Certification of banana plantations is widely used as a device for protecting and improving socio-economic conditions of wageworkers, including their incomes, working conditions and—increasingly—voice [related to labour relations and workplace representation]. However, to date, evidence about the effectiveness of certification in these domains is scarce. We collected detailed field data on (1) economic benefits for improving household income, (2) social benefits for labour practices, and (3) the voice of wageworkers focusing on identity and identification issues amongst (...) wageworkers at Fairtrade certified banana plantations and comparable, non-certified plantations in the Dominican Republic. We used different types of regression models to identify significant relationships. Econometrical analysis of survey results complemented by field observations and outcomes from in-depth stakeholder interviews indicate that the impact of Fairtrade certification on wageworkers’ economic benefits is rather limited. However, the impact on the voice of wageworkers (job satisfaction, sense of ownership, trust), is more evident. On Fairtrade certified plantations workers are more satisfied with the course of life and better represented. Thus while the additional value of Fairtrade certification on primary wages seems limited, Fairtrade has relevant positive effects on the labour force, particularly by delivering in-kind benefits, offering a sense of job-security, improving voice and enabling private savings. Benefits of (Fairtrade) certification, but also other interventions with a similar purpose, might therefore not be discerned in terms of economic benefits such as wages or basic labour conditions that are under direct control of (inter)national law, but they should be identified in terms of social benefits and improved norms of conduct for wageworker engagement. In the present article, the authors continue their sociological interpretations of theempiric data obtained in the research project “Aggregate Capital, Its Structure andRelation to Labour Migration” (2012). The following hypothesis has been proved: ahigher predisposition for the labour migration is more typical for economically activeregion’s inhabitants with fairly high amounts of some indicators of the aggregatecapital, especially physical capital, but with a comparatively lower amount of culturalcapital, which could transform into human capital and further into economic capital inLatgale (...) or Latvia. An in-depth analysis of the factors of life success has revealed that,in general, our respondents tend to assign the lead role not to the personal competitivecharacteristics (resources) but rather to the specificity of the social environment: anexplanation of life success by means of a set of variables that, on the whole, describeit as a socio-political innovation with criminal tendencies (political corruption) is themost spread one. Critics of the organization of industrial work under capitalism have ranged from the “human relations” school to socio‐technical systems theorists and, most vociferously, to advocates of labor process theory (LPT). Their practical influence on management was small as long as production was rolling on and profits rolling in. When competition intensified, however, employers started to question old ideas and, abetted by the needs of new computerized technology, began to broaden jobs, allow workers greater discretion in their performance and (...) involve them in shop floor decision making. LPT, however, has not contributed to this evolution toward more satisfying work. This paper explains why this is so by exploring two major shortcomings of LPT. First and foremost is that LPT has ignored the efficiency of the work process, refusing to acknowledge the legitimacy of a tradeoff between work “goodness” and productivity.As a result, LPT has been unable to propose economically viable alternatives to existing job design and work organization. Second, LPT has identified management's goal in organizing work as gaining control of the process, when, in fact, it has been to make the process as economically efficient as possible. Thus, LPT could not see that, under changed circumstances, management might decentralize control toward the shop floor, if that might promote efficiency. LPT's founder, Harry Braverman, and his disciples believed that it was impossible to reform work under capitalism, but experience shows otherwise. (shrink)

In this paper I focus on the Hungarian intellectual and politician Paul Szende’s sociologically oriented epistemology. I trace the influences of physiology, psychology, economy, evolutionary theory of his day on his sociological theory of abstractive knowledge, and discuss the close connection between physiological, social, and economic aspects in the early sociology of knowledge. My discussion continues with an examination of Szende’s differentiation between two economic effects within social epistemology: on the one hand the ‘economy of thought’ in the tradition of (...) Ernst Mach, with its physiological, organic, and integrative functioning of knowledge; on the other hand, the socio-economic effects of social selection, exclusion, and societal antagonism. Besides the Marxist and more specifically the Austro-Marxist environment of Szende’s writings, I trace the influence of the economic theory of Italian