As one of the most influential comparative philosophers of our time, Henry Rosemont, Jr. is known for his unrelenting criticisms against Western libertarian ideas, and for advocating ideas derived from classic Confucian thought. One of the criticisms against him is that his views are one-sided, and hence unfair to Western libertarian ideas. In this paper, I argue that Rosemont’s one-sidedness is deliberate. His theory is not intended to be a balanced account. I will illustrate that Rosemont’s way of conceiving (...) the human self is not peculiar to him, but characteristic of those who take philosophy as a way of life, such as Mencius and Sartre. I shall argue that their practices suggest a gong-fu perspective, with which we evaluate philosophical theories according to their functions in shaping people’s behaviors and with consideration of the context of their uses. Does it make sense to employ modern logical tools for ancient philosophy? This well-known debate2 has been re-launched by the indologist Piotr Balcerowicz, questioning those who want to look at the Eastern school of Jainism with Western glasses. While plainly acknowledging the legitimacy of Balcerowicz's mistrust, the present paper wants to propose a formal reconstruction of one of the well-known parts of the Jaina philosophy, namely: the saptabhangi, i.e. the theory of sevenfold predication. This essay analyses three meanings of asymmetry on which talk of asymmetry in German-language care discourse is based: as irreversibility [Unumkehrbarkeit], as imbalance [Ungleichgewichtigkeit] and as one-sidedness [Einseitigkeit]. One result of this analysis is that it currently seems doubtful whether asymmetry can serve as a central concept for care theories. Following this, two questions will be discussed. In systematical terms: how could this doubt possibly be resolved? In discourse-analytical terms: What are the functions of asymmetry in care discourse?

In a brilliant series of studies, Roy Bhaskar, the originator of the influential, multi-disciplinary and international philosophy of critical realism, presents for the first time in published form, his new philosophy of Meta-Reality. The philosophy of Meta-Reality confirms many aspects of the great philosophical traditions of the past, while correcting their one-sidedness and transcending their dualism and dichotomies, representing what is valid in them in a radically new way, apt for our contemporary times of global crisis.

In the human quest for orientation vis-à-vis personal life and comprehensive reality the worldviews of religionists and humanists offer different answers, and science also plays a crucial role. Yet it is the ordinary, embodied experience of meaningful engagement with reality in which all these cultural activities are rooted. Human beings have to relate themselves to the entirety of their lives to achieve orientation. This relation involves a non-methodical, meaningful experience that exhibits the crucial features for understanding worldviews: it comprises cognition, (...) volition, and emotion, is embodied, action-oriented, and expressive. From this starting-point, religious and secular worldviews articulate what is experienced as ultimately meaningful. Yet the plurality and one-sidedness of these life stances necessitates critical engagement for which philosophy provides indispensable means. In the end, some worldviews can be ruled out, but we are still left with a plurality of genuine options for orientation. (shrink)

To avoid the one-sidedness and abuse of the rule of xieju 絜矩, Zhang Taiyan 章太炎 redefines zhong-shu 忠恕, the Confucian golden rule, as two separate yet complementary principles, the idea of which is most manifestly drawn from Zhuangzi’s 莊子 “Qiwulun 齊物論”. Zhang’s association of zhong-shu and qiwu 齊物 is based upon his vision of equality premised on recognition of and respect for differences. In Zhang’s reading of the Zhuangzi in light of Yogācāra, the crucial “concept matching” is the explanation (...) of cheng xin 成心 as seeds in the ālaya consciousness. Cheng xin in this sense not only refers to the natural pattern of things and so is the basis for inference and deduction, but also serves as the means to deal with the diversity of opinions. In moral practice, Zhang proposes the liang xing 兩行 approach of his qiwu philosophy: to recognize the equal worth of all beings on one hand, and to take the particular characteristics and desires of individuals into account on the other. Thus, it requires the dual practice of zhong and shu: to acquire firsthand observation through personal experience, and to imagine oneself in the position of the other. (shrink)

The historical origin and the experimental basis of the concept of physical determinism indicate that this basis was removed with the acceptance of the kinetic theory of matter, while its difficulties are increased by the admission that human nature, in its entirety, is a product of natural causation. An indeterministic view of causation has the advantages (a) of unifying the concept of natural law in different spheres of human experience and (b) of a greater generality, which precludes the acceptance of (...) the special case of completely deterministic causation, so long as this is an unproved assumption. It is not inconsistent with the orderliness of the world, or with the fruitful pursuit of natural knowledge. It enriches rather than weakens the concept of of causation. It possesses definite advantages with respect to the one-sidedness of human memory, and to the phenomena of aiming and striving observable in man and other animals. Among biological theories it appears to be most completely in harmony with the theory of natural selection, which in its statistical nature resembles the second law of thermo-dynamics. In an indeterministic world natural causation has a creative element, and science is interested in locating the original causes of effects of special interest, and not merely in pushing a chain of causation backwards ad infinitum. These contrasting tendencies are illustrated by a critique of the mutation theory, and by an attempt more closely to define the sense in which indeterministic causation should be thought of as creative. There is no doubt that periodization is a rather effective method of data ordering and analysis, but it deals with exceptionally complex types of processual and temporal phenomena and thus it simplifies historical reality. Many scholars emphasize the great importance of periodization for the study of history. In fact, any periodization suffers from one-sidedness and certain deviations from reality. However, the number and significance of such deviations can be radically diminished as the effectiveness of periodization is directly connected with (...) its author's understanding of the rules and peculiarities of this methodological procedure. In this paper we would like to suggest a model of periodization of history based on our theory of historical process. We shall also demonstrate some possibilities of mathematical modeling for the problems concerning the macroperiodization of the world historical process. This analysis identifies a number of cycles within this process and suggests its generally hyperexponential shape, which makes it possible to propose a number of forecasts concerning the forthcoming decades. In this article, I present the conception of the first object of human intellect in the thought of the leading representatives of 13th century Scholasticism. The first object of a cognitive faculty is the essence that determines the proper domain of that faculty; thus the first object of human intellect is what defines the possible extension of human epistemic possibilities. The conception of the first object of human intellect presupposes and implies definite solution of important epistemological, metaphysical, and anthropological questions. (...) While one current of scholastic opinion, represented by St. Bonaventure and Henry of Ghent favored God as the first object of human intellect, more empirically minded Aquinas upheld the Aristotelian position that the proper object of human intellectual cognition is the essence of material reality; Duns Scotus evolved an elaborate position that tried to steer the middle course between the solutions of his predecessors and overcome the one-sidedness of their insights. Finally, I proceed to vindicate my opinion, that the epistemology of the 15th century thinker Nicholas of Cusa remained under significant influence of the scholastic debates and solutions. (shrink)

