Religie op het werk? Over positieve en negatieve godsdienstvrijheid bij private ondernemingen en tendensondernemingen In this article we elaborate on the place of religion in the workplace. Does the individual freedom of religion imply that employers must always accommodate the religious claims of employees or can they boast a number of arguments allowing them to legitimately limit that freedom? And, conversely, do employers not also have a right to freedom of religion and a right to formulate certain religious expectations (...) for their employees? In this contribution, we deal with these and related questions from a legal-philosophical perspective. The overall aim is to illustrate the extent to which univocal answers are jeopardized because of conceptual ambiguities. We first make a normative distinction between two strategies (i.e. difference-blind approach and difference-sensitive approach) and subsequently illustrate and elaborate on how and why these strategies can lead to different outcomes in legal cases. We illustrate the extent to which a contextual and proportional analysis can be a way out in theoretical and practical conundrums. (shrink)

In dit stimulerende en diepgravende boek onderzoekt John D. Caputo het religieuze denken. Tijdens dit onderzoek komen fascinerende vragen aan de orde: 'Wat heb ik lief als ik God liefheb?' en 'Wat heeft Star Wars ons te zeggen over de huidige beleving van religie?' (proberen we altijd een manier te vinden om te zeggen: 'God zij met je'?) Waarom betekent religie voor zoveel mensen een moreel houvast in een postmoderne, nihilistische tijd? Is het mogelijk om 'religie zonder (...) religie' te hebben? Via een bespreking van enkele huidige beelden van religie, zoals Robert Duvall's film The Apostle , biedt Caputo ook een aantal fascinerende en originele inzichten in religieus fundamentalisme. In deze bewogen ‘Notities over de verloren ziel van de cultuur’ signaleert Jack Miles hoe religie tot kitsch dreigt te verworden wanneer we haar uitsluitend bezien in concurrentie met de voortschrijdende wetenschap. Pas zodra we deze tweestrijd over rivaliserende kennisaanspraken opgeven en onze duurzame onwetendheid onder ogen zien, is er ruimte voor een religiositeit die geen kitsch is en het ontzag, de verering en de angst voor het Onbekende een plaats geeft in ons leven. Uiteindelijk zouden de klassieke religies (...) van Europa - judaïsme en christendom – een analoge plaats moeten krijgen in de bestudering van onze cultuur, doordat we ze bezien per differentiam, waardoor we ze met een antropologische nieuwsgierigheid tegemoet kunnen treden. Paper is devoted to the ethical issues of business as considered from the points of view of main religions: Christianity – Catholicism and Protestantism – as well as Judaism and Islam. Ethos of Hinduism and the Caux Round Table efforts to disseminate its principles in cooperation with the world of religion are also mentioned. John Paul II’s and Benedict XVI’s addresses to business leaders are recalled. Suggestion to establish partnership relations between clergymen and business people is pointed out.

Over de vraag hoe geloof en verstand zich onderling verhouden, bestaat geen communis opinio; ook in het verleden is die er nooit geweest. Integendeel, de filosofiehistorie vertoont een complexe verscheidenheid van opvattingen. In dit artikel heb ik deze geordend in een beperkt aantal grondschema’s of grondmodellen. Ik breng zeven van die grondmodellen ter sprake, en duid ze kortweg aan met de termen identificatie, conflict, subordinatie, complementariteit, fundering, authenticiteit en transformatie. Mijn analyse laat zien hoe deze modellen, eenmaal present op het (...) publieke forum, zich blijvend doen gelden, tot op de dag van vandaag. Hun sterke en zwakke kanten dagen ons uit tot een eigen standpuntbepaling in het debat over religie en rede. (shrink)

Religion and global bioethics: Religious global bioethics as a precursor to a universal bioethics. From a general public perspective, this article presumes that there is such a thing as a universal ethics; however this assumption does not decrease the challenges with regard to a ‘global ethics’ and ‘bioethics’. The article discusses the views on global religious bioethics that were formulated in 1999. The article further considers these formulations as the forerunner of UNESCO’s perspective on universal bioethics accepted in 2005. The (...) article aims to argue that a global value system will enhance hope of peace and justice in today’s global world. It argues that the absence of shared ethics will reinforce conflict between civilisations and worsen injustice. (shrink)