economist Achille Loria on Szende’s understanding of the antagonistic nature of the transformation of knowledge. The paper is set at the intersection of philosophy of science and history of science. It relates epistemological issues to historical, social, and scientific developments in Szende’s day and thus combines a philosophical analysis of Szende’s sociological theory of knowledge with historical research into the natural, social, and economic sciences of his time. Studies of creative industries typically contend that creative work is profoundly precarious, taking place on a freelance basis in highly competitive, individualized and contingent labour markets. Such studies depict creative workers as correspondingly self-enterprising, self-reliant, self-interested and calculative agents who valorise care-free independence. In contrast, we adopt the ‘ethics of care’ approach to explore, recognize and appreciate the communitarian, relational and moral considerations as well as interpersonal connectedness and interdependencies that underpin creative work. Drawing on in-depth interviews with creative (...) workers in a range of marginal socio-cultural contexts, we argue that creative workers cultivate and sustain a diverse array of practices of care arising from an affective concern with the well-being of others. Far from being merely individualistic and crudely competitive actors, creative workers enact practical ethical responsibilities and affectivities towards a range of human and non-human others, including families, local communities and neighbourhoods, colleagues, artistic scenes and their adjacent genres, and surrounding national and linguistic cultures. In emphasizing the fundamental and structuring role of care in contingent labour markets our approach accords with recent trends in the social sciences that ‘affirmatively’—as opposed to ‘negatively’ and ‘suspiciously’—recognize that mutuality, solidarity and affectivity are powerful drivers of action on a par with or even exceeding market-driven self-centredness. The purpose of this article is to describe how expansive learning in organisations can become a resource for learning in a wider community of practice (CoP). The “developmental work research” approach (DWR) based on cultural historical activity theory (CHAT) is beneficial for analysing and interpreting the requirements in a field of action. Engeström’s specific form of “action research” focuses on expansive learning in activity systems. However, complex socio-technical change processes cannot be initiated and managed by the local community of (...) practise alone. In order to establish the use of new tools, new methodologies or organisational solutions in a field of work, a double path of expansive learning is needed: Findings from the participative analysis and interpretation of contradictions in the local activity system have to be transferred to wider communities of practice. This paper illustrates a double path of expansive learning by presenting the experiences of research and development in machine and plant engineering companies in Germany. In the AQUIMO project, a project team has developed an adaptable software tool for multidisciplinary mechatronical engineering and created a related qualification program. The support from external social researchers has helped to initiate, disseminate and establish new ways to organise the division of labour in teams of engineers. (shrink)

Smart cities are now an established context in which data and digital technologies shape urban politics. Despite increased scholarly focus on algorithmic governance, smart cities and their data production still heavily rely on human labor, raising questions about how that labor is recruited and the implications of different recruitment strategies. In this paper, we illuminate the relations and practices mobilized to recruit the labor required to produce, analyze, and enact data that produce smart cities. We argue that smart cities (...) recruit such digital labor by producing and circulating moral values and sentiments to claim that such participation is a social good. In this article we draw on a 6-year ongoing project in Calgary, Canada to explore how these “moral economies” underwrite smart city ecosystems. We explore three projects related to data and digital labor in the Calgary smart city: a wearable technology collaborative project, a civic hacking group, and the community social media platform Nextdoor. We suggest that moral economies of smart cities signal a new juncture between urban planning and profiting from data, with the potential for creating new socio-political risks. These moral economies signal a shift toward a “new spirit of capitalism” in which labor is managed through indirect persuasion rather than direct compulsion and mandate. (shrink)

