This book examines the legal and moral theory behind the law of evidence and proof, arguing that only by exploring the nature of responsibility in fact-finding can the role and purpose of much of the law be fully understood. The idea that prescribing physicians should be guided by the most reliable scientific evidence seems obvious, but the actual methodology of evidence-based medicine was only introduced in the early 1990s by an international group of clinicians and researchers led by Gordon Guyatt. Since then it has provided a new paradigm for the scientific foundation of medicine and has influenced other disciplines outside of medicine, for example, evidence-based psychotherapy, science and government. Since its introduction just over two decades ago, evidence-based medicine (EBM) has come to dominate medical practice, teaching, and policy. There are a growing number of textbooks, journals, and websites dedicated to EBM research, teaching, and evidence dissemination. EBM was most recently defined as a method that integrates best research evidence with clinical expertise and patient values and circumstances in the treatment of patients. There have been debates throughout the early 21st century about what counts as good (...) research evidence between EBM proponents and philosophical critics and even within the EBM community itself. Similar controversy arises about the relative worth of patient values and clinical expertise (and how these can be integrated). EBM has also evolved in ways that have come under scrutiny. Specifically, policymakers have used EBM research methodology to increase the relative importance of clinical guidelines that some clinicians have argued are tyrannical. Philosophers have addressed all of these controversies, and with very few exceptions have been critical of EBM. In addition most philosophical attention has been on the epistemic role of Randomization and evidence hierarchies, with relatively little attention being paid to the role of Diagnosis, expertise, patient values, and Systematic Reviews within EBM. The recent proliferation of types and accounts of experimentation in sustainability science still lacks philosophical reflection. The present paper introduces this burgeoning topic to the philosophy of science by identifying key notions and dynamics in sustainability experimentation, by discussing taxonomies of sustainability experimentation and by focusing on barriers to the transfer of evidence. It integrates three topics: the philosophy of experimentation; the sustainability science literature on experimentation; and discussions on values in science coming from the general (...) class='Hi'>philosophy of science, the social sciences, and sustainability science. The aim is to improve understanding of how sustainability experimentation has evolved, from a broader picture of the history and philosophy of science, with a specific focus on understanding evidence production and how evidence traveling in and from sustainability experiments can be improved, particularly in the context of complex and pervasive normative commitments of the research. By engaging in these topics, this research is one of the first philosophical accounts of sustainability experimentation, contributing both to the knowledge on specific philosophies of science and to the further development of an evidence-based sustainability science through a better understanding of the barriers to more relevant and usable knowledge. Increasing philosophical attention is being directed to the rapidly growing discipline of evidence-based medicine. Philosophical discussions of EBM, however, remain narrowly focused on randomization, mechanisms, and the sociology of EBM. Other aspects of EBM have been all but ignored, including the nature of clinical reasoning and the question of whether it can be standardized; the application of EBM principles to the logic, value, and ethics of diagnosis and prognosis; evidence synthesis ; and the nature and ethics of placebo (...) controls. Philosophical analysis in each of these areas has the potential to enhance the discussion of EBM methodology and practice. (shrink)

Obviously medicine should be evidence-based. The issues lie in the details: what exactly counts as evidence? Do certain kinds of evidence carry more weight than others? (And if so why?) And how exactly should medicine be based on evidence? When it comes to these details, the evidence-based medicine (EBM) movement has got itself into a mess – or so it will be argued. In order to start to resolve this mess, we need to go 'back (...) to basics'; and that means turning to the philosophy of science. The theory of evidence, or rather the logic of the interrelations between theory and evidence, has always been central to the philosophy of science – sometimes under the alias of the 'theory of confirmation'. When taken together with a little philosophical commonsense, this logic can help us move towards a position on evidence in medicine that is more sophisticated and defensible than anything that EBM has been able so far to supply. This is the first book to systematically examine the underlying theory of evidence in Anglo-American legal systems. Stein develops a detailed and innovative theory which sets aside the traditional vision of evidence law as facilitating the discovery of the truth. Combining probability theory, epistemology, economic analysis, and moral philosophy, he argues instead that the fundamental purpose of evidence law is to apportion the risk of error in conditions of uncertainty.