Two perspectives on religion are contrasted. From the internalist perspective religion is not in need of any neutral justification: its point is manifest within religious life itself, just as the point of morality is manifest within moral life. From the externalist perspective religious practices and attitudes are dependent on the truth of certain assumptions about supernatural realities. It is argued that there are good reasons for endorsing internalism and, consequently, for radically dissociating religion from belief: if religious discourse is non-literal (...) (as the internalist claims), belief becomes dispensable. Finally, however, it is admitted that the internalist, by drawing a sharp line between literal and non-literal language, might miss an important truth about religion. (shrink)

Die Wissenschaft besteht aus einzelnen Behauptungssätzen, aus Kausalsätzen, aus Naturgesetzen, die in mathematischen Formeln ausgedrückt werden, aus Regeln und Ableitungen; aus Hypothesen, Verifikationsmethoden, Verifikationen, beziehungweise Falsifikationen; aus Konstatierungen über die Verwendung sprachlicher Zeichen. All das wird mit dem gemeinsamen Namen "Wissenschaft" bezeichnet. Wir bemerken, dass hierdurch heterogene Satztypen zusammengefasst wurden und wir wollen nach dem gemeinsamen "Durchschnitt" aller erwähnten Satzarten suchen, damit wir den gemeinsamen Namen rechtfertigen und das Verhältnis dieser Zusammenfassung zu einer andern Zusammenfassung, die man als Religion bezeichnet, (...) untersuchen können. Die Religion umfasst überlieferte Erzählungen (historische Behauptungssätze), Kausalsätze. Wir bemerken hier aber etwas Neues: das Auftreten von Normen (von allgemeinen Befehlssätzen) wie auch von Wertungen, die einen integrierenden Bestandteil der Religion bilden. Es kommen auch Mahnungen und Vorwürfe vor. Es erscheint nun zweckmässig zu sein, das Auftreten der letzterwähnten Satztypen als charakteristisch anzusehn, um die Verschiedenheit der zwei Sphären mit ihrer Hilfe zu formulieren. Die Wissenschaft ist dadurch gekennzeichnet, dass ihre Sätze richtig oder unrichtig, wahr oder falsch sind, dass sie aber nicht fordern und nicht werten. Auch die sogenannten ethischen Sätze, insofern sie wissenschaftliche Sätze sind, verpflichten nicht zu Handlungen, sondern beschreiben und erklären bestimmte Verhaltungsweisen des Menschen. Wir wollen die Neutralität, den indifferenten Charakter als das Kennzeichen aller wissenschaftlichen Sätze betrachten: sie sind nicht normativ, sie tragen uns keine Handlungen auf und werten nicht. Die Wissenschaft ist sozusagen, "jenseits von Gut und Böse". Die Religion besteht dagegen hauptsächlich aus Normen und Wertungen. Ihrem eigentlichen Wesen nach stellt die Religion keine Dichtung, keinen Mythos und ebensowenig eine blosse Ethik dar, sondern sie ist etwas viel primäreres: die Veranlassung und die Reglung der menschlichen Handlungen und die Erzeugung von Hemmungen durch Normen und Wertsysteme. Ueberall dort, wo eine Motivquelle auf einen Teil der Menschen, beziehungsweise auf alle Menschen, von andauerndem Einfluss ist und irgend ein Gegenstand der Welt dazu ernannt wird, an das Bekennen zu dieser Motivquelle zu erinnern, dort liegt Religion vor. Die Religion umfasst auch Normenund Wertsysteme, die Handlungen und Hemmungen veranlassen, welche nicht im Dienste der menschlichen Gesellschaft stehen und dadurch ist sie von der Morallehre verschieden. Der Glaube an die "Wichtigkeit" der Normen und Werte wie an jene Behauptungssätze über die Welt, welche den tiefsten Wünschen und der Sehnsucht des Menschen entgegenkommen, ist die wichtigste religiöse Handlung. Overheidssteun voor religie: antiperfectionisme of perfectionisme? I will argue that it is possible to give a neutral or antiperfectionist legitimation for state support for religion, which I consider a perfectionist good that is not in the common interest. I will argue that state support for perfectionist goods (and thus also for religion) can, in some circumstances and under certain conditions, be allowed as a second-best option in order to guarantee an adequate range of valuable options to choose among - (...) and this range of options is a necessary condition for autonomy. Subsequently, I will argue that the bottom line - which is also the limit - for support is a sufficient range of valuable options. Furthermore, I will argue that state support for religion is only allowed if there is a democratic consensus about the value of that particular perfectionist good. Finally, I will claim that state support for religion is only allowed under certain conditions. (shrink)

Levinas' godsdienstwijsbegeerte is verre van een godsdienstig denken. Aan de hand van biografische en zakelijke analyses kan men aantonen dat Levinas thuishoort in de brede Europese traditie van een gehumaniseerde en geseculariseerde opvatting van religie.