In this paper, we argue that the attempts to centre education in one of its three constitutive aspects that have long determined the discourse on the purpose and aims of education run the risk of one-sidedness. Theories of student-centred education have been in vogue for many centuries now, having been born out of a polemic against teacher-centred education which focuses on knowledge transfer. In turn, recent thing-centred or world-centred accounts of education polemicize against student-centred accounts and their privileging of (...) individual learning processes. However, each side of this multifaceted polemic is one-sided in its own way, and this has held back not only theories of education, but also educational practice. We argue that educational theorising that is not attentive to all three aspects and dimensions of educational practices – teacher, student, and world – will ultimately lead to a poorer understanding of the purpose and aims of education. Context: Philosophical debates in recent decades have developed new ways of dealing with old philosophical problems such as reality, truth, knowledge, language, communication, and action. These new approaches deserve serious consideration because they can improve the discourse of radical constructivism. Problem: This paper discusses the following problem: How can we overcome dualistic and ontological approaches to basic philosophical problems – problems that are relevant to all scientific domains? Method: The method applied here can be roughly described as a transition from (...) entities/substantives/identities to actions and processes, the actions and processes from which so-called entities result. Action-orientation – or an actor-based process – is necessarily combined with sense-orientation as provided by culture and society. Results: The paper demonstrates how the problems mentioned above can be reformulated in a non-dualistic and non-ontological way. Implications: Opening up constructivist thinking to insights provided by neighbouring philosophical approaches facilitates interdisciplinary cooperation and helps overcome dualistic remnants – as well as the cognitive one-sidedness of traditional constructivism. In most Western countries, health law bioethics are strongly intertwined. This strong connection is the result of some specific factors that, in the early years of these disciplines, facilitated a rapid development of both. In this paper, I analyse these factors and construe a development theory existing of three phases, or ideal‐typical models. In the moralistic‐paternalistic model, there is almost no health law of explicit medical ethics and the little law there is is usually based on traditional morality, combined with (...) paternalist motives, the objections to this modal are that its paternalism and moralism are unacceptable, that it is too static and knows no external control mechanisms. In the liberal model, which is now dominant on most Western countries, law and ethics closely cooperate and converge, both disciplines use the same framework for analysis: they are product‐oriented rather than practice‐oriented; they use the same conceptual categories, they focus on the minimally decent rather than the ideal, and they are committed to the same substantive normative theory in which patient autonomy and patient rights are central. However, each of these four characteristics also result in a certain one‐sidedness. In some countries, a third model is emerging. In this postliberal model, health law is more modest and acknowledges its inherent and normative limits, whereas ethics takes a richer and most ambitious self image. As a result health law and ethics will partly diverge again. (shrink)

I have chosen this title to set myself the task of commenting on the practice of philosophy in the light of my work as a philosopher in a university postgraduate department of war studies. I shall begin with some general remarks on how we are to understand ‘philosophy’, then discuss a neglected one-sidedness in the commentary which philosophers have attempted on such topics as the problems of the nuclear age.

Despite philosophers’ growing interest in the relation between philosophy and literature in general, over the last few decades comparatively few studies have been published dealing more narrowly with the literary aspects of philosophical texts. The relationship between philosophy and literature is too often taken to be "literature as philosophy" and very rarely "philosophy as literature." It is the dissatisfaction with this one-sidedness that lies at the heart of the present volume. Philosophy has nothing to lose by engaging in a (...) serious process of literary self-analysis. On the contrary, such an exercise would most likely make it stronger, more sophisticated, more playful and especially more self-reflexive. By not moving in this direction, philosophy places itself in the position of not following what has been deemed, since Socrates at least, the worthiest of all philosophical ideals: self-knowledge. The play contains two different fates of Wallenstein—the first, the fate of the determinate progress of a decision, the second, the fate of this decision and the forces opposing it. Each can be taken as a tragic whole in itself. The first: Wallenstein, a great man—for as his own man, as an individual, he has held command [geboten] over many men—appears as this being in command [gebietende], with the splendor and enjoyment of this reign, mysterious because he holds no mystery. (...) The determinate divides itself, of necessity, against his indeterminateness, into two branches, the first internal, the second external. The internal is not a struggle for determination but a fermenting of it; he has personal stature, fame as a commander, as the deliverer of an empire through individuality, command over many who obey him, the fear of friend and foe; he is himself above [erhaben] determination as subject to the emperor and state he has delivered, still less to fanaticism; his plans themselves must be still higher [erhaben]; what determination can satisfy him? He prepares for himself the means for the greatest [end] of his time, to confer [gebieten], in general, peace upon Germany, and, in particular, to acquire for himself a kingdom, and for his friends—comparable rewards.—[But] his higher [erhabene], self-sufficient soul plays [spielende] with the greatest end, and, for this reason, it is without character and can grasp no end, it searches for something higher to prod it. The independent man, who is yet alive and no monk, wants to shift the guilt of determination from himself, and, if there is nothing that can command [gebieten] him—there can be no such thing—then he creates for himself what will command [gebiete] him. Wallenstein seeks his decision, his action and his fate, in the stars. Precisely the one-sidedness of indeterminate being in the midst of nothing but determinateness, independence within nothing but dependences, brings him into relation with a thousand determinations; his friends built these up into ends that become his, his enemies too, against which they must however fight; and this determination, which has developed itself in the fermenting matter—for these are human beings—binds him and renders him dependent, it is not something he created, rather it seizes him. This succumbing of the indeterminate before the determinate is a highly tragic being, it is posited as great and of consequence.—In this, reflection will not justify genius, only present it. The impression of this as a tragic whole stands out for me very vividly. If this whole were a novel, then one could demand to see the determination clarified,—namely, that which Wallenstein has brought to this rule over the people. They are fettered by greatness, lack of determination, his boldness for their sake. It is however part of the play, yet cannot be acted out dramatically, i.e., appear as determining and at the same time determinate. It appears only as a shadow-play [Schattenbild], as it is called in the Prologue, perhaps in a different sense; but the camp is this rule, as something that came into being [gewordenes], a product. The subject of lament in the NT has not received as much attention as it deserves. Some scholars have taken note of this fact, even calling on evangelicals to take up the charge. The present article is a response to such a charge and focuses on the book of 2 Corinthians, where one finds several instances that point to a pattern of lament, revealing a true, back-and-forth covenant interaction with God, rather than one that allows only for praise. After a (...) brief introduction to the concept of biblical lament, a few key passages in 2 Corinthians are examined that, while not formal laments, do provide certain glimpses of lament. These examples encourage a move beyond the one-sidedness of a “doxology-only” faith and toward one that is more robust, able to hold both praise and lament in tension. (shrink)

