction philosophique commune, dépend profondément de la lecture néoplatonicienne de ces deux philosophes. Summary This article concerns the identity and role of the C. Helvidius Priscus who is named in CIL IX, 2827 as an arbiter ex compromisso in a boundary dispute. After examining the inscription itself, I proceed to examine the implications of the mechanism of arbiter ex compromisso in the Roman judicatory system, and the possibility of a high-ranking Roman serving in such a role. The seemingly discrepancy between a high-ranking Roman and the role of a land surveyor is resolved hereby (...) by juxtaposing it twice: once with the precedent of high-ranking surveyors in the agrarian bill of Rullus; and secondly, by reading it in the context of locatio conductio operis contracts. This article focuses on the ways that the author’s somewhat in-between position as both an outsider/researcher and an insider/ex-political Iranian activist now in exile has contributed to the process of research on Iranian women exiles in the Netherlands and the United States. Feminist attention on life stories as a method, and feminist anthropologists’ attention to particularity, involvement and reflexivity give the author the space, and inspire her, to explore the issue of positioning. This makes it possible for her to engage (...) with the issues of home, identity and belonging, not only as a scholar but also as a woman in exile. In this way, the reflexivity resulting from this involvement enables her to reevaluate her own identity, sense of belonging, and life in exile, next to rethinking these essential themes within the social sciences on the theoretical level. The blurred boundary of the self and the other in her research has its moments of complication, but in the end, these complicated moments seem to be not only necessary but rewarding, in many ways. Vacuum Genesis and Spontaneous Emergence of the Universe from Nothing in Reference to the Classical Notion of Causality and Creation ex nihilo The article discousses philosophical and theological reflections inspired by the cosmological model of the origin of the universe from quantum vacuum through quantum tunneling and the model presented by Hartle and Hawking. In the context of the thesis about the possibility of cosmogenesis ex nihilo without the need of God the creator, the question is being raised concerning the (...) ontological status of nothingness and of the laws of nature in the aforementioned models. After pointing to the fact that they do not imply an absolute nothingness in the philosophical sense, the main objectives of both models and philosophical-theological conclusions they inspire are interpreted in the light of the classical principles of potency and act, theory of causation and chance events in nature, elements of classical theology of creation and the classification of sciences in terms of various levels of abstraction, proposed by Aquinas. Noting the fact that some cosmologists cross methodological boundaries of their science, we emphasize the role and significance of their research in a deeper understanding of the philosophical aspects of the origins of the universe, especially the role of potency in the first stages of its existence and evolution. Il y a trois défis pour la sécurité de l’Ouest. Le premier est que l’Ouest, comparé à l’Asie de l’Est, est en déclin. Dans vingt-cinq ans, la taille économique de la Chine continentale pourrait être supérieure à la taille du marché américain ; celle de l’Inde et de l’Indonesie être supérieure à la taille économique de l’Allemagne ; celle de la Corée du Sud excéder l’Angleterre ou la France ou l’Italie. Le second est la prolifération d’un savoir à doubleemploi et (...) le désastre économique de l’ex-Union Soviétique qui auront pour conséquence vraisemblable une prolifération du nucléaire. Le troisième concerne les changements de valeurs qui s’opèrent à l’Ouest et qui favorisent la formation de sociétés occidentales de moins en moins aptes à attaquer ou à se défendre. Mais la réduction du poids de l’Occident dans l’économie globale ne garantit plus que les efforts faciles l’emportent face aux défis du futur, qu’ils viennent des pouvoirs renforcés de l’Est asiatique ou des “desperados” islamiques. Ces défis ne seront vraisemblablement pas relevés au moyen de deux fausses prescriptions qui trouvent quelques faveurs en Europe Continentale. Premièrement, une grande partie de l’Europe de l’Ouest est lasse d’être confrontée à la “destruction créatrice” de ses emplois du fait de la concurrence de l’Asie de l’Est et désire ardemment le protectionnisme. Le remède protectionniste se bâtit sur un diagnostic grandement correct des problèmes occidentaux, mais il est tout de même dangereux si l’on met en perspective la morale, l’économie et la politique du pouvoir. Deuxièmement, certains Européens reconnaissent à juste titre que les grandes puissances historiques, comme la Grande- Bretagne ou la France ou l’Allemagne, n’ont plus une envergure suffisante pour être qualifiées de grandes puissances. Cependant, elles sousestiment la gravité et la vitesse du déclin de