This article studies the underinvestigated but fascinating issue of the sociological determinants of accounting misbehavior while focusing on an allegedly illicit accounting practice (i.e., restatement) in family- vs. nonfamily-controlled corporations. Under the framework of institutional anomie theory, we examined whether sociological structures (i.e., legal forces and cultural values) influence accounting errors inducing restatements. By applying a multivariate regression analysis to a sample of restating firms listed in 23 countries during the 2006 to 2014 period, we found that legal forces and (...) cultural values significantly moderate the severity of accounting errors. The results of this study suggest that investors, managers, and policymakers should more fully consider the sociological structures of societies when debating the feasibility of corporate misbehaviors, as combining firm-level and country-level analyses could help to predict a firm’s accounting misbehaviors, such as more severe accounting errors. In the 1950s, long before his ascent to international renown, Michel Foucault published a scant few works. His early writings on psychology, psychopathology, and anthropology have been dismissed as immature. However, recently discovered manuscripts from the mid-1950s, when Foucault was a lecturer at the University of Lille, testify to the significance of the work that the philosopher produced in the years leading up to the “archaeological” project he launched with History of Madness. Elisabetta Basso offers a groundbreaking and in-depth (...) analysis of Foucault’s Lille manuscripts that sheds new light on the origins of his philosophical project. She considers the epistemological style and methodology of these writings as well as their philosophical context and the scholarly networks in which Foucault was active, foregrounding his relationship to existential psychiatry. Young Foucault blurs the boundaries between biography and theory, exploring the transformations—and, at times, contradictions—that characterize the intellectual trajectory of a philosopher who, as Foucault himself put it, “turned to psychology, and from psychology to history.” Retracing the first steps of the philosopher’s intellectual journey, Basso shows how Foucault’s early writings provide key insights into his archaeological work of the 1960s. The distinction between concept and conception has been widely debated in political philosophy, whereas in the philosophy of psychology is frequently used, but rarely focused on. This paper aims at filling in this lacuna. I claim that far from being explanatorily idle, the distinction makes it possible to provide an adequate description of phenomena such as genuine disagreement, and concept contestation, which would otherwise remain implausibly puzzling. I illustrate and assess three accounts of the concept-conception distinction. Finally I propose a (...) social externalist account, which relies on deference to experts, and builds on Tyler Burge’s ideas of many decades ago. The debate on concepts and conceptions thus shows a connection with the increasing research work on experts and expertise in psychology and social epistemology. (shrink)

We understand our lives through narratives, and the form of these narratives is appropriate for understanding the actions of others, writes MacIntyre (1981). Meanwhile, narratives and our understanding of them also inform our understanding of our own actions. In this article, student kindergarten teachers share anecdotes from their teaching practice assignments. These preservice teachers (PSTs) relay stories that are serious and important from a child’s perspective, and which they themselves experienced as serious and important while spending time with children and (...) listening to children’s voices. Our aim here is to give even very young children a voice in their own everyday lives and to discuss how PSTs might listen more closely to what children are saying. Our narrative analysis of stories (Van Manen, 1997, 2014; Clandinin, 2013) offered by Norwegian and Italian PSTs presents a range of perspectives on life management and a desire for conversation in children aged 2–8 years. The stories are told through the student kindergarten teachers’ voices, and they were shared with and reflected upon with the children’s in-service class teachers. The article sheds retrospective light on children’s telling of, and thinking about, stories. (shrink)

