Abstract:In this paper, I show that certain parts of constitutional texts can plausibly be thought of as having a meaning that changes and evolves on its own. This idea is widely rejected, especially but not only by a group of legal theorists who subscribe to a theory of constitutional interpretation called originalism. In a recent paper, the originalist Lawrence Solum has defended the so-called “fixation thesis”, according to which the meaning of the constitutional (...) text is fixed when it was first enacted and does not change later on. Solum rejects the idea that the meaning of the constitutional text might evolve because he cannot identify a plausible way in which any text could have an evolving meaning. I argue that there are such texts and offer folk-fairy-tales as an example. I then go on to present reasons why constitutions can plausibly be considered to be texts that, like fairy-tales, change their meanings independently. (shrink)

This paper investigates Joseph Schumpeter’s interest theory by specifically focusing on the influence of the relatively unknown author Rudolf Stolzmann. Though Schumpeter spoke about Stolzmann in his early works, the influence has so far not been part of a research paper. The aim of this paper is to show that major contents of the interest theory were developed from a critical review of Stolzmann´s “Soziale Kategorie der Volkswirtschaft”. It can be demonstrated that the definition of entrepreneurial profit and (...) the importance of a bank for interest can already be found in Stolzmann’s first book. This paper claims that Stolzmann played a certain or even a major role for the interest theory of Schumpeter. However, this does not mean that there are no differences between Schumpeter and Stolzmann in general. (shrink)

The purpose of this study is to propose the structural outline and conceptual framework of a Ricœurian translation theory. Following a discussion on the ambiguities around situating Ricœur in translation theory, three major interlinked components of the theory are explored. First, the metaphysics of meaning and translation is established based on Ricœur’s hermeneutics of infinitude. Then, the language-processing component is constructed through an incorporation of Ricœur’s narrative theory. For the New Critics, the presence of paradox in a text served to vouch for the complexity and therefore value of the perspective on life the text offered. For poststructuralists it seems to be even more important: paradox is the hallmark of earnestness. And if paradox is good, self-contradiction is even (...) better. That at least would seem to be the reasoning that justifies the amount of internal contradiction to be encountered among the critical principles most in vogue these days. Let us note twelve of the most egregious of these contradictions.(1) New Criticism is dead. But the New Critics’ major activity, the pursuit of the author’s intended meaning through close reading, is still very much with us. However much poststructuralists have wished to deny the importance of or possibility of achieving understanding of authorially intended meaning, their own critical commentary necessarily begins with the meaning the author is assumed to have intended. For instance, that which Derrida seeks to deconstruct or undercut in Saussure, Rousseau, Austin, or Searle begins in what he thinks they intended to say. However, the New Critic sought to resolve apparent contradictions on the principle that the interpretation producing the greatest consistency would be nearest the author’s meaning (since the author was assumed to have assumed that the reader would assume that the author intended a non-contradictory statement). In contrast, the poststructuralist typically seeks to find and emphasize or, if necessary, induce contradiction—but only after having assumed that degree of consonance and unity in the text necessary to interpret the intended meaning within which can be sought the contradictions for the [End Page 428] discovery of which the reading was undertaken. The result is thus more often than not a New Critical reading into which contradictions have been injected. One is reminded of the old story of the student in a short story writing class who told his friend that he had the story all written—all he had to do was go back and put in the symbols. The typical poststructuralist begins with a reading much like what one would expect from a New Critic and then begins inducing contradictions.(2) Literature and language cannot really be about anything beyond themselves. At the same time literature and the language on which it is dependent are regarded as largely constituting that which we experience. If language cannot refer to non-linguistic things and events, either it cannot have the power to shape our classifications, descriptions, and evaluations of things and events experienced, or there exists nothing beyond language—in which case we can abolish poverty, racism, and sexism by denying that those words have any meaning. Moreover, if language is about nothing but itself, any formulation that uses language to make statements denying the relationship of language to anything outside itself must be meaningless.(3) All narratives, indeed all statements about the world, are fictional. Yet “fictional” would have no meaning if it did not stand in contrast to those things that are not fictional, while the distinctions made available by the contrast are ones we can hardly do without. There are narratives (1) that both tellers and their hearers/readers know to be not true (“not to be the case” is the evasive formulation popular with philosophers), (2) that tellers and/or hearers/readers think true though they prove not to be, and (3) that tellers think true and are in fact partially, perhaps largely true, but erroneous in some details and necessarily incomplete. These classifications require a modicum of explanation, but to lose one’s way among them would seem to require a wilful pursuit of confusion.Class 1. In analytic philosophy, the concept of trust is often considered primarily to be a three-place relation between trustor, trustee, and the domain of trust. The analysis of trust is unsatisfactory, however, if such a relationship is derivative of other forms of trust, and consequently the analysis has only succeeded in explaining a particular branch of trust rather than explaining the root. Annette Baier considers a climate of trust, with all the moral perils of intimacy, explanatorily superior to contract-based, rational trust (...) between non-intimate equals in modern Western philosophy and thus provides an example of how the traditional analytic model is problematic. In this paper, I propose another account on which the conventional three-place trust relationship investigated in analytic philosophy is derivative. Based on Heidegger's fundamental ontology, humans are constitutively hermeneutic. If Heidegger's fundamental ontology or a similar hermeneutic anthropology is accepted, then trust relationships between humans are explanatorily subordinated to trust relationships between readers and texts rather than the other way around, as traditional accounts suggest. This reversal has a significant impact not only on our analysis of trust, but also on moral theory, personal identity, and scientific method. My paper details both the reversal in explanatory primacy and the implications for these philosophical disciplines. (shrink)

The book reconstructs the history of Western ethics. The approach chosen focuses the endless dialectic of moral codes, or different kinds of ethos, moral doctrines that are preached in order to bring about a reform of existing ethos, and ethical theories that have taken shape in the context of controversies about the ethos and moral doctrines as means of justifying or reforming moral doctrines. Such dialectic is what is meant here by the phrase ‘moral traditions’, taken as a name for (...) threads of moral discourse, made in turn of other interwoven threads, including transmission of shared codes, appeals to reform of prevailing custom, rational argument about the justification of some precept on the basis of some shared general teaching or principle, and rational argument about the ultimate basis for principles and justification of authoritative teaching. That is, the approach adopted to the reading of ethical texts depends on a firm belief in the fact that philosophers hardly created any ethical doctrine out of nothing. The main point this book tries to highlight is how different philosophical theories emerged and followed each other as a result of attempts at accounting for what was going on in the world of moral traditions. Changes were propelled by controversies between different schools, and highly abstract arguments were the unintended effects of moves made by controversialists forced to transform (and occasionally to turn upside down) their own doctrines in order to face the challenge posed by other arguments. This is the reason why the book examines not only texts that already enjoy pride of place in the history of philosophy (Aristotle, Kant, Hegel), but also other texts usually treated in the histories of religions (the Bible, the Talmud, the Quran), and others considered to be much less philosophical (Plutarchus, Pufendorf). -/- 1. Plato and a response to ethical scepticism. Two different traditions of morality in VI-V century Greece are described. The birth of philosophical questioning of traditional morality and temporal and spatial variation of custom is described within the context of the v century crisis, the demise of traditional aristocratic and tyrannical rule and the birth of democracy. Two conflicting answers to the challenge are reconstructed, namely conventionalist or immoralist theories formulated by the Sophists and the eudemonist and intellectualist Socratic theory. Plato’s own reformulation of Socrates answer to the Sophists is reconstructed. His psychological views, his classification of the four cardinal virtues and his political theory are described as parts of a unitary system, culminating in an extremely realist moral ontology identifying the idea of the good with the essence of the (moral and extra-moral) world itself. -/- 2. Aristotle and the invention of practical philosophy. Aristotle’s invention of practical philosophy as a field separated from first philosophy is shown to be an implication of his break with Plato moral ultra-realism. Aristotle’s agenda in his moral works is arguably dependent on a polemical intention, namely dismantling Socratic intellectualism. The semi-inductive or virtuously circular method of practical philosophy is illustrated, starting with the received opinions of the better and wiser individuals and trying dialectically to sift what is left of mistake and inconsistence in such opinions, finally trying to correct mistakes and make the overall practical science more consistent. The chapter illustrates then the relationship of individual ethics, or ‘monastics’, with the art and the science of the pater familias, or ‘economics’, and the science of the ruler and citizen, or politics. The nature of virtues, or better, excellences of character, is discussed, highlighting the basic role of hexis, or ‘disposition’. Prudence, or better practical wisdom, is the focus of the chapter. Its relationship with bouleusis or deliberation is examined, and its autonomous status vis-à-vis theoretical knowledge is stressed. -/- 3. Diogenes and philosophy as a way of life. The chapter provides an overview of Hellenistic ethics, which almost amounts to Hellenistic schools of philosophy, in so far as ‘philosophy’ became in these centuries primarily the name for a way of life. The typical character of the Cynical movement is highlighted, that of a school of life, not a school aimed at providing any kind of intellectual training was to be provided. -/- 4. Epicurus and ethics as self-care. The peculiar character of the Epicurean school is described, a combination of a science of well-being aiming, more than at pleasure as in the popular view, at reduction of useless suffering, of unnecessary needs, and at a balanced selection of pleasures of the best and most durable kind. -/- 5. Epictetus and ethics as therapy of the passions. The various phases of Stoicism are described, and the shifting place given to ethics in the Stoic system of idea, culminating in the paradoxical view of ethics, its impossibility in principle notwithstanding, as the only truly significant and necessary part of philosophy. Cicero is treated, showing how his own synthesis of various Hellenistic trends is as a truly philosophical enterprise, deserving serious consideration after one or two centuries when he was confined to the role of literate. Epictetus is chosen as the best example of what the Stoic tradition could yield, an art of living based on sophisticated introspection, in turn aimed at making a kind of cognitive therapy possible, dismantling obnoxious passions at their root by systematically correcting false representations. -/- 6. Philo and the reconciliation of Torah and Platonism. A reconstruction of basic ideas from a few books of the Hebrew Bible is provided, starting with the Prophetic tradition and the focus on God’s mercy as the source of motivation and standard for human behaviour. Then a comparative analysis is undertaken of a parallel tradition, namely the three codifications of the Torā (Law or, better, Instruction), highlighting how a core of moral ideas may be recognized as a basis and preamble of codification of civil law, cultural practice, and regulation of ritual purity. The importance of Leviticus is stressed as the turning point when emphasis mercy, typical of the Prophetic tradition, is combined with the legal tradition, yielding the change