This book argues that the institutions of law, and the structures of legal thought, are to be understood by reference to a moral ideal of freedom or independence from the power of others. The moral value and justificatory force of law are not contingent upon circumstance, but intrinsic to its character. Doctrinal legal arguments are shaped by rival conceptions of the conditions for realization of the idea of law. In making these claims, the author rejects the viewpoint of (...) much contemporary legal theory, and seeks to move jurisprudence closer to an older tradition of philosophical reflection upon law, exemplified by Hobbes and Kant. Modern analytical jurisprudence has tended to view these older philosophies as confused precisely in so far as they equate an understanding of law's nature with a revelation of its moral basis. According to most contemporary legal theorists, the understanding and analysis of existing institutions is quite distinct from any enterprise of moral reflection, but the relationship between ideals and practices is much more intimate than this approach would suggest. Some institutions can be properly understood only when they are viewed as imperfect attempts to realize moral or political ideals; and some ideals can be conceived only by reference to their expression in institutions. Este trabajo se ocupa de algunas ideas éticas del filósofo latinoamericano Andrés Bello (1781-1865), en especial de su “teoría de los sentimientos morales”. En la polémica del siglo XIX entre el llamado racionalismo ético (representado por Théodore Jouffroy) y el utilitarismo (Bentham), Bello adopta una postura intermedia, que pudiera calificarse de “hedonismo moderado” o de “eudemonismo”. Sus puntos de vista sobre la motivación moral o la manera en que la razón y el sentimiento se entrelazan para formar nuestras (...) creencias morales, se revelan como muy próximos a las doctrinas de Aristóteles y de algunos autores contemporáneos. El objetivo de este artículo es realizar una revisión del estado de la cuestión sobre el concepto de estado de naturaleza en el pensamiento de Thomas Hobbes. Dicha revisión permite articular una comprensión de la naturaleza humana, puesto que a diferencia del realismo político el estado de naturaleza en Hobbes no tiene un rol meramente hipotético. Precisamente, la idea de naturaleza humana articula una proto-moralidad que permite comprender la transición hacia el estado civil. Las investigaciones Kavka, Gauthier y Hampton han (...) construido una compleja compresión de la naturaleza humana, la cual permite entender cierto sustrato de proto-moralidad en el pensamiento hobbesiano. Yu Kil-chun (1856–1914) was a pioneering theorist in Korea’s Patriotic Enlightenment Movement. Through works such as Sŏyu kyŏnmun, he proposed a new path for the development of Korean civilization. Yu’s encounter with Pak Kyu-su in his early years prompted his interest in Western civilization. He soon decided to study abroad and experience the Japanese and American civilizations first-hand. Based on his experiences, Yu proposed a general blueprint for political reform during the Kabo Reform of 1894. In 1908, he initiated a (...) political reform movement at the provincial level by organizing two groups named Hŭngsadan and Hansŏng Puminhoe. Subsequently, Yu Kil-chun’s enlightenment theory and writings on reform were regarded as a classical model that helped to initiate the modernization of Korea. However, the existing literature concerning Yu’s work exaggerates the progressive role he played and overlooks the logical contradictions and limitations inherent in his ideas. In this article, I conclude that the contradictions in Yu Kil-chun’s enlightenment theory stem from his moral understanding of civilization and the rights of the people. As a result, the project he envisioned ‘to make all people gentlemen’ ultimately focused on how to raise Confucian subjects of an empire rather than how to cultivate modern citizens. (shrink)

This is a pugnacious book, born of ancient controversy and attempting to return the debate to a time before the central jurisprudential questions were set by Hart and other legal positivists. Simmonds addresses those familiar with current analytical philosophy of law: those of us who know our Hart, Fuller, Dworkin, Raz, MacCormick and Kramer, and who perhaps need to have our attention drawn to Plato, Aristotle, Grotius, Hobbes and Kant. Presuming an informed readership, there is no bibliography, and it incorporates (...) ‘substantial extracts from four recent essays’ , but does not say what they are. Overall, his position is that law should be understood as an attempt to realize an archetype of law, an archetype which is a moral ideal. Those suspicious of moral ideals are not likely to find moral archetypes more philosophically acceptable. Yet, if Simmonds is right, we need them in jurisprudence.Simmonds is against the positivist split between …. (shrink)