De ce fait, on peut affirmer que, en dépit des clivages et des divergences, le commerce équitable participe à la définition d'un espace public d'envergure internationale autour des questions de la consommation et des modes d'organisation du commerce international. La deuxième partie pose la question de savoir dans quelle mesure les impacts générés à la fois sur le marché conventionnel et sur le développement du sud du monde ont du sens pour l'avenir.The practices of fair trade described in this article show how this movement has been able to create links between citizens with shared concerns in the southern and northern hemispheres in the 40 years it has existed. In this way, we are able to affirm that despite certain differences and divisions, fair trade has contributed towards the definition of international public discussion on question such as consumption and the organization of international trade. The first part of this article aims to clarify the technical process and the values underpinning this civic movement through a description of its practices. The second part aims to assess the extent to which the impact fair trade has had on conventional trade and on local development in the southern hemisphere indicates a direction for the future. Taking a detour to reach a goal is intelligent behavior based on making inferences. The main purpose of the present research is to show how such apparently complex behavior can emerge from basic mechanisms such as contextual categorisation and goal attribution when perceiving people. We presentacacia (Action by Contextually Automated Categorising Interactive Agents), a computer model implemented using StarLogo software, grounded in the principles of Artificial Life (Al), capable of simulating the behavior of a group of agents with a goal (...) (for instance, to find a treasure in a treasure hunt ) in an environment where obstacles mask the goal site. The results of the simulations show that agents reach the goal the fastest when they follow each other and take detours. We argue that these results indicate that intelligent adaptive behavior is based on the contextual categorisation of environmental constrainst (that is, obstacles and other agents). (shrink)

Numerous studies suggest that both emotion knowledge and language abilities are powerfully related to young children’s theory of mind. Nonetheless, the magnitude and direction of the associations between language, emotion knowledge, and theory-of-mind performance in the first years of life are still debated. Hence, the aim of this study was to assess the direct effects of emotion knowledge and language on theory-of-mind scores in 2- and 3-year-old children. A sample of 139 children, aged between 24 and 47 months ( M (...) = 35.5 months; SD = 6.73), were directly administered measures of emotion knowledge, theory of mind, and language. We conducted structural equation modeling (SEM) to evaluate the effects of these variables within a single comprehensive framework, while also controlling for any effects of age and gender. The proposed structural equation model provided an excellent fit for the data, indicating that both children’s emotion knowledge, and their language ability had direct positive effects on theory of mind scores. In addition, age was found to wield statistically significant effects on all the variables under study, whereas gender was not significantly associated with any of them. These findings suggest the importance of fostering young children’s emotion knowledge and language ability with a view to enhancing their comprehension of mental states. (shrink)

Critics of clinical artificial intelligence (AI) suggest that the technology is ethically harmful because it may lead to the dehumanization of the doctor–patient relationship (DPR) by eliminating moral empathy, which is viewed as a distinctively human trait. The benefits of clinical empathy—that is, moral empathy applied in the clinical context—are widely praised, but this praise is often unquestioning and lacks context. In this article, I will argue that criticisms of clinical AI based on appeals to empathy are misplaced. As psychological (...) and philosophical research has shown, empathy leads to certain types of biased reasoning and choices. These biases of empathy consistently impact the DPR. Empathy may lead to partial judgments and asymmetric DPRs, as well as disparities in the treatment of patients, undermining respect for patient autonomy and equality. Engineers should consider the flaws of empathy when designing affective artificial systems in the future. The nature of sympathy and compassion (i.e., displaying emotional concern while maintaining some balanced distance) has been defended by some ethicists as more beneficial than perspective-taking in the clinical context. However, these claims do not seem to have impacted the AI debate. Thus, this article will also argue that if machines are programmed for affective behavior, they should also be given some ethical scaffolding. (shrink)

In this paper I focus on the emergence of the concept of the “historical a priori” at the origin of Foucault’s archeology. I emphasize the methodological function of this concept within Foucault’s archaeology, and I maintain that despite the different thesis it entails as compared to its philosophical sources, it pertains to one of the main issues of phenomenology, that is, the problematization of the relation between reality as it appears in its historicity, and transcendentality. I start from the interest (...) of the young Foucault in existential psychiatry, and I focus on the French philosophical context in which Foucault’s Introduction to Ludwig Binswanger’s “Dream and Existence” (1954) was conceived. My aim is to show that the first “phenomenological” phase of Foucault’s work is coherent, from a methodological point of view, with the development of archaeology intended as “historical epistemology.” I conclude by arguing that Foucault’s archaeology is methodologically linked to Canguilhem’s epistemology, in that the latter presents itself as an important attempt at linking together historicity and transcendentality. There is a lot of conceptual engineering going on in medical research. I substantiate this claim with two examples, the medical debate about cancer classification and about obesity as a disease I also argue that the proper target of conceptual engineering in medical research are experts’ conceptions. These are explicitly written down in documents and guidelines, and they bear on research and policies. In the second part of the chapter, I propose an externalist framework in which conceptions have both the (...) explanatory power of psychological concepts and that of semantic concepts. It is likely, however, that human activities and practices distinct from medical research, and regulated by different practices and epistemic rules, call for different targets for conceptual engineering. I conclude with indicating an open agenda of problems for philosophers of medicine interested in conceptual engineering. (shrink)