l’Occident. Une Europe définie par le noyau dur francoallemand deviendra trop étroite, avant même qu’elle ne soit établie dans cette structure. Vraisemblablement, même l’Union Européenne dans sa totalité sera trop petite avant qu’elle ne devienne une véritable communauté sur le plan sécuritaire. Au lieu de ces fausses prescriptions, cet article propose trois réponses aux dilemmes de l’Occident, ou encore trois façons de gérer le déclin de l’Occident. Premièrement, seule la coopération atlantique promet d’être une réponse efficace au dynamisme de l’Asie de l’Est et au déclin de l’Ouest. De plus, la coopération entre l’Amérique du Nord et l’Europe de l’Ouest a besoin d’être complétée par un nouvel engagement à l’égard d’une économie globale ouverte et d’une disposition à s’ajuster aux défis de celle-ci, afin de coopter l’Est asiatique dans une sphère globale de coprospérité. Cela doit vraisemblablement engendrer quelques coupes radicales dans l’Etat-providence. Deuxièmement, la prolifération nucléaire exige aussi une réponse. Il est concevable que la stratégie de défense contre la Chine soit encore plus difficile dans une vingtaine d’années qu’elle le fut contre l’Union Soviétique dans les années 1980. Mais cela ne devrait pas être une excuse pour ne pas construire des missiles de défense en réponse à ceux de l’Iran, de l’Irak, de la Lybie ou de l’Algerie. Troisièmement, les changements des valeurs en Occident semblent plus difficiles à traiter, mais ils renforcent la nécessité d’investir dans la coopération occidentale plutôt qu’uniquement européenne, la nécessité de coopter l’Asie de l’Est plutôt que de plonger dans une autre guerre froide, et la nécessité de contenir l’Etat-providence plutôt que de le développer. There are three challenges to Western security. First, compared to East Asia the West is in decline. In another twenty-five years, the economic size of Mainland China may exceed the size of the American market, India and Indonesia may exceed Germany, South Korea may exceed Britain or France or Italy. Second, the proliferation of dual use knowledge and the economic disaster in the former Soviet Union are likely to result in some nuclear proliferation. Third, value changes within the West will make Western societies ever less capable of deterrence and defense. But the reduced weight of the West in the global economy no longer guarantees that leisurely efforts succeed in meeting future challengers, whether from East Asian great powers or Islamic desperados. These challenges are unlikely to be met by two false prescriptions which enjoy some appeal in Continental Europe. First, much of Western Europe gets tired of observing the “creative destruction” of its jobs by East Asian competitors and longs for protectionism. The protectionist cure is built on a largely correct diagnosis of some Western problems, but nevertheless dangerous from an economic, moral, and power politics perspective. Second, some Europeans rightly recognize that historical great powers, like Britain or France or Germany, are no longer large enough to be great powers. But they underestimate the severity and speed of the decline of the West. A Franco- German core Europe will become too small, even before it is established. Conceivably, even the entire European Union will be too small before it becomes an effective security community. Instead of these false prescriptions this paper advocates three responses to Western dilemmas, or three modes of managing Western decline. First, only Atlantic cooperation promises to be an effective response to East Asian dynamism and Western decline. Moreover, cooperation between North America and Western Europe needs to be complemented with a renewed commitment to an open global economy and a readiness to adjust to its challenges, in order to coopt East Asia into a global co-prosperity sphere. This is likely to necessitate some radical cuts in the welfare state. Second, nuclear proliferation also needs some response. Conceivably, strategic defense is as difficult against China twenty years from now, as it was against the Soviet Union in the 1980s. But this should be no excuse for not building a missile and air defense against the likes of Iran, Iraq, Lybia, or Algeria. Third, the value changes within the West seem least tractable, but they reinforce the necessity of investing in Western rather than merely European cooperation, the necessity of coopting East Asia rather than stumbling into another Cold War, and the necessity for containing the welfare state rather than expanding it. In Re G, the Court of Appeal awarded a joint residence order to the appellant, who was the lesbian ex-partner of the child’s full biological mother. The award also indirectly vested the appellant, a social parent, with parental responsibility and extended a body of case law to same-sex couples, which had until now only been applied to heterosexual couples. The initial purpose of this note is to outline the legal issues of the case in the context of the framework of (...) parental responsibility set out in the Children Act 1989, putting forward a test of ‘parental fitness’ (which