in sensibility of the Second Temple time. Philo of Alexandria is described as one of the three leading figures – together with Rabbi Hillel and Rabbi Yeshua – at the apex the emergence of the mentioned new sensibility, gradually including mercy as an essential part of justice and establishing the starting point of both the Rabbinic and the Christian tradition. This consists precisely in the precept of one’s neighbour’s love or of the golden rule, two eventually identical precepts whose meaning is arguably more sober and sensible than the long-lasting Christian tradition deriving from John and Augustine has made us believe and no novelty vis-à-vis so-called Ancient-Testament teachings. -/- 7. Augustine and Christianity as Neo-Platonism. The first section examines the moral doctrines of so-called 'ethical Treaties' from the Talmud, a group of treaties, among which the best known is Pirqé Avot, that were left out of the six "orders" of the canon as they did not fit in any of the six groups of issues ritual or legal on which the division was based. According to Maimonides, their peculiar theme is provided by the Deòt, 'opinions', i.e., mental dispositions, that is, the translation of the Greek term hexeis and Arab akhlak (in turn providing in this language the name for ethics as such). The three topics I reconstruct are: i) the notion of Torah: The Torah is understood as the world order itself, or as the ‘Wisdom’ that existed even before creation and was ‘the tool by which the world was built’; however, the Torah is an earthly and human entity, as it was "received" by humans, and from that very moment belongs to them; ii) the relationship between love of God and love of neighbour; the treaties require us to study and practice the Torah ‘for its own sake’, that is, require us to act out of love, not out of fear or hope of reward; iii) the idea of sanctification of daily life: having disappeared with the destruction of the Temple the possibility of any conflict between liturgical service and everyday life, the latter is assumed to be in itself divine service: to give food to the poor has the same value as sacrifices in the Temple, and as an implication, the insistence become recurrent on the goodness of created things in themselves along with a polemic against ascetic currents. The conclusions drawn are: i) the moral teachings of the Talmud and those of Yeshua are, rather than similar, virtually identical; one may safely say that the precept of love and the golden rule are central ones for all Talmudic rabbis, that mercy plays an indispensable role alongside with justice, and the latter is not a different thing from one’s neighbour’s love; ii) a peculiarity of Talmud rabbis facing Yeshua is the idea of study as worship, and knowledge as a source of justice; but this is an idea of Judaism after the Temple's destruction that cannot be attributed to the Pharisees of Yeshua’s time; iii) the relation of study and practice in the Talmud parallels that between faith and deeds in Paul's epistles, that is, respectively faith or learning are a necessary and sufficient condition to be recognized as righteous , but deeds are the inevitable effect of either faith or learning. The sayings ascribed to Yeshua are examined first, yielding the conclusion that a close equivalent may be found for every saying in Talmudic literature and yet the whole is ascribed to one rabbi, with rather consistent stress on God’s mercy and unconditional forgiving as the mark of true imitation of God. Thus, Yeshua’s teaching is pure Judaism. The third section describes briefly the galaxy of Gnostic currents and Manichaeism, trying to sketch the profile of moral teachings resulting from an encounter of Asian spiritual traditions, Hellenistic lore and sparks of teachings from apocalyptic Jewish currents. The last section summarizes the turbulent history of several encounters between Christian currents and Hellenistic philosophical schools. The first one was with late Cynicism. Recent, rather controversial, literature discovered the jargon and a few topics from the Stoic-Cynical popular philosophy in a few books from the New Testament itself. This, far from proving that Rabbi Yeshua had been influenced by cynic preachers, is a proof of the necessity felt by Christian preachers to translate the original ‘Christian’ teaching into a Greek lexicon deeply impregnated with cynic terminology. The second was with Platonism, yielding the mild and temperate moral teaching of Clemens of Alexandria, teaching the sanctity of nature and the human body, the joy of moderate fruition of ‘natural’ kinds of pleasures, and the beauty of the marital life – in short, the opposite of the standard picture of Medieval Christianity. Ambrose of Milan brings about a different kind of synthesis, namely with Middle Platonism, where Stoic themes prevail. The most shocking case is Augustine, where an early Manichean education is overcome in a former phase by a synthesis of Plotinian Neo-Platonism and Christian preaching, yielding a sustained polemic with the Manicheans and rather optimistic views on life and Creation, the body and sexuality, and Hebrew-Judaic tradition not far from Clemens of Alexandria. In a later phase, occasioned by controversy on the opposite front, with such Christian currents as the Pelagians and Donatists, Augustine comes back to heavily anti-Judaic and world-denying ascetic attitudes where is earlier Manichean upbringing seems to emerge again. The tragedy of medieval Christianity will be the later Augustine’s overwhelming influence. A final section is dedicated to the monastic tradition where a curious mixture of world-denying asceticism with an astonishingly penetrating ‘science’ of introspection emerges. -/- 8. Al Farabi and the reconciliation of Islam and Platonism. The Qurān and the qadit, that is, collections of sayings ascribed to the prophet Muhammad contain a wealth of precepts and catalogues of virtues mirroring moral contents from the Jewish and the Christian traditions, among them the basic notion of imitation of the Deity, where mercy is assumed to be its basic trait. An important tradition within Islam, namely Sufism, stressed to the utmost degree the role of mercy, turning Islam into a mystic doctrine centred on retreat from the world, abandonment to God’s will, and a peaceful and fraternal attitude to our fellow-beings. A secular literary tradition originating in the Sassanid Empire, the literature of advice to the Prince had for a time a widespread influence in the newly constituted Arabic-Islamic commonwealth. In a later phase, the legacy of Hellenic philosophy made its way into the intellectual elite of the Islamic world. The first important legacy was Platonic, and the Republic became the main text for Islamic Platonism. Al-Farabi wrote an enjoyable remake of the Platonic Republic, arguing that the citizen’s virtues were the basis on which the political building needs to rest. The secular lawgiver is enlightened by the light of reason in his everyday practice of governance, but room is made for the Prophet as the voice of revealed truth that confirms and completes the rational truth that philosophy may afford. In a second phase also Aristotelian and Stoic influence were assimilated. Miskawayh’s treatise was the masterwork at the time Arabic philosophy reached its Zenith. It is a treatment of the soul’s diseases and their remedies, combining the Aristotelian doctrine of the golden mean with the Stoic doctrine of the passions and elements of Galenic medicine. Towards the eleventh-twelve centuries a war raged among theologians and philosophers, finally won by the former with disappearance of philosophy as such. The newly established mainstream, yet, was no kind of intolerant fanaticism. It drew from the work of mystic theologian Al-Ghazālī, the best heir of Sufism, teaching a tolerant and peaceful attitude to our fellow-beings and a passive attitude to destiny as an expression of the Divine will. -/- 9. Moshe ben Maimon and the reconciliation of Torah and Aristotelian ethics. The encounter between the Talmudic tradition and Hellenic philosophy had taken place a first time in Alexandria at the time of Philo but the two traditions had parted way again. In fact, the kind of Platonic Judaism founded by Philo survived only within Christianity, in the fourth Gospel and then in writings by Clemens of Alexandria. The Talmudic literature had absorbed just less striking traits from the Hellenic Philosophy, namely an idea of ethics as care of the self and a role for the education of character as propaedeutic to theoretical knowledge. In the Arabic-Islamic world, a second round started when Jewish authors writing in Arabic undertook the task to prove the full compatibility of the tradition deriving from Torah and Platonic philosophy. The culmination of this attempt is provided by Moshe ben Maimon who tried to use Aristotelian ethics as a language into which the teaching from the Pirké Avot could be translated. -/- 10. Thomas Aquinas and the reconciliation of Christian morality and Aristotelian ethics. In the first section the fresh start is described of philosophical ethics in Latin Europe at the turn of the Millennium. In a first phase, Anselm and Peter Abelard built on a Platonic and Augustinian legacy. In this phase. remarkable innovations are introduced, including Abelard’s claim of the obliging character of erring consciousness. In a second phase, the rediscovery of Nicomachean Ethics thanks to Latin translation of Arabic versions gives birth to a new wave of ethical studies, recovering the very idea of Aristotelian practical philosophy, with the potential implication of full legitimization of natural morality, i.e. ethics without Revelation. Aquinas’s ethics is a theological ethics out of which it would be vain to try to extract a self-contained philosophical ethics. His treatment of topics in philosophical ethics, yet, does not boil down to repetition of Aristotelian arguments but is rather a creative reshaping of such arguments. For example, he introduces also in the practical philosophy a first principle parallel to the principle of non-contradiction; and he also carries out a synthesis of Aristotelianism, Stoicism, and neo-Platonism. Even though it is essentially moral theology, Aquinas’s doctrine - unlike Augustine – grants full citizenship to "natural" morality, firstly by rejecting the claim that the corruption of human nature due to the original sin is so radical as to leave "pure nature" incapable of moral goodness. The doctrine is presented in a more sophisticated formulation in a few of the Quaestiones, such as De Malo and De Veritate, in the Summa contra Gentes and in the commentaries to Aristotle than in the famous Summa Theologica, but the latter work includes the only or the largest exposition of some decisive part of the theory. Thus, the Summa Theologica should be read for what it is more than criticized for not being what it was not meant to be. It was not meant to be the brilliant synthesis of all that Reason he had been able to produce with what Revelation had added about which the Neo-Thomists used to dream, but rather a manual for the training of preachers and confessors, where theoretical claims are not too demanding and a few serious tensions are left. Besides a jump between the Prima Secundae and the Secunda Secundae, being the former an essay in virtue theory and the latter a handbook for confessors, the most serious tension is perhaps the one between the ethics of right reason presented in most of Ia-IIae and the eudemonistic ethics developed in quaestiones 1-5 of the same part; the alternative ethical theory which also may be found in Augustine, the Stoic view of a cosmic reason eventually coincident with the moral law, was believed by Anselm (followed by John Duns Scotus and William of Ockham) to be incompatible with eudemonism. It is questionable whether Thomas could reduce the tension proving that it is just an apparent tension, in so far as the right reason and bliss derived from knowledge of God tend to coincide, but this is just a conjecture. Thomas’s ethics is a virtue ethic, not a law-based one, and moral judgment focuses on the virtues, particularly charity, not on the commandments and even less on absolute prohibitions; Thomas, however, would not have considered a drastic alternative between law and the virtues such as the one which has been advanced in late twentieth-century philosophy to be justified. Nonetheless, when it discusses ‘special’ virtues, it ceases to be an ethics of virtue and becomes a disappointing and often contradictory discussion of legal and illegal acts. Such a discussion takes most of the time ‘reasonable’ middle positions on controversial issues but not the alternative approach that Aristotelianism would have made possible; even when some occasional Aristotelian claim shows up, such as money’s barrenness as a reason against usury, this seems to be made by an author who apparently ignores the Aristotelian Thomas of the Prima Secundae. It is an ethic of human autonomy which recognizes the binding character of the individual conscience and, potentially, even a duty to disobey unjust laws. It is true that what Thomas writes in his discussion of death penalty and persecution of heretics is simply disgusting, and yet we should blame Thomas the man, not Thomist ethical theory. Finally, Thomas’s ethics is not ethical ‘absolutism’, as both traditionalist Catholic theologians and secularist enemies of dogmatic morality tend to believe. It is instead an ethic of prudential judgment. Exceptions to this approach – or better results of logical fallacies – are such claims as the absolute character of negative precepts and of the existence of "intrinsically evil acts", claims that simply cease to make sense in the light