Common-law judgments tend to be more than merely judgments, for judges often make pronouncements that they need not have made had they kept strictly to the task in hand. Why do they do this? The Intricacies of Dicta and Dissent examines two such types of pronouncement, obiter dicta and dissenting opinions, primarily as aspects of English case law. Neil Duxbury shows that both of these phenomena have complex histories, have been put to a variety of uses, and are not amenable (...) to being straightforwardly categorized as secondary sources of law. The purpose of this work is to carry out a systematic, detailed analytical study, together with the direct interpretations, as they follow from the analytical expressions obtained, of three basic “experiments” which have been classical examples in our understanding of quantum mechanics. The experiments considered are: the single- and double-slit (-hole) experiments, and the final one, which, in particular, deals with the situation where a particle is “reflected off” the detection screen in the single-slit experiment. Special emphasis is put on (...) pointing out some purely quantum mechanical results, which follow from the analytical expressions, as well as on making a comparison with classical physics. Many people believe hope’s most important function is to bolster us in despairinducing circumstances. A related but less dramatic view is that instilling or reinforcing hope for a state of affairs is a good way to get people to act to promote that state of affairs. I propose that we conceive of hope as, most paradigmatically, the expression of desire in imagination. I then trace through the implications of this conception for, first, how hope influences motivation and, second, what forms (...) of hope are rational. (shrink)

This article demonstrates the fallacy of legal deduction as a method which is supposed to guarantee the certainty and predictability of the law. The Author asserts that legal deduction is in fact not of a logical nature. Their premises are of an uneven character or else one of them must be created in a non-mechanical way. This in turn makes legal deduction that is comprehended as a mode of inference that is infallible, provided its premises are true / valid nothing (...) more than misunderstanding and fallacy. In addition, in this paper, the outcomes of legal deduction are shown to be highly dependent on the direct and indirect context under the threat of their being utterly absurd. Since the lack of fixity and clarity, these contexts, however, may lead one to madness, i. e. at least unless she or he abandons the idea that only logical types of inferences govern legal deduction and are solely responsible for its outcomes. Mitochondria have been fundamental to the eco‐physiological success of eukaryotes since the last eukaryotic common ancestor (LECA). They contribute essential functions to eukaryotic cells, above and beyond classical respiration. Mitochondria interact with, and complement, metabolic pathways occurring in other organelles, notably diversifying the chloroplast metabolism of photosynthetic organisms. Here, we integrate existing literature to investigate how mitochondrial metabolism varies across the landscape of eukaryotic evolution. We illustrate the mitochondrial remodelling and proteomic changes undergone in conjunction with major evolutionary transitions. We (...) explore how the mitochondrial complexity of the LECA has been remodelled in specific groups to support subsequent evolutionary transitions, such as the acquisition of chloroplasts in photosynthetic species and the emergence of multicellularity. We highlight the versatile and crucial roles played by mitochondria during eukaryotic evolution, extending from its huge contribution to the development of the LECA itself to the dynamic evolution of individual eukaryote groups, reflecting both their current ecologies and evolutionary histories. 1. Comparing the weight of different evils is highly problematic; neither a positivist, interpretive account nor an exclusively aspirational account is satisfactory. 2. Alexander is correct that choosing a lesser evil is sometimes a mandate, not a mere permission, but the point has wider application than he indicates. 3. Is a choice of lesser but not least evil justifiable? Alexander’s affirmative answer is only partially convincing. 4. Alexander endorses a striking claim: the very notion of a reckless belief or reckless (...) mistake (as to the factual grounds for a justification) is incoherent. This claim is insupportable, but the flaws in his argument demonstrate the complexity of the concept of reckless belief, especially in the context of justification defenses, where the probabilistic aspect of the distinction between permissible and impermissible risk-taking is especially salient. 5. Alexander aptly notes that the legislatively preclusion doctrine (which denies application of the lesser evils defense) creates a fundamental tension between legal actors’ power to articulate the content of the defense and the democratic pedigree of the criminal law. I conclude that genuinely democratic principles can be served by permitting juries considerable latitude to recognize a defense when the legislature has not yet had occasion to formulate an exception, or even, in some cases, by authorizing de facto civil disobedience. This article interrogates the extent to which institutional discourses on the governance of religious minorities are useful to think about the complexity of how religion gets negotiated in the quotidian. It takes as its starting point the exploration of the discourse on religious governance in the province of Quebec organized around the notion of request for accommodations. Through an analysis of public policy documents, it examines facets of this discourse of request, including the role it plays in delimiting what we (...) imagine the religious to be and how we imagine it to work. Second, drawing on interviews with self-identified Muslims in Montreal, the article explores how piety gets negotiated in their everyday. These narratives are approached as fertile sites to think differently about the recognition of difference. This two-pronged perspective acts as an invitation to think more broadly about not only what institutional discourses “produce” but also what they “obscure.”. (shrink)

