După sfârşitul celei de a doua mari conflagraţii mondiale, Europa se afla în ruină şi dezastru economico-social. Ajutorul dat de Statele Unite ale Americii în reconstrucţia statelor europene a fost vital pentru supravieţuirea Occidentului european. În anul 1948, cinci state (Franţa, Marea Britanie, Belgia, Ţările de Jos şi Luxemburg) semnează Tratatul de Cooperare Culturală, Socială, Economică şi Apărare Colectivă, pe scurt Tratatul de la Bruxelles . După numirea generalului Dwight Eisenhower în funcţia de comandant suprem aliat în Europa, acest tratat (...) va deveni parte a documentelor NATO. Nevoia de apărare împotriva ameninţării sovietice se face şi mai vizibilă în propunerea ministrului de externe francez Réne Pléven. Planul Pléven, propus în anul 1952, viza constituirea unei Comunităţii Europene a Apărării, dar şi a unei Comunităţi Politice Europene. Planul nu a fost votat de către Adunare Franceză în anul 1954. Eşecul acestei comunităţi se datorează lipsei de viziune a liderilor europeni. O altă piedică în adoptarea acestui plan a fost teama statelor naţionale de posibila federalizare a Europei. (shrink)

Pendant la guerre indo-pakistanaise, les États-Unis ont lié le sort de leur allié à la crédibilité de la puissance américaine. Le président Richard Nixon et son conseiller en matière de sécurité nationale, Henry Kissinger, utilisent le langage du genre pour exprimer leur conception de la crédibilité américaine, une crédibilité construite par et à travers ce langage. En suivant une approche sensible au genre inspirée des approches féministes poststructuralistes, cet article analyse les conversations enregistrées dans lesquelles Nixon et Kissinger (...) ont formulé des mesures politiques risquées afin de paraître « durs » ou de « se comporter comme des mecs » à l’apogée du conflit de 1971. La conception de la crédibilité de Nixon et Kissinger a produit une base extrêmement instable et dangereuse pour la conduite d’une politique étrangère qui aspirait à maintenir l’équilibre des forces entre les États-Unis et l’Union soviétique. El presente trabajo busca develar algunas claves que permitan, de manera coherente, establecer una génesis de los alcances de la política exterior de EE.UU hacia Latinoamérica; entender el ethos que envuelve la costumbre y que genera la tradición. Sin embargo a la hora de inferir, hay que plantearse claramente como interrogante si existe un cruce en las hipótesis o justificaciones de la Doctrina de la Seguridad Nacional, con una predisposición en el etnocentrismo hegemónico con el que se conducen las relaciones (...) en lo político, social y cultural; además de su determinismo económico en términos hemisféricos. L’Association nationale des réseaux de personnel handicapé (NADSN) est un super-réseau qui relie et représente les réseaux de personnel handicapé dans les organisations à travers le Royaume-Uni. Le NADSN a été très préoccupé par le développement de la politique nationale jusqu’à ce jour et par le fait de sortir de la phase de verrouillage COVID-19, car la politique nationale est restée silencieuse en ce qui concerne le personnel handicapé, si ce n'est en présentant un point de vue (...) étroit et médicalisé. Nous avons structuré ce document dans le cadre d’un modèle social du handicap et des sentiments exprimés dans la Convention des Nations unies relative aux droits des personnes handicapées (CDPH) en examinant les problèmes actuels et en formulant nos douze recommandations. Ce document présente les observations du NADSN sur les expériences vécues par les personnes handicapées au cours de la conférence COVID-19. Il décrit ensuite la COVID-19 et l’évolution du lieu de travail. Il aborde ensuite une discussion générale sur les pratiques et les politiques de sécurité au travail, à mesure que nous sortons de l’isolement et au-delà. (shrink)

