In this article, I derive a weak version of Kant's categorical imperative within an informal game-theoretic framework. More specifically, I argue that Hobbesian agents would choose what I call the weak principle of universalization, if they had to decide on a rule of conflict resolution in an idealized but empirically defensible hypothetical decision situation. The discussion clarifies (i) the rationality requirements imposed on agents, (ii) the empirical conditions assumed to warrant the conclusion, and (iii) the political institutions that are (...) necessary to implement the derived principle. The analysis demonstrates the moral significance of the weak principle of universalization and its epistemic advantage over the categorical imperative. (shrink)

Can Lewisian counterpart theory adequately account for the deliberation involved in universalizing moral judgments? In this paper, the dispute between Shalom Lappin and Yehudah Freunlich over the answer to this question is examined and clarified. Then it is argued that Lappin andFreunlich do not join issue in a way which allows for satisfactory adjudication of their dispute. Specifically, they are unaware of the different models of role projection which each employs. InA Theory of Justice, Rawls claims that “to each according to his threat advantage is not a conception of justice.” Although it may indeed seem intuitively plausible that a principle based on “threat advantage” cannot count as a principle of justice, it is an altogether different matter to explain why this is so. The question is especially pressing if one bears in mind that such a principle of bargaining in fact underlies many institutionally regulated interactions. Moreover, to the extent that (...) morality is thought of as a mechanism for guaranteeing mutual advantage in the resolution of conflicts, it may indeed seem necessary that it reflect the bargaining power of the parties (in order to make sure that it is indeed advantageous for all of them). In fact, there is a prominent tradition of social-contract theories (from Hobbes to Gauthier) that work under this assumption and claim to provide an answer to what justice requires as much as Rawls's theory does. So seen, the burden of proof seems to fall rather on the shoulders of those committed to claim both that morality is a mechanism that works to the advantage of all and that it nevertheless requires neutralizing all differences in bargaining power. Richard Hare described the "ethical fanatic" as an agent who appeared to be able to rationally universalize morally horrendous values by "fanatically" accepting the consequences of those values even if their universalization harmed the original agent. This challenges the project of basing ethics on universalization tests, as advocated by Hare, Immanuel Kant, and others. Hare later argued that fanatics are irrational by appealing to a "principle of prudence," but this violates his meta-principle of not basing fundamental ethical principles (...) upon intuitions which are not themselves shown to be required by reason. This failure is corrected by using the concept of "pragmatic implication" to show that any agent's reliance upon any ethical principle commits her to a higher-ordered principle which justifies commitment to the original principle. This threatens an infinite regress, which can only be closed by a unique meta-principle. It is shown that all possible alternatives to this principle fail to actually end the regress, and all strategies of ignoring the regress also entail practical inconsistency. Hence, ethical universalization tests are not empty; they support unique ethical principles whose content does not depend upon the particular values of actual agents. (shrink)

This paper introduces a referential reading of Kant’s practical project, according to which maxims are made morally permissible by their correspondence to objects, though not the ontic objects of Kant’s theoretical project but deontic objects (what ought to be). It illustrates this model by showing how the content of the Formula of Universal Law might be determined by what our capacity of practical reason can stand in a referential relation to, rather than by facts about what kind of beings we (...) are (viz., uncaused causes). This solves the neglected puzzle of why there are passages in Kant’s works suggesting robust analogies between mathematics and ethics, since to universalize a maxim is to test a priori whether a practical object with that particular content can be constructed. An apparent problem with this hypothesis is that the medium of practical sensibility (feeling) does not play a role analogous to the medium of theoretical sensibility (intuition). In response I distinguish two separate Kantian accounts of mathematical apriority. The thesis that maxim universalization is a species of construction, and thus a priori, turns out to be consistent with the account of apriority that informs Kant’s understanding of actual mathematical practice. Discursive theories of justice have been questioned for putting forward high-level principles that should nevertheless play a role in practical discourses in which the justice of a claim is at stake. Here, I will critically examine and systematize the main tenets in Rawls’s and Habermas’s discursive theories, and will suggest that the principles of justice (Rawls) and universalization (Habermas) can and play the role of mandates of optimalization in real deliberations on justice.