Contemporary scholars are engaged in a debate over whether Charles Augustin Coulomb’s results that he presented in his 1785 and 1787 memoirs to the Paris Academy of Sciences were attained experimentally or theoretically. In this paper, we study Coulomb’s famous 1785 electric torsion balance experiment through analysis of relevant texts and, more importantly, through a replication that is more faithful to Coulomb’s original design than previous attempts. We show that, despite recent claims, it has so far proved impossible to obtain (...) the same results reported by Coulomb in his paper of 1785, Coulomb’s published results are most likely atypical, and electric torsion balance experiments degenerate quickly when parameters are altered by small amounts. Gadow's understanding of nursing as a relational narrative anchored in a dialectic between the fundamental subjectivity of the individual client and the objectification of his illness poses some interesting questions for nursing ethics and care. For Gadow, nursing is an encounter with the immediate vulnerability of the client and also lends it responsibilities to the medical objectification of illness aiming at disease treatment and control. Hence, nursing agency is divided between its responsibilities induced by the personal vulnerability of the patient (...) and the more impersonal, but benevolent intention shaped by medical knowledge. Medical knowledge is impersonal in the sense that it is knowledge detached from the subjectivity of the patient. But how is nursing able to reconcile the interests derived from personal and experienced vulnerability with the more impersonal and often conflicting demands of medical knowledge? This question is even more intriguing because there seems to be an objective dimension within a patient's subjectivity itself: an autonomous person can critically evaluate his own subjectivity as a basis for informed self‐interest. The sick person is thus confronted with objectivity on two important levels: the objective facts of his disease and his detachment from his own experiential vulnerability when engaged in the critical evaluation of his self‐interest. This paper will discuss the normative dimensions of these complex and, frequently, conflicting perspectives from the theoretical perspectives of Thomas Nagel's normative responsibility and Sally Gadow's clinical epistemology and relational narratives. The empirical basis for the discussion will be an ongoing study of the ethical dimensions of pain relief and sedation in an intensive care unit. (shrink)

Plato's paradox of relative change in size and number (154e7-155c7) cannot be understood unless the text is emended (see Part i of this article) and unless full weight is given to shifts of mood and tense and to the play of particles. The critical reader will also need to adapt to a non-Fregean concept of equality and to a definition of change different from Geach's definition of "Cambridge change''. Only so will the structure of the paradox explain young Theaetetus' bewilderment, (...) while also showing that the author of the dialogue was not himself a victim of the paradox he has created. I propose a construal of aesthetic value that gives us reason to emphasize some aesthetic practices over others. This construal rests on the existence of a central aesthetic value, namely apprehension-testing intricacy within an appropriate domain. I address three objections: the objection that asks how an aesthetic value based on intricacy can account for the value of minimalism; the objection that asks about the difference between intricacy within a medium and intricacy between media; and the objection (...) that asks about the danger of a regress. I then say that, although this central aesthetic value can in principle allow us to adjudicate between aesthetic practices, we have epistemic limits (about the potential of certain artistic domains to allow for apprehension-testing intricacy) that prevent adjudication in some cases. Even if there is a difference between the vastness of the potential-intricacy-fields somewhere down the line, it is too far for us to see. (shrink)

Research investigating the intricacies of how self-regulated writing strategies are used in a finely focused area of the second language writing process is still lacking. This study takes a mixed-methods approach to explore Chinese English as a Foreign Language learners’ use of self-regulated writing strategies when revising based on automated, peer, and teacher feedback in an online EFL writing context. Thirty-six Chinese university learners filled in three questionnaires. In addition, four learners followed a think-aloud protocol while revising and responding to (...) a stimulated recall interview to provide further data. The results revealed that learners employed an array of self-regulated writing strategies to attain their feedback revision goals. Learners used more cognitive strategies when revising based on automated feedback compared with peer and teacher feedback and more motivational strategies when revising based on teacher feedback. The think-aloud data and stimulated recall interviews coincided with the quantitative findings. Textual analysis revealed that feedback type and quantity were associated with self-regulated writing strategy use. (shrink)

What do mathematicians mean when they use terms such as ‘deep’, ‘elegant’, and ‘beautiful’? By applying empirical methods developed by social psychologists, we demonstrate that mathematicians' appraisals of proofs vary on four dimensions: aesthetics, intricacy, utility, and precision. We pay particular attention to mathematical beauty and show that, contrary to the classical view, beauty and simplicity are almost entirely unrelated in mathematics.