Worldwide, vulnerable neighbourhoods of large cities are often the scene of collective violent conflicts linked with migration and ethnic minorities’ struggles for social justice. However, urban conflicts of this kind have not taken place in Spanish cities with high immigration rates, even though the country has been deeply affected by two recent socioeconomic crises (2009 and 2020). This article reports findings of a study aimed at understanding what lies behind this apparent social peace. The research methodology was based on an (...) analysis of secondary socio-economic and socio-relational data from the Spanish Institute of Statistics and from key national surveys and reports. Results confirmed that immigrant population living in the country are strongly segregated in the lower strata of the labour and socioeconomic structure and have been disproportionately affected by the crises. However, research findings also pointed to the existence of strong closed support networks where social capital has been effective at palliating members’ disadvantage and unrest. Drawing on the Theory of Rupture Frames, we argue that this is a fragile and unsustainable social peace, rooted in social injustice, and anticipate that unless actively prevented, uncontrolled conflict will eventually emerge in main cities’ neighbourhoods in Spain. Drawing on contemporary pragmatic philosophy and grounded in a reading of techniques associated with digital media as sophist practices of influence and manipulation, this paper proposes an ‘experimental’ reading of key aspects of the topological qualities of the infrastructure of the knowledge economy, with its obsessive attempts at measuring, recording and monitoring, or ‘qualculation’. Taking seriously, albeit with humour, early criticisms of actor-network for its ostensibly Machiavellian proclivities, it offers a series of playful stratagems for the exploration and analysis of (...) power as an emergent property of socio-technical relations. Topology, in this account, becomes relevant to cultural analysis because of the way that it allows us to think together processes constructive of the intensive continua of ‘desiring production’ with the sociotechnical operations of digital media infrastructures. Different elements operative within digital media (the super-hub, the power of small numbers, recursion and relational databases) are read stratagematically – as figures of a praxis (the material practice of immaterial labour), that reveals different facets of the operations of power, while also allowing for counter-tactics to be deployed. Rather than proposing a theoretical account or an empirical analysis, the paper develops what Stengers (2011) calls ‘operative constructs’, which become ingredients for further active exploration of and thinking about the topological qualities of mediatic infrastructure. The paper addresses four different and overlapping areas of digital media from a point of view that considers the plural, compositional quality of media/power relations. (shrink)

The critical concept of commodity fetishism and its developed forms of money and capital fetishism ground the contemporary shape of social life under the rule of capital. This chapter offers a novel interpretation based on Marx’s Capital, elucidating the oft-overlooked interconnection of the fetishism triptych that accounts for domination, as well as the normalisation of exploitation as experienced in capitalist life. In commodity fetishism, a market-based pseudo-social ‘thing-hood’ preponderates over commodity owners and producers, concealing the double inversion that constitutes the (...) ‘world of commodities’. Money’s fetish form makes it appear as the ‘sovereign’ of the commodity world, possessing the exclusive social power to establish the value hierarchy of all persons and objects relativised in regard to it. The universal condition of monetisation of the life process in bourgeois society necessitates the adoption of the competition principle, leading to the generalised formation of a commodity self, shaped by competitive individualism. The social separation of the great mass of commodity producers from the means of production and the consequent need to sell themselves as commodities in the form of wage labour constitutes the social basis of capital fetishism, through which the process of capital ‘valorisation’ is enfolded within the process of use value production, disappearing into its socio-material character and thus naturalised. Capital fetishism dissimulates the production of surplus value by social labour and constructs the harmonised appearance of an equitable contribution of ‘factors of production’ in the sharing of the surplus product, thereby obscuring distributional struggles over it. Such antagonisms over surplus undergird the logic of neoliberal capitalism’s two-pronged strategy, pursuing ‘deregulation of labour relations’ on the one hand and dismantling the welfare state on the other. This article examines the ethical characteristics of MNEs employee relations in developing countries. Specifically, it addresses various ethical issues relating to labour relations and trade unions in extractive industries in Nigeria, South Africa and Zambia. Data collected in these countries indicate that criticisms aginst MNEs relating to labour issues and labour practices in developing countries are not lessening. The discussion is lent focus and direction through the analysis of critical incidents from the perspectives of various (...) stakeholders: government, oil and mining companies, and leaders of trade unions. Tensions over pay, expatriate employments as against the locals, negotiation rights and employees well-being are evident. The argument advanced is that the MNEs operating in the extractive industries of Africa will have to improve their relations with local employees in order to bridge the legitimacy gaps that exist. An improved mutual understanding between the MNEs and trade unions is required for both actors to have a smooth working relationship. (shrink)

