Public policy tries to promote appropriate drug use by allowing firms to market drugs in interstate commerce only for uses that the Food and Drug Administration has found to be safe and effective. Because of their medical knowledge, physicians are authorized to prescribe drugs even for uses unapproved by the FDA. Nevertheless, physicians have relied on drug firms for information on appropriate prescribing despite the inherent tension between drug firm dissemination of information to promote sales and rational prescribing. In the (...) past, physicians often relied particularly on drug firm advertising for information on drug use. Today, physicians rely on drug firms to finance continuing medical education. SummaryAgainst the backdrop of the debates on the appropriate understanding of the Reformation in the context of the 500 year anniversary of the Reformation the attempt is made to elaborate the continuing promise of the Reformation with regard to the understanding of justice and freedom. The view of justice as a creative gift and the understanding of freedom as promise presuppose that the character of the Reformation can be understood as the reconfiguration of the traditional theological authorities. The understanding of (...) reality as rooted in the creative justice of God who alone is free because God is his own future is applied in the Lutheran art of making distinctions which relate God’s creative being and action to the created being and action of humans. The continuing promise of the Reformation is the discovery of this unconditional promise and of the way it is witnessed in the Church. As we write this paper in spring 2008, many are hopeful that November’s election will open the door to some form of comprehensive health care reform. In all likelihood, we will elect a president who has campaigned to a greater or lesser extent on promises of improving access to health care, improving quality, and reducing costs. Equally important, it seems likely that the 111th Congress is preparing to undertake meaningful health care reform. And perhaps most important, despite recent (...) attention to energy issues and the economy, opinion polls consistently show that the American public continues to rank health care as one of the two or three most important domestic issues in the fall elections and supports comprehensive health care reform. Irish legislative engagement with abortion law reform has never been framed by recognition of the rights of pregnant women, girls and other people. Rather, where it has taken place at all, it has always been foetocentric and punitive, exceptionalising abortion and conceptualising law as a means of discouraging it. In important ways, the post-repeal landscape has failed to break decisively with this orientation. While in 2018 there was certainly more discussion of women’s entitlement not to be exiled from the (...) country in order to make decisions about reproduction, the framing that dominated legislative and government discourses of abortion law reform was one in which the ‘problem’ being addressed was such that unsafe medication, exclusion from formal medical systems, and the undeserved punishment of people who had received diagnoses of fatal foetal conditions in the course of their ‘much wanted pregnancies’ were the focus. There was little or no engagement in legislative politics with the right to choose, reproductive agency, reproductive justice or the moral standing of pregnant people as ethical decision makers when it came to their pregnancies. As a result, post-repeal abortion law reform was more about managing risk than maximising agency. I will argue that this underpins and partly explains the shortcomings of the new law: the Health (Regulation of Termination of Pregnancy) Act 2018 (‘HRTPA 2018’). Within that new legal regime, I argue, pregnant people continue to lack decisional security when it comes to their reproductive lives and are exposed to significant constitutional and dignitary harms as a result. Attending cram school has long been a trend in ethnic Chinese culture areas, including Taiwan. Despite the fact that school reform policies have been implemented in Taiwan, cram schools have continued to prosper. Therefore, in this educational culture, how to achieve a good educational effect is also a topic worthy of discussion. However, whether students really engage in those tutoring programs provided by cram schools has seldom been studied. To address this gap, this study explored how parents’ hovering attitude (...) toward life and coursework influences their children’s engagement in cram schools. This study targeted those students who attend English cram schools to test the correlates between two types of helicopter parenting, tutoring engagement and continued attendance at cram schools. A total of 320 questionnaires were sent out, and 300 were returned, giving an overall response rate of 93.75%. Excluding seven incomplete or invalid questionnaires, 293 valid questionnaires were received. The results of this study show that hovering behavior awareness is negatively related to cram school engagement, whereas cram school engagement is positively related to the intention to continue attending cram school. Moreover, the results imply that parents should alleviate their helicoptering behavior to enhance their children’s engagement in cram school tutoring programs. (shrink)

Derk Pereboom and Gregg Caruso argue that humans are never morally responsible for their actions and take that thesis as a starting point for a project whose ultimate goal is the reform of responsibility practices, which include expressions of praise, blame, and the institution of legal punishment. This paper shares the skeptical concern that current responsibility practices can be suboptimal and in need of change, but argues that a non-skeptical pursuit of those changes is viable and more promising. The (...) main lines of the argument are developed by assessing the prospects of implementing one of the changes favored within the skeptical project (namely, the reduction of punishment severity) in light of how human moral psychology works. An original vignette experiment (N = 180; participants from Facebook groups related to Brazilian universities) asked participants to recommend sentences for a fictitious criminal after considering alternatives to regular punishment that varied in their effectiveness to prevent reoffending. The results suggest that people can become less punitive even if they continue to believe in moral responsibility and free will. The paper further argues that reforming responsibility practices is more likely to occur without the endorsement of skepticism. (shrink)