In confrontation with the current events of his time, Max Scheler develops his idea of a “new Europe”, which is to emerge from the ruins of the First World War in confrontation with “capitalist England” and through the awakening of a new religiosity. From the 1920s onwards, the idea of unity under Catholicism is overcome and raised to a higher level to a global and cosmopolitan level. Scheler speaks of a “cosmopolitanism” that needs to be learned and will ultimately entail (...) a balancing process (Ausgleichsgeschehen). Scheler understands this Ausgleich and cosmopolitanism as an educational task (Bildungsaufgabe). According to Scheler, only in and through the education (Bildung) of persons towards this idea can national, cultural and religious one-sidedness be overcome. Scheler's new conception of knowledge and Bildung plays an essential role in this, culminating in the concept of the all-man (Allmensch), who, as a relative all-man, is to be both a model and a goal. With the increasing economic development and gradual opening of China’s aviation market, the Chinese aviation industry is experiencing rapid growth and is facing some problems at the same time. Many scholars have assessed the profitability of the Chinese aviation industry using a single assessment approach. Both theory and methods in assessing the profitability of the airlines need to be developed and improved. This article presents a new integrated approach – a combination of factor analysis, principal component analysis, and gray relational (...) analysis. Based on the theory of decision making and data mining, this more reasonable and effective model overcomes the one-sidedness and limitations of the individual methods and has significant impact in theory and practice. The latest newcomer on the epistemology scene is Subject-Sensitive Invariantism (SSI), which is the view that even though the semantics of the verb “know” is invariant, the answer to the question of whether someone knows something is sensitive to factors about that person. Factors about the context of the purported knower are relevant to whether he knows some proposition p or not. In this paper I present Jason Stanley's version of SSI, a theory Stanley calls Interest-Relative Invariantism (IRI). The core (...) epistemological claim of IRI is that knowledge is conceptually connected to practical interests. Stanley's defence of IRI is closely connected to practical reasoning, but unfortunately, I argue, IRI leads to bad practical reasoning. I furthermore show that Stanley's IRI cannot accommodate all of Stanley's five test cases for knowledge attribution, test cases that are supposed to (more or less) make or break theories of knowledge attribution. IRI also has some quite counterintuitive results and derives much of its appeal from one-sidedness of Stanley's examples. The net effect, I claim, is that IRI should be resisted. (shrink)

This study focuses on the interrelation of freedom, finitude, and reconciliation in Hegel?s understanding of religion. These three moments are found at central stages of Hegel?s treatment of the religious, from Hegel?s early fragments to his mature work. Finitude taking shape in the religious phenomena of a tragic fate, sin, or more generally, failing, is central to Hegel?s philosophical understanding of one-sidedness. As finite, man needs to reconcile with the other, and only as reconciled does he achieve freedom. Hegel (...) credits Christianity with the discovery of the primary essences of spirituality: freedom and forgiveness. Freedom is intensified with the death of God: man realizes that there is no God-given, only man-made, legislation. This deepening of freedom does not overcome man?s finitude but instead intensifies it along with a heightened sense for responsibility, and an increased potential for guilt. In this context, forgiveness is the highest spiritual capacity of modern man, whose fate is to bear the freedom of oneself and the other. nema. (shrink)

Although Karl Marx and Søren Kierkegaard are both major figures in nineteenth-century Western thought, they are rarely considered in the same conversation. Marx is the great radical economic theorist, the prophet of communist revolution who famously claimed religion was the "opiate of the masses." Kierkegaard is the renowned defender of Christian piety, a forerunner of existentialism, and a critic of mass politics who challenged us to become "the single individual." But by drawing out important themes bequeathed them by their shared (...) predecessor G. W. F. Hegel, Jamie Aroosi shows how they were engaged in parallel projects of making sense of the modern, "dialectical" self, as it realizes itself through a process of social, economic, political, and religious emancipation. In The Dialectical Self, Aroosi illustrates that what is traditionally viewed as opposition is actually a complementary one-sidedness, born of the fact that Marx and Kierkegaard differently imagined the impediments to the self's appropriation of freedom. Specifically, Kierkegaard's concern with the psychological and spiritual nature of the self reflected his belief that the primary impediments to freedom reside in subjectivity, such as in our willing conformity to social norms. Conversely, Marx's concern with the sociopolitical nature of the self reflected his belief that the primary impediments to freedom reside in the objective world, such as in the exploitation of the economic system. However, according to Aroosi, each thinker represents one half of a larger picture of freedom and selfhood, because the subjective and objective impediments to freedom serve to reinforce one another. By synthesizing the writing of these two diametrically opposed figures, Aroosi demonstrates the importance of envisioning emancipation as a subjective, psychological, and spiritual process as well as an objective, sociopolitical, and economic one. The Dialectical Self attests to the importance and continued relevance of Marx and Kierkegaard for the modern imagination. (shrink)

