This paper focuses on the practical question of how the ideas of John Dewey can contribute to improved intercultural communication theory and practice, especially to training. The question is answered in four parts. The first part refers to the presumed superiority of sensitivity to difference as opposed to similarity in intercultural communication. The second part suggests that Dewey’s duality of potentiality and interaction can be carried over to the duality of competence and performance. The third part highlights the (...) use of the generic concepts of pattern and habit to better understand culture as a practical experience. The final part advocates a closer look at the idea and experience of rhythm as an epistemological alternative to subject vs object. The author relies on his experience as a trainer and a teacher of Intercultural Communication and proceeds down an interdisciplinary path, especially attempting to set up a dialogue with biology, systems and the arts. Ancient Jewish law took a strict approach to medical relationships between Jews and non-Jews. Sages forbade Jews to provide non-Jews with medical services: to treat them, circumcise them, or deliver their babies, in order to refrain from helping pagan-idolatrous society. Such law created particularly severe social conflicts in cases of mixed societies based on joint systems. The current paper focuses on the attitude of Moses ben Maimon, a medieval Sephardic Jewish Rabbi towards providing medical service to gentiles. Following the classical (...) rabbis R. Moshe ben Maimon in his halakhic tome Mishne Torah, objected to treating non-Jews. His rigid attitude found expression in several aspects of helping and giving medical treatment to non-Jews. Despite the classical rabbinical restrictions on medical relationships between Jews and non-Jews, and his own rigid halakhic verdicts, Maimonides treated gentiles. According to one understanding, Maimonides cured Muslims for a wage, which is permitted. However, it seems that the main factor that may have facilitated Maimonides halakhic position is the identification of Islam as a non-idolatrous faith. Interestingly not only on medical issues did the Maimonides act differently than his halakhic rulings in Mishne Torah, rather in other areas as well. (shrink)

In an age of constitutional revolutions and reforms, theory and practice are moving in opposite directions. As a matter of constitutional practice, human dignity has emerged in jurisdictions around the world as the organizing idea of a groundbreaking paradigm. By reconfiguring constitutional norms, institutional structures and legal doctrines, this paradigm transforms human dignity from a mere moral claim into a legal norm that persons have standing to vindicate. As a matter of constitutional theory, however, human dignity (...) remains an enigmatic idea. Some explicate its meaning in abstraction from constitutional practice, while others confine themselves to less exalted ideas. The term ‘identity politics’ is used to refer to a wide range of political movements. In this paper, we look at the theoretical ideas underpinning two strongly, mutually opposed forms of identity politics, and identify some crucial differences between them. We critically compare the identitarian ideology of the New Right with feminist standpoint theory, focusing on two issues: relativism and essentialism. In carrying out this critical comparison we illuminate under-theorized aspects of both new right identitarianism and standpoint theory; (...) demonstrate how the two are distinct; reveal the depth and pervasiveness of the new right ideology’s flaws; and show what a coherent left-wing identity politics could look like. Critics of the organization of industrial work under capitalism have ranged from the “human relations” school to socio‐technical systems theorists and, most vociferously, to advocates of labor process theory (LPT). Their practical influence on management was small as long as production was rolling on and profits rolling in. When competition intensified, however, employers started to question old ideas and, abetted by the needs of new computerized technology, began to broaden jobs, allow workers greater discretion in their performance and involve (...) them in shop floor decision making. LPT, however, has not contributed to this evolution toward more satisfying work. This paper explains why this is so by exploring two major shortcomings of LPT. First and foremost is that LPT has ignored the efficiency of the work process, refusing to acknowledge the legitimacy of a tradeoff between work “goodness” and productivity.As a result, LPT has been unable to propose economically viable alternatives to existing job design and work organization. Second, LPT has identified management's goal in organizing work as gaining control of the process, when, in fact, it has been to make the process as economically efficient as possible. Thus, LPT could not see that, under changed circumstances, management might decentralize control toward the shop floor, if that might promote efficiency. LPT's founder, Harry Braverman, and his disciples believed that it was impossible to reform work under capitalism, but experience shows otherwise. (shrink)

Objectivity can be effectively described as striving for detachment -a capacity to achieve some distance from one's own spontaneous perceptions and convictions, to experimentally adopt perspectives that do not come naturally. Novick's treatment of objectivity satisfies the requirements of objectivity, while on a rhetorical level he rejects the notion as unrealistic. Detachment enables an intellectual, specifically an historian, to operate with self-reflexivity and simultaneously socializes him or her. The ultimate power in a community of detached intellectuals striving for objectivity is (...) a powerful argument. Under Novick's notion of objectivity, the conflict for historians between scholarly integrity and political alliance is unresolvable. Removing neutrality from the definition of objectivity resolves this conflict, enabling historians to strive for detachment and fairness, not disengagement from life. Postmodern disclaimers, such as Novick's on the futility of objectivity, fail, through being overly dismissive, to help us establish criteria for evaluating individual historical accounts. Having objectivity as a goal enables us to establish those criteria. (shrink)