Extended Reality (XR) systems, such as Virtual Reality (VR) and Augmented Reality (AR), provide a digital simulation either of a complete environment, or of particular objects within the real world. Today, XR is used in a wide variety of settings, including gaming, design, engineering, and the military. In addition, XR has been introduced into psychology, cognitive sciences and biomedicine for both basic research as well as diagnosing or treating neurological and psychiatric disorders. In the context of XR, the simulated ‘reality’ (...) can be controlled and people may safely learn to cope with their feelings and behavior. XR also enables to simulate environments that cannot easily be accessed or created otherwise. Therefore, Extended Reality systems are thought to be a promising tool in the resocialization of criminal offenders, more specifically for purposes of risk assessment and treatment of forensic patients. Employing XR in forensic settings raises ethical and legal intricacies which are not raised in case of most other healthcare applications. Whereas a variety of normative issues of XR have been discussed in the context of medicine and consumer usage, the debate on XR in forensic settings is, as yet, straggling. By discussing two general arguments in favor of employing XR in criminal justice, and two arguments calling for caution in this regard, the present paper aims to broaden the current ethical and legal debate on XR applications to their use in the resocialization of criminal offenders, mainly focusing on forensic patients. Moral philosophers, legal theorists, and psychologists who study moral judgment are remarkably agreed in prescribing how to blame people. A blameworthy act occurs when an actor intentionally, negligently or recklessly causes foreseen, or foreseeable, harmful consequences without any compelling mitigating or extenuating circumstances. This simple formulation conveniently forestalls intricacies about how to construe concepts such as will, causation, foresight, and mitigation, but putting that aside for the moment, it seems fair to say that blame “professionals” share compatible conceptions of how (...) to make fair and rational blame ascriptions. Blame “amateurs,” on the other hand, sometimes stretch these rational prescriptions for blame beyond the breaking point. Numerous psychological studies on blame and responsibility, as well as the perplexing outcomes of high-profile criminal and civil trials, demonstrate that everyday blamers are capable of violating virtually every rational prescription that moral philosophers, legal scholars, and rational decision theorists hold dear. Spinoza's writing style has been judged, by various commentators, alternatively as excessively dry or lavishly rich, depending on the precise text that these scholars had in mind when making such judgments. This chapter offers an overview of a selected list of Scholastic debates intersecting the CM. It highlights how Spinoza consciously intervenes in them, showing a certain awareness of the intricacies of Scholastic discourse. Spinoza opens the CM with a discussion of the term “being,” claiming that “being is badly divided (...) into real being and being of reason”. The chapter focuses on how Spinoza can be interpreted as responding to the canonical thought of Francisco Suárez, since the Leiden Scholastics interacted especially with the Escuela de Salamanca. One of Spinoza's main piéces de résistance is the doctrine of the inseparability between the will and intellect of God. Spinoza has a much stronger thesis regarding the “external” identity of God's intellect, power, and will. (shrink)

Advancing the reductionist conviction that biology must be in agreement with the assumptions of reductive physicalism (the upward hierarchy of causal powers, the upward fixing of facts concerning biological levels) A. Rosenberg argues that downward causation is ontologically incoherent and that it comes into play only when we are ignorant of the details of biological phenomena. Moreover, in his view, a careful look at relevant details of biological explanations will reveal the basic molecular level that characterizes biological systems, defined by (...) wholly physical properties, e.g., geometrical structures of molecular aggregates (cells). In response, we argue that contrary to his expectations one cannot infer reductionist assumptions even from detailed biological explanations that invoke the molecular level, as interlevel causal reciprocity is essential to these explanations. Recent very detailed explanations that concern the structure and function of chromatin—the intricacies of supposedly basic molecular level—demonstrate this. They show that what seem to be basic physical parameters extend into a more general biological context, thus rendering elusive the concepts of the basic level and causal hierarchy postulated by the reductionists. In fact, relevant phenomena are defined across levels by entangled, extended parameters. Nor can the biological context be explained away by basic physical parameters defining molecular level shaped by evolution as a physical process. Reductionists claim otherwise only because they overlook the evolutionary significance of initial conditions best defined in terms of extended biological parameters. Perhaps the reductionist assumptions (as well as assumptions that postulate any particular levels as causally fundamental) cannot be inferred from biological explanations because biology aims at manipulating organisms rather than producing explanations that meet the coherence requirements of general ontological models. Or possibly the assumptions of an ontology not based on the concept of causal powers stratified across levels can be inferred from biological explanations. The incoherence of downward causation is inevitable, given reductionist assumptions, but an ontological alternative might avoid this. We outline desiderata for the treatment of levels and properties that realize interlevel causation in such an ontology. (shrink)