The debate over international trade has long pitted “free trade” advocates against those who argue that particular reasons support trade restraints. The newest argument is that open trade leads to a “race to the bottom” in the regulation of health, safety, welfare, and especially labor and environmental concerns, harming the nation’s citizens and undermining national sovereignty. One predicate for this argument – that trade increases competitive pressure on domestic industry – is accurate. That, in turn, will raise the cost of (...) some national policies that otherwise would win political approval. But the remainder of the race to the bottom argument rests on assumptions about regulation, the political process, and trade that do not stand up to examination. While responses to increased international competition will vary, the effects of such competition will generally be consistent with any meaningful notion of sovereignty and also will improve national welfare judged by common economic norms.Le débat sur le commerce international a longtemps opposé les défenseurs du libre échange à ceux qui soutiennent qu’il existe des raisons particulières en faveur de barrières à l’échange. L’argument le plus récent est que le libre échange conduit à une course au “nivellement par le bas” au niveau de la réglementation de la santé, de la sécurité, du bienêtre, et plus particulièrement dans les domaines du travail et de l’environnement. Selon ses tenants, elle aurait pour conséquence de léser les citoyens de la nation et d’affaiblir la souveraineté nationale.Un présupposé de cet argument – selon lequel le commerce accroît la pression concurrentielle subie par l’industrie nationale – est fondé. A son tour cela entraînera une augmentation du coût de certaines politiques nationales qui auraient par ailleurs obtenu un assentiment politique.Mais le reste de l’argumentation du nivellement par le bas repose sur des hypothèses à propos de la réglementation, du processus politique, et du commerce qui ne résistent pas à un examen critique.Bien que les réactions à une concurrence internationale accrue varient, les effets d’une telle concurrence seront généralement cohérents avec toute notion pertinente de souveraineté et amélioreront le bien-être national tel que jugé par les normes économiques standard. Dans les sociétés démocratiques, le droit est le texte où s'écrivent nos croyances fondatrices : croyances en une signification de l'être humain, croyances dans la force des lois et l'empire de la justice, croyances dans les valeurs sociales de l'Interdit. Le droit impose donc un sens commun qui permet aux individus de se lier entre eux et de vivre ensemble, il fonctionne aussi comme une vérité du moment. Il se nourrit et accompagne les transformations sociales et culturelles qui touchent non (...) seulement les sociétés nationales, mais également l'espace mondialisé. Le droit enregistre, selon ses propres temporalités, les changements de valeurs, l'émergence de nouvelles inquiétudes, l'évolution des techniques et des connaissances. Depuis quelques années, nous assistons à une "demande" accrue de droit et de régulation juridique. Nous chercherons tout d'abord à repérer et identifier les nouveaux territoires du droit en montrant comment la norme juridique contribue en permanence à réinventer le réel, à fabriquer inlassablement la condition humaine, à se présenter sans cesse comme l'instituteur du social. Ce mouvement de juridicisation du social et du politique se traduit non seulement par une prolifération et une diversification de la règle de droit, mais également par un processus parallèle de judiciarisation qui voit un certain nombre de problèmes être traités par l'institution judiciaire (politiques de santé, de sécurité, phénomènes de criminalité internationale, etc.). Entrons-nous dans un nouvel âge du droit? Ces nouvelles interactions entre la société et le droit inaugurent-elles l'ère d'une future démocratie juridique? Partant du problème du biopouvoir introduit à la fin du cours de 1976, Il faut défendre la société, Michel Foucault déplace soudain l'horizon du cours : il s'agit non plus de l'histoire des dispositifs de sécurité, qui passe provisoirement au second plan, mais de la généalogie de l'État moderne, à travers les procédures mises en œuvre, en Occident, pour assurer le « gouvernement des hommes ».