of Thomas’s own distinction between human act and natural act, carrying consequences Thomas did not live long enough to draw or was not consistent enough to dare to draw. -/- 11. Francisco de Vitoria and casuistry. The first topic illustrated is the discussion about the notion of pura natura, namely the human condition after the original sin and before divine revelation. The core notion was already there in Aquinas but was later developed by Caietanus (Thomas de Vio) with a number of interesting implications: firstly a view of human nature as such much more positive than Augustine’s and his followers’ view, including both Calvinists and Jansenists; secondly, the implication that the philosopher’s morality, as opposed to the Christian’s morality, is a quite respectable kind of morality; thirdly, that theocracy and prosecution of the unfaithful lacked justification, with more far-fetching consequences than Aquinas himself had dared to draw. The second topic is casuistry, a new name for a comparatively older way of thinking, which was already there in late Stoicism and Cicero as well as in the Talmudic literature. This is an approach aimed at yielding probable enough solutions for doubtful cases even in absence of completely safe staring points. The genre developed from medieval reference books for confessors and became by the sixteenth-century a sophisticated tool-box for dealing with various fields of applied ethics. Francisco Vitoria, the main authority of Baroque Scholasticism, was a controversial figure, among the proponents of the new discipline of casuistry and a consistent proponent of more separation between the religious and the civil authority, stricter limits to the legitimacy of war, innate rights of non-Christian nations in the New World based on the notion of pura natura, providing a standard of ‘natural’ goodness, previous to revelation, on which the Indian nations were judged to live in a naturally good condition, provided with the institutions of family, justice, and religion had accordingly a right to full respect by Christian sovereigns. Bartolomé de Las Casas, arguing along similar lines, was the leader of a historical battle in defence of the rights of the Indios. -/- 12. Michel de Montaigne and the art of living. A short description of one of the Renaissance Phyrronism, one of the classical philosophies revived in the fifteenth and sixteenth century. Montaigne combines the sceptical epistemology with an understanding of ethics – indeed of philosophy as a whole – in terms of an art of living inspired by two basic ideas, sagesse, that is, practical wisdom as the only kind of rationality available after theology, science, and tradition have declared bankrupt, and an aesthetic ideal of self-transformation through the art of writing and introspection. -/- 13. Pierre Nicole and neo-Augustinianism. The chapter illustrates first the vicissitudes of Augustinianism newly born after the late medieval triumph of Thomist Aristotelianism in the alternative Protestant and Catholic versions processed by the Calvinists and the Jansenists. Then it illustrates the doctrines of Pierre Nicole, Blaise Pascal’s best disciple, on the impossibility of introspection, on the ubiquity of self-deception, on the incurably evil character of the passion of love, and on the two moralities, the one of the man of the world, the morality of honesty which is indispensable for granting peace and order but devoid of any true value for eternal salvation, since the same external behaviour may be prompted by opposite motivations, and the morality of charity, the only true one but also useless to society. The third topic is Pierre Malebranche’s view of self-deception as a ubiquitous phenomenon accounting for human action and responsibility and his reformulated theory of self-love, no less ubiquitous than for Nicole and yet not as incurably evil, given the distinction between morally indifferent and even necessary amour de soi and vicious amour proper, a distinction on which the whole of Rousseau’s moral and political theory rests. -/- 14. Samuel von Pufendorf and the new science of morality. The chapter is dedicated to the discovery of the idea of a ‘new moral science’. Hugo Grotius is discussed first highlighting the real character of his project, much closer to the Thomist idea of a natural law accessible to non-corrupted human reason when human beings are living in a state of pura natura. Then Hobbes’s combination of scepticism, voluntarism, and conventionalism is described and both the continuity with Grotius’s new science, in the search for non-revealed rational morality, and the break with him, in the adoption of voluntarism and refusal of an intellectualist view of natural law, are illustrated. Pufendorf’s work is illustrated as a synthesis of the two previous attempts and the – up to Schneewind underestimated – paradigmatic example of the new science of morality. -/- 15. Richard Cumberland and consequentialist voluntarism. The chapter gives an overview of eighteenth-century Anglican ethics, noticing how the Cambridge tradition gave special weight to natural theology as opposed to positive or revealed theology – and how two Cambridge fellows, John Gay and Thomas Brown, elaborated on Cumberland’s (and Malebranche’s, as well as Leibniz’s) strategy for finding a third way between intellectualist view and voluntarist view of the laws of nature. The result of their elaboration was a kind of a rational-choice account of the origins of natural laws, where a law-giver God chooses among a number possible sets of laws on a maximizing criterion, and God’s maximandum is happiness for his creatures. The chapter notices also how such a solution aimed at solving at once the problem of evil and that of the foundation of moral obligation by proving how God’s choice was justified as far as it was the one minimising the amount of suffering in the world. 16. Richard Price and intuitionism. The chapter describes first the doctrines of the Cambridge Platonists, an example of hyper-rationalist reaction to Calvinism. Secondly it describes the sophisticated and universally ignored – from Sidgwick to Anscombe –version of what was later labelled ‘ethical intuitionism’ – showing how it escapes familiar objections and misrepresentations of intuitionism – from Mill to Rawls – in grounding its argument on transcendental arguments while carefully avoiding recourse to introspection and psychological evidence, which has been taken as a too easy target by critics of intuitionism. Thirdly, the chapter discusses Whewell’s ‘philosophy of morality’, as opposed to ‘systematic morality’, not unlike Kant’s distinction between a pure and an empirical moral philosophy. Whewell worked out a systematization of traditional normative ethics as a first step before its rational justification; he believed that the point in the philosophy of morality is justifying a few rational truths about the structure of morality such as to rule hedonism, eudemonism, and consequentialism; yet a system of positive morality cannot be derived solely from such rational truths but requires consideration of the ongoing dialectics between idea and fact in historically given moralities. Whewell’s intuitionism turns out closer to Kantian ethics than commentators have made us believe until now, and quite different from what Sidgwick meant by intuitionism. -/- 17. Adam Smith and the morality of role-switch. The chapter describes first, Hutcheson’s attempt at basing the ‘new science’ of natural law on different bedrock than Pufendorf and the English Platonists, namely a moral sense, a faculty whose existence is assumed to be proved on an empirical basis. The second step is a reconstruction of Hume’s rejoinder in terms of a new science of man including morality on an ‘experimental’ basis, that is, a ‘Newtonian’ hypothetical-deductive approach, distinguished from Hutcheson’s allegedly uncritical descriptive approach to human nature. The third step is a reconstruction of Adam Smith theory of morality understood as emerging from a spontaneous interplay of exchanges of situations (the most basic meaning of the word ‘sympathy’ as construed by this author). -/- 18. Jeremy Bentham and utilitarianism. The bulk of the chapter is dedicated to the doctrines of Jeremy Bentham. The Enlightenment spirit that suggested the idea of a new morality, free from religion, is illustrated. The notion of utility is illustrated as well as the subsequent formulations of the principle of utility. The idea of felicific calculus is discussed, showing how its inner difficulties prompted several reformulations of the principle of utility in order to avoid undesirable implications of proposed formulations. The role of the thesis of spontaneous convergence between interest and duty is discussed, showing how it left numberless questions open, and the distinction between the virtues of prudence, justice and beneficence is described as a way out of the deadlocks of classical utilitarianism. After Bentham, Mill’s reformed utilitarianism is reconstructed, showing how it is a kind of mixed system – as closer to common sense as it gives up Bentham’s claims to consistency and simplicity – resulting as unintended consequences from the controversies in which Mill was too keen to engage. The hidden agenda of the controversy between Utilitarianism and Intuitionism, going beyond the image of the battle between Prejudice and Reason, is described, showing how both competing philosophical outlooks turn out to be more research programs than self-contained doctrinal bodies, and such programs appear to be implemented, and indeed radically transformed while in progress thanks to their enemies no less than to their supporters. -/- 19. Immanuel Kant, practical reason and judgment. The chapter argues that Kant took from Moses Mendelssohn the idea of a distinction between geometry of morals and a practical ethic. He was drastically misunderstood by his followers precisely on this point. He had learned from the sceptics and the Jansenists the lesson that men are prompted to act by deceptive ends, and he was aware that human actions are also empirical phenomena, where laws like the laws of Nature may be detected. His practical ethics made room for judgment as a holistic procedure for assessing the saliency of relevant moral qualities in one given situation; this procedure yields the same results as the geometry of morals does for abstract cases but does so immediately and without balancing conflicting duties with each other, since what makes for the salient quality of a situation is perceived from the very beginning. Kant's practical philosophy is richer than the received image, making room for an ‘empirical moral philosophy’ or moral anthropology including treatment of commerce, needs, value and price, happiness and well-being; the overall social theory and philosophy of history is less different from Adam Smith's than the received image makes believe; the paradox of happiness is central to Kant's philosophy; a distinction between happiness and well-being is clearly drawn; the distinction plays a basic role in establishing a link between the economic and the moral life. -/- 20. Georg Wilhelm Friedrich Hegel and the critique of abstract universalism. The chapter describes first the Romantic movement and the implications some of its concerns, rescuing passions, community, tradition, the individual as the bearer of a unique destiny, and the longing for organic unity between the individual, mankind and nature. Hegel’s contribution is discussed then, highlighting how, on the one hand, he shared a number of these concerns and on the other he had more rationalist leanings. The notion of morality is the pivotal point of the reconstruction, highlighting how Hegel construes this notion as a key to his own diagnosis of the malaise of modernity – the separation of individual and Gemeinschaft – and how his attack on Kant turns around this very idea. -/- 21. Friedrich Nietzsche against Christianity and the Enlightenment. The chapter illustrates first the idea of deconstruction of the back-world of values. Nietzsche claims to be legitimate heir of the French moralists, Leibniz, Kant and Hegel, in so far as he allegedly carries out to its deepest implications their discovery of what lies behind traditional naïve belief in the existence of an objective realm of values just waiting for description by the philosopher. The two exemplars form which genealogy draws inspiration are the classical philologist’s historical reconstructions of lost meanings and the chemist’s decomposition of elements. Then the genealogy of the notions of good and evil carried out in the first dissertation of Genealogy of morals is illustrated with its paradoxical conclusion that will to power is in fact the only ‘genuine’ kind of goodness. The third point illustrated is the dialectic of ascetism and self-realization with its ambiguous outcome. The suggested interpretation of such outcome is that Nietzsche’s normative ethics is a kind of virtue ethics taking an aesthetic ideal as a normative standard -/- 22. George Edward Moore and ideal utilitarianism. The chapter discusses the ideas of common sense and common-sense morality in Sidgwick. I argue that, far from aiming at overcoming common-sense morality, Sidgwick aimed purposely at grounding a consist code of morality by methods allegedly taken from the natural sciences to reach, also in ethics, the same kind of “mature” knowledge as in the natural sciences. His whole polemics with intuitionism was vitiated by the a priori assumption that the widespread ethos of the educated part of humankind, not the theories of the intuitionist philosophers, was what was worth considering as the expression of intuitionist ethics. In spite of a naïve positivist starting-point, Sidgwick