This paper is a clarification and partial justification of a novel approach to the interpretation of Gramsci. My approach aims to avoid reductionism, intellectualism, and one-sidedness, as well as the traditional practice of conflating his political thought with his active political life. I focus on the political theory of the Prison Notebooks and compare it with that of Gaetano Mosca. I regard Mosca as a classic exponent of democratic elitism, according to which elitism and democracy are not opposed to (...) each other but are rather mutually interdependent. Placing Gramsci in the same tradition, my documentation involves four key points. First, the Notebooks contain an explicit discussion of Mosca's ideas such that when Gramsci objects to a theoretical concept or principle, he often presupposes a common methodological orientation, and when he objects to a particular method or approach, he often presupposes a common theoretical view. Second, Gramsci accepts and gives as much importance to Mosca's fundamental principle that in all societies organized elites rule over the popular masses. Third, Gramsci accepts Mosca's distinctive theory of democracy defined as a relationship betwen elites and masses such that the elites are open to the influx of members from the masses. Finally, there is an emblematic practical political convergence btween the two: in 1925, both opposed a Fascist bill against Freemasonry. Although their rhetoric was different, their speeches exhibit astonishing substantive, conceptual and logical similarties. (shrink)

This study is a contribution to the bioethical debate about new and possibly emerging reproductive technologies. Its point of departure is the intuition, which many people seem to share, that using such technologies to select non-disease traits – like sex and emotional stability - in yet unborn children is morally problematic, at least more so than using the technologies to avoid giving birth to children with severe genetic diseases, or attempting to shape the non-disease traits of already existing children by (...) environmental means, like education. The study employs philosophical analysis for the purpose of making this intuition intelligible and judging whether it is justified. Different ways in which the moral problems posed by reproductive technologies are often framed in bioethical debates are criticised as inadequate for this task. In particular, it is argued that the intuition cannot fully be made sense of in terms of harm to the children that such technologies help create. The study attempts to elaborate an alternative to that broadly consequentialist approach, by drawing on Martin Heidegger’s philosophy of technology, Hans Jonas’s ethics, and Aristotle’s practical philosophy, as it has been received and developed in the hermeneutical tradition. It is suggested that reproductive choices, unlike decisions for already born children, are characterised by a peculiar one-sidedness: the future child appears to the parents as something wholly theirs to decide about, not as a concrete other with whom they must interact in a responsive and attuned way. This is problematic because it means that such choices cannot call upon the particularised moral understanding only gained in interpersonal encounters. In particular, it makes them easily shaped by various tendencies, to which parents are always susceptible, to relate to children in instrumentalising ways, and at risk of reinforcing such tendencies. However, this does not mean that all uses of reproductive technologies are equally troubling. When selecting against severe disease the parents can rely on a widely shared illness experience to escape the dangers that one-sidedness involves. It is concluded that the intuition under discussion, thus explicated and in some ways qualified, makes sense morally. (shrink)

The paper describes the conception of logic in Polish didactics authored by the Commission of National Education (KEN), an important educational institution of the European Enlightenment. Since the documents of the Commission refer to a vision of science presented by such influential works then as the Encyclopédie ou dictionnaire universel raisonné [Great French Encyclopedia], the paper compares the requirements from the Commission’s programmer with the encyclopaedic entries that entail logical problems broadly understood. It turns out that the Commission, following the (...) Encyclopédie, not only recommended a list of textbooks of logic but also shared its eclectic vision of logic. Although it is characteristic of modernity to take a relative approach to the importance of traditional logic, transformed into science on method, or literally an outline of epistemology, understood according to É. Condillac as a specific form of metaphysics, nevertheless some elements of logic were eclectically made valid. This logic, from the times of I. Kant, has been defined as formal logic. Practical logical skills were preferred to the knowledge of logical theories. At the same time attention was paid to the meaning of natural logical skills, and drills in logical reasoningwhen studying languages and mathematics. Despite preferences for the analytical method they also noticed the importance of synthetic method. It seems also that although the documents of the Commission do not say anything about the teaching of syllogistic issues, in didactic practice inspired by the Encyclopédie in the schools controlled by the Commission, the room was made to teach these problems. Condillac’s book was preferred in the schools controlled by the Commission, nevertheless, it was not, as in the case of other textbooks, a must on the reading list, an obligatory reading matter, therefore it was not published in Poland. The conception of logic presented by the Commission as modelled on the Encyclopédie managed to avoid the one-sidedness of Condillac’s approach, the approach that in fact eliminated the teaching of logic. This book facilitates a missing dialogue between the secular and the transsecular dimensions of human existence. It explores two kinds of limits of the secular: the inadequacies of its assumptions with respect to the total being of the human, and how it curbs the ontological sensibilities of the human. Kaustuv Roy argues that since secular reason of modernity can only represent the empirical dimension of existence, humans are forced to privatize the non-empirical dimension of being. It is therefore absent from (...) the social, imaginary, as well as public discourse. This one-sidedness is the root cause of many of the ills facing modernity. Roy contends that a bridge-consciousness that praxeologically relates the secular and the non-secular domains of experience is the need of the hour. (shrink)