Securitization is considered to be one of the biggest financial innovations of the last century. It is also regarded as both a catalyst and a solution to the 2008 financial crisis. Once a popular method of financing the mortgage and consumer credit markets, aspects of the global securitization market are now struggling to revive. In this paper, I discuss the role that ethics played in securitization prior to the 2008 financial crisis and find that it is not an obvious story (...) of moral failures, but rather that it lies in more subtle elements of the financial system. The ethics uncertainty role in the securitization story is one of flawed incentives and the shifting of responsibility for handling risk. The role of securitization and the ethics of risk transfer have rarely been discussed explicitly in the literature. The historical origins of securitization and lessons learned from previous flawed uses of the process are also provided. I also detail the various global institutional reform proposals that have taken place. Moving forward, it is crucial to understand the causes, consequences, and ethical implications of securitization in the financial crisis so as to help individuals and managers better assess risk, align incentives, and design appropriate policy responses. Securitizing Islam examines the impact of 9/11 on the lives and perceptions of individuals, focusing on the ways in which identities in Britain have been affected in relation to Islam. 'Securitization' describes the processes by which a particular group or issue comes to be seen as a threat, and thus subject to the perceptions and actions which go with national security. Croft applies this idea to the way in which the attitudes of individuals to their security and to Islam and (...) Muslims have been transformed, affecting the everyday lives of both Muslims and non-Muslims. He argues that Muslims have come to be seen as the 'Other', outside the contemporary conception of Britishness. Reworking securitisation theory and drawing in the sociology of ontological security studies, Securitizing Islam produces a theoretically innovative framework for understanding a contemporary phenomenon that affects the everyday lives of millions. In Commonsense Consequentialism: Wherein Morality Meets Rationality, Douglas Portmore introduces a novel position regarding the actualist securitism – a position he argues is theoretically superior to the standard views in both the actualist and possibilist camps. After distinguishing the two camps through an examination of the original Procrastinate case, I present Portmore's securitism and its implications regarding his modified Procrastinate case. I level two serious objections against securitism: that it implausibly implies that morality is radically more demanding for the virtuous (...) than it is for the vicious and that it fails to recognize moral vice in a wide range of cases. I close by arguing that a possibilist variant of Portmore's securitist view is impervious to such objections and thus appears theoretically superior to the actualist version Portmore promotes. A relatively new debate in ethics concerns the relationship between one's present obligations and how one would act in the future. One popular view is actualism, which holds that what an agent would do in the future affects her present obligations. Agent's future behavior is held fixed and the agent's present obligations are determined by what would be best to do now in light of how the agent would act in the future. Doug Portmore defends a new view he calls (...) moral securitism, which is supposed to avoid the problems associated with actualism. On this account, what an agent would do in the future is treated as fixed iff that agent's future actions are not currently under the agent's present deliberative control. φ-ing is under an agent's present deliberative control iff whether the agent φ's depends upon the immediate outcome of the agent's present deliberations. I argue that moral securitism falls prey to two of the same serious problems that actualism does: it lets agents avoid incurring moral obligations because they have rotten moral dispositions and entails that agents ought to perform truly terribly acts. After providing a few standard counter-examples to actualism to show how it is plagued with these two problems, I offer my own example which demonstrates that moral securitism is subject to a version of these same two problems. I then review Portmore's response to my objection, arguing that it fails. I end the paper by offering a tentative revision of moral securitism that would allow it to avoid the aforementioned problems. (shrink)