Walter Mosley’s Devil in a Blue Dress contributes significantly to the literary debate on the definition of whiteness. The socio-historical construction of whiteness emerging from the novel is amplified by white imagery dovetailing with the claims made about white people directly. For the African American first person narrator, Easy Rawlins, living in post-World War II Los Angeles, whiteness mostly spells terror. The oppressive faces of whiteness consist in the following trajectories: property relations, economic exploitation, labour relations, (...) the legal system, different miens of oppressive white masculinity denigrating blackness, spatial dynamics of post-World War II Los Angeles and the white apparatus of power that the narrator needs to confront throughout the novel. White imagery carried to the extreme magnifies the terrorizing aspect of whiteness in the narrative. Like many authors of colour, Mosley associates whiteness with death. Whiteness inundates Easy Rawlins from all sides, entailing insincerity, dishonesty, interestedness and hypocrisy. (shrink)

The millions of farm workers in the Global South are an important resource for smallholder producers. However, research on their labour organisation is limited. This article focuses on smallholder farm workers in Ghana’s cocoa sector, drawing on insights from qualitative interviews and the concept of bargaining power. We review the labour relations and working conditions of two historical and informally identified labour supply setups (LSSs) in Ghana’s cocoa sector, namely, hired labour and Abusa, a form (...) of landowner–caretaker relations, and identify an imbalance of horizontal power. Further, we analyse the labour relations and working conditions of an emerging and formal LSS in Ghana’s cocoa sector: private labour providers (PLPs). We argue that PLPs are likely to address the imbalance of horizontal power between farm workers and smallholders and bring about significant improvements in the working conditions of farm workers. We also assess the sustainability potential and limitations of PLPs and argue that tensions exist. We contribute to the growing horizontal power perspective by providing avenues for research and policy related to promoting sustained labour rights for farm workers in smallholder agriculture in the Global South. The problems of the functioning of religion in the countries of the European Union are extremely complex and ambiguous. The EU is primarily political and economic. It is in these areas that active intra-integration processes are observed: introduction of a single currency, single payment system, actual “blurring” of borders between member states, development of the Constitutional Treaty, orientation towards the creation of a common market, a common transport network, harmonization of educational systems, etc.

The process of economic globalization has over the years accelerated the pace of labour policy convergence. In the Indian context, labour law since 1991 has witnessed a paradigm shift while embracing a policy of global integration. The ambit of labour relations is now being related with private practice or the informal settings, leading to multiple concerns over labour justice and security. In compliance with global standards, the continuous emphasis upon labour flexibility characterised by flexible (...) labour employment, performance based remuneration, increasing portion of casual labour, has raised several concerns. This paper is an attempt to highlight the attempted and achieved labour law policy convergence in India, coupled with a few suggestions for balance in global national comittments towards labour welfare. The National Labor Relations Act of 1935 has been widely portrayed as an anachronistic piece of legislation that needs to be reformed or abandoned. In the absence of reform, many US labor unions try to avoid the NLRA process altogether by organizing workers outside the confines of the law. But Somos un Pueblo Unido, or “Somos,” a worker center in New Mexico, has been using a novel interpretation of the NLRA less to boost union density than to develop an (...) alternative to contract unionism. By helping nonunionized workers use Section 7 of the NLRA to act concertedly in their own defense, I argue, Somos is combating employer abuse, in the short run, and demonstrating that worker centers and their memberships may be transforming the US labor movement, in the long run. Their experiences illustrate the ability of organizations to redeploy existing institutional resources with potentially transformative results. (shrink)