People seem to perceive and locate pains in bodily locations, but also seem to conceive of pains as mental states that can be introspected. However, pains cannot be both bodily and mental, at least according to most conceptions of these two categories: mental states are not the kind of entities that inhabit body parts. How are we to resolve this paradox of pain? In this paper, I put forward what I call the ‘Developmental Challenge’, tackling the second pillar of this (...) paradox, i.e. the introspectionist view of pain according to which genuine pain reports are introspective reports. This view forms an inconsistent triad with two other widely held positions: young children make genuine pain reports, and young children do not make introspective reports. After introducing the paradox and the introspectionist view of pain in part 1, I present the developmental challenge, and defend both and. I conclude that the inconsistent triad can only be resolved by reconsidering the introspectionist view of pain. In discussing three potential factors that lead to the puzzling intricacies of our concept of pain, I argue that the concept of pain might not be paradoxical after all. (shrink)

Redefining music as "the art of possibly animate things," Musical Vitalities charts a new path for music studies that blends musicological methods with perspectives drawn from the life sciences. In opposition to humanist (...) approaches that insist on a separation between culture and nature--approaches that appear increasingly untenable in an era defined by human-generated climate change--Musical Vitalities treats music as one example of the cultural practices and biotic arts of the animal kingdom rather than as a phenomenon categorically distinct from nonhuman forms of sonic expression. The book challenges the human exceptionalism that has allowed musicologists to overlook music's structural resemblances to the songs of nonhuman species, the intricacies of music's physiological impact on listeners, and the many analogues between music's formal processes and those of the dynamic natural world. Through close readings of Austro-German music and aesthetic writings that suggest wide-ranging analogies between music and nature, Musical Vitalities seeks to both rekindle the critical potential of nineteenth-century music and rejoin the humans at the center of the humanities with the nonhumans whose evolutionary endowments and planetary fates they share. This book exhibits deep philosophical quandaries and intricacies of the historical development of science lying behind a simple and fundamental item of common sense in modern science, namely the composition of water as H2O. Three main phases of development are critically re-examined, covering the historical period from the 1760s to the 1860s: the Chemical Revolution, early electrochemistry, and early atomic chemistry. In each case, the author concludes that the empirical evidence available at the time was not decisive in settling the (...) central debates and therefore the consensus that was reached was unjustified or at least premature. This leads to a significant re-examination of the realism question in the philosophy of science and a unique new advocacy for pluralism in science. Each chapter contains three layers, allowing readers to follow various parts of the book at their chosen level of depth and detail. The second major study in "complementary science", this book offers a rare combination of philosophy, history and science in a bid to improve scientific knowledge through history and philosophy of science. It is argued that, of the three distinct approaches usually adhered to in discussions of this controversy, none will produce an adequate reconstruction of the episode. The philosophical-methodological type of approach leads to a glossing over of the intricacies of deductive and inductive procedures inhering in the writings of both antagonists (§ 1). The metaphysical approach leads to oversimplification as to the thinking of either scientist on the problem of the continuous or discontinuous character of Nature(§ 2). The epistemological (theory (...) of knowledge) type of approach, finally, leads authors to posit a Linnaean realism vs. a Buffonian nominalism, whereas the true position was much more complex than what transpires(§ 3). The paper proceeds, therefore, to provide a novel reconstruction of this wellknown controversy (§ 4-5), concentrating on the differing choices made by the two naturalists in their work of botanical or zoological classification : thus seeking to show that the clash came about because Buffon rejected the rigid principle of character subordination put forward by Linnaeus, and, on a more general level, because the two protagonists were proceeding from deeply diverging views of what natural history, and what the naturalist's function, should be. The liberal international legal order faces a legitimacy crisis today that becomes visible with the recent anti-internationalist turn, the rise of populism and the recent Russian invasion of Ukraine. Either its authority or legitimacy has been tested many times over the last three decades. The article argues that this anti-internationalist trend may be read as a reaction against the neoliberal form taken by international law, not least over the last three decades. In uncovering the intricacies of international law’s legitimacy crisis, (...) the article