Epitome V (1621), and consisted of matching an element of area to an element of time, where each was mathematically determined. His treatment of the area depended solely on the geometry of Euclid's Elements, involving only straight-line and circle propositions – so we have to account for his deliberate avoidance of the sophisticated conic-geometry associated with Apollonius. We show also how his proof could have been made watertight according to modern standards, using methods that lay entirely within his power. The (...) greatest innovation, however, occurred in Kepler's fresh formulation of the measure of time. We trace this concept in relation to early astronomy and conclude that Kepler's treatment unexpectedly entailed the assumption that time varied nonuniformly; meanwhile, a geometrical measure provided the independent variable. Even more surprisingly, this approach turns out to be entirely sound when assessed in present-day terms. Kepler himself attributed the cause of the motion of a single planet around the Sun to a set of `physical' suppositions which represented his religious as well as his Copernican convictions; and we have pared to a minimum – down to four – the number he actually required to achieve this. In the Appendix we use modern mathematics to emphasize the simplicity, both geometrical and kinematical, that objectively characterizes the Sun-focused ellipse as an orbit. Meanwhile we highlight the subjective simplicity of Kepler's own techniques (most of them extremely traditional, some newly created). Abstract This chapter addresses the meta-ethical and psychological implications of Murdoch’s epistemic internalism—her claim that moral responsiveness is a condition of reliable and accurate moral evaluations. Part 1 examines Murdoch’s view that moral judgments feature a quasi-experiential phenomenology analogous to that of certain perceptual ones. Focussing on the phenomenology of our perception-based judgments of certain aspectual properties (e.g., pictorial and musical ones) it argues that such judgments support both Murdoch’s analogy and the internalism she takes it to imply. In Part (...) 2 this chapter considers Murdoch’s internalism as a psychological thesis, assessing it in view of several empirical studies of psychopathic subjects. It argues that the psychopath’s distinctive complex of cognitive and motivational deficits supports Murdoch’s conviction that moral judgment and moral motivation are interdependent. Just as Murdoch believed, many of our ordinary, non-pathological moral beliefs seem to be the natural progeny of our responsiveness to other persons, and so inherit the intrinsic power that others have to move us. Physicians’ fear of criminal prosecution for prescribing opioid analgesics is a major reason why many chronic pain patients are having an increasingly difficult time obtaining medically appropriate pain relief. In Ruan v. United States, 142 S. Ct. 2370 (2022), the Supreme Court unanimously vacated two federal convictions under the Controlled Substances Act. The Court held that the government must prove that the defendant knowingly or intentionally acted in an unauthorized manner.

Despite the growing debate about scholarly impact, an analysis of the onto-epistemic grammar underlying impact has remained absent. By taking a different analytical approach to examining impact, we interrogate the concept through the lens of decolonial thought. We offer an empathetic review of the impact scholarship and illuminate the limits of the modern imaginary that circumscribe critiques of impact in the literature, making visible the Eurocentric and provincial horizons of modern reason underlying these critiques and impact in general. Drawing on (...) Śūnyatā ontological perspective, we seek to articulate from modernity imaginary’s edges and suggest imagining and being otherwise. We argue that the question of scholarly impact is intimately structured by and connected to the modern subject’s desire for ontological security. (shrink)

An alternative approach to analyze the nonrelativistic quantum dynamics of a rigid and extended charged particle taking into account the radiation reaction is discussed with detail. Interpretation of the field operators as annihilation and creation ones, theory of perturbations and renormalization are not used. The analysis is carried out in the Heisenberg picture with the electromagnetic field expanded in a complete orthogonal basis set of functions which allows the electromagnetic field to satisfy arbitrary boundary conditions. The corresponding coefficients are the (...) field operators which satisfy the usual commutation relations. A nonlinear equation of motion for the charged particle is obtained. A careful consideration of the quantum effects allows the derivation of a linear equation of motion which is free of both runaway solutions and preacceleration, even for a point charge. Also, the electromagnetic mass, which is defined as the coefficient of the acceleration operator, vanishes for a point particle. However, this does not mean that the results are free of ambiguities which are exhibited and discussed. (shrink)

The origin of marine invertebrate larvae has been an area of controversy in developmental evolution for over a century. Here, we address the question of whether a pelagic “larval” or benthic “adult” morphology originated first in metazoan lineages by testing the hypothesis that particular gene co-option patterns will be associated with the origin of feeding, indirect developing larval forms. Empirical evidence bearing on this hypothesis is derivable from gene expression studies of the sea urchin larval gut of two closely related (...) but differently developing congenerics, Heliocidaris tuberculata (feeding indirect-developing larva) and H. erythrogramma (nonfeeding direct developer), given two subsidiary hypotheses. (1) If larval gut gene expression in H. tuberculata was co-opted from an ancestral adult expression pattern, then the gut expression pattern will remain in adult H. erythrogramma despite its direct development. (2) Genes expressed in the larval gut of H. tuberculata will not have a coordinated expression pattern in H. erythrogramma larvae due to loss of a functional gut. Five structural genes expressed in the invaginating archenteron of H. tuberculata during gastrulation exhibit substantially different expression patterns in H. erythrogramma with only one remaining endoderm specific. Expression of these genes in the adult of H. erythrogramma and larval gut of H. tuberculata, but not in H. erythrogramma larval endoderm, supports the hypothesis that they first played roles in the formation of adult structures and were subsequently recruited into larval ontogeny during the origin and evolution of feeding planktotrophic deuterostome larvae. One of the ways in which a poet may show his quality is by discrimination and originality in his choice of adjectives. Poetry likes to adorn the bare noun; a noun such as ‘the sky’ calls out for an attribute. But in practice the poet has to take care to avoid the cliche. He can seldom write ‘the blue sky’; even ‘the azure sky’ has become trite. He has to search for the epithet which will be both apt and original.

The poet’s words: “A man’s reach should exceed his grasp” are not merely a command of what ought to be , they are a description of what is. Man has always been stretching himself beyond his own measure. He has a sense of the Infinite: Eternity has been set in his heart: he has not been content to look only on the things seen, his gaze has ever been towards the Unseen. Whatever stage of development he may have reached, he (...) seeks for, and strives after, what is above and beyond himself and his world. In science he tries to get behind the phenomenal reality as his senses apprehend it, to the noumenal , mind. In philosophy he endeavours to bring the multiplicity of his experience, outer and inner, into a unity that will evidence itself to his reason as coherent, and not contradictory. In morality he is not content with the customs and standards of the society of which he is a member; but conscious of their inadequacy, he conceives and aspires to realize an ideal adequate to his nature; his ought to be is always challenging his is . This article attempts to map the broad ethical and legal contours of global child health realities. Its interest is in international duties to reduce disparities in the health of children. Specifically, it inquires into loci of collective rights and responsibilities in this context. Clarity on the sources of this responsibility and the nature of such rights will, it is hoped, contribute to enhanced and sustained action to attenuate these inequalities. A review and critique of the current topography of global health (...) ethics is followed by an analysis of international human rights law as it pertains to global health, with a particular focus on the legal dimensions of child health outcomes. Thus grounded, the article seeks to build conceptual synergies between public health ethics and human rights paradigms to underwrite collective action on global child health disparities. (shrink)

The diffusion of technology in the US has taken place in an environment of both regulation and free enterprise. Each has been subject to manipulation by doctors and medical administrators that has fostered unprecedented ethical dilemmas and legal challenges. Understanding these developments and historical precedents may allow a more rational diffusion policy for medical technology in the future.