Among the multiple, subliminal passions that inspire our life in innumerable ways, literature shows us one that seems to play a particularly penetrating role in human concerns. This passion, which Tymieniecka calls an `esoteric passion', finds its projection and crystallization in space: it is the esoteric passion for space. This subliminal passion, investigated through literature, allows the philosopher to reach beneath the fallacious separations of nature, humanness and the cultural world, restoring the wholeness of experience that has become lost in (...) the artificial one-sidedness of contemporary approaches, confined to language as they are. The elemental passion for place is investigated here in the literary fruits of creative imagination. Unravelled from the very depths of the primogenital, onto-poietic unfolding of life, the passion for place is revealed as projecting into the flux of life: it is a `station' of life-significance. Pierre Olivier distinguishes between two radically different concep-tions of legal fictions: on the one hand, the conception of legal fiction developed by the commentators of the Middle Ages, which culminates in Bartolus’s defini-tion; on the other hand, the conception developed by the 19th Century German scholar Gustav Demelius, who was followed, among others, by Joseph Esser. The main difference between the two approaches is individuated by Olivier in the fact that, while the former consider legal fictions as essentially implying an (...) actual fic-tional element, the latter deny this. In other words, according to Demelius and those who follow him, the term “legal fiction” is a misnomer. In this article, I first provide an example of a legal fiction. In the second and third section, I rely on this example to analyze and assess the two competing accounts. Finally, in the fourth part, I advance a syncretistic account of legal fictions, which should thus point to a possible middle ground between the two competing positions. As it is often the case, there is probably some truth to both accounts; the problem – I will argue – is that both theories tell only a part and not the whole of the story. More precisely, it will be argued that legal fictions essentially involve the structure of “as if”-statements, and that the one-sidedness of the two competing accounts derives from the fact that one focuses too much on the “if”-component (the assumption), whereas the other focuses too much on the “as”-component (the comparison). Cosmopolitanism is concerned to disclose the ethical, cultural and legal basis of political order in a world where political communities and states matter, but not only and exclusively. In circumstances where the trajectories of each and every country are tightly entwined, the partiality, one sidedness and limitedness of ‘reasons of state’ need to be recognized. While states are hugely important vehicles to aid the delivery of effective public recognition, equal liberty and social justice, they should not be thought of (...) as ontologically privileged. They can be judged by how far they deliver these public goods and how far they fail; for the history of states is marked, of course, not just by phases of bad leadership and corruption but also by the most brutal episodes. A cosmopolitanism relevant to our global age must take this as a starting point, and build an ethically sound and politically robust conception of the proper basis of political community, and of the relations among communities. My paper tackles the generic relationship between philosophy and law, the necessity of applying philosophy to law, the legitimacy and range of such an approach, the configuration of the way in which philosophy has left its mark in the juridical sphere. It surveys, in a chronological order, as well as in terms of their co-existence, the various stages of the relationship between philosophy and law. 1. Although both have been “within the walls”, law secludes itself, relatively speaking, in “the world (...) taken as a whole”, to shape its own identity, to survive as a self-sufficient, distinct technique (F. Geny), or it does it in a doctrinary way (positivism). 2. The representatives of philosophy in the juridical sphere are doing their best to uphold law’s struggle for knowledge, to have it gain recognition as a “science”, renounce its one-sidedness and harmonize with the others. 3. Juridical norms are not untouchable in relation with philosophy. Philosophy may work within juridical norms if it has an affinity with the content of juridical normativeness and respects its specificity. 4. The conclusion I reach is that we must try to cultivate a joint area bringing together philosophy and law, an area wherein the specific features of the two distinct fields reach a consensus for the sake of the human condition – hic et nunc. Philosophy bestows coherence and casts light on “law for man’s sake”, while the philosophically founded law appears to be the “normative project of the human”, a human practice inextricably connected with other types of practice, with man as a whole. The practical way to fulfil this goal, like the goal itself, will always be liable to criticism and improvement, open to debates and various options in a concrete socio-historical context. (shrink)

In this article I attack the scandalous one-sidedness of traditional philosophical epistemology. I make clear its total dependence on one and only one paradigm of knowledge – propositional knowledge. Such knowledge presupposes that we are always capable of fully articulate our knowledge verbally or notationally and support it by empirical or formal reasons. On this basis it becomes quite impossible to say anything sensible about, for instance, professional knowledge, not to speak of aesthetical or moral knowledge. Some of us (...) have been aware of this for quite a while as Michael Polanyi already in 1958 pointed it out in his book Personal Knowledge. His most famous statement is: «We know more than we can tell». And he argues that we possess a great amount of tacit knowledge. Therefore we need appropriate categories for handling the various kinds of knowledge which cannot be articulated as propositional knowledge. And that is Polanyi’s weak spot. Inspired by Wittgenstein’s remark in Philosophical Investigations § 78 concerning knowing and saying how high Mont Blanc is, how the word «game» is used and how a clarinet sounds, I have developed an alternative approach where becomes propositional knowledge, becomes various forms of practical knowledge and becomes various kinds of knowledge by familiarity. is a sort of first person knowledge which we are quite unable to express verbally to someone who is unfamiliar with the instruments of the Western musical tradition. On this basis I sketchily analyse the paradigm of knowledge in traditional philosophical epistemology and point out a series of its shortcomings. In the second part of my article I take a close look at a rather new contribution to the discussion of tacit knowledge, written by one of the leading figures within the research field called «the sociology of scientific knowledge» – Harry Collins. His book is called Tacit and Explicit Knowledge and was published in 2010. And his primary aim of the book is to «reconstruct the idea of tacit knowledge from first principles so that the concept’s disparate domains have a common conceptual language». I perform a close reading of his development of the common conceptual language and conclude that he does not succeed. He creates a monstrous terminology which just alienates us from the subject instead of making us see the connections between the «disparate domains» of tacit knowledge. (shrink)