Labour and employment law no longer has a monopoly on regulating labour relations and is facing a crisis as its effectiveness is questioned. Codes of conduct adopted by companies to recognise their social responsibility for the global supply chain are instruments that can usefully complement labour and employment law. The aim of this paper is to analyse in depth the legal nature of codes of conduct and their impact on labour and employment law. Will the (...) use of codes of conduct reinforce the crisis of labour and employment law in the era of globalisation or will these codes be part of a solution to this crisis? Do we have to consider codes of conduct as competitors to labour and employment law or as an opportunity for rethinking the way that labour and employment law norms should be produced and applied? Employee mobility is a phenomenon that challenges workplace ethics. This paper argues that despite on‐going attempts by management and consultants to build and install employee loyalty, and despite the complexity of relationships between employees and their organization, employee mobility remains a common phenomenon in today’s market. Courts, at least Israeli courts, perceive the employee–employer relationship as almost purely contractual and thus strive to protect workers first, often ignoring deeper commitments such as loyalty. The Lithuanian success of implementing international obligation in order to encourage the regulation of labour relations by means of collective agreements is analyzed in this article. It is emphasized that development of social partnership is too slow, coverage of regulation of labour relations by means of collective agreement also is low-level and collective agreements basically are made at the plant level. It is noticed that, because of the need to find a suitable balance between implementing the (...) international obligation to encourage regulation of labour relations by means of collective agreements, and the necessity to undermine the raison d’être of the regulation by means of collective agreements itself, as the process, where attitudes of social partners has to be harmonised at maximum, the state has limited scope to influence the process of making collective agreements. In this paper I argue that the poker analogy is unsuitable as a model for collective bargaining negotiations. Using the poker game analogy is imprudent, its use undermines trust and ignores the cooperative features of business, and its use fails to take into account the values of dignity and fairness which should characterize labor-management negotiations. I propose and defend a model of ideal family decision-making as a superior model to the poker game.

The existence of cooperative labor relations within leading firms in South Korea, amid unfavorable national-level economic and political institutions, merits study by comparative political economists. Late industrializing Korea lacks the conditions that sustain cooperative labor relations in other nonliberal capitalist countries like Germany and Japan. More relevant, therefore, are debates over the emergence and practice of “high performance work systems” in the unfavorable environments of advanced liberal and developing country capitalism. As a successful late industrializing country that combines (...) both advanced and developing capitalism characteristics, Korea represents a useful testing ground for ideas about HPWS. This article will examine cooperation in four leading Korean firms and use the findings to advance key HPWS debates about the possibilities of participation and the conditions under which cooperation can emerge and be sustained. The particularities of Chinese union practices in the private sector and their impacts on the labor relations climate have raised much controversy. This paper presents the findings of a study that analyzed data from 926 enterprises in Chongqing, China, through the lens of institutional trust. The study was designed to examine the influence of union practices on the labor relations climate at the enterprise level. Particular attention was paid to the possible moderator effect that both employee and management (...) trust in unions had on the labor relations climate. We found that employee–union trust positively moderated the impact of union practice on the labor relations climate. However, if management–union trust exceeded employee–union trust, management–union trust weakened the moderator effect of employee–union trust. In other words, management–union trust negatively moderated employee–union trust. This article is organized as follows. In section “Introduction,” we introduce the institutions Chinese unions operate in, especially regarding disputes over the effects on the labor relations climate. In section ‘Theory and hypotheses,” we review the literature and develop the hypotheses. In section “Materials and methods”, we describe the data and method, and in section “Results,” we present the results of the model. Finally, in section “Discussion,” we discuss the implications for China’s union development and note the limitations of the study. (shrink)

In 1998, the Labour government introduced legislation broadening British sentencing powers in relation to crimes aggravated by the offender's hostility towards the victim's actual or perceived race, religion, sexual orientation or disability. Gender is a notable omission from this list. Through a survey of eighty-eight stakeholders working in the violence against women (VAW) sector, this paper explores both the potential benefits and possible disadvantages of adding a gender-based category concerned with VAW to British hate crime legislation. The majority of (...) participants believed that a hate crime approach would offer significant benefits, especially in terms of the symbolic power of the law to send a message to society that VAW is unacceptable. However, most also recognised that the addition of a VAW category to current legislation would involve major practical and conceptual difficulties, not least those