In keeping with an already entrenched paradigm, international trade in tasks exerts upward pressure upon skilled workers’ wages in both home and host countries. Yet certain empirical evidence from intra-European trade shows that sometimes things occur in reverse, that is high skilled workers’ wages in home countries may decline as a result of offshoring, an outcome that looks like an inverse “maquiladora effect”. I try to show that such deviations do not fly in the face of mainstream theory but (...) rather, they reflect the different conditions under which offshoring is performed today as compared to the ones prevailing two decades ago. The current system of international law is experiencing profound transformations. Indeed, the simultaneous processes of globalization combined with the disintegration of international systems of governance and law-making pose complex challenges for legal scholarship. The doctrinal response to these challenges has been theorized within two seemingly contradictory discourses in international law: fragmentation and constitutionalisation. This book takes an innovative approach to international law, viewing the processes of the fragmentation and constitutionalisation as being profoundly interconnected and reflective of each other. Abstract There are two kinds of beliefs. If the ultimate objective is wellbeing (util- ity), the generated beliefs are “practical.” If the ultimate objective is truth, the generated beliefs are “scientific.” This article defends the practical/scientific belief distinction. The proposed distinction has been ignored by standard rational choice theory—as well as by its two major critics, viz., the Tversky/Kahneman program and the Simon/ Gigerenzer program. One ramification of the proposed distinction is clear: agents who make errors with regard to (...) scientific beliefs (e.g., the conjunction fallacy) should not be taken as committing irrationality—because they are most probably engaging the other kind of maximization, the pursuit of wellbeing. This paper critically analyses one of the unexpected results of qualitative research aimed at detecting the presence of unethical business practices in Slovakia. The authors seek to find out why entrepreneurs participating in this research do not take responsibility for the development of business ethics and why, in their primary reflections on unethical practices in the Slovak business environment, have they shifted it almost completely to the State level (1), and whether their attitude is morally justified (2). The main theoretical (...) foundation in the following analysis is the theory of development of business ethics on three levels (micro, mezzo and macro), also known as the “subject-matter of business ethics” approach. The paper discusses attitudes of the research sample, including Slovak entrepreneurs and company representatives, towards the State, and the consecutive critical reflection of their opinions shows that businesspersons tend to give up on their own proactive approach to the development of business ethics and position themselves in the role of an “expectant” instead of a “creator” of ethical standards in society. Furthermore, the paper points out that businesses lack ethical self-reflection in relation to corruption, more precisely, they lack reflection of their place in the corrupt relationship with the State. Given these findings, the paper concludes that an essential basis for the long-term development of business ethics in our country is the establishment of partnerships between the State and business entities, while recognizing the place of nongovernmental democratic institutions. What is the role of political theory in the real world of politics? Opinions have varied about this, ranging from Plato’s arguments for philosopher‐kings to Marx’s relegation of political philosophy to the realms of mere ideology. This paper contrasts the competing claims of intellectualism vs pragmatism in politics. It explores the ends/means relation as one account of how ideas and actions might be connected. This relation is found to be inadequate, and with it the more ambitious claims of intellectualism. (...) This book is a synthetic historiography of present-day international relations theory, a critical analysis of the continuing diversity and complexity of enduring themes through a sustained focus on the analysis of the empirical evidence accumulated by social scientists. Special attention is given to key historical changes in theoretical approaches over the past half-century with full recognition of the contestation over state-based theory, and the changing fortunes of contemporary approaches. I offer two potential diagnoses of the behavioral norms governing post‐truth politics by comparing the view of language, communication, and truth‐telling put forward by David Lewis (extended by game theorists), and John Searle. My first goal is to specify the different ways in which Lewis, and game theorists more generally, in contrast to Searle (in the company of Paul Grice and Jurgen Habermas), go about explaining the normativity of truthfulness within a linguistic community. The main difference is that for Lewis (...) and game theorists, “truthful” signaling follows from an align- ment of interests, and deception follows from mixed motives leading to the calculation that sending false information is better for oneself. Following in the Enlightenment tradition, Searle argues that practical reasoning, which involves mastery of at least one language, requires that actors intend to communicate. This intention includes constraining the content of statements to uphold veracity conditions. After distinguishing between these two accounts, I will artic- ulate the implications for explaining, and even informing actions, constitutive of post‐truth politics. I argue that the strategic view of communication is suffi- cient neither to model everyday conversation nor to reflect a public sphere useful for democratic govern- ment. Both the pedagogy of strategic communication as cheap talk, and its concordance with new digital information technologies, challenge norms of truthful- ness that underlie modern institutions essential to an effective public sphere. Although there is increasing recognition that theory and practice in science are often inseparably intertwined, discussions of scientific controversies often continue to focus on theory, and not practice or methodologies. As a contribution to constructing a framework towards understanding controversies linked to scientific practices, we introduce the notion of borrowed epistemic credibility, to describe the situation in which scientists exploit fallacious similarities between accepted tenets in other fields to garner support for a given position in their (...) own field. Our proposal is based on the analysis of a recent controversy in phylogeography, a biological subdiscipline concerned with the study of the historical causes of variation in genetic diversity within species in concrete biogeographical locations. Through a review of the arguments that support the two conflicting phylogeographic schools, we show that ‘theory’ plays essentially no role as a foundation of the controversy, whereas both sides borrow epistemic credibility from sources such as formal logic, similarity of results to those in other scientific areas, the authority of prominent scientists, or the presumed superiority of quantitative vs. verbal reasoning. Our case study underscores the indivisibility of theory and practice and provide a means to re-examine important philosophical issues such as the meaning of inference, rationality, justification, and objectivity in scientific practice. This paper proposes that the philosophy of Bernard Lonergan can provide insight into the challenge of integrating nursing theory, research and practice. The author discusses Lonergan's work in regard to reflective understanding, authenticity and the human person as a subject of consciously developing unity. This is followed by a discussion of two key elements in Lonergan's work that relate to nursing: the subject–object challenge of nursing inquiry and common sense vs. scientific knowledge. Practical Knowledge Versus Knowledge as Practice The main thesis of this essay is that practice is superior to a "theoretical vs. practical" distinction. In this sense, every sort of knowledge is essentially "practical"; so-called "theoretical" knowledge is an historically overemphasised borderline example of the practical. Based mostly on Wittgenstein's view, I shall gradually refine an opposition between theoretical and practical knowledge by analysing some related dualisms on an active, processual, communicative and applicative concept of knowledge. The paper addresses a contemporary Polish debate on the limits and functions of juristic interpretation of law. After presenting the main theses and features of Jerzy Wróblewski’s clarificative theory of juristic interpretation and Maciej Zieliński’s derivational theory of juristic interpretation, the author critically discusses various arguments used in the debate. Finally, a tentative solution of the controversy, based on the criticism of Zieliński’s conception of legal norm, is proposed. Within anthropology, as elsewhere in the human sciences, there is a tendency to divide knowledge making into two separate poles: conceptual (theory) vs. empirical (ethnography). In Theory Can Be More than It Used to Be, Dominic Boyer, James D. Faubion, and George E. Marcus argue that we need to take a step back from the assumption that we know what theory is to investigate how theory—a matter of concepts, of analytic practice, of medium of value, (...) of professional ideology—operates in anthropology and related fields today. How to interpret and elucidate from a phenomenological perspective the requirement that philosophical theorizing ought to consider the legitimacy or universal validity of ethical principles as well as the diversity of life forms? What could phenomenology say about the distance between the theoretical foundations of ethics and the practical application of its principles? To elucidate these questions, first, we take the characteristics of Habermas’s discourse ethics as reference point to show what Scheler’s material ethics of values consists in and in (...) what sense it rejects both universalism and relativism. Secondly, we present the concepts that articulate the phenomenological foundations of this ethics in order to indicate in what sense “the universal” and “the individual” are taken as complementary. Starting from some questions concerning the problem of the distance between theory and practice raised by this conception, we sketch finally some thematic lines to indicate to what extent it is possible to expect from the material ethics of values to shorten that distance. The article studies philosophical, political, educational program of Marquis de Sade as an attempt to do away with the tradition of Platonic-Christian philosophizing, deconstruct its meaning and form. “Philosophy in the Bedroom” is interpreted as a parody of “Symposium” of Plato, which presents its own Sadian materialist conception as the opposite of Plato's meta-physics. In this context, we prove some essential theses in relation to the historical and philo-sophical significance of the Sadian heritage: 1. Sade creates an original controversy of (...) Plato's dialogue, introducing new Conceptual Personae according to gender and class distinction and complementing theory and practice. 2. The practice enables the transition from erotological discourse to pornographic discourse and transform Platonic idealist seduction as part of Paideia into the pedagogics of the materialistic lechery. 3. The pornographic discourse allows Sade to create a new conceptual apparatus by which an apology for sensual pleasure is op-posed to the ideology of Platonic love. 4. His own utopia/pornotopia of the individual pleasure deconstructing the utopias of the public good of Plato's “Republic” and republicanism of the Enlightenment. 5. Thus Sade tried to make the foundations for a new stage of philosophizing, which would occur after the revolution. (shrink)