El presente texto aborda la problemática del aborto como una cuestión moral, y deja de lado otros enfoques relevantes, dado que estos, en opinión del autor, no tienen como horizonte último el punto de vista moral. A partir de los presupuestos conceptuales y metodológicos de la Ética del discurso, en tanto que ética de la corresponsabilidad solidaria no rigorista, se presentan conceptos ético-discursivos que pueden fundamentar las dos tesis siguientes: a) La interrupción arbitraria de la vida humana en (...) la etapa inicial de desarrollo es una práctica injusta; b) En determinados contextos de interacción y en situaciones específicas de decisión, el principio moral que exige no interrumpir voluntariamente la vida humana inicial puede ser no aplicable o su aplicación no exigible. The present text addresses the problem of abortion as a moral issue, and leaves aside other relevant approaches, since these, in the author's opinion, do not have the moral point of view as their ultimate horizon. From the conceptual and methodological assumptions of Discourse Ethics, as ethics of non-rigorous solidary co-responsibility, discourse-ethical concepts are presented that can support the following two theses: a) The arbitrary interruption of human life in the initial stage of development is an unjust practice; b) In certain contexts of interaction and in specific situations of decision, the moral principle that demands not voluntarily interrupting the initial human life may not be applicable or its application may not be enforceable. Su hipótesis es que la filosofía y la ciencia han debilitado a través de su historia el poder de la corriente vital representada por el tiempo y la memoria. El objetivo de Henri Bergson es defender la necesidad de volver (...) a una metafísica que una en la misma durée el tiempo eterno y el fluir del tiempo vital y corporal. Su metodología consiste en revisar la historia de la idea de tiempo y la concepción de los filósofos sobre ella, así como su resistencia a descubrir la duración por debajo de esta idea de tiempo. Stephen Grimm defends the idea that for understanding people, we need to think of understanding not only in terms of grasp of structure but also in terms of a notion of understanding-as-taking-to-be-good. In this paper, I critically examine this idea. First, I argue that in some cases, understanding-as-taking-to-be-good can be explained in terms of understanding-as-grasp-of-structure. Then, I consider one further way in which understanding-as-taking-to-be-good could be obtained through something which is not a form of grasp of structure, which narrows and (...) refines Grimm’s understanding-as-taking-to-be-good concept. Synthetic biology, as a research field, brings together molecular life scientists, computational biologists, and social scientists to engineer biological systems toward societally desired goals. Given the field’s broad multidisciplinarity and relatively young age, innovative educational methods are required to provide students with the needed background knowledge to push the field forward in the future. The international Genetically Engineered Machine competition is such an example where education and high-level research merge, providing the synthetic biology field with trained students, new ideas, (...) and novel results. In the 2021 edition alone, 343 teams from across the world completed the competition to tackle societal problems with synthetic biology. As Wageningen University & Research celebrates 10 years of participation in iGEM, we share our thoughts and experiences on supervising iGEM teams, which is especially relevant to organizers of current and new teams, and also others interested in the iGEM competition. El largometraje La llorona (Jayro Bustamante, 2019) persigue contribuir a la restitución de una deuda histórica con el pueblo indígena guatemalteco; una deuda no satisfecha plenamente con los acuerdos de paz de 1996. El pasado espectral viene encarnado en Alma, la sirvienta maya kaqchikel que entra a trabajar en la casa del general Monteverde, responsable del genocidio de las comunidades indígenas cuando era presidente del país centroamericano. Al invertir la idea del haunting, o tormento, son el torturador y su familia (...) lxs que se ven acosados por sus acciones pasadas, que hasta ahora habían quedado impunes, no solo a nivel jurídico, sino también a nivel moral. La figura metafórica de “La Llorona”, que llora desconsolada más allá de la muerte porque sus hijos han sido asesinados frente a ella, desencadena el terror que vivirá la familia protagonista, obligada a enfrentarse al pasado en el contexto del juicio popular contra Monteverde. La lujosa mansión del expresidente, una casa tomada, rodeada de manifestantes clamando por sus desaparecidxs, se volverá un espacio asfixiante capaz de atentar contra sus habitantes como respuesta a las demandas de justicia. Este artículo se interroga sobre tres aspectos fundamentales de la película. En primer lugar, cómo se elabora audiovisualmente el contra-archivo del juicio de Ríos Montt en 2013, de quien Monteverde es trasunto en la ficción. En segundo lugar, de qué manera se movilizan las politics of haunting negociando un discurso que transciende el género de terror y entronca con el de denuncia social. Y finalmente, cuáles son los procedimientos que utiliza el filme para presentar la resistencia indígena y la decolonialidad como opciones para construir el presente democrático en Guatemala. Se discuten dos argumentos del diálogo Protágoras sobre la relación entre las virtudes individuales. En primer lugar se defiende -frente a Terry Penner- la tesis de Vlastos de que cuando Sócrates dice que "la justicia es justa", "la justicia es piadosa", etc., está destacando la mutua implicación entre las virtudes, y no su identidad; y se formula una hipótesis para explicar la razón de tal reciprocidad. En segundo lugar, se examina el argumento de que, puesto que la insensatez se opone (...) tanto a la moderación como a la sabiduría, y un término contrario no puede tener más de un contrario, moderación y sabiduría serían "una sola cosa". Se asevera que Platón quiere que rechacemos esta última conclusión, basada en el fondo en la idea de que las distintas virtudes se relacionan entre sí como las partes de un mismo rostro. Se concluye que los argumentos analizados no implican realmente la idea contraintuitiva de la identifi cación mutua de las virtudes.Two arguments from the Protagoras on the unity of the virtues are here dwelt with. First, it is claimed - with G. Vlastos and contra T. Penner - that when Socrates says that “justice is just”, “justice is pious”, etc. he wants to highlight the reciprocity of the individual virtues, not their mutual identity . Second, it is argued that Plato does not really want us to infer from folly’s opposition to both temperance and wisdom the need to identify these two virtues . He is only drawing our attention to their close relationship. This is enough to reject the hypothesis initially defended by Protagoras, i.e. that the different virtues relate to each other as the parts of a face. I conclude that the two aforesaid arguments do not really support the mutual identity of the virtues. (shrink)

In the epistemological context of theory transferand scientific exchanges, the aim of this paper is to indicate the presence of Weberian categories and ideas on dependency theory formulated by Fernando Cardosoand Enzo Faletto. Here we see how the construction of this paradigm was based on some issues, concepts, approaches and orientations of the Weberian research program formulated by José Medina Echavarría to explain Latin American development. We will also consider the contexts of enunciation and reception theories, allowing us to (...) talk about the "sociological school" that was formed in the Social Planning Division of ILPES in mid-sixties, crucial for understanding the history of sociology in Latin America. En el contexto de la discusión epistemológica sobre el examen de las transferencias y los intercambios científicos de las teorías, el objetivo de este artículo es señalar la presencia de categorías e ideas weberianas en lateoría de la dependencia formulada por Fernando Cardoso y Enzo Faletto. Aquí veremos cómo la construcción de este paradigma se sustentó en algunos temas, conceptos, enfoques y orientaciones del programa de investigación weberiano formulado por José Medina Echavarría para explicar el desarrollo latinoamericano. También tendremos en cuenta los contextos de enunciación y de recepción de las teorías, lo que nos permitirá hablar de la "escuela sociológica" que se formó en la División de Planificación Social del ILPES a mitad de los años 60, decisiva para comprender la historia de la sociología en América Latina. In this article we present a notion of “logical perfection”. We first describe through examples a notion oflogical perfectionextracted from the contemporary logical concept of categoricity. Categoricity (in power) has become in the past half century a main driver of ideas in model theory, both mathematically (stability theory may be regarded as a way of approximating categoricity) and philosophically. In the past two decades, categoricity notions have started to overlap with more classical notions of robustness and smoothness. These have (...) been crucial in various parts of mathematics since the nineteenth century. We postulate and present the category of logical perfection. We draw on various notions of perfection from mathematics of the 19th and 20th centuries and then trace the relation to the concept of categoricity in power as a logical notion of what a “mathematically perfect” structure is. El presente trabajo investiga las tesis sobre el poder civil de Alonso de la Veracruz que buscan incorporar en la comunidad política española a los habitantes autóctonos del Nuevo Mundo, tesis que suelen relacionarse con F. de Vitoria y el tomismo español, y que últimamente son consideradas parte del republicanismo novohispano elaborado desde la periferia americana. Se busca demostrar que su propósito era aplicar una teoría de derechos naturales, sin que ello implique participación política de los indios americanos. The paper explores Alonso de la Veracruz's theses on civil power, which sought to integrate the native inhabitants of the New World into the Spanish political community. These theses, which have usually been associated with F. de Vitoria and Spanish Thomism, have recently come to be considered part of a Novohispanic republicanism developed in the American periphery. The article seeks to show that the purpose of such theses was to apply a theory of natural rights that did not entail the political participation of the indigenous population, as well as to analyze Veracruz's position regarding cultural diversity and the war against the indigenous peoples. On the powerful qualities view, every fundamental property is both dispositional and qualitative. Identity theory is the