This article examines the 19th and 20th century European context wherein religion was practiced. In a 'Rip-Van-Winkle' manner it is as if this context had no influence on the Afrikaans speaking church in South Africa. The isolation, that was the result of the apartheid ideology, lead to the Afrikaans speaking church in South Africa not internalising ecumenicity. It is argued that for the church to be able to take an active role in reconciling diversity and therefore contributing to social cohesion (...) in South Africa, the church needs to transcend being a 'nation' church. This is possible by respecting culture and diversity, while recognising the priority of salvation in Christ. This is the ellipse of being church. (shrink)

De geopolitieke spanningen aan het begin van de eenentwintigste eeuw hebben een nieuwe interesse in het werk van Carl Schmitt gewekt. Dat geldt ook voor zijn benadering van het vraagstuk van de relatie tussen religie en politiek. Schmitt zoekt hierbij aansluiting bij zulke uiteenlopende en incompatibele auteurs als Juan Donoso Cortes en Thomas Hobbes. Vooral recent onderzoek heeft duidelijk gemaakt dat Schmitts juridisch-politieke denken inderdaad steunt op een aantal politiek-theologische premissen. Toch moeten we de actualiteit van zijn werk vooral (...) zoeken bij zijn politiek-filosofische probleemstelling die aanhaakt bij Thomas Hobbes. Schmitt kan ons vooral leren dat de privatisering van de religies als middel voor hun politieke neutralisering haar grenzen heeft, vooral in een democratische politieke orde. (shrink)

The majority of legal systems in Western democracies accord special treatment to religions, e.g. exemptions from generally applicable laws if they conflict with religious convictions. Other beliefs do not usually enjoy such far‑reaching tolerance on the part of the state. The article raises the question of how granting such privilege to religious views can be justified. Arguments of some philosophers (e.g. Thomas Hobbes’) which suggest that an intolerant attitude might sometimes be disadvantageous are in fact only instrumental, and do not (...) prove that tolerance is a moral virtue. This last claim only follows from the arguments of John Stuart Mill and John Rawls, who exemplify two basic approaches in ethics, i.e. utilitarianism and deontology. None of the analyzed arguments for freedom of conscience and religion distinguishes between religious and other beliefs, which suggests that the existing differences in their moral and legal treatment cannot be justified. Therefore, the question arises of whether legal regulations regarding religious and other beliefs should not be equated, so that religious views are not privileged. (shrink)

Nehamas geeft in zijn essay een kritische reactie op de religieuze wereldvisie, en houdt een pleidooi voor het heidendom. Het heidendom zou in tegenstelling tot het monotheïsme erkennen dat er veel manieren zijn waarop mensen hun leven kunnen bevestigen, en is volgens Nehamas een combinatie tussen tolerantie en kosmopolitisme.

‘We kunnen Kierkegaard beschouwen als de belangrijkste antigodsdienstijveraar van dit tijdsgewricht. Zowel in de zin die hij er zelf aan geeft, als in die van de gangbare retoriek, is zijn christendom geen religie, maar de vorm van een gelovigheid die wars is van vertoon en strijdlust. Deze houdt haar conflicten binnenskamers, en elke verborgen overwinning slecht een barrière op de weg naar universele broederschap, ook die waarvan religie de oorzaak is.’.

This paper deals with the manifold relations that exist between 'reason' and Christian belief. The plurality of relations is due to the fact that 'reason' can refer to a certain cognitive faculty, a norm, as well as to 'the scientific enterprise'. The author makes three claims in this paper. 1) Even though Christian belief is not, for the most part, a product of the faculty of reason, it does not conflict with the products of reason. 2) Christian belief does not (...) violate norms of reasonable belief. 3) There is no conflict between what science tells us about the history of the cosmos and the evolution of life on Earth, on the one hand, and the Christian doctrine of creation, on the other.