uncovers the paradox of global constitutionalism: that its need to adopt a sectoral form of integration may cause a legitimacy gap/deficit because international authorities, resting their legitimacy primarily on instrumental grounds, may face problems in compensating for the legitimacy deficit caused by the erosion of domestic sovereignty and extending their legitimacy to non-instrumental grounds. This paradox has one necessary structural and two contingent content-related implications for domestic democracies: (1) it necessarily narrows down the regulatory space of nation-states; and this may in turn (2) impair democratic stability and solidarity, and (3) provide a fertile ground for populism. Drawing on Raz’s service conception, the article focuses on the interaction between international and domestic authorities and highlights the problematic aspects of the neoliberal constitutionalization of international law. In the light of this knowledge, and in accordance with rational principles (...) of epistemic probabilities, it adjusts its response to any inference it makes from one of certainty to one with epistemic probability of a degree somewhat less than certainty. But this rational adjustment is itself the consequence of an inference, which will be subject to the same qualifications. By repeating this process, it seems that all certainty reduces to probability and all probability to zero. Hume's argument begins this way: Our reason must be consider 'd as a kind of cause, of which truth is the natural effect; but such-a-one as by _ the irruption of other causes, and by the inconstancy of our mental powers, may frequently be prevented. By this means all knowledge degenerates into probability ; and this probability is greater or less, according to our experience of the veracity or deceitfulness of our understanding, and according to the simplicity or intricacy of the question. 2 It is important to be clear on the logical structure of this argument. One can form the hypothesis about causes that this process of reasoning was in fact one which introduced an 91. element of error. One does not know that this hypothesis is true. But one does know that there is a certain probability that this causal hypothesis is true; as Hume puts it, it may frequently be true. Knowing that we have reasoned poorly sometimes (though not always) in the past, the hypothesis that we have on this occasion reasoned poorly has a certain probability, and we know this even though we have not verified the hypothesis for this particular occasion. On the basis of this unverified but nonetheless somewhat probable causal hypothesis we must as a matter of reason reduce the probability we attach to the belief or affirmation that was produced by the original inference. This reduction of probability is itself a matter of reasoning, however. Therefore about it, also, one can form the hypothesis that it is erroneous, and that the probability of the original affirmation was not reduced sufficiently. On the basis of this new hypothesis we must as a matter of reason reduce still further the probability of the first affirmation. And so on: as I reflect upon my use of reason, all the rules of logic require a continual diminution, and at last a total extinction of belief and evidence. Without separating off emotions as such, Plato and Aristotle alert us to their compositional intricacy, which involves body and mind, cognition and desire, perception and feeling. Even the differences of interpretation to which scholars are resigned focus our minds upon the complexity of the phenomena, and their resistance to over-unitary definitions. Emotions, after all, are things that we feel; at the same time, emotionally is how we often think. Discarding too simple a Socratic focus upon contents of thought, Plato (...) and Aristotle embrace the interconnections, within the emotions, of body and soul, and of perception, imagination, feeling, and thinking. Merchants often use personalized pricing: they charge different consumers different prices for the same product. We assess the ethicality of personalized pricing by generalizing and extending an earlier model by Coker and Izaret (Journal of Business Ethics 173:387–398, 2021) who found that price personalization ethically outperforms unitary pricing. Using a simulation analysis, we show that these results crucially depend on the choice of parameters and do not hold universally. We further incorporate additional sources of marginal cost into the utility function (...) that will likely arise from personalized pricing. These include the expectation that personalized pricing is widely considered unfair by consumers who prefer that all consumers are charged the same price (unitary pricing), and that firms often approximate the consumers’ willingness-to-pay in ways that may raise negative sentiments among consumers who feel that their privacy is breached. By extending our model with disutility from unfairness perception and disutility from surveillance aversion, we demonstrate that personalized pricing is quickly outperformed by unitary pricing under social welfare functions that tend to prioritize total utility (utilitarianism and prioritarianism), whereas personalized pricing can ethically outperform unitary pricing under social welfare functions that tend to prioritize equality (egalitarianism and leximin). In Merleau-Ponty and Nishida, Adam Loughnane initiates a dialogue between two of the twentieth century's most important phenomenologists from the Eastern and Western philosophical worlds. Loughnane guides the reader through the complexities and innovations of Nishida's and Merleau-Ponty's theories of artistic expression and their rarely explored concepts of