This paper is based on the archives of Michel Foucault collected (since 2013) at the manuscripts department of the Bibliothèque nationale de France, Paris. Our investigation focuses in particular on the documents of the 1950s, in order to study the role of the reflection on anthropology and phenomenology at the beginning of Foucault’s philosophical path. This archival material allows us to discover the tremendous work that is at the basis of the relatively few works that Foucault published in the 1950s. (...) The access to the 1950s documents enables us at last to investigate the reasons for the seemingly sharp break that divides these works from the works published by Foucault in the 1960s and the 1970s, in which emerges the archaeological refusal of phenomenology and anthropology, as well as the strong criticism against any form of psychopathological discourse. This paper examines an argument by Schaffer (2017) that aims to prove how, contrary to what many philosophers hold, there is no special explanatory gap occurring in the connection between the physical and the phenomenal. This is because a gap of the same kind can be found in every connection between a more fundamental and a less fundamental level of reality. These gaps lurk everywhere in nature. For Schaffer, they can be bridged by means of substantive metaphysical principles such as (...) grounding principles. He thus puts forward a version of grounding-based physicalism, which is supposed to provide this kind of substantive bridge principle. My main contention is as follows: even if Schaffer’s argument indeed proves the existence of a gap in every connection between fundamental and derivative entities, and such gaps can be bridged by means of grounding principles, a different gap remains open in the psycho-physical connection. The institution of “probation,” a form of judicial probation aimed for adults, was rewied by the recent justice reform law (Cartabia Reform, Dec. 30, 2022), where, even in the rewied version, was confirmed its high civic and reeducational value. Through probation, offenders can realize the paths to change own critical reinterpretation of their behavior. This is an interpretation of punishment that preserves its retributive value, but the challenge that institutions and associations take as welcoming these people into the activities and (...) projects of a (re)educational nature, gives this particular penal measure a restorative purpose too. Probation concerns first and foremost the offender, it also verifies the skills, resilience, and responsibility of those it accommodates. With these premises, in 2023 a collaboration between some professors of the Catholic University of the Sacred Heart and the Piacenza Volunteer Service Center led to the realization a training course and later a Research involving the Associations that take in the people on probation. In this paper, the connections between model theory and the theory of infinite permutation groups are used to study the n-existence and the n-uniqueness for n-amalgamation problems of stable theories. We show that, for any n ⩾ 2, there exists a stable theory having -existence and k-uniqueness, for every k ⩽ n, but has neither -existence nor -uniqueness. Based on the empirical findings correlating disgust with conservatism, most disgust scholars have fed arguments for its moral unreliability and concluded with moral condemnation of this emotion. In this paper, I will examine common arguments about whether relying on disgust in the moral domain is to be considered good or bad. I will problematize the suggestion that we are justified in firmly believing that disgust is an ethically «dumb» – or an ethically «smart» – emotion. It rather seems that moral (...) disgust can be rational or irrational, pro-social or anti-social, liberal or conservative depending on the eliciting contexts, and that such case-by-case conclusions rely on additional meta-ethical premises. Summary The aim of this paper is to compare Brechtian theory concerning empathy in theatre and recent studies showing the biological basis of empathy. First of all, a brief summary about the concept of empathy is provided, with particular attention to empathy in Brechtian theatre. Then, a paragraph is dedicated to explain how empathy and emotional involvement are linked to neurobiological mechanisms and body state. In this paper, we describe a framework for studying social agents’ individual decision making, that takes account of the environment and social dynamics. We describe a study in which we explored the efficiency of foraging strategies within a group of individuals faced with a resource-limited environment. We investigated to what extent cooperative and non-cooperative behaviors impacted on the survival rates of a population of individuals. In the experiment presented here, we considered two different types of individuals: selfish individuals who gather (...) energy for their own use, and cooperative individuals who share the energy they gather with others, thus reducing their own individual chances of survival. In order to study the trade-off between non-cooperative and cooperative behaviors in a pseudo-realistic two-dimensional environment, we introduced an agent-based modeling and simulation tool called ACACIA-ES, which simulated local interactions and spatial behavior for large numbers of individuals in complex environments. The main result from our simulation was that a group of cooperative individuals displayed better survival strategies than groups of selfish individuals when faced with a variety of environmental pressures; however, it was very unlikely that such cooperative strategies could resist competition from selfish individuals, if the outcome of past social interactions was memorized, even when a very small group of selfish individuals was introduced. This paper focuses on one of the original moments of the development of the “phenomenological” current of psychiatry, namely, the psychopathological research of Ludwig Binswanger. By means of the clinical and conceptual problem of schizophrenia as it was conceived and developed at the beginning of the twentieth century, I will try to outline and analyze Binswanger’s perspective from a both historical and epistemological point of view. Binswanger’s own way means of approaching and conceiving schizophrenia within the scientific, medical, and psychiatric (...) context of that time will lead us to grasp the epistemological stakes at the origins of his project of reforming psychiatry by means of phenomenology. I will finally attempt to upgrade and update Binswanger’s project in light of the current reappraisal of phenomenology within the ongoing debate on psychopathology engaged by studies in the field of science and philosophy of mind. Italy is in the forefront of forensic neuroscience practice among European nations. In recent years, the country presented two major criminal cases, the Trieste Case in 2009 and the Como Case in 2011, which were the first cases employing neurogenetic and functional neuroimaging methods in European courts. In this paper we will discuss the consequences that an understanding of the neural and genetic determinants of human (mis)behavior will have on law, especially on the Italian legal context. Some claim that such (...) consequences will actually be revolutionary, while others argue that legal doctrine assumptions won’t be undermined by neuroscientific findings. In the first section of the paper, we introduce the general debate and follow with a section devoted to the two Italian cases. In the third and final section, we discuss epistemological and ethical issues regarding Italian neurolaw. We defend a position which diverges from those prevailing in the debate. While negative outcomes and concerns were usually evidenced, we focus on positive changes coming with the new paradigm of interaction between neuroscience and the law. Our view is that these cases are clearly pioneering ones, anticipating what will happen in the courtrooms of the European Union in the whole, in the near future. (shrink)