Johann Eck (1486–1543) has been introduced to modern scholarship as a prominent figure of the pre-Tridentine Counter-Reformation. As part of the curricular transformations of the University of Ingolstadt, he wrote commentaries on logical and scientific works by Aristotle and Peter of Spain. Utilising a variety of sources, the two volumes dedicated to physics and natural philosophy published in 1518 and 1519 were self-contained textbooks including annotated translations of the texts and quaestio-commentaries. These developed the doctrines of the Oxford Calculators mediated (...) through Continental sources, reproducing their conceptual and mathematical apparatus, including the famous middle degree theorem and Bradwardine’s law. In the 17th century Sir Francis Bacon advocated the patient study of Nature for the benefit of mankind. Most of science today, in its study of medicine, genetics, electronics etc., continues that pragmatic Baconian tradition without fuss. Over the years, however, as its investigation of Nature probed ever deeper into regions far removed from common experience, science has increasingly exhibited traits more usually associated with fundamentalist religion that with dispassionate study. Articulate voices from biology preach the belief in 18th century (...) materialism in the study of evolution; those from physics promulgate a kind of mathematical theology in its study of elementary particles and cosmology; both inveigh against heresy. But science should be beyond that sort of belief. It should not see its undoubted success in manipulating matter as justifying any sort of religious status, as offering a spiritual foundation alternative to religion. As a scientist himself, Brian Ridley is appalled by such theological trends, hence this book. It is an attempt to address these concerns, to reform science, to place science in its broad historical and philosophical context where dogmatic belief has no place, to remind science itself that it has limitations. Herodotos gives him a political motive in outline, that he brought the people over to his side because he had been defeated in a struggle for power against Isagoras ; and in resuming this proposition after a digression he describes the Athenian people as . But he (...) gives us no clear insight into the nature or mechanism of the struggle with Isagoras, and in particular he does not say that the latter's election to the archonship in 508 constituted his victory, though the dating of the reform to the archonship of Isagoras makes that highly probable; nor does he explain in what sense or by whom the Athenian people had been ‘previously excluded’. Decolonisation discourse has gained significant momentum in South Africa with the rise of the various #MustFall movements that strive to rid South Africa of its colonial vestiges. But does South Africa need another national metanarrative that envisions an ideal South Africa and champions utopian social ideals? Following the logic of Johan Degenaar and Dirkie Smit, this contribution argues that we should refrain from developing social meta-narratives that seek to frame a single South African identity and social ethos. However, we do (...) need a grammar for peaceful coexistence that goes beyond legal and procedural considerations to establish basic parameters for a constructive social discourse that promotes peaceful coexistence. Such a grammar cannot be imposed unilaterally on social groupings but should be framed by a public discussion aimed at reaching a consensus among social imaginaries on the rules of discourse. Drawing on Reformed thinkers such as John Calvin and John Althusius, the essay continues to discuss the contribution that the Reformed tradition can make to such a grammar. The last part of the essay proceeds to apply the proposed grammar as a benchmark to evaluate the validity of decolonisation discourse. (shrink)

This article assesses the peculiar condition of being `after' theory. Any attempt to better understand why theory now haunts contemporary intellectual practice more than it challenges it must make use of the archive of feminist theory's critical distance with poststructuralism. In fact, feminist theory's traditional concern with the possibilities of/for agency gives us the most useful framework for assessing both the in/adequacy of theory and the in/adequacy of any `after theory' return (whether to aesthetics, intentionality, universalism, liberalism, the literary, etc.). If the question of agency puts pressure on theory's shortcomings, and the continued failure to locate agency within a constructivist framework gives legitimacy to regressive returns, then a more sustained discussion of agency is urgent. In turn, locating agency requires, philosophically and critically, a recuperation of `experience' as a way of knowing. If it can be argued that the constructive process is what occasions experience, and experience, finally, is the site of agency, then we can theorize the `how' of agency without relying on externalized positionalities (which are phenomenologically untenable). Finally, if, politically speaking, the failure to locate agency leaves us oscillating between the avowal and disavowal of reform, then a sustained discussion of agency promises to take us `beyond reform' altogether. ABSTRACT: This article analyzes the relation between Godwin (1756-1836), Republican and author of Politcal lustice (1793), and French philosophers, particularly Helvetius. Both Godwin and Helvetius were in favour of a political understanding of the theory of knowledge as opposed to an intellectual treatment of policy. They continually questioned the links between policy, history of the human understanding, and moral science from the perspective of the question of education. After the September Massacres (1792), Godwin’s thought changed radically and began to revolve (...) around the notion of perfectibility. The final disagreement marked a distinction between French reformers, who advocated state control, and English writers, influenced by dissent and reformation, who held the idea of perfectibility.RÉSUMÉ: Cet article examine le rapport de Godwin (1756-1836), écrivain anglais «jacobin», auteur de Political Justice (1793), aux philosophes français, Helvétius en particulier. Partisans d’une politisation de la théorie de la connaissance plutôt que d’une intellectualisation de la politique, ils interrogent sans cesse, via la question de l’education, les liens du pouvoir politique, de l’histoire de l’entendement humain etde la science morale. The Protestant Reformation is one of the greatest turning points in the history of Christianity. In some senses, it is described as a ‘theological revolution’ which led to the emergence of the Protestant movement and the separation of the Church. This research explores some of the theological themes that became the turning point of Christianity. These themes are sola scriptura, sola fide, sola gratia, solus Christus and Soli Deo Gloria. This article attempts to briefly explore these essential theological principles of (...) the Reformation and assess its relevance for today in light of new realities, encounters and theological developments. It pays particular attention to the realities of the Global South, mainly South Africa, and shows how these can form a basis for renewal and transformation of Reformed theology and practice today. In this sense, the article establishes that the ‘theological revolution’ continues into the 21st century bringing about ecclesiastical, social and cultural change. (shrink)