For Professor Wahl, the va-et-vient of speculative concepts reveals a restless dialectic whereby the emphasis of the theorist passes periodically from one contrary to another. Thus such notions as subject, object, the one, the many, have each in turn a recurring moment of dominion. But this movement, although it animates the development of ideas, cannot reach a stable equilibrium; and the notion, that may perhaps be attributed to Hegel, of a rational dialectic that has achieved a final resolution, is for (...) Wahl, as for Kierkegaard, a false ideal. This does not mean, however, that we are thereby finally condemned to a relativism or historicism. We can escape the vacillating one-sidedness of a "rational" dialectic. Indeed, the dialectic process seems to invite us to transcend it, or we might say, the very purpose of argument is to transcend itself since vision and not a discursive strategy is the goal of the philosopher. Vulnerability as a critique of the one-sidedness of the principle of autonomy is at risk of overemphasizing the positive dimension of vulnerability. Moreover, in the discourse on vulnerability, the threat of dehumanization (or moral vulnerability) has not been scrutinized enough ethically. Therefore, the ethics of vulnerability is insufficient when faced with the force of war that requires the conceptualization of vulnerability for political-ethics. The Russian war in Ukraine demonstrates this weakness in a striking way: the called-for openness to the (...) other as well as an active form of nonviolence, as promoted by Judith Butler, may not be an option in times of war. Continuing Jessica Benjamin’s psychoanalytic approach to mutual recognition, the essay shows that the task of morality does not rest upon broadening one’s vulnerability, but rather in understanding vulnerable agency as the dialectic of vulnerability and agency. For the further development of this dialectic, the triadic figuration is emphasized, complementing the dyadic relation of self and other. While the Third can take multiple figurations in the psychoanalytical setting, I understand the Third within the political-ethical context as the possibility of a “moral world” of nonviolence and respect. During war, the role of the bystander is to become a witness who, through the process of witnessing, advocacy, diplomacy, and justice, allows for the moral Third to reemerge. Among others, the ethics of vulnerability must spells out the price for the failure of taking on this responsibility, namely the eclipse of morality. (shrink)

This article contests the division that, up to now, has characterized the two fundamental approaches to the philosophy of Alain Badiou. The first concentrates its attention upon the domain of being and being-there, while the other is concerned with the event and the retroactive coming-to-be of truths. As a matter of fact, it argues that this division misses Badiou’s core proposal: his attempt to renovate materialistic dialectics in order to account for the emergence of novelty in a divided situation. -/- (...) With this context in mind, the focus of the paper is Badiou’s uninterrupted confrontation with Hegel as the source of the most important concepts that build up his post-dialectical dialectics, even after the so called ‘mathematical turn’, that is to say, the notions of scission and subject. Hence, it analyses these categories as they first appear in Théorie du sujet’s dialectics between algebra and topology. Secondly, it explores how they are transposed in L’Être et l’événement, emphasising the latter’s profoundly dialectical articulation notwithstanding its overly structural and potentially misleading orientation. Thirdly, it tries to underline how Logiques des mondes supplements this one-sidedness with the topological approach of a (new) theory of the subject, where Théorie du sujet represents the ‘vanishing mediator’ between the two tomes of Badiou’s magnum opus. Finally, it concludes that Badiou finds in Hegel a doctrine of the event, motivated by the creation of a new figure of man against those of reaction and obscurantism that dominate modern democratic materialism. In North Atlantic culture dying is mostly seen as a personal event. The societal dimension of dying and the impact of the cultural horizon are often overlooked. In this contribution a revised version of a medieval Ars moriendi model is used as a lens to perceive the one-sidedness of North Atlantic culture.

Zhejiang's aesthetic education has developed rapidly in recent years, especially in the context of global aesthetic education that promotes the integration of noble culture with popular culture and emphasizes diversity, compromise, and reproducibility. In light of this year's high reexamination of aesthetic education by the country, provinces, and cities, aesthetic education has been elevated to a new level. However, existing aesthetic education still has problems, such as the indistinguishability of aesthetic education and art education concepts, the one-sidedness of aesthetic (...) education content, and the shortage of aesthetic education teachers. These problems have long affected the development of Zhejiang's aesthetic education. The issue of promoting aesthetic education has become a major concern for aesthetic education teachers throughout the province and even the country. Therefore, this article focuses on the current situation and problems of Zhejiang's aesthetic education. A comparison of the current status and achievements of Taiwan's aesthetic education with Zhejiang, drawing on each other's experience, learning from each other's strengths and weaknesses, and in-depth research on teachers' performance in aesthetic education, aesthetic education training programs, and campus cultural construction, and other aspects is put forward. A series of implementation plans for the promotion of aesthetic education, such as "synergy training" and "education of people with a view," was provided as a practical experiment and a theoretical reference for promoting the rapid development of aesthetic education in the country. The current theory of social policy is characterized by considerable inconsistencies and analytical gaps. Disciplinary one-sidedness goes together with nontransparent and partially incompatible epistemological considerations. In this paper, it is shown that the Gestalt theory can be a sound starting point for the theory of social policy. Gestalt theory provides a groundwork for the selection of behavioral assumptions, the understanding of self-organization processes and the formulation of basic normative questions.

The question of whether homeopathy is a science is currently discussed almost exclusively against the background of the modern concept of natural science. This approach, however, fails to notice that homeopathy—in terms of history of science—rests on different roots that can essentially be traced back to two most influential traditions of science: on the one hand, principles and notions of Aristotelism which determined 2,000 years of Western history of science and, on the other hand, the modern concept of natural science (...) that has been dominating the history of medicine for less than 200 years. While Aristotle’s “science of the living” still included ontologic and teleologic dimensions for the sake of comprehending nature in a uniform way, the interest of modern natural science was reduced to functional and causal explanations of all phenomena for the purpose of commanding nature. In order to prevent further ecological catastrophes as well as to regain lost dimensions of our lives, the one-sidedness and theory-loadedness of our modern natural–scientific view of life should henceforth be counterbalanced by lifeworld–practical Aristotelic categories. In this way, the ground would be ready to conceive the scientific character of homeopathy—in a broader, Aristotelian sense. (shrink)

Misunderstandings of Hegel have several roots: one is the intrinsic difficulty of his highly technical and interrelated conceptual sets, another is ideological opponents who consequently take statements out of context, and a third is following those of high stature who pass on the misunderstandings. Typical misunderstandings concern freedom and necessity, slavery, that status of the individual, God and the State, facts measuring up to concepts, the relation of rationality and actuality, the status of passion, and, above all, the nature of (...) absolute knowing. Resituating these notions within the whole of the System shows the one-sidedness of typical misunderstandings and opens the way toward appropriation. (shrink)