The investigation aims at analysing the two general notions of mankind and people in two lexicographic reference works on trade and commerce published in London in the 1750s: Rolt’s A New Dictionary of Trade and Commerce (1756) and Postlethwayt’s The Universal Dictionary of Trade and Commerce (1757). An overview of the same notions in universal dictionaries of arts and sciences (cfr. References, Primary Sources), issued before and after ND and UD, will also be of help to define a more general (...) background. Starting from the key words mankind and people, their frequency and relevance in the two dictionaries, the investigation is widened to include related terms (e.g. multiword expressions and language patterns in which mankind and people occur) and semantic categories (e.g. specific contexts of use: social condition, social values, demography, identity and citizenship, etc.). The many entries, cross-references, and the various lexical clusters reveal a complex lexicographic and lexicological network. This network, beyond providing information and contents on specific topics, ultimately emphasises the hierarchical organising principle at the basis of Late Modern British society: in particular, people unfolds into a myriad of ‘entities’. Dictionaries of trade and commerce are plentiful sources of knowledge, from general concepts and notions to more specific contents, but also powerful ideological tools. (shrink)

The paper focuses on two claims widely held in the philosophy of mind, namely, content externalism and phenomenological internalism. The question it addresses is which picture, if any, of the relationship between representational and phenomenal properties makes the conjunction between the two claims tenable. The main thesis of the paper is that the conjunction is tenable only within an account which treats the two kinds of properties as distinct, irreducible and yet related to each other.