focuses on active ‘care’ as its central consideration) for social parents who must appeal to the court’s discretion to obtain parental responsibility. Secondly, the note offers at once a positive reading of Re G while highlighting a number of reservations centring upon continued legal preference for the ‘sexual family’. It is argued that while the legal recognition of ‘family diversity’ and parenthood remains modelled on this ‘sexual family’, the relaxation of family ‘boundaries’ (despite legal victories such as Re G) will remain limited. Hence, establishing creator and creature as distinct entities, it produces a « dialectic of the finite and the infinite » in which each term « would be interchangeable ». Yet, Hegel fails to distinguish the pair of concepts finite/infinite from the pair finite spirit / infinite spirit, which leads him to consider the two terms of the latter as opposite ; and that is precisely what is questionable. Although the strict separation of the terms of the first pair of notions leads to a self-annihilating dialectic , making a clear-cut distinction between the terms of the second couple is the necessary condition to deal with authentic relations from person to person. As I understand this view, there are really two intertwined claims to be established. The first is that the things beyond the skin that make up material culture (in other words, the physical objects and artefacts in which cultural networks (...) and systems of human social relations are realized) may be essential to the enactment of, and be partly constitutive of, certain cognitive systems or operations. The consequence of establishing this claim is supposed to be that we have a mandate to recast the boundaries of the mind so as to include, as proper parts of the mind, things located beyond the skin. Thus, in talking about the contribution of the world to cognition, Malafouris (2004, 58) concludes that ‘what we have traditionally construed as an active or passive but always clearly separated external stimulus for setting a cognitive mechanism into motion, may be after all a continuous part of the machinery itself; at least ex hypothesi’. This is the position that, in philosophical circles, is known increasingly as the extended mind hypothesis (Clark & Chalmers 1998; Menary forthcoming). Henceforth I shall refer to this hypothesis as EM. A stock example will help bring the idea into view. Rumelhart et al. (1986) note that most of us solve difficult multiplication problems by using ‘pen and paper’ as an external resource. This book provides reflection on the increasingly blurry boundaries that characterize the human-animal relationship. In the Anthropocene humans and animals have come closer together and this asks for rethinking old divisions. Firstly, new scientific insights and technological advances lead to a blurring of the boundaries between animals and humans. Secondly, our increasing influence on nature leads to a rethinking of the old distinction between individual animal ethics and collectivist environmental ethics. Thirdly, ongoing urbanization and destruction of animal habitats (...) leads to a blurring between the categories of wild and domesticated animals. Finally, globalization and global climate change have led to the fragmentation of natural habitats, blurring the old distinction between in situ and ex situ conservation. In this book, researchers at the cutting edge of their fields systematically examine the broad field of human-animal relations, dealing with wild, liminal, and domestic animals, with conservation, and zoos, and with technologies such as biomimicry. This book is timely in that it explores the new directions in which our thinking about the human-animal relationship are developing. While the target audience primarily consists of animal studies scholars, coming from a wide range of disciplines including philosophy, sociology, psychology, ethology, literature, and film studies, many of the topics that are discussed have relevance beyond a purely theoretical one; as such the book also aims to inspire for example biologists, conservationists, and zoo keepers to reflect on their relationship with animals. The myriad of negative effects brought about by the incarceration of a family member have consistently been demonstrated in research. However, previous works have tended to focus on the perspectives of family members separately, rather than exploring the dynamic relationships within the family as an entire unit. Moreover, such research is still limited in the Chinese cultural context. Thus, the current study aimed to examine the applicability of the Family Process Theory on a small sample of Chinese fathers who were (...) imprisoned and have returned to their communities, conceptualizing the challenges faced by their families under the theoretical elements of rules of transformation, rituals, ambiguous loss and boundary ambiguity. A total of 17 participants were recruited through the assistance of service organizations, and data were collected via semi-structured interviews. As congruent with the theory, inmates’ families were found to