faith. The intricacies of both philosophers' views are illuminated by analyses of artists, including Cézanne, Sesshū, Rodin, Hasegawa, and other major figures of European, Chinese, and Japanese art history, who enact a radical (...) form of expression that Loughnane calls the practice of "motor-perceptual faith." He argues that the artist's motor-perceptual body, as poetically articulated in Nishida's and Merleau-Ponty's early works, enacts a form of faith that can be parsed in the final writings of both philosophers. The concept of faith is enlarged through its enactment by the artist, while the concept of artistic expression is broadened by casting it as a motor-perceptual conception of faith. Merleau-Ponty and Nishida is an exciting new intercultural reading of these philosophers' writings that opens up under-explored areas of their projects. To unravel the intricacies of the last argument of the Phaedo for the immortality of the soul, the reader has to peel away successive presuppositions, his own, Plato's and not least the presupposition that Plato very skilfully portrays as being shared by Socrates and his friends.A first presupposition is the reader's own. According to our modern ways of thinking, a soul that is immortal, if there is such a thing, is a soul that lives forever. That presupposition is not shared (...) by Socrates and Cebes (Socrates' interlocutor in the final argument). A soul that survives separation from the body, once or a number of times, is held to have survived death and therefore to be immortal. But it does not follow that it will live forever. For a soul to live forever, it must be shown to be not only immortal, but imperishable. Only if the soul is both immortal and imperishable can the assembled company be sure that the Socrates who is talking to them now will still be living when, after sunset, he has drunk the hemlock and can talk to them no more.The modern reader who has divested himself of the presupposition that immortal and imperishable are mere synonyms, and therefore appreciates the need for an argument designed specifically to prove that the soul is imperishable and not merely immortal, has nonetheless to be aware of a second presupposition, a presupposition shared by Socrates and his friends which restricts the meaning that the modern reader might otherwise suppose to be conveyed by the word 'imperishable'. Both Socrates and Cebes, as portrayed in the Phaedo, take it for granted that the only time when the soul might perish is the moment of her separation from the body. Provided it can be shown that the soul will survive separation from the body, no matter how often the body is taken from her, the soul, so they are happy to assume, will have shown herself to be both immortal and imperishable.We do not have to suppose that this second presupposition is shared by the author of the dialogue. Plato's subtle but insistent restriction of the moment when the soul might be threatened with extinction to the moment of her separation from the body has been deliberately designed to alert the reader to a way of thinking which Socrates, Cebes and Echecrates all take for granted, but which Plato does not necessarily invite the reader of the dialogue to share.The restriction is nonetheless essential to the structure of the argument. It is because Socrates does not envisage a possible extinction of the soul at any moment other than the moment of separation from the body that he is able to present a soul that is essentially alive as immune to the death which separates soul from body, however often such a separation may occur, and as therefore (so he claims) not only immortal but imperishable.In presenting that argument, how far has Plato deliberately foregone any attempt to prove that the soul is imperishable subsequently to the moment of her separation from the body? Socrates argues that the soul is unaffected by the death of the body because she is essentially alive. He does not argue that she is immune to destruction or extinction because she is essentially existent. In the face of Plato's silence, in the Phaedo and elsewhere, the modern reader has to hold in abeyance a third and final presupposition, that only a being whose essence it is to exist can of its nature never not exist.To understand the dialogue is therefore no easy matter. The reader needs to distinguish Socrates as the mouthpiece of Plato from Plato as the author of the dialogue. At the same time the modern reader has to distinguish the Plato of history from a fictional Plato who shares our own ideas and our own preconceptions, including the concept of a being cuius essentia est esse. Theorizing about perception is often motivated by a belief that without a way of ensuring that our perceptual experience correctly reflects the external world we cannot be sure that we perceive the world at all. Historically, coming up with a way of securing such epistemic contact has been a foundational issue in psychology. Recent ecological and enactive approaches challenge the requirement for perception to attain epistemic contact. This article aims to explicate this pragmatic starting point and the new direction of (...) inquiry that this opens up for psychology. It does so by detailing the development of James J. Gibson’s ecological psychology. Securing epistemic contact has been a leitmotiv in Gibson’s early work, but subsequent developments in Gibson’s works can teach us what it takes to adopt a pragmatic approach to psychology. We propose a reading of the developments in Gibson’s original works that shows that, since perception is a mode of acting, perception aims for pragmatic contact before allowing for epistemic contact. Amplifying these pragmatist lines of thought in Gibson’s works we end by considering situations where an individual is adapted to the intricacies of specific social practices. These situations show how pragmatic contact can also afford attaining epistemic contact. (shrink)