was encouraged by his own approach in exploring the fruitfulness of coherentist methods for normative ethics. Thus, Sidgwick left an ambivalent legacy to twentieth-century ethics: the dogmatic idea of a “new” morality of a consequentialist kind, and the fruitful idea that we can argue rationally in normative ethics albeit without shared foundations. Then it reconstructs the background of ideas, concerns and intentions out of which Moore’s early essays, the preliminary version, and then the final version of Principia Ethica originated. I stress the role of religious concerns, as well as that of the Idealist legacy. I argue that PE is more a patchwork of rather diverging contributions than a unitary work, not to say the paradigm of a new school in Ethics. I add a comparison with Rashdall’s almost contemporary ethical work, suggesting that the latter defends the same general claims in a different way, one that manages to pave decisive objections in a more plausible way. I end by suggesting that the emergence of Analytic Ethics was a more ambiguous phenomenon than the received view would make us believe, and that the wheat (or some other gluten-free grain) of this tradition, that is, what logic can do for philosophy, should be separated from the chaff, that is, the confused and mutually incompatible legacies of Utilitarianism and Idealism. -/- 23. Edmund Husserl and the a-priori of action. The chapter illustrates first the idea of phenomenology and the Husserl’s project of a phenomenological ethic as illustrated in his 1908-1914 lectures. The key idea is dismissing psychology and trying to ground a new science of the a priori of action, within which a more restricted field of inquiry will be the science of right actions. Then the chapter illustrates the criticism of modern moral philosophy carried out in the 1920 lectures, where the main target is naturalism, understood in the Kantian meaning of primacy of common sense. The third point illustrate is Adolph Reinach’s theory of social acts as a key the grounding of norms, a view that basically sketches the very ideas ‘discovered’ later by Clarence I. Lewis, John Searle, Karl-Otto Apel and Jürgen Habermas. A final section is dedicated to Nicolai Hartman, who always refused to define himself a phenomenologist and yet developed a more articulated and detailed theory of ‘values’ – with surprising affinities with George E. Moore - than philosophers such as Max Scheler who claimed to Husserl’s legitimate heirs. -/- 24. Bertrand Russell and non-cognitivism. The chapter reconstructs first the discussion after Moore. The naturalistic-fallacy argument was widely accepted but twisted to prove instead that the intuitive character of the definition of ‘good’, its non-cognitive meaning, in a first phase identified with ‘emotive’ meaning. Alfred Julius Ayer is indicated as a typical proponent of such non-cognitivist meta-ethics. More detailed discussion is dedicated to Bertrand Russell’s ethics, a more nuanced and sophisticated doctrine, arguing that non-cognitivism does not condemn morality to arbitrariness and that the project of a rational normative ethics is still possible, heading finally to the justification of a kind of non-hedonist utilitarianism. Stevenson’s theory, another moderate version of emotivism is discussed at some length, showing how the author comes close to the discovery of the role of a pragmatic dimension of language as a basis for ethical argument. Last of all, the discussion from the Forties about Hume’s law is described, mentioning Karl Popper’s argument and Richard Hare’s early non-cognitivist but non-emotivist doctrine named prescriptivism. -/- 25. Elizabeth Anscombe and the revival of virtue ethics. The chapter discusses the three theses defended by Anscombe in 'Modern Moral Philosophy'. I argue that: a) her answer to the question "why should I be moral?" requires a solution of the problem of theodicy, and ignores any attempts to save the moral point of view without recourse to divine retribution; b) her notion of divine law is an odd one more neo-Augustinian than Biblical or Scholastic; c) her image of Kantian ethics and intuitionism is the impoverished image manufactured by consequentialist opponents for polemical purposes and that she seems strangely accept it; d) the difficulty of identifying the "relevant descriptions" of acts is not an argument in favour of an ethics of virtue and against consequentialism or Kantian ethics, and indeed the role of judgment in the latter is a response to the difficulties raised by the case of judgment concerning future action. A short look at further developments in the neo-naturalist current is given trough a reconstruction of Philippa Foot’s and Peter Geach’s critiques to the naturalist-fallacy argument and Alasdair MacIntyre’s grand reconstruction of the origins and allegedly unavoidable failure of the Enlightenment project of an autonomous ethic. -/- 26. Richard Hare and neo-Utilitarianism. The chapter addresses the issue of the complex process of self-transformation Utilitarianism underwent after Sidgwick’s and Moore’s fatal criticism and the unexpected Phoenix-like process of rebirth of a doctrine definitely refuted. A glimpse at this uproarious process is given through two examples. The first is Roy Harrod Wittgensteinian transformation of Utilitarianism in pure normative ethics depurated from hedonism as well as from whatsoever theory of the good. This results in preference utilitarianism combined with a ‘Kantian’ version of rule utilitarianism. The second is Richard Hare’s two-level preference utilitarianism where act utilitarianism plays the function of eventual rational justification of moral judgments and rule-utilitarianism that of action-guiding practical device. -/- 27. Hans-Georg Gadamer and rehabilitation of practical philosophy. The post-war rediscovery of ethics by many German thinkers and its culmination in the Sixties in the movement named ‘Rehabilitation of practical philosophy’ is described. Among the actors of such rehabilitation there were a few of Heidegger’s most brilliant disciples, and Hans-Georg Gadamer is chosen as a paradigmatic example. His reading of Aristotle’s lesson I reconstructed, starting with Heidegger’s lesson but then subtly subverting its outcome thanks to the recovery of the central role of the notion of phronesis. -/- 28. Karl-Otto Apel and the revival of Kantian ethics. Parallel to the neo-Aristotelian trend, there was in the Rehabilitation of practical philosophy a Kantian current. This started, instead than the rehabilitation of prudence, with the discovery of the pragmatic dimension of language carried out by Charles Peirce and the Oxford linguistic philosophy. On this basis, Karl-Otto Apel singled out as the decisive proponent of the linguistic and Kantian turn in German-speaking ethics, worked out the performative-contradiction argument while claiming that this was able to provide a new rational and universal basis for normative ethics. An examination of his argument is some detail is offered, followed by a more cursory reconstruction of Jürgen Habermas’s elaboration on Apel’s theory. -/- 29. John Rawls and public ethics as applied ethics. Rawls’s distinction between a “political” and a “metaphysical” approach to one central part of ethical theory, namely the theory of justice, is interpreted as a formulation of the same basic idea at the root of both the principles approach and neo-casuistry, both discussed in the following chapter, namely that it is possible to reach an agreement concerning positive moral judgments even though the discussion is still open – and in Rawls’ view never will be close – on the basic criteria for judgment. -/- 30. Beauchamp and Childress and bioethics as applied ethics. The chapter presents the revolution of applied ethics while stressing its methodological novelty, exemplified primarily by Beauchamp and Childress principles approach and then by Jonsen and Toulmin’s new casuistry. -/- . From mid-2020 until early 2023, the Chronicle of Higher Education published a series of essays that, when summed up, represents a valediction for English and American literary studies as practiced during the last half century. Some of the Chronicle authors, enjoying the privilege of tenure, speak for the profession as it was in healthier times. Others, representing a younger generation of scholars, hold on to unstable teaching positions. All are disconsolate.The essays, collected on the Chronicle website, look back to (...) those earlier times to seek the reasons for today's dreary situation. In dirgelike recitations, external causes are named and excoriated: the drying up of state funding, the growth of administrative personnel at the cost of faculty positions, the reluctance of debt-ridden students to concentrate on studies not leading to jobs, and the general parental and public resistance to anything considered effete. But at least one contributor to the series, Michael Clune of Case Western Reserve University, will not permit his fellow teachers to escape whipping: “Our fuzziness about what we do raises in the minds of our publics the not unreasonable assumption that we don't know what we're doing. The crisis in the humanities requires that we be open and honest about our discipline's rationales.”What does such a call to action mean? Does Clune ask for more exacting curricular control, more agreement as to pedagogical mission, a greater consensus about certifiable merit in professional advancement? About specific alterations to the system, he is not forthcoming, and this generalization applies to most of the other contributors as well: the prognosis is clear but the cure beyond anyone's reach. Why? To propose radical changes to the humane disciplines, even when most necessary, invites deep resistance. If professors are largely political liberals, they are also pedagogical archconservatives. Clune is nevertheless right in asking fellow professors for candor about what they are doing. The one strategy that cannot work is rehearsing their woes in public. Nor can a focus on the theoretical skirmishes in which they entangle themselves create the kind of consumer demand—student demand—that is needed. Unless they can collectively devise (or recover) intellectual attractions to draw in a new generation of students and fill lecture halls and seminar seats with them, humanists will be even further shunted to the sidelines.Another essayist, herself determined to get matters straightened out and thereby save the discipline, imagines her colleagues uniting to establish a stricter definition of what they collectively should do. Hannah Walser of the Harvard Society of Fellows believes that professors teaching literary works have been all too satisfied with the wasteful art of praising or derogating the performance or rhetorical brilliance of their colleagues: “In literary studies’ more affirmative modes, elaborate assurances of our colleagues’ competence—those more-a-comment-than-a-questions that praise a talk as beautiful, brilliant, powerful, and so on—end up standing in for actual arguments about the rightness or wrongness of a claim.” Literary works do not function as truth-telling “claims,” however, but as imaginative creations entertaining both truth and falsehood, the “real” as well as the “unreal.” In order to read those creations, and to share those readings with others, teachers must agree on the empirical terms, the evidentiary tools, to use. Walser rightly wants everyone to play the same game with the same rules. Only then can teachers come to terms with literary objects whose ultimate value is determined by something direct and visceral—aesthetic pleasure. But while Walser is right to call for procedural agreement, such a call will not, by itself, entice students to return to the classroom.In another essay, Katie Kadue looks back nostalgically to a time when, in its modest way, the world of literary studies had “stars,” when the English Institute featured brilliant personages at well-attended meetings, when jobs were plentiful and seminal books about theoretical issues were everywhere discussed. To Kadue, a young scholar, such moments seem all the more dazzling and attractive by virtue of their absence today. Were “stars” again to capture collective attention, a sign would be given that the humanities could recover its health and make literary study attractive to students again.Hence the Chronicle publication concludes with portraits of two humanists, Sianne Ngai and Mark McGurl, who have gained some recognition and acclaim. Perhaps, as the Chronicle suggests, with them a new constellation of stars is coming into view.Ngai is the author of three impressive and widely discussed monographs, the most recent being Theory of the Gimmick (2020), which, with a complexity uniquely its own, asks the reader to study the mixed attraction and repulsion produced by the intrusion of a “gimmick”—something in a text that draws attention to itself and exposes the inner workings of the text. When we encounter a gimmick in a text, it provokes both suspicion and pleasure: “When we say something is a gimmick, we mean it is overrated and deceptive, that you would have to be a sucker to fall for it. Yet gimmicks exert a strange hold on us. As with a magic show, we can enjoy the gimmick even while we know we are being tricked.” Other gimmicks—arousing “small” or “minor” affects—have been overlooked or dismissed in conventional literary discourse. Ngai, entranced by them, also argues that, beyond suspicion, pleasure, and annoyance, gimmicks have the power to reveal deep cultural, economic, and political forces shaped by contemporary capitalism.Ngai's strategy is ingenious and idiosyncratic. Its apparent strength is that it can explain everything—literary, economic, political, and cultural—that comes within its range. But its very originality renders it inoperable by anyone, be it student or teacher, other than its inventor. Like Marshall McLuhan, Hugh Kenner, Leslie Fiedler, and Stanley Fish before her—each of them working with a home-grown methodology—Ngai herself is her theory. Her inimitability prevents her theoretical procedures from becoming a generally shared answer to the classroom problems of literary study.McGurl, a sociologist of textual production, readership, and consumption, is more conventional than Ngai. He is certainly more omnivorous. He is interested in everything out there for the reader or listener to acquire, high or low, bad or good, by way of book, podcast, recording, or any other means or genre. His recent book Everything and Less: The Novel in the Age of Amazon shows how the company “has created the psychological and temporal conditions that not only alter how fiction is bought, sold, distributed, and read, but also how it is produced.” Might it be possible—and attractive—for teachers and students to follow and extend procedures like those of McGurl? An immense panorama of verbal matter might thereby await classroom after classroom. With much to read and much to hear, professors and students could examine and evaluate data aplenty. Might classrooms and seminar rooms once again be filled, this time by sociologists of literature? Professor Clune's query—“Why should students listen to me? What claim do I have on the public?”