come across problems particularly in the transitioning phase and establishment of new rituals, while ambiguity surrounding the incarceration and the blurred role of the father led to problems with fatherhood identity both during and after the incarceration. Recommendations are made, in line with these findings and the suggestions of ex-prisoners, for services to have more of a focus on preserving the integrity of inmates’ families. Given the right circumstances, families can even serve as a motivator for incarcerated fathers to improve themselves and mature, leveraging the important supportive role of the family and the fear of again being separated from one’s family as effective deterrents to recidivism. West Indian military service in the First World War is recalled in many settings. During the war, race and class boundaries of colonial society were temporarily eroded by visions of imperial unity, but quickly restated through post-war assertions of imperial authority. However, recollections of wartime sacrifices were kept alive by Pan-African, ex-service and emerging nationalist groups before being incorporated into independent Caribbean national identity and migrant West Indian communities. During the centenary commemorations, West Indian participation has increasingly been mediated (...) through literature, theatre and broadcasting. Spheres of conflict which provided more heroic visions, such as the Middle East or the Taranto mutiny, have acquired particular symbolic importance, contrasting with the more tragic representations of the war as a whole. According to classical Indian introspective analysis of aesthetics the basic emotions determine human activity and are the well- spring of literature and art, especially if the emotions become dis- sociated from a sense of egocentricity, i.e. if they become detached from a sense of self so that they no longer are in uenced by ex- istential fear. The comparatively close similarity between Indian aesthetics and the neurophysiology of the different affective states suggests the possibility that such aesthetic value judgments may be based on widespread evolutionary determinants. In addition, the quantum cosmologies of Andrej Linde and Roger Penrose are presented. Doron Navot | : According to recent conceptual proposals, institutional corruption should be understood within the boundaries of the institution and its purpose. Political corruption in democracies, prominent scholars suggest, is characterized by the violation of institutional ideals or behaviors that tend to harm democratic processes and institutions. This paper rejects the idea that compromises, preferences, political agreements, or consent can be the baseline of conceptualization of political corruption. In order to improve the identification of abuse of power, the (...) concept of political corruption should not be related directly to democratic institutions and processes; rather, it should be related to ideals whose content is independent of citizens’ preferences, institutions and processes. More specifically, I articulate the relations between political corruption and the notion of subjection, and include powerful citizens in the category of political corruption. Yet, I also suggest redefining under what conditions agents are culpable for their motivations in promoting private gain. By doing this, we better realize how democratic institutions can be the source of corruption and not just its victims. Such a redefinition, I propose finally, is the basis for the distinction between individual and institutional corruption. | : Selon les propositions conceptuelles récentes, la corruption institutionnelle doit être comprise dans les limites de l’institution et de ses objectifs. One of Israel Kirzner’s less wellknown contributions is to the theory of capital. In this paper, we link the Austrian theory of capital and the theory of economic organization. Our starting point is the key Austrian notion of capital heterogeneity which we interpret in terms of attributes. Most capital assets are multi-attribute in nature, and many attributes may not be known to entrepreneurs. This fosters a need for experimenting with capital combinations. Because there are costs of measuring attributes, this process (...) has implications for economic organization. Thus, we argue that novel implications for the understanding of ownership and the existence and boundaries of firms may be teased out of such a perspective.La théorie du capital représente une des contributions les moins connues d’Israel Kirzner. In other words Guido’s esthetic position is sophistic, self-amused, and self-conscious.Since artistic expressions are generally conceived as reflecting their consumers, late-medieval chansons have been interpreted as a manifestation of the incredibly decadent yet sophisticated social milieu in which and for which the music was created. This famous crisis in the papal reign has been associated with a strong tendency to secularization in the papal Court, by which life styles became luxurious if not licentious. 