Since the emergence of psychology, its relation with religion has been inconsistent. Their different sources and methodologies but common aims made them close or distanced. Today these disciplines acknowledged and learned to benefit from each other. The affect of religion/spirituality on human’s lives raised the attention of psychology and required the integration of these into psychotherapy. In order to approach the psychology-religion relation via the traces of religion within psychotherapy the paper deals with the necessity, the knowledge needed, the principles (...) when integrating religious/spiritual principles and practices into psychotherapy; finally the religious traces in psychotherapy. The paper comprises few Turkish examples together with the huge body of theoretical and practical examples on the topic. These theories and practices should be important examples for Turkey. By addressing the religious traces in psychotherapy the aim of the paper is to show that the cliff between psychology and religion is in fact not that deep.SummaryIt can be argued that psychology and religion have common interests relating the well-being of individuals. There is a huge body of research that emphasizes the implementation and necessity of cultural, religious, spiritual principles in professional psychology. The proprium of these models is to integrate the client’s religious/spiritual sources into therapy. Especially religious clients benefit from therapies that define their treatment goals around their religious views. However, it must be considered that if the disorder has a biological dimension and/or is severe psychopathologic pure religious interventions will not be sufficient. This paper traces the religious/spiritual principles within psychotherapies and shows that the cliff between religion and psychology is not that deep.At different places in the world therapy is done according to western standards. However, determining mental health or disorders according to western criteria might be problematic. In societies in which religious/spiritual life is an essential part of culture, religion plays a crucial role in people’s perception of disease and treatment. In mental health, spirituality is an important and primary source for coping. Empirical studies reveal the positive outcomes of religious practices such as personal prayer, repentance, meditation, and dhikir on mental and physical health. In light of this data it becomes clear that psychotherapies should be revised socio-culturally and culturally sensitive psychotherapies that cover belief and religious practices should be developed. Another need for the integration of religion, belief, and spirituality with psychotherapy is the significant effect of these experiences on individual’s lives. With regard to the broad impact of religion, psychological interventions solely might not be sufficient to fulfill human psychological needs. As studies show, religious clients expect religious practices in treatment as well as a therapist who is open and respectful to religious principles, ready to talk about own religious beliefs, willing to integrate religious matters into therapy. To fulfill these expectations therapists, need to be trained and educated in religious/spiritual matters. Additionally, the therapist must acknowledge and be conscious about her/his own worldview, religious commitment, and spiritual life. However, the therapist needs not to be religious him/herself or share the same religion as the client. It is sufficient that the therapist is open and receptive to the client’s beliefs so that these can be used as effective sources in therapy. Spiritual psychotherapy considers spirituality as one of the main sources of clients. Thus, it might be critical when the therapist has poor knowledge about religion when the client considers it as significant. This source might be helpful for the client in coping with his/her problems and limitations. Having knowledge about the client’s religion and culture might also be important to acknowledge his/her perceptions and beliefs. Because individuals’ understanding of disease, their beliefs about reasons for mental disorders, their expectations from the health system are important factors in seeking help and choosing therapy.Therapists who decide to integrate spiritual/religious principles into psychotherapy have to adhere to some ethical principles. The source and the degree of the psychological disorder are important, too. Even though the efficacy of religious rituals and spiritual interventions are extensive in each case it has to be investigated whether religiosity/spirituality is part of the problem or the solution. Certain aspects will guide the therapist in deciding whether to integrate religiosity/spirituality into the therapy process or not. Additionally, he/she has to gather information about the client’s religious/spiritual life (spiritual anamneses) in order to choose the most appropriate religious method and intervention. Today psychotherapy deals with coping, questions about the meaning, purpose, and way of life. Actually, these are issues with which religious traditions has dealt and proposed solutions for thousands of years ago. For example, ethical principles for mental health professionals correspond to those of religious teachings. The attitudes and the type of relationship recommended by the client-centered approach are also commended by religious teachings for all human relations. Beginning with the 1960’s an increasing interest in Buddhist teachings is observable among psychotherapists. Mental exercises (especially meditation) cause transformations in the self-perception and lead to enduring changes in consciousness. Religions such as Islam, Judaism, and Buddhism recommend meditation technics like contemplation, dhikr, and yoga. Confession in the Catholic Church has similarities with psychotherapeutic catharsis. Many cultures own one kind of forgiveness rituals of confessions. As studies report people benefit from these rituals. Forgiveness is a multifaceted issue with psychological and spiritual dimensions and involves cognitive, emotional, relational, and spiritual processes. Research indicates the religious and psychological functions of forgiveness. Many subjects such as personal prayer, hope, empathy, love, and tolerance are common issues of both, psychotherapy and religion/spirituality. Different psychotherapeutic approaches and especially positive psychology integrate these values that are valued by religion/spirituality into their theories and practices.In conclusion, the cliff between psychology and religion/spirituality is not that deep at it seems at first sight. They have many subjects in common. Individuals turn to religion and spirituality in times of crises. This makes it inevitable to include religion and spirituality into the therapeutic process. Because religions provide ways of coping, hope, and meaning in difficult times. This fact is recognized and accepted abroad and lead to the religious/spiritual psychotherapy movement, which will hopefully an inspiration for Turkish psychology as well. (shrink)