Despite all the attention given to Kant’s universalizability tests, one crucial aspect of Kant’s thought is often overlooked. Attention to this issue, I will argue, helps us resolve two serious problems for Kant’s ethics. Put briefly, the first problem is this: Kant, despite his stated intent to the contrary, doesn’t seem to use universalization in arguing for duties to oneself, and, anyway, it is not at all clear why duties to oneself should be grounded on a procedure that envisions (...) a world in which everyone wills the contrary of those duties. The second, more global problem is that if we follow Barbara Herman in holding that Kantian ethics can provide a structure for moral deliberation, we need an interpretation of the universalization procedure that unproblematically allows it to generate something like prima facie duties to guide that deliberation; but it is not at all clear that we have such an interpretation. I argue here that if we expand our limited way of thinking about universalization, we can solve the first problem and work towards a solution to the second. We can begin by recalling that Kant’s ‘Law of Nature’ formulation (FLN) of the Categorical Imperative obligates us to ‘act as if the maxim of your action were to become by your will a universal law of nature’ (G, 421). Christine Korsgaard claims that Gewirth’s argument for morality fails to demonstrate that there is a categorically binding principle on action because it operates with the assumption that reasons for action are essentially private. This attribution is unfounded and Korsgaard’s own argument for moral obligation, in its appeal to Wittgenstein’s Private Language Argument to establish that reasons for action are essentially public, is misdirected and unnecessary. Gewirth’s attempt to demonstrate a strictly a priori connection between a moral principle and the concept (...) of being an agent as such is essentially Kantian, and recognizing that the Principle of Hypothetical Imperatives is categorically binding requires Kantians to accept that Gewirth’s Principle of Generic Consistency is the supreme practical principle. European Stories is the first book of its kind in any European language. Its authors explore the many different ways 'public intellectuals' have debated Europe - the EU and its periphery - within distinct epistemological, disciplinary, ideological and above all national traditions. The chapters focus on the post-1989 era but with a view to the long history of the 'European idea' and its variants across the continent. To what extent such ideas frame the attitude of European publics is left open. (...) But the authors assume that they matter to the European project as a whole. While the twelve national cases have been selected for the broad range they offer, from founding to non-EU member states, they are not exhaustive as the book is meant to encourage further research. The authors of these chapters are all themselves fully immersed in their respective public spheres although generally not strongly identified with one 'camp' or another. The expected readership is broad and interdisciplinary, ranging from political philosophy, to political science, international relations, history, sociology and the history of ideas. In Minimal Morality, Michael Moehler justifies what he calls the weak principle of universalization as a principle of pure instrumental morality. This article addresses the application of this principle and problems associated with it. Specifically, the article focuses on the principle’s ability to protect the interests of the most vulnerable members of society: agents without primary moral standing, specifically non-human animals; and the weakest members of society, either as a result of their diminished relative bargaining power in certain cases (...) of conflict, or because of their present standing in society, made worse off by historical injustices. Central to the discourse ethics advanced by Jürgen Habermas is a principle of universalization (U) amounting to a dialogical equivalent of Kant's Categorical Imperative. Habermas has proposed that ?U? follows by material implication from two premises: (1) what it means to discuss whether a moral norm ought to be . adopted and (2) what those involved in argumentation must suppose of themselves if they are to consider a consensus they reach as rationally motivated. To date, no satisfactory derivation of (...) ?U? from these two premises has been presented. Thus the present study attempts to show how one can, without begging the question, arrive at ?U? by assuming a suitable explication of these two premises, supplemented with a fairly innocuous assumption about the context of discourse. If the argument is sound, then ?U? brings both deontological and consequentialist intuitions together with a notion of solidarity that requires an intersubjective account of insight. (shrink)

This study explores Nietzsche's views on selfishness and its role within his envisaged “revaluation of values”. Nietzsche advocates selfishness only for the “higher men” those characters who embody human excellence and whom he hopes will replace the person of guilt and ressentiment. Important parts of Nietzsche's mature work can be read as offering approaches to traditional philosophical problems in the spirit of the emerging biological sciences of his day, in particular physiology and evolutionary biology. Particularly striking in this context is (...) his effort to offer explanations in the spirit of these sciences for the emergence of norms of conduct commonly seen as moral. (shrink)

This chapter explores the nature of moral rights by examining their formal structure, their status within morality, and rival theories concerning their content. Moral rights are construed as ones which legal systems ought to embody. As such, it is argued that consideration of the possibility of conflicts between rights and other moral values, and among rights themselves, serves to illuminate issues surrounding their content and moral status.