5This socio-historical account is based on suggestive conjectures, comprising in part explanatory commonplaces. No direct relation can be established between the “Great Schism” or the specific social condition, of Avignon and the most refined music of the late fourteenth century. Furthermore, the claim of the above social account for a contextual approach is misleading. In fact no solid immanent relations are shown to exist between a complex, quasi-degenerate society on the one hand, and the intricate rhythms of the music on the other. The attribution of complexity in the broadest sense of the term does not satisfy our curiosity as to the possible interdependence between style and society. Interestingly enough, as far as late fourteenth-century chansons style is concerned, such an association can even be countered, considering the coincidental cultivation of the new simple style in the complex and decadent Burgundian courts of the waning Middle Ages. 6Here I propose to examine the late fourteenth-century musical style not on the background of social procedures but in the context of fourteenth century scientific thought, and to demonstrate immanent and structural cohesion between a compositional trend that features manipulations within the dimension of musical time and the sciences which investigate the properties of time qua continuum. De nombreuses études sur l'apprentissage des langues étrangères montrent que l'apprenant est incapable d'atteindre le niveau d'un locuteur natif. Des phénomènes de fossilisation et de nativisation demeurent, même à un niveau très avancé (Selinker & Lamendella, 1980 ; Selinker & Lakshamanan, 1992 ; Andersen, 1983 ; Narcy-Combes, 2005). Cet article met en évidence le rôle limitatif des représentations cognitives chez l'apprenant dans un contexte où il est possible d'isoler chronologiquement la construction des représentations cognitives et celle d'une première langue. Ce (...) contexte est celui de la surdité profonde prélinguistique, et plus spécifiquement celui de l'oralisme : l’acquisition de la langue y est différée de quelques mois ou années sans qu'il n'y ait de système linguistique préalable puisque les oralistes sont tenus à l'écart des langues signées. Les jeunes sourds développent des représentations cognitives dans leurs premières années de vie, préalablement à l'accès à une première langue. Or, des études expérimentales (ex. Vinter, 2000) montrent que les sujets sourds ont une approche inhabituelle du spatial et du temporel, approche pouvant être mise en rapport avec l'absence de perception auditive. Du fait des liens entre perception sensorielle et conception (ex. Talmy, 1988 & 2000), les représentations cognitives des sujets sourds relativement à l'espace et au temps seraient donc spécifiques. La langue orale produite par ces sujets à l'adolescence présente quant à elle des caractéristiques inhabituelles dans les domaines de la langue qui sont liés à l'espace et au temps, et ce, aussi bien chez les anglophones que chez les francophones dont les productions orales ont été analysées (ex. Vincent-Durroux, 2009 & 2008). Les représentations cognitives influent donc sur l'appropriation de la langue par les sourds. Judges decide cases by appeal to rules of general application they deem to be law. If a candidate rule resolves the case and is, ex ante and independently of the judge’s judgment, the law, then the judge has a legal obligation to declare it as such and follow it. That, at any rate, is conventional wisdom. Yet the principle is false – a rule’s being law or the judge’s believing it to be law is neither necessary nor even sufficient for (...) a judge being legally obliged to follow it. The principle’s falsity is especially apparent in so-called hard cases, where the line between legal and non-legal rules is obscure. Moreover, judges have authority to disregard law in hard cases not because moral obligations trump legal obligations. Rather, the law itself circumscribes its own authority. Context: Since 2015, physicians are the only health professionals who have the legal authority to administer medical aid in dying (MAID) in Quebec. A new legislative context is bringing major changes to their end-of-life care practice. Objective: Explore the meaning-making factors that emerge from the experience of physicians administering MAID in order to shed light on what leads them to integrate this practice into their professional continuum. Methodology: Semi-structured interviews were conducted with ten physicians who had performed at least one (...) MAID throughout the territory of the CIUSSS de l’Estrie. Analysis: Conducted using Pierre Paillé’s (1994) grounded theorization, it showed that MAID is a human approach requiring time and social skills, and where life skills are paramount. The results suggest that MAID is located at the boundaries of the physician’s personal and professional identity. In short, what motivates a physician to participate in the MAID process is their narrative identity, including the values and meaning that they give to their experiential journey. Conclusion: MAID is an existential form of care, and the process is experienced differently by each