—could then be answered: We and you hereby claim everything written as our province; we, a new generation of humanists, will thus have work enough.Alas, for universities and colleges to make such a move—to resolve that literary study should embrace all of writing—would be to forfeit the one inestimably valuable form of intellectual capital now and forever readily available to them: that unique body of works known as literature: poetry, drama, fiction. Some professors appear to believe that this capital asset is wanting, depleted as a source, and therefore impotent to generate exciting scholarly work or teaching—which is why, for the last four or so decades, “theory” in its many varieties has proved so seductive. But theoretical discourse, derivative and secondary, proves vapid without the fiction, poetry, and drama from which it derived and on which it survives. Recognizing the rare power to be found in the works themselves and nowhere else, it is to those works that teachers must somehow return. Only then will there be compelling reason to hope that students will follow. (shrink)

The work of the German philosopher Manfred Frank has profoundly affected the direction of the contemporary debate in many areas of philosophy and literary theory. This present collection, first published in 1998, brings together some of his most important essays, on subjects as diverse as Schleiermacher's hermeneutics, the status of the literary text, and the response to the work of Derrida and Lacan. Frank shows how the discussions of subjectivity in recent literary theory fail to take (...) account of important developments in German Idealist and Romantic philosophy. The prominence accorded language in literary theory and analytic philosophy, he claims, ignores key arguments inherited from Romantic hermeneutics, those which demonstrate that interpretation is an individual activity never finally governed by rules. Making meaning out of life requires effort, sustained thought and action. It can be difficult to reassert our responsibility for solving real life problems from within social science research or current trends, such as extremely deconstructivist text, and postmodernism in its cheerfully nihilistic guise. Hermeneutical philosophy, of the Ricoeurian reconstructive mode, rehabilitates text as a powerful device for influencing others and offers us courage to proceed with the human project by developing a way of writing, thinking and behaving that (...) is provisional, affirmative and conciliatory, yet constantly questioning. Ricoeur invites the person, both reflective subject and empiricist object of research, to combine these elements and use written text and action as text for an active mode of living. Within philosophy he attempts to achieve a rapprochement between hermeneutical and rational thought. Understanding oneself, through better understanding of the other, derives benefit from crossing disciplinary boundaries between, in this study, philosophy and the social sciences (education and psychology), in order to attempt to move from the particular, individual issues to the general, holistic view and return to one’s own situation to act for oneself and others. Ricoeur offers us the opportunity to repossess language, to be ethical and practical, and to challenge the hegemony of Explaining, going beyond method and methodology into epistemology and beyond fact into Understanding: an ontology of hope that makes sense of plurality, without the damage of relativism. This text attempts a narrative ethics, illustrating how Ricoeur’s work transformed my thinking from that of a method-bound psychologist to that of, perhaps, a philosopher in the making. Depending on how people respond to it, a constitution can cause suffering on a vast scale or lay the foundation for a nation’s liberty, prosperity, and equality. As currently practiced, constitutional theory and interpretation especially concern the meaning, history, and philosophy of constitutional texts. These approaches cannot predict the responses of people to constitutions. Constitutional consequentialism, which I advocate, is a research program that aims to predict the effect of alternative forms and interpretations of constitutions (...) on policy values, especially liberty, prosperity, and equality. This paper discusses two constitutional processes. “Median democracy,” which empowers the median voter, is implemented by referenda and ballot initiatives, special districts, and winner-take-all elections. “Bargain democracy,” which lubricates bargaining among factions and regions, is implemented by legislatures, comprehensive governments, and proportional representation. I show that median democracy causes stability, whereas bargain democracy ideally causes efficiency and often causes corruption or instability. (shrink)

Construed broadly as interpretation theory, hermeneutics could be understood to encompass all modes of interpretation (textual or otherwise), including any kind of literary criticism, from Aristotle's poetics to the New Criticism of the 1950s, as well as the French tradition of structuralism and even perhaps Derridean poststructural thought. Although Gadamer and Ricoeur both recognize the poetic work or, at least, lyric poetry, as belonging to a special class of literature, they do display somewhat different attitudes toward it. Certain works in the most recent Polish constitutional law literature suggest that there is acceptance of the principle or the concept of autonomous interpretation of a constitution (autonomy of interpretation of constitutional terms). The Constitutional Tribunal also makes reference to this in numerous rulings. Paradoxically, however, that concept is not very popular in legal theory. It might seem that Polish legal theoreticians and philosophers do not appreciate the concept of interpretation of a constitution devised through (...) practice with the support of constitutional law doctrine. It might, however, mean that opinions on autonomous interpretation of Polish Constitution are nothing more than rhetorical arguments formulated ad hoc not a coherent concept or a theory. It is used in the Bible, and its English modern use, according to the Oxford english dictionary, probably comes from a medieval Latin translation of Aristotle. The dictionary does (...) not direct us to any specific translation, but prompts us to compare with Italian and, of course, French usage. In French, however, the word théorie was not used until quite late. In fact, it appeared for the first time in French in a 1584 translation of Antonio de Guevara, the famous Spanish court preacher and man of letters whose oeuvre was translated, imitated, and plagiarized in France, Italy, Germany, and England during the sixteenth century. In Spanish, the word theoria had begun its vernacular life a few years before in the writings of Fernando de Herrera.Theoria is already documented by Antonio de Nebrija’s Vocabulario español-latino of 1495, listed between “speculation” and “species” and designating the contemplative and the art of speculation, from theory to the perception of its quality. It is appropriate that Spanish would give theory to the West, sharing with it a point of view or, better, a series of perspectives or miradores, as María Rosa Menocal would call them, from which to look back into or beyond cultural and literary practices [“Visions of al-Andalus”]. Although Kierkegaard's writings have not exerted an essential influence on canonical trends in literary criticism and theory, his work has supplied subtle and important inspiration for numerous eminent literary critics and theorists. Kierkegaard's influence transcends many polemics in literary theory—a claim justified by the fact that literary critics who draw significant examples and authority from Kierkegaard support varied and sometimes greatly conflicting philosophical and moral positions. This chapter argues that literary‐critical topics invested in (...) Kierkegaard's texts and ideas can be grouped loosely under three thematic banners: irony, repetition, and silence. These themes are often pursued with reference to Kierkegaard's On the Concept of Irony, Repetition, and Fear and Trembling, respectively. What are our constitutional possibilities? The importance of this question is illustrated by the striking breadth of recent discussions, ranging from the interpretation of the United States Constitution as a guarantee of fundamental economic equality and proposals to restore the lost constitution to arguments for the virtual abandonment of structural provisions of the Constitution of 1789. Such proposals are conventionally understood as placing constitutional options on the table as real options for constitutional change. Normative constitutional theory (...) asks the question whether these options are desirable - whether political actors (citizens, legislators, executives, or judges) should take action to bring about their plans for constitutional reform or revolution. Frequently, normative constitutional theories are criticized on the ground that they are undesirable, unwise, on inconsistent with the best theories of political morality and legitimate legal authority, but sometimes one hears a very different form of criticism, expressed in locutions such as the following: That is unrealistic. That's not possible. That is pie in the sky. You are imagining castles in the air. Your suggestion is utopian. That isn't feasible. These objections invoke the idea of ephemeral constitutional possibility - constitutional options that are not real or actual possibilities. What are our constitutional possibilities? How should we think about the feasible choice set for constitutional change? What are the differences between ideal and nonideal theory? What role should the ideas of path dependency and second best play in constitutional theory? These inquiries cross the lines between normative, positive, and conceptual constitutional theory. At the conceptual level, we can ask what phrases like constitutional possibility, ideal theory, and the feasible choice set mean. At the level of positive constitutional theory, we can ask about the forces and institutions that condition constitutional possibility. At the level of normative constitutional theory, we can ask about the implications of constitutional possibility for political morality. Constitutional Possibilities proceeds as follows. Part I introduces the idea of ephemeral constitutional possibilities. Part II will cobble together a conceptual toolkit for thinking about possibility and necessity in constitutional theory: the tools include: (a) the distinction between ideal and nonideal theory, (b) the notion of a constitutional second best, and (c) an introduction to possible-worlds semantics. This paper explores how the notion of distance works in the practice of interpretation by studying the philosophical underpinnings of the originalism debate in American constitutionalism. Focusing on some of its most important spokespeople, the paper shows that they start from the historicist presupposition that distance can in principle be overcome by a reconstruction of the original intentions of the framers of the Constitution. With the help of Hans-Georg Gadamer, who explicitly based his philosophical hermeneutics on the notion of (...) distance, this presupposition will be criticized. The paper concludes that the originalist and hermeneuticist positions do not mutually exclude each other, but can be synthesized if they are seen as different questions about the same text. The meaning of the Constitution is therefore not given but is dependent on the direction of the questions asked by the interpreter. From this question-dependency of meaning it follows that interpretation follows the law of acoustics: "Angle of incidence equates angle of reflection.". (shrink)