The article is based on the analysis of the works of the famous Ukrainian thinker from Canada, Yuriy Mulyk-Lutsyk, who in the mid-twentieth century. deeply considered the state of the Ukrainian diaspora, its search for a strategy of its development abroad within the limits of ethnic particularism and international universalism. His thoughts have not lost their relevance today, as new waves of migration pose the same questions to Ukrainians: whether to remain or dissolve as a national community among a (...) multiethnic and multicultural world. The migrants, diasporans, whose grandchildren have lost their connection with their historical homeland and are part of other multinational states, are particularly disturbed by those outside Ukraine. The main problem of the migrants and diasporas of that time, according to Mulyk-Lutsyk, was that they did not distinguish between ethnic particularism and interethnic universalism, identifying or substituting one another. This led to radical one-sidedness: the Ukrainians cared for one or the other in themselves. The main reason for this imbalance according to the thinker was that Ukrainians intellectually were not ready to migrate. They did not have time to realize their ethnic identity, their uniqueness, as they got into millstone universalism, which led them to "spiritual turmoil, gypsyism". Instead of meeting with other worlds, Ukrainians experienced a cultural trauma. It is possible to overcome the latter by realizing the equality of the universal and the specific, the universal and the ethnic, which are two "natural signs of one and the same". The Ukrainians should understand that they/he are/is human, because he has such physical and spiritual attributes that are common to all people; at the same time he is a member of this ethnic community because it contains such features that are not present and cannot be found in other ethnic communities. Although universal and specific are opposite to one another, however, in the person they exist in combination both as a physical indivisible unity and as a spiritual one. Yu.Mulyk-Lutsyk realized that integration into a multidimensional space, sometimes so alien, but to be friendly for himself, is very difficult. He insisted on fostering within himself both national and universal, where the particular was affirmed through the universal and the universal manifested in the particular. Eventually the thinker urged: if the ethnic community understands what the essence of its ethnicism is, that is, it realizes the secret connection between ethnic content and ethnic form and learns the absolute, natural boundaries of ethnicism, which are not free to artificially, illegally, unnaturally, contraband; and if the ethnic community at the same time understands the essence of its universalism, that is, it realizes the secret connection between human content and human form, and learns the absolute, natural limits of humanity, in which it is not free to artificially, illegally, unnaturally, contraband if and only then the ethnic community in general and each of its constituent units in particular will form a unity on a natural basis - national unity. Knowledge of the experience gained by the Ukrainian diaspora in Canada may be of use to those who wish to migrate to other countries and other cultural worlds. (shrink)

The Anthropocene overthrows classical dichotomies like technology and nature and a new class of beings emerges: hybrids. The transitive status of hybrids - which establishes an extra, separate, 'third' ontological category, going beyond the dichotomy between nature and technology - constitutes a significant problem for environmental philosophy and philosophy of technology since they traditionally focus on either 'nature' (natural entities) or 'artefacts' (technological objects). In order to reflect on the ethical significance of hybrids, a classification of different types of hybrids (...) is required. Such a classification is provided by this article, based on insights from both environmental philosophy and philosophy of technology. After explaining why a new class of beings emerges in the Anthropocene, and reflecting on the one-sidedness of philosophy of technology and environmental philosophy in their focus on either technology or nature, we propose a new classification of hybrids in this article that provides a new starting point for reflections on the moral significance of hybrids in environmental philosophy and philosophy of technology. In Being and Time as well as in his later writings, Heidegger comes to distinguish between fundamental moods and everyday or inauthentic moods. He also claims that phenomenology, rather than psychology, is the appropriate method for examining moods. This article employs a schematic approach to investigate a phenomenology of fundamental moods in terms of its possibilities and limits. Since, in Being and Time, the distinction between fundamental moods and ordinary moods is tied to the division between authenticity and inauthenticity, the (...) latter concepts need to be addressed first. Guided by Klaus Held's article 'Fundamental Moods and Heidegger's Critique of Contemporary Culture', the second part of the article argues that Heidegger's phenomenology of moods is indeed one-sided, favouring anxiety at the expense of awe. Finally, I argue that, contrary to Held's claims, this one-sidedness cannot be amended by the means one finds in Heidegger's analyses. Instead, it is necessary to undertake closer examination of those moods which necessarily involve the other person. (shrink)

For all its diversity, contemporary discourse about the Other shares the following suppositions: the Other in its radicality eludes the economy of the logic of the Same; it is beyond Being; its alterity is tied to the infinite in a manner that exceeds the ambit of thematization; and the problem it presents to philosophy is novel, in the precise sense that the dominant logic of the Western tradition, the so-called “logic of the Same” , is incapable of recognizing the full (...) depth of the problem of the Other. In what follows I will engage critically each of these suppositions, to the end of answering the question whether contemporary discourse about the Other is determined by a two-fold one-sidedness, characterized by its thoroughly modern presuppositions about the nature of the Self and logic and by its positing of the kath auto status of the Other as something that is either completely unrelated to the Same or, granting the necessity of recognizing some kind of relation to the Same, something that has absolute priority over the Same. My answer to this question will be “yes.” I will endeavor to demonstrate the two-fold one-sidedness belonging to these suppositions by first returning to the original discussion of the Other in the Western tradition, Plato’s account of the dialogue between the philosophical Stranger from Elea and the mathematician Theaetetus in the Sophist. Ethics and legal design currently seem to be involved in a “vortex of temporality” (Jürgen Habermas), which, according to the understanding of many, integrates them into a modern way of life. Examples are the protection of life (Embryo Protection Act and abortion, reinterpretation of Article 1 of the Basic Law in the Maunz/Dürig commentary by Herdegen), the promotion of plural family forms and sexual relationship worlds (“marriage for all“, life stage partnership), assisted dying (judgment of the Federal Constitutional Court on (...) assisted suicide). Apparently, it is always about the dismantling of traditional taboos and the establishment of legal regulations that are intended to correspond to a new ethical consciousness and plural ideological worlds. The discussion in ethics theory and legal theory in this situation has agreed on a model of the gravitational fields of liberal self-execution, in which cultural development in ethics and law should find its moral support and at the same time its legal ethical dynamics. According to this understanding, a basic consensus is maintained in the execution of liberal debates (also on moral and legal questions). It is articulated in human rights principles, which themselves must be discussed again in open conversation in their meaning, but which at the same time bring themselves to the fore as irrefutable exactly in this social process. Theological ethics maintains a certain distance from this interpretation. The understanding of freedom must then be structured for the lifestyle of society in such a way that the one-sidedness of individualism and abstract overemphasis, even exaggeration, is avoided. The aim is to integrate social integration, reference to natural framework conditions and realistic border awareness in ethics and law. Moral theology can be based in this on the further development of social science. (shrink)