physician; therefore, it is important to respect the meaning and values of each physician, whether or not they incorporate MAID into their medical practice. Rational individuals who perceive information sequentially are confronted to cognitive dissonance and dynamic uncertainty in a way that sets a natural limit to the ex post efficiency of their choices. From the normative perspective which ignores this dynamic uncertainty, their rationality seems limited. Sequential perception is assumed in a model of Bayesian revision of the contingent preference in a repeated choice. This model predicts both the cognitive dissonance phenomenon studied by Festinger and the formation of stable habits. It also shows (...) how an ordinary man can be rational with bounded informational and computational abilities and, for the same reasons, give a disproportionate weight to impressions without any normative value in his own choices and judgments. Sequential perception and cognitive consistency offer a credible alternative to the cognitive bias paradigm for predicting anomalies in choice and game behavior.Des individus logiques percevant l’information de manière séquentielle sont soumis à une dissonance cognitive et une incertitude dynamique qui limitent naturellement l’efficacité ex post de leurs choix. By examining these parallels and then the (...) crucial differences between the two texts, we can see that poems 12 and 13 exploit their superficially nugatory stance in order to scrutinize the values and social protocols which make that stance seem appropriate. 1 Thus these poems, social in that they reflect a world of dinner parties and dinner-party gossip, are social also in that they play a role in the poet’s project of social criticism and analysis. 2Poems 12 and 13 form a pair not only because of their position in the corpus as we have it or the mention of Fabullus in both poems, but also because of structural and thematic parallels. 3 Scholars have spent a greater amount of time on the more accessible poem 13, but 12 deserves equal attention as an example of how Catullus deals with his chosen themes and how he characterizes himself. 4 Poem 12 is addressed to Asinius Marrucinus the napkin thief. The structure of the poem is simple but effective: opening attack, contrast with brother, warning that more blame-poetry will follow, mention of the stolen item, and its description: the napkin is important not because of its monetary value but because it is a gift from friends; to devalue it would be to devalue that friendship. The conuiuium becomes the point of departure for a brief statement of affection for distant friends, and also for a comment on the nature of friends and friendship. 5 Catullus might simply have written a few lines saying that he was fond of Fabullus and Veranius, but he did not. Instead he chose a circuitous route, one which leads briefly through the conuiuium. The napkin thief has not merely committed an act which was insulsum ; he has interfered in Catullus’ personal life by removing an object with sentimental associations.The poem implies a dramatic situation, albeit not an obviously serious one: at a conuiuium Asinius stole Catullus’ napkin. This implied narrative forces us to envision Catullus as one of the neglegentiores amid “laughter and wine.” He then becomes the annoyed poet, protesting [End Page 386] this petty theft and threatening to abuse the perpetrator with iambic invective should he not return it. So far, this is not a serious poem; the whole affair seems trivial, and the self-presentation of Catullus is not particularly flattering. In the end, however, Catullus reveals that his concern is not with the loss of the napkin, but with the role of that napkin in the maintenance of his friendship (see Martin 1992, 130–31). The sympotic background disappears, and finally Catullus emerges as one whose real concern is with proper regard for and maintenance of his personal relationships.Catullus paints himself as the Roman sophisticate who travels in high circles. We can see this from his choice of victim, and by his invocation of Pollio in line 6, since these brothers came from an important Roman family. Theory in the “Post” Era: A Vocabulary for the 21st-Century Conceptual Commons. Bloomsbury, 2021. 376pp.Far from “mourning” the demise of theory, this timely and thoughtfully curated essay collection testifies to its “renewed vitality,” its compelling presence “across (...) fields, domains of life, and geocultural boundaries,” and its power to build an ever-expanding world community of practioners who are forming what has come to be known as a “theory commons” (ix). As the collection’s editors point out, theory’s new lease on life hinges on ensuring both the democratic workings of this “world discourse formation” (1) and on the responsible theorizing of the very notion of community in “a world threatened by all kinds of anti-communal actions and reactions, from runaway globalization to exacerbated tribalism and tunnel-vision politics” (x). Working on the margins, specifically, out of a Romanian “lab” called The Critical Theory Institute (CTI), which