This paper investigates simple syntactic methods for revising prioritized belief bases, that are semantically meaningful in the frameworks of possibility theory and of Spohn''s ordinal conditional functions. Here, revising prioritized belief bases amounts to conditioning a distribution function on interpretations. The input information leading to the revision of a knowledge base can be sure or uncertain. Different types of scales for priorities are allowed: finite vs. infinite, numerical vs. ordinal. Syntactic revision is envisaged here as a process which transforms (...) a prioritized belief bases into a new prioritized belief base, and thus allows a subsequent iteration. (shrink)

The paper considers the possibility of detecting points of contact between Michel Foucault’s theory of power and the theory of communicative agency formed by Jurgen Habermas. In the beginning, the development of the philosophical discourse of modernity, which Habermas analyzes in his work bearing the same title, is laid out, with the aim to gain insight into the nature of Habermas’s critique of Foucault. After having reviewed some of the basis of Foucault’s theory, the author points out (...) Habermas’s depiction of the theory of power as the pinnacle of Nietzschean, anti - modernist stream of the philosophical discourse. The critique is based on Habermas’s assumption that Foucault’s analyses of power fails to comprehend the complexity of modernity. Foucault, according to Habermas, over - emphasizes one dimension of the process of modernization - gradual strengthening of the disciplinatory power based on the "control of the spirit". The author, however, wishes to point out the importance the theory of power ascribes to the preservation of insight into the complexity of history. Through the insight into multiple and divergent nature of historical processes that are responsible for the formation of modern society, the individual becomes historically self - conscious and able to step out of the paradigm of self - relating subject. As the theory of communicative agency also tends to transcend the "limits of the subject - philosophy", the author concludes that Foucault’s work is, to the same extent as Habermas’s, imbued with the idea of "modernity as an unrealized undertaking". Towards the end of the paper the author analyzes Foucault’s relation to Enlightenment, in order to show the essentially modern nature of his thought. (shrink)