An in-depth analysis of the recent reform in Italian psychiatry reveals that the relevance of these changes transcends national borders. However, these changes are, from the scientific point of view, worth much more than mere biased pragmatic interest. The reshaping of theory made possible by the transformation of Italian psychiatry in fact opens up new prospects for a scientifically founded form of psychiatric care. Thanks to the new Mental Health Act (No. 180 of 1978),2 it has been possible to (...) set up a type of administrative and institutional organization in which the psychiatric hospital no longer constitutes a functional part of the structures of psychiatric care. This reform thus provides the launching path for a real alternative where current psychiatric ideas and working methods can no longer be accepted as the gospel truth. This paper discusses how a correct problem-definition of psychiatric admission can provide a basis for a correct approach to psychopathological behaviour in a setting where the psychiatric hospital has no role to play and for the consolidation of this new practice. Kennedy offers an account of the desacralization of politics in the West by critically examining the works of five central figures in the (...) Protestant Reformed tradition: John Calvin (1509–64), Richard Hooker (1554–1600), Johannes Althusius (1557–1638), Thomas Hobbes (1588–1679), and John Locke (1632–1705). He dedicates a chapter to each thinker. The core of Kennedy's thesis is that desacralization is the result of a shift in the way modern thinkers like Hobbes and Locke reimagined the nature of natural law. The medieval tradition, having found its fullest expression in the work of St. Thomas Aquinas, saw natural law as one of four different types of law: eternal law (the eternal plan of creation in the mind of God), natural law (the rational creature's participation in the eternal law), human law (civil laws that are derived from the natural law), and divine law (the Old and New Testaments). According to Kennedy, the eventual desacralization of politics was set in motion with the development of arguments for natural rights that relied on a natural law that was in [End Page 553] practice severed from eternal law. But in that case, our political institutions—which are founded on the natural law—are purely human constructions and thus entirely secular.The usual story is that the Protestant Reformation constituted the decisive break with the medieval tradition and that it was the political theology of the reformers and their immediate successors that made the secularization of politics nearly inevitable. Kennedy wants to push back against that story. He argues, quite convincingly, that Calvin, Hooker, and Althusius, all Reformed Protestants, were in continuity with their medieval predecessors. Although Calvin is often depicted by his contemporary followers—especially among American Evangelicals—as hostile to the natural law tradition, Kennedy marshals an impressive case that shows that classical natural law seemed almost second nature to Calvin. My own sense is that the confusion over Calvin is the result of his contemporary readers expecting him to use the vocabulary of an Aquinas or a Duns Scotus. But not finding that vocabulary, they conclude that he rejected the natural law. Kennedy dispels that confusion by showing that Calvin in fact was fully committed to the four types of law absent the technical jargon of medieval scholasticism.Hooker and Althusius, writes Kennedy, continue in that tradition, though with a bit of a twist that some argue portends to Hobbes and Locke. Hooker and Althusius use the language of contract to account for the origin of certain aspects of political life. But Kennedy insists that it is a mistake to interpret them as proto-contractarians (as one finds in Hobbes and Locke), for they still held that the natural law participates in the eternal law, and that any agreements employed in the service of political life are under the authority of, and guided by, the natural law. One could argue, then, that these "contracts," like constitutions and treaties, are nonstatutory manifestations of the human law, which is perfectly consistent with classical natural law. So like Calvin before them, Hooker and Althusius were, as Kennedy puts it, theistic political naturalists.Hobbes and Locke are a different story. ABSTRACTThe health‐care reform promised by the Patient Protection and Affordable Care Act of March 2010 continues our dependence on a central feature of the American health‐care system: employer‐sponsored insurance . In this article I will criticize the assumptions regarding market and welfare concerns on which this dependence is based and argue that efforts to mandate ESI ignore both the dynamics of the employment relation and the nature of health‐care needs. A comparison between investing in employee education and investing in (...) employee health will reveal the pragmatic challenges to ESI and the covert appeal to employer beneficence on which ESI rests. This paper argues that relying on ESI to guarantee appropriate care for a significant segment of the population is undesirable and unsustainable from both market and moral perspectives. (shrink)

This second collection of essays for the Societas series by Tom Rubens continues the author’s discussion of contemporary issues contained in "Progressive Secular Society". The present book is divided into three main sections. The first deals with social, economic and cultural issues; the second with topics which are essentially philosophical; and the third with themes which are chiefly literary. Throughout, the viewpoint expressed is that of secular humanism.