opened its doors in early 2000, the contributors seek to revise the “standard history of theory,” one whose “Western origins, authority, and cultural compass ” strike them as “exceedingly reductive” (3). This project of geotheoretical repositioning and recalibration aims to recast theory as a “quintessentially cross-linguistic, cross-cultural, trans- and intercontinental undertaking” (4). As such, it carries on the project, launched in a previous volume, Romanian Literature as World Literature (2018), of fashioning an alternative to the nation-state paradigm that has long shaped literary and intellectual histories. In both of these works, Romanian critics and theorists have tuned into a wide range of voices, and tapped into a shared conceptual and methodological apparatus—itself the product of “an ethno-linguistic medley of traditions” (8). This approach informs what editors see as the “epoch-making” (17) discursive paradigm that has taken shape in globally networked post-Cold War societies (17), a viral model of cultural influence that fosters an ontology of “contact, contagion, of infection, dissemination, and horizontal accumulation” (15).To give us a sense of theory’s complex genealogy and evolution, the editors reference the Bulgarian critic Galin Tihanov, who has attributed [End Page 122] important developments in contemporary theory to the achievements of theorists (Nikolai Trubetskoi, Roman Jakobson, Vladimir Propp, and Georg Lukács) and schools of thought (Russian Formalism and the Prague Linguistic Circle). Acilius Glabrio In 189 B.C.E. J. Bradford Churchill THE RACE FOR THE CENSORSHIP of 189 became the setting for one of the most dramatic domestic political disputes of the early second century. 1 M. Porcius Cato (cos. 195) was seeking the censorship, and among his competitors was another homo novus, (...) M.' Acilius Glabrio (cos. 191). Now, Cato had served as tribunus militum under the consul Glabrio during the campaign of 191 against Antiochus III in Greece. Cato had led a flanking expedition to decide the battle at Thermopylae, at the conclusion of which the king's camp was invaded and plundered. 2 Cato said that after the battle, Glabrio had embraced him and cried out that neither he nor the Roman people could repay his good services. 3 Glabrio sent Cato home with news of the victory. 4Now, in the race for the censorship of 189, public opinion was inclining in favor of Glabrio because he had conducted a lavish distribution of congiaria--vessels, perhaps precious, filled with wine or oil. The nobles among the competitors took umbrage at his being preferred to them, and two tribunes, P. Sempronius Gracchus and C. Acilium quarta: "postquam nativitas ex navibus eduxi, non ex militibus atque nautis piscatores penatores fici, sed arum dedi." First there are several problems which are relatively minor and no longer yield much controversy. The word quarta indicates there were at least four speeches "against Acilius." More often than not, this is dismissed as a simple error. 7 The word nativitas is clearly foreign to the context, and was long ago emended to navitas, as a poetic and archaic variant on nautas. 8 The transmitted fici is regularly and reasonably emended to feci. 9 [End Page 550]The more difficult question centers on the phrase sed arum dedi. André Dacier, in an early modern edition of Festus (Amsterdam 1700), emended arum to aurum. 10 Much later, Theodor Mommsen offered the conjecture arma. 11 This is now the prevailing reading, accepted most significantly by Enrica Malcovati (1953, 39) in the authoritative edition of the Oratorum Romanorum Fragmenta. 12 Maria Teresa Sblendorio Cugusi (1982, 77), following Lindsay (1913, 268), printed and obelized arum, but in her commentary (1982, 215) considered Mommsen's emendation preferable to Dacier's because the latter "appears inconsistent with the context." After discussing the origin of private property, Cicero asserts that it should be maintained as distributed. Of the matter marked corrupt, e quo is likely to be a repetition of the preceding ex quo and therefore intrusive. si quis evidently requires supplementation. Müller inserted quid after (...) quis, but in that case one would expect a further specification. The better candidate for the supplement after quis is perhaps plus, the reading of the two fifteenth-century Munich codices 7020 and 650, an easy error. Cf. Cic. Possediamo un testo parallelo delle prime sei lezioni sul terzo libro, in cui possiamo mettere a con-fronto la dottrina di Pietro con quella di s. Tommaso. Il confronto proposto verte sul tema delle inclinazioni naturali e, segnatamente, sul loro rapporto con il bene e con il diritto naturale. Si presentano in sinossi su tre colonne il testo di Aristotele (nella traduzione latina di Guglielmo di Moerbeke utilizzata dai due commentatori), il commento di s. Tommaso ed il commento di Pietro d’Alvernia. (...) Alla fine di ciascuna sezione ho sviluppato alcune considerazioni conclusive di taglio teoretico. L’elemento teoreticamente più interessante introdotto da Pietro è costituito dall’affermazione che l’uomo “è nato per