How is constitution‐making possible, when people disagree on so many questions about what is good and what is right? The answer lies in the existence of incompletely theorized agreements–agreements on abstract formulations and on particular practices, amidst disagreement about the largest issues in social life. Such agreements help make constitutions and constitutional law possible, even within nations whose citizens cannot concur on the most fundamental matters. Incompletely theorized agreements thus help illuminate an enduring constitutional puzzle: how members of (...) diverse societies can work together on terms of mutual respect amidst intense disagreements about both the right and the good. In this article, I offer a theoretical account of a central yet surprisingly overlooked form of legal influence or control, one that I refer to as the law’s ‘exhortative’ influence. The law exercises an ‘imperative’ influence when it purports to control agents’ behavior by imposing on them legal duties to act or refrain from acting in the legally desired or repelled way. By contrast, it exercises what I call an exhortative form of influence when (...) it aims at impacting agents’ reasons for action whilst refraining from mandating or prohibiting the legally desired or repelled conduct. The law’s exhortative control or influence must be distinguished not only from its imperative influence, but also from what I call the law’s merely ‘instructive’ form of influence, such as the one provided by so-called power-conferring laws. Though I illustrate the functioning of this special form of legal control—the law’s exhortative influence—by using primarily the example of the law of contracts, the article offers novel insights about law in general as a mode of social ordering by developing a theory of the structure of ‘legal incentives’. Legal incentives, I contend, are the means through which the law exercises its exhortative influence. Clearly distinguishing different techniques of legal influence is not only of analytical interest, but should invite us to think of accounts of the justification of legal authority that consider the similarities but also the differences in the moral significance of these diverse techniques. Ferdinand de Saussure's distinction between parole and langue has greatly helped linguists to clarify the relationship between particular speech events and the underlying reservoir of verbal signs and combinatory rules. The relationship emerges from Saussure's Cours de linguistique générale as one between concrete instances of employed language and a slowly but permanently changing virtual system.1 It seems to me that the more recent literary distinctions between the implied author of a work and its actual author and between the implied (...) and the actual reader point to similar relationships along the rhetorical axis of communication.2 For example, the respective authors implied by The Comedy of Errors and by The Tempest are in a sense fixed, concrete manifestations of the actual author whose permanently shifting potential of manifesting himself in literary works or otherwise was only partially realized between 1564 and 1616; his full potential has thus forever remained virtual. The congenial readers implied by the respective plays are in turn two of many "roles" which an actual reader may attempt to slip into for the length of time it takes him to read one work or another. Even a book like Mein Kampf will be adequately understood only by men and women able and willing temporarily to become Adolf Hitler's implied readers. The price may be high, but having shed the mental mask and costume required for the proper "performance" of the text, a discerning person will emerge from the ordeal with a keener sense of the despicable part assigned to the book's actual readers. I hardly need to add that works of imaginative literature tend to imply readers whose intellectual, emotive, and moral response is far less predetermined than is the response of the reader implied by the typical work of assertive discourse. · 1. The Space Act of 1958 begins, “The Congress hereby declares that it is the policy of the United States that activities in space should be devoted to peaceful purposes for the benefit of all mankind.” In March 1982, a Defense Department official commented on the statute: “We interpret the right to use space for peaceful purposes to include military uses of space to promote peace in the world.”1 The absurdity of this willful misinterpretation amazed me on first reading, and months (...) later it readily came to mind when I was looking for an effective way to illustrate the politics of interpretation. With just the right touch of moral indignation, I offered my literary criticism class this example of militaristic ideology blatantly misreading an antimilitaristic text.“But … the Defense Department is right!” objected the first student to speak. Somewhat amused, I spent the next ten minutes trying, with decreasing amusement, to show this student that the Reagan administration’s reading was clearly, obviously, painfully wrong. I pointed to the text. I cited the traditional interpretation. I noted the class consensus, which supported me. All to no avail. It was at this point that I felt that “theoretical urge”: the overwhelming desire for a hermeneutic account to which I could appeal to prove my student wrong. What I wanted was a general theory of interpretation that could supply rules outlawing my student’s misreading.This little hermeneutic fable introduces the three topics of my essay. One topic is the theoretical moment that concludes the narrative; another is the simple plot, a brief rhetorical exchange; and finally there’s the institutional setting in which the exchange takes place. Philosophical hermeneutics developed by the German philosopher Hans-Georg Gadamer and founded on interpretation as explicit form of comprehension generated a debate on contemporary hermeneutics about texts written at different periods of time from those in which they must then be applied. This debate is necessarily very instructive for the jurist when he interprets texts and creates positive law to produce a determined effect on recipients. Comprehension as participation in truth involves questioning and an interpretation devoid of (...) prejudices. Bringing a postcolonial perspective to UK constitutional debates and including a detailed and comparative engagement with the constitutions of Britain’s ex-colonies, this book is an original reflection upon the relationship between the written and the unwritten constitution. Can a nation have an unwritten constitution? While written constitutions both found and define modern nations, Britain is commonly regarded as one of the very few exceptions to this rule. Drawing on a range of theories concerning writing, law and violence, _Constitutions (...) _makes a theoretical intervention into conventional constitutional analyses by problematizing the notion of a ‘written constitution’ on which they are based. Situated within the frame of the former British empire, this book deconstructs the conventional opposition between the ‘margins’ and the ‘centre’, as well as between the ‘written’ and ‘unwritten’, by paying very close, detailed attention to the constitutional texts under consideration. Pryor argues that Britain’s ‘unwritten’ constitution and ‘immemorial’ common law only take on meaning in a relation of difference with the written constitutions of its former colonies. These texts, in turn, draw on this pre-literate origin in order to legitimize themselves. Oxford: Clarendon Press, 1998. xv + 235 pp. Cloth, $65.The focus here is on rescuing Cicero's correspondence from the subliterary status of mere historical and biographical source material, and promoting an appreciation of its inherent artistic value and interest. Now that the text of the letters has finally been restored to a sound (...) footing and their historical contents well elucidated, Hutchinson cogently argues that it is time for scholars to pay more attention to them from a literary perspective. Accordingly, he shows how Cicero's constant rhetorical shaping of his material lifts the letters beyond the level of mere historical documents to that of a sophisticated and persuasive form of literature. In his introductory chapter he explains that critics have long shied away from this kind of literary approach because Cicero did not write these letters for publication. But even so, there is evidence that Cicero saw the potential of letters as a distinct and respectable literary genre. We are reminded, for example, that he knew and valued various published collections of letters, such as those by Plato and Epicurus, and that toward the end of his life he planned to publish a small edited selection of his own correspondence. We also know that he was conscious of different categories of letter writing based on [End Page 159] function and manner (Fam. 2.4.1), thereby showing his awareness of the aesthetic dimensions inherent in the form. In particular, examination of the dozens of his letters of recommendation (Fam. 13) reveals his deliberate manipulation of established epistolary conventions. Also notable is the prevalence of prose rhythms, similar to those found throughout his published works--a strong indication of self-conscious artistry in the composition of his letters. Finally, the goal of persuasion, central in much of the correspondence, naturally called forth the author's exceptional rhetorical powers to craft his words in an artfully persuasive way. Considering all these factors, Hutchinson argues that Cicero's letters must not be naively mined as historical source material without considering the aesthetic considerations which influenced their composition; in fact, he says, "the constant shaping of material for persuasive and aesthetic ends, in presentation, structure, and style, prevents any direct or straightforward access to history" (23). The present literary approach is therefore long overdue.After exploring in chapter 1 these general issues that justify his approach, Hutchinson devotes the remaining chapters of his book to discussing six specific themes, each illustrated by passages taken from a wide selection of different letters (including samples written to Cicero) and comparing them to passages from other types of literature. The six themes are Exile, Consolation, Narrative, Dialogue, Time, and Humor.The chapter on exile presents three letters Cicero wrote in 58 b.c. during the intense personal crisis of his banishment from Rome (Fam. 14.4, Att. 3.7, Q. Though usually interpreted as embarrassing emotional exhibitions of a weak character out of control, these letters in fact show great eloquence and mastery of language, astutely molded to suit the addressee: to his wife he is tender, to Atticus he is argumentative, to his brother he is formal. Beneath the superficial emotional hyperbole, the subtlety and mobility of the author's intelligence remains evident throughout, and emotion blends with argument and rhetorical power just as deftly here as it does in the published speeches. So too in the next chapter, on consolation, where the subject matter remains emotionally gloomy, we can observe Cicero's renowned rhetorical skills at work. Language is an essential tool that shapes human interactions and understanding from birth, blending innate abilities with environmental factors. Oral language is the first form of communication, while written language develops through structured learning. Piaget's theory suggests a strong connection between language development and cognitive growth, with cultural context playing a significant role. Sociolinguistic theory also emphasizes how social and cultural factors influence linguistic interactions, shaping expression in different settings. This study examined the relationship between reading comprehension and cultural (...) identity. A reading test, featuring texts reflecting diverse linguistic and cultural realities, was administered to 120 students in Barranquilla. The test included informal, informational, and literary readings, each tied to specific contexts. The results demonstrated that students more easily understood culturally familiar texts, while unfamiliar contexts posed greater challenges. This suggests that cultural familiarity significantly enhances reading comprehension, while cultural distance can hinder interpretation. The findings highlight the critical role of cultural and linguistic context in reading comprehension. Texts aligned with a reader's cultural experiences improve understanding and retention, pointing to the need for educational approaches that integrate students' cultural backgrounds to enhance learning and motivation. W. B. Yeats’ poem “Politics” has as its epigraph Thomas Mann’s remark, “In our time the destiny of man presents its meaning in political terms.”1 Yeats chose the epigraph in 1938, just before World War II, for a poem proclaiming that sexuality holds his interest more than politics. This still may be true for poets, but by the looks of things, not for many contemporary critics, who, if they do not choose one over the other, subsume one under the (...) other. For them everything is political , which is to hold that everything is reduced to questions of power. So it is, in their eyes, with canons.The first canonization of note for western culture seems to have been that of the Hebrew Scriptures; and although there is much dispute about the whole matter of how that occurred, it is interesting to observe that in a 1971 book entitled The Shaping of Jewish History: A Radical New Interpretation Ellis Rivkin presents the development of that canon in political terms, arguing that production of the Hebrew Scriptures “was not primarily the work of scribes, scholars, or editors who sought out neglected traditions about wilderness experience, but of a class struggling to gain power.”2 In a very interesting article on this subject, Gerald L. Bruns observes that the lesson of this is that the concept of canon is not literary but a “category of power” . Rivkin himself decides, as Bruns remarks, to treat “the promulgation of canonical texts of the Scriptures, not according to literary criteria but according to power criteria” . Presumably