I examine Kant’s claim in part one ofReligion within the Boundaries of Mere Reasonthat moral reform requires both a ‘change of heart’ and gradual reformation of one’s sense (R,6: 47). I argue that Kant’s conception of moral reform is neither fundamentally obscure nor is it as vulnerable to serious objections as several commentators have suggested. I defend Kant by explaining how he can maintain both that we can choose our moral disposition via an intelligible choice and that we (...) become good through a continuous struggle. This chapter provides an overview of the historical background as well as philosophical outlook behind the twentieth-century Confucian thinker Liang Shuming’s 梁漱溟 (1893–1988) engagement with the movement for “rural reconstruction” (xiangcun jianshe 鄉村建設) which took off during the 1930s in Republican China. After situating Liang’s turn toward the countryside and his activities in Shandong province as leader of the Institute for Rural Reconstruction in their broader socio-political context and his own trajectory as an intellectual and reformer, I describe and analyze (...) the complex constellation of cultural, historical, social, political, and economic elements in his 1937 Theory of Rural Reconstruction (Xiangcun jianshe lilun 鄉村建設理論). In doing so, I pay particular attention to the relation between Liang’s idiosyncratic reinterpretation of premodern China’s social order as grounded in an affirmation of “reason” (lixing 理性) and his vision for a form of “national self-awakening” (minzu zijue 民族自覺) rooted in the countryside as a place where the traditional Confucian primacy of “ethical relations” (lunli 倫理) has supposedly been preserved. In conclusion, I argue that Liang’s idea of rural “collective life” (tuanti shenghuo 團體生活) as the basis for a wholly new form of society counts as a non-state-centered approach to modernization which continues to resonate in contemporary postrevolutionary China. Children’s literature was first published in the eighteenth century at a time when the philosophical ideas of Jean-Jacques Rousseau on education and childhood were being discussed. Ironically, however, the first generation of children’s literature (by Maria Edgeworth et al) was incongruous with Rousseau’s ideas since the works were didactic, constraining and demanded passive acceptance from their readers. This instigated a deficit or reductionist model to represent childhood and children’s literature as simple and uncomplicated and led to children’s literature being overlooked (...) and its contribution to philosophical discussions being undermined. Although Rousseau advocates freeing the child to develop, he does not feel that reading fiction promotes child development, which is a weakness in an otherwise strong argument for educational reform. Yet, rather ironically, the second generation of children’s writers, from Lewis Carroll onwards, more truly embraced Rousseau’s broader philosophical ideas on education and childhood than their predecessors, encouraging and freeing readers to imagine, reflect and actively engage in ontological enquiry. The emphasis had changed with the child being embraced in education and society as active participant rather than passive or disengaged recipient. Works deemed to be seminal to the canon of children’s literature such as Alice’s Adventures in Wonderland, Peter Pan and The Chronicles of Narnia challenge readers to work through conflicts many of which can be identified retrospectively as exhibiting postmodern characteristics. By exploring moral and spiritual dilemmas in their writing, Carroll, Barrie and Lewis’s works can be regarded as contributing to discussions on theodical postmodernism. The successes of The Lord of the Rings and Narnia films suggest that there is an interest in exploring moral dilemmas, fulfilling a need (perhaps for tolerance and understanding) in society at large. Children’s literature has an almost divine power to restore, to repair and to heal, all characteristics of theodical postmodernism but differing from the more widely held conception of postmodernism which pulls apart, exacerbates and exposes. Children’s literature therefore offers a healthy and constructive approach to working through moral dilemmas. In their deconstruction of childhood, these authors have brought children’s literature closer to aspects of enquiry traditionally found in the domain of adult mainstream literature. As the boundaries between childhood and adulthood become more fluid, less certain, debate is centring around whether the canon of children’s literature itself has become redundant or meaningless since there are no longer any restrictions on which subjects can be treated in children’s literature. Despite the fact that children’s literature clearly engages with difficult issues, it continues to be left out of the critical equation, not given serious attention, disregarded as simplistic and ignored in contemporary philosophical discussions concerning morality, postmodernism and the future of childhood. With children’s literature coming closer to mainstream literature, and exhibiting prominent features of postmodernism, however, it is only a matter of time before philosophical discussions actively engage with children’s literature and recognise its contribution to the resolution and reconciliation of ontological dilemmas. When this occurs, philosophy and children’s literature will re-engage, enriching contemporary investigations of existence, ethics and knowledge and fruitfully developing thought in these areas. Kelly, Gerard The tumultuous events of the sixteenth century irrevocably changed the shape of the Western Church and thus Christianity more generally. The division that ensued affected not just the institutional life of the church, but also towns and villages, families and neighbours. For generations, people lived with the consequences of this division, often within the intimacy of their own family life. Fortunately, this has changed. The twentieth century is rightly referred to as the ecumenical century. We are able to (...) point to milestones on the way to unity, beginning with the Edinburgh Missionary Conference in 1910, and then the First World Conference on Faith and Order in 1927, and the formation of the World Council of Churches in 1948. After the conclusion of the Second Vatican Council in 1965, the Catholic Church began to participate in ecumenical gatherings. Its entry brought a new way of ecumenical dialogue, and the era of the bilateral dialogue began, alongside the existing multilateral dialogue. Today the Catholic Church at the international level has been and/or continues to be in dialogue with the Anglican Communion, the Lutheran World Federation, the World Methodist Council, the World Alliance of Reformed Churches, the Baptist World Alliance, the Disciples of Christ, Pentecostals, Evangelicals, and three families of Eastern and Oriental Orthodox Churches. In Australia the Catholic Church is currently engaged in dialogue with the Anglican Church, the Lutheran Church and the Uniting Church. The Catholic Church participates in a multilateral way through both the Joint Working Group with the World Council of Churches and as a member of the Faith and Order Commission of the World Council of Churches. The beatific vision is widely perceived as a Roman Catholic doctrine. Many continue to view deification as a distinctively Eastern Orthodox doctrine incompatible with the Western theological tradition, especially its Protestant expressions. This essay will demonstrate that several Reformers of the first and second generation promoted a vision of redemption that culminates with deification and beatific vision. They affirmed these concepts without apology in confessional statements, dogmatic works, biblical commentaries, and polemical treatises. Attention will focus on figures in the Reformed (...) tradition though one could produce similar surveys for the Lutheran and Anglican branches of the Reformation as well. John Calvin will receive extended treatment because some