standard account of the view, which makes the stronger claim that a property’s dispositionality and qualitativity are identical to each other, and identical to the property itself. Recent defences of the powerful qualities view have involved novel theories of powerful qualities which are not also variants of identity theory. Giannotti (Erkenntnis 86:603–621, 2021a) has suggested a novel theory of his own, the dual aspect (...) account, which makes use of a particular notion of aspects. For Giannotti, dispositionality and qualitativity are each an aspect of a property, and an aspect is a property’s way of being. The importance of aspects is twofold. Firstly, by introducing aspects to identity theory, the theory becomes more precise. Secondly, aspects allow for a novel theory of powerful qualities, the dual aspect account, which maintains that dispositionality and qualitativity are aspects, but rejects the identity claim. Giannotti’s aim is to show that even if identity theory is false, the dual aspect account remains an available theory for advocates of powerful qualities. This paper will be a critical examination of Giannotti’s ideas. Firstly, I will clarify Giannotti’s notion of aspects, explaining how it involves a misunderstanding of supervenience, and why it does not offer the advantages that he claims it does. Secondly, in light of my discussion of aspects, I will argue that the dual aspect account lacks relative advantages over the compound view of powerful qualities. (shrink)

Las ideas expuestas por José Eusebio Caro en su obra inconclusa intitulada Mecánica social o Teoría del movimiento humano, considerado en su naturaleza, en sus efectos y en sus causas, en 1836, recoge aspectos característicos del pensamiento de las primeras décadas del Siglo XIX, con raíces algunas de ellas en ápocas anteriores. La riqueza intelectual de la obra en mención indujo la investigación analítica, de la cual da cuenta este documento, según la siguiente pregunta de investigación: ¿Cuáles son los (...) rasgos epistemológicos predominantes en las tesis filosóficas y sociológicas de José Eusebio Caro, en su obra póstuma inconclusa intitulada Mecánica social o teoría del movimiento humano, considerado en su naturaleza, en sus efectos y en sus causas? El estudio en torno a esta obra se concentra en precisar aspectos epistemológicos de una propuesta que comparte honores con el positivismo y con el surgimiento de la teoría social cuyas tesis dan paso al surgimiento de la sociología. Esto, en un particular siglo caracterizado por la búsqueda de la originalidad ideológica y política del continente americano, que esperaba resurgir lejos de la dominación española y cerca de los teóricos franceses y de los desarrollos ideológicos de Inglaterra. El presente artículo indaga si ¿es el sujeto un ser autónomo en la deliberación política o sonlos pensamientos, las posturas y las formas de la organización política mediadas por las distintas herramientas comunicacionales a las que se ve expuesto quienes lo determinan? Así, analiza larelación que existe entre mass media y política, con la capacidad deliberativa del individuo altomar decisiones en el contexto político, a partir de Chomsky y Han. La metodología es cualitativa con diseño documental, el instrumento son fichas (...) bibliográficas aplicadas a fuentes primarias y secundarias. Se usan bases de datos con el algoritmo: “Neoliberalismo, psicopolítica, big data, medios de comunicación de masas y democracia”. Se analizan 13 libros y 20 artículos. Se identifican las nuevas formas y herramientas de organización política y la relación entre política y medios de comunicación. Se concluye que: 1) el neoliberalismo direcciona la idea de libre mercado hacia el individuo mismo, 2) es necesaria una ciudadanía crítica que tenga un rol más activo en lademocracia, 3) se identifica a la psicopolítica como una nueva forma de organización política, 4) lanueva herramienta de la política es el big data, 5) se evidencia que la relación entre política y massmedia está vinculada con los grupos de poder y 6) la emocionalización de la comunicación políticadisminuye la autonomía individual. Esta confusión lleva a que se apliquen al primero categorías propias del segundo. Se examinan las "paradojas ónticas" que mi cuerpo (la carne) inaugura (a); se despeja la tesis de dos interpretaciones de las meditaciones primera y sexta (b); se discute la (...) "excepción a la metafísica" instaurada por el conocimiento de mi cuerpo (c); se arriesga, siguiendo una indicación del autor, la apertura a una dimensión ética que exige examinar ya no la unión de cuerpo y alma, sino la unión por el amor a un semejante y a la comunidad de semejantes (d). The article carries out a critical examination of J.-L. Marion's latest work, "Sur la pensée passive de Descartes", whose main thesis is that the problems posed by the union of body and soul confuse two terms: body and my body. This confusion leads to the application to the former of categories inherent to the latter. The paper examines the "ontic paradoxes" that my body (the flesh) gives rise to (a); it clarifies the thesis of two interpretations of the First and Sixth Meditations (b); it discusses the "exception to metaphysics" established by the knowledge of my body (c); and, following an indication by the author, it proposes an opening to the ethical dimension, which demands an examination of the union, through love, with a fellow human being and with the community of human beings, rather than of the union of body and soul (d). Neste artigo, propõe-se um exame crítico da última obra de J.