resulting from problematic assumptions about the nature of hate crimes versus VAW, and a general unwillingness on the part of policy-makers to address the socio-cultural inequalities that underpin VAW. Overall, the fact that the majority of participants favoured inclusion, on the basis that the possible symbolic benefits were likely to outweigh the potential practical disadvantages, is significant: it speaks to the power of hate crime legislation to challenge many forms of inequality and discrimination still endemic in British society. The remarkable growth in the application of information and communications technologies indicates a great shift toward a globally integrated society. The urban metropolises are turning into intersections of transit and migration of goods, capital, services, cultures, knowledge and especially people. Moreover the flow of bodies, information and money is changing the rules of what defines national territory, space and identity. Social realities with specific qualities are appearing, implying a new spatial correlation between the local and the global. International airports and (...) within emerging extraterritorial zones have become an important threshold controlling the flow of people in a free market economy. The airport border mutates into an abstract space permeating the physical territory of the airport and beyond. This abstract border space, within which mobile bodies operate, is created by a bureaucratic system of inclusion and exclusion particular to transition states. Transit zones at airports emerge because of a complex set of factors: border crossing as well as increasingly stringent security and safety regulations. The innumerable thresholds within these transit zones are points of congestion governed and increasingly supported by technological systems of identification. Within the transnation state, the movement of bodies is the constant subject of streaming and proceduralization. Increasingly, the conventional system of control based on face-to-face interaction between the controlling and the controlled is being replaced by the algorithmic precision of database logic. The paradigm of pattern matching ensures precise verification of the uniqueness of the body, in turn offering new potentials for permeability and flux. These different orders of legal and economic categorization create manifold sub-territories accessible to select groups of travellers. Nowadays, the airport is a transnation state spatialized through a new order of architecture, a manifestation of technology of abstract procedures of transition, inclusion and exclusion, adopting emergent patterns of socio-spatial mobility in a globalized network. This book examines what value if any, the state has for the pursuit of progressive politics; and how it might need to be re-thought or reimagined to deliver transformative change. Is it possible to reimagine the state in ways that open up projects of political transformation? This interdisciplinary collection provides alternative perspectives to the 'antistatism' of much critical writing and contemporary political movement activism. Contributors explore ways of reimagining the state that attend critically to the capitalist, neoliberal, gendered and racist (...) conditions of contemporary polities, yet seek to hold onto the state in the process. Drawing on postcolonial, poststructuralist, feminist, queer, Marxist, and anarchist thinking, they consider how states might be reread and reclaimed for radical politics. At the heart of this book is state plasticity - the capacity of the state conceptually and materially to take different forms. This plasticity is central to transformational thinking and practice, and to the conditions and labour that allow it to take place. But what can reimagining do; and what difficulties does it confront? This book will appeal to academics and research students concerned with critical and transformative approaches to state theory, particularly in governance studies, politics and political theory, socio-legal studies, international relations, geography, gender/sexuality, cultural studies and anthropology. The article is devoted to the consideration of the image of zombie in two contexts, which are, firstly, the transformation of capitalist figures of production and consumption, and secondly, the transformation of desire and sensuality. Two models of socio-philosophical interpretation of zombies related to the development of capitalism are revealed: the consumer and the proletarian. They concern the discourse of the economic crisis and the disgust to “irrational consumption” and the discourse of the exploitation of the worker by dead (...) labor. It is noted that the image of zombie embodies total alienation, loss of social connection, which is based on emotional affinity, intimacy and affectivity. The figure of zombie is seen as the opposite of the Enlightenment model of human existence, which is characterized by a fundamental multiplicity, sensitivity and taste, which became the basis of a market economy. The image of zombie represents the fear of dissolving human diversity in the identity of desire and corporeality, which is destroyed and appears as “the same”. Zombies embody the instinct and infectivity of being. They denote “naked life”, the signs of which are the right to kill or exploit them. On the other hand, zombies are