Main description: In seinem Werk untersucht Christian Dessau die rechtskulturelle Einbettung von Rechtstheorie in nationale Kontexte. Untersucht wird die Frage, welchen Einfluss externe Faktoren auf die Themenwahl und inhaltliche Ausprägung von Rechtswissenschaftlern, insbesondere Rechtstheoretikern, haben.Zu diesem Zwecke werden in der Studie drei Wissenschaftler internationalen Ranges aus Finnland, Schweden und Deutschland als Beispiele herangezogen, die in ihrem jeweiligen eigenen rechtskulturellen Kontext betrachtet werden: Aulis Aarnio, Aleksander Peczenik und Robert Alexy. Diesen ist gemeinsam, dass sie in den 1970er und 80er Jahren (...) jeweils eine Variation einer Argumentationstheorie des Rechtes vorgelegt haben. Die Veröffentlichungen der Wissenschaftler aus dieser Zeit werden vor dem Kontext ihrer jeweiligen Rechtskultur ausgelegt, um Hinweise auf eine Beeinflussung in Rahmen von vier Zonen herauszuarbeiten. Aufgrund ihres textorientierten Ansatzes stellt sich der disziplinäre Kontext bei allen drei Wissenschaftlern als besonders ergiebig heraus. Im Gegensatz zu klassischen rechtstheoretischen Arbeiten beschränkt sich der Verfasser nicht auf den theorieimmanenten Kontext, sondern betrachtet beispielsweise eine rechtswissenschaftliche Schule auch als einen sozialen Kontext. Methodisch ist die Studie interdisziplinär angelegt, so nutzt sie neben den rechtswissenschaftlichen Methoden parallel oder zu Zwecken der Validierung auch andere geistes- und sozialwissenschaftliche Methoden.Im Ergebnis zeigt der Autor viele Aspekte auf, die es als evident erscheinen lassen, dass auch im Feld der Rechtstheorie, die sich selbst eher als abstrakte und vom nationalen Recht losgelöste internationale Theorie versteht, eine Auslegung unter Berücksichtigung des rechtskulturellen Kontextes einen neuen Erkenntnisgewinn verspricht. Drawing on the author’s archival research in Germany and the US, empirical data about US-allied troop sexual violence during post-World War II occupied Germany suggests a complex interplay between gender, security, silence production, and state identity. Through a feminist security studies lens, this article theorizes about an unexplored, obscured form of de-securitization: the unmaking of a security issue or referent object as active silence. De-securitization as silence provides a unique insight into silence production, gender’s normativity, and security. To move beyond (...) de-securitization’s presumed politicization, the argument identifies specific hypervisibilities and new state-self, dominant memory regimes as acts, discursive representations, processes, or incidents of de-securitization – producing and reproducing active silence and facilitating the making of a newly imagined, ‘good’ German state-self. Comment penser de manière systématique au type de compromis que les membres d’une démocratie seraient disposés à effectuer, et aux coûts qu’ils seraient prêts à assumer en termes de droits ? Adaptant une proposition faite par Ronald Dworkin pour penser ce type de question dans le (...) cas de la santé, je définis une situation hypothétique de choix qui, à travers les conditions épistémiques et conatives qu’elle impose aux participants, est susceptible de nous guider sur ces deux questions.The adoption of security as a goal of public policy requires that compromises be made with other legitimate goals of policy , and that limits be imposed upon certain individual rights. How can we think in a principled manner about the kinds of compromises that citizens in a democracy would be ready to accept, and about the costs they would be ready to bear in terms of rights? A proposal made by Ronald Dworkin to address analogous questions in the case of health-care is adapted to the case of security: I define a hypothetical choice situation that imposes the kinds of epistemic and motivational constraints upon participants that are required to address these questions. La Sécurité sociale fête ses 70 ans. D’aucuns n’oseraient évoquer la fin de cette institution tellement elle est inscrite dans le patrimoine de notre nation. La « Sécu » a atteint ce statut particulier de [bien commun], sans que débat il y ait! Pourtant, c’est cette absence de débat sur ses fondements qui risque de mettre un terme à son devenir et à toutes formes de démocratie sociale. La Sécu est-elle toujours un [bien commun]? Cette contribution pose les bases (...) d’un débat qui n’a que trop attendu, livre un regard autodidacte, et suggère des liens entre maintien de la cohésion sociale et rénovation démocratique. À travers l’exploration de son histoire, du sens voulu par le Conseil national de la résistance, et des représentations actuelles, nous poserons les bases d’un plaidoyer pour sauver notre Sécurité sociale, un [commun] essentiel à notre cohésion sociale et à notre démocratie. The contemporary debate in democracies routinely refers to online misinformation, disinformation, and deception, as security-issues in need of urgent attention. Despite this pervasive discourse, however, policymakers often appear incapable of articulating what security means in this context. This paper argues that we must understand the unique practical and normative challenges to security actualized by such online information threats, when they arise in a democratic context. Investigating security-making in the nexus between technology and national security through the concept of “cybersovereignty,” the (...) paper highlights a shared blind spot in the envisaged protection of national security and democracy in cyberspace. Failing to consider the implications of non-territoriality