In his book “Medical Philosophy: Conceptual issues in Medicine”, Mario Bunge provides a unique account of medical philosophy that is deeply rooted in a realist ontology he calls “systemism”. According to systemism, the world consists of systems and their parts, and systems possess emergent properties that their parts lack. Events within systems may form causes and effects that are constantly conjoined via particular mechanisms. Bunge supports the views of the evidence-based medicine movement that randomized controlled trials (RCTs) (...) provide the best evidence to establish the truth of causal hypothesis; in fact, he argues that _only_ RCTs have this ability. Here, we argue that Bunge neglects the important feature of patients being open systems which are in steady interaction with their environment. We show that accepting this feature leads to counter-intuitive consequences for his account of medical hypothesis testing. In particular, we point out that (i) the confirmation of hypotheses is inherently stochastic and affords a probabilistic account of both confirmation and evidence which we provide here; (ii) RCTs are neither necessary nor sufficient to establish the truth of a causal claim; (iii) testing of causal hypotheses requires taking into account background knowledge and the context within which an intervention is applied. We conclude that there is no “best” research methodology in medicine, but that different methodologies should coexist in a complementary fashion. (shrink)

The present volume is one of a type we should soon expect to be seeing more of in philosophy of medicine. Philosophy of medicine has now been around long enough that entire careers, or at least substantial portions of careers, can and have been devoted to it. This is an important milestone in the field.This is true, even though, as the author indicates in the introduction, this is not solely a book of philosophy of medicine. Investigations in (...) philosophy of medicine, and the essays included in this volume in particular, can not only contribute to “the development of philosophy of medicine as a discipline” but can also “test and help revise some of [philosophy of science’s] views” . Thus, this book is intended as a contribution both to philosophy of medicine as a specific discipline and to philosophy of science generally. In this paper I am concerned with the relation between the history of science and the philosophy of science from the perspective of philosophy. In particular, I examine two philosophical objections against the idea that the history of science can provide evidences to the philosophy of science. The first objection is metaphysical and suggests that given Hume’s law, i.e. that norms cannot be derived from facts and given that the history of science is a descriptive enterprise while (...) the philosophy of science is a normative endeavor, the former cannot be informative for the latter. The second is epistemological and is often called the ‘case studies dilemma’. According to this dilemma, we can neither deduce general philosophical theories from particular historical cases nor test the former through the latter. I argue that although those objections fail to be fatal for the idea that the historical data can provide evidence for the philosophical theories of science, they can help us draw a proper image of the relation between the history and the philosophy of science. I conclude that this picture presupposes the constant epistemic iteration between the two disciplines. (shrink)

This anthology of essays presents a sample of studies from recent philosophy of medicine addressing issues which attempt to answer very general (interdependent) questions: (a) what is a disease and what is health? (b) How do we (causally) explain diseases? (c) And how do we distinguish diseases, id est define classes of diseases and recognize that an instance X of disease belongs to a given class B? (d) How do we assess and choose cure/ therapy? The book is divided (...) into three sections: classification, disease, and evidence. In general, attention is focused on statistics in medicine and epidemiology, issues in psychiatry, and connecting medicine with evolutionary biology and genetics. Many authors position the theories that they address within their historical contexts. The nature of health and disease will be addressed in several essays that also touch upon very general questions about the definition of medicine and its status. Several chapters scrutinize classification because of its centrality within philosophical problems raised by medicine and its core position in the philosophical questioning of psychiatry. Specificities of medical explanation have recently come under a new light, particularly because of the rise of statistical methods, and several chapters investigate these methods in specific contexts such as epidemiology or meta-analysis of random testing. Taken together this collection addresses the question of how we gather, use and assess evidence for various medical theories. The rich assortment of disciplines featured also includes epidemiology, parasitology, and public health, while technical aspects such as the application of game theory to medical research and the misuse of the DSM in forensic psychiatry are also given an airing. The book addresses more than the construction of medical knowledge, however, adding cogent appraisal of the processes of decision making in medicine and the protocols used to justify therapeutic choices. According to the Variety of Evidence Thesis items of evidence from independent lines of investigation are more confirmatory, ceteris paribus, than e.g. replications of analogous studies. This thesis is known to fail Bovens and Hartmann, Claveau. How- ever, the results obtained by the former only concern instruments whose evidence is either fully random or perfectly reliable; instead in Claveau, unreliability is modelled as deterministic bias. In both cases, the unreliable instrument delivers totally irrelevant information. We present a (...) model which formalises both reliability, and unreliability, differently. Our instruments are either reliable, but affected by random error, or they are biased but not deterministically so. Bovens and Hartmann’s results are counter-intuitive in that in their model a long series of consistent reports from the same instrument does not raise suspicion of “too-good-to- be-true” evidence. This happens precisely because they neither contemplate the role of systematic bias, nor unavoidable random error of reliable instruments. In our model the Variety of Evidence Thesis fails as well, but the area of failure is considerably smaller than for Bovens and Hartmann, Claveau and holds for realistic cases. The essential mechanism which triggers VET failure is the rate of false to true positives for the two kinds of instruments. Our emphasis is on modelling beliefs about sources of knowledge and their role in hypothesis confirmation in interaction with dimensions of evidence, such as variety and consistency. (shrink)