Resumo: A partir de um estudo sobre os tropos de Enesidemo consignados e discutidos por Sexto Empírico, em suas Hipotiposis pirrônicas, propomos um ensaio de filosofia no qual a leitura desses tropos nos conduz à necessidade de postular uma universalidade nova, radical e intransponível. Por meio dela, não só o teor e o alcance filosóficos do ceticismo podem ser enfatizados, mas também se pode assegurar um lugar de pensamento não-relativista contra a intolerância dogmática ou contra a insatisfação com os conflitos (...) da filosofia.: Based on a study of the tropes of Aenesidemus discussed by Sextus Empiricus in his Pyrrhoniae Hypotyposes, we propose a reading which leads us to the need to postulate for contemporary thought a new universality that is radical and insurmountable. By this means, the philosophical content and scope of skepticism can be understood in the sense of an encounter - finally - with the much sought after notion of truth as that which can not be possessed, or whose announced possession is always the revelation of a one-sidedness. In addition, a place of non-relativistic thought can be secured against dogmatic intolerance and against dissatisfaction with the conflicts of philosophy. (shrink)

Responsibilities towards employees constitute a recognised general subject area in the field of business ethics. Thus, research has been done regarding respecting employees’ rights to fairness in dismissal procedures, to their privacy, to a fair wage, etc. Employee loyalty has also been shown to be very important both in management literature and in legal debate but much less attention has been given to employer loyalty which could be one of the responsibilities of an employer to his or her employee. Rather, (...) some confusion regarding the nature of loyalty has at times led to suggestions that loyalty should be replaced by self-interest. However, scholars who favour this view usually do so in reaction to the one-sidedness of loyalty expectations. This paper proposes that loyalty is a duty that employers also owe their employees, based on the reciprocal nature of certain rights and duties within human relationships and an understanding of psychological contracts. Thus the paper argues that loyalty should be a mutual expectation between the parties rather than unidirectional. In fact, employer loyalty enriches the employers themselves in terms of their human fulfilment, since it is a human virtue, and leads to employee loyalty response, which then impacts the bottom-line.The paper’s content is also important insofar as it could contribute to building ethical duty foundations for employers in developing countries where weak regulatory environments combine with the harshness of the economy to make it an employers’ world and make instances of unfairness towards employees common. Ideologies about threatening language from scholarly and practitioner communities of practice reflect a genre replete with stances of violence and threatener control, wherein authorial intent is more strongly attributed to threats possessing characteristics that strengthen a threatener’s role in or commitment to the act. Using the resources of Appraisal analysis, this article examines the ways in which interpersonal stances, or a speaker or writer’s commitment to or attitudes about a person or proposition, are manifested and function in a realized threat (...) of violence. The analysis reveals that threateners use myriad rhetorical strategies to convey interpersonal meaning and take stances that both strengthen and weaken their apparent level of commitment, thus contradicting the one-sidedness of threatening language ideologies and demonstrating the need for further research on stancetaking in threatening discourse. College-student subjects made notes about the morality of early abortion, as if they were preparing for a class discussion. Analysis of the quality of their arguments suggests that a distinction can be made between arguments based on well-supported warrants and those based on warrants that are easily criticised. The subjects also evaluated notes made by other, hypothetical, students preparing for the same discussion. Most subjects evaluated the set of arguments as better when the arguments were all on one side than (...) when both sides were presented, even when the hypothetical student was on the opposite side of the issue from the evaluator. Subjects who favoured one-sidedness also tended to make one-sided arguments themselves. The results suggest that ?myside bias? is partly caused by beliefs about what makes thinking good. (shrink)

The essay presents Patočka’s intellectual relationship to Karl Jaspers on the basis of his texts from the 1960s and 1970s, with a starting point in the 1969 study What is Existence?. After introducing some general connections and differences, based in particular on the forms of heresy in both philosophers, the basic contours of the notion of existence are examined more closely. Patočka understands existence as the performance of a threefold movement that is in many respects problematic. The virtue of Jaspers’ (...) position, on the other hand, lies in its focused clarity. While both thinkers emphasize the concept of authentic performance, the key issue becomes its one-sidedness, which can be described as surrender without acceptance. (shrink)

This paper explores the ways in which neoliberal schooling is threatening education. We define education as the development of cognitive and imaginative capacities for understanding of and critical engagement with social reality. Education opens horizons of possibility for collective and individual life-experience and activity by exposing the one-sidedness and contradictions of ruling-value systems. Schooling, by contrast, subordinates thought and imagination to the reproduction of the ruling money-value system, narrowing horizons of possibility for collective and individual life to service to (...) the prevailing structure of power. Our paper draws on our overlapping experiences as educators, one in the university system, the other in the adult education system. In both systems, students’ life-requirement for education is subordinated to the capitalist need for compliant wage-labourers and consumers. In opposition to this instrumentalization we will present an interpretation of “real world education” as a unique form of collective work through which teachers and students construct alternatives that can serve as the guiding ideas for new projects for social and political transformation.