it is this program that warrants Rivkin’s subtitle Radical New Interpretation. But what would the literary criteria that are opposed to power criteria here be? Are there any longer believers in the more than trivial existence of such criteria? Does the destiny of literature now present its meaning political terms? If there are no longer thought to be such things as literary criteria, is there, can there be, literature? We have heard answers in the negative to the last question; and the notion of canon has recently been addressed almost always in terms of politics and power, most notably, of course, but certainly not exclusively, by feminist and minority critics. In the Thirties, European personalism was an inspirational philosophical movement, with its birthplace in France, but with proponents and sympathizers in many other countries as well. Following the Second World War, Christian-Democratic politicians translated personalistic ideas into a political doctrine. Sometimes they still refer to personalism, but most often this reference is little more than a nostalgic salute. In the mainstream of Anglo-Saxon political philosophy, there are practically no references to personalistic philosophers. Is personalism exhausted as a philosophy or political (...) ideology? Yes and no. Paul Ricoeur, writing in Esprit , summed up the situation like this: “personalism is dead”, but he was careful to mention a “return of the person”. Indeed, no tradition or movement can simply perpetuate itself. It must, in order to continue making history, always abolish itself as a `system' so as to make room for the unsaid and the unthought in its tradition, an idea that Mounier also fervently believed in.To better situate the current discussion of personalism, however, it is necessary to look back to the original characteristics of personalism in the Thirties. As a response to the crisis provoked by the economic depression, failing democracy and existential uncertainty, there arose in France a number of `non-conformist movements' who labelled themselves personalistic. They did not constitute a unified movement with a commonly shared theory. It was rather a collection of `personalisms'. The article by the historian Christian Roy about the ecological personalism of Bernard Charbonneau and Jacques Ellul sheds interesting light on the multiple origins of French personalism, which is all too easily identified with the work of Maritain and Mounier alone. The work of Jacques Maritain, and the network of writers and artists surrounding him, undoubtedly remains a significant historical reference point when speaking of personalism.Another group was formed around Alexandre Marc who, along with Raymond Aron, Arnaud Dandieu, Daniel-Rops and Denis de Rougemont, kept the journal Ordre Nouveau alive for five years . They elaborated the idea of federalism as a way out of liberalism and totalitarianism. The most important and durable group, however, was formed by the movement and journal Esprit, founded in 1932 by Emmanuel Mounier and George Izard. In order to stress the historical importance of Esprit, we are including here a testimony from 1982, written by Paulette Mounier, the founder's wife, in which she looks back on 50 years of Esprit. After the war, some new and related groups formed, such as Economy and Humanism around Louis-Joseph Lebret. An historical survey of the dissemination of personalistic centres and movements, not only in France but over all of Europe, would be material for a stimulating historical research project. In this issue, there will also be mention of, among others, the Prague personalism of Jan Patocka and Vaclav Havel, the Leuven personalism of Louis Janssens, and the Polish personalism of Tadeusz Mazowiecki and others. But this list is far from exhaustive.What unites these various branches of the personalistic tree? It is a certain conception — or better perhaps: a certain attitude to the human person. Personalists were not seeking in the first instance a new academic theory about the person, but rather a practical philosophy of engagement. In the Thirties, quite a few personalists finished their university studies and chose not for an academic career but for non-conformist, demanding and vulnerable commitments with limited financial means. What motivated them? Primarily a strong sense that the time in which they were living was a turning point, one which was being ignored by the academic world. They interpreted the diverse economic, political and cultural crisis phenomena as symptoms of a more global crisis of civilization which demanded a response through radical change.Hence a certain rhetoric of a `new order', `spiritual revolution', `radical reform' and `rebirth'. But the rhetoric was supported by innovative ideas regarding political federalism, the third way economy and human alienation. The motivation for all this derived from a strong commitment to defend the concrete human person against the arrogance of systems, bureaucracies and ideologies, while at the same time avoiding the pitfalls of individualism — the reason why some personalists always qualified personalism as `communitarian'.In fact, much of what presents itself as communitarian philosophy today is a retrieval of personalistic themes from the Thirties applied to the current situation, a situation which is also interpreted by communitarians as a global cultural crisis. One should not forget, however, that alongside and sometimes opposed to the communitarian theme with its call to bring people back to their communitarian roots, personalists underscored the priority of metaphysics over politics, a theme that can likewise be found in the writings of personalistic dissidents in Eastern Europe. In the words of Mounier in Qu'est-ce que le personnalisme : “personalism combines faith in a certain human absolute with a progressive historical experience”.To what extent is personalistic thinking still relevant today? Its current relevance will be examined in three ways. In the first section, a number of articles are presented which illustrate the active presence of personalistic thought in the domains of politics and applied ethics. Vaclav Havel sent one of his recent addresses in which he links the theme of human rights with that of a world spirituality. His article is preceded by an introduction by Guido Van Heeswijck, situating Prague personalism.The need for an orientational philosophy of the person is not only manifest today in the political arena. Developments in economics, ecology, health care, the media, technology and in the world of the professions have had an extraordinarily large impact on the human person's lifeworld. The whole area of applied ethics requires a dynamic and orientational concept of the person. The contributions by Paul Schotsmans and Luk Bouckaert are seeking a personalistic point of departure for applied ethics. The more historical article by Christian Roy on ecological personalism has been included in the first section because it can be inspiring for an environmental ethics.The second section is more philosophical. To what extent does the `personalistic' conception of the person put forward in the Thirties still have any relevance today, following the waves of structuralism, post-structuralism and postmodernism? Paul Ricoeur's article, Approaching the Human Person — originally published in Esprit in 1990 and now translated for the first time — can be seen as a reference text. Ricoeur shows in what sense the concept of the person must be broadened in order to continue functioning. The person as `narrative identity' can only write history through the medium of language and institutions. Starting from very different assumptions, the articles by Louis Janssens & Joseph Selling and the analysis of Roland Breeur also explore the idea that a person is what he is only when his identity is opened up, touched by an exteriority or conceived as a focal point . It is this radical openness and vulnerability that gives the person its historical and transcendent dynamic, and prevents us from encapsulating it in existing systems, theories and power relations. The connection with Emmanuel Levinas and his hermeneutic of the idea of the infinite is an obvious one to draw.The third section contains a historical survey in which a number of active `personalistic' centres and journals are presented.Various European centres that appeal explicitly to some form of personalistic thinking were posed the following questions: What is the main historical reference to personalism at your centre? and How do you implement, today, a personalist credo in your work? John Dick organized the responses to these questions under a number of headings. This survey aims to provide not so much an exhaustive but a representative picture of the ways in which European personalism lives on as a mosaic of centres engaged in everyday history. (shrink)

This study correlates argumentation, translation, and literature to construct a new model for assessing the quality of translated literature. Literary translation is described as being compatible with the rhetorical stream of argumentation studies, while the study rests on the overriding notion of ethics of difference in argumentative cross-cultural and translational encounters. The model incorporates ethics of difference and interpretive act, pragma-dialectical contributions of scheme/structure and rhetorical/dialectical situations, and aesthetic features including figures of speech and genres of literature. Application of (...) the model to an English translation of a classical poem shows that the model can be systematically applied to quality assessment of translated literature. Considering the implications and suggestions for further research, the study can progressively develop into a literary or cross-linguistic subgenre of argumentation theory, with implications for comparative literature, philosophy of meaning, translation theory, and dialectical hermeneutics. For them, “science” means information theory, chaos or catastrophe theory, fractals, pataphysics, “autopoeisis” or self-organization, emergence, cyborgs, hypertext, virtual signs (...) and other aspects of sci-fi, or techno-politics. (I encountered these subjects at a comparative literature conference I attended in March 1995.) These “scientific” positions are used as trendy metaphors for talking about chance, uncertainty, accident, ideology, and multidimensionality in literary works or in the aims of their authors. In other words, the buzzwords of contemporary science become one more angle from which to view or project another facet onto the glassy, self-reflective edifice of contemporary literary theory, rather than a means from which to shatter it and build again from scratch with more earthy, substantial materials. Joseph Carroll’s book provides the view and the means for this genuinely new and constructive (if initially destructive) possibility.It is ironic that in the present critical climate the very virtues of the book might be seen by some as faults—e.g., the lucid, elegant writing and the erudition and interdisciplinarity of the work as a whole. Carroll [End Page 229] writes clearly, authoritatively, without jargon, and with frequent, delicious wit. His values, aims, explanations, evidence, and criticisms are concisely and plainly stated. This is in marked contrast to the enigmatic and idiosyncratic nature of much recent criticism, and might have the initially disorienting effect of returning to earth and breathing pure oxygen after one has become accustomed to the thin and rarefied atmosphere of remote, icy peaks.Carroll offers wide-ranging and illuminating discussions of standard literary and critical works from both the European and Anglo-American tradition over the past several centuries, and refers to dozens of writers from diverse periods and nationalities. Additionally he enlists, and criticizes where appropriate, ideas from such diverse nonliterary figures as Darwin himself and writers about Darwin, T. H. Huxley, Konrad Lorenz, John Bowlby, Sir John Eccles, the prominent sociobiologists and evolutionary psychologists, S. J. Gould, Richard Lewontin, Derek Bickerton, Piaget, Karl Popper, Thomas Kuhn, Clifford Geertz, H. J. Eysenck, Cardinal Newman, Thorstein Veblen, Trotsky, Raymond Williams, and Richard Rorty, among others.One can be forgiven for wishing to forego an exploration of this demanding array of knowledge argued from the unfamiliar perspective of evolutionary biology. For in order seriously to consider Carroll’s new way of looking at human endeavor (including literature) one must also look critically at what was laboriously mastered during all those years of graduate school and tenure-driven writing for publication. No one wants to be persuaded to give up a view of the world that has been mastered with painstaking diligence. Still less does anyone want to spend time with something that according to conventional academic wisdom is downright wrong-headed. This is really the challenge of Carroll’s book—because such minor matters as the plain unfashionable title, clear writing, impressive erudition, and dated or forgotten thinkers can be overcome if the stakes are high enough.I wish to suggest that the stakes are high enough and that the time is right for this inevitable change of viewpoint. Along with others in diverse fields such as cognitive and developmental psychology, personality theory, neurology, medicine, sociology, political science, epistemology, cultural anthropology, ethics, and linguistics, I find the Darwinian perspective to offer the most comprehensive and viable possibility for an understanding of human behavior and culture, including the arts. Joseph Carroll admirably articulates this position and applies it to literary theory. I invite scholars who think that evolutionary explanations [End Page 230] are erroneous, dangerous, reductionist, simplistic, or irrelevant to read Carroll and deal seriously with his arguments. His book should be the central text for theory classes and seminars, as well as the subject of conferences. If in its simplest form, hermeneutics is a quest for understanding, then part of that quest will always include striving to understand being and the meaning of being. This open access book takes that ambition seriously, arguing that hermeneutics and metaphysics, so central to philosophical thought but so rarely put in tandem, are two complementary fundamentals of human existence. Metaphysical Hermeneutics puts forward the argument for a hermeneutical metaphysics in service of philosophy's basic aim: to make (...) sense of our experience. Jean Grondin builds his argument for this combined discipline around the idea of 'sense' – a theme that is both hermeneutical and metaphysical. What we seek to glimpse is not just a figment of the mind but always the meaning of something. Grondin calls on one of the founding figures of contemporary hermeneutics Hans-Georg Gadamer to test his theories, singling out the metaphysical dimension of Gadamer's ideas and questioning his seeming embrace and rejection of that dimension. Explicitly invoking early pragmatism—which argued that philosophy should join the natural sciences and regard itself as “the workshop of being, where we catch fact in the making” (...) 