Mediating the meaning of evidence through epistemological diversityNursing's disciplinary recognition of ‘multiple ways of knowing’ reflects an epistemological diversity that supports nursing praxis. Nursing as praxis offers a conceptual way to explore what it is about the interface of practice, knowledge and evidence in nursing that distinguishes us as a discipline. I suggest that the relationship between evidence and knowledge is defined and mediated by the same epistemological diversity that supports nursing as praxis. Just as the meaning (...) and truth‐value of evidence is evaluated from within the body of existing disciplinary knowledge, new evidence may prompt an evaluation of the meaning and truth‐value of extant nursing knowledge. Nursing practice that relies on scientific evidence as a singular basis of practice knowledge is susceptible to exploitation by the diverse agendas operating within an ideology of evidence‐based practice and the healthcare system. Mediating the meaning of evidence for nursing practice through acknowledgement of the diverse epistemologies that underpin nursing knowledge will contribute to a disciplinary‐specific definition of what constitutes evidence for nursing, and will better direct how evidence is integrated into a disciplinary body of knowledge. The Value of Evidence thesis (VE) tells us to gather evidence before deciding in any decision problem, if the evidence is free. This appar- ently plausible principle faces two problems. First, it fails on evidence externalism or nonclassical decision theories. Second, it’s not general enough: it tells us to prefer gaining free evidence to gaining no evi- dence, but it doesn’t tell us to prefer gaining more informative evidence to gaining less informative evidence (...) when both are free. This paper defends an alternative value-of-evidence principle that solves the above two problems. We call it ‘the Comparative Value of Evidence for the Resolute (CVER).’ CVER not only generalizes VE to the comparative case but is also compatible with evidence externalism and nonclassical decision theories. Our argument, if successful, broadens the scope of the value-of-evidence principle and shows that it’s more robust than previously imagined. (shrink)

Philosophy of religion has been the object of penetrating critiques concerning its continued near-complete blindness to all but a single religion. The need for philosophy of religion to open up so as to include more than merely occasional and tokenistic treatments of ‘Other’ religions is clearly evident from the slew of recently published titles concerned with diversifying the field. In this light, a book such as Victoria Harrison’s Eastern Philosophy of Religion should surely come as a welcome (...) addition. And yet, unfortunately, this book turns out to be a case study in how not to diversify philosophy of religion in the twenty-first century. (shrink)

The epistemology of studies addressing questions about historical and prehistorical phenomena is a subject of increasing discussion among philosophers of science. A related field of inquiry that has yet to be connected to this topic is the epistemology of climate science. Branching these areas of research, I show how variety-of-evidence reasoning accounts for scientific inferences about the past by detailing a case study in paleoclimate reconstruction. This analysis aims to clarify the logic of historical inquiry in general and, by (...) focusing on a case study about climate change, it offers an epistemic account of a particular discipline that is of environmental and social importance. Many philosophers of science think scientific practice can benefit from philosophical concepts, and as such philosophy of science should play a direct role in science and engineering education. In this paper we consider a highly integrative course design strategy for integrating philosophy of science in specific disciplinary educational programmes through adaptation, operationalization and embedding of philosophy of science material to fit both the scientific and educational structure of a programme. The goal of the strategy is to help (...) encourage students to recognize the value of philosophical concepts to scientific decision making and to apply them in their own scientific practice. We use the example of a 7.5 ECTS civil engineering course which implements this design at a European technical university, to elaborate these concepts, and present some evidence on how students receive the course. We discuss some of challenges and limitations of implementing this kind of strategy for teaching philosophy of science. (shrink)

This paper presents an analysis of the forms of response that scientists make when confronted with anomalous data. We postulate that there are seven ways in which an individual who currently holds a theory can respond to anomalous data: (1) ignore the data; (2) reject the data; (3) exclude the data from the domain of the current theory; (4) hold the data in abeyance; (5) reinterpret the data; (6) make peripheral changes to the current theory; or (7) change the theory. The philosophy of superdeterminism is based on a single scientific fact about the universe, namely that cause and effect in physics are not real. In 2020, accomplished Swedish theoretical physicist, Dr. Johan Hansson published a physics proof using Albert Einstein’s Theory of Special Relativity that our universe is superdeterministic meaning a predetermined static block universe without cause and effect in physics. There are various grounds for objecting to Dr. Hansson’s version of superdeterminism, but none hold any water. The most (...) common objections are easily dismissed on the basis of the objector’s ignorance that Dr. Hansson’s version of superdeterminism is unique and not subject to the same objections faced by the version of superdeterminism originally put forth by Dr. John Bell. Other objections based on the Copenhagen interpretation of quantum mechanics can be dismissed, because Dr. Hansson’s version of superdeterminism disproves the Copenhagen interpretation and there is no direct evidence that the Copenhagen interpretation is true. Finally, a wide range of remaining objections can be dismissed for various specific reasons. (shrink)