scholars dispute whether he affirmed deification. This essay presents important evidence thus far overlooked which should settle the question. There has been a backlash from recently graduated proponents of the Dutch Reformed Church of South Africa that they are unemployed not just because of dwindling church member numbers, but mainly because contract posts are being filled by retired ministers and not by the proponents. International research suggests that the reason retired ministers continue working is not necessarily because they want to, but because they do not have sufficient retirement savings. The aim of this study was to examine the perceptions (...) of Dutch Reformed ministers who would reach retirement age within the next 5 years, in an effort to establish their preparedness for retirement. The respondents were sent a link to an online questionnaire and 147 useable questionnaires were returned, representing a response rate of 47.7%. The results indicated that almost half of the respondents stated that they would want to continue working in a part-time ministerial post after retirement and that the ministers’ motivation to continue working was directly linked to their lack of financial provision for retirement. A major cause for concern is the high number of respondents who selected the ‘uncertain’ response option for most of the retirement questions, as they are so close to retirement. An intervention to incorporate financial management specifically in theological training is urgently needed. (shrink)

While it cannot be denied that the 16th-century Reformation, which challenged papal authority and questioned the Catholic Church’s ability to define Christian moral practice in a just manner, indeed came with deep and lasting political changes, it remained a male-dominated discourse. The Reformation was arguably patriarchal and points to a patriarchal culture of subordination and oppression of women that prevailed then and is still pertinent in the church and all spheres of society today. The absence of Elmina and the silenced (...) yet loud voices and cries from the female dungeons below a Dutch Reformed Church in the upper levels of the castle in the retelling of the narrative of the Reformation leaves much to be desired and has a bearing on how black women perceive the Reformation 500 years later. The article thus problematises the Reformation through the heuristic eyes of Elmina Castle in Ghana as the genesis of the ‘dungeoning’ of black women justified by faith. The article argues that black women are reformers from the dungeons following the historical experience of reformation and the Reformed faith as racist and sexist, among other ills experienced by blacks in the Global South, with black women literally kept in the dungeons below a Reformed Church building as they were in Elmina with a biblical inscription, Psalm 138, on the threshold of its main door. This article thus points to irreconcilable contradictions maintained by the Reformed faith that continues to bury black women in the ‘dungeons’ even today. The enfleshment of black bodies in the dungeons of the Elmina Castle underneath a Reformed Church building is seen as the historical and heuristic starting point of engaging Reformed faith from a womanist perspective. Prof. W.A. Dreyer played an important role in the continuous reformation of the Nederduitsch Hervormde Kerk van Afrika (NHKA). This contribution to his Festschrift is not about him. He would not want that. It is about the church and how his understanding of reformed ecclesiology became the basis on which the transformation from ‘ Volkskerk ’ to missional church took place. According to himself, that was his calling and his life’s work. The importance of his contribution cannot be understood without (...) the historical background in which it played out. Neither is it possible to envisage what really happened without acknowledging the theologians who played an important part in his life. This article therefore starts with a short overview of the history of the NHKA. It then proceeds with an overview of how important theologians in the NHKA influenced his ecclesiology. It concludes with three specific contributions that Prof. W.A. Dreyer made which makes him a key role player which led the NHKA on the way of Ecclesia reformata semper reformanda. Contribution: Prof. W.A. Dreyer became an important church leader in the Netherdutch Reformed Church. His leadership resulted in important changes in the church and especially in the ecclesiology of the church. This article, which is part of his Festschrift, gives an overview of his theological contribution through the lens of semper reformanda. Anglicanism's relationship with its Reformation heritage represents a tension. It looks to the Reformation as the movement from which an English Church, independent of papal authority, was inaugurated. At the same time, it refuses to be labelled as a “church of the Reformation”, pointing to its continuity with a much longer history of Christian practice in Britain. The growth of the Anglican Communion and current controversies over church order, the interpretation of scripture and the exercise of authority make Anglican (...) identity difficult to define. Identity would once have been sought in liturgy, but the view that liturgy completely enshrines Anglican doctrine has been convincingly put to rest by scholarship since the 1970s. This paper argues that the liturgical legacy of the Reformation offers categories that can help to form possible approaches to the current crisis of Anglican identity. (shrink)

This paper explores the dynamics of security sector reform (SSR), a term used to refer to efforts made to reform the security structures of states emerging from conflict or authoritarianism. While "local ownership" is increasingly viewed as a necessary element of any sustainable SSR strategy, there remains a significant gap between international policy and practice in this area. In practice, the SSR agenda continues to be driven largely by international actors, with minimal input, let alone ownership, on the (...) part of either governments or civil society within reforming states. Indeed, the notion of local ownership has come to serve as much as a disciplining mechanism as a tool to overcome exclusion in the making and execution of security policy, and the effectiveness and sustainability of SSR programming have suffered as a result. In light of this, the paper will explore both the potential for, and the limits of, rehabilitating the notion of local ownership to enable more participatory forms of SSR, and argues that any practical local ownership strategy requires a dual policy of negotiating with state actors and engaging with non-state actors. This is a sequel to the author's The Language and Logic of the Bible: The Earlier Middle Ages. The period of the reformation saw immense changes of approach to the study of the Bible, which in turn brought huge consequences. This book, seeking to show the direction of endeavour of such study in the last medieval centuries, examines the theory of exegesis, practical interpretation, popular Bible study and preaching, and looks especially at the areas of logic and language in which (...) the scholars of the period had considerable expertise. The condemnation of the scholastics has tended to sink with them a proper recognition of what they achieved. In looking forward to the reformation, Dr Evans demonstrates a greater continuity of attitude than has often been allowed and describes how the enquiries of later medieval scholars opened out into the explorations of the sixteenth century made by Protestant and Roman Catholic thinkers alike. Herman Bavinck (1854–1921), the Dutch master of dogmatic theology, wrote a systematic treatise in theological ethics. Bavinck is a theistic moral realist whose ethics is deontological and virtue centered. His realism—both ontological and epistemic—is reflected in his understanding of conscience and its relation to the objective moral law. Furthermore, this review article discusses issues in Christian anthropology, particularly the selfhood of the human person, the relation between nature and grace, creation and redemption, and philosophy and theology, and the distinction between (...) objective and subjective religion. It concludes with a brief reflection on Bavinck’s hermeneutics of renewal and reform in the continuity of the catholicity of the Reformed tradition. (shrink)