the embodiment of Use value: an empty post-capitalist, post-proletarian and post-consumer “life” reduced to pure need. Zombies figure represents the inner contradiction of capitalism: on the one hand, the fear of renewing a Labour power that is no longer able to work, and on the other, the fear of losing sensual diversity that suspends the endless process of consumption. Thus, the fear of zombie is a defensive reaction to capitalist existence. On the other hand, it is an adjustment of consciousness, when the coercion to work and consume is based on the fear of becoming a zombie, in the presence of an unconscious willingness to destroy those whom capitalism excludes as zombies. The change speed in the new infor- mation and communication field is the reason for many questions related to studying the problems of society and the machine, finding out the place of artificial intelligence in social relations. These pro- cesses stimulated the philosophical research, the subject of which was man, modern technologies, scenarios for the development of society, socio- cultural and political-legal forms of (...) its organization. Since the 90s of the twentieth century in the West and later in Russia, a transhumanistic concept has been formed, which connects man, society and technology in a special way. Representatives of transhumanism study the technical develop- ments of human immortality and build models of the perfect man, pursuing as a goal, his deliver- ance from suffering and disease. Transhumanistic perspectives actualize the need for a thorough, constructive and critical assessment of the possible advantages and risks of technological development, and its impact on the political and legal structure. In this regard, the ability to see and isolate the features of this process and subsequent reflection is fundamentally important. The purpose of the article is to consider political and legal transformations in the context of the interaction of modern technologies and soci- ety through the prism of transhumanistic perspec- tives, to identify possible directions of philosophical reflection of political and legal modes of modernity. Methods. To achieve the research goal, general scientific methods of cognition were used: analysis and synthesis, induction, deduction, comparison, abstraction. The article also applied institutional- functional and system-structural approaches, the method of interpretation and content analysis. The analysis of public opinion and special labeling of artificial intelligence was carried out with the help of appealing to network content (social networks, blogs, and forums). Communication channels reproduce messages mentioning modern technolo- gies from the point of view of the philistine world- view based on stereotypes broadcast in society and the influence of popular culture. Content analysis revealed the relevance of the spectrum of labeling, relative to artificial intelligence systems, includ- ing the verbs “create”, “destroy”, “help”, “enslave”. Regarding the sphere of labor, law and politics, the positions differ, from outright alarmism to utopian images of social well-being. Scientific novelty of the study. The article analyzes the prospects of considering the phenom- enon of social transformations, the forms of their representation through political and legal views as exemplified by transhumanism. Results. The author attempts to give a comprehen- sive description of social changes in the field of public administration, legal regulation, legal per- sonality and legal responsibility, social equality of participants in legal relations through the specific refraction of these social phenomena in transhu- manistic ideas. The spectrum of the main problems in the sphere of interests of the transhumanistic worldview is listed. Conclusion. Turning to modernization strategies on the example of transhumanism is a natural and necessary need in the political and legal sphere, in particular. In the course of the analysis, a wide range of problems were identified that actualize the social and axiological and anthropological optics of the research. Diverse forms of transhumanistic political trends act as manifestations of socio-legal reflection on the intensification of innovation- ism, which is capable of radically changing human nature. The current proliferation of restitutive claims in response to expropriation in armed conflicts occurs at the interstices of humanitarianism and transitional justice. Restitution indicates the expansion of the humanitarian mandate from providing immediate relief to those who have suffered loss, to engaging in remedial, redressive and restorative practices. That intersection between the humanitarian goals and post-conflict justice is one of the signs of ‘new’ forms and ethos of humanitarianism. This article offers a critical reading of the ‘restitutive desire’ underpinning the (...) humanitarian restitutive politics, which it relates to political fantasies of reversibility and undoing. It locates the genealogy of restitution in Émile Durkheim’s work on the division of labour, individualization and the distinction between repressive and restitutive law. It argues that in the Durkheimian socio-legal tradition restitution figures as a return of ‘matters to their former status’ and of ‘disturbed relationships to their normal form’. It then turns to Sigmund Freud’s essay on Daniel Schreber, which defines restitution not as procedure of undoing, but as a reparative practice that nevertheless affirms the subject’s ‘catastrophic loss of the world’. The Freudian perspective uncouples restitution and undoing and asks about the possibility of restitutive politics haunted by unrectifiable loss. (shrink)

