The system of clinical ethics committees (CECs) in the United Kingdom is based on goodwill. No formal requirements exist as to constitution, membership, range of expertise or the status of their recommendations. Healthcare professionals are not obliged to use CECs where they exist, nor to follow any advice received. In addition, the make-up of CECs suggests that ethics itself may be under-represented. In most cases, there is one member with a training in ethics – the rest are healthcare professionals or (...) administrators, although a lawyer is generally also included in the membership. This begs the question as whether CECs can ‘do ethics’, as well whether or not they can take seriously the requirements of due process, formal justice and human rights. The growth of knowledge and its effects on the practice of medicine have been issues of philosophical and ethical interest for several decades and will remain so for many years to come. The outline of the present volume was conceived nearly three years ago. In 1987, a conference on this theme was held in Maastricht, the Netherlands, on the occasion of the founding of the European Society for Philosophy of Medicine and Health Care (ESPMH). Most of the chapters of this (...) book are derived from papers presented at that meeting, and for the purpose of editing the book Stuart Spicker, Ph. D., joined two founding members of ESPMH, Henk ten Have and Gerrit Kimsma. The three of them successfully brought together a number of interesting contribu tions to the theme, and ESPMH is grateful and proud to have initiated the production of this volume. The Society intends that annual meetings be held in different European countries on a rotating basis and to publish volumes related to these meetings whenever feasible. In 1988, the second conference was held in Aarhus, Denmark on "Values in Medical Decision Making and Resource Allocation in Health Care". In 1989, a meeting was held in Czestochowa, Poland, on "European Traditions in Philosophy of Medicine. From Brentano to Bieganski". It is hoped that these conferences and the books to be derived from them, will initiate a new European tradition, lasting well into the 21 st century! P. J. (shrink)

The psalmist addresses himself to God and those with whom he shares the land. From this position, principally chosen, he begins to meditate on his heritage.Part II shows that in the (...) corpus of the psalm, v.4bc-10, the theme “heritage” is developed in such a way that God's vicinity appears to be its fundamental value. This transposition makes it possible that the most threatening aspect of our earthly existence comes up: death. The psalmist draws the utmost consequences from God's vicinity. Since there is no limit to the length of God's protection, he is safe even from the Sheol.In Part III then we see that the praying person, carried by his personal growth, expresses in v. 11 the hope for an unassailable happiness of life, also for others. In one form or another an elevated, pleasure-transcending view of love is common, we might say natural. For readers of Latin poetry Catullus is perhaps the most impressive spokesman. In many respects, of course, Catullus is special. His particular values and choice of terminology, in his time and situation, mark him out from his crowd; in the Roman world indeed, ‘whole love’, perhaps rather its utterance, is hard to document before him. But a belief that love is powerful and profound, (...) an important if not the most important thing in life, this is not a rarity. Roman tombstones attest to love and devotion, and myths inherited from Greece enshrine love's power, endurance, and transcendence. (shrink)

In this paper I shall be examining the nature and provenance of what many people state or imply to be a traditional, conventional, even trite figure of speech: the Augustan Elegists' figure of the ‘seruitium amoris’’. It is indeed a very frequent image in the Elegists. As. F. O. Copley says: ‘Of all the figures used by the Roman elegists, probably none is quite so familiar as that of the lover as slave.’’ But frequency does not equal triteness nor traditionality.

Giorgio Agamben defines the sacred man or Homo Sacer as one who is not worthy of sacrifice. Having lost all rights, the person is reduced to the non-human. In modern times, banishment or banning by the law occurs when a state of exception is sanctioned by a totalitarian supremacy that suspends judicial power. The state of exception does not lie within or outside the boundaries of the judicial order, but in a zone of indifference. The state of exception in which (...) the norm is annulled represents the inclusion, which in turn captures the space in which law becomes suspended. Here, I discuss how the authorities in José Saramago's Blindness and The Cave function within the law of exception, confining and defining space, and ultimately marking the Homo Sacer. (shrink)

This review considers Semantic Syntax and Slavic Transformational Syntax particularly in the light of their contributions to the theory of grammar. Semantic Syntax is shown to have a polemical bias against the Aspects model and toward generative semantics. Its editor's position in the constellation of semantic logicians is defined; pro-Chomskian objections to the logical-cognitive semantic theory are advanced. Slavic Transformational Syntax is comprised of essays with a wide range of theoretical stances; the insights of the radical case grammar of James (...) Miller are compared with those of Semantic Syntax. Remarks on deixis by Richard Brecht are discussed in relationship to semantic-logic approaches. Certain similarities of Jakobsonian functionalism and generative semantics are discussed. (shrink)