The past three decades have seen a decline in traditional industries in the United Kingdom and there has been a relative decline in the value of physical assets to the UK economy. At the same time, the value of intangible assets seen in intellectual property rights have increased considerably. As such, IP rights represent important assets for companies and often comprise the foundation for market dominance and continued profitability. There is a structural uncertainty in the law relating to the use (...) of IP as collateral for the purpose of raising debt finance and this may impact upon the survival of firms with high ratios of intangible to tangible assets. This article considers the proper goals for an effective credit and security regime in IP. It examines the significance of the availability of collateral to the lending decision and also considers whether the reluctance to maximise the use of IP as security reflects inherent difficulties which arise out of the nature of IP as economic assets. This has implications for the reform of English personal property security law and the development of bright line priority rules associated with Article 9 of the US Uniform Commercial Code which is often cited as a model for reform of English law. The health care industry has moved at a rapid pace away from paper records to an electronic platform across almost all sectors — much of it at the encouragement and insistence of the federal government. Such rapid expansion has increased exponentially the risk to individuals in the privacy of their data and, increasingly, to their physical well-being when medical records are inaccessible through ransomware attacks. Recognizing the unique and critical nature of medical records, the United States Congress established the Health (...) Care Industry Cybersecurity Task Force under the Cybersecurity Information Sharing Act of 2015 for the purpose of reviewing cybersecurity risks within the health care industry and identifying who will lead and coordinate efforts to address such risks among the various agencies. The Task Force has since issued a report setting forth six high-level imperatives that the health care industry needs to achieve in order to combat cybersecurity, and, notably, many of the vulnerabilities plaguing the industry identified in the Report as requiring correction are not necessarily related to specific flaws in the current cybersecurity framework, but rather susceptibilities presented by the infrastructure and associated regulatory regime that has evolved over the last few decades over the health care industry generally. That is, the current health care infrastructure by its nature exacerbates cybersecurity risk. Between a lack of information sharing of industry threats, risks, and mitigations, disparate leadership and governance goals for cybersecurity, the confluence and contradiction of existing federal and state laws, fragmentation in the fee-for-service delivery system, lack of care coordination, and disparate resources across and among sectors, the industry suffers from heightened cyber risk. Solutions that are reactive to problems within the current infrastructure will likely have little long term impact toward reducing cybersecurity vulnerabilities because they do not address the underlying system challenges. All of these confluences causes one to wonder whether if in fact the current health care delivery infrastructure is a contributing factor to the incidents of cybersecurity attacks and the exorbitant costs associated with resolving data breaches, should Congress look not just to curb breach incidents, but to address root cause systematic challenges in the health industry infrastructure that create increased exposure of cybersecurity threats? This article argues that cybersecurity risks will continue to be heightened and more costly to the health care industry as compared to other industries unless and until some general system redesign is achieved that allows for greater sharing of resources among industry participants to ensure the same protections are implemented at all levels of the industry, which can be strengthened through greater interoperability of systems across the health care industry; and increased focus and attention on the importance of cybersecurity issues as a priority among system reforms. From the 1960s, the focus shifted to questions of social deprivation and educational opportunities, secondary school selection, the debate on standards, Robbins and higher education, and the continuing theme of the (...) dominance of public schools. The book is divided into four sections, which are then divided into chapters. Each chapter takes as its main reference point a key issue within the chronological framework of the book, e.g. resistance to secondary education for all, politics and textbooks, multilateral and technical schools, pressure groups and the 1944 Education Act, Churchill and the Conservatives. We are never illness or disease, but, rather, always their sum in the world of day-to-day experience. Disease and illness are not closed systems, but mutually constitutive and continuously interacting worlds. In the patient’s case it is always experience as well. Pain, sickness and death help make that particular experienced identity unavoidable, and at some level ultimately inaccessible to medicine’s changing understanding of disease and tools for managing it. Health—rather than cost containment, specific conditions, or technologies—should be the central focus (...) for health care and health-care reform. In this paper, I explore the concept of applied Islamic ethics, the facts, its challenges, and its future. I aim to highlight some of the deep-rooted issues that Muslims have faced historically and continue to experience today as they apply religious guidance to their daily lives. I consider the causes and rationale behind the current situation and look beyond to suggest ways in which this may evolve, calling for a radical reform. Muslims throughout the world are experiencing a deepening (...) crisis of identity and confusion about their faith's principles and practices. I suggest how improvements might be achieved, in order to gain more coherence and understanding. This approach recognizes the importance of inviting an in-depth, deliberate analysis of relevant dialogues between religious experts of the text (scholars) and practitioners, those working at the grassroots. This approach remains faithful to the fundamental principles of the Islamic sources but also considers our present context. I recommend a shift in authority from scholars alone to a more inclusive, critical engagement of practitioners. Through this more comprehensive methodology of applied Islamic ethics, I suggest that Muslim communities, organizations, and individuals can remain faithful to their religious principles while, at the same time, actively participating in and contributing to our evolving societies. While I recognize that this will be a long process, I am confident that with applied Islamic ethics, the current feelings of confusion, self-doubt, and even apathy, given the previous failed processes of adaptation and reform, will give way to a new confidence in knowing how to address contemporary challenges. Looking back at the reception of Kant's philosophy in the twentieth century, it is striking to see how many philosophers tried to enlist Kant in their campaigns to "overcome" and "eliminate" metaphysics. Twentieth-century Kant scholars often shared their contemporaries' hostility to metaphysics, especially the "dogmatic" rationalism of Leibniz and Wolff. These attitudes can still be found within the discipline and among Kant scholars, but much has changed in the last thirty years. Andrews, Robert M A way of dealing with historical episodes, the consequences of which continue to challenge us, is to ask a counterfactual-a 'what if?' question. Martin Luther's life, his critique of the Catholic Church, his challenge to the social and political hegemony of European Catholicism, the resultant splintering of an ecclesial unity assumed by the medieval mind to be practically impenetrable, is one such historical episode. My counterfactual is as follows: What would have been the consequences to European Catholicism (...) had Luther not rebelled against the church? As this article will later discuss, Luther famously spent many hours in the confessional during his time as an Augustinian friar. Luther's superior, spiritual guide, and confessor, Johann von Staupitz -whose motto was 'I am yours, save me'-often assured Luther that his sins were forgiven, that Christ's work had been done, and that he consequently had no need to despair of the mercy of God. It was advice that Luther ultimately found unsatisfactory. 