In gestational surrogacy arrangements, the womb is often figured as a holding environment that brings the child of commissioning parents to fruition but does not shape fetal identity. This article probes the racial imaginary of such a figuration—what I term the “nonracializing womb”—where gestation is seen as peripheral to racial transmission. Drawing on feminist science studies frameworks and data from interviews with parents who commissioned surrogates, this article traces the cultural politics of the nonracializing womb, positioning it as an index (...) for broader understandings of race, reproductive labor, and kinship that hinge on nuclear and biogenetic forms. It then problematizes this figure of gestation by engaging emerging research on environmental epigenetics, which offers a lively model of pregnancy as shaping fetal biology, blurring the lines between surrogate and fetus. I argue that epigenetics offers a resource to reimagine gestation as a racializing process, by theorizing race not as solely genetic, but as relational, socio-environmental, and forged through distributed kinship lineages. Despite a staggering body of research demonstrating sex differences in expressed emotion, very few theoretical models (evolutionary or non-evolutionary) offer a critical examination of the adaptive nature of such differences. From the perspective of a socio-relational framework, emotive behaviors evolved to promote the attraction and aversion of different types of relationships by advertising the two most parsimonious properties ofreciprocity potential, or perceived attractiveness as a prospective social partner. These are the individual's (a)perceived capacityor ability to provide expedient resources, or (...) to inflict immediate harm onto others, and their (b)perceived trustworthinessor probability of actually reciprocating altruism (Vigil 2007). Depending on the unique social demands and relational constraints that each sex evolved, individuals should be sensitive to advertise “capacity” and “trustworthiness” cues through selective displays of dominant versus submissive and masculine versus feminine emotive behaviors, respectively. In this article, I introduce the basic theoretical assumptions and hypotheses of the framework, and show how the models provide a solid scaffold with which to begin to interpret common sex differences in the emotional development literature. I conclude by describing how the framework can be used to predict condition-based and situation-based variation in affect and other forms of expressive behaviors. (shrink)

This monograph investigates the collaborative creation of scientific knowledge in research groups. To do so, I combine philosophical analysis with a first-hand comparative case study of two research groups in experimental science. Qualitative data are gained through observation and interviews, and I combine empirical insights with existing approaches to knowledge creation in philosophy of science and social epistemology. -/- On the basis of my empirically-grounded analysis I make several conceptual contributions. I study scientific collaboration as the interaction of scientists within (...) research groups. Thereby, I argue that research groups and their role in scientific practice deserve more philosophical attention than they have hitherto received. In contemporary natural science, research groups are key to the formulation and corroboration of scientific knowledge claims prior to their publication. Specifically, I suggest epistemic difference and the porosity of social structure as two conceptual leitmotifs in the study of group collaboration. With epistemic difference, I emphasize the value of socio-cognitive heterogeneity in group collaboration. With porosity, I underline the fact that a research group as social structure does not entirely contain the inter-individual efforts necessary to formulate and corroborate knowledge claims. -/- In my analysis of research groups, I focus on the division of epistemic labor among group members. Through their complementary collaborative efforts single scientists engage in relations of mutual epistemic dependence. To deepen philosophy’s understanding of scientific practice in its diversity, a distinction should be made between opaque and translucent epistemic dependence. While opaque epistemic dependence involves asymmetries in expertise, translucent epistemic dependence does not. As epistemic dependence is facilitated by trust, I investigate the dynamics of epistemic trust in group collaboration. Trust among collaborating scientists is inherently incomplete, and I show that scientists make use of diverse strategies to increase and to supplement personal trust. Based on my reflections on trust and dependence, I give an account of the relation between individual knowing and collaboratively created knowledge in research groups. Together these investigations contribute to the discussion of philosophical methodology in the study of scientific practice and promote the use of empirical methods. (shrink)