Hegel's aim in this work is to interpret the varied phenomena of Nature from the standpoint of a dialectical logic. This article shows why it is important to do normative or practical philosophy of science, especially philosophy of science that criticizes and evaluates contemporary use of scientific methods to analyze welfare-affecting societal problems. The article introduces the scientific, ethical, and social problem of environmental injustice—disproportionate environmental and pollution threats that are responsible for roughly 40% of all preventable disease and death. Next it explains that many deadly threats continue in part because of “special-interest science”, methodologically flawed science that (...) is done to promote corporate profits, rather than truth, then argues that philosophers of science should use normative or practical philosophy of science to critique and expose special-interest science. To illustrate special-interest science, the article provides two case studies, on diesel-particulate-matter pollution and on organophophate-pesticide pollution, and shows how diesel and pesticide polluters use special-interest science. For instance, they often ignore observational data, illegitimately demand statistically significant evidence of harm from observational data, use small sample sizes, do the wrong tests, or demand certainty—rather than a preponderance of evidence—to justify a conclusion about pollution harm. They also use flawed normative arguments to defend both diesel and pesticide pollution. The article concludes that, given the epistemic, scientific, human-welfare toll of special-interest science, philosophers of science need to do normative or practical philosophy of science that exposes these scientific flaws. We live in an age alleged devoted to evidence-based medicine. Evidence-based medicine, however, depends on reliable data and if the data are largely, if not completely, manipulated by the manufacturer of pharmaceuticals, then the data are not reliable. Evidence-based medicine is an illusion. This book raises and attempts to answer the following questions: What are the ways in which the profit motive of industry undermines the integrity of science? How is science protected from corporate malfeasance in a (...) capitalist economy? Our particular focus is the relationship between the pharmaceutical industry and medicine. We argue that medicine desperately needs to re-evaluate its relationship with the pharmaceutical industry and re-affirm the ideal of evidence-based medicine. In our view, Karl Popper’s philosophy of science, Falsificationism and Critical Rationalism, provides a rigorous conception of science required to preserve the integrity of the scientific basis of medicine against the commercial influences. This paper examines the role of coherence of evidence in what I call the non-dynamic model of confirmation. It appears that other things being equal, a higher degree of coherence among pieces of evidence raises to a higher degree the probability of the proposition they support. I argue against this view on the basis of three related observations. First, we should be able to assess the impact of coherence on any hypothesis of interest the evidence supports. Second, (...) the impact of coherence among the pieces of evidence can be different on different hypotheses of interest they support. Third, when we assess the impact of coherence on a hypothesis of interest, other conditions that should be held equal for a fair assessment include the degrees of individual support which the propositions directly supported by the respective pieces of evidence provide for the hypothesis. Once we take these points into consideration, the impression that coherence of evidence plays a positive role in confirmation dissipates. In some cases it can be shown that other things being equal, a higher degree of coherence among the pieces of evidence reduces the degree of confirmation for the hypothesis they support. (shrink)

The central place which the concept of evidence or self-evidence has in Husserl’s philosophy puts him fully in the rationalist tradition. One of the criticisms which has been leveled against this tradition from several sides is that from the time of Descartes at least, it has conceived of consciousness solely as an observer of the world and not as a participant in it. In one fashion or another this tradition treats truth as founded on evidence for (...) consciousness, and this leads to such problems as Cartesian dualism with its “ghost in the machine,” or solipsism, either mundane or transcendental. Replicability is widely taken to ground the epistemic authority of science. However, in recent years, important published findings in the social, behavioral, and biomedical sciences have failed to replicate, suggesting that these fields are facing a “replicability crisis.” For philosophers, the crisis should not be taken as bad news but as an opportunity to do work on several fronts, including conceptual analysis, history and philosophy of science, research ethics, and social epistemology. Significant contributions to debates in the philosophy of evidence-based medicine (EBM) have come from a variety of different philosophical quarters, yet mainstream discourse in the field has been largely devoid of contributions from scholars working in the pragmatist tradition. This is a particularly conspicuous omission, given pragmatism’s commitment to the melioristic view that philosophy both can, and should, be about the business of concretely bettering the human estate. Two exceptions to this oversight come from Brian Walsh and (...) Maya Goldenberg. Unfortunately, in both cases, the misapplication of pragmatist thinking leads to the mistaken view that EBM is committed to some form of pernicious objectivism. This article aims to revise these pragmatist critiques in order to bring them more consistently in line with pragmatist values and commitments.