'I did not love, no, rather I hated the just God who punishes sinners', Luther famously said in 1545, reflecting on his time as a monk, articulating a conscience that found solace only outside of Roman communion. One of the central issues in comparative law and political economy is whether the forces of globalization will result in the convergence of public policies across countries. Noting in particular that taxes collected still cover a considerable range across industrialized countries — from a low of 20% of GDP to a high of 50% — some have argued that globalization has not resulted in a loss of tax sovereignty. However, following a review of the evidence, in this Article we conclude (...) that globalization has had significant but subtle effects on tax levels and structures. Moreover, these pressures will make it increasingly difficult for countries to raise revenue to finance new public needs and to structure their tax systems in order to achieve a more socially acceptable distribution of income than what market forces dictate. Tax levels in most countries have remained essentially flat over the past twenty years, but there is a host of reasons for thinking they would have continued to rise were it not for the pressures of globalization. Statutory corporate tax rates have declined dramatically and, although corporate tax revenues have remained robust, this has been due to factors unrelated to deliberate tax policy choices. Personal marginal tax rates have also declined sharply and tax revenues have been increasingly raised by regressive consumption taxes. These trends stem from tax competition brought on by the forces of globalization, not from changing ideas or other political variables. In this Article we conclude that in order to prevent tax competition from completely eroding the ability of countries to fashion their own tax systems, there will have to be considerable cooperation among the major countries and some harmonization of aspects of their tax systems, particularly as they apply to footloose factors of production. Racial divisions, polarisation and tensions are on the rise in South Africa today. A democratic dream of a rainbow nation remains just a dream with racism continuing to raise its ugly head in the democratic South Africa, to the detriment of the rainbow dream of a united South Africa. This article seeks to probe whether South Africans should continue to sing the song of racial reconciliation in the light of the continued racial tensions and post-colonial and post-apartheid legacies and stereotypes (...) that continue to manifest in our private and public spaces. Based on an examination of the decoloniality project, Africanisation and Reformation, through literature study, the article calls for the decoloniality of faith in an effort to craft a vision for a non-racial society. This vision not only takes the importance of the redeeming memories of the 500 years of Reformation seriously, but also the notion of Africanisation and, in particular, the use of the African value systems in shaping and reconstructing a non-racial South Africa. This article taps into the resourcefulness of the Reformed faith in South Africa, as articulated in the theologies of Snyman, Tshaka and Botha, and applies them to South African discourses of decoloniality. Theoretically, this study is framed within the semiotic tradition of communication theory, which theorizes communication as the intersubjective mediation by signs. Methodologically, this study is guided by Peirce’s semiotic ideas, especially his writing about the commens and commind, or the sign and the object, and the power of a community as the final interpretant performing the process of sensemaking. Results showed how the survivors of a natural calamity symbolically interacted with such calamity, and how this led to a reformation of (...) the way they view themselves and the world. The survivors’ symbolic images captured in narratives, in sketches and drawings, and in poetry helped them to reframe their sense of self and their worldview by believing in common sense and intuition, and by valuing the power of courage, initiative, preparedness, hope, and resilience. An unfortunate irony emerged in their symbolic interaction with the disaster such that their sinning and self-inflicted blame made them think they were worthy of punishment. Nonetheless, this unfortunate irony will change if the survivors continue to reflect on their civic roles, interrogate their environmental and political contexts, and expand their awareness and social consciousness. As these unfold, the survivors will be able to accomplish empowerment, emancipation, and an independent mind. (shrink)

This contribution revisits the priesthood of believers. It is placed within the current discourse on relevant ecclesiologies and ecclesial praxis for 21st-century reformed churches. Luther placed much emphasis on the priesthood of believers in his rejection of the Roman Catholic differentiation between ordained clergy and laity. This was taken up by Calvin, but not to the same extent as Luther. The limited attention given to the priesthood of believers in reformed ecclesiologies, confessions and church orders is challenged in the current (...) discourse on ecclesiology, especially by theologians working in the field of missional ecclesiology. Much emphasis is placed on the role of the ‘ordinary’ church member in terms of ministry. It is proposed that a continued reformation of the church would inter alia imply a renewed appreciation of the priesthood of believers. The shift in ecclesiology must be visible in reformed church polity and church orders. The interrelatedness of ecclesiology, church polity, church order and ecclesial praxis makes this unavoidable. A church order should not be regarded as an immutable historical document with everlasting authority, but rather as an instrument that could facilitate change and ecclesial praxis in the spirit of ecclesia semper reformanda. As such, church polity could even be regarded as a ‘practical ecclesiology’. Recent changes to the Church Order of the Nederduitsch Hervormde Kerk van Afrika are used as a case study and to illustrate the point.Contribution: The primary contribution of this manuscript contributes to the historical and systematic analysis of the concept ‘priesthood of all believers’, as well as its relevance to the current discourse on missional ecclesiology. This essay explains Luther's understanding of justification by faith and how this doctrine shaped his understanding of the use and abuse of reason in the academy and in the community. In particular, this paper will sketch how Luther's vision of the roles of faith and reason reformed the academy's understanding of philosophy, science, and political theory and how this vision continues to transform contemporary discussions in philosophy, science, ethics, and ecclesiology.