Some would conceive philosophy as being divided into Analytic and Continental. This, as John Searle points out, is rather like conceiving America as being divided into Business and Kansas. Searle’s wise saying has not, as yet, received the theoretical attention it deserves. In both cases we have a certain domain, which is conceived as being divided into two parts, one defined in spatial terms, the other defined in terms of objects, practices or features widely spread through some spatial area. The boundaries of the field of communications have been unclear from the beginnings. Somewhere between the liberal arts/humanities and the social sciences, communications exists in a contested space where advocates of different methods and positions have attempted to define the field and police intruders and trespassers. Despite several decades of attempts to define and institutionalize the field of communications, there seems to be no general agreement concerning its subject-matter, method, or institutional home. In different universities, communications is sometimes placed in (...) humanities departments, sometimes in the social sciences, and generally in schools of communications. But the boundaries of the various departments within schools of communications are drawn differently, with the study of mass-mediated communications and culture{0} sometimes housed in Departments of Communication, Radio/Television/Film, Speech Communication, Theater Arts, or Journalism departments. Many of these departments combine study of mass-mediated communication and culture with courses in production, thus further bifurcating the field between academic study and professional training, between theory and practice. In this book, the author shows that it is necessary to enrich the conceptual frame of the theory of rational choice beyond consequentialism. He argues that consequentialism as a general theory of rational action fails and that this does not force us into the dichotomy teleology vs deontology. The unity of practical reason can be saved without consequentialism. In the process, he presents insightful criticism of standard models of action and rational choice. This will help readers discover a (...) new perspective on the theory of rationality. The approach is radical: It transcends the reductive narrowness of instrumental rationality without denying its practical impact. Actions do exist that are outlined in accordance to utility maximizing or even self-interest maximizing. Yet, not all actions are to be understood in these terms. Actions oriented around social roles, for example, cannot count as irrational only because there is no known underlying maximizing heuristic. The concept of bounded rationality tries to embed instrumental rationality into a form of life to highlight limits of our cognitive capabilities and selective perceptions. However, the agent is still left within the realm of cost-benefit-reasoning. The idea of social preferences or meta-preferences cannot encompass the plurality of human actions. According to the author they ignore the plurality of reasons that drive agency. Hence, they coerce agency in fitting into a theory that undermines humanity. His theory of structural rationality acknowledges lifeworld patterns of interaction and meaning. (shrink)

This article studies the underinvestigated but fascinating issue of the sociological determinants of accounting misbehavior while focusing on an allegedly illicit accounting practice (i.e., restatement) in family- vs. nonfamily-controlled corporations. Under the framework of institutional anomie theory, we examined whether sociological structures (i.e., legal forces and cultural values) influence accounting errors inducing restatements. By applying a multivariate regression analysis to a sample of restating firms listed in 23 countries during the 2006 to 2014 period, we found that legal (...) forces and cultural values significantly moderate the severity of accounting errors. The results of this study suggest that investors, managers, and policymakers should more fully consider the sociological structures of societies when debating the feasibility of corporate misbehaviors, as combining firm-level and country-level analyses could help to predict a firm’s accounting misbehaviors, such as more severe accounting errors. At its inception, geoethics was envisioned as a type of professional ethics concerned with the moral implications of geoscientific research, applications, and practices. More recently, however, some scholars have proposed versions of geoethics as public and global ethics. To better understand these developments, this article considers the relationship between geoethics and environmental ethics by exploring different aspects of the human-nature relation (i.e., the moral status and role of humans in relation to the non-human world). We start by noting that the (...) main strains of geoethical thought elaborated so far represent examples of environmental virtue ethics and defend moral weak anthropocentric positions (e.g., “ethical”, “responsible” or “enlightened” anthropocentrism). Some scholars propose that such weak anthropocentric geoethics can synthesize the different positions in environmental ethics and move beyond them toward a novel and distinct approach. We compare the meaning and the use of the term “anthropocentrism” in both environmental ethics and geoethics, stressing that although geoethics is inevitably epistemically anthropocentric (i.e., anthropogenic), it does not need to be morally anthropocentric. We consider the compatibility of non-anthropocentric stances with current geoethical theory and argue for the integration of normative non-anthropocentric accounts (e.g., ecocentric) into geoethical debates and geoscience education. Pediatric oncology has a strong research culture. Most pediatric oncologists are investigators, involved in clinical care as well as research. As a result, a remarkable proportion of children with cancer enrolls in a trial during treatment. This paper discusses the ethical consequences of the unprecedented integration of research and care in pediatric oncology from the perspective of parents and physicians. An empirical ethical approach, combining (1) a narrative review of (primarily) qualitative studies on parents' and physicians' experiences of the pediatric (...) oncology research practice, and (2) comparison of these experiences with existing theoretical ethical concepts about (pediatric) research. The use of empirical evidence enriches these concepts by taking into account the peculiarities that ethical challenges pose in practice. Analysis of the 22 studies reviewed revealed that the integration of research and care has consequences for the informed consent process, the promotion of the child's best interests, and the role of the physician (doctor vs. scientist). True consent to research is difficult to achieve due to the complexity of research protocols, emotional stress and parents' dependency on their child's physician. Parents' role is to promote their child's best interests, also when they are asked to consider enrolling their child in a trial. Parents are almost never in equipoise on trial participation, which leaves them with the agonizing situation of wanting to do what is best for their child, while being fearful of making the wrong decision. Furthermore, a therapeutic misconception endangers correct assessment of participation, making parents inaccurately attribute therapeutic intent to research procedures. Physicians prefer the perspective of a therapist over a researcher. Consequently they may truly believe that in the research setting they promote the child's best interests, which maintains the existence of a therapeutic misconception between them and parents. Due to the integration of research and care, their different ethical perspectives become intertwined in the daily practice of pediatric oncology. Increasing awareness of what this means for the communication between parents and physicians is essential. Future research should focus on efforts that overcome the problems that the synchronicity of research and care evokes. (shrink)