1 —Rorty argues that philosophers should now abandon the natural sciences, and become “edifiers” and “ironist theorists” on the model of literary criticism. 2Rorty’s pragmatism amounts to the claim that philosophy ought to wind up and put away its long preoccupation with metaphysics, ontology, and epistemology and abandon the pretense of deductive rigor to become “dialectical.” This newly reformed philosophy would, as Rorty puts it, “play off vocabularies against one another, rather than merely... infer propositions from one another” (CIS, p. 78). Rorty’s belief in philosophy as a form of conversation may owe less to American pragmatism, however, than to Continental hermeneutics (particularly Hans Georg Gadamer’s Truth and Method). Nevertheless, I intend to take him at his word, and apply the fundamental tenet of pragmatism to his own theorizing. I take the following remark by William James as definitional of American pragmatism: “What practical difference would it make to any one if this notion rather than that notion were true? If no practical difference whatever can be traced, then the alternatives mean practically the same thing, and all dispute is idle. Whenever a dispute is serious, we ought to be able to show that some practical difference that must follow from one side or the other’s being right” (PR, p. 26).In the light of this pragmatic principal, most philosophical and [End Page 261] literary theories make little if any practical difference to the practice of literary criticism, although philosophy and theory can displace, occlude, or banish it. The whole issue turns on what is meant by the term, literary criticism. Rorty assumes that criticism is an interpretive activity, and that nothing further need be said. Yet interpretation is not the sole activity of literary criticism, nor is the practice of literary interpretation sufficiently well formulated to serve as a model upon which philosophy could reform itself.Although Rorty’s proposed reformation of philosophy on the model of literary criticism is seen by many literary critics as a friendly takeover, it can just as easily be seen as hostile, as an updating and domestication of Hans Georg Gadamer’s philosophical hermeneutics, which would make interpretation foundational for all of the knowledge industries. With respect to his paternalistic attitude toward literary criticism, Rorty is very much within a philosophical tradition of foundationalism that begins, as far as literary criticism is concerned, with Plato’s Ion. Whereas Plato argued that literary criticism is a misguided or unworthy form of discourse, Rorty turns it into an approved variety of philosophical discourse. By the time they reach early adulthood, English speakers are familiar with the meaning of thousands of words. In the last decades, computational simulations known as distributional semantic models have demonstrated that it is possible to induce word meaning representations solely from word co-occurrence statistics extracted from a large amount of text. However, while these models learn in batch mode from large corpora, human word learning proceeds incrementally after minimal exposure to new words. In this study, we run (...) a set of experiments investigating whether minimal distributional evidence from very short passages suffices to trigger successful word learning in subjects, testing their linguistic and visual intuitions about the concepts associated with new words. After confirming that subjects are indeed very efficient distributional learners even from small amounts of evidence, we test a DSM on the same multimodal task, finding that it behaves in a remarkable human-like way. We conclude that DSMs provide a convincing computational account of word learning even at the early stages in which a word is first encountered, and the way they build meaning representations can offer new insights into human language acquisition. This paper addresses the subject of textual creativity by drawing on work done in classical literary theory and criticism, specifically new criticism, structuralism and early poststructuralism. The question of how readers and writers engage creatively with the text is closely related to educational concerns, though they are often thought of as separate disciplines. Modern literary theory in many ways collapses this distinction in its concern for how literariness is achieved and, specifically, how ‘literary quality’ is accomplished in (...) the textual and the social dimension. Taking literary and aesthetic creativity as a point of departure in the reading of five central authors in classical literary criticism, the paper identifies the processes of narrative imagination and emotional identification as central to the role that the textual dimension plays in the creative process of the author/reader—particularly in the way it provides a space for experimentation and self-reflexion through ‘storying’. As a driver of tourist-oriented citizenship behavior, the effect of social support has not been thoroughly investigated. Grounded in a framework integrating the stimulus-organism-response model and self-determination theory, this study investigates how social support influences TOCB through the sense of self-determination. Structural equation modeling is used to analyze the survey data collected from 377 tourists in China. It is found that social support have a remarkably positive impact on the sense of self-determination which have an intermediary role in the (...) relationship between social support and TOCB. This study provides empirical evidence for the marketing strategies of tourism destinations and enterprises. (shrink)

128 female Ss were asked to make 4 judgments about a young woman after reading her "job application portfolio." Five characteristics of the young woman were manipulated orthogonally. Ss were asked to report how each of the 5 manipulated factors had influenced each of their judgments. "Observer Ss," who had access only to very impoverished descriptions of each of the 5 factors, were asked to predict how each of the factors would influence each of the judgments. Results show that (...) S reports about the effects of the factors on the judgments were in general highly inaccurate; observer predictions were extremely similar to S reports; for the single judgment for which Ss showed substantial accuracy, observer predictions were as accurate as S reports. Results indicate that whatever introspective access to cognitive processes may exist, it is not sufficient to produce generally accurate reports about such processes, nor even to produce reports that differ much from those of poorly informed outside observers. The paper traces, historically and systematically, the influence of Carnap’s philosophical program on the writings of Nelson Goodman, focusing on the relationship between Carnap’s Aufbau and Goodman’s Structure of Appearance. In particular, drawing on unpublished material from the Carnap Research Archives, I show that Carnap had already anticipated Goodman’s criticism of the method of quasi-analysis and that Goodman misconstrued the status of this procedure on several counts. I also argue that Carnap’s anti-metaphysical stance left his approach with an explanatory (...) deficit which Goodman’s pragmatist pluralism is able to address. (shrink)

The paper proposes a radical change of focus for understanding the fundamental purpose and value of literary interpretation. It criticises an orthodox view in analytical philosophy of literature, according to which theories of meaning in the philosophy of language, in particular Gricean or speech act or other pragmatic theories, offer the most illuminating way to grasp the relevant principles of interpretation. The argument here is that the application of such theories in this context is not just wrong in (...) detail (this or that theory needs revising) but wrong in principle. The focus is wrong. The importation of philosophy of language distorts the essential character of interpretation, which should be seen as involving not so much meaning as value, not individual sentences but whole works, not obsessed with authorial intention but focused on the protocols of reading. This paper draws out what Derrida’s work—in particular as concerns law, democracy, and intergenerational justice in the context of the European heritage—can contribute to constitutionalism and the legal relation to future people, at the national level and the supranational one of the European Union. The first section outlines some of Derrida’s contributions to legal scholarship and European identity, and then, in the following two sections, argue for two main points. First, Derrida can help us understand the much-discussed double (...) bind of the constitutional relation to future people as merely an instance of a more general aporia. The double bind consists in the fact that the constitutional promise to safeguard future freedom also limits and binds future people. I will show how this aporia results from the temporal structure of the constitutional founding of law. Accordingly, the double bind cannot be resolved, either conceptually or in constitutional practice, but only be negotiated with greater awareness. Second, the same aporia of time entails that future generations are already implicated in the founding and re-founding of law here and now. Because the present moment is constitutively related to the past and the future, the meaning of a constitutional founding can become legible only from the future. Hence, the present generation, whose unity is never given, cannot but draw an advance credit on the future whose cooperation it anticipates. As a result, the political promise of Europe depends on its relation to its geographical, but also to its temporal others. (shrink)

Les textes spirituels nous feraient voir ainsi comment il est possible de mener une existence chrétienne. Dire cela ne doit (...) pas masquer la situation dans laquelle nous lisons ces textes aujourd’hui : ils se trouvent au carrefour d’intérêts et de démarches tantôt complémentaires, tantôt conflictuelles, situés sur une ligne qui semble départager la foi de l’absence de foi en Jésus Christ. Aussi, parler à l’intérieur du christianisme de la relation des textes spirituels à l’existence chrétienne suppose de s’inscrire en ce lieu de divergences herméneutiques. Ainsi nous a-t-il paru fécond, dans le contexte de ces lectures plurielles, de nous interroger sur la relation qui s’instaure entre les lecteurs et ces textes. Nous montrerons dans un premier temps quels problèmes surgissent de la constitution du corpus des textes spirituels pour préciser les types d’interprétations qui ont cours. Nous pourrons nous demander dans un second temps ce qui se donne à lire dans ces textes afin de dégager, dans une troisième partie, la manière dont ils peuvent être lus aujourd’hui au sein de la foi chrétienne. In Christianity today, spiritual texts are read and appreciated for the vivid intensity of Christian life that they reveal and the impetus to living faith that they communicate. The adjective “spiritual” describes texts that deal with the life of faith in prayer or action. It refers explicitly to the Spirit which led Jesus of Nazareth according to the Scriptures. Spiritual texts thus help us to see how it is possible to lead a Christian existence. However, saying this must not mask the context in which we read these texts today: they stand at a crossroads of interests and approaches that may be complementary or conflictual, on what appears to be the dividing line between the absence of faith and faith in Jesus Christ. Endeavouring to speak from inside Christianity of the relation between spiritual texts and Christian existence supposes that we situate ourselves inside this realm of hermeneutical divergences. It thus appeared fruitful, in the context of this plurality of readings, to explore the relationship that gradually takes shape between readers and these texts. We shall first outline the problems that arise from the way the corpus of spiritual texts is brought together in order to show the types of interpretation commonly to be found. Then, we can look into the content of these texts in order, in the third part, to bring out the ways in which they can be read today within the framework of Christian faith. (shrink)