in cyberspace, the “cybersovereign” approach runs into a cul de sac. Security-making, when understood as the continuous constitution of “cybersovereign” boundaries presumes the existence of a legitimate securitizing actor; however, this actor can only be legitimate as a product of pre-existing boundaries. In response to the problems outlined, the article proposes an alternative object of protection in the form of human judgment and, specifically, “political judgment” in the Arendtian sense. The turn to political judgment offers a conceptualization of security that can account for contemporary policy practises in relation to security and the online information threat, as well as for the human communicating subject in the interactive and essentially incomplete information and communication environment. Zowel de legitimatie en vorming van het internationale recht als de handhaving van de internationale verplichtingen van de Staat op nationaal niveau zijn hiervan afhankelijk. Dieser Aufsatz geht von folgender Überlegung aus: Will man die Dynamik und Brisanz des Einwanderungsproblems in einer philosophischen Reflexion begreifen, darf die nationale Identität des Einwanderungslandes nicht ausgeblendet werden. Deshalb wird im Folgenden versucht, die Immigrationsproblematik aus dieser Perspektive zu erörtern. Dafür werde ich im ersten Schritt den Begriff einer liberalen nationalen Identität entwickeln. Im zweiten Schritt werde ich auf die deutsche Diskussion über nationale Identität eingehen, in der sich mit der ›universalistischen‹ und der ›traditionalistischen‹ Position zwei diametral (...) verschiedene Auffassungen von nationaler Identität gegenüberstehen. Schließlich werde ich der Frage nachgehen, ob und gegebenenfalls wie sich der kontextualistische Ansatz von Joseph Carens fruchtbar machen lässt, um zwischen diesen beiden Positionen zu vermitteln. En août 1960, le congrès « La femme africaine trace son avenir»s’ouvre à l’université d’Ibadan, au sud-ouest du Nigéria. Cinquante-cinq femmes de huit pays l’Afrique de l’Ouest se rassemblent pour la première fois au-delà des lignes de démarcation linguistiques et coloniales. Au programme : discuter l’avenir des Africaines dans les nations indépendantes et dans une nouvelle Afrique, libre de la domination coloniale. Les analyses proposées par les déléguées montrent leur volonté de redéfinir leurs rôles en imaginant de nouveaux droits et (...) devoirs, qui leur permettraient de construire leurs positions en tant que citoyennes nationales et panafricaines dans un moment de soleil des indépendances. Ce moment radieux est cependant de courte durée et les logiques politiques nationales l’emportent sur les discours unitaires. Toutefois, ces débats constituent une trame de fond pour l’action des organisations nationales et les réflexions théoriques féministes menées dans la sous-région pendant les décennies suivantes. The joint international action against Iraq and the search for a new security doctrine following the end of the Cold War, led, in the early '90s, to a revival of the notion of collective security embodied in several international agreements. This notion is based on the assumption of responding collectively to international aggression. However, the international guagmires of recent years and especially the case of former Yugoslavia where international organizations have played the role of alibi to agression, has once more, (...) dealt a major blow to the illusion of the implementation of the principles of collective security. In a way similar to the 1930s and the bipolar balance of power of the Cold War, collective security seems ephemeral today. We can therefore safelypredict that in the foreseeable future, international relations wilt continue to be shaped by the balance of specific state interests and not by universally applied principles of collective security. Between 7 June and 10 June 1979, the first elections of the representatives of the European Parliament by direct universal suffrage will be held in all the Member States of the European Community.Within that period, the elections shall be held on a date fixed by each Member State. The electoral procedure, except for the common provisions of the annexed Act to the Council Decision on directelections of 20 September 1976, shall be governed in each Member State by its national procedures. (...) There will be nine parallel national elections. The Council Decision and the annexed Act of 20 September 1976 are considered in retrospect and then analysed, as are the national electoral laws, which will be used for the European elections in the different Member States. Their mutual differences and contradictions are discussed.Changes from the electoral procedure in use for national elections are traced. Broadly speaking, one of the aims of the article is to show that the potential influence of an individual vote of a «European citizenl» on the composition of the European Parliament wilt differ considerably from one Member State to another.In the closing remarks, the European elections are put into the perspective of furthering the democratisation of the European Communities.