Migrant farmworkers dominate the horticultural workforce in many parts of the Minority (developed) World. The ‘manual’ work that they do—picking and packing fruits and vegetables, and pruning vines and trees—is widely designated unskilled. In policy, media, academic, activist and everyday discourses, hired farm work is framed as something anybody can do. We interrogate this notion with empirical evidence from the Sunraysia horticultural region of Australia. The region’s grape and almond farms depend heavily on migrant workers. By-and-large, the farmers and farmworkers (...) we spoke to pushed back against the unskilled tag. They asserted that farmworkers acquire knowledge and skills over time and that experienced farmworkers are valuable—their value being brought into sharp relief against accounts of inexperienced farmworkers’ errors. Our interviewees provided rich insights into farmworkers’ engagements with crops and the intricacies of picking and pruning well. Far from being bereft of knowledge and skills, they recognised that experienced farmworkers bring benefits. They improve productivity, product quality and ultimately profits. This is especially so when open communication channels exist across the farm hierarchy, when experienced farmworkers’ insights are taken seriously by their employers. Our research is informed by organisational studies literature and scholarship on craft/making. Like factory floor workers and artisans, experienced farmworkers bring accumulated knowledge and skills to their work, gained through repeat performance. They reflect on and adjust their activities in dialogue with their materials and the environment. Experienced farmworkers demonstrate care, dexterity and judgement. They are not unskilled, and they are more than labouring bodies. (shrink)

Summary Prägnanz was suggested by Max Wertheimer in the 1920s as subsuming all “Laws of Gestalt” as they apply to visual awareness. Thus, it assumes a prominent position in any account of Gestalt phenomena. From a phenomenological perspective, some visual stimuli evidently “have more Prägnanz” than others, so Prägnanz seems to be an intensive quality. Here, we investigate the intricacies that need to be faced on the way to a definition of formal scales. Such measures naturally depend both upon the (...) stimulus and upon the observer. Structural complexity bottlenecks of visual systems play a role, as well as the relevance to biological fitness, that is the affinity to the optical user interface. In Arabic and Turkish dictionaries, qıyāmat has a meaning that includes both the end of the world and the day of reckoning. In the Qur’ān, apocalypse is used for referring to the Day of Judgment. The end of the world is described mostly by as-sāa and similar words. First, in order not to cause any confusion, we will use cosmic qıyāmat for the event which will take place after the first blowing of the trumpet and which is called as-sāa by (...) Qur’ān. We will use qıyāmat/doomsday for the event which will take place after the second blowing of the trumpet. According to Qur’ān, the cosmic qıyāmat begins with the first blowing of the trumpet. Its characteristic features are, such as a violent shaking, splitting of the sky, walking of the mountains hitting each other like clouds of dust, darkening of the stars, extinction of the sun and the moon at the same time, overflowing and boiling of the seas, and transformation of the world into a plain platform where there is neither a pit nor a mound after all. On the other hand, qıyāmat/doomsday begins with the second blowing of the trumpet. Since the sky has already opened and the earth has flattened like stretched animal skin as a result of the cosmic qıyāmat, the place is ready. Then people rise from their graves. They are sent in groups to the location of reckoning. There is a court before which no one is subjected to any unfairness; and at the end, there is heaven or hell. There are depictions of apocalypse in many chapters of Qur’ān. In these depictions, it is not clear whether it is the cosmic qıyāmat or the qıyāmat/doomsday. Qur’ān usually begins with depicting cosmic qıyāmat and lasts with portraying qıyāmat/doomsday. Namely, both processes are intertwined. This fact causes confusion between the depictions of cosmic qıyāmat and the ones of reckoning day. For example, the first 5 verses of Surah al-Qāriʿah describe the cosmic qıyāmat. Al-Qāriʿah is one of the names of the cosmic qıyāmat. It is portrayed as a terrible disaster, terrible voice and heart breaking horror. At that moment, people will be thrown here and there like blades around the fire. The mountains will be like coloured wool scattered around. Then the following verse describes the positions of those whose scales are heavy or light. As seen, after a terrifying short scene of cosmic qıyāmat, the verses rapidly pass to describe qıyāmat/doomsday. This is normal considering the dynamic perspective of Qur’ān. However, some commentators have linked the depiction in the first five verses to the following verses and interpreted it as the qıyāmat/doomsday. They tried to justify this through strained interpretations. The same is also true for Surah az-Zalzalah. The first five verses of this surah depict violent quakes, shedding of the heaviness of the earth, astonishment of the human being who are crying "what is happening to this?!". It is certain that violent quakes are referring to cosmic qıyāmat. The shedding of heaviness of the earth is interpreted as