Confucius, Plato, and Aristotle would agree on three propositions: genuine virtue represents a kind of second nature, a result of education such that patterns of choice become natural and predictable that would not be natural and predictable for the average person; there are patterns of gratification attendant on genuine virtue, that involve deeper values than most of the things that people pursue in life; and because of these, genuine virtue is always in a person's self-interest. The word “gratification” here is (...) deliberately broad. There can be brief periods of satisfaction, with performances that enjoyably are going well; these would amount to refined pleasures. But there also can be an agreeable sense of having come to terms with oneself, with no sense of self-disapproval or keen regret. This can be an important element in happiness. (shrink)

The article actualizes the significance of scholastic encyclopedias for the religious and secular culture of medieval Europe. Their role as a compendium of accumulated knowledge and at the same time ideological synthesis of Christian religious doctrine and scientific achievements, ancient and scholastic traditions, university, and church-monastery intellectual culture is shown. The main attention is paid to the multi-volume Vincent of Beauvais’ work «Speculum Maius» as the most significant work among medieval encyclopedias and its conceptual completion. The extraordinary role of the (...) encyclopedia as a documentary evidence of knowledge, ideas, worldview, mentality of the Western European Middle Ages is proved. The author outlines the principles of codification of «The Great Mirror»; highlights the influence of the Christian-theological context on the content, structure and methods of organizing its material; the relationship of encyclopedic work with the processes of development and rationalization of the religious worldview. The focus is on the universalizing potential of the Christianity concepts, the extraordinary expression of which was the work by Vincent of Beauvais. The aspiration for universality was manifested both in the desire to understand the world as a Whole, created by God-completed omnipresence, and in attempts to base all the accumulated human experience, all kinds of knowledge and life on the principles of the Christian worldview. The encyclopedia is valued as a real «mirror» of an entire era, the medieval reception of Christianity, the history of European science and knowledge. (shrink)

I propose that artworks represent a specific and homogeneous ontological kind, grounded in a common ontological core. I call this common core ‘non-universalizable embodied meaning’, and I argue that this common core explains how artworks unfold their ontological identity at the physical, intentional, and social levels on the basis of an original and irreducible mode of material embodiment and cultural emergence; this common core functions as the constitutive rule of art and institutes an axiological normativity, that is, normativity based on (...) aesthetic value; it has a central role both in the theoretical definition of art and in the identification, recognition, and fruition of the individual artworks; it enables artistic creativity, historical transformations of art, and the current, multifaceted state of art. This paper aims to advance two claims. First, it aims to show that Hume’s argument against the rationality of induction is sound. However, I claim that the conclusion does not follow merely from the self-defeating attempts to justify the rule of induction, unlike traditional readings of the argument. Rather, the skeptical conclusion must also take into account Hume’s argument that the secret powers that are present in bodies and give rise to sensible qualities are unknowable. The paper’s second aim is (...) to show that Newtonian induction escapes Hume’s secret powers argument, given that it includes a transductive inference, from observable phenomena to the powers present in the ultimate parts of matter. Consequently Hume’s argument against the rationality of induction does not demonstrate the non-rational nature of Newtonian induction. (shrink)

This paper gives two complete and elementary proofs that if the speed of light over closed paths has a universal value c, then it is possible to synchronize clocks in such a way that the one-way speed of light is c. The first proof is an elementary version of a recent proof. The second provides high precision experimental evidence that it is possible to synchronize clocks in such a way that the one-way speed of light has a universal value.