Legal and ethical issues arise for clinicians working with female clients who are survivors of domestic violence and who have children. Statistics indicate that children of 30%-80% of such women are also abused. Disclosure by an abused woman of concurrent child abuse creates an ethical dilemma for the clinician involving adherence to mandatory reporting laws and the ethical duty to protect vs. ethical issues of confidentiality and respect for client autonomy. Potential resolution of this dilemma incorporates core tenets of feminist (...) theory. A hypothetical scenario illustrating the ethical dilemma is provided, and some practical guidelines for its resolution, although not yet empirically tested, are outlined. (shrink)

In the early part of the 20th century the logical positivists launched a powerful attack on traditional philosophy, rejecting the very idea of philosophy as a substantive discipline and replacing it with a practical, conventionalist, meta-theoretical view of philosophy. The positivist critique was based on a series of dichotomies: the analytic vs. the synthetic, the external vs. the internal, the apriori vs. the empirical, the meta-theoretical vs. the object- theoretical, the conventional vs. the factual. Quine's attack on the positivists' dichotomies (...) was, by extension (if not by intention), also an attack on their critique of philosophy. Quine's own theory, however, in time took an extreme naturalistic turn that, if anything, deepened the schism between philosophy and knowledge. -/- In this paper I show that many of Quine's early philosophical ideas - his denial of the analytic-synthetic distinction, his thesis of the interconnectedness of knowledge, his universal revisability thesis, his principle of the inseparability of language and theory, his methodological pragmatism, and his realism - are in fact compatible with a substantive philosophy. Moreover, certain inner tensions in Quine's theory naturally lead to a new model of knowledge in which philosophy plays a substantive role: not as a "first philosophy", or as a "meta-science", or as a "chapter in psychology", but as an independent discipline in its own right, alongside, continuous with, and complementary to, science. Study represents an application of the neutrosophic method, for solving the contradiction between communication and information. In addition, it recourse to an appropriate method of approaching the contradictions: Extensics, as the method and the science of solving the contradictions. The research core is the reality that the scientific research of communication-information relationship has reached a dead end. The bivalent relationship communicationinformation, information-communication has come to be contradictory, and the two concepts to block each other. After the critical examination of conflicting (...) positions expressed by many experts in the field, the extensic and inclusive hypothesis is issued that information is a form of communication. The object of communication is the sending of a message. The message may consist of thoughts, ideas, opinions, feelings, beliefs, facts, information, intelligence or other significational elements. When the message content is primarily informational, communication will become information or intelligence. The arguments of supporting the hypothesis are: a) linguistic (the most important being that there is "communication of information" but not "information of communication"; also, it is clarified and reinforced the over situated referent, that of the communication as a process), b) systemic-procedural (in the communication system is developing an information system; the informing actant is a type of communicator, the information process is a communication process), c) practical (the delimitation eliminates the efforts of disparate and inconsistent understanding of the two concepts), d) epistemological arguments (the possibility of intersubjective thinking of reality is created), linguistic arguments, e) logical and realistic arguments (it is noted the situation that allows to think coherently in a system of concepts - derivative series or integrative groups) f) and arguments from historical experience (the concept of communication has temporal priority, it appears 13 times in Julius Caesar’s writings ). In an axiomatic conclusion, the main arguments are summarized in four axioms: three are based on the pertinent observations of specialists, and the fourth is a relevant application of Florentin Smarandache’s neutrosophic theory. Two welcome extensions of evolutionary thinking have come to prominence over the last thirty years: the so-called ’extended evolutionary synthesis’ (EES) and debate about biological kinds and individuals. These two agendas have, however, remained orthogonal to one another. The EES has mostly restricted itself to widening the explanations of adaptation offered by the preceding ’modern evolutionary synthesis’ by including additional mechanisms of inheritance and variation; while discussion of biological kinds has turned toward philosophical questions of essential vs. contingent properties of (...) life forms and realist vs. epistemological approaches to categorization and classification. Here we attempt to broaden the explanatory scope of evolutionary theory by linking these two agendas. We expand on the mechanistic orientation of the EES, using new understandings of networked systems of components in order to engage the distinct intellectual challenge of the origination of “historical kinds”. With this phrase we designate a subset of natural kinds that acquires, through evolutionary processes, a quasi-independent lineage-history. Such kinds emerge in both biology and culture, and we enlarge the limited number of historical kinds that have thus far been recognized in evolutionary biology in a series of paradigmatic exemplars, from genes and cell types to rituals and music. For each exemplar we discern specific mechanisms by which it arose and persists; comparing these, we suggest a general unity in the ways in which diverse historical kinds originate. (shrink)