earth’s turning upside down. Some commentators claim that the heaviness of the earth means "humans and jinn". They say that this verse articulates the resurrection. In this case, for a meaningful integrity, the two following verses must be replaced. The earth reveals the dead that it has hided underground through resurrection. The reckoning begins and the earth speaks. Human become surprised by this and express their astonishment by crying, "what is happening to this (earth)". However, in such an interpretation, although a meaningful integrity is created via making a replacement, it is not easy to find a place for the following verse "People leave their graves in groups" (az-Zalzalah 99/6). It is reasonable to accept that the first five verses belong to the cosmic qıyāmat and the sixth verse belongs to the Day of Judgment. Because, as from the sixth verse, like in the previous chapter, it is mentioned that people will be removed from their graves in groups. Despite the confusion we have mentioned, this surah is also interpreted as if the whole surah belonged to qıyāmat/doomsday via linking the previous verses to the next verses, similar as in the Surah al-Qāriʿah. A similar confusion also exists in the Surah of al-Infitār, al-Inshiqāq and at-Takwīr. The examples clearly revealed the intertwining between the cosmic qıyāmat and the qıyāmat/doomsday depictions in the Qur’ān.. Knowing the intricacy between the processes of apocalypse scenes in Qur’ān will be a signal for a more accurate interpretation. (shrink)

It was only later, in the condemnation of the theologian Ratramnus2 and the development of the doctrine of transubstantiation, that the classical formulation took shape.3 That doctrine was expressed in philosophic terms that were then current, concepts that were accepted as clear and valid frameworks for thinking.Medieval theologians, especially the great St. Thomas Aquinas in the thirteenth [End Page 89] century, had just rediscovered Aristotle and gloried in the subtle intricacies and vast overviews that this "new" learning provided them.4 They philosophized by seeking insight into and defining the very act of existence itself, discussing the "essences," or "substances" of things as the underlying realities that we encounter in our life and in our faith. In this view, Christ "subsists"—that is, he really exists—as the substance of the bread and wine in the Eucharist. The development of ideologies in re-construction and transformation of the Indian subcontinent during and after its division into new nation states in 1947emerged as the fault lines in its structural and organizational imbalances, which is an interesting phenomenon and at times led to the violent and radical political discourses. This ideological transformation became imbalanced, due to the exploitation by opportunists in state and political elements, through consciously planned attitude especially in dogma, religious traditions, ethnicity and political/state governance thereby fulfilling ulterior (...) motives. Resultantly, violence and conflicts emerged in both the fragile states of the Indian subcontinent besides undergoing a series of dictatorship, one party rule, manipulation of elites, and ethnic or national polarization ultimately leading to the weak governmental structure. This research was aimed at ascertaining both at theoretical and practical levels, the causes of intricacies involved in transformation of religious ideology into a fault line besides suppressing ethnic and identity markers of traditional society like Pakistan, exploiting the structural organization of political governments through state/bureaucratic regimes. It was discovered that this transformation became such due to the indulgence of state elements and their practices besides illiberal democratic governments, which were also leading to the violence and militancy where ideology/religion has been used for parochial political interests embodied in desires to hang on to power. Henceforth, the power made the dismemberment of joint Pakistan in post-1971era, whereas continuously challenged the fragile integrity after 1971. (shrink)

During the past decade, a small but rapidly growing number of Law&Tech scholars have been applying algorithmic methods in their legal research. This Article does it too, for the sake of saving disclosure regulation failure: a normative strategy that has long been considered dead by legal scholars, but conspicuously abused by rule-makers. Existing proposals to revive disclosure duties, however, either focus on the industry policies (e.g. seeking to reduce consumers’ costs of reading) or on rulemaking (e.g. by simplifying linguistic intricacies). (...) But failure may well depend on both. Therefore, this Article develops a `comprehensive approach', suggesting to use computational tools to cope with linguistic and behavioral failures at both the enactment and implementation phases of disclosure duties, thus filling a void in the Law & Tech scholarship. Specifically, it outlines how algorithmic tools can be used in a holistic manner to address the many failures of disclosures from the rulemaking in parliament to consumer screens. It suggests a multi-layered design where lawmakers deploy three tools in order to produce optimal disclosure rules: machine learning, natural language processing, and behavioral experimentation through regulatory sandboxes. To clarify how and why these tasks should be performed, disclosures in the contexts of online contract terms and privacy online are taken as examples. Because algorithmic rulemaking is frequently met with well-justified skepticism, problems of its compatibility with legitimacy, efficacy and proportionality are also discussed. (shrink)