In this roundtable discussion, early-career researchers working in the field of law, gender, and sexuality discuss international and trans-national developments to legal gender. ‘The Future of Legal Gender’ research project focused on the legislative framework of England and Wales to develop a prototype for decertification. The domestic legislation, however, was situated within a wider international context throughout the project. This roundtable discussion, therefore, provided an opportunity for reflection on the transnational issues raised by decertification, with a particular focus on developments (...) arising in the jurisdiction(s) studied by the early career researchers. The roundtable began with a brief outline of these recent developments before moving to an open discussion on key themes including the value of reform on wider society, changes on-the-ground by non-state actors, and alternative processes for tackling gender inequalities without certifying legal gender. This article places Angela Davis’s analysis of why the modern individual trends towards self-isolation in conversation with Alexis de Tocqueville’s competing account in Democracy in America. I argue that Davis misidentifies the problem of isolation as a ‘systems problem’, rather than as a ‘people problem’ (as Tocqueville implies), and that she underestimates the extent to which people’s self-understanding can evolve within the capitalist system. She argues that women’s oppression is a consequence of the isolation which emerges under capitalism, so she (...) believes that the overthrow of capitalism is required to overcome it. Yet much progress in redressing women’s oppression has been achieved within capitalism as a result of its recent troubles. Accordingly, I suggest that Tocqueville offers a plausible theory of reform that can help feminists continue to rectify women’s oppression within the capitalist system. Specifically, feminists should heed Tocqueville’s counsel, that smart institutional interventions can help reform how people understand themselves, and focus on designing policies which can encourage people to move away from the belief that women are more naturally suited to domestic labour than men. The practice of the black church being a follower of the leading white church is a continuous process in the Gereformeerde Kerke in Suid Afrika. This makes it difficult to contextualise Reformed Theology to address African challenges and problems. There are many reasons for the subordination of the black theologians, but for the sake of this article, I identified the issue of sustentasie1 as one of the causes. The lack of financial independence implies that the black church2 cannot determine their (...) destiny by revising, transforming and even Africanising their theology to fit into their context and challenges, since that would mean they are biting the hand that feeds them. This article will argue that it is time that Africans stop being a theological duplication of the Western theologies and that they take responsibility to ensure that their theology addresses the immediate situation of the Black Reformed people with or without the support from the white church. The ineffectiveness of some elders and deacons of Maranatha Reformed Church of Christ to implement their functions and duties contributed to the deterioration of the spiritual and material sustainability of the church. To counteract this corrosion, the church established a training team that instituted an informal programme as a means of revitalising elders and deacons. After running a pilot project to test the training programme, the team presented its report to the General Church Assembly. A selective interpretation of informal education (...) can contribute to a misguided and limited perception of informal knowledge and acquisition as uncivilised and unsustainable. In this article, the researcher seeks to articulate the formal and informal dynamics of informal education. He employed an exploratory concurrent design of mixed methods research within an indigenous paradigm to analyse the report on training of elders and deacons. The researcher used a convenience sampling strategy to select the authors of the report, namely four trainers and four trainees, with whom he conducted a focus group discussion. Although strategically formulated, the learning activities and resources were continuously innovated in the informal programme for elders and deacons. The conclusion reached is that the learning process in informal education is flexible and mutually edifying for educators and trainees.Contribution: Education for the proclamation of the gospel and church governance is not intended exclusively for ministers or theologians. Despite their diversity, elders and deacons need to be educated on the proclamation of the gospel according to the teachings of their church, using their respective contexts. Informal education, which comprises formal and informal dynamics, can contribute towards addressing the problem of untrained elders and deacons. (shrink)

This article aims to elaborate the effects of Ghazan Khan’s reformative measures for changing Mongol lifestyle. They migrated from one place to another to make a living but after his reforms, they were settled. Mongols were among the people who lived in the Central Asia usually made raids on the neighboring nations. They had taken to a life of vagrancy and never wanted to be settled in a particular place. When they entered the civilized Persia, the Mongolian government became highly (...) polarized. On the one hand, the Mongols habitually destroyed the government’s sources of income (agriculture and trade), and on the other, they were its military force, whose existence was a necessity. As this polarization continued, political and economic crises emerged, too. Then, Ghazan Khan, by some actions, hindered the collapse of the Ilkhanate. As a result, the Mongols underwent a self-imposed settled life but it was against the great Yasa code of Genghis Khan. (shrink)

This article interrogates the scientific conference as a means by which the organizers of the World League for Sexual Reform's 1929 conference attempted to marshal the ‘scientific spirit’ in order to present progressive sexual reform as a rational and scientifically informed undertaking. The conference was carefully curated to make the sex reform movement (and the assorted characters that gathered under its banner) look serious, legitimate and, most importantly, scientific. The conference was also an attempt by organizer Norman (...) Haire to exert control over the strategy of sexology, an enterprise that put him at odds with other prominent sexologists of the time. Crucially, Haire understood sexology as inherently intellectually interdisciplinary, but was strategically convinced that the only sound rubric through which to promote and gain acceptance for the movement was through medical science. This central debate, about how best to define the contested concept of sexology, continues among historians today. By examining how the 1929 conference organizers wrestled to define their sex-reforming remit and how they curated the conference to that end, this paper will offer a window onto the mechanisms via which adherents of intellectual communities contend with heterogeneity, how we judge forms of knowledge and, ultimately, what constitutes science.