BackgroundBetween the need for transparency in healthcare, widely promoted by patient’s safety campaigns, and the fear of negative consequences and malpractice threats, physicians face challenging decisions on whether or not disclosing medical errors to patients and families is a valid option.We aim to assess the knowledge, attitudes and practices (KAP) of physicians in our center regarding medical error disclosure.MethodsThis is a cross-sectional self-administered questionnaire study. The questionnaire was piloted and no major modifications were made.A day-long training workshop consisting of didactic (...) lectures, short and long case scenarios with role playing and feedback from the instructors, were conducted. Physicians who attended these training workshops were invited to complete the questionnaire at the end of the training, and physicians who did not attend any training were sent a copy of the questionnaire to their offices to complete. To assure anonymity and transparency of responses, we did not query names or departments.Descriptive statistics were used to present demographics and KAP. The differences between response\s of physicians who received the training and those who did not were analyzed with t-test and descriptive statistics. The 0.05 level of significance was used as a cutoff measure for statistical significance.ResultsEighty-eight physicians completed the questionnaire (55 attended training (62.50%), and 33 did not (37.50%)). Sixty Five percent of physicians were males and the mean number of years of experience was 16.5 years. Eighty-Seven percent (n = 73) of physicians were more likely to report major harm, compared to minor harm or no harm. Physicians who attended the workshop were more knowledgeable of articles of Jordan’s Law on Medical and Health Liability (66.7% vs 45.5%,p-value = 0.017) and the Law was more likely to affect their decision on error disclosure (61.8% vs 36.4%,p-value = 0.024).ConclusionFormal training workshops on disclosing medical errors have the power to positively influence physicians’ KAP toward disclosing medical errors to patients and possibly promoting a culture of transparency in the health care system. Aesthetic theory distinguishes different approaches to understanding the sensory and logical. The author agrees with I. Kant’s theory that sensory perception is subjective and the imagination is given the opportunity to invent fictional characters that do not exist in real life. Digital technologies make it possible to revive and introduce such characters into an artistic performance. This process becomes possible with the help of computer algorithms that are used to create art practices. There are many contradictory publications where (...) there is no understanding of the technological process of the task at hand, for example, that it is possible to write a program that will “teach machine aesthetics” using pictures. Therefore, the author turns to three technological solutions (virtual reality, augmented reality and artificial intelligence or neural networks) and examines, using the example of existing programs and applications, how the process of interacting computer algorithms of artistic creativity with the imagination and skill of stage work directors (play, opera, choreography). The author solves this issue within the framework of algorithmic aesthetics, which considers the process of communication, but unlike media theory, considers the process of information exchange in binary code. The algorithms by which the written programs operate do not create a “code spirit”, but allow the creation of tools for artistic creativity and the development of the skills of talented people. The article is devoted to the problem of the expert knowledge crisis, which consists in a decrease in public trust in scientific experts, the transformation of the role of experts in making socially significant decisions, escapism or neglect on the part of experts in relation to the society. We believe that in order to resolve the existing confrontation between society and experts, it is necessary to compare the positions of both, and then formulate common grounds that can serve for resolving (...) the conflict. We assign the role of moderator in the practice of resolving this conflict to politicians, who are forced to maneuver between the advice of experts and the opinions of voters, and also take responsibility for the consequences of implementing decisions. Reconstructing the position of experts, we rely primarily on the work of T. Nichols “The Death of Expertise”. We believe that it very clearly articulates the concerns of the scientific community about its current status, role and future fate, as well as the expert community’s understanding of the reasons for the current situation. The position of society is expressed in the works of P. Feyerabend. So, as the first task of our article, we see a comparison of these positions and identification of key points of conflict contradiction. Looking for resolving the conflict contradiction, we rely on the concept of communicative action by J. Habermas and the ideas of the actor-network theory of B. Latour. It is possible to compare all four positions thanks to the analytical approach to the history of philosophy of J. Barnes. An argumentative analysis makes it possible to clearly identify both the basic points of their contradiction and the positions common to all parties, which should form the basis for the search for consensus. Such basic positions are not the assessment of expert or profane knowledge, but the desire by all parties of communication to preserve the democratic structure of society. (shrink)