-L. Marion, intitulada "Sur la pensée passive de Descartes", dedicada à união de alma e corpo, e cuja tese principal é: os problemas que essa união suscita confundem dois termos, corpo e meu corpo. The papers are based on presentations given at a panel discussion in Oxford in December 2009. In this 'Introduction' Pavlos Eleftheriadis outlines the main themes of the book, namely that the idea of law is intrinsically moral, the distinction between analytical and normative jurisprudence is false and law (...) is not a list of rules or a chain of authorisation, but a system of thought that follows the basic principles of practical reason. El presente artículo pretende mostrar cómo en la filosofía de Andrés Bello puede llegar a comprenderse el cuerpo como suposición y como una entidad propuesta con anterioridad empírica que hace posible la comprensión del dinamismo de la propia realidad y a la vez la coexistencia de los fenómenos en el mundo. Además, el papel de medium ejercido por esta corporalidad permitiría dar cuenta de la referencialidad en la relación mundo-mente. Todo ello enmarcado bajo una posible deriva fenomenalista lingüística del propio (...) autor a través de la defensa del juicio como aquél que actúa como referencia del significado de la propia sensación para poder dar validez y existencia a las propias percepciones e ideas. En el anterior número de Ideas y Valores (157 de abril de 2015) se publicó la primera parte, que corresponde a la introducción y las dos primeras secciones del original.

El presente artículo aborda el tópico ‘racionalidad’ en la versión estándar del enfoque pragmadialéctico (PD) de argumentación, que pretende superar la dicotomía, entre los aspectos normativo y descriptivo, existente en los estudios sobre argumentación. Se señala que la pragmadialéctica asume ciertos postulados popperianos al conceptualizar su noción de racionalidad, y dado que también incluye elementos de filósofos como Searle y Grice, se indaga si las ideas de racionalidad de estos filósofos están presentes en el compromiso con la racionalidad de (...) los pragmadialécticos. Por otra parte se da cuenta de algunos nexos entre el pensamiento aristotélico y los tres filósofos señalados con el fin de aclarar la concepción que tienen los pragmadialécticos acerca de la racionalidad, estimulando así un regreso enriquecedor a las fuentes de la argumentación. El carácter analítico de Meditationes implica que, por una parte, ninguna verdad puede ser interpretada sin referencia al lugar concreto que ocupa en el orden de razones y, por otra, que no existen en Meditationes ficciones que permanezcan advertidamente como tales. Sin embargo, la presencia de algunas pasiones no ha sido justificada, lo que pone en cuestión el carácter analítico de la obra. Proponemos que tales pasiones son efecto de juicios implícitos. Para poner a prueba nuestra hipótesis, hemos elegido un (...) enigmático párrafo que hemos denominado el “texto de la adoración.”. (shrink)

One major objection to social rights is a failure of determining which precise social and economic claims should be granted rights status. The social rights debate has grappled with this ‘indeterminacy problem’ for quite some time, and a number of proposals have emerged aimed at fixing the content of these rights. In what follows I examine three distinct approaches to fleshing out the idea of a minimum threshold: social rights as the fulfilment of basic needs, social rights as the securing (...) of a minimally decent life and social rights as a requirement of citizenship. Each of these proposals progressively expands on what the minimum threshold of social rights requires and, conversely, what obligations they generate on part of the state. I will show that none of these approaches is entirely satisfactory and suggest that the social rights debate look elsewhere to determine its content. (shrink)

All at once two processes of domination were triggered: one supported by the force of arms, and the other by the power of ideas and beliefs. If the defenders of utopian thinking were able to create a lasting achievement, it is because they managed to make their ideas fit with (...) the principles governing the social life of the indigenous peoples: thus a substantial part of what remains from the period of Don Vasco de Quiroga had preceded it. Cultures will not be able to transcend nationalisms and rise to the level of concerns shared by the whole of humanity until they can stand up for their own particular character against ‘globalizing’ trends. En este artículo se realiza una semblanza general del pensador colombiano Darío Botero Uribe, en especial, sobre sus ideas en torno al pensamiento latinoamericano. En este sentido, se aborda el problema de la particularidad y la universalidad del pensamiento, la crítica de la modernización y el colonialismo intelectual, el problema de la cultura y de su puesto en la filosofía latinoamericana y colombiana, a la vez que establece una relación con la problemática del mestizaje indoamericano.