perfezionarsi” quanto al corpo e quanto all’anima ed ha a questo una esplicita in-clinazione naturale: “[Homo] natus est perfici et naturaliter inclinatur ad hoc quod perficiatur”. Qui si riecheggia l’ontologia tommasiana delle inclinazioni naturali e la metafisica del bene che le è sotte-sa. Bonum est quod omnia appetunt, ma le sostanze appetunt quella perfezione a cui sono inclinate in virtù della loro propria forma, cum unumquodque sit id quod est per suam formam. Il bene è dunque ciò che viene richiesto dalla forma dell’ente, per giungere alla piena realizzazione del dinamismo insito nella forma stessa, dinamismo che si placa solo nella piena attualizzazione di sé, ossia nella perfezione dell’ente. Bisogna notare l’attitudine di Pietro ad usare la categoria dell’inclinazione naturale, anche quando il testo aristotelico non la contiene. È necessario indugiare un po’ su questo tema, giacché in esso - a nostro giudizio - è possibile leggere il fondamento dell’etica classica, così spesso frainteso dai moderni. L’uomo è una creatura strutturalmente “indigente”: homo pluribus indiget. Quest’indigenza, per usare la terminologia di Hume contro lo stesso Hume, è un is da cui consegue rigorosamente un ought. L’indigenza è un fatto, è una carenza costatabile empiricamente; ma costatare una carenza significa scoprire nell’essere fattuale il dover essere: lo stato in cui la carenza è tolta. L’uomo, imperfectus et ex parte animae et ex parte corporis, in ragione della sua stessa imperfezione, rimanda all’uomo “perfetto”, come la potenza rimanda all’atto ed anzi è preceduta dall’atto. Asconius 63 , commenting on the pro Cornelio: Fuerunt enim plures Quinti Metelli, ex quibus duo consulares, Pius et Creticus, de quibus apparet eum non dicere, duo autem adulescentes, Nepos et Celer, ex quibus nunc Nepotem significat. Eius enim patrem Q.Metellum Nepotem, Baliarici filium, Macedonici nepotem qui consul fuit cum T. Didio, Curio is de quo loquitur accusavit … Cicero and his scholiast refer to ‘duo Metelli, Celer et Nepos’ but like Asconius do not specify their relationship. Celer himself, followed (...) by Cicero in correspondence with him, calls Nepos his frater, but since both bore the praenomen Q., this cannot be the whole story. Celer's career shows that he was the elder, yet Nepos senior, according to Asconius, entrusted his feud with Curio not to him but to Nepos iunior. (shrink)

Some of the challenges in Sanders et al. (this issue) can be aptly illustrated by means of charity nudges, that is, nudges designed to increase charitable donations. These nudges raise many ethical questions. First, Oxfam’s triptychs with suggested donations are designed to increase giving. If successful, do our actions match ex ante or ex post preferences? Does this make a difference to the autonomy of the donor? Second, the Behavioural Insights Team conducted experiments using social networks to nudge people to (...) give more. Do these appeals steer clear of exploiting power relations? Do they respect boundaries of privacy? Third, in an online campaign by Kiva, donors are asked to contribute directly to personalized initiatives. In many cases, the initiative has already been funded and donor money is funnelled to a new cause. Is such a “pre-disbursal” arrangement truthful and true to purpose as a social business model? A. 6. 20, claims to have read ‘in quodam commentario’ that theoriginal text had been not ora but Nola; ‘postea Vergilium petisse a Nolanis, aquam uti duceret in propincum rus, Nolanos beneficium petitum non fecisse, poetam offensum nomen urbis eorum, quasi ex hominum memoria, sic excarmine suo derasisse oramque pro Nola mutasse’. It may be from this passagethat by way of Donatus this story reached the expanded Servius: ‘et hocemendauit ipse, quia Nolam posuerat; nam postea offensus a (...) The social science literature on identity politics around questions of race and ethnicity is profuse, prolix and contentious. Indigenous identity politics have seen a parallel growth and are equally complex. While there are analogies and overlaps, indigenous identities and social movements are neither conceptually nor empirically a sub-set of ethnic identities. The central issue of indigenous groups is the place of first peoples in relation to the nation-state system. This takes different forms in old world states of Asia and Africa (...) to those of new world settler (ex-colonial) states of the Americas and Australasia. While the major issues of the indigenous peoples have expanded beyond their national boundaries, their modes of participation in the national political arenas vary. They share a gradual nationalization of indigenous movements, including stronger links with socio-political forces of the respective countries in the region, a heightened consciousness of global processes and the broadening and enrichment of their socio-cultural and economic objectives. This paper looks at trans-national dimensions of indigenous social movements and identity politics in relation to nation-state policy regimes and examines the varying routes taken by indigenous peoples to achieve their goals.