Adequate assessment of (un)consciousness is not only of theoretical interest but also has a practical and ethical importance, especially when it comes to disorders of consciousness (DOC). Accurately determining the presence or absence of consciousness in patients with DOC allows informed decisions to be made about long-term care support, referral for rehabilitation, pain management and withdrawal of life support. We believe that a theoretical account of what conscious experience is and how it emerges within the brain will advance the search (...) for appropriate neuromarkers of the presence or absence of consciousness in non-communicative brain-damaged patients. The Architecture of Reason aims to develop a unified theory of theoretical and practical rationality along foundationalist lines. The structure of practical reason, Audi argues, is closely parallel to that of theoretical reason: just as the rationality of inferential beliefs ultimately rests on the rationality of basic beliefs, so too the rationality of instrumental desires and of the corresponding actions ultimately rests on the rationality of intrinsic desires. Intrinsic desires are rational if they are well-grounded in certain “objectively valuable” (...) features of experience, much as basic beliefs are justified, and thus rational, if they are well-grounded in certain perceptual or intuitive features of experience. Though Audi’s theory of practical rationality does not strictly require “axiological experientialism”, in point of fact it is “the experientially grounded rationality of intrinsic desire that chiefly concerns [him] in accounting for the foundations of practical reason”. This normative sort of foundationalism, Audi holds, is to be distinguished from merely motivational foundationalism; the latter is compatible with certain instrumental accounts of rationality which view intrinsic desires as ultimate motivational states capable, via appropriate beliefs, of conferring rationality on the actions they motivate without themselves being properly regarded as rational. The normative foundationalism that Audi proposes to defend in opposition to instrumentalism about practical reason holds not only that rational action must ultimately be well-grounded in rational intrinsic desires, but that “there are substantive criteria for the rationality of intrinsic desires”. My aim in this discussion note is to raise some concerns about Audi’s claim to have established a normatively and substantively foundational alternative to instrumentalism, and thus to have provided a unified foundational account of rationality. In closing, I shall also attempt to respond to certain objections Audi has raised against instrumentalism. Much in this wide-ranging book, however, remains untouched by my comments; many of its excellent features would doubtless have been highlighted in the context of a general review. (shrink)

In this article I try to investigate the possible insights one may reach by considering the development on the level of socio-philosophical theories as a symptom of the development taking place on the level of social practice.

Confusion abounds in Jonathan Kramer’s attempt, in “Can Modernism Survive George Rochberg?” , to reply to the issues I raised in my essay “Can the Arts Survive Modernism? ” . Besides the endemic disarray of his thought process, he confutes and contradicts himself at every turn—either out of his own mouth or out of the mouths of those he quotes to support his position. He is incapable of following his own line of argument either because he doesn’t remember in one (...) part of his paper what he’s said in another or because he doesn’t grasp the logical implications of his own statements sufficiently follow through. Thus he constantly cuts the ground out from under his own feet.Some specific illustrations are in order. First, let me deal with how he “thinks.” To write prose we perforce must use words; and when we use words, it behooves us to know what they mean. All too often Kramer appears not to know what key words he uses do mean—but he marches blindly on through his own jungle of tangled thoughts. For instance, when he says, “A far better example of reductionism in musical scholarship than Schenker’s multilayered theory is Rochberg’s own article,” he reveals a total lack of understanding his key word, “reductionism” . “Reductionism” is the distilled or diminished content left after removing, stripping away, all alternative ways of understanding a situation or problem. That, of course, is what Schenker did in promulgating his theory of tonal practice, and it is clear Kramer understands that much. “Reductionism,” however, hardly describes the presentation of an overview of the impact of modernism on the life of the twentieth century which is what my article does. George Rochberg is the composer of a large body of musical works and the author of a recently published collection of essays, The Aesthetics of Survival, a Composer’s View of Twentieth-Century Music. He recently completed his fifth symphony, on commission from the Chicago Symphony. In 1983 he retired from the University of Pennsylvania as Emeritus Annenberg Professor of the Humanities. His previous contribution to Critical Inquiry, “Can the Arts Survive Modernism? ,” appeared in the December 1984 issue. (shrink)

The construct of “choking under pressure” is concerned with the phenomenon of unexpected, sudden, and significant declines in individual athletes’ performances in important situations and has received empirical attention in the field of sport psychology. Although a number of theories about the reasons for the occurrence of choking under pressure exist and several intervention approaches have been developed, underlying mechanisms of choking are still under debate and the effectiveness of existing interventions remains contested. These sudden performance declines also occur in (...) team sport. “Collective sport team collapse,” which describes the situation when an entire sport team underperforms significantly within an important competitive situation, has received less empirical attention, in comparison to individual choking research. While there are a few studies that have investigated causes of collective team collapse, understandably, there has been limited empirical investigation of preventative and intervention strategies. Although the two constructs appear to share several similar characteristics and mechanisms, research has not yet examined the conceptual, theoretical, empirical, and practical links between choking under pressure and collective sport team collapse. In this review article, we seek to examine these similarities and differences and identify new ways of thinking about future interventions. Furthermore, current empirical understandings in the field of choking under pressure and collective sport team collapse are presented and the most effective intervention approaches for both constructs are introduced. On the basis of this examination, we modestly make some initial recommendations for sport psychological practitioners and future research. (shrink)
